1, The meeting was called to order by Vice- President Carl& at 7:30 P.M. The
ollowing were present: Vice - President Mike Caris, Aldermen John Mlinar,
Marlin Torgerson and Pat Mikulecky, Absent: Mayor Paul L. Ackland. Also

(a) CONSIDERATION OF RECOMMENDATION OF CITY DIRECTORS ON ANNUAL WAGE
ADJUSTMENT AS REQUESTED BY CITY COUNCIL
Following a report by Administrator Plotz, Alderman Mlinar moved to
approve a four percent across the board wage adjustment. Motion sec-

onded by Alderman Torgerson, The motion was amended by Alderman Miku-
lecky to have a cap of $800. Motion died for lack of a second. The
main motion carried three to zero, with Alderman Mikulecky abstaining
from voting.
(b) CONSIDERATION OF REQUEST BY TREE BOARD AND SOLID WASTE MANAGEMENT
COMMITTEE TO USE CITY CREW FOR CHRISTMAS TREE PICKUP
Following discussion, Alderman Mlinar moved to approve the request.
Motion seconded by Alderman Mikulecky and unanimously carried.
(c) CONSIDERATION OF REQUEST BY LIONS CLUB AND CHAMBER OF COMMERCE TO
CONSTRUCT AN ICE STRUCTURE
Following a presentation, Alderman Mikulecky moved to approve the re-
quest of the five items listed in the December 27, 1988 memorandum as
well as what the City did last year. Motion seconded by Alderman Tor -
gerson and unanimously carried,
7. RESOLUTIONS AND ORDINANCES
(a) RESOLUTION NO. 8923 - TRANSFERRING $30,000 FROM LIQUOR STORE TO
GENERAL FUND
The motion was made by Alderman Mikulecky, seconded by Alderman Torger
son, to waive reading and adopt Resolution No. 8923. Motion unanimous-
ly carried.
(b) RESOLUTION NO. 8924 - TRANSFERRING $91,895 FROM THE GENERAL FUND TO
POLICE FACILITY CONSTRUCTION OF 1986 FUND
The motion was made by Alderman Torgerson, seconded by Alderman Mlinar,
to waive reading and adopt Resolution No. 8924. Motion unanimously
carried.
(c) ORDINANCE N0. 31/88 - ORDINANCE ADOPTING MINNESOTA STATUTORY LAW
GOVERNING LIBRARY BOARDS OF DIRECTORS
The motion was made by Alderman Mlinar, seconded by Alderman Torgerson,
to waive first reading and set second reading of ordinance to January
10, 1989. Motion unanimously carried.
8. UNFINISHED BUSINESS
(a) CONSIDERATION OF DEFERRING ASSESSMENT ON BEELER /ANDERSON PROPERTY
It was recommended to approve abatement on the two parcels of property
owned by Beeler /Anderson for the special assessment of $505.02 on each
parcel collectible in 1988. The special assessment would be deferred,
and the penalty of 12 percent would apply only to the unpaid taxes.

Following discussion, Alderman Torgerson moved to defer the special
assessment and interest for five years or unless earlier development.
Motion seconded by Alderman Mlinar and unanimously carried.
9. NEW BUSINESS
(a) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
Alderman Mikulecky recommended discontinuance of service on January 3,
1989 at noon unless other arrangements were made. Motion seconded by
Alderman Torgerson and unanimously carried.
(b) CONSIDERATION OF ADOPTING ORDINANCE TO ALLOW USE OF GOLF CARTS ON CITY
STREETS
Following discussion of amended wording in the ordinance, Alderman Tor -
gerson moved to defer until the next meeting. Motion seconded by Ald-
erman Mikulecky and unanimously carried.
(c) CONSIDERATION OF JOB DESCRIPTION FOR POLICE SCHOOL LIAISON OFFICER
Following discussion, Alderman Torgerson moved to approve the Job des-
cription. Motion seconded by Alderman Mlinar and unanimously carried.
(d) CONSIDERATION OF CARR COMPANY'S RETAINAGE REDUCTION
It was recommended to reduce the retainage for Robert L. Carr Co. from
2 -1/2 percent to $150,000. Alderman Mlinar moved to approve the re-
tainage reduction. Motion seconded by Alderman Mikulecky and unani-
mously carried.
(e) CONSIDERATION OF 1988 BUDGET FOR ECONOMIC LOAN AND ENERGY LOAN FUNDS
Following discussion, Alderman Mlinar moved to approve and waive read-
ing and adopt Resolution No. 8931. Motion seconded by Alderman Torger-
son and unanimously carried.
(f) CONSIDERATION OF OFFICE SPACE IN CITY HALL FOR MAINSTREET
ADMINISTRATIVE OFFICER
Following discussion, Alderman Mlinar moved to approve the request.
Motion seconded by Alderman Torgerson and unanimously carried.
(g) CONSIDERATION OF REPLACEMENT OF FIRE MARSHAL'S VEHICLE
Following discussion, no action was taken and the previous action pre-
vailed.
(h) CONSIDERATION OF FIVE YEAR MUNICIPAL STATE AID CONSTRUCTION PROGRAM
Following discussion, Alderman Mlinar moved to approve and waive read-

(i) CONSIDERATION OF AWARDING CONTRACT FOR LETTING 10. 20, PROJECT 88 -36
City Engineer Anderson recommended awarding the contract for project
No. 88 -36 to Neenah Foundry Company for $11,514.
Following discussion, Alderman Mikulecky moved to approve and enter
into contract and to waive reading and adopt Resolution No. 8932. Mo-
tion seconded by Alderman Mlinar and unanimously carried.
(j) CONSIDERATION OF MINNESOTA DEPARTMENT OF TRANSPORTATION AGENCY
AGREEMENT
Following discussion, Alderman Torgerson moved to approve and enter
into an agreement and to waive reading and adopt Resolution No. 8926.

