City Attorney Anderson administered the Oath of Office to
newly elected Mayor Marlin Torgerson and Council Member
William T. Craig.
2. APPOINTMENT OF KAY PETERSON AS COUNCIL MEMBER TO FILL VACANCY
ON CITY COUNCIL AND INSTALLATION OF OFFICE
The motion was made, seconded, and unanimously carried to
confirm the appointment of Kay Peterson to the City Council to
fill the unexpired term of two years.
City Attorney Anderson administered the Oath of Office to
appointed Council Member Kay Peterson.
3. The meeting was called to order by Mayor Torgerson at 5:00

The motion to approve the Fire Department appointments
was made by Council Member Mlinar, seconded by Council

6. REPORT BY CITY ADMINISTRATOR
Administrator Plotz stated the Directors will complete their
annual reports by mid - January. The City Council will need to
determine a date to hear the presentations. There will also
be forthcoming meetings with the Hospital /Nursing Home Board,
Hutchinson Utilities Commission, HCDC Board of Directors, and
Township and County officials.
Mr. Plotz noted there will be a follow -up meeting with County
representatives on January 25, 1994 concerning the tri- agency
maintenance facility.
7. REPORT BY FINANCE DIRECTOR

Director Kenneth B. Merrill reported he would be sending the
Council Members the budget for the water /sewer funds, liquor
store fund, and central garage fund. It will need to be acted
on at the January 11, 1994 meeting.
The motion to hold a budget workshop at 6;30 P.M. on January
11, 1994 was made by Council Member Mlinar, seconded by
Council Member Craig, and unanimously carried.
There being no further business, the meeting adjourned at 5:15
P.M.

• Hutchinson Airport Commission Meeting
January 3, 1994
Meeting was called to order at 7:05 P.M. by Chairman Dave Skaar.
Members present: Dave Skaar, Dennis Kahl, Jim Faber, Mayor Marlin Torgenson,
Joe Dooley and Tim Miller
City Staff present: Doug Meier
Guest present: Tom Parker, Bernie Knutson, Tim Eakins and John Bucsko
Tim Eakins addressed the airport commission with his idea of establishing
a sky divers club at Hutchinson Airport.
Recoomendation made by Jim Faber /Joe Dooley that Tim Eakins meet with City
Administrator concerning the establishment of a sky diving club at Hutchinson
Airport. Joe Dooley and Dennis Kahl were appointed as representatives for the
project.
Motion made by Dennis Kahl and seconded by Tim Miller with a recommendation
that the air space be waived in conjunction with McLeod County Fair for
Dooley Air Shows for the 5 (five) evenings of the fair for approximately
45 minutes each evening. Passed unanimously.

RE: Tree Board Appointment
As of January, 1994 the Hutchinson Tree Board is one member short of it's
required five members. Current members on the Tree Board are: Carol Brown, Laura
Poser, Jay Beytien, and Dr. Virgil Voigt.
Dr. Virgil Voigt, current chair of the Tree Board, has recommended to the Tree
Board that Dave Larson, Vice President of Marquette Bank, Hutchinson is interested
and willing to be a Tree Board Member. Jay Beytien has also indicated that the
Reverend Brian Brosz, who is currently a Parks, Recreation and Community Education
Advisory Board Member is also interested in the Tree Board functions.
The Tree Board, according to City Ordinance, is to have City Council
representation, along with citizen membership.
In order to best meet the busy schedules of the Hutchinson Council Members,
the Tree Board makes the following recommendation.
Appoint Dave Larson to the Tree Board, with Rev. Brian Brosz as ex- officio
member representing the Parks, Recreation and Community Education Advisory Board.
John Mlinar, Council Representative, resides on the Parks, Recreation and
Community Education Board. The Tree Board would still have council representation
through Rev. Brosz and the Parks, Recreation and Community Education Board.

