REGULAR MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, OCTOBER 25, 1988
1. The meeting was called to order by Mayor Ackland at 7:30 P.M. The follow-
ing were present: Mayor Paul L. Ackland, Aldermen Mike Carls (arrived at
8:00 P.M J , John Mlinar, Marlin Torgerson and Pat Mikulecky. Also present:
City Administrator Gary D. Plotz, Director of Engineering Eugene Anderson,
and City Attorney G. Barry Anderson.

The invocation was given by the Rev. Harry Kelm.

Mayor Ackland called the hearing to order at 8:38 P.M. by reading the
notice of public hearing. No one was present to be heard.
Alderman Carls moved to close the hearing at 8:40 P.M. Motion seconded
by Alderman Mikulecky and unanimously carried.
Alderman Mlinar moved to approve and issue the liquor license. Motion
seconded by Alderman Mikulecky and unanimously carried.

The motion was made by Alderman Carla, seconded by Alderman Mlinar, to

Alderman Carla moved to reject second reading. Motion seconded by Ald-
erman Mikulecky. Upon roll call vote, the motion failed three to two,
with Aldermen Carla and Mikulecky voting aye and Aldermen Mlinar, Tor -
gerson and Mayor Ackland voting nay.
The motion was made by Alderman Mlinar, seconded by Alderman Torgerson,
to approve, waive second reading and adopt Ordinance No. 792. The mo-
tion carried three to two with roll call vote of Aldermen Mlinar, Tor -
gerson and Mayor Ackland voting aye and Aldermen Carla and Mikulecky
voting nay.
(d) RESOLUTION NO. 8882 - RESOLUTION GIVING APPROVAL TO CITY MULTI- HAZARD
EMERGENCY RESPONSE PLAN
The motion was made by Alderman Torgerson, seconded by Alderman Miku-
lecky, and unanimously carried, to table to November 7, 1988 meeting.
(e) RESOLUTION NO. 8883 - RESOLUTION FOR PROCLAMATION OF MINNESOTA SUDDEN
INFANT DEATH SYNDROME AWARENESS MONTH
Alderman Mlinar moved to waive reading and adopt Resolution No. 8883.
Motion seconded by Alderman Carla and unanimously carried.
(f) RESOLUTION 10. 8884 - RESOLUTION RELEASING AND REPLACING PLEDGED
SECURITIES FROM FIRST STATE FEDERAL SAVINGS & LOAN ASSOCIATION
The motion was made by Alderman Torgerson, seconded by Alderman Miku-
lecky and unanimously carried, to waive reading and adopt Resolution

(a) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
Alderman Carls moved to authorize discontinuation of service, except
whereby arrangements had been made, for noon on October 31. Motion
seconded by Alderman Mlinar and unanimously carried.
(b) CONSIDERATION OF PARKING ON ONE SIDE OF MERRILL STREET FROM CLINTON
AVENUE TO SOUTH GRADE ROAD
Following discussion of no parking on Merrill Street, Alderman Torger-
son moved to change Section 715:20, Subdivision 19, by adding the word
ing "from November 1 to May 1" for no parking on the east side of Mer-
rill Street from Clinton Avenue to South Grade Road and to waive first
reading of Ordinance No. 28/88 and set second reading November 7, 1988.
Motion seconded by Alderman Carls and unanimously carried.

Following discussion of the proposed survey, Alderman Torgerson moved
to approve the survey, to include the additional utilities questions,
and authorization to proceed as recommended. Motion seconded by Alder-
man Carls and unanimously carried.
(e) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY CARLIE KARG WITH
FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Following discussion, Alderman Mlinar moved to approve the conditional
use permit and waive reading and adopt Resolution No. 8885. Motion
seconded by Alderman Carls and unanimously carried.
(f) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY HUTCHINSON SCHOOL
DISTRICT N0, 423 WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Following discussion, Alderman Mlinar moved to approve the conditional
use permit and waive reading and adopt Resolution No. 8886. Notion
seconded by Alderman Torgerson and unanimously carried.
(g) CONSIDERATION OF VARIANCE REQUESTED BY JAY FREEDLAND WITH FAVORABLE
RECOMMENDATION OF PLANNING COMMISSION
Following lengthy discussion, Alderman Torgerson moved to continue this
item to the November 7, 1988 Council meeting. Motion seconded by Ald-
erman Carls and unanimously carried.

FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Following lengthy discussion, Alderman Torgerson moved to continue this
item to the November 7, 1.988 Council meeting. Motion seconded by Ald-
erman Mlinar and unanimously carried.
(i) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY RANDY ANDERSON FOR
DAY CARE ON BLUFF STREET WITH FAVORABLE RECOMMENDATION OF PLANNING
COMMISSION
Mr. Randy Anderson presented a site plan of the proposed day care cen-
ter and explained its operation. Mayor Ackland then read a petition
from residents in the Bluff Street area who were opposed to the loca-
tion of the day care. Several neighbors spoke in opposition of the
center because of traffic concerns and additional noise.
Following discussion, Alderman Torgerson moved to accept the recommen-
dation of the Planning Commission to approve the conditonal use permit
and to waive reading and adopt Resolution No. 8889. Notion seconded by
Alderman Carls and unanimously carried,
(j) CONSIDERATION OF CONDITIONAL USE PERMIT /PUD PLAT FOR COUNTRY CLUB
ESTATES NO. 3 REQUESTED BY L & G ENTERPRISES WITH FAVORABLE
RECOMMENDATION OF PLANNING COMMISSION
Following discussion, Alderman Torgerson moved to approve the condi-
tional use permit /PUD and to waive reading and adopt Resolution No.
8890. Motion seconded by Alderman Mlinar and unanimously carried.
(k) CONSIDERATION OF REQUEST FOR EXTENSION OF CONDITIONAL USE PERMIT AND
VARIANCE SUBMITTED BY EVERETT HANTGE WITH FAVORABLE RECOMMENDATION OF
PLANNING COMMISSION
Following discussion, Alderman Carls moved to approve the extension.
Motion seconded by Alderman Torgerson and unanimously carried.
(1) CONSIDERATION OF SKETCH PLAN SUBMITTED BY DICK MCCLURE (TWO MILE
RADIUS) WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
The motion was made by Alderman Mikulecky, seconded by Alderman Carls,
to refer the sketch plan to the County with no objection. Motion unan-
imously carried.
(m) CONSIDERATION OF PURCHASE OF MAMMOGRAPHY UNIT FOR HUTCHINSON COMMUNITY
HOSPITAL
Following discussion, Alderman Torgerson moved to approve the purchase.
Motion seconded by Alderman Carls and unanimously carried.
(n) DISCUSSION OF EMPLOYEE CHRISTMAS PARTY

Following discussion of whether or not the City could pay the employee
cost for the Christmas party, Alderman Mikulecky moved to continue past
policy. Motion seconded by Alderman Carls and unanimously carried.
(o) CONSIDERATION OF PROPOSED FEE FOR EXCAVATION PERMITS
The Director of Engineering reported it was now State law to call the
"One Call Gopher State Center" regarding excavation information. The
center in turn contacts the city involved, The League of Cities and
MN /DOT were opposed to the system.
Following discussion, Alderman Mlinar moved to approve the excavation
permit fee of $5.00. Motion seconded by Alderman Torgerson. The mo-
tion was amended by Alderman Carls to direct the City staff to deter-
mine the cost of issuance of the permit to the City for time involved
and to submit a bill to the State of Minnesota to recover City cost for
issuing the permit, Amended motion seconded by Alderman Torgerson and
unanimously carried. Main motion carried unanimously.
Alderman Carls further moved to go on record by having staff prepare a
Resolution to be sent to the League of Minnesota Cities, Coalition of
Outstate Cities, State Legislators and other appropriate state offi-
cial(s) to express the City's displeasure with the system. Motion
seconded by Alderman Torgerson and unanimously carried.
(p) CONSIDERATION OF SUPPLEMENTAL AGREEMENTS NO. 6, 7 & 8 FOR LETTING 10. 7
Following discussion, Alderman Mikulecky moved to approve and enter
into a supplemental agreement, Motion seconded by Alderman Carls and
unanimously carried.
(q) CONSIDERATION OF 1988 BUDGET STATUS FOR PROTECTIVE INSPECTIONS
DEPARTMENT
The Building Official requested appropriation of an additional $3,000
to the Protective Inspections Department's 1988 budget. Following dis-
cussion, Alderman Torgerson moved to approve the request. Motion sec-
onded by Alderman Mlinar and unanimously carried.
10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
City Administrator Plotz addressed including a discipline policy and
gift policy as part of the City's policy book.
It was reported there was a request for temporary parking restriction
on Main Street in front of the Republican Headquarters on November 1,
1988 from 7:30 A.M. to 8:30 A.M. for a political rally. Following dis-
cussion, Alderman Carls moved to approve the request. Motion seconded
by Alderman Mlinar and unanimously carried.

(b) COMMUNICATIONS FROM ALDERMAN MARLIN TORGERSON
Alderman Torgerson inquired about the signs on Highway 7 and Bluff
Street which were put up during the detour of Main Street but have not
been removed since the highway reopened.
(c) COMMUNICATIONS FROM ALDERMAN PAT MIKULECKY
Alderman Mikulecky raised a question on the survey item concerning
monthly billing for water and sewer. He suggested the people be
asked on the survey if they would prefer a monthly billing for water/
sewer /refuse and gas /electric all on one statement.
(d) COMMUNICATIONS FROM CITY ATTORNEY
City Attorney Anderson reported that Judge Schmidt had ruled in the
City's favor concerning the DeGrote special assessment appeal.
Mr. Sam Ulland had contacted the City Attorney with an offer to pay
part of his overdue water account and pay the balance over a period of
time. It was noted that a motion was set for October 28 to clean out
non - conforming trailers at Midwest Trailer Park. No action was taken.
The City Attorney requested a closed City Council meeting on October 27
at 6:00 P.M. to discuss pending litigation against Burns Manor Nursing
Home by Mr. & Mrs. Hinde. Alderman Mlinar moved to hold a special
closed meeting on October 27, 1988 at 6:00 P.M. Motion seconded by
Alderman Torgerson and unanimously carried.
(f) COMMUNICATIONS FROM MAYOR PAUL L. ACKLAND
Mayor Ackland stated that the Country Club Terrace Trailer Park was ex-
periencing water usage problems. The owner had requested relief from
the billing on the EPA charge and the sewer use charge. This matter
will be discussed at the November 7 Council meeting.

