REGULAR MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, JULY 26, 1983
1. The meeting was called to order by Mayor DeMeyer at 7:30 P.M., with the follow-
ing present: Alderman Mike Carls, Alderman John Mlinar, Alderman Kenneth Gruen -
hagen, Alderman Ted Beatty, and Mayor James G. DeMeyer. Also present: Assistant
City Clerk Kenneth B. Merrill, City Engineer Marlow V. Priebe, and City Attorney`
James Schaefer.
2. INVOCATION
The invocation was given by the Reverend Eldon Albin.
3. MINUTES
The minutes of the regular meeting of July 12, 1983 were approved as presented,
upon motion by Alderman Mlinar, seconded by Alderman Beatty and carried unani-
mously.

5. COMMUNICATIONS, REQUESTS AND PETITIONS
(a) CONSIDERATION OF REQUEST BY T. L. SCALAWAGS FOR A DANCE PERMIT AND LICENSE
TO SELL "ON SALE" NON- INTOXICATING MALT LIQUOR ON AUGUST 14, 1983
A representative for T. L. Scalwags reported he had been advised by the
Police Department to obtain a 3.2 beer license to sell on the parking lot
during the time a dance was conducted at T. L. Scalawags.
Following discussion, it was moved by Alderman Mlinar to approve the appli-
cations contingent upon a written acceptance by the Police Department and
that the request meet the standards of the Fire Marshal and fire codes.
Motion seconded by Alderman Carls and approved unanimously.
6. RESOLUTIONS AND ORDINANCES
(a) ORDINANCE NO. 11/83 - AN ORDINANCE PROHIBITING PEDDLERS OR SOLICITORS FROM
ENTERING UPON CERTAIN PREMISES WITHIN THE CITY OF HUTCHINSON, MINNESOTA AND

After discussion, Alderman Gruenhagen moved to waive second reading and
adopt Ordinance No. 667. The motion was seconded by Alderman Beatty and
unanimously carried.

Following discussion, the motion was made by Alderman Beatty, seconded by
Alderman Mlinar, to defer action. Motion unanimously approved.
(c) ORDINANCE NO. 13/83 - ORDINANCE AMENDING SECTION 710 :00 OF THE 1974 ORDINANCE
CODE OF THE CITY OF HUTCHINSON, ENTITLED ONE WAY TRAFFIC
The City Attorney commented that the wording for Subdivisions 3 and 4 of
Ordinance No. 13/83 had been slightly revised for easier understanding.
After discussion, it was moved by Alderman Beatty, seconded by Alderman
Carls, to waive the first reading and set second reading of Ordinance No.`
13/83 for August 9, 1983. Motion carried unanimously.
(d) ORDINANCE NO. 14/83 - AN ORDINANCE GRANTING TO HUTCH AGRI -TECH THE RIGHT TO
MAINTAIN A STRUCTURE UPON CERTAIN CITY OWNED RIGHT OF WAYS IN THE CITY OF
HUTCHINSON, STATE OF MINNESOTA
It was reported that a portion of a structure belonging to Hutch Agri -Tech
extends onto City right -of -way. Therefore, it would be necessary for the
City to grant a franchise authorizing the right to maintain a structure upon
the City owned right -of -way for a 20 year period.
Following discussion, Alderman Beatty made the motion to waive the first read-
ing of Ordinance No. 14/83 and set second reading for August 9, 1983. Motion
seconded by Alderman Carls and approved unanimously.
(e) RESOLUTION NO. 7457 - RESOLUTION FOR PURCHASE
After discussion, the motion was made by Alderman Beatty, seconded by Alder-
man Carls, to waive reading and adopt Resolution No. 7457. Motion unanimously
carried.
(f) ORDINANCE NO. 15/83 - AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES
AND OTHER VEHICLES ON CERTAIN STREETS OF THE CITY OF HUTCHINSON, MINNESOTA
AND PROVIDING PENALTY FOR VIOLATION THEREOF
It was pointed out that the wording "abutting the west 75 feet of Lot 10 in
Block 13, South Half City" should read "east 75 feet."
Following discussion, it was moved by Alderman Beatty to waive the first read-
ing of Ordinance No. 15/83 as amended and set the second reading for August 9,
1983. Motion seconded by Alderman Mlinar and approved unanimously.

(a) CONSIDERATION OF AWARDING BID FOR 1983 IMPROVEMENT BONDS
Mr. Bill Fahey of Ehlers & Associates reviewed the five bids received this
afternoon and recommended Dain Bosworth, Inc. as low bidder at $474,937.50,
with a net interest rate of 8.0497 %, for the 1983 improvement bonds.
After discussion, Alderman Gruenhagen moved to approve and waive reading
and adopt Resolution No. 7462. Motion seconded by Alderman Mlinar and
unanimously carried.
Alderman Beatty made the motion that the affidavits were approved and ordered
on file in the office of the City Administrator. Motion seconded by Alder-
man Mlinar and approved unanimously.

(b) CONSIDERATION OF AWARDING BID FOR PROJECT 83 -01 -16 (DEFERRED JUNE 14, 1983)
City Engineer Priebe reported on the bids received for Project 83- 01 -16.
He recommended awarding the contract to Aero Asphalt, Inc. in the amount
of $75,455.00.
It was moved by Alderman Beatty, seconded by Alderman Gruenhagen, to approve
awarding the contract to Aero Asphalt and to waive reading and adopt Resolu-
tion No. 7455. Motion unanimously approved.
(c) CONSIDERATION OF PARKING LOT LAYOUT FOR MASONIC TEMPLE SITE
(DEFERRED JUNE 14, 1983)
The four proposed plans for the Masonic Temple parking lot were discussed.
It was determined to amend plan "A" for 50 parking spaces.
Alderman Beatty moved to approve plan "A" as amended to save the ash tree,
two -foot bush, and two spruce trees in the northeast corner of
the parking lot, for a total of 50 parking spaces. The motion was seconded
by Alderman Mlinar and carried, with roll call vote of Aldermen Gruenhagen,
Beatty, Carls and Mlinar voting aye and the Chair abstaining from voting.
(d) CONSIDERATION OF REQUEST FROM CITIZENS BANK FOR BEAUTIFICATION ON FIRST
AVENUE SOUTHWEST (DEFERRED JULY 12, 1983)
This item was withdrawn from the agenda.
(e) CONSIDERATION OF AWARDING BID(S) FOR GROUP LIFE AND ACCIDENTAL DEATH AND
DISMEMBERMENT, LONG -TERM DISABILITY AND DENTAL INSURANCE
(DEFERRED JULY 19, 1983)
Mr. Dwight Tange of Risk Control, Inc. summarized the bids received for
group insurance. It was his recommendation to award the following: 1) group
life insurance to Minnesota Mutual Life Insurance Company for one year; 2)
long -term disability to Schools Insurance Fund, underwritten by Fireman's'
Fund Insurance Company with Phil Stewart Insurance Agency of Albert Lea as
agent of record,for one year; and 3) group dental insurance to Bob Martin
and Associates of Minneapolis, underwritten by Canada Life Insurance Com-
pany, for one year.
Following discussion, upon motion by Alderman Beatty it was moved to award
the group insurance bids as recommended by insurance consultant Dwight Tange.
Motion seconded by Alderman Carls and carried unanimously.
(f) CONSIDERATION OF STREET MAINTENANCE PROGRAM, PROJECT 83 -07

