• SPECIAL MEETING - HUTCHINSON CITY COUNCIL
WEDNESDAY, APRIL 22, 1987
The special meeting was called to order by Mayor Ackland at 6:30 P.M. Present
were: Alderman Mike Carls, Alderman Pat Mikulecky, Alderman Marlin Torgerson
(arrived at 6:55 P.M.), and Mayor Paul L. Ackland. Absent: Alderman John
Mlinar. Also present: City Administrator Gary D. Plotz, Vergil Florhaug of
CAM, and committee chairman Dick Burgart.
Mayor Ackland stated the purpose of the meeting was to review the bids and award
contracts for the police station.
Mr. Vergil Florhaug reported the State Fire Marshal had reversed his opinion re-
garding the two hour fire walls, and the proposed changes in the plan were not
necessary. This would represent a savings of about $18,000. The total revision
cost for the trade contractor changes per the State code requirements would have
been $21,150.
Discussion was given to line item No. 35 for fire protection. It was reported
the present equipment would be moved from the old building into the new build-
ing. Closed circuit TV cameras and monitors would be installed at an approxi-
mate cost of $9,000. No firm figures were available for the new phone system.
• The proposed alternates were discussed, and it was the consensus of the Council
to trade -off the burnished block for epoxy painted block in the basement area
for a $7,540 difference in cost. The following figures were approved:

Finance Director Merrill stated the $100,000 general fund transfer would be done
by Resolution at a later date. Also, federal revenue sharing funds are avail-
able and could be transferred subsequent to a public hearing.
Alderman Carls moved to let the bids with the adjustments on line items No. 34
and No. 35 as discussed. Motion seconded by Alderman Torgerson and unanimously
carried.
Mr. Florhaug commented in closing that letters would be sent to the bid holders
and a pre- construction meeting would be held within the next week.

1. The meeting was called to order by Mayor Ackland at 7:30 P.M. The follow-
ing were present: Alderman Mike Carl s, Alderman John Mlinar, Alderman Mar-

(a) CONSIDERATION OF CHANGE IN CITY POLICY FOR STORM DAMAGE
(DEFERRED APRIL 14, 1987)
Director Bruce Ericson reported on the proposed changes in the storm
damage policy. Following discussion, Alderman Mlinar moved to approve
the policy change, with the provision for City clean -up in the event of
storm damage. Motion seconded by Alderman Torgerson, who then amended
the motion to read "clean -up would be at the discretion of the Street
and Park Departments and directors." Amended motion seconded by Alder- •
man Mlinar and carried four to one, with Alderman Mikulecky voting nay.
The main motion carried three to two, with a roll call vote of Aldermen
Carls, Mlianr and Torgerson voting aye and Alderman Mikulecky and Mayor
Ackland voting nay.
(b) CONSIDERATION OF REQUEST FOR CITY OF HUTCHINSON TO SPONSOR FIREWORKS
DISPLAY FOR JAYCEE WATER CARNIVAL (DEFERRED APRIL 14, 1987)
Following extensive discussion, it was the consensus of the Council
that the City donation towards the fireworks display would be reviewed
on a yearly basis.
Alderman Torgerson moved to approve the request. Motion seconded by
Alderman Mlinar. The motion was amended by Alderman Carls that the
City designate $1,000, or 50% of the $2,000, toward the fireworks dis-
play. Mayor Ackland seconded the motion, and the amendment unanimously
carried. The main motion carried unanimously.
Commodore Mark Erickson reported a different location would be used for
the street dance. Alderman Carls moved to award a new permit for the
dance at a different location. Motion seconded by Alderman Mlinar and
unanimously carried.

(a) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
Alderman Torgerson moved to authorize discontinuation of service as
recommended unless other arrangements had been made. Motion seconded
by Alderman Mikulecky and unanimously carried.
(b) CONSIDERATION OF LAWCON GRANT APPLICATION FOR BASS POND
Director Bruce Ericson explained the two options on the LAWCON grant
application. Following discussion, Alderman Carls moved to give pre-
liminary approval to the LAWCON grant application with the acquisitions
as presented by Director Ericson. Motion seconded by Alderman Mlinar
and unanimously carried.
(c) CONSIDERATION OF OVERCHARGE FOR WATER /SEWER OF THREE PROPERTIES
• Finance Director Merrill reported three properties were overcharged for
water /sewer due to faulty readings on the 1 -1/2 inch water meters. The
proposed adjustments were based on the percentage of over - reading, with
an error factor on billing of 75% for Maplewood Academy and 53% for
Chet & Associates and a 70% error factor for Haukos Bros.
Mr. Willard Haukos and his son requested the Council consider a 75% er-
ror rate, with interest. It was the legal opinion of the City Attorney
that the City was not obligated to pay interest on the overcharge; how-
ever, the State Statute policy would be 8% interest.
Following discussion, Alderman Carls moved to calculate reimbursement
on a 74% error rate and pay interest at 8% for the Haukos account. Mo-
tion seconded by Alderman Torgerson. Alderman Carls amended his motion
to make reimbursement for the other two properties as stated in the Fi-
nance Director's memorandum dated April 24, 1987, with interest at 8 %.
Amended motion seconded by Alderman Mlinar and unanimously carried.
Main motion carried unanimously.
(d) CONSIDERATION OF UNDERGROUND EXCAVATIONS ON SHADY RIDGE ROAD AS 1987
PROJECT FOR SUNSET RIDGE ADDITION
It was reported that the final plat and subdivision agreement were nec-
essary before approval could be given to the project. Since no peti-
tion for the project had been submitted, it would require a 4/5 vote
• of the Council. No public hearing could be held due to the timeframe
for the bond sale.