NOTICE OF HEARING ON PROPOSED IMPROVEMENT
PROJECT NO. 94-03
TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of Hutchinson, Minnesota, will meet
in the Council Chambers of the City Hall at 8:00 P.M. on the 11th day of January, 1994,
to consider the making of an improvement of Lakewood Drive from 700' southerly of
McDonald Drive to South Grade Road by the construction of storm sewer, sanitary
sewer, and services, watermain and services, grading, gravel base, concrete curb and
gutter, bituminous base, bituminous surfacing and appurtenances, pursuant to
Minnesota Statutes, Sections 429.011 to 429.111. The area proposed to be assessed for
such improvement is the benefitted property, for which property owners shall
receive mailed notice.
The estimated City Cost of said improvement is $305,000.00 with an estimated
$35,000.00 Assessable Cost, for the total estimated cost of $340,000.00.
Such persons as desire to be heard with reference to the proposed
improvement will be heard at this meeting.

WHEREAS, a resolution of the City Council adopted the 14th day of December,
1993, fixed a date for a Council Hearing on the improvement of Lakewood Drive from
700' southerly of McDonald Drive to South Grade Road by the construction of storm
sewer, sanitary sewer, and services, watermain and services, grading, gravel base,
concrete curb and gutter, bituminous base, bituminous surfacing and appurtenances.
AND WHEREAS, ten days' published notice of the hearing through two weekly
Publications of the required notice was given and the hearing was held thereon on
the 11th day of January, 1994, at which all persons desiring to be heard were given
an opportunity to be heard thereon.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON,MINNESOTA:
1. Such improvement is hereby ordered as proposed in the resolution adopted
the 14th day of December, 1993.
2. John P. Rodeberg is hereby designated as the Engineer for this
improvement. He shall prepare plans and specifications for the making of such
improvement.

be a good time to refund of our 1987 wastewater. The refunding
would reduce our interest cost on this issue. The sale would
involve a cross over refunding issue.

RE: City of Hutchinson; Refinancing Callable Portion of $5,975,000 G.O. Wastewater Bonds of
1987 Crossover Advance Refunding on June 1, 11M.
Dear Ken:
Since we met in November, the bond market had been heading steadier upward. As a result, I held off
updating our refunding analysis. During the second week in December, there was a marked improvement
as noted on the enclosed graph. That trend may continue into next year if rates stay the same, and there
is no increase in bond supply. On the attached Cronin calendar you can see that very few sales have been
scheduled through January of 1994. As we discussed, you may wish to consider refinancing the'87 G.O
Wastewater Improvement Bonds. After reviewing refunding of all outstanding issues in our October 22,
. 1993 report, this issue is the most likely advance refunding candidate.
Enclosed is an updated projection of the above refunding that we did the W week of December. Current
rates are about 1/4 of 1% lower than the attached projection and about 1/5 of 1% higher than the
projections in the October 22, 1993 memo to you (October, 1993 was the low point in the market to date).
Our analysis of December 2, 1993 projects the following savings:
Future Interest Saving $456,695 or $57,086 per year (96 thru 03)
Net Present Value Benefit $357,507
Percent of Refunded Principal - 8.7%
See the attached exhibits of existing debt (Exhibit 1.00), new debt (Exhibit 2.00), debt comparisons (Exhibit
3.00) and sources and uses (Exhibit 4.00).
We are ready, should you wish us to proceed, to solicit competitive bids at the January 25, 1994 City
Council meeting, assuming this savings justifies the refinancing. The major drawback would be that for
1994, you will once again likely be subject to arbitrage rebate. This will require future filings with the IRS
through the life of the 1994 issues. 1 assume that over all, we will be able to issue less than $10 million
in 1994 making this and the other 1994 issues 'bank qualified' Should you wish to proceed, we would
recommend the following sale details:
Dated Date: February 17, 1994
1st Interest: December 1, 1994 and semiannually thereafter
1st Maturity: June 1, 1996
Principal Amount: See Exhibit 2.00. The Issuer reserves the right to increase or decrease the
principal amount of the Bonds on the day of the sale. Any such increase or
• decrease will not exceed $75,000 in total principal amount, will be in increments
of $5,000, and may be made in any maturity. If the principal amount of the Bonds
is adjusted, the purchase price will be adjusted proportionately.

