SPECIAL MEETING - HUTCHINSON CITY COUNCIL
WEDNESDAY, MARCH 16, 1983
1. CALL TO ORDER
The special meeting was called to order by Mayor DeMeyer at 6:00 P.M., with the
following present: Alderman Mike Carls, Alderman John Mlinar, Alderman Kenneth
Gruenhagen, Alderman Ted Beatty, and Mayor James G. DeMeyer. Also present: City
Administrator Gary D. Plotz and City Engineer Marlow V. Priebe.
2. OLD BUSINESS
(a) DISCUSSION OF FUTURE USE OR EXPANSION OF HUTCHINSON LIQUOR STORE
(REQUESTED BY ALDERMAN KENNETH GRUENHAGEN) (DEFERRED FEBRUARY 22, 1983)
It was reported that approximately four or five years ago the City purchased
property along Highway 7 for the purpose of constructing a new liquor store.
Discussion then followed regarding the need for additional space in the exist-
ing liquor store. Several alternative suggestions were presented by the City
Administrator.
The general consensus of the Council was that it would not be in the best
interest of the City to construct a new liquor store at this time. Alder-
man Carls moved that the City not consider liquor store expansion at the
present time, except to request from the Building Official a report on neces-
sary rewiring and roof repair needed. Motion seconded by Alderman Beatty
and unanimously carried.
(b) DISCUSSION OF SALE OF OLD FIRE STATION (REQUESTED BY ALDERMAN KENNETH
GRUENHAGEN) (DEFERRED FEBRUARY 22, 1983)
After discussion, it was the consensus of the Council that the future of
the old fire station should be referred to the special committee being ap-
pointed to review various city -owned property.
The motion was made by Alderman Carls to refer consideration of the future
of the old fire station to the City's special committee. Motion seconded by
Alderman Mlinar and carried unanimously.
RECESS: Alderman Mlinar moved to recess from 7:00 P.M. to 8:45 P.M. to allow every-
one the opportunity to attend Lenten services. Alderman Gruenhagen seconded
the motion, and it unanimously carried.
(c) DISCUSSION RUENHAALE OF ( DEFERR SUBDIVISION (LOTS 1983) 17) (REQUESTED BY ALDERMAN
KENNETH The Council members discussed the possible sale of several parcels of park
land. It was the recommendation of the Parks and Recreation Board that the

following parcels of existing "miscellaneous" park land could be sold, with
the money to be placed in a Park Dedication Fund:
Block 1, Lot 7 Woller's Subdivision
Block 3, Lots 11 & 12 Selchow- Jorgenson Subdivision
Lot 16 & 17 Park Subdivision
Lot 15 Park Subdivision, except for approx. 390 feet of
the north end of Lot 15
The Board .further recommended to keep that portion of Lot 15, Park Subdi-
vision and Lot 13, Park Subdivision.
After discussion, Alderman Carls moved that the Council proceed with sell-
ing lots 16 and 17 Park Subdivision and the area south of the section line
near the river and along the highway, and lots 11 and 12 Selchow - Jorgenson
Subdivision. Motion seconded by Alderman Beatty. During discussion of
the sale of lots 11 and 12, it was determined that a written agreement
should be obtained prior to a bidding process of the property. Aldermen
Carls and Beatty approved deletion of lots 11 and 12 from the original mo-
tion, and it unanimously carried.
Alderman Beatty made the motion to offer Lots 16 and 17 and the southerly
portion of lot 18 to the abutting property owners who are landlocked prior
to putting the lots up for bids. Motion seconded by Alderman Gruenhagen
and unanimously approved.
City Administrator Plotz reported that lots 11 and 12, lots 16 and 17 and
the area near the river would have appraisals performed by C. R. Pelton`&
Associates.
(d) DISCUSSION OF SALE OF TWO VACANT CITY LOTS (LOTS 11 & 12 OF BLOCK 3,
SELCHOW- JORGENSON SUBDIVISION) (REQUESTED BY ALDERMAN KENNETH GRUENHAGEN)
(DEFERRED FEBRUARY 22, 1983)
There was discussion regarding the sale of the two vacant lots in the
Selchow- Jorgenson Subdivision.
Attorney Neil Jensen will be representing the Jorgenson Conservatorship in
the event the land is sold by the City.
Alderman Carls made the motion to defer action on lots 11 and 12 of Block 3
until the next City Council meeting, after receiving input from the parties
involved. Motion seconded by Alderman Mlinar and carried unanimously.
(e) CONSIDERATION OF STATUS OF HUTCHINSON PUBLIC LIBRARY
It was reported that the estimated cost to repair the public library would
be $26,800.00. Discussion was given to the situation of the library, but
no action was taken.

(f) CONSIDERATION OF STATUS OF HUTCHINSON POLICE DEPARTMENT
Police Chief Dean O'Borsky stated there was a real need for additional space
in the police department. He projected his department needed about 6,000
square feet, not including garage space. He further commented that he was
opposed to adding on a second floor to the existing building or remodeling
the old fire station for his department. He would, however, be in favor
of purchasing the Central District Services building for a police station.
City Administrator Plotz pointed out that the property
Hall would be available, contingent upon a life estate

(j) CONSIDERATION OF SCOPE OF RESPONSIBILITIES FOR FACILITIES COMMITTEE
(DEFERRED FEBRUARY 22, 1983)
Extensive discussion was given to the Facilities Committee, its makeup and
scope of responsibilities.
Alderman Gruenhagen made the motion to refer the following items to the
facilities committee and be in the following order: 1) old fire station,
2) public library, 3) police department, 4) gym facilities, 5) swimming
pool, and 6) City Hall. Motion seconded by Alderman Beatty and failed by
the following vote: Aldermen Gruenhagen and Beatty voted aye and Aldermen
Carls and Mlinar and Mayor DeMeyer voted nay.
It was the consensus of the Council that the appointed committee should
determine the order of priorities in accordance with the amount of money
available.