Bond Consultant Bill Fahey stated the storm sewer improvement could be
included in the bond sale if the Council called for a public hearing
tonight and set the hearing date for May 26, 1987. It would require
35% of the property owners to sign the petition requesting the improve-
ment.
After discussion, Alderman Torgerson moved that $73,200 be included in
the bond sale for Sunset Ridge Addition improvement project No. 87 -33,
to set a public hearing on Shady Ridge Road project No. 87 -34 for May
26, 1987 at 8:00 P.M., and to waive readings and adopt Resolutions No.
8494, No. 8504, No. 8505 and No. 8506. Motion seconded by Alderman
Mlinar and unanimously carried.
(e) CONSIDERATION OF APPROVING REDUCED HOURS IN 1987 FOR HOMER PITTMAN
The motion was made by Alderman Carls, seconded by Alderman Torgerson,
to approve the reduced hours. Motion unanimously carried.
(f) CONSIDERATION OF APPOINTING JIM MARKA AS CHIEF BUILDING OFFICIAL
Alderman Torgerson moved to approve the appointment of Jim Marka. Mo-
tion seconded by Alderman Mikulecky and carried unanimously.
(g) CONSIDERATION OF CONDITIONAL USE PERMIT SUBMITTED BY TACO JOHN'S WITH •
FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Alderman Mlinar moved to approve the conditional use permit and to
waive reading and adopt Resolution No. 8498. Alderman Mikulecky sec-

(s) CONSIDERATION OF SETTING BID DATE FOR SALE OF 1987 BONDS
Bond Consultant Bill Fahey presented bond maturity schedules of 15 and
19 year periods for the wastewater treatment plant and 10 years for the
improvement projects. It was his reconendation to open bids on May
26, 1987 at 11:00 A.M. and award the bids at the May 26 Council meet-
ing.
Following discussion, Alderman Carls moved to waive reading and adopt
Resolution No. 8508 relating to the sale of $5,975,000 for general ob-
ligation wastewater treatment bonds of 1987 (15 years). Motion second-
ed by Alderman Mlinar and unanimously carried.
The motion was made by Alderman Mlinar, seconded by Alderman Torgerson, •
to waive reading and adopt Resolution No. 8509 relating to $1,200,000
improvement bonds of 1987. Motion carried unanimously.
(t) CONSIDERATION OF INSTALLING STOP SIGNS AT INTERSECTIONS OF FOURTH
AVENUE SOUTHWEST AND GROVE STREET AND FOURTH AVENUE SOUTHWEST AND
GLEN STREET
Alderman Torgerson moved that upon the recommendation of the Interim
Police Chief, to waive first reading of Ordinance No. 2/87 and set the
second reading for May 26, 1987. Motion seconded by Alderman Mlinar
and unanimously carried.
(u) CONSIDERATION OF AWARDING CONTRACTS FOR IMPROVEMENT PROJECTS NO. 87 -14
AND NO. 87 -23
It was the recommendation of the Engineering Department to award the
contract for project No. 87 -14 to Juul Contracting Co. for $22,388.50
and to Wm. Mueller & Sons for $78,165.00 on project No. 87 -23.
Following discussion, Alderman Torgerson moved to approve and enter
into contracts and to waive readings and adopt Resolutions No. 8496 and
No. 8497. Motion seconded by Alderman Mikulecky and carried unani-
mously.
(v) CONSIDERATION OF INCLUDING WOODRIDGE SUBDIVISION PETITION TO LIST OF •
1987 IMPROVEMENT PROJECTS AND BOND SALE
A 100% petition for street surfacing on Campbell Lane in Woodridge

included in the 1987 improvement projects.
Following discussion, Alderman Mlinar moved to approve project No.
87 -35 and to waive reading and adopt Resolution No. 8503. Motion sec-
onded by Alderman Torgerson and carried four to zero. Alderman Miku-
lecky abstained from voting since he was a property owner.
(w) CONSIDERATION OF TEMPORARY WAGE ADJUSTMENT FOR ACTING POLICE CHIEF
The motion was made by Alderman Mikulecky, seconded by Alderman Carls,
to approve the temporary wage adjustment. Motion unanimously carried.
(x) CONSIDERATION OF PETITION TO WITHDRAW PROJECT NO. 87 -24 FROM 1987
IMPROVEMENT PROJECTS
It was reported that the property owner, Tyrone Helland, had submitted
a petition requesting to withdraw project No. 87 -24 from the 1987 im-
provements.
After discussion, Alderman Torgerson moved to grant the request of
withdrawal for project No. 87 -24 from the 1987 improvement projects and
to waive reading and adopt Resolution No. 8507. Motion seconded by

10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
City Administrator Plotz reported on the timetable for installation of
the signal light on Hwy. 7 West and School Road. He also reviewed a
map which showed the easements and their locations for the new waste-
water treatment plant. It was determined to hold a joint City Council
and Hassan Valley Township Board meeting on May 6, 1987 at 7:00 P.M. to
discuss obtaining an easement from the township.
The airport appraisals have been completed, and the City Attorney is

A pre- construction meeting for the new police station has been sched-
uled for May 6 at 10:00 A.M.
The auditing firm has made recommendations regarding the City's cash
policies, and the Council will receive a copy of the report.
The County Assessor recommended two dates for the Board of Review. It
was the consensus of the Council to meet on June 17, 1987 at 4:30 P.M.
• The Council was advised that they may be contacted by Dori Johnson re-
garding some property she owns which is for sale.

