The meeting was called to order at 5:30 p.m. by Mayor Torgerson.' Present: Mayor Marlin
Torgerson, Council Members Bill Craig, John Mlinar, Kay Peterson, and Don Erickson.

(b) CONSIDERATION OF ACCEPTING CROW RIVER TASK FORCE
RECOMMENDATION TO TERMINATE OTTER LAKE DREDGING PROJECT
Following discussion, Council Member Erickson moved to approve the
recommendation of the Crow River Task Force to terminate the Otter Lake dredging
project. Motion seconded by Council Member Mlinar and unanimously carried.
(c) DISCUSSION OF ENFORCEMENT POLICY OF 1991 -1994 UNIFORM FIRE
CODE REGARDING OPEN FLAMES IN PUBLIC PLACES (CHRISTMAS
CANDLELIGHT SERVICES)
The Reverend Max Myers stated he was addressing the issue of Christmas
candlelight services and representing the local churches as Chair of the Ministerial
Association. He commented that Fire Marshall Stotts had talked about the fire code
regarding open flames in public places, and he was seeking clarification from the
City Council regarding the fire code. It was noted that since the 1994 State Fire
Code has not been officially adopted, the State is still operating under the 1991 fire
code.
• Fire Marshall Stotts stated that both the 1982 and 1991 City fire code did not allow
lighted candles because there is a safety factor involved. Mr. Stotts reported that
the local Fire Chief has the authority to determine if lit candles can be used during
services within the municipality. He thought the City could have some liability if
there were a fire and the fire code was not enforced.
Following discussion, Council Member Craig made a motion for directive to the Fire
Chief to work out some kind of public safety guidelines for holding a candlelight
service for Christmas 1995. Motion seconded by Council Member Mlinar and
unanimously carried.
(d) CONSIDERATION OF PURCHASE OF FIVE REPLACEMENT HOSPITAL
BEDS AT HUTCHINSON COMMUNITY HOSPITAL
Following discussion, Council Member Mlinar moved to approve the purchase of
hospital beds, seconded by Council Member Erickson and unanimously carried.
10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ATTORNEY
City Attorney Anderson commented on a meeting held December 5, 1995, regarding
the Osgood/Hayden street improvement project. He stated the contractor is to make
a proposal for settlement of the dispute prior to December 21, 1995, so there may be
something to include in the December 26, 1995 City Council packet.

(b) COMMUNICATIONS FROM CITY ADMINISTRATOR
City Administrator Plotz requested authorization for the Finance Director to invest
funds for a long -term reinvestment fund and pass - through mortgages.

seconded by Council Member Erickson and unanimously carried.

SPECIAL CITY COUNCIL MEETING
TRUTH IN TAXATION HEARING
MONDAY, DECEMBER 4, 1995
The meeting was called to order by Mayor Torgerson at 5:00 p.m. Present were: Mayor Marlin
Torgerson, Council Members Bill Craig, John Mlinar, Kay Peterson, and Don Erickson. Also
present: City Administrator Gary D. Plotz, Finance Director Kenneth B. Merrill, and City Attorney
G. Barry Anderson.
Assessor Brad Emans explained to the audience how the system works to determine property
evaluation. He reported that while in the past three years the commercial values have remained
stable, or even gone down, the residential values have increased around 25 %. Mr. Emans stated the
1996 taxes are from the 1995 estimated market value. The Assessor reported that three factors
affect taxes: (1) the tax shift in values from commercial to residential; (2) the estimated market
value of homes, and (3) the budget of the three taxing districts (tax capacity).
Finance Director Kenneth B. Merrill reviewed the truth in taxation notice and the proposed property
tax for 1996, covering the various aspects of the city budget.
• From the approximate 40 people in attendance, about six residents expressed the overall opinion of
the group. It was the general consensus that the residents thought taxes were too high so they were
looking for an answer to the reason why residential taxes had increased considerably in the last three
years. They felt they had no control over the tax increases, and their salary increases are not keeping
up with tax increases. Several suggestions were presented as to how the City Council could reduce
the tax burden on the residents.

The Council Members reported that although they are making an effort to cut back on spending and
taxes, they are committed to bond indebtedness. It was the consensus of the City Council to make
every attempt to hold the line on future taxes.
The motion to close the hearing at 8:00 p.m. was made by Council Member Erickson, seconded by
Council Member Mlinar and unanimously carried.

Tuesday, November 21, 1995
1. CALL TO ORDER 5:30 P.M.
Is members meeting was called to order by Chairman Dean Wood at 5:30 p.m. with the following
members present: Craig Lenz, Glenn Matejka, Bill Arndt, Bill Craig, Dan Prochnow, Roger
Gilmer and Chairman Wood. Members Absent: None Also Present: Building Official Jim
Marka and City Attorney G. Barry Anderson.
2. CONSIDERATION OF MINUTES OF REGULAR MEETING DATED OCTOBER 17 1995
Mr. Lenz made a motion to approve the minutes as corrected dated October 17, 1995,
seconded by Mr. Craig the motion carried unanimously.
3. PUBLIC HEARINGS
a) CONSIDERATION OF PRELIMINARY AND FINAL PLAT TO BE KNOWN AS
"KRSIEAN ACRES PLAT TWO" SUBMITTED BY ANNA KRSIEAN LOCATED ON
13TH AVE N.W.
Chairman Wood opened the hearing at 5:32 p.m. with the reading of publication
#4882 as published in the Hutchinson Leader on Thursday, November 9, 1995.
The request is for the purpose of considering a preliminary and final plat to be
known as " Krsiean Acres Plat Two" submitted by Anna Krsiean located on 13th Ave.
N.W.
Building Official Jim Marka explained the replat of the existing area to accommodate
residential type lots. He stated the right of way in the south end of the cul -de -sac
is the only issue to be resolved and recommends approval of the preliminary plat
• with final plat approval in December contingent on deeding of the southerly portion
of the cul-de -sac. City Attorney Anderson stated he is comfortable with the wording
of the legal description for the cul-de -sac.
Mr. Ron Krsiean commented on the use of the property.
Discussion followed on the cul -de -sac or through street and the ghost plat in the
1970's. Discussion also followed on the septic systems in the plat with hook -up to
city in the Spring of 1996.
Mr. Craig moved to close the hearing, seconded by Mr. Prochnow the hearing
closed at 5:38 p.m. Mr. Craig made a motion to recommend approval of the
preliminary plat with staff recommendations. Seconded by Mr. Lenz the motion
carried unanimously.
4. OLD BUSINESS
a) CONSIDERATION OF HUSKI ADDITION POND DESIGN
Building Official Jim Marka commented on the pond design as provided by Sand
Companies, Inc. Mr. Marka stated the City Engineer considers the design adequate
and staff recommends the proposed grades comply with the "Best Management
Practices ". Discussion followed on the maintenance of the pond, fencing, depth
of the pond and horizontal slope.
City Attorney Anderson commented on the difference between ponds and swimming
pools and interpretation of the ordinance regarding swimming pools. He stated
fencing poses a problem and the City Council will ultimately decide if there is to be
fencing or not.