Alderman Mlinar moved to direct all six of the aforementioned items to
the facilities committee as being Council concerns. Motion seconded by
Alderman Beatty and unanimously approved.
It was moved by Alderman Mlinar that Alderman Carls and Alderman Beatty
be Council representatives on the facilities committee. Motion seconded by
Alderman Gruenhagen and carried unanimously.
Alderman Carls made the motion to direct the facilities committee to feel
free to propose various alternatives to the City Council and not return
with just a single plan. Alderman Beatty seconded the motion, and it unan-
imously carried.
Alderman Beatty moved that September 1, 1983 be established as the dead-
line for the report of alternatives from the facilities committee. Motion
seconded by Alderman Carls and approved unanimously.
Reference was made to an old street right -of -way property located near Red-
man Realty. The City Engineer will research this piece of property and re-
port back to the Council.
The motion was made by Alderman Gruenhagen to sell city -owned property on
Highway 7 (proposed liquor store site) to the highest bidder. Motion sec-
onded by Alderman Beatty. The motion was amended by Alderman Gruenhagen
that the City has the first right of refusal. Alderman Beatty seconded
the amendment. Alderman Gruenhagen further amended the motion to include
this parcel of property in the appraisals to be done. Amendment seconded
by Alderman Beatty and unanimously approved.
Alderman Gruenhagen made the motion that city -owned property on Waller
Drive (Block 1, Lot 7 Waller's Subdivision) be offered to adjoining property
owners. The motion was seconded by Alderman Carls and carried unanimously.
3. NEW BUSINESS
(a) DISCUSSION OF GRAHAM STREET SURFACING IMPROVEMENT (REQUESTED BY MAYOR JAMES
G. DEMEYER)
Mr. Duane Dickey appeared before the Council and requested a letter from the
City addressed to the Veterans Administration stating the project on Graham
Street had met all the requirements for completion. The City Engineer was
not authorized to approve the project inasmuch as the blacktop work was done
and paid for by the developer. Atkinson Blacktop from Litchfield had been
approved by the City Council to put in the surfacing according to the City
plans and specifications. Mr. Dickey also requested a statement to the ef-
fect that the City will maintain the streets.

City Engineer Priebe reported he was not involved with the project on Graham
Street. The Council had accepted the proposal from Mr. Dickey for the work
to be done privately. Therefore, since the Council approved the project and
the work, it would be in their jurisdiction to approve the upkeep of the
streets.
Alderman Beatty made the motion to approve sending a letter of completion
as requested. Motion seconded by Alderman Carls and carried, with Alderman
Gruenhagen abstaining from voting.
4. ADJOURNMENT
Alderman Beatty moved to adjourn the meeting at 10:33 P.M. Alderman Mlinar
seconded the motion, and it carried unanimously.

AND WHEREAS, the Clerk, has notified the Council that such proposed
assessment has been completed and filed in his office for public inspection,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
1. A hearing shall be held on the 24th day of Mme', 1983, in the Council
Chambers at City Hall at 8:00 p.m. to pass upon such proposed assessment and
at such time and place all persons owning property affected by such
assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing on
the proposed assessment to be published once in the official newspaper at
least two weeks prior to the hearing, and he shall state in the notice the
total cost of the improvement. He shall also cause mailed notice to be given
to the owner of each parcel described in the assessment roll not less than two
weeks prior to the hearings.

RE: Parking Assessment for Caroline Anderson
Dear Sirs:
Caroline Anderson recently contacted me concerning the
computation of her parking assessment. bars. Anderson is the
owner and operator of Caroline's Beauty Shop located at 34 b_ain
Street in Hutchinson. ::rs. Anderson resides and homesteads in
the first floor rear portion of that building. Only the front
part of the square footage of the building is actually used
for business purposes. 17hen the assessments were made, we were
not aware of the fact that a part of the square footage used to
compute necessary parking requirements was in actuality home-
stead or non - business square footage. ::rs. Anderson was not
aware that her parking requirements had apparently been computed
incorrectly until she discussed this matter with her financial
representative.
There is a method provided by statute for correcting
errors in special assessments. In order to make such corrections,
a rehearing on the individual special assessment with published
notice and notice to the effected property owner needs to be
held. I would request that this ratter be placed on the council
agenda for consideration on April 26, 1983. If the council is
agreeable, a public hearing could be set at that date and the
cit;7 staff recompute a corrected special assessment during the
interim.

RE: Walt Kelley, special assessment appeal
Dear Gary:
I have recently discussed Walt Kelley's appeal of his
special assessments with Mr. Kelley's attorney Roger Gilmer.
i:r. Gilmer indicates that I,r. Kelley has no philosophical
problems with the parking program as such but feels that his
special assessment is greater than the benefits he receives.
llr. Gilmer points out that less than half of the floor space
in !�r. Ielley's establishment is actually used for or open to
the public. The remainder of the space is used for storage or
food preparation. Iir. Gilmer feels that in the past the city
was quite liberal in reclassifying areas of other establishments
from retail to warehousing. i•ir. Gilmer feels that the matter
could be settled if the city would be willing to reduce its
special assessments by 50%. I feel that if the city would reduce
the assessment by 1/3 there is a strong likelihood that Mr. Kelley
would dismiss his appeal and pay the assessment in one lump sum.
There are several distinct advantages to settling this appeal
at this time. First, it would mean that there is one less court
battle to be fought. Second, settlement of one of the parking
appeals would create favorable publicity. By reports in the
press and by word of mouth news of the settlement would soon
reach the other appellants. Third, a settlement at this time
might create a steam- roller effect, prompting other appellants
to begin serious negotiations for settlement of their appeals.
By showing that the city is willing to compromise on the dollar
figures assessed, the other appellants might be willing to
settle in order to avoid expenses of litigation. I do believe
that a lot of the appellants are taring a "wait and see" attitude

and that settlement of one case might have a domino effect
on the others.
I would like this matter set as an agenda item on Tuesday,
April 25, 19013. I would appreciate it if you could discuss
this matter individually with the council members or have then
contact me personally prior to the meeting. Without breaking
the open meeting law, I think it would be nice to reach some
kind of consensus on this matter on an individual one -to -one
basis before opening it to public debate.