HUTCHINSON AIRPORT COMMISSION
Monday, October 31, 1988
Meeting called to order by Doug McGraw at 8:30 p.m.
Members Present: Chairman Doug McGraw, Don Pankake, John Miller, Dennis
Kahl and Dave Skaar.
Members Absent: Mayor Paul Ackland
Guest: Gene Anderson, City Engineer, and Greg Kokesh
Doug Johnson, a representative from D.O.T., aeronautics division, gave a
presentation concerning the condition of the lighting system at the Hutchinson
Municipal Airport. Attached is a letter from Mr. Johnson addressing the
estimated cost of possible improvements.
Mr. Johnson indicated that it was possible the State would participate
with the funding of this improvement project, at a 1/3 City cost, 2/3
State funded.
Gene Anderson briefed the Commission concerning the progress on the
hangar project.
The meeting adjourned at 10:20 p.m.

The Hutchinson airport is experiencing problems with the
underground cables. They are full of moisture and have bad
transformer connections. Several sections have had to be
replaced. The cables are 20+ years old. Below is an estimated
cost for several possible improvements.

EMERGENCY RESPONSE PLAN
WHEREAS, the Congress of the United States has enacted Public Law 99 -499,
Superfund Amendments and Reauthorization Act (SARA) of 1986, and
WHEREAS, the State of Minnesota, Department of Public Safety, Division
of Emergency Management has issued Bulletin No. 87 -1 which outlines the
requirements for developing and updating local government emergency plans and
supporting documents to comply with Title III of Public Law 99 -499, and
WHEREAS, the Director of Emergency Management for the City of Hutchinson
has updated the City Multi - Hazard Emergency Response Plan in accordance with
Public Law 99 -499 and State of Minnesota, Department of Public Safety, Division
of Emergency Management Bulletin No. 87 -1.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
THAT said City Multi- Hazard Emergency Response Plan is hereby approved
and accepted by the City as being in accord and conformity with all ordinances
of the City of Hutchinson, Laws of the State of Minnesota, and Public Law
99 -499.

Subd. 20. It shall be unlawful for any firm, person, or corporation to
park a motor vehicle or other vehicles on the East side of Merrill Street
from Clinton Avenue To South Grade Road from November 1st to May 1st.
Section 2. Penalty. Any person violating the provisions of this
ordinance shall be guilty of a penal offense and upon conviction shall be
punished by a fine of not more than three hundred dollars or by imprisonment
for not to exceed ninety days, or both.
Section 3. Effective Date. This ordinance shall take effect upon its
publication.

SECTION 1. That notice of hearing was duly given and publication of said

that the part of the building on the vacated parcel cannot be used
without reconstruction, the above - described real property shall auto-
matically revert to Grantor and its heirs without any need for Grantor
and its heirs to take any affirmative action to effectuate this
reverter.
It is expressly stated that this grant shall not be construed as a
right of re -entry for condition broken, which would require Grantor or
its heirs to take legal action to regain title to the above- described
property. This reverter shall be effective by operation of law and
shall not require Grantor to take any affirmative steps whatsoever.
It is also expressly understood and agreed that in the event a dispute
arises between the parties concerning whether or not the City is
entitled to the automatice right of reverter, said dispute shall be
arbitrated in accordance with rules and regulations established by the
American Arbitration Association."

SUBJECT: Discussion with Jay Freedland

As per the request of the City Council, I discussed the possibilities of relo-
cating the salvage operation, possibly on City property (near the tree dump).
Mr. Freedland's position is that a substantial portion of his revenue is from
citizens bringing in cans. He believes his salvage of various cans would be cut
in half if the operation were located on Hwy. 22 South. He feels that conven-
ience to the customer is very important, and his present location is where he
intends to stay for the next three to five years. He says he respectfully re-
quests his conditional use permit and variance be voted on, up or down, at the
Monday, November 7 Council meeting. He denies to install the fence before freeze.
Regarding the solid fence, Mr. Freedland says this item was discussed at the
Planning Commission meeting. It was felt a metal fence with plastic slats (8
feet high) provided better security, limited maintenance, and a superior appear-
ance vs. plywood, etc.
Regarding the 200 foot setback from a residential boundary, Mr. Freedland feels
that his variance application addresses that zoning provision inasmuch as he
feels that he has a hardship. See attached application, page 2.
Lastly, Mr. Freedland said he would be willing to negotiate relocating his oper-
ation in three to five years; however, he has no interest at this time. He in-
tends to be at the Council meeting to answer any questions.

SUBJECT: Variance Request as Submitted by Jay Freedland for a salvage yard
Pursuant to Section 6.05, B3, of Zoning Ordinance No. 464, the Hutchinson
Planning Commission is hereby submitting its findings of fact and recom
mendation with respect to the aforementioned request for a variance.
HISTORY
On September 28, 1988, Jay Freedland, Hutchinson Iron and Metal, submitted an
application for a variance to allow him to construct a fenced in salvage yard
within the Floodway located at 4 Monroe. A public hearing was held at the regular
meeting of the Planning Commission on Tuesday, October 18, 1988, at which time
there was no one present who objected to the request.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee
paid.