There was discussion of regulating ponding and swimming pools and defining the
term "detention ponds ". Discussion also followed on the time line for Huski
Townhouses and the possibility of beginning the process to add ordinance language •
regarding ponding.
Mr. Craig made a motion to continue this item to December, seconded by Mr.
Matejka the motion,carried unanimously. Mr. Craig made a motion directing city
staff to research the requirements for ponding in Hutchinson by contacting safety
engineers from HTI and 3M concerning standards of slopes on ponds and
presenting the information to the Planning Commission in December. Seconded by
Mr. Matejka the motion carried unanimously.

a) CONSIDERATION OF COMMUNITY EVENTS SIGN
Jim Marka commented on the donation from Citizens Bank of a digitized sign
located on the existing pylon by the river. He stated MnDOT is in approval of the
sign. City Council has accepted the donation. City Attorney Anderson stated the
Chamber of Commerce will handle the content of the sign. Discussion followed on
the size of lettering for advertising and content. It was the consensus of the
Planning Commission to formally accept the sign.
b) CONSIDERATION OF JOINT PLANNING BOARD STATUS
Mr. Marka explained the purpose of the Joint Planning Board and the One -Stop
Shop concept. He suggested to move forward with the board in an advisory
capacity as recommended by McLeod County Commissioners. This would open
communication between City, County and Townships. Barry Anderson stated the •
County Board is concerned with legal issues should the Joint Board be legislative.
He stated only one other county has a joint board.
Mr. Prochnow made a motion to move forward with the Joint Board as an advisory
board to pursue all avenues of communication. Seconded by Mr. Arndt the motion
carried unanimously.
C) CONSIDERATION OF SHALOM BAPTIST PARKING ARRANGEMENT
Jim Marka explained the present parking arrangement and stated staff recommends
approval of the request. Mr. Prochnow moved to recommend approval of the
request, seconded by Mr. Craig the motion carried. Mr. Matejka abstained from
voting.
d) CONSIDERATION OF REMOVAL OF PORTABLE SIGNS FROM PUBLIC RIGHT
OF WAY
Building Official Marka commented on the number of portable signs posted in the
city and the circumstances leading to the proposal of a policy regulating portable
signs placed in the city right -of -way. City Attorney Anderson commented on the
issues of signs placed in public right -of -way. Mr. Marka stated the street
department presently removes temporary signs of little value and the city notifies
violators when the signs are of more value. Discussion followed adopting a uniform
policy. Barry Anderson stated he would write an ordinance for the January meeting.
Mr. Matekja made a motion directing staff to bring back to Planning Commission
with recommendations. Seconded by Mr. Gilmer the motion carried. Mr. Prochnow .

f) DISCUSSION AND DIRECTIVE TO STAFF REGARDING LANDUSE/ZONING
DISTRICT OF PAWN BROKER ESTABLISHMENTS
Mr. Mark stated City Attorney Anderson is establishing a licensing procedure for
Pawn Brokers in Hutchinson. He explained the staff is recommending the pawn
broker establishments be permitted in C -3, C-4, 1 -1, 1 -2 and I/C Zoning Districts.
Discussion followed on the need to establish land use and zoning for these
establishments.
Mr. Prochnow made a motion to approve staff recommendations, seconded by Mr.
Craig the motion carried unanimously.
g) CONSIDERATION OF EXTENSION OF CONDITIONAL USE PERMIT FOR
CONSTRUCTION OF AN OFFICE BUILDING LOCATED AT 902 HWY 15 S.
Jim Marka commented on the request by Mr. David Broll to extend the conditional
use permit. Mr. Lenz made a motion to approve, seconded by Mr. Arndt the motion
carried unanimously.
COMMUNICATION FROM STAFF
• a) Discussion of request to rezone property in Helland's 4th Addition
Jim explained the request to rezone a lot in R -1 (Single Family Residence District)
to R -2 (Multiple Family Residence District) for twin homes. He stated staff would
recommend denial as this is "spot zoning ".
b) Discussion of request by V.F.W. to place military equipment on parking lot for
display
Mr. Marka commented on the inquiry by the V.F.W. to place a display in their
parking lot. He stated there is an existing variance for the parking requirement and
the staff has requested a site diagram.
C) Jim Marka commented on a request to place an 8' x 12' self contained Expresso
Coffee Shop in the parking lot located at Plaza 15.

I am enclosing herewith for your review and for consideration by
the City Council at the next regularly scheduled City Council
meeting an ordinance dealing with the regulation of pawn brokers
and precious metal dealers.
A little background is appropriate. As you know, the City of
Hutchinson has one pawn broker located within the City limits. As
far as I know, no significant problems have been encountered with
this operation. However, the experience in other communities ha as
positive and the Courts have been very willing to grant to
municipalities police powers to regulate such establishments.
Over the course of the last several years, the police department
and this office have discussed the regulation of pawn brokers and
the results of that discussion are set forth in the enclosed
ordinance.
This is, without question, the most detailed business regulation
ordinance ever adopted by the City of Hutchinson and that is
largely because of the potential for problems relating to such
establishments.
While regulating pawn brokers, I pointed out that it might be worth
considering the regulation of precious metal dealers as well,
. because quite frequently, the same problems associated with pawn
brokers also show up with previous metal dealers who, of course,
frequently accept in trade or purchase outright precious metals

land use issues as the planning commission is presently considering
the appropriate zoning for pawn brokers and I expect a
recommendation to come from the planning commission for
consideration by the City Council at the last regularly scheduled
December City Council meeting. By carbon copy of this
correspondence to Jim Marka, I would suggest that the land use
issues be phrased not only in terms of pawn brokers, but also
precious metal dealers at least until the Council decides whether
or not it wishes to include precious metal dealers within the
ambient of the ordinance.
Although the City should certainly not delegate its regulatory
authority to the individuals or businesses to be regulated, the
thought occurs to me that it nonetheless may make sense to provide
a copy of the proposed ordinance to those existing business
establishments that City staff can identify as likely to be subject
to these regulations so that the City avoids adopting regulations
that require the impossible or that are otherwise in need of
revision.
I would suggest that we have the first reading of the ordinance,
distribute copies as appropriate and then, if necessary, the second
reading could be delayed to take into account any changes that
might be appropriate.

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA, ADDING CITY CODE
SECTION 6.41 DEALING WITH THE REGULATION OF SECOND HAND GOODS
DEALERS AND PAWN SHOPS; AND, ADOPTING, BY REFERENCE, CITY CODE
CHAPTER 1 IN SECTION 2.99 WHICH, AMONG OTHER THINGS, CONTAIN
PENALTY PROVISIONS.
THE CITY OF HUTCHINSON ORDAINS:
Section 1. City Code, Sec. 6.41 is added and shall read as
follows:
SEC. 6.41. PAWN BROKERS AND PRECIOUS METAL DEALER LICENSES.
Subd. 1. Purpose. The City Council finds that
pawnbrokers and precious metal dealers potentially provide an
opportunity for the commission and concealment of crimes. Such
businesses have the ability to receive and transfer stolen property
easily and quickly. The City Council also finds that consumer
protection regulation is warranted in transactions involving pawn
brokers and precious metal dealers. The purpose of this section is
to prevent pawnbroking and precious metal businesses from being
used as facilities for commission of crimes and to ensure that such
businesses comply with basic consumer protection standards, thereby
. protecting the public health, safety and general welfare of the
citizens of the City.
Subd. 2. Definitions. The following terms, as used in
this Section shall have the meanings stated:
A. "Item containing precious metal" means an item
made in whole or in part of metal and containing more than one
percent by weight of silver, gold or platinum.
B. "Minor" means any natural person under the age
of 18 years.
C. "Oversized items" means large items such as
cars, boats, and other motorized vehicles and motorized equipment.
D. "Pawnbroker" means a person who loans money on
deposit or pledge of personal property or other valuable thing;
who deals in the purchasing of personal property or other valuable
thing on condition of selling the same back again at a stipulated
price; or who loans money secured by chattel mortgage on personal
property, taking possession of the property or any part thereof so
mortgaged. To the extent that a pawnbroker business includes
buying personal property previously used, rented, or leased, the
provisions of this section shall be applicable. Any bank, savings
and loan association, or credit union shall not be deemed a
. pawnbroker for purposes of this section.
E. "Person" means one or more natural persons; a
partnership, including a limited partnership; a corporation;
including a foreign, domestic, or nonprofit corporation; a trust;
a political subdivision of the state; or any other business
organization.
F. "Precious Metal Dealer" means any person
engaging in the business of buying coins or secondhand items
containing precious metal, including, but not limited to, jewelry,
watches, eating utensils, candlesticks, and religious and
decorative objects.
G. "Precious Metals" means silver, gold, or
platinum.
H. "Secondhand item" means tangible personal
property, excluding motor vehicles, which has been previously used,
rented, owned or leased.
Subd. 3. License Required. No person shall engage in
the trade or business of pawnbroker or precious metal dealer within
the city unless such person is currently licensed under this
ordinance.
Subd. 4. Exceptions to License Requirement.
A. Precious Metal Dealers conducting the following
transactions are not required to obtain a license under this
Section.
1. Transactions at occasional "garage" or
"yard" sales, or estate sales or farm auctions held at the
decedent's residence, except that precious metal dealers must
comply with the requirements of Minnesota Statutes, Sections
325F.734 to 325F.742, for these transactions.
2. Transactions regulated by Minnesota
Statutes, Section 80A.
3. Transactions regulated by the Federal
Commodity Futures Commission Act.
4. Transactions involving the purchase of
precious metal grindings, filings, slag, sweeps, scraps, or dust
from an industrial manufacturer, dental lab, dentist, or agent
thereof.
5. Transactions involving the purchase of
photographic film, such as lithographic and x -ray film or silver
residue or flake recovered in lithographic and x -ray film
processing.
6. Transactions involving coins, bullion, or
ingots.

