TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of Hutchinson, Minnesota,
will meet in the Council Chambers of the City Hall at 7:00 P.M. on the 28th
day of March, 1988, to consider the making of an improvement on:
3rd Avenue N.W. from Main Street to T.H. 7 by Construction of Storm
Sewer, Sewer /Water Services to the Property Line of all Buildings or
Buildable Sites, Grading, Aggregate Base, Curb and Gutter, Concrete
Driveway Approaches, Bituminous Surfacing, and Appurtenances,
pursuant to Minnesota Statutes, Sections 429.011 to 429.111. The area
proposed to be assessed for such improvement is the benefitted property, for
which property owners shall receive mailed notice.
The estimated City Cost is $259,667.00 and the estimated Assessable Cost is
$258,345.00, for a total estimated cost of such improvement of $518,012.00.
Such persons as desire to be heard with reference to the proposed improvement
• will be heard at this meeting.

RE: Public Hearing for 3rd Avenue N.W. Improvements
The improvement hearing for Project 88 -17, the 3rd Avenue Northwest storm
sewer and street reconstruction project, is scheduled for March 28th. If
the project is ordered, it appears that, with the present schedule of
Council meetings, the earliest contract could be awarded is June 14th.
Construction could then begin in late June or early July.
Attached for the Council's consideration after the improvement hearing, is
• a resolution ordering the project, and a resolution approving plans and
specifications and authorizing advertisement for bids.

RESOLUTION NO.
WHEREAS, a resolution of the City Council adopted the 8th day of March,
1988, fixed a date for a Council Hearing on the improvement of 3rd Avenue
Northwest from Main Street to T.H. 7 by the construction of Storm Sewer, Sewer
and Water Services to the Property Line of all Buildings or Buildable Sites,
Grading, Aggregate Base, Curb and Gutter, Concrete Driveway Approaches,
Bituminous Surfacing, and Appurtenances;
AND WHEREAS, ten days' published notice of the hearing through two weekly
publications of the required notice was given and the hearing was held thereon
on the 28th day of March, 1988, at which all persons desiring to be heard
were given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
1. Such improvement is hereby ordered as proposed in the council
resolution adopted the 8th day of March, 1988.
2. Eugene Anderson is hereby designated as the Engineer for this
improvement. He shall prepare plans and specifications for the making of such •

RESOLUTION APPROVING PLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS

PROJECT NO. 88 -17
WHEREAS, pursuant to a resolution adopted by the Council on March 28th,
1988, the Director of Engineering has prepared plans and specifications for
the improvement of 3rd Avenue Northwest from Main Street to T.H. 7 by the
construction of Storm Sewer, Sewer and Water Services to the Property Line of
all Buildings or Buildable Sites, Grading, Aggregate Base, Curb and Gutter,
Concrete Driveway Approaches, Bituminous Surfacing, and Appurtenances, and has
presented such plans and specifications to the Council for approval;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
1. Such plans and specifications, a copy of which is attached hereto and
made a part hereof, are hereby approved.
2. The City Administrator shall prepare and cause to be inserted in the
official newspaper, an advertisement for bids upon the making of such
improvement under such approved plans and specifications. The advertisement
shall be published for two weeks, shall specify the work to be done, shall
• state that bids will be opened and considered by the Council at 2:00 P.M. on
May 13th, 1988, in the Council Chambers of the City Hall, Hutchinson,
Minnesota, and that no bids will be considered unless sealed and filed with
the Administrator and accompanied by a cash deposit, cashier's check, bid bond
or certified check payable to the City of Hutchinson for 10 per cent of the
amount of such bid.

technically speaking, it may not be necessary to have City
Council approval. However, in the interests of keeping everyone
fully advised, I am at this time requesting that the Council
approve payment of the sum of $10,000 to Citizens State Bank of
Gibbon, the record owner of the former Albertson property and
payment of the sum of $5,500 to Jerome Renner.
As to the Albertson parcel, I am holding in escrow the clear zone
easement and the quit claim deed, both of which have been exe-
cuted by Citizens State Bank of Gibbon. As to the Renner pro-
perty, approval will have to be subject to appropriate
examination of title. You may recall that with respect to both
of these parcels, the review appraisal and the Minnesota
Department of Transportation appraisal were in agreement with the
figures specified. While this, of course, will be a payment from
the City of Hutchinson, James Groehler, with the State Department
of Transportation, advises that there should be little difficulty

in setting up the appropriate account for repayment to the City's
percentage.
I am still arguing with the State of Minnesota on the subject of
the appropriate treatment of the City of Hutchinson parcel.
You may be aware that the Citizens State Bank of Gibbon has had
financial difficulties and it is my understanding that ownership
of the bank has now changed. However, I was able to arrange for
a closing in escrow (hence the photocopies of the enclosed docu-
ments) prior to the transfer, assuming I can get the money to the
bank by the first of April. Therefore, it is important that we
close this transaction this coming week.
With respect to Renner, I am merely asking that the Council
approve payment of the agreed upon sum of $5,500 when the legal
requirements dealing with transfer of title have been completed.
If additional information is required, do not hesitate to contact
• me.