FINDINGS
1. Mr. Jay Freedland, Hutch Iron and Metal, has applied for a
variance from Section 9 of the Zoning Ordinance No. 464 to allow him to
construct a fenced -in salvage yard within the Floodway located at 4 Monroe,
with the following legal description:
Lot 10, Block 4 - South 1/2 City
City of Hutchinson
2. The Planning Commission has reviewed the application for a variance and
has recommended to the City Council that the application be granted.
3. The Council has considered the effect of the proposed variance upon the
health, safety, and welfare of the community, existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, and the
values of property in the surrounding area and the effect of the proposed
variance upon the Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding
property, it is possible to use the subject property in such a way that the
proposed variance will not impair an adequate supply of light and air to
adjacent property, unreasonably increase the congestion in the public streets,
increase the danger of fire, endanger the public safety, unreasonably diminish
or impair health, safety, comfort, morals, or in any other aspect be contrary to
the intent of the ordinance and the Comprehensive Plan.
5. The special conditions applying to the structure or land in question
are peculiar to such property or immediately adjoining property and do not apply
generally to other land or structures in the district in which such land is
located.
6. The granting of the application is necessary for the preservation and
enjoyment of a substantial property right of the applicant. It will not merely
serve as a convenience to the applicant, but is necessary to alleviate demon-
strable hardship or difficulty.
CONCLUSION
The application for variance for the purpose designated is granted based
upon the findings set forth above.

• Enclosed please find a copy of correspondence received from Attorney
Bradford regarding the above referenced matter. I believe the pro-
posal outlined in his letter represents the "bottom dollar," that
the claimants would be willing to accept.
It is clear that there was an overcharge beginning in approximately
1971 and continuing during the entire time period between 1971 and
the Haukos purchase. It may not be realistic to expect the
claimants to settle for less than the figure specified. They, of
course, have not risk in any litigation except attorneys' fees
which, given the parties involved in this case, is not likely to be
an issue.
I don't believe it is necessary to have a special closed meeting to
consider this one item. I believe it can be a regular agenda item,
as it has been in the past.

As you may recall, I wrote both you and members of the council some
time ago regarding an apparent overpayment of utility bills by Curt
Bradford and others. The property involved is one for which a re-
imbursement was made to the current record owner based on water
records back to 1983. Bradford, and his successor, want approximately
$23,000 in claimed overcharges going back to about 1969. Since there
are various good faith defenses that the City could raise, I have a
difficult time going along with Bradford's proposed disposition.
However, since litigation will otherwise certainly result, I could
recommend an offer of $5000 from the City's water and sewer fund since
that amount is also the City's deductible and will quickly disappear
once an action is started.
This matter was supposed to have been on the agenda for tonight but
apparently only part of my message was delivered to Marilyn.

SUBJECT: Purchase of Handheld Radios
This memorandum will serve as a request for approval to begin the purchase process
for acquiring new handheld radios pursuant to the approval by the City Council.
As you know, the City Council has approved the purchase of 14 new handheld radios in
the Police Department 1989 budget. The Motorola MT 1000 handheld radios are
currently available on the State bid. Because of the inter - governmental association
and cooperation agreements that State bid allows for the City of Hutchinson to
acquire the radios through that particular bidding process and would preclude the
need for the City of Hutchinson to go through the bidding process.
I have contacted Finance Director Ken Merrill to ascertain if it would be acceptable
to begin the purchase process at this time pursuant to generally accepted accounting
principles. Mr. Merrill stated that it would be acceptable to begin the purchase
. process as long as the billing for the radios and physical acquisition of the radios
does not take place until after January 1, 1989. Based upon this information, I
respectfully request that this department be allowed to begin the purchase process so
as to expedite the acquisition of the handheld radios.

Assessment Roll No. 245
The referenced parcel is located on the north side of 3rd Avenue N.W. between
James Street and Water Street. Assessments to the tract for the roadway
construction project total $4,637.84, which includes the commercial rate
frontage assessment of $57.75 for a width of 66 feet. Council policy for this
project was to assess residential uses that were homestead at the rate of
$20.00 per front foot and to defer the assessment until such time as the
property is used for commercial purposes.
In prepareing the assessment roll we noted that Mr. Bud Nussbaum, who resides
in rural Dassel, is the owner of the property, so we presumed the parcel to be
non - homestead. On that basis the commercial rate would apply. After
receiving the attached correspondence from Mr. Nussbaum, we checked with the
County Assessor who informed us that the resident on the parcel has a live
interest in the property and as such, the County considers the tract to have
homestead status.
In keeping with the policy for this project, the frontage assessment should be
reduced to $20.00 per foot and the entire assessment deferred. The amended
assessment would then be as follows:

Alderman Torgerson moved to use the maximum amount of state aid funds
against the entire project, to give all property owners in the assessed
area a credit for past storm sewer assessments, and to assess five
cents per square foot to property north of Highway 7. Motion seconded

certified to the County Auditor for collection in the same manner as real
estate taxes.
In subsequent years, the amount certified each October will be 1/10 of the
original principal amount plus interest for the ensuing calendar year at the

The unpaid balance may be paid in full at the Office of the City Administrator
at any time prior to November 15th in any year. However, partial payments

WHEREAS, the City Council has determined that the final assessable cost
of the improvement of 3rd Avenue Northwest from Main Street to T.H. 7 West by
the construction of storm sewer, sewer and water services to the property line
of all buildings or buildable sites, grading, aggregate base, curb and gutter,
concrete driveway approaches, bituminous surfacing and appurtenances, has been
reduced and the assessments for said improvement have been adjusted
accordingly.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made
a part hereof, is hereby accepted, and shall constitute the special assessment
against the lands named therein, and each tract of land therein included in
hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of ten (10) years, the first of the installments to be
payable on or before the first Monday in January, 1989, and shall bear
interest at the rate of 6.71 percent per annum as set down by the adoption of
this assessment resolution. To the first installment shall be added interest
on the entire assessment from October 1st, 1988, until the 31st day of
December, 1989. To each subsequent installment when due, shall be added
interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment, to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid by the 1st day of October, 1988; and he may, at any time
thereafter, pay to the City Treasurer the entire amount of the assessment
remaining unpaid, with interest accrued to the 31st day of December, of the
year in which such payment is made. Such payment must be made before November
15th, or interest will be charged through December 31st, of the next
succeeding year.
4. The Administrator shall forthwith transmit a certified duplicate of
this assessment to the County Auditor to be extended on the property tax lists
of the County, and such assessments shall be collected and paid over in the
same manner as other municipal taxes.