7. Transactions in which the secondhand item
containing precious metal is exchanged for a new item containing
is precious metal and the value of the new item exceeds the value of
the secondhand item, except that a person who is a precious metal
dealer by engaging in a transaction which is not exempted by this
Section must comply with the requirements of Minnesota Statutes,
Sections 325F.734 to 325F.742.
8. Transactions between precious metal dealers
if both dealers are licensed under Minnesota Statutes, Section
325F.733, or if the seller's business is located outside of the
state and the item is shipped from outside the state to a dealer
licensed under Minnesota Statutes, Section 325F.733.
9. Transactions in which the buyer of the
secondhand item containing precious metal is engaged primarily in
the business of buying and selling antiques, and the items are
resold in an unaltered condition except for repair, and the items
are resold at retail, and the buyer paid less the $2,500 for
secondhand items containing precious metals purchased within any
period of 12 consecutive months.
B. A person who holds a motor vehicle dealer
license is exempt from the terms of this ordinance with respect to
motor vehicles.
Subd. 5. Persons Ineligible. The following_are not
eligible for licensure under this Section:
A. Anyone not a citizens of the United States or a
resident alien;
B. A minor at the time the application is filed;
C. Anyone who has been convicted of any crime
directly related to the licensed occupation and has not shown
competent evidence of sufficient rehabilitation and present fitness
to perform the duties of pawnbroker or precious metal dealer under
Minnesota Statutes, Section 364.03, Subdivision 3, or a person not
of good moral character and repute;
D. Anyone who holds a liquor license;
E. Anyone who, in the sole judgment of the City
Council, is not the real party in interest or beneficial owner of
the business operated under the license.
F. Anyone who has had a pawnbroker or precious
metal dealer's license revoked anywhere within five years of the
license application.
G. In the case of an individual, anyone who is not
a resident of McLeod County; in the case of a partnership, the
managing partner is not a resident of McLeod County; or in the
case of a corporation, the manager is not a resident of Mcleod
County. The required residency must be established by the time the
license is issued and maintained throughout the existence of the
license and all renewals. The time for establishing residency, for
good cause, be extended by the Council.
Subd. 6. Places Ineligible. The following places are
not eligible for licensure under this Section:
A. No license shall be issued for any place or any
business ineligible for a license under City Ordinance or State
law.
B. No license shall be issued for a place or
business which holds a liquor license.
C. No license shall be granted for operation on any
premises on which taxes, assessments or other financial claims of
the City or other government agency are delinquent and unpaid.
Subd. 7. License application.
A. In addition to any other information required by
any other government agency, every application for a license under
this Ordinance shall be made on a form supplied by the City, shall
be verified and shall contain not only the following information,
but such other information as the City may reasonably require:
1. Representations as to the applicant's
character;
2. The business in connection with which the
proposed license will operate;
3. Whether the applicant is -the owner and
operator of the business and if not, who is;
4. Whether the applicant has ever used or been
known by a name other than his /her true name, and if so, what was
the name, or names, and information concerning dates and places
where used;
5. Whether the applicant is married or single.
If married, the true name, place and date of birth and street
address of applicant's spouse;
6. Street address at which applicant and
spouse have lived during the preceding ten years;
7. Kind, name and location of every business
or occupation applicant and spouse have been engaged in during the
preceding ten years;
8. Names and addresses of applicant's and 0
spouse's employers and partners, if any, for the preceding ten
years;
9. Whether the applicant or spouse has ever
been convicted of a violation of any state law or local ordinance,
other than a non - alcohol related traffic offense. If so, the
applicant shall furnish information as to the time, place and
offense for which convictions were had;
10. Whether the applicant or spouse has ever
been engaged as an employee or in operating a pawnshop or precious
metal dealership or other business of a similar nature. If so,
applicant shall furnish information as to the time, place and
length of time.
11. Whether the applicant has ever been in
military service. If so, the applicant shall, upon request,
document all discharges.
12. If the applicant is a partnership, the
name and address of all partners and all information concerning
each partner as is required of a single applicant as above. A
managing partner, or partners, shall be designated. The interest
of each partner, or partners in the business shall be submitted
with the application and, if the partnership is required to file a
certificate as to trade name under the provisions of Minnesota
Statute, Chapter 333, a copy of the certificate certified by the
District Court Administrator shall be attached to the application.
13. If the applicant is a corporation or other
organization, the applicant shall submit the following:
a. Name, and if incorporated, the state
of incorporation;
b. A true copy of the certificate of
incorporation, articles of incorporation or association agreements;
c. The name of the manager or proprietor
or other agent in charge of, or to be in charge of the premises to
be licensed, giving all information about said person as is
required in the case of a single applicant.
d. A list of all persons who, single or
together with their spouse own or control an interest in said
corporation or association in excess of five percent or who are
officers of said corporation or association, together with their
addresses and all information as is required for a single
applicant.
14. A list of responsible persons, including
the names of owners, managers and assistant managers, who-may be
notified or contacted by State of City employees - in - case - of-
emergency.
15. Whether the applicant holds a current
pawnbroker or precious metal dealer license from any other
governmental unit and whether the applicant is licensed under
Minnesota Statutes, Section 471.924 or 325F.731 to 325.744.
16. Whether the applicant has ever been denied
a pawnbroker or precious metal dealer license from any other
governmental unit.
17. The location of the business premises.
18. The legal description of the premises to
be licensed including a map of the area for which the license is
sought, showing dimensions, locations of building, street access
and parking facilities.
19. Whether all real estate and personal
property taxes that are due and payable for the premises to be
licensed have been paid, and if not paid, the years and amounts
that are unpaid.
20. Other information which the City deems
appropriate.
No person shall make a false statement or material
omission in a license application or investigation. Any false
statement or material omission shall be grounds for_ denial,
suspension, or revocation of a license.
Each licensee shall have the continuing duty to
properly notify the City Administrator of any change in the
information or facts required to be furnished on the application
for a license. This duty shall continue throughout the period of
the license. Failure to comply with this section shall constitute
cause for revocation or suspension of the license.-
The application for the renewal of any existing
license shall be made at least 90 days prior to the date of the
expiration of the license and shall be made on the form which the
Council provides.
Subd. 8. Fees
A. Every applicant for a license shall pay to the
City the investigation fee specified by the City. This fee shall
be for the purpose of conducting a preliminary background and
financial investigation of the applicant. If the Council believes
that the public interest so warrants, it may require a similar
investigation at the time of renewal of any license. if an
investigation -is ordered by the City Council at the time of license
renewal, the applicant shall pay the fee specified above,- except
'that the fee-shall be the smaller of the stated dollar "amount or
the actual cost of the investigation. There shall be no refund of
the investigation fee for any person after the investigation has