HISTORY
On March 7, 1983, a request was submitted by Miller Properties for a conditional
use permit which would allow the construction of 2 buildings of 2 units and 2

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Miller Properties of Hutchinson, Minnesota has made application to
the City Council for a Conditional Use Permit under Section 6.07, C.5 of
Zoning Ordinance No. 464 to change a Planned Unit Development in Stoney Point
Addition from one building of eight units to two buildings of two units and
two buildings of three units, with the legal description of:
Lots 1, 2, 3, 4 and 5 in Block 1 Stoney Point Addition,
according to the map or plat thereof on file and of record
in the office of the Register of Deeds in and for said County
and State
2. The City Council has considered the recommendation of the Planning
Commission and the effect of the proposed use on health, safety, and welfare
of the occupants of the surrounding lands, existing and anticipated traffic
conditions, and the effect on values of properties in the surrounding area and
the effect of the use on the Comprehensive Plan.
3. The Council has determined that the proposed use will not be
detrimental to the health, safety, or general welfare of the community nor
will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed use is in harmony
with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
CONCLUSION
The application for Conditional Use Permit for the purpose designated is
granted, based upon the findings set forth above.

RESOLUTION GIVING APPROVAL OF PRELIMINARY AND FINAL PLAT
FOR MCDONALD'S SEVENTH ADDITION
WHEREAS, Loretta McDonald of Hutchinson, Minnesota,owner and subdivider of
the land proposed to be platted as MCDonald's Seventh Addition has submitted her
application for approval of preliminary and final plat of said subdivision in the
manner required for platting of land under the Hutchinson Ordinance Code, and all
proceedings have been duly had thereunder, and
WHEREAS, said plat is in all respects consistent with the City Plan and the
regulations and requirements of the Laws of the State of Minnesota and the ordinance
of the City of Hutchinson and
WHEREAS, said plat is situated upon the following described lands in McLeod
County, Minnesota, to -wit:
That part of the Southeast Quarter of the Northeast Quarter of Section 2,

cepted by the City as being in accord and conformity with all ordinances, City plans
and regulations of the City of Hutchinson and the laws of the State of Minnesota.
2. That the City Clerk is hereby directed to file a certified copy of this
resolution in the office of the County Recorder for their use as required by M.S.A.
462.358(3).

On March 29, 1983, an application was submitted by Mr. Larry Sorenson for
a conditional use permit that would allow remodeling, building expansion
and a security fence on his property in an IC -1 zone. A public hearing was
held at the regular meeting of the Planning Commission on April 19, 1983.
There was no one present who objected to the request.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee paid.
2. Notices were mailed to surrounding property owners as well as published
in the Hutchinson Leader on April 7, 1983.
3. The proposal is in conformance with the requirements of a Conditional
Use Permit.
RECOMMENDATION
It is the recommendation of the Planning Commission that the conditional use
permit requested be granted with the stipulation that proposed parking areas
be surfaced by July 1, 1984 and that construction meet flood plain area require-
ments.

RESOLUTION NO. 7374
RESOLUTION GRANTING CONDITIONAL USE PERMIT UNDER
SECTION 6.07, C.5 OF ZONING ORDINANCE N0. 464 TO ALLOW
REMODELING, BUILDING EXPANSION AND SECURITY FENCE IN AN IC -1 ZONE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Mr. Larry Sorenson of Hutchinson, Minnesota has made application to
the City Council for a Conditional Use Permit under Section 6.07, C.5 of
Zoning Ordinance No. 464 to allow remodeling, building expansion and a
security fence on his property in an IC -1 zone, with a common description of
305 Bluff Street, and a legal description of:
That part of Lots 1, 2, 3, 4, 5 and 6, all in Block 18, North
Half of Hutchinson, according to the recorded plat thereof, lying
northeasterly of a line parallel with, and 25.00 feet northeasterly
(as measured at a right angle) from the center line of the main
track of the Minneapolis Industrial Railway Company
2. The City Council has considered the recommendation of the Planning
Commission and the effect of the proposed use on health, safety, and welfare
of the occupants of the surrounding lands, existing and anticipated traffic
conditions, and the effect on values of properties in the surrounding area and
the effect of the use on the Comprehensive Plan.
3. The Council has determined that the proposed use will not be
detrimental to the health, safety, or general welfare of the community nor
will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed use is in harmony
with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
The application for Conditional Use Permit for the purpose designated is
granted, based upon the findings set forth above, with the stipulation that
proposed parking areas be surfaced by July 1, 1984 and that construction meet
flood plain area requirements.

Planning Commission is hereby submitting its finding of fact and recommend-
ation with respect to the aforementioned request for preliminary and final
plat.
HISTORY
On April 1, 1983, John Miller made application to plat a parcel of
property to be known as California Addition. A public hearing was held
at the regular meeting of the Planning Commission on April 19, 1983.
There was no was present who objected to the request.
FINDINGS OF FACT
1. The required application, plat maps and appropriate fee were submitted.
2. Notices were mailed to the surrounding property owners as well as
published in the Hutchinson Leader on April 7, 1983.
3. The Parks and Playground contribution has been met by previous land donation.
4. There being no problems with the plat as submitted, it was considered for
final plat as well.
RECOMMENDATION
It is the recommendation of the Planning Commission that the requested pre-
liminary and final plat be approved as requested.