Mr. Plotz reported the cost of the four air conditioning units for
Burns Manor Nursing Home was $300 per unit higher than what was auth-
orized by the City Council at its April 14, 1987 meeting. He had
instructed the administrator to proceed with the purchase since it was
still low bid.
(b) COMMUNICATIONS FROM ALDERMAN MARLIN TORGERSON
Alderman Torgerson stated the Utilities Commission had received some
requests for decorative street lighting in new additions. They would
like the Council to adopt a policy establishing the type of pole to be
used and the lighting fixtures. The City staff was directed to draft a
policy for Council review.
(c) COMMUNICATIONS FROM MAYOR PAUL L. ACKLAND
Mayor Ackland commented on an Action Alert issued by the League of
Cities regarding a proposal of three percent levy limit which has al-
ready passed one committee and a cut in LGA's in 1987. He felt the
Council should go on record opposing it.
Alderman Torgerson moved that the City go on record opposing the Leg-
islative proposals. Motion seconded by Alderman Carls and unanimously •
carried.
11. CLAIMS, APPROPRIATIONS AND CONTRACT PAYMENTS
(a) VERIFIED CLAIMS
The motion was made by Alderman Mikulecky, seconded by Alderman Mlinar,
to approve and authorize payment from the appropriate funds. Motion
unanimously carried.

WEDNESDAY, MAY 6, 1987 - 7:00 P.M.
The following were present for the meeting:
City of Hutchinson: Alderman Mike Carl s, Alderman John Ml inar, Alderman Marlin
Torgerson, Alderman Pat Mikulecky, Mayor Paul L. Ackland, City Administrator
Gary D. Plotz, City Attorney Barry Anderson, Randy DeVries, and Atty. Paul Ras-
mussen.
Hassan Valley Township: Robert E. Anderson, Atty. Dick Cox, Wayne Oliva, Bob
Fratzke, Willard Reiner, and Melvin Kobow.
Donohue: Jim Miller and George MacDonald
The Mayor of Hutchinson introduced George MacDonald of Donohue & Associates.
Mr. MacDonald reviewed the layout for the forcemain and described the color -
coded map, which was previously mailed to each town board member and their at-
torney.
The Mayor, thereafter, called upon the town officials to solicit questions and
• concerns. Attorney Dick Cox represented the concerns of the town board. The
City's attorney, Paul Rasmussen, responded.
After some discussion, the town board requested a break to consult with their
attorney. Upon returning, Wayne Oliva responded they had no problem in granting
the easement; however, they requested $6,000 for legal fees and town board pay.
It was estimated by the township the legal fees were approximately $2,500 to
date. Council members requested an itemization of cost to be prepared by Hassan
Valley officials for consideration at the next City Council meeting on May 12,
1987. Mr. Oliva agreed to do so for the May 12, 1987 Council meeting.
It was also agreed the town board would consider approving or disapproving the
easement at the next town board meeting of May 12, 1987.

we pay tribute to those Veterans who have died serving our
country in time of War.
The American Legion and Veterans of Foreign Wars of Hutchinson
will again be having a Memorial Day parade, followed by a
Memorial Service at Legion Park. Parade line -up will be at
9:30 A.M. at Citizens Bank. We will then march south on
Main Street to Legion Park, where a Memorial Service will

the south side of Roberts First and Second Additions by con-
struction of a storm sewer and appurtenances.
We are against this project for the following reasons:
1. Our property has already been assessed for two
previous storm sewers. If after these two assessments,
the problem has not been alleviated, it would seem that
it is the city's obligation to correct it at the city's
expense.
2. We have also individually invested money in water-
proofing our own basements.
3. Since we have no water problem, we will not benefit
in any way from this improvement.
4. We feel this improvement will only benefit a couple
of property owners at the expense of the entire neighbor-
hood.

This is a letter of objection to the proposed assessment to my
property, Lot 3, Robert's 1st addition, for letting No. 1, Project
,NO. 87 -01. The notice of the assessment hearing sent by the city

states that the funding for the project is to be assessed to those property
owners living in Robert's 1st addition. I am definitely opposed
to any portion of the funding for this project being assessed

RESOLUTION ADOPTING ASSESSMENT
ASSESSMENT ROLL NO. 224
Resolution No. 8515
WHEREAS, pursuant to proper notice duly given as required by law, the
Council has met and heard and passed upon all objections to the proposed
assessment for the improvement of Ontario Street, Third Avenue S.S., Huron
Street and Oak Street by the construction of Watermain and Appurtenances,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made
a part hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein, and each tract of land therein included in
hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of ten (10) years, the first of the installments to be
payable on or before the first Monday in January, 1988, and shall bear
interest at the rate of _ percent per annum as set down by the adoption of
this assessment resolution. To the first installment shall be added interest
on the entire assessment from October 1, 1987, until the 31st day of December,
1988. To each subsequent installment when due, shall be added interest for
one year on all unpaid installments.
• 3. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment, to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid by the 1st day of October, 1987; and he may, at any time
thereafter, pay to the City Treasurer the entire amount of the assessment
remaining unpaid, with interest accrued to the 31st day of December, of the
year in which such payment is made. Such payment must be made before October
10, or interest will be charged through December 31, of the next succeeding
year.
4. The Clerk shall forthwith transmit a certified duplicate of this
assessment to the County Auditor to be extended on the proper tax lists of the
County, and such assessments shall be collected and paid over in the same
manner as other municipal taxes.