begun.
• B. The annual fees for a pawnshop or precious metal
dealer's license shall be established by the City Council.
C. Each license shall'expire on December 31st of
the year in which it is issued. Fees for licenses issued during
the license year shall be prorated according to the number of
months remaining in the year. For this purpose an unexpired
fraction of a month shall be counted as a whole month which shall
have elapsed.
D. No refund of any fee shall be made except as
authorized by the City Council.
Subd. 9. Bond required. At the time of filing an
application for a license, the applicant shall file a bond in the
amount of $5,000 with the City Administrator. The bond, with a
duly licensed surety company as surety thereon, must be approved as
to form by the city attorney. Said bond must be conditioned that
the licensee shall observe the ordinances of the City, in relation
to the business of pawnbroker and precious metal dealer, and that
the licensee will account for and deliver to any person legally
entitled thereto any articles which may have come into the
possession of the licensee as pawnbroker or precious metal dealer
or in lieu thereof such licensee shall pay the person or persons
. the reasonable value thereof.
Subd. 10. Granting of Licenses.
A. No license shall be issued until the Police
Department has conducted an investigation of the representations
set forth in the application, the applicant's moral character, and
the applicant's financial status. All applicants must cooperate
with this investigation.
B. No license shall be issued until the Council has
held a public hearing in such manner as the Council may direct. At
the public hearing all persons interested in the matter shall be
heard, and the hearing may be adjourned from time to time. No
hearing shall be required for a renewal of a license, but the
Council may, in its sole discretion, hold such a hearing.
C. After investigation and hearing, the Council
shall, at its discretion, grant or deny the application.
D. Each license shall be issued only to the
applicant and for the premises described in the application. No
license may be transferred to another person or place without
application to the Council in the same manner as an application for
a new license. Transfer of 25 percent or more of the stock of a
corporation or of a controlling interest thereof,-- whichever-is
_ less, shall be deemed a transfer of the license of a corporate
licensee. If the licensee is a corporation which is wholly owned
by another corporation, the same provisions about the transfer of
a stock or a controlling interest shall apply to that parent
corporation, any second parent corporation which wholly owns the
parent corporation, and all other similarly situated parent
corporations up through the chain of ownership. Transfer of this
amount of stock without prior Council approval is a ground for
revocation or suspension of the license. In addition, each day the
licensee operates under the license after a transfer has taken
place without obtaining Council approval shall be a separate
violation of this ordinance.
E. Any application for a license may be considered
by the City Council at the same time an applicant is requesting any
land use approvals needed for the sit, including site plan review,
rezoning, or an amendment to the Comprehensive Guide Plan. Final
approval of a license shall not be granted until the City Council
has given at least preliminary approval to any necessary land use
request. If an application is granted for a location where a
building is under construction or not ready for occupancy, the
license shall not be delivered to the licensee until a certificate
of occupancy has been issued for the licensed premises.
F. In the case of the death of a licensee, the
personal representative of a licensee may continue operation of the
business for not more than 180 days after the licensee's death.
Subd. 11. Maintenance of Peace. Every licensee is
responsible for the conduct of his or her place of business and the •
conditions of order in it. The act of any employee of the licensed
premises is deemed the act of the licensee as well, and the
licensee shall be liable for all penalties provided by this
ordinance equally with the employee, except criminal penalties.
Subd. 12. Display of License. Every license must be
posted in a conspicuous place in the premises for which it is used.
Subd. 13. Record Reeding_ At the time of a receipt of
an item of property, every licensee shall immediately record, in
English, in an indelible ink, in a book or journal, which has page
numbers that are preprinted the following information:
A. An accurate description of the item of property
including, but not limited to, any trademark, identification
number, serial number, model number, brand name, or other
identifying mark on such item;
B. The date and time the item of property was
received by the licensee.
C. The name, address, and date of birth and
reasonable accurate physical description of the person from whom
the item of property was received.
D. The amount of money loaned upon or pledged for 0
the item.
• E. The identification number from one of the
following forms of identification of the person from whom the item
was received:
1. a valid Minnesota photo driver's license;
2. a Minnesota photo Identification card;
3. a photo identification card issued by the
state of residency of the person from whom the item was received,
and one other valid form of identification;
4. passport; or
5. military photo identification.
F. Such other information as law enforcement
officials or the City may reasonably require.
Subd. 14. Photographic Record. A pawnbroker must obtain
a photograph of each person selling or pawning any firearm. The
pawnbroker shall notify the person being photographed prior to
taking his or her picture. The photograph shall be at least two
inches in length by two inches in width and shall be immediately
developed and referenced with the information regarding the person
and the item sold or pawned. The major portion of the photograph
shall include a front facial pose. The photograph shall be
retained by the pawnbroker for 30 days.
• Subd. 15. Inspection of Records. The licensee shall
make available the information required above at all reasonable
times for inspection by Law Enforcement Officials. The information
required in Subsection 4 shall be retained by the pawnbroker or
precious metal dealer for at least four years.
Subd. 16. Receipts. The licensee shall provide a
receipt to the seller or pledger of any item of property received,
which shall be numbered to correspond to the entry in the
licensee's records and shall include:
A. The name, address, and phone number of the
pawnbroker or precious metal dealer business.
B. The date on which the item was received by the
pawnbroker or precious metal dealer.
C. A description of the item received and amount
paid to the pledger or seller in exchange for the item pawned or
sold, and whether it was pawned or sold.
D. The signature of the pawnbroker or precious
metal dealer or agent.
-- -- - -- - E. The last regular business day by which the item -
must be redeemed by the pledger without risk that the item will be
• sold and the amount necessary to redeem the pawned item(s) on that
date.
F. The annual rate of interest charged on pawned •
items received.
G. The name and address of the seller or pledger.
Subd. 17. Reports to Police. For the types of items
listed below, the licensee must submit to the City Police
Department on a daily basis a list of the specific items purchased
or received that day. The list must be on forms approved by the
City.
A. Any item with a serial number, identification
number, or "Operation Identification" number;
equipment;
B. Cameras;
C. Electronic, audio, video or radar detection
D. Precious jewelry, gems and metals;
E. Artist - signed or artist - attributed works of art;
F. Firearms;
G. Any item not included in (A) - (F) above which
the licensee intends to sell for more than $200, except for •
furniture and kitchen or laundry appliances.
Subd. 18. Stolen or Lost Property. A pawnbroker or
precious metal dealer must report to City police any item pledged
or received, or sought to be pledged or received, if the licensee
has reason to believe that the article was stolen or lost.
Subd. 19. Police Restrictions on Sale or Redemption.
Whenever the City Police Department notifies the licensee not to
sell an item, the item shall not be sold or removed from the
licensed premises until authorized to be released by the City
Police Department.
Subd. 20. Redemption or sale. Any item received by the
licensee for which a report to the City police is required shall
not be sold or otherwise transferred , or in the case of precious
metal, melted down or dismantled, for 30 days after the date of
such report to the police. However, a person may redeem a pawned
item 72 hours after the item was received by the licensee,
excluding Sundays and legal holidays.
Subd. 21.
Inspection
of Items.

Subd. 27. Suspensions and Revocations of License.