RESOLUTION GIVING APPROVAL OF PRELIMINARY AND FINAL PLAT
FOR CALIFORNIA ADDITION
WHEREAS, Mr. John Miller of Hutchinson, Minnesota, owner and subdivider of
the land proposed to be platted as California Addition, has submitted his appli-
cation for approval of preliminary and final plat of said subdivision in the man-
ner required for platting of land under the Hutchinson Ordinance Code, and all
proceedings have been duly had thereunder, and
WHEREAS, said plat is in all respects consistent with the City Plan and the
regulations and requirements of the Laws of the State of Minnesota and the ordi-
nance of the City of Hutchinson and
WHEREAS, said plat is situated upon the following described lands in McLeod
County, Minnesota, to -wit;
Tracts B and D of Registered Land Survey No. 15, McLeod County
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
1. That said plat of California Addition is hereby approved and ac c epted by
the City as being in accord and conformity with all ordinances, City plans and reg-
ulations of the City of Hutchinson and the laws of the State of Minnesota.
2. That the City Clerk is hereby directed to file a certified copy of this
resolution in the office of the County Recorder for their use as required by M.S.A.
462.358(3).
BE IT FURTHER RESOLVED THAT such execution of the certification upon said plat
by Mayor and City Clerk, as required, shall be conclusive showing of proper com-
pliance therewith by the subdivider and City officials charged with duties above
described and shall entitle such plat to be placed on record forthwith without fur-
ther formality.

RE: Annexation by Anthony Machtemes
in Sec. 31 -T117N -R29W
If the area proposed for annexation is approved by the City, I recommend the
City include the annexation of that part of Lot 9 of Auditors Plat of the South
Half of Section 30 and the North Half of Section 31, T117N, R29W, not presently
annexed. This recommendation is based on the fact that said part of Lot 9 will
be totally surrounded by the City subsequent to Mr. Machtemes annexation.
I recommend annexation based on the following:
1. Sanitary sewer can be extended to serve part of the area and a lift
station would be feasible to serve the balance of the property.
2. Watermain can be extended to serve the plat, all such lines to be
8" diameter.
3. A portion of the area can be served through the City storm sewer
system. The balance of the area should be served by extending
service from County Ditch No. 18, inasmuch as, the property is in
County Ditch No. 18 water shed district. A portion of the area will
be required to have rear yard perforated drain lines to properly
drain the area.
4. At least 10% of the land will be required to be donated for Parks
and Playground as per the Comprehensive Plan.
As per City Ordinance, the land, when annexed, will be zoned R -2. It is my
opinion, that some portion of this land may be best used for Multiple Dwellings
and would require an R -3 zoning. This should be resolved at the time a
preliminary plat for the total area is submitted. The first plat by Mr.
Machtemes should be for the total tract with some single lot blocks and
designate the park land. Future subdivision of the large lots would be made in
the same manner as other developers have done.

SUBJECT: Recommendation for installation of fence at North Park
The fencing project at North Park was bid to specifi-
cations using 2" mesh, 9 guage wire with a 2 ounce zinc
coating. The fencing also includes 2V line posts on the
10 foot sections, and 2" line posts on the 4 foot sections
with top rail and tension wire.
We received two bids on the project as follows, Crowley
Fence Company for $2,170 installed, and Yardmen Fence Company
for $2,148.
We have worked with the Yardmen Fence Company, and
would recommend accepting their low bid of $2,148 for the
completion of the project.

At the April meeting of the Parks & Recreation Board, Richard Schmidtbauer
presented his plans for the development South of Century Avenue, which
included a three acre park.
Mr. Schmidtbauer proposed that the park board name the park to coincide
with the name of the development. The board unanimously approved the name
of 'Orchard Park" at the suggestion of Mr. Schmidtbauer.

It is recommended that the City consider improvements to all of the unimproved
streets in an area bounded on the North by Sth Ave. S.W., on the South by T.H.
15, on the West by Lynn Road and on the East by Main Street. These
improvements should be scheduled for completion in 1984, however, if hearings
are completed in ample time, the costs could be included in the 1983 bond issue
and some work completed on same in 1983.
It is, also, recommended the City consider assessment for maintenance of all
streets at a fixed cost per year, based on the typofastreet and said

assessment should be for each year of a four (4) year
Type A streets should be exempt for two (2) years, Type B streets for three (3)
years and Type C streets should be exempt for four (4) years after the latest
construction, and the property owner would only be assessed part of the four
(4) year period accordingly. The fixed cost is as follows:
Temporary Surfaced Street - $1.00 /front foot /year
Bituminous Base Street - $0.40 /front foot /year
Bituminous Wear Street - $0.20 /front foot /year
The attached resolutions should be adopted to begin the process.
It is anticipated cost reports could be submitted for review by May 10th and
hearings could be scheduled for May 31st for the improvement and June 1st for
the maintenance.

The special assessment appeals in the above captioned -
matter have been pending for a considerable amount of time.
Bill Haas, attorney for the appellants, and I have been
conducting negotiations and we appear to have reached a satis-
factory settlement. All three appellants have paid the first
installment of the special assessment. In exchange for their
dismissal of the appeal, the city mould accept this payment
as full and co plete settlement for their special assessments.
You may be aware that all three appellants assert that they
receive little or no benefits from the project since the
drainage that they have naturally flows into a county drainage
ditch.
I have discussed this .-ratter with :arlow Priebe and he
has no objections to settling this ;natter on this basis. I
an enclosing for your inspection a copy of a stipulation which
has been agreed to by all appellants and if acceptable to the
city council, should be signed by the :layor and the City Clerk.
I am also enclosing a copy of a proposed order which would
settle the court case through a mutually agreed upon dismissal.
I would request that this matter be set as a council agenda
item on Tuesday, April 26, 1983.

during 1982 in the amount of $2,283.82 is an amount substantially equal
to but not greater than the benefits said Plaintiff has received from
the completion of Project 81 -10 Section C and that payment of said
amount shall constitute full, final, and complete payment for assess-
ments levied or certified thereunder. It is acknowledged by the parties
and reuresented to this Court that the actual Plaintiffs in this matter
is Kahle's Furniture & Carpet of Hutch., Inc., and that said Roger F.
Kahle is acting in behalf of said corporation and taxpayer.
4. That the McLeod County Auditor is berebv enjoined from
collecting from respective Plaintiffs any amount of tax certified for
the year 1983 or subsequent years as a result of special assessments
levied against respective Plaintiffs for work done under Project 81 -1n
Section C.
5. That the Plaintiffs' actions in this proceeding are hereby
dismissed with prejudice.