(k) CONSIDERATION OF ORDERING PREPARATION OF ENGINEER'S REPORT AND CALLING
HEARING FOR IMPROVEMENT PROJECT NO. 89 -02
Following a report by Engineer Anderson, Alderman Torgerson moved to
approve the report, set the hearing for January 24, 1989 at 8:00 P.M.,
and waive readings and adopt Resolutions No. 8927 and No. 8928. motion
seconded by Alderman Mikulecky and unanimously carried.
(1) CONSIDERATION OF AMENDMENT TO ZONING ORDINANCE NO. 464 FOR SIGNS
REQUESTED BY CITY STAFF WITH FAVORABLE RECOMMENDATION OF PLANNING
COMMISSION
City Administrator Plotz reviewed the zoning ordinance regarding signs.
Mr. Skip Quade, Chairman of the Deisgn Review Committee, reported on
the committee's recommendations.
Following considerable discussion, Alderman Torgerson moved to approve
and to waive first reading of Ordinance No. 33/88 and set the second
reading for January 10, 1989, with the following changes that the "sign -
age in the Main Street area, which is defined as the area located be-
tween the East side of Franklin Avenue from the Crow River to Fourth
Avenue Southwest and the West side of Hassan Street from the Crow River
to Fourth Avenue Southeast shall be subject of the following additional
requirements." Alderman Mlinar seconded the motion and carried three
to one, with Aldermen Mlinar, Torgerson and Carls voting aye and Alder-
man Mikulecky voting nay.
(m) CONSIDERATION OF VARIANCE REQUESTED BY LANCE HEATON FOR PARKING AT
WESTSIDE GROCERY WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION

(p) CONSIDERATION OF MERIT INCREASE FOR CITY ADMINISTRATOR
Alderman Mlinar moved for a one percent increase, retro- active to the
City Administrator's anniversary date. The motion was seconded and

(q) CONSIDERATION OF FINANCING OF POLICE RECORDING MACHINE
Following discussion. Alderman Torgerson moved to approve and enter
into a contract with Dougherty Dawkins Lease Group, Inc. Motion sec-
onded by Alderman Mlinar and unanimously carried.
(r) CONSIDERATION OF COMPUTER MAINTENANCE IN POLICE STATION
Following discussion, Alderman Mikulecky moved to approve State Con-
tract M8333 for $13 per month. Motion seconded by Alderman Torgerson
and unanimously carried.
(s) CONSIDERATION OF RESOLUTION DESIGNATING COUNTY STATE AID HIGHWAY NO. 7
Following discussion, Alderman Mlinar moved to approve and waive read-
ing and adopt Resolution No. 8933. Motion seconded by Alderman Miku-
lecky and unanimously carried.
(t) CONSIDERATION OF REMODELING HOSPITAL COURT YARD
Following discussion, Alderman Mlinar moved to approve the remodeling.

(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
City Administrator Plotz reported on a meeting with Hutchinson Tech-
nology, "no. regarding Bluff Street improvements.
(b) COMMUNICATIONS FROM ALDERMAN JOHN MLINAR
Alderman Mlinar commented on the need to install a guard rail on the
east side of Jefferson Street at Century Avenue for safety reasons.
He further commended the individuals responsible for the lighting this
year and mentioned the favorable comments that were received.
(c) COMMUNICATIONS FROM ALDERMAN PAT MIKULECKY
Alderman Mikulecky inquired if the Hutchmobile would be available on
New Year's Eve for anyone desiring a ride.
(d) COMMUNICATIONS FROM CITY ATTORNEY
Attorney Anderson reported that Judge Mansur had denied the Hinde's re- .
quest for post trial relief. The plaintiff will, therefore, have to
decide whether or not to appeal to the court of appeals.
(e) COMMUNICATIONS FROM DIRECTOR OF ENGINEERING
Engineer Anderson commented on a letter received from the City's ap-
praiser regarding monetary consideration from MN/DOT for the purchase
along Hwy. 22 South, and it was his opinion that the $800 offer was
low. Anderson stated that MN /DOT will proceed with condemnation in
order to maintain their schedule.
(f) COMMUNICATIONS FROM ALDERMAN MIKE CARLS
Alderman Carls commented on the recent City auction and suggested that
the City obtain quotes locally for future auctions.

Hutchinson Police Commission Meeting
December 21, 1988
The Hutchinson Police Commission met on Wednesday, December 21, 1988 at 12:00
noon at the Police Department. Members present were Jeff Haag, Delores Saar
and Kevin Compton. Also present was Chief Steven Madson and Sergeants Gregor
and Kirchoff.
Chairman Jeff Haag opened the meeting by inquiring as to what information Chief
Madson had found regarding the testing procedure to be used to establish
an eligibility roster for patrol officers. Chief Madson advised that it is
very difficult to find a test for patrol officers, as most are geared toward
administration. He found that many localities are waiving a written exam
because of the P.O.S.T. exam which all officers who are licensed or
eligible to be licensed have previously taken. He then made the
recommendation that we eliminate a written test and take the following steps:
1) Determine that they are licensed or eligible to be licensed.
2) Review resumes and compare resume to job description.
3) Review resumes more closely and bring in for interviews
4) Determine which applicants to do background investigations on - possibly
10 applicants.
5) Review background information and make a recommendation of three
applicants to the Council.
Steve then advised that the Council has appropriated the funds for a School
Liaison /Emergency Planner position
but they have not yet given the approval to seek applicants, which they
must do. Once that has been done the Police Commission will be notified to
begin the advertising process.
Jeff Haag then made a motion to accept the P.O.S.T, exam as the written exam
Delores Saar seconded the motion and it was approved.
A second motion was made by Jeff which states that Sergeant John Gregor will
submit to the Commission a list of the basic procedural requirements to be
used to establish the eligibility roster. Kevin Compton seconded the motion
and it was approved.
Jeff advised that the City Council, by resolution at the last Council
meeting, had encouraged the Police Commission to retain Chief Madson on a
permanent basis. Jeff then made a motion that Steven Madson be made a
permanent full time employee of the City of Hutchinson and that his probation
end as of this date, December 21, 1988. The motion was seconded by Delores
Saar and approved.
The meeting adjourned at 12:45.