City Engineer Priebe reported on the projected assessment for the street
maintenance.program of project 83 -07. A lengthy discussion followed re-
garding justification for the assessments and the benefits received. Ref-
erence was made to the City of Bloomington, which utilizes an assessment
program.
The motion was made by Alderman Beatty to approve the project and order
preparation of the assessment roll based on the following recommendations:
1) reduce all highway frontages to 10C per front foot with the exception of
those properties on Highway 22 between Washington and Fair Avenue; 2) reduce
the assessments on gravel surface streets to 501� per foot; 3) reduce the
maximum front footage on A, B and C streets to 100 foot residential lot;
and 4) the cul de sacs be assessed so that the total cost of the cul de sac
divided by the number of lots in that cul de sac would be paid on the lot
by lot basis rather than a front foot basis; contingent upon a report from
the City Attorney regarding definitions of the City Charter vs. improvement
vs. maintenance. Motion seconded by Alderman Carls and carried with roll
call vote of Aldermen Gruenhagen, Beatty, Carls and Mayor DeMeyer voting
aye and Alderman Mlinar voting nay.
RECESS: Alderman Carls moved to adjourn for a five - minute recess at 9:40 P.M. Mo-
tion seconded by Alderman Gruenhagen and carried unanimously. The meeting
reconvened at 9:45 P.M.
(g) CONSIDERATION OF JOHN MCLAUGHLIN PROPERTY
City Attorney Schaefer requested authorization to seek bids for the removal
of a structure located on the John McLaughlin property. He indicated the
bid advertisement should be subject to rejection of any and all bids and
that the bidder would be required to hold the bid(s) open for at least 30
days. The City would be able to obtain any necessary court approval to re-
move the structure in that amount of time.
After discussion, Alderman Beatty moved to approve and call for bids. Mo-
tion seconded by Alderman Gruenhagen and approved unanimously.
(h) PRESENTATION BY CITY ATTORNEY CONCERNING APPRAISALS FOR PARKING ASSESSMENT
SETTLEMENT
The City Attorney requested to defer this matter to the next Council meeting.
Upon motion by Alderman Beatty, seconded by Alderman Mlinar, it was approved
to defer action to the next Council meeting. Motion unanimously carried..
9. NEW BUSINESS
(a) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
No one was present to request an extension of the payment period. It was

moved by Alderman Beatty, seconded by Alderman Mlinar, to authorize dis-
continuation of service as recommended by City staff, unless otherwise
stated. Motion approved unanimously.
(b) CONSIDERATION OF REQUEST FOR HUTCHINSON FIRE MARSHALL TO INSPECT MCLEOD
COUNTY JAIL
Sheriff Kopesky requested approval from the City Council to allow the Hutch-
inson Fire Marshall to inspect the McLeod County Jail.on a quarterly basis.
The local fire department official had a conflict of interest and could not
perform the required inspection.
Following discussion, it was moved by Alderman Gruenhagen to approve the .
request, with the inspection to be performed on City time, and the City of
Hutchinson to bill McLeod County for the Fire Marshall's services. Alder-
man Mlinar seconded the motion and unanimously approved.
(c) CONSIDERATION OF REQUEST BY HUTCHINSON AMBASSADORS FOR FOOD CONCESSIONS
STAND PERMIT IN LIBRARY SQUARE PARK FOR ARTS AND CRAFTS FESTIVAL
After discussion, the motion was made by Alderman Mlinar, seconded by Ald-
erman Beatty, to approve a food concession stand. Motion carried unanimously.
(d) CONSIDERATION OF APPLICATION FOR GAMBLING DEVICES LICENSE AND BINGO LICENSE
BY ELKS CLUB
The Elks Club submitted applications for gambling devices and bingo licenses,
with the request to waive the bonding requirement and to run bingo at the
McLeod County Fair in addition to the Club site. It was the recommendation
of Sgt. John Gregor to waive the bonding requirement and to require a separ-
ate bingo license for the McLeod County Fair Grounds.
Following discussion, Alderman Beatty moved to approve the licenses as out-
lined in the requests and based on the statements from Sgt. Gregor. Motion
seconded by Alderman Gruenhagen and approved unanimously.
(e) CONSIDERATION OF HANDICAP SIGN ON NORTHWEST SIDE OF BUILDING AT 101 PARK
PLACE
After discussion, the motion was made by Alderman Carls to approve two han-
dicap signs at 101 Park Place. Alderman Beatty seconded the motion, and it
unanimously carried.
(f) CONSIDERATION OF PRELIMINARY GRANT APPLICATION FOR FORMER "ANTIQUE SHOP"
SITE (WESELOH PROPERTY)
Parks and Recreation Director Ericson requested permission to submit a pre-
liminary application through LAWCON for acquisition of the Weseloh property.
The total cost of the property would be $26,000.

Following discussion, Alderman Mlinar moved to approve that the City pro-
ceed with grant application for the former antique shop site. Motion sec-
onded by Alderman Beatty and carried unanimously.
It was moved by Alderman Beatty, seconded by Alderman Mlinar, to waive read-
ing and adopt Resolution No. 7463. Motion unanimously approved.
(g) CONSIDERATION OF PRELIMINARY GRANT APPLICATION FOR DEVELOPMENT OF BASS
POND AREA
Director Ericson reported the bass pond area was being considered for swim-
ming and ice skating. He requested authorization to submit a preliminary
grant application for its development, at an estimated cost of $353,000.
After discussion, the motion was made by Alderman Gruenhagen, seconded by
Alderman Beatty, to authorize City staff to submit a grant application.
Motion unanimously carried.
Alderman Beatty moved to waive reading and adopt Resolution No. 7464. Motion
seconded by Alderman Gruenhagen and approved unanimously.

(k) CONSIDERATION OF REQUEST FOR VARIANCE AS SUBMITTED BY EUGENE HAVELKA WITH
UNFAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Mr. Eugene Havelka appeared before the Council to appeal the recommendation
of the Planning Commission. He presented a drawing of the proposed layout
for construction of a garage. Alderman Beatty stated the Planning Commission
could not find a hardship to require a variance, and therefore, denied the
request.

(m) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT AS SUBMITTED BY PURE
CULTURE PRODUCTS WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION,
WITH CONTINGENCIES.
Pure Culture Products requested a conditional use permit to allow the instal-
lation of a product storage tank at 35 Adams Street North. The Planning Com-
mission recommended approval, contingent upon approval from the DNR and a
statement from the PCA indicating emissions were acceptable.
After discussion, Alderman Gruenhagen moved that with the recommendation of
the Planning Commission, to approve the conditional use permit and to waive
reading and adopt Resolution No. 7459, contingent upon approval from the DNR
and a statement from the PCA. Motion seconded by Alderman Beatty and approved
unanimously.
(n) CONSIDERATION OF REQUEST FOR VARIANCE AS SUBMITTED BY GEORGE THELEN WITH
UNFAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Mr. George Thelen requested a variance to amend a previous variance. It was
the recommendation of the Planning Commission to deny the variance.
Alderman Beatty moved to uphold the Planning Commission's recommendation and
deny the request for a variance. Motion seconded by Alderman Mlinar and
carried unanimously.
(o) CONSIDERATION OF REQUEST FOR PRELIMINARY AND FINAL PLAT FOR MAC'S BLUFF
ADDITION AS SUBMITTED BY ANTHONY MACHTEMES
City Engineer Priebe presented a proposed plan for Mac's Bluff Addition.
It was noted that the final plat would be subject to approval of annexation
at the hearing on August 4, 1983.