BY ADDING SUBDIVISION NO. 25 AND NO. 26 THERETO, RELATIVE TO
"TRAFFIC, LOCAL REGULATIONS"
THE CITY OF HUTCHINSON DOES ORDAIN:
Section 1. Section 710:10 of the 1974 Ordinance Code of the City of
Hutchinson, entitled "Stop Streets" is hereby amended by adding thereto Sub-
division No. 25 and No. 26, which shall be as follows:
Subd. No. 25. That the following named street to -wit:
Fourth Avenue Southwest at the intersection of Grove Street
and the same is hereby declared, established and made a stop
street.
Subd. No. 26. That the following named street to -wit:

RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS
PROJECT 90. 87 -35
Resolution No. 8512
WHEREAS, a certain petition requesting the improvement of Hilltop Lane
and Campbell Lane adjacent to Bloekt and Block 2 in Woodridge Addition by the
construction of Bituminous Surfacing and Appurtenances, was duly presented to
the Council on the 28th day of April, 1987; and
WHEREAS, pursuant to a resolution of the Council adopted April 28th,
1987, a report has been prepared by Eugene Anderson, Director of Engineering,
with reference to the improvement, and this report was received by the Council
on May 12th, 1987;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
1. The Council finds and determines that said petition was signed by all
owners of real property affected by the improvement, and that the entire cost
of the improvement is to be assessed against such property pursuant to
Minnesota Statute 429, at an estimated total cost of $12,444.00.

The State of Minnesota has adopted the 1987 Minnesota State Building Code.
The City of Hutchinson must adopt the 1987 Minnesota State Building Code
in order to use and enforce the codes and appendices. Attached is the
Ordinance necessary for adoption of said Building Code.
We should be receiving the new code books by the end of May.

enforced within the inoorporated limits of the City, and extraterritorial
limits permitted by Minnesota Statutes, 1964.
The Building Department shall be the Building Code Department of the City
of Hutchinson. The Administrative Authority shall be a State Certified
"Building Official ".
The Appointing Authority shall designate the Building Official for the
jurisdiction of the City of Hutchinson.
Section 3.
A. Permits, Inspections and Fees. Permits, inspections and collection
of fees shall be as provided in Chapter 3 of the Uniform Building
Code, 1982 Edition.
B. Surcharge. In addition to the permit fee required by item A above,
the applicant shall pay a surcharge to be remitted to the Minnesota
Department of Administration as prescribed by Minnesota Statutes
1984, Section 16B-T0-
Section 4. Violations and Penalties. (The penalty described in the
• Uniform Building Code, 1982 Edition, Section 205 as amended shall be in
keeping with Minnesota Statutes 609.033 - 609.034 which provides for a maximum
fine of $700.)
Section 5. Effective Date of Ordinance. The effective date of this
Ordinance is

The City Council of the City of Hutchinson does ordain as follows:

the building code for the City of Hutchinson. Such code is hereby
incorporated in this ordinance as completely as if set out in full.

WITNESSETH:
made and entered into on this day of
1987, by and between the Town of Hassan
subdivision of the State of Minnesota,
Grantor, and the City of Hutchinson, a
of the State of Minnesota, hereinafter
THAT, for and in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt
and sufficiency of which are hereby acknowledged, Grantor does
hereby give and grant in perpetuity to the City an easement,
right -of -way, privilege and authority to construct, repair,
maintain and operate an underground sanitary sewer /waste water
treatment force main on, along, through, across or under the
following described lands lying and being in the County of McLeod
and State of Minnesota, to -wit:
That Part of Outlot A in Hutchinson Industrial District
lying East of the following described line:
Beginning at a point on the South Line of Outlot A, 165.0
• feet East of the Southwest Corner of Outlot A; thence North
parallel to the West Line of Outlot A to a point on the
Northeasterly Line of Outlot A;
Together with;
A 66.00 foot wide strip of land across Lots 9, 10, 12, 15,
16, 17 and 18 of Auditor's Plat of the West Half of Section
5, Township 116 North, Range 29 West.
The centerline of said 66.00 foot wide strip is
described as beginning at the Northwest Corner of said
Lot 10; thence South 5 degrees 28 minutes 41 seconds
West a distance of 1,259.54 feet, more or less, to the
Northerly lot line of Lot 24 of Auditor's Plat of the
West Half of Section 5, Township 116 North, Range 29
West and said centerline there terminating. (For
purposes of this description, the West Line of said Lot
10 is assumed to have a bearing of South 0 degrees 44
minutes 18 seconds West.)
Together with:
The East 40.00 feet of the North 725 feet of Lot F and the
East 40.00 feet of the South 200 feet of Lot A of Auditor's
• Plat of the South half of Section 6, Township 116 North,
Range 29 West; and the West 26 feet of Lots 24, 28 and 30 of
Auditor's Plat of the West Half of Section 5, Township 116
North, Range 29 West.
Together with the right of the City, its heirs or assigns, •
to construct, repair, maintain and operate said underground
sanitary sewer /waste water treatment force main, adding thereto
from time to time, across, through or under the above - described
premises, to cut and remove from said premises any trees or other
obstructions which may endanger the safety or interfere with the
use of said sanitary sewer /waste water treatment force main, and
the right of ingress and egress to and over said above - described
premises for the purpose of maintaining, repairing, renewing or
adding to said sanitary sewer /waste water treatment force main,
and for doing anything necessary, useful or convenient for the
use of the easement herein granted; also the privilege of
removing at any time any or all of said improvements.
It is further agreed as follows:
1. The City agrees that the work of installing and
maintaining said sanitary sewer /waste water treatment force main
shall be performed and completed in a good and workmanlike manner
and in accordance with plans and specifications as prepared by
the City. The City further agrees that none of the costs of
planning, constructing, operating, maintaining, improving or
expanding said sanitary sewer /waste water treatment force main
and underground water main shall be taxed, charged, or assessed
to Grantor.
2. The City assumes and agrees to pay for all loss, damage, •
injury or death, including costs and expenses incident thereto,
caused to any person or entity, including Grantor, or to the
property of any person or entity, including Grantor, by or during
the construction of said sanitary sewer /waste water treatment
force main or by the maintenance and repair thereof, or by its
presence or use of the property of Grantor up to the amount of
insurance required to be carried by the contractor; and the City
shall indemnify Grantor against and save it harmless from such
liability for any such loss, damage, injury or death. In case any
suit shall be brought against Grantor on account of any suc-
loss, damage, injury or death, the City agrees at its own expense
to assume the defense thereof and to pay such judgments recovered
against Grantor, or costs incurred by Grantor on account of any
such suit; provided, however, that in case any suit be brought
against Grantor for any such loss, damage, injury or death,
Grantor, providing it has been served with proper summons, shall
give notice in writing of any such suit and of such service to
the City Clerk of the City in order that the City may make a
proper defense.
3. The City agrees that it shall be responsible for any
destruction of or damage to crops, trees, shrubbery, fences,
improvements, and the land itself, resulting directly from the
activities authorized under this easement, either by restoring or •
repairing such damage or by making a cash settlement with
Grantor, its heirs or assigns, in lieu thereof. The City further
agrees to restore the property above described to the same