We have been married 22 years, have two children now attending
college and been at the above address for the last 14 years.
Tim is employed by the Chicago and North Western Railroad for
the past 24 years and Rose is currently manager of the.Hammond
Hotel in Hammond, WI. We both enjoy skydiving, hot air
ballooning and new challenges.
We've seen many changes in skydiving since becoming involved
in 1981 and also recognize the potential for a profitable
business in skydiving. With the advent of Accelerated Freefall
training and Tandem Instruction the general public can experience
the thrill of skydiving with as little as 45 minutes training
(Tandems), or make a skydive themselves under very controlled
conditions accompanied by two USDA Rated Jumpmasters from an
altitude of 12,000 feet. A full service drop zone would also
offer the traditional method of training known as Static Line.
We are looking for the right facilities and are willing to
relocate in our desire to provide the best skydiving atmosphere
and location to our friends and customers alike.
Tim is a Commercial Hot Air Balloon Pilot with 760 hours and
is an Instructor in all three methods of training, Static Line,
Accelerated Freefall and Tandem. He currently has 1340 jumps.
Rose is also a Commercial Hot Air Balloon Pilot with 1160 hours
and having recently returned to the sport of skydiving in 1992
has made 230 jumps since.

1. PURPOSE. This advisory circular (AC) provides suggestions to improve
sport parachuting safety and disseminates information to assist all parties
associated with sport parachuting in complying with Federal Aviation
Regulations (FAR) Part 105, Parachute Jumping. It also contains a list of
aircraft which may be operated with one cabin door removed and includes
procedures for obtaining Federal Aviation Administration (FAA) authorization
for flight with the door removed.
2. CANCELLATION. AC 105 -2B, Sport Parachute Jumping, dated August 21, 1989,
is cancelled. (Note: Distribution of this AC (105 -2B) was not made.)
3. BACKGROUND.
• a. Sport parachute jumping (also called skydiving) activity continues to
increase and is an FAA - recognized aeronautical activity. Even though
parachutists (also called skydivers) are not certificated airmen, the FAA
recommends that all beginning parachutists obtain formal training. Training
should be conducted in accordance with the United States Parachute Association
(USPA) training recommendations or by training programs from other similar
organizations.
b. Skvdiv_ing_ has _certain inherent risks especially for students. In
response to this risk, the skydiving community has developed procedures and
practices to reduce the risk factors. A significant level of safety can be
maintained by following these procedures and by properly preparing for each
parachute jump. Developments in parachuting continue to contribute to the
advancement of aviation technology and aviation safety.
c. In the revision _process_of_this AC, the FAA solicited comments from
the parachute industry and users. The USPA should be contacted for state -of-
the -art information which relates to parachute jumping that is not
specifically mentioned in this AC (see paragraph 5c).

4. DEFINITIONS.
a. 'Airports without Operating Control Towers' - means an airport without a control tower or an airport
with a control tower which is not operating. These airports are commonly referred to as non - towered,
uncontrolled, or part-time towered airports.
b. Common Traffic Advisory Frequency (CTAF) - a designated frequency for the purpose of carrying
out airport advisory practices while operating to or from an airport which does not have a control tower or
an airport where the control tower is not operational. The CTAF Is normally a UNICOM, MULTICOM, flight
service station, or tower frequency. CTAF is identified in appropriate aeronautical publications.