(p) CONSIDERATION OF REQUEST FOR VARIANCE AS SUBMITTED BY CHARLES MILLER WITH
FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Mr. Charles Miller requested a variance for reduction of the sideyard set-
back to install a below grade swimming pool at 486 Shady Ridge Road.
After discussion, Alderman Beatty moved to approve the variance and waive
reading and adopt Resolution No. 7461. Motion seconded by Alderman Carls.
Upon roll call, Aldermen Beatty and Carls and Mayor DeMeyer voted aye and
Aldermen Gruenhagen and Mlinar voted nay. The Chair deferred the ruling
until the vote could be reviewed by the City Attorney.
(q) CONSIDERATION OF PROPERTY OWNERS COMPLAINT ABOUT DOG KENNEL
City Attorney Schaefer reported on the background regarding the dog kennel
complaint. The owner of the dog kennel was contacted by Officer Bakken and
given one week in which to comply with the City's zoning ordinance. No ac-
tion would be required of the Council at this time. Attorney Schaefer sug-
gested amending the ordinance to better control dog kennels.
Alderman Beatty moved to defer this item until such time as notification
has been received regarding the dog owner and to instruct the City Attorney
to draft an amended ordinance for review at the next Council meeting. Motion
seconded by Alderman Mlinar and carried unanimously.
(r) CONSIDERATION OF MERIT ADJUSTMENTS FOR HOURLY EMPLOYEES
Following discussion, the motion was made by Alderman Mlinar to approve the
merit adjustments for hourly employees. Motion seconded by Alderman Carls
and approved unanimously.
10. MISCELLANEOUS
(a) RESOLUTION OF APPRECIATION FOR ATTORNEY JOHN E. KEEFE
Mayor DeMeyer read Resolution No. 7456 which expressed appreciation for
Attorney John E. Keefe's services as Assistant City Attorney from January
1982 to June 1983.
It was moved by Alderman Beatty, seconded by Alderman Mlinar, to adopt Reso-
lution No. 7456. Motion unanimously carried.

(b) CONSIDERATION OF APPLICATION FOR "ON SALE" NON- INTOXICATING MALT LIQUOR
LICENSE BY HEATWOLE THRESHING ASSOCIATION FOR AUGUST 13, 1983 AT THE CIVIC
ARENA
Sgt. John Gregor reported that in the past no license was issued for "family"
events at the Civic Arena. It was his recommendation to deny the request.
After discussion, Alderman Beatty moved to deny the request for a malt liquor
license at the Civic Arena. Motion seconded by Alderman Carls and approved
unanimously.
(c) COMMUNICATIONS FROM ASSISTANT CITY CLERK
Assistant Clerk Merrill reported the League of Cities had submitted an opin-
ion regarding the use of city funds for a picnic for city employees and mem-
bers of city boards and commissions. Based on the League's letter, the City
could proceed to schedule a picnic. The date of August 24 was selected for
this event.
Mention was made of the levy limit meeting scheduled for August 4. Mr. Mer-
rill reported he planned to attend.
The Council was asked if the Directors would be considered for merit adjust-
ment. No definite decision was reached, but the comment was made that the
increased insurance costs might be taken out of the merit fund.
(d) COMMUNICATIONS FROM MAINTENANCE OPERATIONS DIRECTOR
Director Neumann stated there had been a request to use the City's steamer
and portable box office at a special event to be held this week at the Gopher
Camp Fire. It was his recommendation to require a signed hold harmless agree-
ment.
Following discussion, the motion was made by Alderman Beatty, seconded by
Alderman Mlinar, to approve the use of City equipment and to instruct the
City Attorney to prepare an agreement. Motion carried unanimously.
It was reported by Director Neumann that there was an old over -head exhaust
system in the Bretzke garage. He requested authorization to remove it and
move the system to the street garage.
Alderman Beatty moved to approve the request. Motion seconded by Alderman
Gruenhagen and unanimously approved.
(e) COMMUNICATIONS FROM BUILDING OFFICIAL
Building Official Pittman stated that while he was on vacation, there would
be no one to do inspections the week of August 15. He requested authoriza-
tion for the City Engineer to do inspections in his absence during that
period of time.

Personnel Coordinator Sitz reported that Mark Schnobrich had attended a
library conference in Minneapolis. He received some good information.
(h) COMMUNICATIONS FROM ALDERMAN JOHN MLINAR
Alderman Mlinar suggested scheduling a board of review meeting to allow
commercial establishments to review their commercial rates and /or services
with the City Council and Junker Sanitation.

In response to the notice of the hearing for
improvements to one block and 66 ft on Franklin Street
from second Avenue S.W. to 66ft so of Third Ave. S.W.
We have been at two meetings and objected to
the proposed improvements. As I see it the only one
who would have a need for such an improvement to
the street is the Red 8x1 Store. Those of us living
on the West side of the street certainly do not need
such a street. What is wrong with the curb and gutters
we now have? Also if such a need exsists why only to
a little over one block?
After being given the street between Main and Franklin
on Third Ave which causes us frequent inconvience, an
example being instead of going one block to the Post Office
we now either have to walk'three blocks to get there or
else dodge between the cars in Red Owls parking lqt, I
feel it is only fair to let those who the need to further
their financial interests pay for the improvements if they
so need them and not expect us to pay in order to improve
their interests.

WHEREAS, a resolution of the city council adopted the 12th day of July,
1983, fixed a date for a council hearing on the proposed improvement of storm
sewer from the existing trunk line to the Jr. /Sr. High School property on the
proposed extension of Goebel Street on the DeForest Wagner property,
AND WHEREAS, ten days' published notice of the hearing through two weekly
publications of the required notice was given and the hearing was held thereon
on the 9th day of August, 1983, at which all persons desiring to be heard were
given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
1. Such improvement is hereby ordered as proposed in the council
resolution adopted the 12th day of July, 1983.
2. Marlow V. Priebe is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such
improvement.

I request Council permission to attend the Criminal Justice Course at
the Radisson South, Blomington, MN August 29, 30 and 31. I have attended this
course in other years and find it to be an outstanding presentation. As part
of the $125.00 tuition fee the department receives the 1983 Criminal Code and
Traffic Code, along with the 1983 Selective Minnesota Statute books which we
would otherwise normally purchase. This course is designed for law enforcement
officers, attorneys and judges. It is a fine way of continuing the legal
education which is required not only by State Statutes, but enables me as a
supervisor to better complete my job. I am applying early, as in past years
the class has filled and people have been turned away.