• condition, grade, elevation, contour and slope as existed prior
to the grant of this easement. The City expressly agrees to
provide sufficient graveling and blading of the property for a
period of three (3) years following completion of the improvement
to allow for compaction of soils and proper restoration of the
surface of the property.
4. The City agrees that this easement shall not adversely
affect the public's right of access to or travel over the
property above described, and that no abutting property owner
will be denied reasonable access on said roadway during
construction or any subsequent maintenance work.
5. The City agrees that to the extent feasible the
underground sanitary sewer /waste water treatment force main (the
pipe itself) will lie outside and to the West of the existing
public roadway.
IN WITNESS WHEREOF, we have hereunto set our hands and seals
and acknowledge this instrument to be our free and voluntary act
for the uses and purposes herein set forth.

A petition has been presented which is signed by all owners of the property in
proposed Sunset Ridge Addition for utilities, grading and aggregate base
improvements. The Preliminary Plat for this subdivision was approved by the
Council at the April 28th meetingr together with Resolution Ordering
Preparation of Engineer's Report for the afore described improvements and
Resolution Receiving Report and Calling for Hearing on Improvement.
• Since the statute allows the Council to order improvements without a public
hearing in cases where owners of all property benefitted by the improvements
have petitioned the Council to construct the improvements and to assess the
entire cost against their property.
I recommend that the accompanying resolutions be adopted. The status of the
improvements will thereby be advanced to authorizing preparation of plans and
specifications without a public hearing.

BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. A certain petition requesting the improvement of Connecticut Street
and Connecticut Court in Sunset Ridge Addition in accordance with the
Preliminary Plat approved by the Council on April 28th, 19879 by the
construction of Sanitary Sewer, Watermain, Storm Sewer, Sewer and Water
Services, Grading, Aggregate Base and Appurtenances, filed with the Council on
May 12th, 1987, is hereby declared to be signed by the required percentage of
owners of property affected thereby. This declaration is made in conformity
to Minnesota Statute, Section 429.035.

Because of personal health concerns I have had since my surgery
a year ago, please be advised that I will be taking early retirement
fran the City of Hutchinson. My last day of actual work will
be June 30, 1987, after which I will be taking my vacation leave.
I will be continuing the medical insurance coverage as provided

MUTUAL AID PACT
0
The Mutual Aid Pact of 1975 designates the McLeod
County Sheriff as Coordinator for any Mutual Aid needs
within McLeod County. The following procedures have
been established by participants to implement requests
for assistance.
Upon reciept of a call for assistance from any
community, a part of Mutual Aid Pact, the McLeod County
Sheriff will alert all cooperating agencies as to the
emergency and the possible need for manpower and assistance.
It is important that the requesting agency apprise the
Sheriff of exactly what the emergency is and what additional
resources will most likely be needed. If possible, the
Sheriff or his•represenative will make an estimate of the
situation by a personal visit to the scene or by consulta-
tion with supervisory personnel of the requesting agency.
When an estimate of the situation has been made, the •
Sheriff will then notify all cooperating agencies regarding
the manpower and equipment needed and coordinate this for
the requesting agency. This is an important aspect of the
Pact as it will usually permit the requesting agency to
allocate its particular resources to the immediate problem.
An area of concern for administrators may be the
decision as to when to invoke Mutual Aid requests. As
denoted in section IV, subdivision 2 of the Joint and Coop-
erative Agreement For the Use of Police Personnel and Equip-
ment, this is not normally at the discretion of the requesting
official.- A safe assumption. might be that any incident which
is beyond the capabilities of the requesting agency and is of

an emergency nature, will justify Mutual Aid assistance.
For this reason it is suggested that each chief of police
aquaint his personnel with the Mutual Aid Pact procedures.
A further recommendation would be that each officer within
a department have a basic familiarity with Mutual Aid, his
responsibilities when reporting to another agency and the
protection afforded him under his department's Workmen's
Compensation. (Refer to section IV, subdivision 6.)
In conjunction with explaining the Mutual Aid Pact,
law enforcement administrators may also find it beneficial
to do some advance planning should they ever have occasion
to invoke it. For example, consideration should be given
to such things as parking space for the vehicles of outside
agencies, accessible assembly points and arrangments for
briefing personnel as they arrive.
To assist the Sheriff in his capacity as the Mutual Aid
Coordinator, it is important that he have accurate, written
documentation of all instances of Mutual Aid situations.
Therefore, it is imparative that each requesting party, as
soon as possible after asking for Mutual Aid assistance, for-
ward to the Sheriff a written copy of same. This letter should
contain the following information: date, time, brief des-
cription of the incident, type of assistance requested and the
name and title of the requesting party.
It is realized that in some instances, due to the time
element and nature of the incident, mutual assistance between
two agencies may not require the coordination services of
the Sheriff's office. In these situations it would be
appreciated if the Sheriff could recieve from the requesting

quested and the name of the responding agency.