SUBJECT: 1983 Roller Skating
The Civic Arena is currently being prepared for the 1983 Roller
Skating season. Each season we normally contract with the Cokato rink
for their skates and music. However, they have informed us they will
be closing and will not be able to continue our summer operation as
scheduled. They have offered to rent us their skates and music for
the entire season at a cost of $2,000.
We have not yet seen the effect the new roller rink (Minnesota Fun)
will have on our attendance, however, we feel our schedule can be
adjusted so as not to conflict with their schedule. We are recommend-
ing to change our schedule to Monday and Thursday evenings rather than
Tuesday and Thursdays. Minnesota Fun has private parties on Monday
evenings and adult skates on Thursday evenings.
In order to continue with roller skating, we will need to rent the
skates from Cokato,but feel we will cover the costs from the skate
rental. Also we plan on offering a special "season pass" this year
which should help with attendance and the pass will also encourage
family participation.

SENIOR ADVISORY BOARD
JANUARY 14, 1983
The meeting of the Senior Advisory Board was called to order by
Chairman Haukos at 2:00 p.m. January 14 (postponed from December 16, 1982).

The minutes of the meeting of October 13, 1982, were approved.
Lil Erickson, new Senior Center Aide, was introduced. She has joined
the staff through the Green Thumb Program.
Staff reports were given summarizing activities both planned and completed.
The Board discussed the possibility of a "one year anniversary" event.
After review of the activities already occurring regularly as part
of the Center's programs, it was decided that another party or open house
event would not be the best way of commemorating one year of operation.
Rather, it was decided that a letter from the Board should be written
"To the Editor" of the Hutchinson Leader noting the past year's program
in a positive light. John Longley was designated as the Board member
to write the letter in the name of the Board.
Chairman Haukos indicated that future Board meetings would be called
as the need arose to discuss specific matters or update policies.
At this time, no date was established for another meeting.
Meeting adjourned at 3:30 p.m.

MINUTES
AIRPORT ZONING BOARD
THURSDAY, MARCH 24, 1983
The meeting was called to order by City Administrator Gary Plotz at
7:46 P.M., with the following members present: Don Pankake, Jerold Wright,
Norbert Shimek, George Quast, Doug Hedin and LeRoy Olson. Members absent:
Melvin Sprengler and David Huser.
City Administrator Plotz explained that the first item of business was
to nominate a ninth member of the board to replace former chairwoman, Kay
Peterson. Discussion followed. A motion was made by Mr. Wright to nominate
Mr. Robert Carney as the Board chairman. The motion was seconded by Mr.
Pankake. After a brief discussion, the motion carried unanimously.
City Administrator Plotz read item B2 from the memo dated March 15,
1983, which called for an informational meeting for both Board members and
property owners affected by the Zoning Ordinance under consideration.
Consultant Ray Strege of Toltz, King, Duvall, Anderson & Associates, Inc.,
will be present at the meeting to answer any questions. After discussion, it
was the consensus of the Board that the informational meeting be held on
Thursday, April 14, at 7:30 P.M. in the council chambers at City Hall.
It was the consensus of the Board that the property owners affected by
the Zoning Ordinance should be contacted personally by Board members before
the informational meeting to explain the Zoning Ordinance as drawn up and to
invite them to the meeting on April 14. Mr. Wright commented that the maps as
drawn might not be accurate as to identification of property owners.
Discussion followed. Board members identified those property owners they
would contact before the April 14 meeting.
Mr. Shimek raised some questions about the content of the Zoning
Ordinance as stated in the preliminary copy. After discussion, it was the
consensus of the Board that questions about the ordinance could best be
answered by the consultant and should be referred to him at the informational
meeting.
Mr. Pankake moved to adjourn the meeting. Seconded by Mr. Wright, the
motion carried unanimously. The meeting was adjourned at 9:10 P.M.