AN ORDINANCE RELATING TO THE LICENSING OF
PEDDLERS, SOLICITORS, AND TRANSIENT MERCHANTS
AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF.
THE CITY COUNCIL OF HUTCHINSON, MINNESOTA ORDAINS:
Section 1. Definitions. When used in this ordinance, the
following terms have the following meanings:
(a) "Peddler" means any person, whether a resident of the
city of Hutchinson or not, who goes from house to house, from place
to place, or from street to street, conveying or transporting goods,
wares or merchandise or offering or exposing the same for sale, or
making sales and delivering articles to purchasers. It does not
include vendors of milk, bakery products, groceries or ice who
distribute their products to regular customers on established-routes.
(b) "Solicitor" means any person, whether a resident of the
city of Hutchinson or not, who goes from house to house, from place
to place, or from street to street, soliciting or taking or
attempting to take orders for sale of goods, wares or merchandise,
including magazines, books, periodicals, or personal property of any
nature whatsoever for future delivery, or for service to be performed
in the future, whether or not such individual has, carries or exposes
for sale a sample of the subject of such order or whether or not
he is collecting advance payments on such orders. Such definition
includes any person who, for himself, or for another person, firm
or corporation, hires, leases, uses or occupies any building, motor
vehicle, trailer, structure, tent, railroad boxcar, boat; hotel
room, lodging house, apartment, shop, or other place within the
city for the primary purpose of exhibiting samples and taking- orders
for future delivery.
(c) "Transient merchant" includes any person, firm or corporation,
whether as owner, agent, consignee, or employee, whether a resident
of the city of Hutchinson or not, who engages in a temporary business
of selling and delivering goods, wares and merchandise within the
city, and who, in furtherance of such purpose, hires, leases, uses or
occupies any building, structure, motor vehicle, trailer, tent,
railroad boxcar, boat, public room in hotels, lodging houses,
apartments, shops, or any street, alley or other place within the
city, for the exhibition and sale of such goods, wares and merchan-
dise, either privately or at public auction, provided that such
definition does not include any person, firm or corporation who,
while occupying such temporary location, does not sell from stock,
but exhibits samples for the purpose of securing orders for future
delivery only. The person, firm or corporation so engaged is
relieved from complying with the provisions of this ordinance
merely by reason of associating temporarily with any local dealer,
trader, merchant, or auctioneer, or by conducting such transient
business in connection with, as a part of, or in the name of any
local dealer, trader, merchant, or auctioneer.
Section 2. Permit Required: It is unlawful for any peddler,
solicitor or transient merchant to engage in any business within
the city of Hutchinson without first obtaining a permit therefor in
compliance with the provisions of this ordinance.
Section 3. Exemptions. The terms of this ordinance do not
include the acts of persons selling personal property at wholesale
to dealers in such articles, nor to newsboys, nor to the acts of
merchants or their employees in delivering goods in the regular
course of business. Nothing contained in this ordinance prohibits
any sale required by statute or by order of any court, or prevents
any person conducting a bona fide auction sale pursuant to law.
Section 4. Application. Applicants for a permit under this
ordinance shall file with the city clerk a sworn application in
writing on a form to be furnished by the city clerk. The application
shall give the following information:
(a) Name and physical description of applicant;
(b) Complete permanent home and local address of the applicant
and, in the case of transient merchants, the local address from
which proposed sales will be made;
(c) A brief description of the nature of the business and the
goods to be sold;
(d) The name and address of the employer, principal or supplier

of the applicant, together with credentials therefrom establishing
the exact relationship,
(e) The length of time for which the right to do business is
desired;
(f) The source of supply of the goods or property proposed to
be sold, or orders taken for the sale thereof, where such goods or
products are located at the time said application is filed, and
the proposed method of delivery;
(g) A recent photograph of the applicant which picture shall
be approximately 2" by 2" showing the head and shoulders of the
applicant in a clear and distinguishing manner;
(h) The names of at least two property owners of McLeod County,
Minnesota, who will certify as to the applicant's good character
and business respectability, or, in lieu of the names of references,
such other available evidence as to the good character and business
responsibility of the applicant as will enable an investigator to
properly evaluate such character and business responsibility;
(i) A statement as to whether or not the applicant has been
convicted of any crime, misdemeanor, or violation of any municipal
ordinance, other than traffic violations, the nature of the offense
and the punishment or penalty assessed therefor;
(j) The last municipalities, not to exceed three, where applicant
carried on business immediately preceding date of application and
the addresses from which such business was conducted in those
municipalities;
(k) At the time of filing the application, a fee of $
shall be paid to the city clerk to cover the cost of investigation
of the facts stated therein.
Section 5• Religious and Charitable Organizations, Exemption.
The provisions of this ordinance shall not apply to any organization,
society, association or corporation desiring to solicit or have
solicited in its name money, donations of money or property, or
financial assistance of any kind or desiring to sell or distribute any
item of literature or merchandise for which a fee is charged or
solicited from persons other than members of such organizations
upon the streets, in office or business buildings, by house to house
canvass, or in public places for a charitable, religious, patriotic
or philanthropic purpose.
Section 6. Investigation and Issuance. (a) Upon receipt of
each application, it shall be referred to the (chief of police),
who shall immediately institute such investigation of the applicants
business and moral character as he deems necessary for the protection
of the public good and shall endorse the application in the manner
prescribed in this section within 72 hours after it has been filed
by the applicant with the clerk.
(b) If as a result of such investigation, the applicant's
character or business responsibility is found to be unsatisfactory,
the chief of police shall endorse on such application his disapproval
and his reasons for the same, and return the application to the
city clerk, who shall notify the applicant that his application is
disapproved and that no permit will be issued.
(c) If as a result of such investigation, the character and
business responsibility of the applicant are found to be satisfactory,
the chief of police shall endorse on the application his approval
and return the application to the city clerk, who shall deliver. -
to the applicant his permit. Such permit shall contain the sign-
ature of the issuing officer and shall show the name, address and
photograph of said permittee, the class of permit issued and the
kinds of goods to be sold thereunder, the date of issuance and the
length of time, not to exceed one year from the date of issuance
that the same shall be operative, as well as the permit number and
other identifying description of any vehicle used in such licensed
business. Each peddler, solicitor, or transient merchant must
secure a personal permit. No permit shall be used at any time by
any person other than the one to whom it is issued. The clerk
shall keep a permanent record of all permits issued.
Section 7. Loud Noises and Speaking Devices. No permittee,
nor any person in his behalf, shall shout, cry out, blow a horn,
ring a bell, or use any sound amplifying device upon any of the
streets, alleys, parks or other public places of the city or
upon private premises where sound of sufficient volume is emitted
or produced therefrom to be capable of being plainly heard upon
the streets, avenues, alleys, parks, or other public places, for
the purpose of attracting attention to any goods, wares or
merchandise which such licenses proposes to sell.