The State of Minnesota is requesting that the City grant a temporary easement
on and across a portion of the City owned property located on the westerly
side of T.H. 22 from Fair Avenue southerly to the Juul property. Your
attention is called to the attached drawing showing the requested easement 25
feet in width.
The Minnesota Department of Transportation is in need of the addition easement
area to supplement their present right -of -way, which is 100 feet in width, for
the reconstruction of T.H. 22 proposed in 1989. The State is offering the
City $2,025.00 in monetary consideration.
The easement document is attached. 1 recommend that the State's offer be
accepted and that the temporary easement be granted.
Mn /DOT has informed me that additional right -of -way will be needed further
south along T.H. 22. When documentation is received it will be presented to
the Council for consideration.

Country Club Terrace, for a number of months. For background information, please

Mr. Block is willing to pay for all water usage; however, he requests a retro-
active adjustment on the sewer based on his finding that the excess water is
not going down our sanitary sewer system.
For comparison purposes, I have had our billing clerk check McDonald's Mobile
Home Court account. The average sewer charge (winter quarter) is 15,000 gallons
per quarter, per unit.

Based on the sewer charge of a similar mobile home court, I would propose the
sewer charge be adjusted to a like 15,000 gallon per quarter, per unit. The
total adjusted credit on this basis would be $ 8.534.98 for ?7 427ons/
quarter since the purchase date in 1987 to September 29, 1988.
Secondly, as part of my recommendation, I would suggest that the credit be ex-
tended to December 31 as an incentive to solve the leak within the next six to
seven weeks. The concern is that the water charge (over 500,000 gallons) is
only 40C per 1,000 and financially would be only a limited incentive to rapidly
solve the problem before winter.
Thirdly, I recommend that the winter usage sewer charge be based on actual us-
age for January, February and March.

I have reviewed the letter dated July 2S, 1988, from W.R. Block,
General Manager of Hutch Inc., regarding water usage at Country Club
Terrace trailer court. I feel that there are two important items to
be addressed concerning the water usage.
1. If there is a problem with broken water lines, these should
be fixed right away. It is up to Hutch Inc. to look into the
problem and fix it.
2. Many times while checking high water uses our water department
will check toilets to see if water is leaking through them,
this could be the case at Country Club Terrace, again it is
up to Hutch Inc. to check.
In conclusion, if our staff can be of any assistance, we will gladly
work with Hutch Inc. to get to the bottom of the problem.

FOR YOUR INFORMATION
On Thursday, July 21, 1988, I had the pleasure of meeting with
the Mayor, City Administrator and City Water /Wastewater Director
to discuss two issues of importance: the establishment of a new
water /sewer /EP billing procedure for mobile home parks and the
development of a new city park. As the representative of the
owners of Country Club Terrace (CCT) MHP I have evaluated the
issues and would like to present CCT's position on both herewith.
I. Water /Sewer /Environmental Protection
As indicated in previous correspondence (April 7, 1988) we
believe that due to a problem in our infrastructure we are
using significantly more water than in previous similar
quarters. We used 41.5 percent more in the winter quarter
of 1988 (Dec -Feb) than the winter quarter of the previous
Year and 64.4 percent more in the spring quarter (Mar -May)
of 1988 than the spring quarter of 1987. During the same
time periods the additional homes in the park represent a
5.8 percent and a 7.2 percent increase, respectively.
We are certainly responsible for the cost of the water.
However, we feel that a new system should be — used to bill
for sewer_ and environmen�a� protectio n c osts. Other
residents of the City of Hutchinson are metered and billed
individually for the water they use. The sewer and EP
charges are based on the winter quarter when residents do
not water lawns and gardens, or wash cars. This is a fair
deal. These citizens are not charged for water loss from
the City's watermains, for hydrant flushing, or for watering
city parks. The residents of CCT not only pay for all water
used by the park, including water losses from the
distribution system, but are also charged for sewer and EP
on the system losses. This is not fair.
It should also be pointed out that CCT pays for all
maintenance and repairs of the water distribution and sewer
collection systems within the park. The City does not incur
any expenses whatsoever for the system beyond the master
meter or upstream from the collection manholes.