A. Delinquent Taxes. The City Council may suspend
or revoke a license issued under this Chapter for operation on any
premises on which real estate taxes, assessments or other financial
claims of the City or of the State are due, delinquent, or unpaid.
If an action has been commenced pursuant to the provisions of
Minnesota Statutes Chapter 278, questioning the amount of validity
of taxes, the Council may on application by the licensee waive
strict compliance with the provision; no waiver may be granted,
however, for taxes, or any portion thereof, which remain unpaid for
a period exceeding one year after becoming due unless such one year
period is extended through no fault of the licensee.
B. Violations. The Council may either suspend for
up to 60 days or revoke any license or impose a civil fine not to
exceed $2,000 for each violation upon a finding that the licensee
or an agent or employee of the licensee has failed to comply with
any applicable statute, regulation or ordinance. No suspension or
revocation shall take effect until the licensee has been afforded
an opportunity for a hearing pursuant to Minnesota Statute Section
14.57 to 14.69. Any conviction by the licensee for theft,
burglary, robbery, receiving stolen property or any other crime or
violation involving stolen property shall result in the immediate
suspension pending a hearing on revocation of any license issued
hereunder.
Section 2. City Code Chapter 1 entitled "General Provisions
and Definitions applicable to the Entire City Code Including
Penalty for Violation" and Section 2.99 entitled "Violation a
Misdemeanor" are hereby adopted in their entirety, by reference, as
though repeated verbatim herein.
Section 3. This ordinance shall take effect upon its adoption
and publication.

WHEREAS, it appears to the City Council of Hutchinson, Minnesota that the
hereinafter described should be designated a Municipal State Aid Street under the
provisions of Minnesota Law.
NOW, THEREFORE, be it resolved by the City Council of the City of
Hutchinson, Minnesota that the road described as follows:
School Road NW, from its current termini at Golf Course Road (CR 93),
north -east to a point on North High Drive (CSAH 12) at its intersection with
Judson Road (formerly Minnesota Road), a total length of 0.40 miles,
shall be, and hereby is established, located and designated as a Municipal State Aid
Street.
BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and
directed to forward two certified copies of this resolution to the Commissioner of
Transportation for his consideration, and that upon his approval of the designation

ECONOMIC & COMMUNITY DEVELOPMENT (RECD) OF THE
"MEDIAN HOUSING" VALUATIONS FOR THE CITY OF HUTCHINSON
WHEN DETERMINING FINANCING ELIGIBILITY
WHEREAS, the City of Hutchinson has invested approximately $350,000 in infrastructure for
"first time home buyers" in cooperation with the Farmers Mortgage Home Administration
(FMHA); and
WHEREAS, the City of Hutchinson has received preliminary approval of a "Conditional Letter
of Map Amendment" from the Federal Emergency Management Agency (FEMA) to remove the
subdivisions of Parkside 1 st and 2nd Additions from the floodplain; and
WHEREAS, the City of Hutchinson has unsuccessfully fulfilled the housing demands by not
providing low income "first time home buyer" housing which has resulted in a demotion of the
community's ability to attract production employees for local industry; and
WHEREAS, the State of Minnesota "Building Valuation Data" represents, for dwellings, an
average cost per square footage of main floor - $57.88, unfinished basement - $11.65, and
attached garage - $17.72; and
• WHEREAS, Hutchinson soils are a heavy clay with perched water escalating infrastructure
assessments; and
E
WHEREAS, the Hutchinson Housing and Redevelopment Authority (HRA) has requested that
the City of Hutchinson take action to request reconsideration by the RECD.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON that it
hereby requests that the Rural Economic & Community Development (RECD) reconsider the
determination of the housing valuations for the City of Hutchinson to include realistic and actual

communications system. When the project was approved it was with
the understanding the cost would be funded over several years.
It would be requested to have the city's water and sewer fund
purchase the note which would authorize a pay back over 5 years
beginning in 1996 (the first payment has been budgeted).
We would ask authorization to issue a note from the water and sewer
fund for $191,000. The rate would be 6.0% with an annual repayment
over 5 years.

At the November 21, 1995 HRA Board meeting, the HRA Board considered charging
property owners for housing loan subordination requests. The HRA Board approved
charging a minimal fee of $25.00 for housing loan subordination requests.
The HRA requests that this $25.00 housing loan subordination request fee be added to the
City fee schedule for consideration and approval by the City Council.

SINGLE / TWO FAMILY RESIDENCE CONSTRUCTION
1. Charge for construction water shall be as follows: $50.00 (collected as part of the water meter fee
with the plumbing permit).
2. The construction water may be turned on and off by and at the discretion of the contractor /property
owner.
3. No water meter shall be installed at the property until the building has had a final inspection by the
City Building and Inspections department, unless a large meter must be plumbed in by the
contractor, or by prior approval of the Building and Inspections personnel and the Water Department
Supervisor.
4. If water is not available to the property when a request for service is made, connection to the closest
fire hydrant will be allowed until water service is put into the property. After that time, it will be
expected that the connection will be made to the water service line to the property. It will be at the
discretion of the City staff to determine that a hook -up to a fire hydrant will be practical or
appropriate. Factors to consider shall be distance, safety, traffic, etc.
5. All plumbing, hoses, fittings, etc., shall be provided by the contractor.
• 6. Contractor shall install proper backflow preventors on all connections made on to City potable water
supply lines. Reference Minnesota Plumbing Code Section 4715.1900. The City must shut water off
if no backflow protection is installed.
7. Contact the Hutchinson Water Department at 234 -4222 regarding any of the above items.
ALL OTHER CONSTRUCTION
1. Charge for construction water will be $25.00 /week (7 days) with a minimum charge of one week, or
$75.00 / month (30 days).

TAX INCREMENT DISTRICT NUMBER 9 AND NUMBER 10
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
WHEREAS, the City of Hutchinson approved on June 12, 1995, the
creation of Tax Increment Financing District No. 9, a redevelopment
district and,
WHEREAS, the City of Hutchinson approved on June 27, 1955, the
creation of Tax Increment Financing District No. 10, a
• redevelopment district and,
WHEREAS, the City of Hutchinson requested certification from
McLeod County of Tax Increment Financing District Nos. 9 and 10
prier to July 1, 1955 and,
WHEREAS, pursuant to Minnesota Statutes, Section 273.1399, the
district will cause a reduction in state aids paid to the
municipality unless the district qualifies as an exempt district
and,
WHEREAS, the Minnesota Statutes, Section 273.1399, Subdivision
6, allows the governing body of a municipality by December 31,
1955, to choose to make a qualifying contribution for a tax
increment financing district for which request for certification
was made after June 30, 1994 and before July 1, 1995.
THEREFORE, be it resolved by the Hutchinson City Council that
it elects to maintain the option to make a contribution of 7.5
percent of the annual increment estimated to be generated from Tax
Increment Financing District No. 9 and No. 10, and that the
• contribution will be paid from unrestricted money and it will be
used to pay project costs and will not be used for general

plans to incur without the project.

It is our understanding Hutchinson Iron and Metal relocation agreement has language requiring the
restoration of the original site.
0 Based on this arrangement we feel the original site and alleyway must be:
Entirely cleaned up including removal of all debris within 8" of the surface. This will require
plowing or tilling of the private property and grading with gravel in the alleyway.
The private property and boulevards are to be planted sodded with an established grass turf.
The entire site is to be inspected by the Hutchinson Building Department. Pictures will be
forwarded to the Council/Administration for approval.