HUTCHINSON PLANNING COMMISSION
TUESDAY, MARCH 15, 1983
1. CALL TO ORDER
The regular meeting of the Hutchinson Planning Commission was called to
order by Vice Chairman Roland Ebent at 7:35 P.M. with the following
members present: Dr. Thomas Lyke, Jim Johnson, Don Erickson, Ted Beatty,
Elsa Young and Vice Chairman Ebent. Chairman Larry Romo arrived at 7:55
P.M. Also present: City Engineer Marlow Priebe, Fire Marshal George
Field, City Attorney Jim Schaefer and City Administrator Gary Plotz.
2. MINUTES
The minutes of the regular meeting dated Tuesday, February 15, 1983, were
approved on a motion by Elsa Young. Seconded by Jim Johnson, the motion
carried unanimously.
3. PUBLIC HEARINGS
(a) CONTINUATION OF PUBLIC HEARING FOR CONDITIONAL USE PERMIT AS
SUBMITTED BY MR. GEORGE THELEN
Vice - Chariman Ebent asked for comments from the floor. Mr George
Thelen and Mr. Jerry Tilden were present to show site plan as revised
after the requested survey had been completed.
Mr. Beatty moved to close the Public Hearing at 7:40 P.M. Seconded
by Mr. Johnson, the motion carried unanimously.
Mr. Beatty moved to recommend to the City Council approval of the
conditional use permit as requested. Seconded by Mrs. Young, the
motion carried unanimously.
(b) CONTINUATION OF PUBLIC HEARING FOR VARIANCE AS SUBMITTED BY MR.
GEORGE THELEN
No action was taken as the survey prompted a new variance request
(Item 3c).
(c) CONSIDERATION OF REQUEST FOR VARIANCE AS SUBMITTED BY MR. GEORGE
THELEN
Vice - Chairman Ebent opened the hearing at 7:43 P.M.
After discussion, Mr. Johnson moved to close the hearing at 7:45 P.M.
Seconded by Mr. Beatty, the motion carried unanimously.
Mr. Erickson made a motion to recommend approval of the requested
variance provided staff recommendations are met. (Staff interprets
that the 101.5' average depth and 114' width meets parcel size
requirements. All blacktopped area must meet city requirements for
blacktopped parking lots. Staff recommends that the city draft
easement to alley as shown on the site plan.) Seconded by Mr.
Beatty, the motion carried unanimously.
(d) CONSIDERATION OF REQUEST FOR ZONING RECLASSIFICATION SUBMITTED BY MR.
LARRY SORENSON
Vice - Chairman Ebent opened the Public Hearing at 7:46 P.M. with the
reading of publication 11 3025.
Mr. Sorenson was present to explain that he plans to do some
remodeling of his business located at 305 Bluff Street that requires
industrial zoning. Staff noted that most of the property surrounding
the site is now zoned IC -1.
Mr. Beatty made a motion to close the hearing at 8:49 P.M. Seconded
by Mr. Erickson, the motion carried unanimously.
Mr. Johnson moved to recommend to the City Council approval of the
request for rezoning. Seconded by Mr. Beatty, the motion carried
unanimously.
4. OLD BUSINESS
(a) A letter sent to City Administrator Plotz concerning a temporary
variance granted allowing placement of a moblie home was discussed.
It was the consensus of the Commission that the State will not
approve such a variance. Mr. Erickson recommended that a notice be
sent to all mobile home owners so they are aware of the State's
position.
(b) REVIEW OF PRELIMINARY PLAT SUBMITTED BY DENNIS ALBERTSON
The preliminary plat under consideration had been presented earlier.
City Staff objected to the multiple references to the word "oak" in
the plat name and for proposed streets. Upon recommendation from the
Planning Commission and City Council, the County also recommended
name changes. The new name, "Wood View Acres" and proposed street
names were acceptable to the City staff.
Mr. Beatty moved to recommend approval to the City Council. Seconded
by Mr. Erickson, the motion carried unanimously.
(c) ANNUAL REVIEW OF COMPREHENSIVE PLAN
City Engineer Marlow Priebe reviewed the City Comprehensive Plan.
Possible future developments were explained. Questions from the
Planning Commission members were answered.
Mr. Beatty moved to advise the City Council that the Planning
Commission had reviewed and accepted the Comprehensive Plan as
presented by Mr. Priebe. Seconded by Mr. Ebent, the motion carried
unanimously.

5. NEW BUSINESS
(a) PLANNING SLIDE PRESENTATION

City Administrator Plotz introduced the first of four slide
presentations on city planning commissions prepared by the State
Department of Urban and City Development. After viewing the
presentation, a short discussion was held.

MINUTES
Tree Board
March 15, 1983
Senior Citizens Center
Members Present: Roy Johnsen, Mrs. Axel Jensen, Ivan Larson and Mike Carls.
Special Guest: Jim Schaefer, City Attorney
ARV Suit
Jim Schaefer gave an update on the Anderson River Valley Law suit now
pending in preliminary pretrial. Jim is working with a Mr. Fritz Brown
who is defense attorney in the suit representing the City of Hutchinson's
Insurance Company. The city has answered all of the interrogatories from
the law firm representing ARV and the city has also sent some interroga-
tories to them. No formal response has been received from them as of yet.
Jim stated he felt the basis for the law suit against the city was to reach
some form of compromise for ARV in order that they may have their $25,000
performance bond returned to them.
Another matter discussed was the status of Snyder Tree Service and the
$2,500 over - payment to them in the summer of 1981. After hearing from
Mark Schnobrich and his unsuccessful attempt to reach Snyder Tree Service,
Jim said he was going to send one more letter to Snyder requesting res-
titution with the money. If there is no response, he was going to seek
City Council approval to go ahead with a suit against Snyder Tree Service
for the over payed amount. Jim will report on that at a latter date.
Arbor Day, 1983
Board members agreed on a change of date for Arbor Day from May 7th to
April 29th, National Arbor Day, due to conflicts with Mothers Day and
other commitments. Schnobrich stated he was expecting to receive the
trees on May 7th, but would look into trying to get them for the earlier
date. He also stated the reason he picked May 7tb was due to the unpre-
dictablility of April weather. A final date will be decided by the next
meeting.
Tree Inventory
Schnobrich banded out a copy of the tree inventory to each board member and a
breif discussion on it's contents was held. Highlighting the discussion
was the fact that the inventory would be used for planning trimming,
planting and other maintenance programs for years to come. The inventory
would be discussed in more detail at the next board meeting with emphasis
on dead wood tree removal and specie selection for 1984 planting.
As a point of record, some of the statistics from the inventory are listed
below.