Section 8. Use of Sreets No permittee shall have any
exclusive right to any location in the public streets, nor shall
any be permitted a stationary location thereon, nor shall any be
permitted to operate in a congested area where such operation
might impede or inconvenience the public use of such streets.
For the purpose of this ordinance, the judgment of a police officer,
exercised in good faith, shall be deemed conclusive as to whether
the area is congested and the public impeded or inconvenienced.
Section 9• Exhibition of Perit. Permittees are required to
exhibit their permit at the request of any citizen.
Section 10. Duty of Police to Enforce. It shall be the duty
of the police of the city of Hutchinson to require any person seen
peddling, soliciting or canvassing and who is not known by such
officer to have obtained a permit hereunder to produce his permit
and to enforce the provisions of this ordinance against any
person found to be violating the same.
Section 11. Records. The chief of police shall report to
the city clerk all convictions for violation of this ordinance and
the city clerk shall maintain a record for each permit issued and
record the reports of violation therein.
Section 12. Revocation of License. (a) Permits issued under
the provisions of this ordinance may be revoked by the council of
the city of Hutchinson after notice and hearing, for any of the
following causes:
(1) Fraud, misrepresentation, or incorrect statement contained
in the application for permit;
(2) Fraud, misrepresentation or incorrect statement made in
the course of carrying on his business as solicitor, canvasser,
peddler, transient merchant, itinerant merchant or itinerant vendor;
(3) Any violation of this ordinance;
(Q) Conviction of any crime or misdemeanor;
(5) Conducting the business of peddler, canvasser, solicitor,
transient merchant, itinerant merchant, or itinerant vendor, as the
case may be, in an unlawful manner or in such a manner as to
constitute a breach of peace or to constitute a menace to health,
safety or general welfare of the public.
(b) Notice of the hearing for revocation of a permit shall be
given by the city clerk in writing, setting forth specifically
the grounds of complaint and the time and place of hearing. Such
notice shall be mailed, postage prepaid, to the permittee at his
last known address at least five days prior to the date set for
hearing, or shall be delivered by a police officer in the same
manner as a summons at least three days prior to the date set for
hearing.
Section 13. Appeal. Any person aggrieved by the section of
the chief of police or the city clerk in the denial of a permit
as provided in Section 6 of this ordinance may appeal to the council.
Such appeal shall be taken by filing with the council within
fourteen days after notice of the action complained of, a written
statement setting forth fully the grounds for the appeal. The council
shall set a time and place for a hearing on such appeal, and notice
of such hearing shall be given to the appellant in the same manner
as provided in Section 12 of this ordinance for notice of hearing
on revocation.
Section 14. Reapplication. No permittee whose permit has
been revoked shall make further application until at least six
months have elapsed since the last previous revocation.
Section 15. Expiration of Permit. All annual permits issued
under the provisions of this ordinance shall expire at midnight
the 31st day of December in the year when issued. Other than annual
licenses shall expire at midnight on the date specified in the
license.
Section 16. Penalty. Any person who violates any provision
of this ordinance is guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine not exceeding $500 or by
imprisonment for a period not exceeding 90 days or both, plus, in
either case, the costs of prosecution.

AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES AND OTHER VEHICLES ON
CERTAIN STREETS OF THE CITY OF HUTCHINSON, MINNESOTA AND PROVIDING PENALTY
FOR VIOLATION THEREOF
THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA, DOES ORDAIN:
SECTION I. It shall be unlawful for any firm, person or corporation to
park a motor vehicle or other vehicle in the City of Hutchinson on the South
side of Linden Avenue Southeast between Lynn Road and Main Street.
SECTION II. Any person violating any of the provisions of this ordinance
shall, upon conviction thereof, be punished by a fine of not more than Three
Hundred Dollars ($300.00) or by imprisonment for a period of not more than
ninety (90) days.

SECTION III. All ordinances and parts of ordinances inconsistent with
this ordinance are hereby repealed.
SECTION IV. This ordinance shall be in force and effect from and after
its publication.

AN ORDINANCE PERTAINING TO UNLAWFUL
DISPLAY -TO MINORS OF INDECENT PUBLICATONS,
PICTURES OR ARTICLES.
THE CITY COUNCIL OF HUTCHINSON, MINNESOTA DOES ORDAIN:
SECTION 1. (1) It shall be unlawful to knowingly display to
view at newsstands or any other business establishment frequented
by minors under the age of eighteen (18) years of where said
minors are or may be invited as a part of the general public,
any book; pocketbook, pamphlet or magazine the cover of which
exploits, is devoted to, or is principally made up of
descriptions or depictions of illicit sex or sexual immorality
or which is lewd, lascivious, or indecent, or which consists
of pictures of nude or partially denuded figures posed or
presented in a manner to provoke or arouse lust or passion or to
exploit sex, lust or perversion for commercial gain or any
article or instrument of indecent or immoral use unless said
book, pocket book, pamphlet or magazine shall be wrapped in an
opaque material with only the title of said book, pocket book,
pamphlet or magazine visible.
(2) As used in this section, the terms defined herein shall
have the following meanings ascribed to them:
(a) "description or depictions of illicit sex or
immorality" means:
(1) human genitals in a state of sexual stimulation
or arousal;
(2) acts of human masturbation, sexual intercourse
or sodomy;
(3) fondling or other erotic touching of human
genitals, pubic region, buttock or female breast.
(b) "nude or partially denuded figures" means:
(1) less than completely and opaquely covered human
genitals, pubic areas, buttock, and female breast below a point
immediately above the top of the areola; and
(2) humal male genitals in a discernibly turgid
state, even if completely and opaguely covered.
(c) "knowingly" means having knowledge of the character
of the publication or failure on notice to exercise reasonable
inspection which would disclose the character of the same."
SECTION 2. Any person who shall violate the provisions of
this Ordinance shall be guilty of a misdemeanor.
SECTION 3. This Ordinance shall take effect and be in full
force one week from and after its publication.

The library board met on July 21, 1983, with the following members present:
Albert Linde, Elaine Clay, Kathy McGraw, Ralph Bergstrom, Paul Ackland.
The minutes of the previous meeting were read and approved.
Letter of intent was sent to Bill Asp.
Ralph said the scale model is being made.
Albert Linde met with Bill Asp on Monday, July 18, in St. Paul at an infor-
mational meeting regarding construction grants. Approximately 30 people
were present at the meeting.
The total grant amount is $735,686.Oo, with the highest amount being $200,000.
Application must have complete plans, specifications, etc. The deadline for
application is October 1, 1983.
Ralph Albert and Barb Whittenberg will meet and further discuss grant appli-
cation.
Meeting adjourned at 5:35. Motion made by Elaine and seconded by K. McGraw.

1983
The Board of Directors for Burns Manor Municipal Nursing Home
met Thursday, June 23, 1983, at Burns Manor, 12:00 noon, President
Leslie Linder presiding.
All members present, except Gloria Dansereau and Mike Carls.
Stan Gallup, who is an intern in Long Term Care Administrator
Practicum, University of Minnesota was a guest.
A motion was made by Keith Duehn and seconded by Esther Kuehl,
to accept the minutes as read. Motion carried.
A motion was made by Eldred Miller and seconded by Larry Graf
to pay the bills as presented, a copy of which is attached to the
minutes on file and made a part thereof. Motion carried.
David Jensen, Financial Advisor, gave the monthly financial
report.
Discussion on Welfare final rate for the period, July 1, 1983
thru June 30, 1984. All rates will be effective July 1, 1983.
Skilled - $43.08 I.C.F. - $38.01. Under the new law there are
changes in allocation costs. Motion was made by Larry Graf and
seconded by Keith Duehn, to consult with Thorsen Campbell Rolando
& Lehne, Certified Public Accounts, and to file an ammended report
if necessary. Motion carried.
A motion was made by Keith Duehn and seconded by Eldred Miller,
to install a thermostatically control fan to regulate air temperature
in the basement food storage room. Cost $3,000.00. Motion carried.
A motion was made by Eldred Miller and seconded by Esther Kuehl,
to repair or replace sidewalks, cost $1,925.00. Motion carried.
An employee was dismissed, June 14, 1983 for seizing a patient's
arm. She raised her fist and shook it at the patient, (no witnesses
were present but it was reported by the resident.) The employee
was under observation for other incidents and was on probation.
The Patient Bill of Rights in Health Care Facilities (Minnesota
State Law) and Burns Manor Employee Discipline Guide were referred
to. The employee has not appealed the decision by presenting a
written statement to the Administrator, which is her right as stated
in the Employee Policy.