• (2) Due to limited maneuverability, airships will not normally fly a standard traffic pattern, though
they may on occasion at reduced airspeeds.
e. PARACHUTE OPERATIONS
(1) Parachuting has been determined by the FAA to be a legitimate aeronautical activity. All
activities are normally conducted under a NOTAM noting the location, attitudes, and time or duration of jump
operations. The Airport/FacAity Directory lists airports where permanent drop zones are located.
(2) —Jumpers normally exit the aircraft either above, or well upwind of, the airport and at altitudes
well above traffic patter altitude. Parachutes are normally deployed between 2,000 feet and
5,000 feet AGL and can be expected to be within 2 miles of the airport when below 3,000 feet AGL,
(3) Pilots of jump aircraft are required by Part 105 to establish two -way radio communications with
the air traffic control facility which has jurisdiction over the affected airspace prior to jump operations. Jump
pilots are also encouraged to provide advisory Information on the CTAF, i.e.,'Chambersburg traffic, jumpers
away over Chambersburg.'
(4) Parachutists maneuver to avoid landing on active runways. Because parachutes have limited
flight-performance, aircraft should maneuver to avoid any potential conflicts in either the airspace or runway
environment.

The Rules
Skydiving in the U.S. is governed by FAR Part
105, .Intentional Parachute Jumping." This regula-
tion establishes the basic operating procedures for
skydiving so that it meshes safely with other aero-
nautical uses of the nation's airspace and airports.
FAA Advisory Circular 105 provides additional
guidance on parachute equipment and operations.
FAA Order 5190.6A (which stipulates how own-
ers of federally - funded airports manage their facili-
ties) stales an owner must "make it available to all
types, kinds and classes of aeronautical activity on
fair and equitable terms and without unjust discrimi-
nation." Skydiving is recognized as an "aeronautical
activity" by the FAA.
The U.S. Parachute Association, founded in 1957
and headquartered in Alexandria, VA, establishes in-
structor qualifications, issues licenses and publishes
comprehensive recommended operating procedures.
This skydiving center belongs to USDA and uses
only USDA -rated instructors. All parachute riggers
hold FAA certificates, and many of the jumpers on
this held hold current FAA pilot certificates.
Our skydiving center is eager to work with avia-
tors and others at the airport to protect the safety of
all airport users and the surrounding community.

ABOUT SKYDIVING
AT THIS AIRPORT
Parachutes are a common sight at more and more
airports. This brochure was prepared to help inform
other aviators about the skydiving activities at this
airport.
Skydiving has grown since the early 1960s when
local jumpers formed clubs and began weekend sky-
diving at airports all across the countrv. The spurt
has grown in many places into full -lime, seven -days-
a -week skydiving centers.
The sport recognized as an aeronautical activity
by the FAA —has established itself worldwide
through skydiving training centers like the one on
this airport.
Skydiving centers are also the home of companies
that service, manufacture and sell parachutes and
other skydiving equipment. Skydiving operations re-
quire fuel, aircraft maintenance and other related
•
services. These companies employ local residents
and contribute to the health of the economy in their
communities.
Also, most skydiving centers bring patrons from
larger cities to outlying rural communities on the
weekends. They and their friends who come to
watch often spend the day and visit local establish-
ments before returning to the city.