DEFERRED LOAN REPAYMENT AGREEMENT AND MORTGAGE
THIS AGREEMENT, made and entered into this _ day of
December, 1995 by and between the City of Hutchinson ( "Lender ") and
Hutchinson Iron and Metal, Inc. and hereinafter collectively
referred to as "Borrower "; and, where applicable, Contract for Deed
Vendors, remainderman, or separated spouses or others not in
possession joining in this agreement at the place provided below:

WHEREAS, Borrower has purchased a parcel of land consisting of
5.50 acres and said property is hereafter referred to as "the
Land;"
WHEREAS, Borrower has made improvements that have increased
. the value of the property such that the taxes assessed to the
property are equal to or greater than one tenth (1 /10) of the loan
amount set forth in this Agreement;
WHEREAS, Lender has loaned Twenty six Thousand Six Hundred
Sixty six and 67/100 Dollars ($26,666.67), to Borrower at the rate
of 9% per annum, and receipt of the same is hereby acknowledged by
Borrower, for the purpose of encouraging industrial development in
the Hutchinson Industrial Park and;
WHEREAS, Borrower and Lender desire to set forth herein the
provisions for Borrower's repayment or forgiveness of the loan, and
to provide for securing said repayment with the mortgage on the

order of Lender the principal of the loan, with interest as
hereinafter provided, at the office of the Lender in Hutchinson,
Minnesota, or at such other place as the Lender may designate in
writing, upon the occurrence of any of the following events
( "Repayment Events ") within a period of ten years after the date of
the loan as set forth above:
a. If any portion of the land subject to the terms of
this deferred loan repayment agreement and mortgage
is sold, transferred or otherwise conveyed, whether
by deed, contract for deed or otherwise and whether
said transfer or sale is voluntary or involuntary.
•
b. The filing of a voluntary or involuntary bankruptcy
petition by the Borrower or its principals.
Repayment of the loan as required above shall be made to
Lender no later than the 30th day after the occurrence of any
Repayment Event, which day is hereby designated for purposes of
this Agreement as the maturity date of the loan. This maturity
date shall occur regardless of whether notice required by this
Agreement is given or received on or before said maturity date.
Absent the occurrence of any repayment event, within ten years
after the date of the loan as set forth above, upon the
commencement of the 11th year after said date of the loan,
Borrower, at that time and at any time thereafter, shall have no

obligation to repay the loan or any party thereof to the Lender.

2. It is understood and agreed between the parties that
10% of the principal amount of the loan shall be forgiven and
become a grant to the Borrower for each year the Borrower continues
to own all of the Land and no Repayment Event occurs within the ten
year period following the date of this Agreement. This ten year
period is hereafter referred to as the "Forgiveness Period."
3. Should any Repayment Event occur within the Forgiveness
Period, then payment of the remaining balance of the deferred loan
shall be made as follows:
a. If any portion of the improved property is sold,
then the Borrower shall pay to the Lender the
remaining, unforgiven principal amount of the loan
together with interest on that amount at 9% per
year for the number of years remaining to complete
• the Forgiveness Period.
b. If any part of the unimproved property is sold,
then the Borrower shall pay to the Lender that
portion of the remaining unforgiven principal
amount of the loan that bears the same ratio to the
unforgiven amount that the part sold bears to the
total Land together with interest on that amount at
9% per year for the number of years remaining to
complete the Forgiveness Period.
4. As security for the Borrower's personal covenant and
obligation for repayment as herein provided, and subject to the
terms and conditions of this Agreement, Borrower hereby grants, and
the Lender shall and hereby does have, a Mortgage lien on the real
estate hereinafter described, together with all hereditament and

appurtenances thereto, in the full amount necessary to satisfy such
repayment obligation and the cost, including reasonable attorney's
fees of collecting the same. The said real estate subject to said
Mortgage lien is situate in McLeod County, Minnesota, and is
legally described as set forth on attached Exhibit "A" and
incorporated as if fully set forth below.
5. Immediately upon any sale, transfer or other conveyance
of the above - described real estate within ten (10) years of the
date of the Loan as set forth above, Borrower or his /her heirs,
executors, or representatives, hereby covenant and agree to give
Lender notice thereof.
6. In the event Borrower or his /her heirs, executors, or
representatives shall fail or refuse to make a required payment
within said limited period, or otherwise in any way be in default
under the terms and conditions of this Agreement, the Borrower
confers upon the Lender the option of declaring all sums then owing
by the Borrower immediately due and payable without notice, and
hereby authorizes and empowers the Lender to foreclose this
Mortgage by judicial proceedings or to sell the mortgaged premises
at public auction and convey the same to the purchases in fee
simple in accordance with the mortgage foreclosure statute
appearing at Minn. Stat. Chapter 581, and out of the moneys arising
from such sale to retain all sums secured hereby, together with
interest and all legal costs and charges of such foreclosure and
the maximum attorneys fees permitted by Law, which costs, charges
and fees the Borrower herein agrees to pay.
The Borrower and Lender further covenant and agree as
follows:

a. Borrower shall be furnished a conformed copy of
this Agreement
at the time of execution or after
recordation.
b. Upon default of any covenant or agreement by
Borrower under the terms of this Agreement, Lender
prior to foreclosure shall mail notice to Borrower
as provided herein specifying (i) the nature of the
default by the Borrower, (ii) the action required
to cure such default, (iii) a date, if such default
is capable of being cured by Borrower, not less
than thirty (30) days from the date the notice is
mailed to Borrower by which such default, if
capable of being cured, must be cured; and (iv)
•
that failure to cure such default on or before the
date specified in the notice may result in
acceleration of the sum secured by this Mortgage
and sale of the mortgaged premises. The notice
shall further inform Borrower of the right, if any,
to reinstate after acceleration and the right to
bring a court action to assert the nonexistence of
a default or any other defense of the Borrower to
acceleration and sale.
C. In addition to any notice required under applicable
law to be given in another manner, (i) any notice
to the Borrower provided for in this Agreement
shall be given by mailing such notice by certified

mail addressed to the Borrower at the address of
the mortgaged premises, or at such other address as

the Borrower may designate in writing to the Lender
as provided herein, and (ii) any notice to the
Lender shall be given by certified mail, return
receipt requested, to Lender at the following
address: City of Hutchinson, Attention: Finance
Director, Hutchinson City Center, 111 Hassan Street
S.E., Hutchinson, Minnesota 55350, or to such other
address as Lender may designate by notice in
writing to the Borrower as provided herein. Any
notice provided for in this Agreement shall be
deemed to have been given to Borrower or Lender
when given in the manner designated herein.
7. The Mortgage lien created by this Agreement shall
terminate and shall be of no further force or effect in the event
Borrower or his /her heirs, executors, or representatives are not in
default of any of the covenants or agreements contained herein, and
Lender has not, on or before December -, 2005 (a) commenced an
action in the manner provided by statute for the foreclosure of the
Mortgage and (b) filed for record a notice of said action, or a
power of attorney to foreclose mortgage, or a lis pendens referring
to the same, in the office of the County Recorder or Registrar of
Titles, as the case may be, in the County where said real estate is
situated. Lender may, in its sole discretion, extend said
termination date of said lien by filing for record, on or before
said termination date, an agreement with Borrower or his /her heirs,
executors, or representatives evidencing such extension.
8. This Agreement shall run with the aforementioned real
estate and shall inure to the benefit of and be binding upon the

parties hereto and their respective heirs, executors,
• representatives, successors and assigns. Wherever used, the
singular number shall include the plural, and the plural the
singular. All covenants and agreements of the Borrower shall be
joint and several.
•
9. In the event that any provision or clause of this
agreement shall conflict with applicable law, such conflict shall
not affect the other provisions of this Agreement which can be
given effect without the conflicting provision, and to this end the
provisions of the Agreement are declared to be severable.

INDUSTRIAL DISTRICT)
Pursuant to Section 6.05, of Zoning Ordinance No. 464, the Hutchinson Planning Commission is
hereby submitting its findings of fact and recommendation with respect to the aforementioned
request for rezoning.
HISTORY
In November, 1995, City Staff submitted a request to rezone recently annexed Goebel property
from R -1 (Single Family Residence District) to I -1 (Light Industrial District). A hearing was held
• at a regular meeting of the Planning Commission on Tuesday, December 19, 1995, there were no
neighboring property owners objecting to the request.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee paid.
2. Notices were mailed to the surrounding property owners as well as published in the
Hutchinson Leader on Thursday, December 7, 1995.
3. It was the consensus of the Planning Commission that the request be approved,
RECOMMENDATION
It is the recommendation of the Planning Commission that the aforementioned request to rezone be
approved base on the findings set forth above.