1983
A statement will be sent to the Hutchinson Leader and
KDUZ radio station stating that the Burns Manor Nursing Home Board
has not requested that the City of Hutchinson enter into an agree-
ment with the Adventist Health System for a change in the
ownership or management of the City Nursing Home. Burns Manor
has been and remains financially independent and does not receive
financial assistance from the City of Hutchinson. The quality of
care and philosophy of Burns Manor will remain unchanged. A copy
of the letter will be sent to the responsible party of each
patient.
There being no further business, a motion was made by Keith
Duehn and seconded by Eldred Miller, to adjourn the meeting.
Motion carried.
The Burns Manor Board of Directors will meet Thrusday July
21, 1983 at noon, in the Annex sun porch at Burns Manor Municipal
Nursing Home.

Previcus discussions c-ith staff and Motor Pool personnel have
indicated the Fire Marshal vehicle should be replaced in 1983 with
a large passenger capacity vehicle, with preference towards a good
used vehicle.
In looking around we have found a real "gem" at Swanke Motors.
In a Motor Pool examination and test drives by Doug Meiers, Ken
Wichterman and George Field, all agree this is the vehicle best suited
for the Fire Marshal.
Permission is requested to purchase a used 1978 Buick Nine
passenger station wagon in excellent condition for $4500.00. His
old vehicle will be sold at our city auction this fall.

TRANSPORTATION BOARD
AUGUST 9, 1983
Exerpt from Minutes:
Staff reported on requests to use Hutchmobile for special purposes:
1. Radio Station KDUZ is planning an open house on Sunday afternoon,
August 28. Since parking is limited at the station, they have
requested Hutchmobile service to shuttle visitors to and from a
parking lot at regular intervals throughout the afternoon. They
would be agreeable to paying $50 for about 4 hours bus service with
the understanding that the Hutchmobile would be advertised as part
of the open house promotion. After discussion, a motion was made,
seconded, and unanimously carried to recommend approval of this
request to the City Council.
2. Hutchinson Public School Adult Education Office has requested
Hutchmobile service for a Saturday morning tour sometime in October,
in conjunction with an adult class. They propose to pay $2 per
rider, with a minimum of 10 participants. After discussion, the
board felt that such service could be provided at a fee "per hour"
which would cover all actual costs, regardless of the number of
participants. Motion was made, seconded, and unanimously carried,
to recommend to the City Council that such service be made available,
provided the school is willing to pay the actual cost of the service.
3. Staff suggested that, if service is provided for the KDUZ open house,
informational leaflets be handed out to passengers that day, which
would include a coupon good for a half price ride on the Hutchmobile
during regular service hours. Motion was made, seconded, and
unanimously carried to recommend to the City Council that these
leaflets with coupons be distributed.
4. Staff suggested that two Fridays in August be advertised as
"Friday is Free Day" on the regular shuttle schedule to encourage
new riders. After discussion, motion was made, seconded, and carried
unanimously to recommend to the City Council that shuttle service
be free on two Fridays in August.

RE: REQUEST FOR CONDITIONAL USE PERMIT BY PURE CULTURE PRODUCTS
The reason I did not respond previously to the notice was because this appeared
to be the same request they made for installation of a bulk oxygen tank that
I reviewed with Gary Plotz on February 15, 1983. At that time we determined
that the site was located within the flood fringe portion of the flood plain.
Consequently, I advised Gary that the installation could be authorized but that
it must be securely anchored and also not subject to flooding damage.
Since I did not receive a copy of the application along with the recent notice,
I have no way of knowing for certain if this is the same project. If it is,
then the comments that I made to Gary last winter are still appropriate. If
it is not, I would request that you send a copy of the application along with
a photocopy of the appropriate flood plain map on which you have indicated the
proposed tank location so that a determination can be made as to the particular
requirements.

Old Business: The McLeod County Fair booth was discussed. We can display
our safety literature at the sheriffs table, if we so wish.
Larry Ladd sugested that if we had a supply of good material we could send
it out with the weekly Shoppers Guide. This will be checked into.
President Myron Johnson received a letter from the State Safety Council
regarding the life- saving act by the members of the Hutchinson Police
Department. The President, Robert Anderson would like to be notified
personally in the future and they will provide recognition as they have
a IIonor Deed Award.
New Business: Les Linder stated there is a blind corner on 2nd Ave. SE
between Monroe and Ontario. Weeds and bushes need to be cut as it is a
hazard when driving the school bus. Ken',Gruefthagen of the city council
will look into this and advise the street department of this and other
corners where there are bushes and overhanging trees.
George Field will put in the budget for the safety council to the city
councilfor the amount of 150.00, the amount given us last year for expenses.
Bill Arndt Epoke regarding road signs and names for county roads, as some
counties have done. There are some 1200 plus numbers for the fire department.
Some counties are doing this in regards to the 911 emergency number,

The Hutchinson City Council
RE: Improvement vs. Maintenance
Dear Councilman:
Section 7.13 of the Hutchinson City Charter states "No
obligations shall be issued to pay current expenses, but the
council may issue and sell obligations for any other municipal
purpose in accordance with law and within the limitations
prescribed by law. Although the charter does not provide any
definition of "current expenses ", Blacks Law Dictionary defines
that term as "Usual, ordinary, running, and incidental expenses
of a municipality, its continuing regular expenditures." Routine
maintenance of a city street is generally of a recurring nature.
The expenditures made on routine maintenance such as graveling,
grading, repair of chuck holes and other similar items are not
intended to be of a permanent or even semi - permanent nature.
It is anticipated that such maintenance will be necessary on a
annual basis and in the past it has been possible to anticipate
with a fair degree of accuracy the amount of expenditures
necessary to provide the services needed. Any expenditure
from maintenance that would be of a short -term nature would in
all likelihood fall under the definition of "current expenses"
and should be paid for from the general fund rather than the
sale of obligations.since Section 7.13 prohibits the sale of
obligations for the payment of current expenses.
Rather than having this type of maintenance paid for from
the general fund, the city has the option of specially assessing
the benefited property owners under the provisions of Minnesota
Statutes 429.021. That section defines improvement authorized
for special assessments. Among the improvements so authorized
is the ability to "acquire, open, and widen any street, and to
improve the same by constructing, reconstructing, and maintaining