JUMP pilots hold
commercial ratings, and many have logged several
thousand hours as pilot in command.
Jump pilots often fly patterns that may seem un-
usual to other pilots. During the climb to altitude,
they stay near the airport and climb rapidly. Some
popular jumpships, such as the Pilatus Porter and
Twin Otter, have STOL characteristics, and thus can
safely fly tight patterns. In fact, descent and landing
by some of these aircraft occasionally alarms non -
aviators, who think the plane may be "crashing,"
but it's just another ordinary landing for these jump
planes.
Jump Operations
Skydiving operations take place from sunrise to
sunset year round. Ceilings below 2,500 feet and
winds above 2j ots effectively ground skydivers.
Night jumps . nducted on an occasional basis,
usually when the moon is full. An additional
NOTAM is filed before night jumps begin, and all
skydivers wear lights visible for at least three miles.
A typical jump involves exiting the aircraft from
7,000 to 13,000 ft. AGL and freefalling for about
one minute to approximately 2,500 ft. AGL for para-
chute deployment. Normal canopy openings are be-
tween 2,000 ft. AGL and 4,000 ft. AGL. All jumpers
are under canopy by 2,000 ft. AGL for the descent
to the landing area.
'file canopy descent takes about two to five min-
utes. These procedures mean the parachutists are
under fully - inflated canopies at least 1,000 ft. above
most traffic pattern altitudes.
Most modern parachute canopies measure about
10 x 20 ft. and have a 20 mph to 30 mph forward
speed and a 3:1 glide ratio. In other words, it's rela-
tively easy for pilots to spot skydivers under canopy
over the airport. Unlike an aircraft, a parachute is
traveling quite slowly and nearly vertically, making
it easier to see and avoid than an aircraft. That's the
main reason there aren't collisions between a
skydiver under canopy and an aircraft in Right.
Skydiving is almost always conducted upwind of
the landing area. Jumpers exit upwind and stay up-
wind until 200 feet from the ground. Then they fly
slightly downwind of the target before turning up-
wind to land. Thus, it's unlikely for a pilot on final
approach to encounter a parachutist, because a pi-
lot's final approach starts downwind of the airport,
while jumpers stay upwind. Any potential conflict
between an aircraft and parachute is minimized.
A modern parachute is like a highly maneuverable
but low- performance glider. Like sailplane pilots,
parachutists sometimes land places other than the
airport. Skydivers are taught to avoid landing on ac-
tive runways and taxiways.

RE PAY PLAN FOR 1994
The attached Resolution formalizes the 1994 pay schedule which
was approved by the City Council on December 28, 1993. We have
added a Grade E2, midway between two existing grades, for future
use, if necessary. It is currently an empty grade.
The Resolution also adopts the position classification assignment
table on page 3. The table reflects changes in the
parks /recreation department which occurred during 1993 and which
were provided for in the 1994 budget, reclassifying the park and
recreation specialist and director positions. Also, the
wastewater laboratory technician and motor vehicle deputy
registrar positions have been changed from grade VIII to grade IX
for pay equity. A few part time positions have been
administratively reclassified, as provided for in the pay plan.
The new positions of custodian /courier and GIS coordinator have
been added.

RESOLUTION ADOPTING POSITION CLASSIFICATION
ASSIGNIENT TABLE EFFECTIVE JANUARY 1, 1994
WHEREAS, the City Council has considered the existing classification of
Positions for the City of Hutchinson and the current economic conditions,
BE IT RESOLVED, that a Position Classification Plan is hereby adopted. All
Positions covered by this Resolution shall be grouped in grades having a definite
range of difficulty and responsibility. For each position there shall be a title;
and there shall be shown examples of work which are illustrative of duties of
positions, as well as requirements as to knowledge, abilities and skills necessary
for performance of the work; and a statement of experience and training desirable
for recruitment into a position.
A. ALLOCATION OF NEW POSITIONS.
When a new position is created for which no appropriate description exists or when
the duties of an existing position are sufficiently changed so that no appropriate
description exists, the City Council after recommendation of the Personnel
Coordinator shall cause an appropriate job description - specification to be written
for said position.
B. REVIEW OF PLAN.
As often as necessary to assure continued correct classification, the Position
Classification Plan shall be reviewed by the Personnel Coordinator and necessary
adjustments recommended to the City Council.
C. FILING OF PLAN.
Upon adoption of the Resolution, a copy of the Position Classification Plan approved
by the City Council shall be placed on file with the City Administrator. The plan
so filed and subsequently adjusted by the Council shall be the Position
Classification Plan of the City.
1. Elements of the Plan. The Compensation Plan shall consist of
a. A Basic Table of Numbered Pay Grades for All Emvlovees.
Each numbered pay grade in the basic table consists of a minimum (Level 1)
rate, a maximum (Level 7) rate, and a midpoint (Level 4) rate, in addition to
intermediate levels, shown on page 4.
b. A Position Classification Assignment Table for Emolovees.
The assignment table shall assign all of the various positions in the Position
Classification Plan to the appropriate pay grade. Said table follows in page
3.
2. Modification of Plan.
The City Council reserves the right to modify any or all of the pay grades or
position classification assignments as set forth in said plan at any time.