Parks & Recreation Board
November 30, 1988
Members present: Lyle Block;chairman, Virgil Voight, Lee Cox, Linda Martin,
and John Mlinar. Also present were Bruce Ericson, Mary Haugen and Karen McKay.
Guest present: Todd Grins; High School Hockey coach.
The meeting was called to order at 5:15 p.m.
The minutes dated October 26, 1988 were approved by a motion made by Linda
Martin, and seconded by Lee Cox. The board unanimously agreed.
Lions Halloween Party
The board received a copy of a letter from the Lions Club requesting use of
the Recreation Center Monday, October 30, 1989 from 5:00 -9:00 p.m. and Tuesday,
October 31, 1989 all day for the annual Halloween Party. They also requested
that the rental fee be waived for 1989 as it was for 1988. Bruce told the
board that the revenue for an evening was in the area of $216. Virgil made a
motion that the request be approved, Lee seconded the motion. The board agreed
unanimously.
Lighting of Library Square
The Christmas lights in Library Square are on a timer. Recently a timer was
added to the Hospice Tree. There have been many favorable compliments on the
lighting this year.
Celebrate 1990 Grant Application
Celebrate 1990 is a beautification project goal for all of Minnesota. Ralph
Johnson's sixth grade science class presented the proposal to the City Council.
Seven service organizations expressed support for the project. The application
will include the planting of 161 boulevard trees from Linden Avenue south to
Century Avenue, and a gravel bikeway /walkway from the Bass Pond area to School
Road Bridge. This bikeway /walkway is part of the Luce Line Trail and will be
blacktopped by the Department of Natural Resources (D.N.R.) in the future. A
sidewalk was added to the application leading from the Luce Line Trail and
proceeding north to Millers Woods. Millers Woods will contain a two thirds
mile nature trail. Several cities will be applying for this grant.
Bruce told the board that the city didn't get the grant. The LAWCON
representative did not have the same procedure for gaining and subtracting
points as the last year's representative. Bruce is waiting for an analysis.
Board Member Replacement
There is still an opening on the board from the vacancy of Peg Shaffer. Jay
Beytien has expressed an interest in the position. It was the opinion of the
board that another female be appointed.

Smoking in Public Buildings
Todd Grins, High School Hockey coach, was present to state his concern in
regards to smoking in the Civic Arena. Mary contacted the State Department of
Health to confirm the regulations regarding smoking in public buildings. A
smoking area has to be ventilated, the area cannot be an entrance or exit to a
building.
After a brief discussion, Virgil Voight made a motion that the Civic Arena and
Recreation Center comply with the Minnesota Clean Air Act to have "smoke free"
buidings enforced immediately. John Mlinar seconded the motion, and the board
unanimously agreed.
Civic Arena
Complaints were registered with board members regarding the Civic Arena,
including a request for the outside doors to be reattached to the entryway.
Mary felt the complaints could be resolved, and the doors could be replaced.
Long range plans for the Civic Arena are to include $150,000 worth of repair
over the next five years with an agreement made with the School District. Lyle
requested that Marv, along with Lee Cox and Linda Martin, compile and
prioritize a list of items to bring to the March meeting. The money won't be
available until 1990, the school will be using the city's portion to repair the
High School tennis courts in 1989.
The Youth Hockey Association has requested extra ice time on Saturday, February
11 for a Pee Wee Bandom B tournament. This would involve cancelling some
figure skating lessons. The board felt that the request should be denied, but
should perhaps be considered next year when the ice time schedule is prepared.
Arts & Crafts Show
Virgil Voight felt that the electric supply in the Library Square area was not
adequate. This past year a "Taste of Hutchinson" was added to the Arts and
Crafts Show, and several vendors were in need of an electric supply. He feels
that as the "Taste of Hutchinson" will become more popular. John Mlinar felt
that the city would pay for improvements made. Bruce should contact Utilities
and have Butch give him a recommendation, and the actual work contracted out.
Bruce Accepts Position in Brainerd
Bruce told the board that he has accepted the position of Director of Parks and
Recreation in Brainerd. He expects to resign from the City of Hutchinson the
end of December, and begin working in Brainerd after the first of the year.

Glencoe Jaycees
I have reviewed the short -term non- intoxicating malt liquor license appli-
cation submitted by the Glencoe Jaycees for the purpose of serving beer on
the Crow River during the Sno -Break weekend.
I do not believe at this time that the City Council has jurisdiction to issue
a liquor license for this event because the event is being conducted on the
Crow River, and it is my understanding that the waterways belong to the state.
And, therefore, I do not believe the City Council has jurisdiction. I have
contacted the City Attorney for an opinion regarding this issue.
Additionally, I would not recommend your approval based on the fact that the area
of consumption has not been well defined and no site plan has been provided
by the Glencoe Jaycees. Another potential problem exists from the standpoint
of alcohol being consumed in an area where the participants of the race will
be located, and there have been no reasonable safe guards provided to prohibit
the participants from consuming and then utilizing vehicles at excessive speeds.
I believe that this creates a very serious safety hazard.