Sugar Maple - 1,630 % of total 3.5 %, Norway Maple - 440, % of total .9 %,

PARK & RECREATION ADVISORY BOARD
Wednesday, March 2, 1983
City Hall Auditorium
Members Present
Chairman; Dr. Chernausek, Roy Johnsen, Rollie Jensen, Kathy McGraw and
Mike Carls. Also present were Bruce Ericson and Karen McKay.
Minutes
Rollie Jensen made a motion to approve the minutes. Roy Johnsen seconded
the motion, the board unanimously agreed.
New Recreation Facility
Bruce told the board that the Old Armory had been sold and the money was
placed in a separate fund. The public facilities committee is being formed,
names are being compiled, and there will be a representative from the Park
and Recreation Board on the committee.
sunny's Antiques
Roy Johnsen told the board that he wasn't given a price for the Sunny's An-
tiques building or lot. Mike Carls mentioned that he didn't feel there was
money available to begin new projects, however, a price for the lot and
building will be checked into.
Tartan Park
Tartan Park baseball field was the center of discussion. Bruce showed the
board several possibilities dealing with the creation of a new baseball
field. options include locating it on the softball field at Tartan Park
or at West River Park. The Tartan proposal hinges on the possible future
expansion of the Water /Sewer treatment plant. Bruce was directed to con-
tact the School District and the Legion Ball Club to discuss financing of
such a facility.
City Parks
The city council asked the Park Board to provide a list of park propery that
that they would be willing to give up for sale. The areas of discussion
were several lots on Highway 22, west of 3M, two lots on Jorgenson Street,
near the curve on that street, and an alley near Woller Drive. Roy Johnsen
made a motion to sell Block 1, Lot 7 of Woller's Subdivision, Block 3,
Lots 11 & 12 of the Selchow, Jorgenson_ Subdivision and Lots 16, 17 and part
of Lot 15 Park Subdivision. The north end of Lot 15, west of 314 to be ex-
cluded. Rollie Jensen seconded the motion and the board unanimously agreed.
Miscellaneous
The 1982 Revenue Report was passed out to-the board for their review. Bruce
pointed out that the arena expenditures were okay, but the revenues fell
short.
Adjournment
Dr. Chernausek made a motion to adjourn the meeting at 6:40 p.m., Kathy
McGraw seconded the motion.

SUBJECT Downtown Parking
I have received the request for a report on the three hour parking limit
on lots in the downtown district as well as the question of reserving parking
places for city employees.
In December 1982 Ordinance 18/82 was enacted and placed three hour parking
limits in the downtown business district. The Council decided that a six month
trial period and review would be done. This trial period is over at the end
of June. Prior to the enacting of this three hour parking ordinance several
studies were made, not only by the Police Department, but by others in the
community regarding the need for such parking. At that time decisions were
made based on what was the best judgement of the Council. My feeling is that
those circumstances still exist and that it would behoove the City of Hutchinson
to wait until the six month trial period has elapsed.
With the onset of warmer weather and some changing traffic patterns within
the community, my feeling is that we wait until the trial period ends so that
I may then present to the Council a report and evaluation which fully encompasses
what the problems and potential solutions are. To over react now on the basis
of a few complaints might not be the best way to approach this particular
problem.

$6,414.84 or 43.70 %.
T have reviewed the Municipal State Aid Standards and find that roadway requirements with diagonal parking cannot he
met. 'Therefore, it would not be feasible to consider Franklin Street to be designated as a Municipal State Aid
Street.
The above reports have given credit to Residential Zoned property as in the past. The Commercial Zoned property that
is presently used for residential purposes has a deferred assessment for the additional cost for a 9 ton street.
This, in my opinion, is the only way the City could collect same if the property is converted to commercial use.
The Conunerci.aL Zoned property that is being used commercially has no credit as in the past.
T recommend this area be considered for improvement. If found acceptable, I recommend we hold a hearing on May 10th, •
1983, as follows:

The Minnesota State Building Code has been adopted by Minn. Stat. 16.851 as
a Uniform Building Code applicable throughout the state, and was in full
force and effect as of March 1, 1983. At this time the City should adopt the
State Building Code and the Building Code for the City of Hutchinson. An
ordinance is attached for that purpose.
Also, since we are adopting the new State Building Code, we should consider
adopting the Building Permit Fee Schedule in the attached Ordinance Amending
Section 520 of the 1974 Ordinance Code of the City of Hutchinson. This fee
schedule is taken from Table 3 -A of Chapter 3 of the Uniform Building Code
with minor revisions. This fee schedule is used in neighboring towns and is
also recommended by the State.

AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE
An Ordinance adopting the Minnesota State Building Code; providing for its
administration and enforcement: Regulating the erection, construction,
enlargement, alteration, repair, moving, removal, demolition, conversion,
occupancy, equipment, use, height, area and maintenance of all buildings and /or
structures in the City of Hutchinson: Providing for the issuance of permits
and collection of fees therefore; providing penalties for the violation
thereof: Repealing Ordinance No. 622 of the City of Hutchinson and all other
ordinances and parts of ordinances in conflict therewith.
THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA, DOES ORDAIN:
SECTION 1. Building Code. The Minnesota State Building Code, one copy of
which is on file in the office of the City Clerk, has been adopted by Minn.
Stat. 16.851 (1977)as a uniform building code applicable throughout the state.
Such code is hereby confirmed as the building code of the City of Hutchinson
and incorporated in this ordinance by reference as completely as if set out in
full excepting only Table 3 -A from Chapter 3 of the said Uniform Building Code
and all the appendices to the State Building Code described as "not mandatory"
that are not expressly adopted by this ordinance.
A. The 1980 Edition of the State Building Code and 11 -22 -82 Rules
(Effective 3 -1 -1983) as published in the State Register, adopts by
reference the following codes:
1. 1982 Edition of the Uniform Building Code, identified as "UBC ";

SECTION 2. Organization and Enforcement. The organization of the
Building Department and enforcement of the Code shall be conducted within the
guidelines established by Chapter 2 of the Uniform Building Code 1982 Edition.
(The Code shall be enforced within the incorporated limits of the City, and
extraterritorial limits permitted by Law.)
The Building Department shall be the Building Code Department of the City
of Hutchinson. The Administrative Authority shall be a State Certified
"Building Official" so designated by the Appointing Authority.
The Appointing Authority shall be the City Council of the City of
Hutchinson.
SECTION 3.
A. Permits, Inspections and Fees. The issuance of permits, conductions of
inspections and collection of fees shall be as provided for in Chapter
3 of the Uniform Building Code and Table 3 -A as revised and adopted by
the City of Hutchinson by Ordinance No. is used as a guideline for
a schedule of fees.