We would like to suggest a new method for billing mobile
home parks in the City of Hutchinson.
a. Water
All water must be metered at a master meter. The park
is responsible for the cost of all water used. Water
should be paid for at the established rates for that
commodity.
b. Sewer and EP
Since individual mobile homes are not metered at this
time, two alternatives should be considered:
1. Install meters and bill individual residents for
waa r, sewer and EP just like the other citizens
of Hutchinson. The mobile home park owner would
pay for the difference in water cost only between
the master meter reading and the total of the •
mobile home meters.
2. Use the theoretical per capita water usage in the
City of Hutchinson as the basis for sewer and EP
billings. The theoretical per capita water usage
can be determined by randomly selecting 50 water
bills of individual homes for the winter quarter
of 1988; determining the number of occupants of
each home; and then dividing the total water used
by the 50 homes by the number of days in the
quarter to determine the average daily water
consumption for the fifty homes; and then dividing
that result by the total number of occupants.
This will result in the theoretical per capita
water usage. We suggest that the Mayor and
Council members be included in the 50 homes. The
process of determining theoretical per capita
usage could be done on an annual or less frequent
basis, but always in the winter quarter.
The theoretical per capita water usage would then
be multiplied by the number of persons residing in
the mobile home park during each quarter (this
information can be obtained from the mobile home
park manager on a quarterly basis). This product
will be the daily water use of all residents.

This number would then be multiplied by the total
number of days in the quarter to determine the
basis for sewer and HP billing to the park owner.
Attached for your review is a breakdown of CCT's
winter and spring quarter billing using
alternative 2 as the method of billing for sewer
and SP. We have assumed a theoretical per capita
water use of 65 gallons per day.
II. Park Contribution
At our meeting, Mr. Plotz, the City Administrator, presented
plans for a city park to be located north of CCT. Past and
present city policies regarding developer contributions to
park improvements were discussed. While it is recognized
that statutorally CCT owes nothing to the City for park
improvements, we realize that a park in the proposed
. location will benefit CCT's residents.
Presently there is an area within the mobile home park
which, in the past, was used as a playground for children.
At the urging of adjacent residents, playground equipment
was removed. The space is now vacant.
CCT is willing to pay $6000 to the City as a park
contribution. Of this amount $3000 will be paid this year
(1988) and the balance upon the completion of park
improvements.
CCT is also willing to construct a park access consisting of
a six foot wide sidewalk with a six foot high fence on each
side. The access would be located between lots 200 and 201
shown on the attached drawing.
This offer is contingent on the City allowing CCT to convert
the vacant park space to four mobile home lots and the
adoption of a new water /sewer /SP billing procedure for
mobile home parks.

In summary, the tenants of CCT expect to be treated as are other
citizens of the City of Hutchinson. The cost of City services
should not differentiate on the basis of the type of housing one
occupies. The types of ,jobs prevalent in the City of Hutchinson
mandate that affordable housing for its citizens be available.
CCT provides 213 spaces for low cost housing. Many of our
tenants are employees of Hutchinson Technologies and earn
relatively low salaries for assembly work. We do not want to
impose a rent increase to cover the overcharging for City
services.
We are currently undertaking a program to determine the
substantial increase in water use at the mobile home park. Each
water riser will be inspected and parts will be replaced if
necessary. Watermain leakage will be repaired when located. We
will monitor our master meter during a period of zero water use
(see attached notice) to quantify system losses.
We are excited about the City's decision to develop a park to the
north of our property and wish to participate in its financing. •
However, it is a two way street.

RE: Water Use
In the past six months the water usage at the mobile home park
has increased significantly over the previous time periods.
According to our invoices the second quarter usage in 1987 was
3,068,000 gallons while the second quarter in 1988 was 5,044,000
gallons. This represents a 64.4% increase in water use. During
the same time period, the number of homes in the park has
increased by 7.2 %. Obviously something is wrong.
We expect a problem with the watermains. To check the watermain
leakage, we will monitor the water meter for a 2 -hour period on
Wednesday, Au oust 10, 1988 from 2:00 A.M. to 4:00 A.M. WE
REQUEST THAT TENANTS DO NOT USE WATER DURING THIS TWO HOUR
PERIOD. If no water is used by the tenants, all water passing
through the meter must then be attributable to water loss in the
distribution system.

This letter is a follow -up to my July 25, 1988 correspondence
requesting a restructuring of the water /sewer /EP billing process
for Country Club Terrace Mobile Home Park.
On Wednesday, August 10, 1988 we monitored the water meter at the
park. Residents were advised that they were not to use water
between 2:00 A.M. and 4:00 A.M. that day. Water used during that
period would then be considered as losses in the watermains. The
results are as follows:

1900/120 minutes = 15.83 gpm. = 22,800 gpd.
It can now be clearly stated that the distribution system has
losses of approximately 22,800 gallons per day.
The amount of water would not be detected if each individual
mobile home was metered and billed accordingly.
Using the 22,800 gpd. figure results in a quarterly loss of
2,052,000 gallons. The total water used in the second quarter
was 5,044,000 gallons. The total amount used by the residents
therefore, was 2,992,000 gallons. Using the actual population of
the mobile park at 526 persons results in a per capita water
usage of 63.2 gallons per day. This compares favorably with the
theoretical per capita water use of 65 gpd used in my previous
correspondence.
We believe that this data should be sufficient for the council to
adopt a new billing procedure that treats our residents like the
other citizens of Hutchinson. The park will pay for all water
used. However, we request that the sewer and EP rates be based
on a theoretical per capita water use of 65 gpd.