An ordinance adopting Minnesota statutory taw governing library boards of
directors:
AN ORDINANCE ADOPTING MINNESOTA STATUTES 44134.001 THROUGH 134.15 FOLLOWS
WHICH WILL GOVERN AND DEFINE THE DUTIES AND POWERS OF THE CITY OF HUTCHINSON'S
LIBRARY BOARD OF DIRECTORS. THE CITY COUNCIL'S ADOPTION OF THE MINNESOTA
STATUTORY LAW IS PREFACED BY COMMENTS DRAFTED BY RALPH BERGSTROM REGARDING THE
HISTORY OF THE CITY OF HUTCHINSON'S LIBRARY.
The City of Hutchinson now seeks to adopt an ordinance formally organizing the
Library Board. The history of the Hutchinson Public Library dates back to
1874. Asa B. Hutchinson, one of the founders of the city, and other citizens
donated books and money to purchase library materials.
Library circulation was increased to some extent by the so- called "Traveling
Libraries" that brought fifty books each month from the State Library. Books
were acquired by public subscription of $1.00 annually. Contributors were
allowed free use of the books. Others were charged a fee of 5C per book for
two weeks' use.
The books were housed in the Rideout 8 Hutchinson Drug Store and a fee was
paid to the druggist as caretaker. The library was a very successful venture
and it became evident that the library needed a building of its own. In a
regular city election on April 2, 1901, it was voted to establish a Free
Public Library. The Village Council was also authorized to levy such taxes as
allowed for the support of the library. The vote was 276 to 76.
The first Library Board was elected by the voters on July 20, 1901. At that
time the following were elected to serve:
E.J. Stearns, H.L. Merrill, L.P. Harrington, J.R. Larson, Carlos Avery,
Mrs. C.S. Tredway, Mrs. H.L. Merrill, Mrs. J.L. Farber and Mrs. O.A.
Kohler. E.J. Stearns was the first president of the Library Board and
Marjorie Wakefield was the first librarian.
In 1902 the Board leased two rooms in the drugstore located on the telephone
company's building as the first site of the Free Public Library. It was
formally opened to the public on September 3, 1902. The library was an
outstanding success from the start and soon outgrew its quarters. A most
welcome opportunity presented itself in 1903 when Andrew Carnegie offered to
donate $10,000 toward building a new library. The only condition imposed by
Mr. Carnegie was that a sum total equal to 10% of the amount given should be
raised each year for maintenance of the library. In a city election held in
May, 1903 the city voted to accept the gift and also voted to place the new
building in the Public Square which had been reserved for park purposes by the
founders of the village. The city provided an additional $2,500, making the
total cost of the building $12,500.
The new building was dedicated on June 21, 1904. Mrs. Clara Baldwin of the
State Library Board was the main speaker at the dedication. A colonial clock
was presented to the library by the ladies of the Fortnightly Club. The clock
is still being used today. The library was open two days a week, seven hours
per day.
In 1975, Hutchinson Public Library became a member of the Crow River Regional
Library and in 1985 joined the Pioneerland Library System which includes the
following counties: McLeod, Meeker, Kandiyohi, Chippewa, Swift and Big Stone
as well as the cities of Madison, Dawson, Bird Island, Renville and Hector.
In 1977 the Minnesota Historical Society and the Interior Department of the
United States in Washington, D.C., placed the Hutchinson Public Library
building on the National Register of Historic Places. This insures its future
preservation and any additions that are made must be in in conformity with the
original architecture.
The City Council of the City of Hutchinson does ordain as follows:
Minnesota Statute § §134.001 through 134.15 are hereby adopted and incorporated
as if set out at length herein. Statutory language governing length of board
members' service shall compute current board members' accrued service in
determining maximum terms and years of service.
The Hutchinson City Council hereby declares that should any section, paragraph
or sentence of this ordinance or of the statutory language hereby adopted is
declared for any reason to be invalid, all other portions of this ordinance
are valid and independent of any such portion declared invalid.
This ordinance shall take effect upon passage and publication.

THAT G, Barry Anderson be appointed as City Attorney at a retainer fee
for a one year period from January 1, 1989 to December 81, 1989. Services to be
included within the retainer fee are: prosecution of Police Department cases;
attendance at all Citv Council and Planning Commission meetings; preparation
of Resolutions and Ordinances; negotiating property acquisition and counseling
property owners on relocation law and benefits; legal services for all bond
issues, except legal services for industrial revenue and tax increment bond /note
issues and other customary legal services in the normal cause of City business.
Matters such as appearance in county, state district, or federal dis-
trict court will be billed separately, with an annual ceiling for such legal
expenditures as determined by the City Council. State Supreme Court and Court

I am assuming the State of Minnesota has done an appraisal of the
subject property. we would appreciate receiving a copy of the
appraisal as soon as possible. It is also our understanding that up
to a specified sum, the State will reimburse the City for appraisal
expense and the City would like to make arrangements for an
appraisal. Please confirm this point at your earliest convenience.
Finally, it is my understanding that on March 24, 1989, the Court
will consider the Petition for Eminent Domain and at that time the
public purpose of the eminent domain proceeding can be considered.
It will be my recommendation to the City Council that the public
Purpose of this proceeding not be challenged and the City will not
oppose the scheduled "quick take" now scheduled by the State of
Minnesota.
The only offer we have received from the State was for the sum of
$800 which was felt to be inadequate and it is on that issue that
the City and State part company.
If you should need any further information or have any questions,