The general purpose of this agreement is to provide a means
by which a party to this agreement may obtain police assistance
from other parties when the party requesting such assistance deems
it to be necessary. This agreement is made pursuant to Minnesota
Statutes, Section 471.59.
II.
DEFIMTION OF THE
For the purpose of this agreement, the terms defined in
this section shall have the meanings given then.
Subdivision 1. "Party" means a governmental unit which is
a party to this agreement.
Subdivision 2. "Eligible party" means a governmental unit
which is entitled to become a party to this agreement, at its •
awn option. The eligible parties are the County of McLeod and
every city, village and town within the County of McLeod, State of
Minnesota.
Subdivision 3. "Requesting party" means a party which
requests police assistance fran other parties.
Subdivision 4. "Responding party" means a party which provides
police assistance to a requesting party.
Subdivision 5. "Police assistance" includes police or sheriff
personnel and equipment.
Subdivision 6. "Requesting official" means the person who

has been designated by the requesting party to request police
• assistance from other parties.
Subdivision 7. "Responding official" is the person who
has been designated by a party to determine whether and to what
extent that party should provide police assistance to a requesting
party-
III.
FO-;amrxy
The parties to this agreement shall consist of as many
eligible parties as shall elect, through resolutions adopted by
their respective* governing bodies, to become parties. Upon the
adoption of such resolution by an eligible party an executed copy
of this agreement shall be sent by it to the County Sheriff of
McLeod County, together with a certified copy of the resolution
authorizing the agreement. lihen any of the eligible parties
have elected to become parties and have provided such resolutions,
this agreement shall become operative, and shall continue in force
until, by reason of withdrawals as hereinafter provided, the
number of parties to this agreement is reduced to less than three.
The Sheriff of McLeod county shall maintain a current list of the
parties of this agreement, he shall notify the designated responding
official of each of the parties of such change.
IV.
Subdivision 1. Each party shall designate, and keep on
file with the County Sheriff of Mcleod County, the name of the
person of that party who shall be its requesting official and
responding official. A party may designate the same person as
both the requesting official and the responding official. Also,

a party may designate alternate officials to act in the absence
• of the official.
- Subdivision 2. Whenever, in the opinion of a requesting
official of a party, there is a need for police assistance
fran other parties to assist the police officers of the requesting
party, such requesting official may, in his discretion, call
upon the responding official of any other party to furnish police
assistance to and within the boundaries of the requesting party.
Subdivision 3. Upon the receipt of a request for police
assistance fram a party, the responding official for any other party
may authorize and direct the law enforcement officers of the respond-
ing party to provide police assistance to the requesting party.
Whether the responding party shall provide such police assistance
to the requesting party and, if so, to what extent such police
assistance shall be provided shalLte determined solely by the
responding official (subject to such supervision and direction as
may be applicable to him within the governmental structure of the
party by which he is employed). Failure to provide assistance will

not result in liability to a party.
Subdivision 4. When responding party provides police
assistance under the terms of this agreement, it may in turn
request assistance from other parties as "backup" durmng the time
that it is providing police assistance outside its boundaries.
Subdivision 5. Whenever a responding party has provided
police assistance to a requesting party, the responding official
may at any time recall such police assistance or any part thereof
to the responding party, if the responding official in his best
judgment deems this necessary.
Subdivision 6. When a responding party supplies law

enforcement officers to a requesting party, such officers shall
• repk n under the direction and control of the responding Party:
shall be paid by the responding party; shall be protected by the
workmen's Compensation of the responding party; and shall otherwise
be deemed to be performing their regular duties for the responding
party. However, the responding party shall undertake to coordinate
with the requesting party the police assistianee which it provides.
Subdivision 7. A responding party shall be responsible for
its own personnel, equigent and supplies and for injuries or
death to any such personnel or damage to any such equipment or
supplies, exept that unused equipment and supplies shall be returned
to the responding party by the requesting party when circumstances
permit this to be done.
Subdivision 8. The requesting party shall not be res_porr
sible for any injuries, losses or damages to persons or property
arising out of the acts of any of the personnel of a responding party
nor shall the responding party be responsible for any injuries,
. losses or damages arising out of the acts of any of the personnel of
the requesting party or the personnel of any other responding party.
Subdivision 9. While a Civil Defense emergency is in effect
under local ordinance or state or federal law within the boundaries
of a party hereto, said party shall not request assistance from
another party.
V.
WITHDRAii41L AND TERMINATION
This agreement shall continue in effect until the number
of parties is less than three. Any party may withdraw at any time
upon thirty, (30) days' written notice to the Sheriff of McLeod

County; such a party nay become a party if later entering into this
agreement. The Sheriff of ticleod County shall thereupon give no-
tice of such withdrawal, and of the effective date thereof,
to all other parties, as hereinbefore provided.

This project provides for the reconstruction of sanitary sewer in the area of
Bluff Street and 5th Avenue N.E. and 6th Avenue N.E. Bids were taken on two
alternates, one being a gravity system and the second being a lift station
with a force main. The gravity system is deeper than the lift station
alternate, and the low bid was $133,690.50, compared to the alternate lift
station bid of $110,447.25.
Economic analysis of the two alternatives by determining annual cost and also,
capitalized cost results in them being nearly equal because of the following
operation and maintenance estimated costs associated with the lift station:
1. Annual power comsumption of $400.00, present day cost.
2. Annual pump inspection and maintenance $275.00 plus parts as
required, present day cost.
3. Pump replacement every 20 years, more or less, $5,300.00, present
day cost.
Since the gravity system is a viable alternative and in any case, is superior
to a lift station system from the standpoint of reliability and maintenance,
and since for this project, the two alternatives are economically comparable,
I recommend that a contract be awarded for the gravity system alternative in
the amount of $133,690.50.