SUBJECT: Hutchinson School District Request for Return of Debt Levy

A request has been received by City Administrator Plotz to rebate the dollars
for the 1988 debt levy back to the school. Attorney Jerry Gilligan of Dorsey &
Whitney stated that the City, while not required, may give the money back to the
school district. Some background information is provided for your review.
The year 1989 will bring many changes in real estate tax law. 1989 will not
use mill rates but rather tax capacity rate. Also, gone are the assessed values
replaced with tax capacity percentages. All of this means no one is sure of
the impact on tax increment programs. In fact, some cities are levying general
taxes to make up for anticipated deficiency of the increment. We are not yet
sure of the impact of our district.
We were beginning to rebate the excess increments beginning with revenue from
1987. 1987 was the year in which sufficient revenues for two years of debt
service of the tax increment bonds,plus 500,000 for the revolving loan fund,
were on hand. Increment dollars over this requirement were to be rebated, per
City Council action.
With the request from the school, and if the Council approves, the priority
would be for the return of debt dollars to the school. Any excess dollars would
then be rebated to all jurisdictions. This rebate would now come in the form ofa
reduction incapture rather than dollars to the county, city and school govern-
ments as had been originally planned. (This is according to Ed Ide, County Audi-
tor.)
The following suggestions on this debt service disbursement to the school are
offered:

1. Any rebate would be considered only after the debt service requirements
for the year were met. Rebate would be up to the debt service on the 1988
bond issue if funds were available.
2. An annual City Council review would be made and authorization would be made
at the time of review.
3. School District No. 423 must apply the dollars received to reduce the
1988 bond debt service requirements of the year following.
4. Settlement amounts would be determined in timely fashion to allow School
District No. 423 to determine the 1988 bond levy for the following year.
Payments will coincide with tax settlements from the county that year.

The School Board of the Hutchinson School District hereby requests the City
Council of Hutchinson to approve the disbursements to the school district tax
receipts captured by the tax increment district in the amount equivalent to the
taxes raised from the increased tax efforts caused by the passage of the May 17,
1988 school district bond issue for a new school building.
The rationale for this request is as follows: During the 1987 legislative session
and with adjustments in the 1988 session, the tax increment laws were revised. The
intent of these revisions were to allow tax revenues from bond issues passed after
May 1, 1988, to be sent on to the taxing district. This prevents a "windfall"
of tax receipts to the tax increment district because of the school district's
May 17, 1988 approved bond issue.
Based on the 1988 numbers (which would need to be revised when payable 89 assessed
values are known) listed below is how I see the calculation working:
— Tax revenues needed to pay principal and interest on an annual basis on the
May 17, 1988 bond issue = $600,000
— The school district assessed value is $71,405,303.
— Tax increment district assessed value is $2,617,068
— Mills for bond: $600,000 — $7,405,303 = 8.4 mills
— 8.4 mills x $2,617,068 = $21,983 captured tax revenue related to bond issue

In your letter of October 14th you inquired as to the

after May 1, 1988. The reason for your inquiry is the fact that
after May 1, 1988 the voters of the Hutchinson School District
approved the issuance of bonds for the construction of a new
school which is expected to increase the District's tax levy by
6 -7 mills.
The amendment concerning school district levies added
Section 469.177, subdivision 10 to the Minnesota Tax Increment
Financing Act (a copy of which is enclosed). The language of
this subdivision is poorly drafted and confusing, but basically
provides that for tax increment financing districts for which
certification of original assessed value was requested before
May 1, 1988 (such as the City's existing tax increment district),
if voters in the school district in the tax increment financing
district approve a new levy or an increased levy after the
original assessed value of the tax increment financing district
was certified, the tax increment which is attributable to the
increase in the school district's mill rate pursuant to the
referendum will be received by the entity which created the tax
increment financing district, but must be paid by the entity to
the school district if one of the following conditions apply:

(i) there are no bonds outstanding on
May 1, 1988 to which tax increment from the
district is pledged;
(ii) there are no bonds outstanding to
which tax increment from the district is
pledged that were issued before May 1, 1988
at the time the referendum is approved; or
(iii) neither of the conditions under
(i) and (ii) above are satisfied, but the
governing body of the municipality (which in
certain cases will not actually be the entity
which created the district such as in the
case of a tax increment financing district
created by an HRA) and school district by a
majority vote approve the payment of the tax
increment attributable to the increase in
levy to the school district.
Applying this law to the City's situation, the City is
not required without its approval to pay to the Hutchinson School
District the tax increment attributable to the increase in the
District's levy resulting from the new school approved by the
voters because the conditions listed under (i) and (ii) above are
not satisfied since (a) on May 1, 1988 the City had outstanding
bonds to which tax increment from the district is pledged
(therefore the condition under (i) is not satisfied), and (b) at
the time the referendum was approved the City had outstanding
bonds that were issued before May 1, 1988 to which tax increment
from the district is pledged (therefore the condition under (ii)
is not satisfied). Consequently, the only situation in which the
City would be required to pay such amount to the School District
is if the City Council and School Board approve such payment by a
majority vote.
In your letter you ask whether the City Council can
agree to make such a payment in the situation where it is not
required to make a payment, since it has pledged to the payment
of its outstanding tax increment bonds all tax increment derived
from the tax increment financing district. The pledge made by
the City of the tax increment to the payment of the bonds
represents a covenant in a contract between the City and the
holders of the tax increment bonds. If the City were to agree to
pay the tax increment attributable to the tax levies for the new
school to the School District it would be amending this covenant

without the approval of the holders of the bonds. Such an
amendment without bondholder approval may only be made in a case
where it can be shown by clear and conclusive evidence that it
will not affect the ability of the City to pay the bonds and will
not otherwise be prejudicial to the holders of the bonds. In
making this determination, the City Council will need to consider
among other things, (i) the present financial condition of the
tax increment financing district and whether the amount of tax
increment being generated thereby is more than sufficient to pay
the bonds and any other obligations payable from the tax
increment, (ii) the effect of the changes in the Minnesota
property tax law on the amount of tax increment to be derived
from the district, and (iii) the fact that the bonds are general
obligations of the City to which its full faith, credit and tax
powers are pledged. If after considering such factors and any
other pertinent facts the City Council is able to determine in
good faith that the holders of the bonds are not prejudiced by
making such payments to the School District, it should be
permitted to make such payments. However, such determination of
the Council is not conclusive and a bondholder could sue to
enjoin such payments, in which case a court would be forced to
consider the issue.