NOW. THEREFORE, it is agreed as follows:
1. The State will reimburse the Municipality for the reasonable expenses and costs, hereafter referred to as acquisition
costs, incurred by the Municipality in acquiring property for its airport. The Municipality shall provide the documentation
set forth in pargraphs 3 and 4 of this Agreement within two years, or four years if property owner elects to receive pay-
ment in four installments, according to Minn. Stat. § 117.231.
2. The estimated acquisition cost is S Z101006.00 . The proportionate shares of the total project cost
are Federal %. State L L "ili1 Wo, and Municipal 3 3 Y3 % and the State's
obligation shall not exceed s J'JD, 000. 00 . In the event federal reimbursement becomes available
or is increased for acquisition of this property, the State shall be entitled to withhold from such Federal funds an amount
not to exceed the State share of this Agreement. No funds are committed under this Agreement until they are en-
cumbered by the Minnesota Department of Finance.
3. The State will reimburse1he Municipality when it has presented to the State the following:
a. A survey satisfactory to the State which shall be by a registered land surveyor and shall show the location of said
property.
b. A written appraisal report satisfactory to the State and conforming to the standards required by Minn. Slat. § 117.52
by a real estate valuation expert approved by the State, showing the fair market value of the property.
c. Satisfactory copies of conveyance instruments for all property interests acquired.
d. Paid invoices satisfactory to the State, which invoices shall show the fact and date of payment, to whom payment
was made by the municipality and for what purpose.
e. An attorney's written opinion satisfactory to the State showing that the Municipality has a valid fee simple absolute It-
tle to, or a valid easement over, any property acquired. In the case of an easement, the opinion shall also show the
fee simple ownership and the municipality's valid easement. The easement shall be superior to the interest held by
others and their interest shall be shown in the title opinion.
I . Satisfactory evidence or certification by the appropriate municipality officer that the Municipality has complied with
Minn. Slat. § 117.52 in any property acquisition under this Agreement.
4. In the event that the Municipality decides to acquire title to property by eminent domain upon receipt of a written request
by the Municipality the State may issue its check for the appropriate amount payable to the Municipality and the Clerk of
the appropriate District Court. This procedure shall be used only if the Municipality certifies that it does not have suffi-
cient funds to acquire, with its own funds, the property necessary for the airport. In this event, the following procedures
shall apply before payment is made by the State:
a. The Municipality shall certify that it does not have sufficient funds to acquire with its own funds the property
necessary for the airport.
b. The Municipality shall present to the State a satisfactory survey which shall be by a registered land surveyor and
shall show the location of the said property.
c. The Municipality shall present to the State a satisfactory written appraisal report by a real estate valuation expert ap-
proved by the State, showing the fair market value of the property being acquired by the eminent domain procedure.
d. The Municipality shall provide the State with a copy of the petition and a statement of the amount to be deposited in-
to court for each parcel.
e. The attorney for the Municipality shall submit a written opinion to the State that, upon the deposit of the necessary
funds into the office of the Clear of District Court, the Municipality will have acquired fee simple absolute title, or a
valid easement as to the land to be acquired.
In the event that the fair market value of the property, as determined by Commissioners or by a jury, exceeds the
amount paid into court under procedures in paragraph 4, [hen the reimbursement procedures, as described in
paragraph 3 above, shall be used. If, however, the fair market value as finally determined is less than the amount
paid into court, then the surplus shall be returned by the Municipality to the Stale.
5. The State shall evaluate acquisition costs and the adequacy of the size of the property and of the property interests ac-
quired. The amount of State participation shall be based upon that determination.
6. The Municipality shall operate and maintain its airport as a licensed, municipally -owned airport at al' times of the year
for a period of twenty years from the date that the Municipality first received such reimbursement under this Agreement.
The Municipality further agrees that it willnot sell, mortgage, lease, assign, abandon, use for other than airport purposes,
or in any way transfer any of the Municipality's interest in the airport property without prior wirtten approval of the State,
and then such transfer may be made subject to such conditions as the State may designate at that time.
7. If the Municipality fails to comply with the terms of this Agreement, the State may terminate it upon 30 days written
notice to the Municipality, and the Municipality will return upon demand to the State the amounts received hereunder
plus interest at 6% per annum from the date of payment.
8. The Municipality presently has available sufficient unencumbered funds to pay its share of the acquisition costs and it
shall be responsible in the execution of this Agreement that all provision of its municipal charter and applicable state
and federal laws have been strictly followed.
9. The Municipality shall maintain its records and provide information at the request of the State so as to permit the
Department of Transportation, the Legislative Auditor, or the State Auditor to examine those books, records, accounting
practices and procedures of the Municipality relevant to this contract pursuant to Minn. Star. § 168.06 Subd. 4.
10. The Municipality shall save and hold harmless the State from any claims, liabilities, or damages including but not limited
to its costs and attorneys' fees arising out of the property acquisition financed hereunder..
11. The Municipality agrees that all contracts for materials, supplies, or work performed under this agreement shall comply
with the equal employment opportunity requirements of Minn. Stat. § 181.59.

Attached is the pay plan Resolution for 1989, incorporating
the new pay table previously approved by the council and the
new positions authorized in the past year.
This Resolution is the same as in previous years, with no
proposed changes. Attention is drawn to the fact that
Section (C.3.) provides for merit reviews. The council set
limits on merits in 1988, and it is our intention to keep
within the same limits in 1989. That is, for employees
above midpoint, the maximum amount that can be granted is
2 %, with an overall average of no more than 1.25 %. Those
few employees below midpoint would be eligible for up
to 4% consideration.

RESOLUTION ADOPTING POSITION CLASSIFICATION
ASSIGNMENT TABLE EFFECTIVE JANUARI 19 1989
WHEREAS, the City Council has considered the existing classification of
positions for the City of Hutchinson and the current economic conditions,
BE IT RESOLVED, that a Position Classification Plan is hereby adopted.
All positions covered by this Resolution shall be grouped in grades having a
definite range of difficulty and responsibility. For each position there
shall be a title; and there shall be shown examples of work which are
illustrative of duties of positions, as well as requirements as to knowledge,
abilities and skills necessary for performance of the work; and a statement of
experience and training desirable for recruitment into a position.
A. Allocation of New Positions.
When a new position is created for which no appropriate description exists or
when the duties of an existing position are sufficiently changed so that no
appropriate description exists, the City Council after recommendation of the
Personnel Coordinator shall cause an appropriate job description - specification
to be written for said position.
B. Review of Plan.
As often as necessary to assure continued correct classifications, the
Position Classification Plan shall be reviewed by the Personnel Coordinator
and necessary adjustments recommended to the City Council.
C. Filing of Plan.
Upon adoption of this Resolution, a copy of the Position Classification
Plan approved by the City Council shall be placed on file with the City
Administrator. The plan so filed and subsequently adjusted by the
Council shall be the Position Classification Plan of the City.
1. Elements of the Plan. The Compensation Plan shall consist of:
a. A Basic Table of Numbered Pay Grades for All Employees.
Each numbered pay grade in the basic table consists of a minimum
(Level 1) rate, a maximum (Level 7) rate, and a midpoint (Level 4)
rate, in addition to intermediate levels, shown on page 4.
b. A Position Classification Assignment Table for Employees.
The assignment table shall assign all of the various positions in
the Position Classification Plan to the appropriate pay grade.
Said table follows on page 3.
2. Modification of Plan.
• The City Council reserves the right to modify any or all of the
pay grades or position classification assignments as set forth in
said plan at any time.