SUBDIVISION AGREEMENT
CASA ADDITION
• CITY OF HUTCHINSON, MINNESOTA
THIS AGREEMENT, made and entered into the day and year set forth
hereinafter, by and between John Miller S Sedona Miller, husband and wife,
hereinafter called the "Subdivider ", and the City of Hutchinson, a Municipal
corporation in the County of McLeod, State of Minnesota, hereinafter called
the "City ";
WITNESSETH:
WHEREAS, the Subdivider is the owner and developer of part of the
Northwest Quarter of the Southeast Quarter of Section 36, Township 117 North,
Range 30 West, City of Hutchinson, McLeod County, Minnesota, to be known as
CASA ADDITION, and;
WHEREAS, City Ordinance 464 AND 466 requires subdividers to make certain
improvements in the subdivision;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
1. It is understood and agreed that the following improvements along
T.H. 7 and 22 have been completed by the City to date and the amount
shown is the cost incurred by the City corresponding to the indicated
assessment roll for constructing the improvements to serve the
• subdivision:
Sanitary Sewer Improvements, Project 1969 -1, Corresponding to
Assessment Roll No. 33 Adopted September 14, 1970, $1,472.00 Plus
Interest;
Water Main Improvements, Project 1969 -1, Corresponding to
Assessment Roll No. 33 Adopted September 14, 1970, $1,004.95 Plus
Interest;
and the following deferred assessments:
Assessment Roll No. 33, Project 1969 -1, Adopted September 14,
1970, Storm Sewer Improvements, $5,096.86 Plus Interest.
2. It is understood and agreed that the aforedescribed costs and the
deferred assessment for Roll No. 33, will be allocated to lots in
Casa Addition as follows:
Sanitary sewer, corresponding to Roll No. 33, base cost of
$1,472.00 plus accrued interest of $1,491.32, for a total
assessable cost of $2,963.32, will be allocated equally to the
lots in Casa Addition.

Water main corresponding to Roll No. 33, base cost of $1.004.95
plus interest of $1,017.84, for a total assessable cost of
$2,022.79, will be allocated equally to the lots in Casa Addition.
Assessment Roll No. 33, storm sewer base assessment of $5,096.86
plus accrued interest of $5,186.01, for a total assessment cost of
$10,282.87, will be activated and allocated equally to the lots in
Casa Addition.
3. It is understood and agreed that the Subdivider approves the
activating of the deferred assessments and the allocation of
assessable costs as hereinbefore described in paragraphs 1 and 2, and
that the Subdivider hereby waives all rights to a public hearing and
appeal of the cost of same.
4. It is understood and agreed that, in the event that Lot 2 and Lot 3
should fall under separate ownership, prior to the deeding of either
lot, the Subdivider shall execute and cause to be recorded in the
Office of the McLeod County Recorder, a roadway and utility easement
not less than 25 feet in width along and abutting the east line of
Lot 3 from the south line of Lot 3 to the north line of Lot 3 for
access to Lot 2. A recorded copy of said easement shall be provided
to the City.
It is further understood and agreed that when development is pending •
for the property east of and abutting CASA ADDITION, the Subdivider
shall negotiate in good faith with the owner of said property, for
mutual roadway and utility easements along and on both sides of the
east line of Lot 3. Easements should be not less than 25 feet in
width, and subsequent to execution shall be recorded in the Office of
the McLeod County Recorder. A recorded copy of said easements shall
be provided to the City.
5. It is understood and agreed that the Subdivider hereby petitions the
City for the following improvements on Texas Avenue from California
Street to the East Terminus of Texas Avenue:
A. Sanitary Sewer and Service Leads
B. Water Main and Service Leads
C. Storm Sewer and Service Leads
D. Street Grading
E. Aggregate Base
F. Curb and Gutter
G. Surfacing
It is understood and agreed that said improvements will be
constructed under several contracts beginning in 1988.

9• It is understood and agreed that all electrical, gas, telephone and
cable television lines in easements that may have to be moved by
request of the property owner, will be done at said property owners
expense.
10. It is understood and agreed that to fulfill City Policy, two trees
will be provided in the margin (boulevard) of each lot. The
Subdivider or property owner shall purchase from the City and pay one
half the cost of said trees and the City's portion of the payment for
the trees shall not exceed $10.00 per tree. Said trees shall be
planted by the property owner.
The Subdivider hereby petitions the City to install two trees per lot
and assess the properties in the subdivision, the cost less allowed
City's portion of said cost. Said installation to be included in the
last assessable improvement to be installed for the subdivision. All
trees installed at the time of said last assessable improvement will
be credited to the properties where the trees are located.
Species selection will be determined by the Tree Board. Should the
Subdivider or property owner wish to plant a tree which deviates from
the selected specie list, he /she must present his /her request to the
• Tree Board.
The City will, at no charge to the property owner, replace any tree
which dies within one year of the time of planting.
11. This agreement shall be binding upon and extend to the heirs,
representatives, assigns and successors of the parties.
12. It is understood and agreed that it is the responsibility of the
Subdivider to record this agreement at the County Recorder's Office
and that no Building Permits will be issued until said Agreement is
recorded.