RE: Item 9 -P of City Council Meeting Agenda of July 26, 1983
Dear Marilyn:
I was requested to investigate the number of votes
necessary to approve a- variance- In this particular instance
the planning commission has recommended approval of a variance
and the city council by a three -to -two vote approved the
recommendations of the planning commission. At that meeting
it was questioned whether a simple majority is sufficient
to approve a varianceor whether a two- thirds majority is
required.
Section 3.04 of the Hutchinson City Charter provides
"An affirmative vote of a majority of all the members of the
Council shall be required for the passing of all ordinances
and resolutions, except as otherwise provided in this charter."
In examining the City Charter, I find no specific provision
that requires a two - thirds majority vote to approve variance
requests.
Minnesota Statutes annotated section 462.357 also deals
with the subject of variances. There is no specific requirement
concerning a greater than majority vote being necessary to
approve a variance listed in that statute.
The Hutchinson City Zoning Ordinance deals with variances
in Section 6.05• That section does not require more than a
simple majority to approve a variance.
In examining the zoning ordinances, I feel Section 607C6
may be the cause of the confusion concerning the number of votes
necessary to pass on a recommendation from the planning
commission. That section states in part "Any proposed
conditional use which fails to receive the approval of the
majority of the members of the planning commission voting
upon it shall not be passed except by a favorable vote of
two - thirds of all the members of the city council." Please
note that section deals specifically with conditional uses
and does not mention variances. Even if the variance section

were to have included such a requirement, it would not be
applicable in this particular case since the planning commission
passed favorably upon the proposed variance.

Dear Mr. Priebe:
The Minnesota Pollution Control Agency has in the past received a
number of complaints concerning emissions from the Pure Culture
Products, Inc. facility located at 35 Adams Street North in
Hutchinson: In response to those complaints, the Minnesota
Pollution Control Agency (MPCA), Division of Air Quality
conducted an inspection of the Pure Culture Products facility on
March 21, 1983.
As you probably know, this facility consists of a fermentation
plant for the production of edible yeast food supplements. The
yeast cells are grown in an alcohol medium with added nutrients,
dried, and packaged for sale and distribution.
During the course of my inspection I was able to observe the
operation of the fermentation process used to produce the yeast
product. In addition, I observed the operation of one of the
facility's two boilers. At no time during the course of my
inspection, was I able to document any violations of Minnesota
Pollution Control Agency rules. With this fact in mind it was my
recommendation that the Pure Culture Products facility be issued
an Air Emission Facility Operating Permit from the Minnesota
Pollution Control Agency.
In order to assist you in resolving complaints from local
residents, I am enclosing a copy of my inspection report for your
review. If you have any questions or need any clarification
concerning the Pure Culture Products facility, please feel free

Reports of Progress:
Bob Boese, Director of WPLS, stated he has six signed contracts from Appleton,
Madison, Kerkhoven, Graceville, Ortonville, and Dawson. Big Stone and Chippewa
counties have approved the merger but the signed agreements have not been received.
Burton Sundberg, _Director of CRRL, reported that signed agreements have been re-
ceived from Bird Island, Hutchinson, Glencoe, Willmar, and Renville. McLeod County
has approved the agreement but the signed agreement has not been received.
Status of Board Appointments -- All appointments will be continuous on the new
Board for the duration of the current appointment. The new Agreement states that
Board appointments shall run from July 1 with the option that another date could
be established. WPLS has four appointments that will be expiring on July 1. Ulrich/
Gaffney moved that the date for Board appointments be changed from July 1 to January 1.
Carried.
FY 1984 Grant Applications -- The new system will apply for three grants prior to
July 1. Each of the three grants were reviewed by the staff stating the purpose
for the grant and the proposed expenditures. The State Aid Grant is for $149,000,
Federal is $27,000 (this will be used for the development of the COM catalogs);
and the Establishment Grant of $24,000 for the first year and $12,000 for the second
year. George/Boehlke moved that the above three grants be approved by the Board,
signed by the Director and the Chairman, and submitted. Carried.
Gaffney /George moved that the secretary be instructed to send a letter of thanks'
to State Senator Randy P. Kamrath of Canby for his support in securing the special
Incentive Grants for the new system.
Personnel Policies and Salaries through December 31, 1983 -- Each Board should
continue with their personnel policies through the end of 1983, as recommended by
the CRRL/WPLS Merger Study Committee on May 4. Moench /Linde moved that the above
recommendation be adopted. Carried.
Budget for July- December, 1983 -- Bob Boese reported that the two systems will
continue operating on their current budgets through December 1983 with two separate
accounts. The Incentive Grant of $24,000 would be for the new system for the 1984
budget. A combined account would begin January 1, 1984..
Name for New System -- A list of possible names for the new library system was
presented. Other suggestions were: Pioneer Library and Mid - Minnesota. Gaffney/
Kubasch moved that the naming of the new system be tabled until the next meeting.
Carried.
Administration of New System -- Malone /Boehlke moved that Burton Sundberg be the
Director and Bob Boese and Kathy Matson be named Associate Directors. Carried.
Committee Appointments -- Chairman Sanders indicated the new officers and the
Director and Associate Directors would meet regarding the appointment to committees.
Members would be notified by letter of their appointment and meeting dates. The
Committees are: operational Policies, Personnel Policies, Finance (Budget), and
Bylaws.
Other:
a. 1984 Budget -- Bob Boese presented the 1984 budget. George/Hebrink moved the
attached proposed budget of $771,828 for 1984 be adopted. Carried.
b. Date and Place of Next Meeting -- The next meeting of the combined Boards will
be at a date to be later announced; however, Hebrink /Boehlke moved that the next
CRRL/WPLS meeting be held at 7:30 p.m. in Montevideo. Carried. It was the consensus
of the Board that the remainder of the CRRL/WPLS Board meetings be held in Willmar
which is centrally located. Board members then voted by ballot as to the day of
the week they would like the Board meetings to be on. Mr. Sundberg will tally them.

past few months - a total of 7 since January.
+ If this indicates a "trend ", certainly at some point a really
serious or tragic accident will occur.
+ It is necessary to make employees aware of the situation so that
each individual contributes to the overall safety of all city
employees. We must change the "trend."

+ On- the -job accidents are costly in two ways:
1. Cost in a direct loss of manpower - time - personal well - being.
2. Cost in increased Workers Compensation insurance rates.

+ The City has had a favorable record in the past. Our loss experience
is less than the average for all cities in our insurance category.
+ We have had 74% of the "average" number of Worker's Compensation
claims. This good record saves the city $9,000 per year in insurance
premiums. If we were "average" we would pay $9,000 more per year
in premiums.
THE FUTURE
+ We want to emphasize individual concern for safety by every
employee. Talk about it - make suggestions - cooperate fully.
+ Department heads and supervisors will be working to reinforce
consistent safe practices.