a. Non - Administrative (Hourly) Employees.
Each position is assigned a pay grade. The normal beginning rate
for a new employee will be the minimum rate. After satisfactory
completion of six (6) months probation, a five percent increase will
normally be granted. Thereafter, consideration for performance
increases will be given annually each individual anniversary date.
The City Administrator reserves the discretion to adjust individual
rates within the assigned pay grades based upon (a) a merit review and
recommendation from the department head, reflecting job performance
over the preceding twelve months, and (b) consideration of equity
among departments. Consideration for market adjustment for all
pay grades will be made each January 1.
b. Administrative (Salaried) Employees.
Each position is assigned a pay grade. The normal beginning rate
for a new employee will be the minimum rate. In special situations,
a beginning provisional (Level 0) rate may be used. After
satisfactory completion of six (6) months probation, a five percent
increase will normally be granted. Thereafter, consideration for
performance increases will be given annually each individual
anniversary date. The City Administrator reserves the discretion
to adjust individual rates within the assigned pay grades based
upon (a) a merit review and recommendation from the City
Administrator or department head, reflecting job performance over
the preceding twelve months and (b) consideration of equity among
departments. The Council will determine any merit increase for the
City Administrator. Consideration for market adjustment for all pay
grades will be made each January 1.
c. Police Civil Service Employees.
In Police Civil Service positions, the established starting rate
for patrol officers shall be Grade X, Level 2, followed by a
probationary period of one year. After completion of probation, an
increase to Level 3 shall be granted. Likewise, an increase to
Leve14 shall be granted after completion of two years employment
and to Level 5 after three years employment. Thereafter, length of
service shall be recognized as follows:

Supervisory and investigative police department personnel shall be
salaried, with salary subject to periodic review by the Chief of
Police, and any recommendation for merit adjustment made to the City
Administrator. Any market adjustment on January 1 of any year shall be
separate and apart from the merit adjustments.
None of the increases provided by this section shall be made so as to
compensate any employee in an amount exceeding the maximum step in the
assigned pay range.

Our office has been contacted by the McLeod County Attorney regarding
the above - referenced matter. As you may recall, the City of
Hutchinson stepped into the Maplewood drainage problem and conducted
extensive research and some cleanout services in an effort to deter-
mine what, exactly, was causing Maplewood Academy's drainage problem.
If I am interpreting my notes correctly, the City Engineer concluded
the line was functional and further concluded throughout the entire
744 foot test segment, the line was essentially clear. No evidence
exists that the line was crushed at any point by the City. Perhaps
before the City Engineer leaves, he could prepare a short memorandum

In any event, the City has 156 man hours invested to date in this pro-
ject. The County has offered to turn over to the City maintenance
(funds on the line totalling $1,350. I am prepared to recommend accep-
tance of that offer since the City has per orme the services.

Dear Mr. Ids:
The County Ditch pipe in the northeast part of the city has long been a
problem, especially as it pertains to draining the northeasterly portion of
the Maplewood Academy property. That portion of the Academy land, which at
one time was drained by the County Ditch 18 pipe, has not been served for a
number of years and consequently, water ponded making the land unfit for
agricultural use. Property so affected totaled about II.5 acres on the average.
Besides being a nuisance, the ponding water was the source of potential
litigation because Maplewood Academy intended to bring suit against the City if
the drainage problem was not corrected. It had been assumed that, when homes
were built adjacent to the County pipe on the block lying between Ninth Avenue
and Northwoods Avenue between T.A. 15 and Oak Street, such construction either
collapsed the pipe or otherwise damaged it so that it no longer carried runoff.
The Academy laid the blame on the City through its building inspection
activities. The problem was brought to the attention of the County Board this
past winter during a joint meeting between the Board and the City Council.
in an effort to resolve the matter, the City began to attempt to isolate the
exact location of the blockage in the pipe on April 6th, 1988. Several points
along the presumed route of the pipe at and south of Northwoods Avenue were
excavated to determine the exact depth and location of the pipe so as to
evaluate the pipe. For the most part, the pipe for a distance of about four
block south of Northwoods Avenue was at least half full of soil and mud. Pipe
cleaning and location work was done by City personnel as scheduling permitted
using pipe jetting and vacuum cleaning equipment. Excavation work and
construction of manholes, which were needed to permit cleaning of the pipe that
had numerous changes in direction and sections that were too lengthy to
otherwise permit cleaning, was done for the City by Juul Contracting. Finally,
on June 2nd, 1988, the pipe lying in the block between Ninth Avenue and
Northwoods Avenue and between T.H. 15 and Oak Street was opened. The pipe was
completely plugged with mud and soil for a distance estimated to be two hundred
feet. The ponded area on the Maplewood Academy property immediately began to

drain and was ultimately completely drained. That area is still dry at the
present time due to the City's efforts.
Since maintenance of the ditch system is ultimately the responsibility of the
County, the City requests and expects reimbursement of costs incurred for
correcting this chronic problem. Those costs are summarized below and are
substantiated by accompanying invoices, and labor and equipment documentation.
All invoiced costs have been paid by the City.

reached on the claims of Mr. Sturges regarding construction of a
ditch located on the southerly edge of the City of Hutchinson.
To review briefly, you may also recall that the settlement proposal
made by the plaintiff in this matter was a demand in the neighbor-
hood of $35,000.00 plus the loss of use of the real estate.
Since council authorization, I have been in contact with the attorney
for the plaintiff and this matter has been thoroughly analysed and
is argued; plaintiff's demand has dropped steadily and the settlement
proposal now on the table, without any additional offer on the part
of the City of Hutchinson, is $15,000.00. A copy of the settlement