Pursuant to Section 6.05, of Zoning Ordinance No. 464, the Hutchinson Planning Commission is hereby
submitting its findings of fact and recommendation with respect to the aforementioned request to amend
Zoning Ordinance # 464
HISTORY
In November, 1995, the Hutchinson Planning Staff requested an amendment to the Hutchinson Zoning
Ordinance #464 adding Pawn Broker Establishment land use as follows:
• Sections 8.11, 8.12, 8.13, 8.14 and 8.15 - Pawn broker establishments shall be permitted in the
C -3 (Central Commercial District), C-4 (Fringe Commercial District), 1 -1 (Light Industrial District),
1 -2 (Heavy Industrial District) and I/C (Industrial /Commercial District).
FINDINGS OF FACT
1. All procedural requirements for amendments to the Subdivision Ordinance have been complied with.
2. Notice was published in the Hutchinson Leader on Thursday, December 7, 1995.
3. The proposal was deemed to be appropriate and in the best interest of the City.
The hearing was held at the regular meeting of the Planning Commission on Tuesday, December 19, 1995,
at which time there was no one present objecting to the request.
RECOMMENDATION
It is the recommendation of the Planning Commission that the aforementioned request to amend Hutchinson
Zoning Ordinance #464, Chapter 11, Hutchinson Municipal Code be granted as set forth above.

• I am enclosing herewith for your review and for consideration by
the City Council at the next regularly scheduled City Council
meeting an ordinance dealing with the regulation of pawn brokers
and precious metal dealers.
A little background is appropriate. As you know, the City of
Hutchinson has one pawn broker located within the City limits. As
far as I know, no significant problems have been encountered with
this operation. However, the experience in other communities ha as
positive and the Courts have been very willing to grant to
municipalities police powers to regulate such establishments.
Over the course of the last several years, the police department
and this office have discussed the regulation of pawn brokers and
the results of that discussion are set forth in the enclosed
ordinance.
This is, without question, the most detailed business regulation
ordinance ever adopted by the City of Hutchinson and that is
largely because of the potential for problems relating to such
establishments.
While regulating pawn brokers, I pointed out that it might be worth
considering the regulation of precious metal dealers as well,
because quite frequently, the same problems associated with pawn
. brokers also show up with previous metal dealers who, of course,
frequently accept in trade or purchase outright precious metals

want to leave anyone with the impression that we are dealing with
any kind of a problem with present business operations, but rather
these regulations are intended to attempt to control potential
problems.
I have intentionally omitted from this ordinance any discussion of
land use issues as the planning commission is presently considering
the appropriate zoning for pawn brokers and I expect a
recommendation to come from the planning commission for
consideration by the City Council at the last regularly scheduled
December City Council meeting. By carbon copy of this
correspondence to Jim Marka, I would suggest that the land use
issues be phrased not only in terms of pawn brokers, but also
precious metal dealers at least until the Council decides whether

Although the City should certainly not delegate its regulatory
authority to the individuals or businesses to be regulated, the
thought occurs to me that it nonetheless may make sense to- provide
a copy of the proposed ordinance to those existing business •
establishments that City staff can identify as likely to be subject
to these regulations so that the City avoids adopting regulations
that require the impossible or that are otherwise in need of
revision.
I would suggest that we have the first reading of the ordinance,
distribute copies as appropriate and then, if necessary, the second
reading could be delayed to take into account any changes that
might be appropriate.

1. CALL TO ORDER 5:30 P M.
• The meeting was called to order by Chairman Dean Wood at 5:30 p.m. with the following
members present: Craig Lenz, Bill Craig, Dan Prochnow, Glenn Matejka, Roger Gilmer, Bill
Arndt and Chairman Wood. Members Absent: None Also present: Planning Coordinator
Brenda Ewing, Director of Engineering John Rodeberg and City Attorney G. Barry Anderson
CONSIDERATION OF MINUTES OF REGULAR MEETING DATED NOVEMBER 21 1995
Mr. Matejka made a motion to approve the minutes dated November 21, 1995, seconded
by Mr. Gilmer the motion carried unanimously.
PUBLIC HEARINGS
a) CONSIDERATION OF AMENDMENT TO SHORELAND MANAGEMENT
ORDINANCE SECTIONS 2.71 AND 5.22 PROHIBITING BOATHOUSES
Chairman Wood opened the hearing at 5:32 p.m. with the reading of publication
#4886 as published in the Hutchinson Leader on Thursday, December 7, 1995. The
request is for the purpose of considering an amendment to the Shoreland
Management Ordinance, Sections 2.71 and 5.22 to prohibit boathouses.
Planning Coordinator Brenda Ewing explained the recommendation by the DNR
hydrologist to prohibit boathouses. Discussion followed on the definition of
• boathouse versus water oriented accessory structure and also setbacks of water
oriented storage buildings. There was discussion on the intent of the language and
the restrictiveness.
Mr. Craig moved to continue the hearing to January and directed staff to review,
seconded by Mr. Lenz the motion carried unanimously.
b) CONSIDERATION TO REZONE RECENTLY ANNEXED PROPERTY LOCATED
ALONG 5TH AVE. N.E. (GOEBEL PROPERTY) FROM R -1 (SINGLE FAMILY
RESIDENCE DISTRICT) TO 1 -1 (LIGHT INDUSTRIAL DISTRICT)
Chairman Wood opened the hearing at 5:45 p.m. with the reading of publication
#4887 as published in the Hutchinson Leader on Thursday, December 7, 1995. The
request is for the purpose of considering to rezone the recently annexed Goebel
property along 5th Ave. N.E. from R -1 to 1 -1.
Ms. Ewing commented on the recently annexed Goebel property located along 5th
Ave. N.E. She stated the rezoning is a housekeeping measure to keep the zoning
consistent in the area and that she has contacted Mr. Goebel regarding the
rezoning. Mr. Goebel has no objection to rezoning the property to 1 -1.
Mr. Prochnow made a motion to close the hearing, seconded by Mr. Gilmer the
hearing closed at 5:50 p.m. Mr. Lenz made a motion to approve the rezoning.

Chairman Wood opened the hearing at 5:51 p.m. with the reading of publication
#4888 as published in the Hutchinson Leader on Thursday, December 7, 1995. The
request is for the purpose of considering an addition to the Zoning Ordinance
permitting Pawn Broker Establishments in C -3, C -4, 1 -1, 1 -2 and I/C Districts.
Brenda Ewing commented on the request to address the land use for Pawn Broker
Establishments. The City Attorney commented on the addition of Precious Metal
Dealers also. Discussion followed on the definition of Precious Metal Dealer. City
Attorney G. Barry Anderson explained the City Council will decide whether or not
the ordinance will include Precious Metal Dealers. There was discussion on the
land use decision and the fact the City Council will act on public policy. The
consensus of the Planning Commission is not to include Precious Metal Dealers.
Mr. Matejka made a motion to close the hearing, seconded by Mr. Lenz the hearing
closed at 5:57 p.m. Mr. Matekja made a motion to approve the land use for Pawn
Broker Establishments not including Precious Metal Dealers. Seconded by Mr.
Lenz the motion carried unanimously.
4. OLD BUSINESS
a) CONSIDERATION OF STAFF RECOMMENDATIONS REGARDING POND
DESIGN CRITERIA FOR HUTCHINSON •
Planning Coordinator Brenda Ewing commented on the standards regarding pond
design and the Best Management Practices. Director of Engineering John
Rodeberg explained the issues of runoff and drainage which create a need for
ponding. He stated the only standard available is the Best Management Practices
which regulates by slope and planted growth along the edge of the pond. Mr.
Rodeberg explained there is no support for fencing of ponds. He presented an
overhead on pond design and stated there will be more ponding in the city.
Discussion followed on ponds close to the street. Mr. Rodeberg explained it would
be more accessible near the street. There was discussion on liability issues.
b) CONSIDERATION OF HUSKI ADDITION POND DESIGN
Mr. Rodeberg recommends a 10:1 or 8:1 slope with the pond 4 feet deep. He
stated there is no benefit to a deeper pond. The developer will be liable for the pond
on his property. The developer will revise the drawing by the January meeting.
Mr. Matejka made a motion to continue both items A and B until January and
directed staff to review. Seconded by Mr. Lenz the motion carried unanimously.
5. NEW BUSINESS
a) CONSIDERATION OF FINAL PLAT OF " KRSIEAN ACRES PLAT TWO"
SUBMITTED BY ANNA KRSIEAN 0
Ms. Ewing stated the dedication has not been received by the Riggotts. The