employee will be the minimum rate. After satisfactory completion of twelve
months probation, up to a five percent increase-will normally be granted, with
the exception that such increase may be granted midway through the

Administrator. Thereafter, consideration for performance increases will be
given annually each individual anniversary date. The City Administrator
reserves the discretion to adjust individual rates within the assigned pay
grades based upon (a) a merit review and recommendation from the department
head, reflecting job performance over the preceding twelve months, and (b)
consideration of equity among departments. Consideration for market
adjustment for all pay grades will be made each January 1.
b. Administrative (Salaried) Emnlovees

provisional (Level 0) rate may be used. After satisfactory completion of
twelve months probation, up to a five percent increase will normally be
granted, with the exception that such increase may be granted midway through
the probationary period (at six months) with the approval of the City
Administrator. Thereafter, consideration for performance increases will be
given annually each individual anniversary date. The City Administrator
reserves the discretion to adjust individual rates within the assigned pay .
grades based upon (a) a merit review and recommendation from the City

C. Police Civil Service Employees.
In Police Civil Service positions, the established starting rate for patrol

year. After completion of probation, an increase to Level 3 shall be granted.
Likewise, an increase to Level 4 shall be granted after completion of two
years employment and to Level 5 after three years employment. Thereafter,
length of service (longevity) shall be recognized as follows:

department office, dispatch and school liaison personnel shall be hourly and
under merit plan. Any market adjustment on January 1 of any year shall be
separate and apart from the merit adjustments.
None of the increases provided by this section shall be made so as to compensate any
employee in an amount exceeding the maximum step in the assigned pay range.

AIRPORT HANGAR POLICY
• This airport hangar policy was adopted by the Hutchinson
Airport Commission and confirmed by the City Council for the City
of Hutchinson. _
RECITALS:
1. The City of Hutchinson has constructed, and has
available, hangar space for rent for the purpose of storing
airplanes and airplane- related equipment.
2. Insufficient hangar space is presently available to
accommodate all who wish to take advantage of the availability of
airplane hangars.
3. The City of Hutchinson is responsible for maintenance,
repair, managing and, in general, operating the Hutchinson
Municipal Airport, now known as Ken Butler Field, and provides
• significant administrative and financial support to the airport.
4. The City of Hutchinson has constructed, at city expense,
a series of hangars which are available for rent and the city now
desires to adopt a formal policy governing the "waiting list" for
space available in said hangars.
NOW THEREFORE BE IT RESOLVED BY THE HUTCHINSON AIRPORT
COMMISSION AND THE CITY COUNCIL OF THE CITY OF HOTCHINSONt
1. Waiting List. The Hutchinson Airport Commission shall
maintain a waiting list for Hutchinson applicants and a separate
waiting list for applicants from outside the City of Hutchinson.
2. Waitina List Priority. Any person or entity living
within the corporate city limits of the City of Hutchinson, or

having a principal place of business within the corporate city
limits of the City of Hutchinson, shall be listed on the City of
Hutchinson waiting list for hangar space. The names of all other
applicants shall be carried on a separate list. All names,
regardless of the list, shall be ranked in order of the date the
application was received by the City Administrator.
3. Availability of Ranaar Space. When a hangar becomes
available, the same shall be offered to the first name on the city
list and shall be offered to each succeeding individual on the city
list. If the hangar is not chosen by anyone from the city list,
the same procedure shall be followed with the list reserved for all
other applicants. Hangar space can be declined on two separate
occasions without loss of priority. If hangar space is declined on
a third occasion, the party so declining shall lose priority and
shall drop to the bottom of the applicable list. No person shall M
be eligible for more than two hangars. Every applicant shall own
an aircraft registered in the State of Minnesota to be eligible for
inclusion on either list.
4. Rules and Reoulations. All persons on either list shall
comply with all rules and regulations promulgated by the Hutchinson
Airport Commission or the City of Hutchinson or other appropriate
governmental and management agencies. Failure to comply with the
rules and regulations may result in forfeiture of the privilege of
renting hangar space at Hutchinson Community Airport.
5. No Property Riaht. Nothing in this policy shall be
construed as creating any property right, under state or federal

law or under state or federal constitutions, in any individual or
applicant by virtue of inclusion or exclusion from any waiting list
for hangar space at the Hutchinson Municipal Airport.
This policy is made and adopted this 28th day of December,
1993.