The insurance carrier for the City of Hutchinson has no responsibility
for damages arising out of the loss of the land. Nonetheless, I have
arranged to have the insurance carrier contribute $1,000.00 towards
the settlement amount plus pay the additional damages claimed by
Sturges for the loss of the use of the land (which amounts to only
$160.00) .
Thus, the settlement proposal before the city council is to pay the
sum of $14,000.00 ($15,000.00 minus $1,000.00) in exchange for an
easement and in exchange for a commitment to cover the ditch when
it would become appropriate and consistent with existing city policy.
The precise language would need to be approved by the city engineer,
but I assume in general this concept is acceptable.
It would be my recommendation to the city council that the proposal
now before the City of Hutchinson be approved. It is possible, of
course, that if an eminent domain proceeding were completed the
damages would be less than $14,000.00. However, I think a more
likely outcome is probably of an award of somewhere between ten and
twelve thousand dollars and frankly, the risk of a much higher award
is not worth the gamble represented by the additional two thousand
dollars in the proposed settlement.
• It would be my recommendation to simplify matters and to have the
settlement proposal as outlined by Mr. Malecki's letter dated
December 28, 1988, approved subject to approval by the city engineer
and city attorney of the language to be included in the release of
all claims.
Obviously, we would also need an easement from Mr. Sturges as part
of the settlement.
The easiest way to handle this matter is to allow this matter to be
placed on the agenda unless someone objects strongly and wishes to
have a closed meeting. Please let the administrator know if that is
your wish.

I am enclosing and sending to you a copy of a settlement proposal
received from Attorney Malecki dated December 28, 1988 which is, I
believe, self - explanatory. Mr. Malecki and I have had several con-
tacts regarding this matter and regarding the possibility of settle-
ment. I have advised him repeatedly that settlement in the $30,000
to $40,000 range, which his client apparently feels he is entitled
to, is not realistic and will only prompt an extensive and compli-
cated eminent domain proceeding. I strongly urged his client to
adopt a more reasonable approach.
I am pleased to report that the December 28, letter is, in my opi-
nion, a much more reasonable proposal. I am also sending a copy of
the letter to Eugene Anderson because part of the proposal requires
the enclosure of the ditch at the appropriate time which, I assume,
the City will want to do in any event, although that day is probably
a long ways off.
I would ask that this matter be placed on the agenda for the next
regularly scheduled Council meeting. I am also engaged in settle-
ment negotiations with the insurance carrier and I may very well
request that the matter be deferred to the last meeting in January,
but there is at least a possibility that we can wrap it up earlier

and for the time being, please place it on the agenda for the first
meeting in January.
I believe we are close enough to settlement that a closed meeting
will not be necessary unless some member of the Council feels
strongly about the need for a closed meeting.

I have now conferred with Mr. Sturges concerning the
possible settlement of his dispute with the city of Hutchinson.

Mr. Sturges has authorized settlement of his dispute with
the city of Hutchinson on the following terms and conditions:
1. The city of Hutchinson would pay Delmer Sturges $15,000
in return for the grant by Mr. Sturges of a perpetual easement
to the city of Hutchinson, permitting them to discharge storm sewer
water into the presently existing open ditch, which easement would
contain a proviso that would require the city to eventually install
a buried pipe to receive this water and to fill in the open ditch
at a point in time in the future that would be consistent with
established city policy for the handling of storm sewer drain water
through buried pipes when development of the surrounding area reaches
the point that city policy /procedure would require that the storm
sewer water be handled via a buried sewer pipe as opposed to an
open ditch.
2. Payment by the insurer for the city of a reasonable
sum for loss of use of the land in question from the date that
• Mr. Sturges cancelled the contract with Albertson and continuing
through the date of the settlement contemplated by this letter.

This amount would be determined by the reasonable cash rental value
of the lands in question for the time frame in question, based
on a usage of the lands as agricultural lands.
I recognize that some additional negotiation would be
necessary to come up with language that would be acceptable to
both Mr. Sturges and the city as concerns the proviso outlined
at subparagraph 1 above for future transformation of the open ditch
to a buried storm sewer pipe, and would suggest that you and I
negotiate on that language once we have agreement as to the basic
settlement concept outlined above.
If settlement is not achieved, Mr. Sturges has directed
that we fully resist any petition by the city for condemnation
of the land in question on the basis that the city can demonstrate
no public need or necessity for a fee taking and that an easement
permitting the city to bury a sewer drain pipe across the Sturges
land to accommodate the water discharging therefrom would be more
than adequate to meet the public's needs.
Both Mr. Sturges and I hope that protracted and expensive
litigation can be avoided in this matter, and we do look forward
to hearing from the city with respect to the proposal outlined
above.
I am willing to exchange our appraiser's report with
you in return for a copy of your appraiser's report.

SUBJECT: DOWNTOWN SIDEWALK SNOW REMOVAL POLICY
This is to inform you that the City of Hutchinson has an ordinance that prohi-
bits allowing snow and ice to collect on public sidewalks for more than 24 hours
after its deposit thereon.
Regarding the downtown business district sidewalks and where no boulevard (grass
area) exists, the city is in the second year of an experimenter program.
Specifically, the program o� applies when there is 3 inches of snow or more
ter- - - -�
and the street t ere ore requires win - rowing . In this situation the city
removes the bulk or majority o the snow on the sidewalk, however miscellaneous
cleanup around buildings, entrances, posts, etc. is still the responsibility of
the owner /tenant, because of the limitation of our epuipment and manpower. The
initial city removal of the bulk of the snow from sidewalks will be done only
once, the remaining snow or snow thrown by passing vehicles shall be the respon-
sibility of the property owner or occupant, and fall under the jurisdiction of
Section 635.05 of the city ordinance entitled Snow, Ice, Dirt, and Rubbish
Removal.
I hope this letter reaffirms our intentions for the winter of 1989. Thank you.