The Hutchinson Police Civil Service Commission is on record as
opposing the demotion of Nancy Buss.We recommend that the council
rescind the demotion and to work within the rules and regulations
of the Civil Service Commission.
To our knowiadge no action has been taken regaidding the above.

The meeting was called to order at 7 :30 p.m. by Chairman Boshlks. Nelson/Buchanan
moved approval of the March 9 minutes. Carried. Johnson/Bubr moved acceptance of the
treasmeer's report. Carried.
Thd first quarter summary shows that 25.92% of the budgeted amount for the year has
�son spent. Members of the Executive Committee received copies of the 1986 auditor's
eport. This report is filed with all governing units and the state, and is given to
all board members.
Director's report:
1. The March circulation figures show a healthy increase over March, 1986. Clippings,
the Public Library Newsletter and the IDS newsletter were passed around.
2. Continuing education activities:
a. A second PLS staff retreat is being planned for late October at Green Lake bible
Camp. Tentative dates are October 2223, 1987.
b. A Chdldren✓Young Adult Workshop, sponsored by SAM?4IB, will be held iii Willmar on
May 6 and at Southwest State May 7.
3. Update on buildings:
a. Atwater Is planning to remodel the front of the library building.
b. Glencoe - Library board members favor the purchase of the IGA building with an area
of 8700 square feet. The decision to buy the building is still pending.
c. Hector - At present the library is in rented quarters. The board has been offered a
long -term loan from a local resident to buy the building.
d. The Raymond Library is having an open house April 25, 1987.
e. Spicer - A proposal has been made to move the library to an old depot at one edge of
town. The city council has turned don a request to reject this location. ,A public
meeting is scheduled for April 21, 1987.
Nelson/Turck moved payment of the bills. Carried.
OG A is supporting passage of bills on access and automation. The access bill would
require all counties in the state to provide library services. (Counties in the PIS
.area not affiliated with a regional system are Renville, Lac Qui Parle and Yellow
Medicine). The automation would allocate $1,800.000 to the regional system over a
two -year period. The bills are separate in the Swats. The House's Library Article
Includes state aid to libraries and the acosse bill.
Four governing units — Hutchinson, Kandiyohi County, Meeker County and Ortonville - -have •
not signed the Revised Agreement. This agreement is not effective until all governing
units have signed it but there is no deadline.
New business:
1. Suggested procedure for developing and approving the 1988 Budget:
Before June, 1987 -- Personnel committee make recommendations to the finance committee
on personnel costs for 1988
July, 1987 - Finance committee submit the proposed budget to the full board
August, 1987 --Full board vote approval of the proposed budget
September, 1987 -- Submit the proposed budget to the governing units
2. The full board will meet in May, July and August. Executive committee meetings are
in June and September.
3. Applications for a Technical Service Director to be located in Montevideo are being
receivdd through April 30, 1987.
The full board will meet May 11.

THE HUTCHINSON SAFETY COUNCIL
The Hutchinson Safety Council met on March 30, 1987 at the Fire Hall
at 12:00 noon. Present were 15 members.
The meeting was called to order by President Warren Kempfert. We
observed a moment of silent prayer.
The minutes of the February meeting were read and approved. The
treasurer's report was read.
For old business Marlin Torgerson reported he has selected council
members to find programs for our meetings through August. Orville
Kuiken will arrange the April program.
Chairman Kempfert asked about Les Linder's concern brought before our
Council in February regarding traffic concerns. Karlin Torgerson
reported that the City Council is in continuous communication with
the State. Another meeting is scheduled soon and Marlin will check
with them regarding lights for the areas of concern.
The first item of new business was a letter from the 1987 Senior Class
Party Finance Committee asking for a donation for the graduation
• party. Larry Ladd moved we spend the same as last year, $25.00.and
purchase a prize. Marlin Torgerson seconded the motion and it carried
unanimously. John Renyolds will be asked to purchase the gift.
Chairman Kempfert noted the Minnesota Safety Council conference will
be May 12 and 13. It is especially aimed at the industrial area.
He had handouts for those interested.
George Field announced that next week will be the Health Fair at the
Mall. It was decided we should keep this in mind for future years
to present information on either severe weather and /or seat belts.
The meeting was adjourned.
Our next meeting will be April 27, 1987 at 12:00 noon at the Fire Hall.

HUTCHINSON FIRE DEPARTMENT
REGULAR MEETING
Monday, April 6, 1987

The meeting was called to order at 8:12 p.m. Minutes of the previous meeting
were read and approved.
Mike Schmidt asked if and when we were having the fire department camp -out.
It was suggested the second week -end in June.
Chief Henke reported that the Town Boards want the old fire number system with
new signs. The committee will continue with that recommendation.
The audit is complete and everything is in order.
Ass't. Chief Emans reported on #237. The committee will be going to Pierce
and 3D Companies to inquire on refurbishing #237.
Charles Lingbeck has applied for membership to the department. He will be
investigated in April and voted on at the May meeting.
There was alot of discussion regarding grass fires. Use common sense when it
comes to how many you can make.

There will be a Sky Warn class Weds., April 26th, 7 to 9 p.m. at the Silver
Lake Auditorium.
The floor was opened to discussion regarding the tabled motion on the purchase
of a dry suit. A motion was made and seconded to bring the previous motion to
the floor. After some discussion a motion was made and seconded to purchase
one wet suit. Motion passed.
Gary Forcier suggested we purchase a new chain saw. There was discussion on
the matter and it was left to be discussed by the officer's.
Chief Henke discussed the community Right - To - Know, and what our
involvement is. It is felt we should wait for guidelines from the State.
There was a lengthy discussion regarding the Downtown Sprinkler System,
whether we supportit or not. It was felt we should seek other means for
prevention.