I am writing to you in your capacity as the City Attorney for the City of
Hutchinson. I have examined a title for property owned by B & G Cartage &
Warehouse in the southeasterly portion of Hutchinson. My client is the owner
of Lot 14 in Lot "G" Subdivision. I am enclosing a quit claim deed that I
request the officials of the City of Hutchinson execute and deliver to me for
filing to eliminate a potential title problem. The title problem is this:
1. The plat of Lot "G" Subdivision was filed June 27, 1961.
Notwithstanding the platting the owners of the instant property
continued to use a metes and bounds description for the last 30
years up to and including the current ownership. The metes and
bounds description varies somewhat from the plat. The calls by
direction and point all match up, but the distances do not. The
saving grace is that the call in question is a problem goes to the
right -of -way line to the old railroad, follows along it and then
back to the west, even though the dimensions are incorrect.
2. For your easy reference I am enclosing a photocopy of one of the
pages of the abstract giving the incorrect description that was
repeatedly used. I am also providing a photocopy of the plat
showing Lot 14 in which I have marked the metes and bounds
calls to show the variation from the platted description.

3. At this point we are asking the neighbors to the east and south
(where there would be a potential problem of shortfall) to give a
quit claim deed as to Lot 14 to eliminate any question of claim.
The City of Hutchinson is the owner of record to the old railroad
right -of -way immediately to the east.
As a second matter and not directly related to the marketability of this title, is
an easement right -of -way that appears in the abstract. I am enclosing a
photocopy of that document. The problem with it is that it references a legal
description that does not exist. There is no Lot G, Subdivision of Lot G of
Auditor's Plat... ". There must be a typographical error there. This is a grant
for a crossing as the southerly 30 feet of Lot 17 (wherever that is). Although
it doesn't appear to directly affect my client it is a matter it should have some
attention since this document is meaningless in its present form. You may
also wish to discuss this with the City officials.

Whereas the City of Hutchinson wishes to pursue a solid waste capital assistance program
grant from the Minnesota Pollution Control Agency. Also, the City of Hutchinson wishes
to pursue an implementation schedule extension relative to the February 1995 deadline for
new sludge facilities in operation per the 503 regulations, and the City of Hutchinson would
like RUST E&I to assist the City in these tasks.
Insert the following Task IV and Task V to existing Section A - Scope of Services:

Client shall pay RUST E&I for the Services in accordance with the following:
Compensation for the Services set forth in Part I shall be per diem not to exceed $19,600.
In the event authorization to proceed is not received by January 1, 1994, this price shall be
renegotiated. RUST E&I will bill the Client no less frequently than monthly, with a
maximum of $7,300 billed in 1993. Net payment is due in 30 days. Past due invoices will
be subject to a service charge at the rate of 1 -112 percent per month. The bill will consist
of a calculation of the amount of lump sum due based on percentage of Project completed
during the billing period. Unless Client provides RUST E&I with a written statement of
any objections to the bill within 15 days of receipt, Client shall be deemed to accept the bill
as submitted.

SOLID WASTE CAPITAL ASSISTANCE PROGRAM GRANT
FROM THE MINNESOTA POLLUTION CONTROL AGENCY
WHEREAS, the City of Hutchinson, Minnesota, has made
application to the Office of Waste Management for a capital
assistance program grant to construct a co- composting facility.
BE IT RESOLVED by the City Council that the City of Hutchinson
will implement the project, provide necessary local financing, and
accept and exercise the governmental powers necessary to develop
and operate the project.
BE IT FURTHER RESOLVED that the City Council authorizes the
City Administrator to sign the Preliminary Capital Assistance
Program grant application on behalf of the City of Hutchinson.
Adopted by the City Council this 11th day of January, 1994.