We have received and reviewed your application to renew your manufactured
home park license for Midwest Mobile Home Park, located in Hutchinson,
Minnesota. It has been decided to deny your renewal and you will
not be licensed to operate a manufactured home park at that location
for the calendar year 1989.
This decision has been made and this action taken for the following
reasons:
Minnesota Statutes section 327.14, subdivision 3, defines a manufactured
home park as "manufactured home park means any site, lot, field
or tract of land upon which two or more occupied manufactured
homes are located, either free of charge or for compensation,
and includes any building, structure, tent, vehicle or enclosure
used or intended for use as a part of the equipment of the manufactured
home park." During several months of 1987 and all of 1988 there
have not been two or more occupied manufactured homes located
on the site, lot, field or tract of land formally operated as
Midwest Mobile Home Park.
Minnesota Statutes, section 327.20, subdivision 1 (1) requires
that a responsible attendant or caretaker be in charge of every
manufactured home park. for over one year there has been no
responsible attendant or caretaker in charge of the manufactured
home park formally operated as Midwest Trailer Park.
Minnesota Statutes 327.20, subdivision 1 (2) requires that all
sewage and other water carried waste be discharged into a municipal
sewage system whenever available. There is a municipal sewage
system available to the park but because of delinquent bills
you are forbidden to discharge any sewage to the municipal sewage
system.
Minnesota Statutes 327.20, subdivision 1 (4) requires that an
adequate supply of water of safe sanitary quality be furnished
at each manufactured home. The park is connected to the municipal
water supply system but because of delinquent bills the water
has been shut off to the park for over a year.

5. Minnesota Statutes 327.20, subdivision 1 (7) requires that a
manufactured home park licensed prior to March 1, 1988 provide
a safe place of shelter for park residents or a plan for the
evacuation of park residents to a safe place of shelter within
a reasonable distance of the park. No shelter or plan for evacuation
has been made known to this Department.
6. Section 327.20, subdivision 3 requires that a manufactured home
park owner maintain streets and roadways in the park, so as to
permit passage of emergency vehicles and normal resident travel.
For over a year roads have been in disrepair to the extent that
vehicles could not pass through the park without difficulty.
On December 21, 1988, you submitted a fee for the renewal of your
license to operate during 1989. A fee of $30.00 cash was paid.
We are processing a refund and a check will be sent to you in the
near future.

PLEASE TAKE NOTICE that pursuant to the authority of the Department
of Health in Minnesota Statutes, section 327.18, subdivision 1, you
are hereby directed to abate the conditions set forth above in paragraphs
1 -6 and notified that no license will be issued until such conditions
are abated. •

before me if you so choose. Please direct any request for a hearing

This is a friendly letter to ask your cooperation in assisting the city in
re- locating the dumpster that is presently located adjacent to your building, as
shown in the attached photocopy.
The City Street Department would assist you in re- locating the dumpster, so
as not to interfere with city snow removal efforts. Specifically, Doug Meier or
Larry Karg from our street department will be contacting you. I understand that
they do have some ideas on alternative locations for the dumpster, plus the city
will offer some physical assistance to re- locate the dumpster.
Aside from the snow removal consideration, our city, like other communities
. in Minnesota are experiencing increasing insurance claims and premiums.' The
types of claims that we are seeing are claims resulting from "alleged"
negligence for maintaining streets, alleys, sidewalks, and parks in a "safe"
manner. We, therefore, are looking at the relocation of the dumpster as another
means to minimize any possible exposure from liability.
I realize your dumpster may have been there for years, however, Doug and
Larry have good ideas that I hope you will consider.

Please be advised that the trial court in the above entitled matter
has issued an order denying the plaintiff's requested post trial
relief. The plaintiff will now need to make a decision as to
whether or not to appeal from the adverse result at the trial level.
It is not clear to me whether or not the court has entered judgment
pursuant to a judgment and decree or has merely issued an order
denying a new trial; in any event, plaintiff will now have no longer
than 90 days and possibly no longer than 30 days to appeal to the
court of appeals.

Chairman Ulrich called the meeting to order at 7:30 p.m. Jeanette Buchanan attended
to ensure a quorum.
Turck /Conradi moved to approve the minutes of the November 14 meeting. Carried.
Approval of the treasurer's report for ;:ovember was delayed due to the absence of the
treasurer.
Director's report:
1. The statistical report for November shows an increase over November, 1987.
2. The Lake Lillian Library is in new quarters on Main Street.
3. Clippings were passed around.
4. The Mid- Minnesota Family Education Council received a Bremer grant of $2,300 to
purchase Family Life materials. PIS will administer the program.
5. Legislative Day is scheduled for February 21 in St. Paul.
Conradi/Buchanan moved approval of the bills. Carried.
New business:
Turck/Buhr moved to have the firm of Westberg and dischens audit PIS financial records.
Carried.
Committee and project reports:
1. ::xtension of Access - Four representatives from PLS met with the Canby Library
Board and Council on November 28, 1988.
2. The SAMMIE Governing Board met December 8 at Marshall. SAtiMIE will be sponsoring
a class on Basic Reference through St. Cloud State. The class will meet at the
Willmar Community College.
3. Automation Project planning has been on hold for two years due to lack of funds.
If the state legislature passes proposed funding legislation, automation ptans could
be implemented. Several regional library systems are considering the possibility of
pooling specifications for library, automation. Traverse des Sioux and Great River
systems have each written a proposal for automation p +ajacts, These could be combined.
4. The statewide circuit for the distribution of 16mm film packets to state library
systems is scheduled to end in 1991. Several systems, including Pioneerland, are
interested in forming a mini- circuit to keep these films in circulation.
Communications:
1. Pionearland Library System will receive $266,271: in State and Federal funds for
FY89.
2. Al Lewis of the LDS office has sent a chart showing amounts budgeted and per
capita payments for library systems in Minnesota.
3. Appointments of PLS Board members: Howard Turck, Meeker County; Margaret Jenner,
Bird Island; Sandy Casper, Graceville.
h. The PIS insurance carrier sent a check for $143.56 for medical expenses to a
Willmar library patron w}o stumbled on the boulevard.
The full board will meet January 9.
The meeting was adjourned at 8:32 p.m.