Monday, April 13, 1987
The meeting was called to order at 6:58 p.m.
Chain saw needs repair. It is recommended we trade it in on a new one. Gary
Forcier had price quotes that he reported on. Motion made and seconded to buy
a chain saw and cut off saw from the General Fund. Motion passed.
It is suggested we purchase a small refrigerator or cooler for the back of
• #235 for beverages while firefighting. Brad Emans had price quotes for these
items. Motion made and seconded that we purchase the largest refrigerator
possible to fit in #235, from Sears.- Motion passed.
The meeting was adjourned at 7:13 p.m.

RELIEF ASSOCIATION
Monday, April 20, 1987
The meeting was called to order at 9:22 p.m. Minutes were read and approved •
with minor changes.
Gary Henke is waiting for his books to come back from the annual audit.
Hewitt Assoc. actuarial study is now underway. The cost should be less than
$2,000.00.
A motion was made and seconded to have Florian Thode's name put on the pension
roll as of April 1, 1987. Florian has an active date of November 2, 1964 and
a retirement date of December 7, 1981. Motion passed.
Motion was made and seconded to add Jamie Emans, Scott Powell and Kevin Piehl
to the Association membership. Also, a motion was made and seconded to drop
Jeff Wegner from membership. Both motions passed.
We have $95,000.00 in investments coming due in April and May. We will be re-
investing.
President Smith asked for two volunteers to make recommended changes to the
By -Laws and report back at the July meeting. Gary Henke and Steve Schramm
volunteered.

SUBJECT: Pre 73 Retirees Assessment

Call your representative and senator to object to any employing unit assessment
to fund the lump sum payments to PERA members who retired prior to 1973 (the
year of change to the high five).
Each year for the last ten these retirees with generally lower benefits have
received a 13th check funded by a state general fund appropriation. Last year
the 13th check was $19 multiplied by years of service. This year the proposal
is $25 per year of service.
The governor's budget contained six million dollars from the general fund to pay
a $25 /year benefit to pre 73 teachers and members of the Minneapolis Employees
Retirement fund. The governor recommended taking the necessary funds for other
local and state pre 73ers from the better funded PERA and MSRS active fund. The
Legislative Commission on Pensions and Retirement rejected that approach as
unfair and damaging to the funds and likely to cause anxiety among retirees and
public employees as to the safety of their funds.
The House State Departments division of the appropriations committee being
desperate to come up with funding for programs to which the house has committed,
has revived the governor's proposal with a bizarre twist. It has adopted language
authorizing the PERA Board to impose an employer additional contribution of up
to .15% of salary of PERA general fund members and .06% of salary applied to
payroll of police and fire fund members. A similar employer change is
authorized in the state retirement plan.
The legislation again penalizes those funds which were most prudent and
conservative in their expenditures, benefits and funding. It mandates increased
city expenditures (just under 1 million dollars per year) and is likely to
continue this annual cost for the forseeable future, for a program that buys no
local services and the size of which is entirely determined by the legislature
and governor.
INSTALLATION OF SIGNAL LIGHT - HWY. 7 WEST /SCHOOL ROAD
After discussing the situation with Mr. Gene Setrum, DOT, and Randy at Quade's, the follow-
ing timetable has been established:
May 8, 11, 12 Installation by Quade's
May 12 -14 Inspection by DOT
I have also been informed there was a change -order on the job between DOT, prime contractor
and subcontractor. The overhead "arm" of the signalization has caused the delay.
WEEKLY MEETING AT WASTEWATER PROJECT
• keep the project moving, Donohue, the contractor, and myself have had weekly meetings.
Each Tuesday at 10:00 A.M: we hold these sessions. Copies of our minutes will be in the
Council packet for your information.
PARKS GRANT PRESENTATION
Bruce Ericson will be at the Council meeting to make a presentation on improvements at the
bass pond and Tartan Park areas. Our local share can be paid over a three year span.
CITY ENGINEER STARTS
Gene Anderson started on Monday, and we have been working on getting him acquainted with
the employees and contractors. Today he attended our meeting with the contractors at the
wastewater site.
TOWNSHIP OFFICIALS TO ATTEND COUNCIL MEETING - WASTEWATER FORCEMAIN

�e township clerk, Wayne Olivia, and myself are suggesting a workshop on Monday, May 4,

and Council are invited. Barry Anderson has informed me we have a 40 -foot wide corridor
of easements at this time. I have taped a map on the wall for the Council meeting tonight.

AIRPORT APPRAISALS COMPLETED
Please be advised that the airport appraisals are completed. Atty. Barry Anderson would
like until the next Council meeting (May 12) to look the appraisals over and make a recom-
mendation to the Council.
POLICE STATION - PRE- CONSTRUCTION MEETING
The pre- construction meeting for the new police station has been scheduled for Wednesday,
May 6 at 10:00 A.M.
REVIEW OF AUDITORS - CASH POLICY(S)
Ken Merrill and I will be reviewing the recommendations with the City auditors this com-
ing Thursday morning. We intend to implement recommendations and notify the Council.
The report, itself, will be mailed to you for your information.
COUNTY ASSESSOR OFFERS DATES FOR BOARD OF REVIEW
Tony Victorian has advised me that all homeowners will have received valuation cards this
year (only properties with changed values received cards last year). Tony anticipates a
much larger turnout at this year's Board of Review.
He offers the following evening dates:
Wednesday - June 17
or
Thursday - June 18
He also recommends starting at 4:00 P.M. in order to complete the review at one meeting.
If property(s) need to be physically examined, the Board of Review would need to recon-
vene the next day at noon (preferably) to adopt any additional adjustments.