b) CONSIDERATION OF PRELIMINARY PLAT OF "OLSONS COUNTRY VIEW'
LOCATED IN LYNN TWP., SECTION 13, SUBMITTED BY ROGER OLSON
Brenda Ewing commented on staff recommendations requesting shared driveway

to approve the preliminary plat with staff recommendations. Seconded by Mr. Arndt
the motion carried unanimously.
C) CONSIDERATION OF FINAL PLAT OF "BUSS SUBDIVISION" LOCATED IN
ACOMA TWP., SECTION 13, SUBMITTED BY FABIAN BUSS
Planning Coordinator Brenda Ewing explained this property is outside the proposed
Urban Boundary District and staff has no recommendation. Mr. Matejka moved no
recommendation noting the property is outside the Urban Boundary District.
Seconded by Mr. Gilmer the motion carried unanimously.
6. COMMUNICATION FROM STAFF
a) Discussion of Comprehensive Plan update of Landuse Map
Bonnie Baumetz explained the process used to update the maps for the
Comprehensive Plan and stated the staff would possibly review the Comp Plan by
quadrants. It was the consensus of the Planning Commission to review the maps
the complete city at one time and not by quadrant.
b) Discussion of County Comprehensive Plan sections relating to the city and urban
boundary district
Brenda Ewing explained the review by staff. She stated Jim Marka drafted a letter
to McLeod Zoning Administrator Ed Homan regarding areas of concern by the city.
C) Discussion of Joint Planning Board progress
Ms. Ewing updated the commission on the Joint Planning Board acting as an
advisory board holding the public hearing and bringing a recommendation to the
County Board. She stated a task force has been formed to discuss and recommend
the process to be used.

Policy Title. Guidelines for Issuance of Tax Increment Incentive in Industrial Park
The 1980 re- establishment of a Tax Increment District in the Hutchinson Industrial Park enabled the
City ofHutchinson to provide incentives for Industrial Growth.
In compliance with the State Statute and the original intent of the Industrial Park Tax Increment District,
the following shall serve as guidelines for the Hutchinson Community Development Corporation to act on behalf
of the City to administer the Tax Increment funding for the Industrial Park District.
The potential tax capture for each property is a variable dependent largely on the type ofbuilding to be
built, square footages of tilding, and the designed use of the building. Therefore, each project in the Industrial
Park Tax Increment District will be considered for potential incentives in the sequence listed below (up to a
maximum ofthe guarenteed tax captured for the years remaining in the Tax Increment District).
Incentive (In order of consideration)
10% Administrative Fee to the City ofHutcbinson
Land Write -Down Formula (as is currently approved by City of Hutchinson)
Recover Infra- Structure Costs Incurred by City
Land Preparation to Construct Building
Any implementation of the above usage for Tax Increment Financing in the Hutchinson Industrial Park
shall be reviewed and approved first by the HCDC Finance Team and then Reviewed and approved by the
HCDC Board of Directors. Following HCDC Board approval a copy of the action will be sent to members of
the City Council, City Administrator, and City Finance Director.

Resolution of Support
for
Impressions Incorporated
BE IT RESOLVED THAT the City of Hutchinson acts in support of the issuance of the bonds for
Impressions Incorporated as presented in the Application submitted to the Minnesota Agricultural
and Economic Development Board (the 'Board ") and that the City of Hutchinson hereby supports
the 'Board" issuing Industrial Development Bond funding for this project on behalf of Impressions
Incorporated.
BE IT FURTHER RESOLVED that upon approval of its application by the Minnesota Agricultural
and Economic Development Board, the City of Hutchinson certifies that it will comply with all
applicable laws and regulations relating to this project.
• AS APPLICABLE, BE IT FURTHER RESOLVED that the City of Hutchinson as reviewed the
proposed project information from Impressions Incorporated and no adverse findings or concerns were
identified.
NOW, THEREFORE BE IT RESOLVED that the Mayor of Hutchinson is hereby authorized to

The board of directors of Hutchinson Area Health Care (HAHC), as part of their regular meeting on December 19,
1995, considered a recommendation from staff for award of the hospital roof repair bid process held in late
November. This bid included replacement of

"Roof Repair Bid. The board reviewed a comparison of the bids received in the November bidding process
for hospital roof repair. Repairs were proposed to the roof covering the surgical, OB and general patient
care wings, main nurses' station and visitor lobby. It was noted this section of the roof was original to the
building's 1970 construction and continues to leak with ice and snow build -up. Staff recommendation was
made to accept the bid from Gag Sheet Metal of New Ulm, at a low bid of $74,634.00.

"Motion was made by Daggett, seconded by Black, to recommend to the City Council the award of

The intersection of North High Drive and Highway 15 has been studied and found to fall short of meeting
• any warrants for a traffic signal. Warrants including traffic volumes, peak hour volume, four hour
volume, interruption of continuous traffic, and accident experience were considered.
It should be noted that traffic signals rarely act as a safety device, but rather as device to assign right of
way to traffic flow. I believe that North High Drive has a better accident experience now than it would
have with a traffic signal.
The intersection did not meet warrants for four way stop sign control either. Four way stops work best
when the traffic is approximately equal on all entering streets. In this case Highway 15 is by far the
highest volume roadway. A four way stop sign controlled intersection would not serve the motoring
public well at this intersection.

Jim Marka called the meeting to order.
2. NEW BUSINESS
a) Advisory Board
Jim Marka commented on the County recommending the Joint Board as an
Advisory Board. Discussion followed with a consensus the Joint Board will
act in the capacity of a planning commission bringing recommendations to
the County Board. The County Board will be held accountable for the
decisions made after receiving the recommendations from the Joint Planning
Board.

b) Review of County and City Fee Structures
The consensus of those present is to adopt the county fee schedule.
C) Review of Urban Boundary District
Jim Marka stated the boundary district will be reviewed annually by the Joint
Board. Modifications may be made at the Annual Review.
d) Discussion of One -Stop Shop Concept
Jim explained the concept. The city is in the process of providing a One -
Stop Shop to the customer. He displayed overheads of the checklists used
by the city and commented on the positive approach of the government
responding to what the public wants. He suggested the Joint Board begin
with the platting procedure in the urban boundary district. Possibly the city
and county could develop a checklist for development within the urban
boundary district.
Discussion followed on platting of ag land.
Jim explained the invitation and contact persons list for pre - development
meeting which has been accepted positively by the public. He stated the
developer has the opportunity to meet with all involved at this meeting which
includes the Hutchinson Utilities.
There was discussion on the concept with favorable comments..
Ed Homan stated in order to accomplish the goals and objectives of the Joint
Planning Board everyone involved must make a serious commitment to the
public to get the job done. He stated the customers are frustrated by the
number of meetings presently that must be attended.
Discussion followed on the need to develop a checklist for the board to
review and the possibility of creating a task force to establish the process
and bring back to the Joint Board. There was discussion of the ordinance
revisions.
It was the consensus of those present to create a seven member task force
made up of one representative from each township, Jim Marka, Ed Homan

and Brenda Ewing. Grant Knutson volunteered from Lynn Township and
Dave Plamann volunteered from Acoma Township. The Hassan Valley
representatives will appoint a member at their meeting to be held on
December 12th. Hutchinson Township will appoint a member on December
14th. It was decided the Task Force will meet on Monday, January 8, 1996,
at 2:00 p.m. in the Hutchinson City Center Main Conference room. A packet
will be mailed with ordinances, agenda, etc. prior to the meeting.
e) Set next meeting date
It was decided the next meeting will possibly be in February in order to give
the task force time to establish the process.