The most frequent type of lifting injury is
"backstrain." This is a result of over-
stretching certain muscles and generally can
be avoided by using the proper lifting tech-
nique.
BEAT THE HEAT
Know the symptoms of heat- related problems...
Heat Exhaustion - Symptoms
Fatigue - weakness - ;sometimes nausea. In
severe cases, weakness is extreme and
perspiration is profuse. Skin is pale and
clammy but body temperature seems about
normal.
First Aid
Have the victim lie down and raise the feet
with a pillow. Give sips of salt water
solution (z teaspoon salt to s glass water)
every 15 minutes for 3 or 4 doses. If the
victim is unable to hold down the fluid,
don't give any more fluids and get the vict
to the hospital.
Preventive Measures
Fluid lost by perspiration must be repplaced
by the intake of more water or salty beve-
rage. # # # # # # # #

urgent medical attention is required,
the Medical Center will be advised you
are coming.
2. As soon as possible, fill out the yellow
"First Report of Injury" form in your
department and return it to the insurance
clerk at City Hall. (Usually the same day.,
3. Every time you visit the Medical Center
for continued treatment of such an injury,
you should tell them again that this is a
work - related injury.
4. For work - related treatment, the Medical
Center will send you the hill. You should
then bring it to the insurance clerk for
processing.

The Department of Revenue will soon be making a decision concerning the interpretation
of the LGA (Local Government Aid) statute for the distribution of LGA in 1984. (Some
ciites have learned of this impending decision and assumed it would affect 1983 LGA
distribution. It does not.) Since the amount appropriated($246.2 million) will probably
not be sufficient to "fully fund" the formula, some sort of proportional reduction will
be necessary.
The issue is: how will the proportional reductions be accomplished?
Depending on how the reduction is done, some cities may get less of an increase than
they might have otherwise received; other cities may get a greater decrease than they
would have otherwise anticipated.
Two major alternatives are now being considered by the Revenue Department:
1. The first, advocated by cities of the first class, would reduce the "preliminary
aid factor" of each city. (The "preliminary aid factor" is the amount of LGA a city
would receive if there were no maximum increase or decrease provisions. It is the
"pure formula" amount.)
COMMENT: This alternative benefits cities whose preliminary aid amount exceeds the
6 percent maximum increase permitted by the statute. As a result, they will still
receive the 6 percent LGA increase even if the proportional reduction of the "preliminary
aid factor" takes place. (Note: a large number of cities, including Minneapolis,
St. Paul, and Duluth probably fall into this category.)
The cities which would appear to bear the brunt of this method are: a) the 50 or so
which receive LGA on the preliminary aid factor (i.e., the maximum provisions do not
constrain them - they are "on the formula "); b) "borderline cities" which are not now
on the "formula ", but which may be after the proportional cutbacks; and c) the cities
which receive LGA on the basis of the "3/4 mill maximum decrease" provision. The $6.4
million allocated to that 3/4 mill provision would have to be spread more thinly.
2. The second alternative would determine each city's proportional share of any
shortfall based on its preliminary aid factor. Then, that amount would be subtracted
from each city's final aid amount. (This is the traditional method used by the Department
of Revenue in past years to calculate LGA distribution and is the one initially indicated
by the Department for use in determining 1984 aid amounts.)

WHEN AND HOW WILL A DECISION BE MADE?
On July 15, representatives from the cities of Minneapolis and St. Paul met with the
Department of Revenue on this matter. Peggy flicker, LMC Legislative Counsel, attended
on behalf of the League. At that time, Minneapolis representatives indicated that the
matter of proportional reduction had been discussed during deliberations on LGA at the
1983 Legislature; that the legislature intended that Alternative I be used; and that
this method is most consistent with the property tax relief purpose of LGA.
Several key legislators are apparently writing letters to that effect to the Department
of Revenue at this time. Cities informed and aware of the pending decision are contacting
the department. If your city has a concern in this regard, please contact the office of .
the Commissioner of Revenue to express your city's views. Contacting the League will also
provide information for the LMC Board of Directors on the matter.
The LMC Board of Directors will meet on Thursday, August 4, to discuss the questions
raised by the current situation. Arthur Roemer, Minnesota Commissioner of Revenue, has
indicated that he is interested in proceeding to make a decision in the matter and may
do so before actual data on the extent of the shortfall is available since it is the
concern of the department that .a process be in place to determine the calculations of
LGA distribution for 1984.
The Department of Revenue anticipates that all data necessary to determine the 1984
LGA distribution will be available by the end of July. Only then will the department
know the extent of the shortfall and how each city would fare under each alternative.
Time is of the essence. It is a matter that will be decided soon.

The Crow River Regional Library Board met at Library Square in Litchfield on Monday,
July 11. Chairman Mankell called the meeting to order.
Buchanan /Moench moved to approve the minutes of the June meeting. Carried.
Sanders/Kubasch moved to approve the treasurer's report for June. Carried.
Director's report:
a. Barbara Whittenberg, Hutchinson librarian, is retiring September 30, 1983. CRRL and
the Hutchinson Library Board will work together to name a replacement.
b. The June statistical report was reviewed.
c. CRRL and WPLS received a SMAHC grant to run a children's play, "Big Anthony and the
Magic Ring," at area libraries this summer. Five performances have been given so far.
d. The staff bus trip will be July 28. The group will visit the Duluth Public Library
which is the only completely automated public library in Minnesota. The bus will make
pickups at New London and St. Cloud.
e. The semi- annual Book Sale will be held Wednesday, July 20, in Willmar.
f. The CRRL board will continue to meet as a separate group to approve expenditures
through December, 1983.
Hebrink /Ulrich moved that the bills be paid. Carried.
WPLS /CRRL merger developments: All 18 governing units have now approved the merger
agreement, however, a one -year initial membership has been requested by three governing
units within the CRRL area. This change must be presented to the combined library
board at its next meeting on August 8 and to all governing units for approval.
CRRL 1983 Budget:
One CRRL governing unit had earlier stated its decision to use the amount required for
maintenance of effort rather than the 1983 budgeted amount, a reduction of $2500. After
discussion, Sanders /George moved to authorize Mr. Sundberg to make an appointment
with this governing unit to explain the position of this board, and to encourage
restoration of the cut. Otherwise, services to libraries within that unit will have
to be cut to make up the deficit. Carried. It was suggested -that Mr. Sundberg

compile a list of specific services to be cut such as hours and number of books
purchased.
Communications:
a. The Public Library Newsletter was passed around.
b. A revision of laws for Minnesota public libraries became effective July 1, 1983.
Some of the changes:
1. Library trustees may serve no more than three consecutive three -year terms on
any library board.
2. Reimbursement is limited to traveling expenses.
3. Library boards now have control over library funds and interest earned from
such funds.
4. It is a petty misdemeanor to intentionally damage, remove, or fail to return
library property.
c. CRRL should receive approximately $120,000 instate and federal aid by December,
1983.
d. LSCA Title II (Library Construction Act) Informational Meeting will be held in
St. Paul July 18.
New Business:
a. Kandiyohi County, Meeker County, and Litchfield made changes in contract wording
before they approved it. These changes will be recommended for approval by the combined
CRRL/WPLS board on August 8.
b. Reactions to the 1984 budget proposal for the merged system:
1. McLeod County -- question on 58 salary adjustment
2. Meeker County -- no increase proposed
3. Willmar -- limit raise to 6.38
c. Kathy Matson will check on the cost of having the board meetings in Library
Square instead of the courthouse whenever we would meet in Litchfield.
Mileage reports were filed.