• RESOLUTION CALLING FOR REPEAL OF "ONE CALL GOPHER STATE" EXCAVATION PROCEDURE
WHEREAS, the Minnesota State Legislature has mandated by law a 'One Call
Gopher State" Center for excavation information, and
WHEREAS, the new law and procedures DUPLICATES the informational process
utilized now for public safety in the Hutchinson area, and
WHEREAS, the City Council feels that if something works, especially so
well, why fix it?
WHEREAS, 'One Call Gopher State" merely imposes a unneeded level of bureau-
cracy and cost on local government,
NOW HEREBY BE IT RESOLVED that the City of Hutchinson requests responsive
action to repeal the 'One Call Gopher State" Center.
BE IT FURTHER RESOLVED that the State of Minnesota reimburse the City of
Hutchinson the sum of $5,000.00 for the unnecessary staff time, telephone charges,
• and inquiry charges through December 31, 1988.

TO: MAYOR AND CITY COUNCIL

RE: TRANSIT MARKETING
This year, as part of our transit (Hutchmobile) contract
with MN /DOT, we have been allocated marketing monies
se that certain advertising we do is 1008 reimbursed
by the state. The theme of the advertising is Heartland
Express.
We plan on carrying out a suggested promotion in November
which involves advertising free rides (by coupon) for
one week.
This advertising, along with the cost of free rides given,
is included in the amount we will be billing the state
for 1008 reimbursement. There will be no city cost
involved in the free rides.

RE: FLOODPLAIN MANAGEMENT, HUTCHINSON
I am writing as a follow up to our discussion concerning the
conditional use application by Hutchinson Iron & Metal Inc. to
operate a storage yard in the flood fringe area. Any structure,
building or appurtenant work associated with the proposal should be
elevated to the regulatory flood protection elevation (RFPE). The
regulatory flood protection elevation is equal to the elevation of
the 100 year flood, plus the increase associated with designation of
the flood way (up to .5 foot), plus 1.0 foot of freeboard.
Also, it my understanding the Planning Commission will be requiring
Hutchinson Iron and Metal to submit a detailed list of all materials
that will be stored on site. The list should be reviewed by the
Minnesota Pollution Control Agency for potential impacts to water
quality during flooding conditions. I have discussed this matter
with Mark Jacobs, Pollution Control Agency Regional Director, at
Marshall, Minnesota. He stated that the Marshall Pollution Control
Agency staff is willing to assist the City with review of proposed on
site storage materials. Mark can be reached at (507)537 -7146.

HUTCHINSON SAFETY COUNCIL
The Hutchinson Safety Council met on September 26, 1988 at the Fire Hall at 12;00
noon. There were 16 members present for the meeting. Randy Exstad presented the
program concerned with school /school transportation safety. 2 elementary school
guests, Kelly Hahn and Justin Barrick talked about attending Legionville' in Brained.
Legionville trains school patrol captains and is sponsored by the American Legion.
The Handout "Focus on Transportaion" was made available to all Safety Council members.
The meeting was called to order by President Warren Kempfert.
The minutes were approved as written.
Old Business
1. Norma Severtson from the Day Activity Center was very concerned and helpful in
solving the problem with the DAC bus turning around on Highway 7. The problem
is now rectified.
2. Fair Display: Several letters thanked the Safety Council for the display. The
motion was approved unanimously that we be represented at the Fair again next
year if possible, next to John Reynold's booth.
3. Hutchinson Safety Council Sign: Larry Karg from the City Street Dept. stated
that a sign can be designed in an aluminum sign furnished by the Street Dept:
but a volunteer is'needed to design the sign, color scheme and lettering etc.
Mark Schnobrick suggested the art department at the senior high. Randy Exstad
will contact the school, to determine their interest in helping us. A motion
was made and approved to award a prize for the design selected. Randy Exstad
and Larry Karg were selected to be on a sub- conm,_:,ee to decide on sign design
criteria and the possible monetary reward for design selected.
New Business
1. The traffic past Country Kitchen often exceeds the speed limit. Warren will
check into it with Marlin Torgerson to see what can be done about it.
2. October 9 -15 is Fire Prevention Week. George Field stated that tours are being
provided to elementary students.
3. Halloween party will again be sponsored by Lions at the Civic Arena.
John Reynolds suggested the Safety Council sponsor an ad about Halloween safety.
Warren Kempfert will check into it.
4. Community Marquee Guidelines were discussed. It was suggested that the
Safety Council may want to use the marquess for recognition in the Community.
5. The Southern MN Safety Council is meeting October 27, 1988. Brochures are
available from President Kempfert if anyone is interested in attending.
There being no further business the meeting was adjourned at 1:00 p.m. by
President Warren Kempfert.
Next meeting October 31, 1988 at the Fire Hall.