RE: City Warning Sirens
As you recall, last June (1993) the city council authorized me, as
emergency management director, to seek funds for the purpose of
replacing the current city warning sirens (civil defense). As of
this writing it appears there will be no funding available due to
the flood disaster of 1993.
Anticipating no funding, the full expected cost of new sirens was
placed in the 1994 budget. Although removed from the operating
budget it is anticipated that this project would be paid by
equipment bonds.
Since it would be necessary to have installation completed by April
. 1994, I am requesting authority to begin procuring bids for this
project.
If you have any questions or concerns regarding this memorandum,

This correspondence is for the purpose of confirming the good news
that the District Court has dismissed both of the statutory claims
in the Junker litigation.
This leaves just the 3M claim and the waste water treatment claim.
While the City may have a defense against the waste water treatment
claim, the City has no defense on the 3M claim. I discussed this
matter with Morgan at some length last week and it is his
recommendation, with which I concur, that it would be appropriate
for the City to get rid of the 3M claim as soon as possible.
Attorney Savage, representing the interests of Junker, will accept
$18,000.00 for settlement of the Junker claim alone and it is our
joint recommendation that $18,000.00 be offered to resolve that
issue.
I presume, although I do not know for sure that Junker will more
than likely appeal the adverse determination that he has received
from the trial court.
The opinion itself is interesting in that it rather pointedly notes
that Junker could not have been surprised at the failure to renew
the contract, in view of his litigious nature.

By carbon copy of this correspondence to the council members, I
would suggest that if it would be possible to dispose of the 3M
matter without having a closed meeting on Monday, I would like to
do so. Obviously, I do not want to have any extensive discussion
regarding the merits of the claim and I would prefer to have a
simple vote, up or down, on whether or not to offer the $18,000.00
requested by attorney Godfrey. I do not wish to impede the right
of any council member to discuss this matter in some detail, but if
we are going to do this, I would then request that a closed meeting
/be used for that purpose.
Otherwise, we can simply call for a vote on whether or not to
( extend the $18,000.00 necessary to settle the 3M claim.

The Hutchinson Fire Department responded to 26 calls in December
and had a total of 273 calls for the year. One more call than in
1992.
• Of the 26 calls:
7 were car accidents
9 alarms at schools or businesses
2 apartment fires
1 Haz -mat spill at 3M

Dear Sir:
We are in receipt of your letter of December 21, 1993.
We realize your bid specifications called for the City of Hutchinson
to have salvage rights until the building was turned over to the
demolition contractor, but are a little puzzled as to what will be
considered by the city to be considered salvage? Normally, in the
demolition business of this type of structure, "salvage" means
removing and saving desks, window air conditioning units, historical
artifacts etc.. "Salvage" does not mean gutting the building of any
thing of value to the contractor, which he may have considered to be
of value when he offered his bid, such as plumbing, electrical,
•backup electrical in this case, heating, doors, windows, and
structural timbers, etc..
When nothing to be salvaged is specifically identified in advance of
the bid opening, but thought of later as an after thought, the
contractor is put in the spot of having to determine what is the
best course of action to allow both financially and sometimes
politically.
In the case of your building, I personally do not think it is in the
best interests of the City of Hutchinson to go into the salvage
business. I think when you weigh the costs involved, advertising,
insurance, auctioneer, storage, "bad will ", etc., against any
profit, you will find the rewards to be negligible. One of my
greatest fears, if I were you, would be the possible asbestos
contamination of the complete building (all demolition material), by
amateur salvage efforts, along with possible future legal actions by
the salvagers themselves (health). Should the demolition materials
become contaminated, I think you could realistically see your
demolition /removal /disposal costs increase by 1,000 percent.
I think we can accommodate you with a reasonable delay in the
demolition schedule, if you need further time with the moving to
your new facility.