The Subdivider waives all rights to public hearings and appeal for
the costs of the improvements. The waiving of all such rights shall
be binding upon and extend to the heirs, representatives, assigns,
and successors of the Subdivider.
It is understood and agreed that the costs for each improvement will
be assessed as follows:
Fifty percent of the cost of the improvements will be assessed
equally to the lots in CASA ADDITION and to other benefitted
property on the basis of square footage of property benefitted,
and the prorated share of CASA ADDITION will be assessed equally
to the lots in CASA ADDITION.
6. It is understood and agreed that the Subdivider hereby petitions the
City for storm sewer, curb and gutter, and appurtenances on the north
side of T.H. 7 8 22 adjacent to CASA ADDITION.
It is understood and agreed that said improvements may be constructed
under several contracts beginning at a time deemed feasible by the
City and by the State of Minnesota.

It is understood and agreed that the Subdivider waives all rights to
public hearings and appeal for the costs of the improvements. The •
waiving of all such rights shall be binding upon and extend to the
heirs, representatives, assigns, and successors of the Subdivider.
It is understood and agreed that the prorated share of the cost of
the improvements attributable to CASA ADDITION will be assessed
equally to the lots in CASA ADDITION.
7. It is understood and agreed that the Subdivider will make a cash
contribution to the City of Hutchinson Parks and Playground for
CASA ADDITION in the amount of $694.54, which is for one dwelling
unit per lot. Charges for additional dwelling units per lot will be
due at the time a Building Permit is issued and the cost will be
according to the City Fee Schedule for additional units at the time
said permit is issued.
8. It is understood and agreed that, prior to the installation of
electrical, gas, telephone and cable television utilities and
appurtenances in the platted easements, the Subdivider will clear any
trees and /or debris from utility easements, as per the request of the
utility prior to installation of the facility and shall grade the
easements to within 6" of finish grade.

Accompanying are resolutions approving plans and specifications and
authorizing advertising for bids for Lettings 5, 6 and 7. Projects
included in the lettings include all projects ordered by the Council for
which plans and specifications were not heretofore approved, except for
the 3rd Avenue Northwest project, which will otherwise be presented.
The resolutions also include two projects not yet ordered by the Council
- the surfacing on Tyler Street and on McDonald Drive - and the
• construction of aggregate base, curb and gutter and bituminous surfacing
on the Golf Course roadway.
Approval of the resolutions is requested so that the status of the projects

1988, the Director of Engineering has prepared plans and specifications for

Project No. 88 -01 Colorado Street from 8th Avenue N.W. to North
Terminus, and 8th Avenue N.W. from School Road to
Colorado Street and Colorado Circle from Colorado
Street to the Cul -de -sac by the Construction of

Surfacing, and Appurtenances; and
• WHEREAS, said plans and specifications have been presented to the Council

The estimated total cost assumes that an easement can be obtained for the east
30 feet of right -of -way, and that purchase or condemnation will not be
required. The total right -of -way width would then be 50 feet. The estimated
assessable cost was determined assuming $40.00 per assessable foot for
residentail frontage and $50.00 per assessable foot for commercial frontage on
the east side of Florida Street. It is assumed that no assessments will be
deferred, despite there being undeveloped property on the east side of Florida
Street.

WHEREAS, it is proposed to improve Florida Street from T.H. 7 West to
Approximately 384' North of the Centerline of T.H. 7 West by the construction
of Grading, Aggregate Base, Curb and Gutter, Bituminous Surfacing, Sewer and
Water Services to the Property Line of all Buildings or Buildable Sites, and
Appurtenances; and
WHEREAS, it is proposed to assess the benefitted property for all or a
portion of the cost of the improvement, pursuant to Minnesota Statutes,
Chapter 429,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
That the proposed improvement be referred to Eugene Anderson for study
and that he is instructed to report to the Council with all convenient speed
advising the Council in a preliminary way as to whether the proposed
improvement is feasible and as to whether it should best be made as proposed
or in connection with some other improvement, and the estimated cost of the
improvement as recommended.

a report has been prepared by Eugene Anderson with reference to the
improvement of Florida Street from T.H. 7 West to Approximately 384' North of
the Centerline of T.H. 7 West by the construction of Grading, Aggregate Base,
Curb and Gutter, Bituminous Surfacing, Sewer and Water Services to the
Property Line of all Buildings or Buildable Sites, and Appurtenances, and said
report was received by the Council on March 28th, 1988.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
1. The Council will consider the improvements of such streets in
accordance with the reports and the assessment of benefitted property
for all or a portion of the cost of the improvement pursuant to Minnesota
Statutes Chapter 429.
2. A Public Hearing shall be held on such proposed improvements on the
12th day of April, 1988s in the Council Chambers of the City Hall at 8:00
P.M., and the Clerk shall give mailed and published notice of such hearing and
improvements as required by law.