B. Surcharge. In additon to the permit fee required by Section 3. A.
above, the applicant shall pay a surcharge in the amount fixed by law.
The amount required by law shall be remitted quarterly to the
Minnesota Department of Administration.
SECTION 4. Violations and Penalties. The penalty described in the Uniform
Building Code, 1982 Edition, Section 205 as amended, shall be in keeping with
Minnesota Statutes 609.031 which provides for a maximum fine of $500 or
imprisonment for 90 days, or both.
SECTION S. Effective Date of Ordinance. This ordinance shall be in full
force and effect from and after its passage and publication.

ORDINANCE AMENDING SECTION 520 OF THE 1974 ORDINANCE CODE OF THE CITY OF
HUTCHINSON, ENTITLED BUILDING PERMIT FEES
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION 1. Section 520:05 of the 1981 Ordinance Code of the City of
Hutchinson, entitled Building Permit Fees, is hereby amended to read as follows:
Section 520:00. Building Permit Fees
Subd. 1. A fee for each building permit shall be paid to the Clerk as set
forth in the table in Section 520:05.
Subd. 2. The determination of value or valuation under any of the
provisions of this code shall be made by the Building Official. The
valuation to be used in computing the permit and plan -check fees shall be
the total value of all construction work for which the permit is issued, as
well as all finish work, painting, roofing, electrical, plumbing, heating,
air conditioning, elevators, fire extinguishing systems and any other
permanent work or permanent equipment.
Section 520:05. Schedule of Fees. The following shall be the schedule of
fees for building permits in this municipality:

For moving buildings, the building permit fee shall be:
$15.00 for a dwelling house; $6.00 for a garage, whether attached or
unattached to the dwelling house.
For demolition of buildings, the building permit fee shall be:
$25.00 plus a deposit of $50.00 per day for the first ten (10)
days and $100.00 per day thereafter up to thirty (30) days. Any
permit requested extending over thirty (30) days must be approved and
the deposit set by council.
Section 520:10. Late Payment of Fees. Where work for which a permit is
required by the Building Code is started or proceeded with prior to
obtaining said permit, the fees above specified shall be doubled, but the
payment of such double fee shall not relieve any persons from fully
complying with the requirements of the code in the execution of the work
nor from any other penalties prescribed herein.
Section 520:25. Reinspection Fee. The fee for each reinspection shall be
$10.00.
SECTION 2. Effective Date. This Ordinance shall take effect upon its
passage and publication.

FINDINGS
1. Mr. and Mrs. Gary D. Plotz of Hutchinson, Minnesota has made
application to the City Council for a Conditional Use Permit under Section
6.07, C.5 of Zoning Ordinance No. 464 to allow construction of a doughnut and
fuel store in a C -4 zone, with a legal description of:
Lot 1, Block 1, Hutchinson Mall Addition, Hutchinson, Minnesota
2. The City Council has considered the recommendation of the Planning
Commission and the effect of the proposed use on health, safety, and welfare
of the occupants of the surrounding lands, existing and anticipated traffic
conditions, and the effect on values of properties in the surrounding area and
the effect of the use of the Comprehensive Plan.
3. The Council has determined that the proposed use will not be
detrimental to the health, safety, or general welfare of the community nor
will it cause serious traffic congestion nor hazards, nor will it seriously
depreciate surrounding property values, and the proposed use is in harmony
with the general purpose and intent of the Zoning Ordinance and the
Comprehensive Plan.
CONCLUSION
The application for Conditional Use Permit for the purpose designated is
granted, based upon the findings set forth above.

the directional and private traffic control sign be allowed. It was also

BE IT RESOLVED BY THE CITY COUNCIL OF' THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Mr. and Mrs. Gary D. Plotz of Hutchinson have applied for a variance from

property in the surrounding area and the effect of the proposed variance upon the
Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding prop-
erty, it is possible to use the subject property in such a way that the proposed
variance will not impair an adequate supply of light and air to adjacent property,
unreasonably increase the congestion in the public streets, increase the danger of
fire, endanger the public safety, unreasonably diminish or impair health, safety,
comfort, morals, or in any other aspect be contrary to the intent of the ordinance
and the Comprehensive Plan.
5. The special conditions applying to the structure or land in question are
peculiar to such property or immediately adjoining property and do not apply gen-
erally to other land or structures in the district in which such land is located.
6. The granting of the application is necessary for the preservation and en-
joyment of a substantial property right of the applicant. It will not merely serve
as a convenience to the applicant, but is necessary to alleviate demonstrable hard-
ship or difficulty.
CONCLUSION
The application for variance for the purpose designated is granted based upon
the findings set forth above, with variance(s) for the aggregate signage area be
allowed, the duo -pole sign be allowed and the directional and private traffic control

FOR YOUR INFORMATION
You asked a question about the Good Samaritan Law. I an enclosing the Senate
version and the House version of proposed changes to that law.
The House Bill has an exemption for such individuals as fire fighters,
volunteer police officers, etc., regardless if they are on duty or off duty.
The provision that needs some further looking at in the House Bill is that
it would be a misdemeanor if a citizen did not stop to assist someone even
if in their own mind they nay render more harm than good.
In the Senate Bill, volunteer firemen, etc., would not be exempt if they were
acting in their official capacity as a fireman, etc. The rationale that I
have picked up from the chief Senate author for this change is that because
of the new training for these types of people, it is felt that they should not
be exempt from liability. This feeling was brought forth by the chief author
even though he fully realized that there is a great degree or level of training
for these individuals. It is his feeling that there should perhaps be proper
liability insurance or responsibility by the governing authority such as the
City, County, Township, etc.
I am leaning towards the language in the House File — absent the provision
' that it would be a misdemeanor if you did not assist someone. .
