1. The meeting was called to order at 7;30 P.M. by Mayor
Torgerson. Present were: Mayor Marlin Torgerson, Council
Members Bill Craig, Kay Peterson and Don Erickson. Absent:
Council Member John Mlinar. Also present: City Administrator

The motion to approve the consent agenda, with the
exception of items 4 -(g), (h), and (i), was made by
Council Member Erickson, seconded by Council Member
Peterson and unanimously carried.
The motion to remove item 4 -(g) from the agenda was made
by Council Member Peterson, seconded by Council Member
Erickson and unanimously carried.
During discussion of item 4 -(h), it was noted that all of
• the conditions mentioned in Attorney James Degiovanni's
letter were the same as the staff and Planning Commission
recommendations. Engineer Rodeberg stated all of the
lots in the Industrial Park are non- conforming to the
City's zoning ordinance. The Planning Commission
determined there was undue hardship. Administrator Plotz
stated the conditional use permit was approved in
concept, and Jay Freedland will need a final site plan
approved by the Planning Commission prior to issuance of
a building permit.
Following discussion, the motion to accept the
recommendations of the Planning Commission in their
entirety was made by Council Member Craig, seconded by
Council Member Erickson and unanimously carried.
Following discussion of item 4 -(i), the motion that
approval be contingent upon acceptance of the final site
plan was made by Council Member Craig, seconded by
Council Member Peterson and unanimously carried.

(a) CONSIDERATION OF HCVN LOAN AGREEMENT /LEASE FOR SPACE IN
CITY CENTER (DEFERRED FROM APRIL 12, 1994)
Finance Director Kenneth Merrill reviewed the terms and
conditions of the proposed $20,000.00 loan agreement/
lease to HCVN. The interest rate would be 6.55% over a
five year period, with monthly payments to commence June
1994. Also, HCVN will reimburse the City $50 per month
to cover heating, electric and air conditioning cost.
Following discussion, the motion to approve the loan
agreement /lease and to adopt Resolution No. 10210 was
made by Council Member Peterson, seconded by Council
Member Craig and unanimously carried.

(b) CONSIDERATION OF LMCIT OPEN MEETING LAW DEFENSE COST
COVERAGE
Following a presentation by Insurance Agent Dennis Potter
and Finance Director Kenneth Merrill, the motion was made
by Council Member Erickson, seconded by Council Member
Peterson and unanimously carried, to reject the law
defense cost coverage.
9. NEW BUSINESS
(a) CONSIDERATION OF PURCHASE OF KEG COOLER FOR LIQUOR HUTCH
Following discussion, the motion to approve the
recommendation was made by Council Member Erickson,
seconded by Council Member Peterson and unanimously
carried.
(b) CONSIDERATION OF SKYDIVING AGREEMENT BETWEEN THE CITY OF
HUTCHINSON AND SKY'S THE LIMIT
Following discussion, the motion to approve and enter
into an agreement with Sky's the Limit was made by
• Council Member Craig, seconded by Council Member Erickson
and carried three to one, with Council Members Craig,
Erickson, and Torgerson voting aye and Council Member
Peterson voting nay.
(c) CONSIDERATION OF APPLICATION OF W D H, INC. FOR

Following discussion, the motion to approve was made by

Following discussion, the motion to approve the sale and

(e) CONSIDERATION OF AWARDING BID FOR LETTING NO. 10, PROJECT

Council Member Craig, seconded by Council Member Erickson

(g) CONSIDERATION OF DEVELOPMENT AGREEMENT REGARDING TAX
INCREMENT FINANCING FOR PRINCE OF PEACE PROJECT
Following discussion, the motion to defer to the next
meeting was made by Council Member Peterson, seconded by
Council Member Erickson and unanimously carried.
(h) CONSIDERATION OF ENTERING INTO CONTRACT WITH OSM FOR
BRIDGE CONSULTANT SERVICES
Following a report from the City Engineer, the motion to
approve entering into a contract with OSM for the Bluff •
Street bridge, not to exceed $45,000 without approval,
was made by Council Member Peterson, seconded by Council
Member Erickson and unanimously carried.
(i) CONSIDERATION OF ENTERING INTO CONTRACT WITH BOLTON &
MENK FOR CONSULTANT SERVICES ON LETTING NO. 6, PROJECT
NO. 94 -06 (OSGOOD AND HAYDEN ADDITIONS AND SURROUNDING

It was reported the City of Hutchinson would be the lead

Following discussion, the motion to approve a posted sign
"Access Road" at the entrance and to leave the address 40
West Highland Park Drive NE was made by Council Member
Peterson, seconded by Council Member Erickson and
unanimously carried.

(a) COMMUNICATIONS FROM COUNCIL MEMBER BILL CRAIG
Council Member Craig complimented the Building Official
on his efforts to communicate with the townships to keep
them informed on issues regarding annexation, etc. He
also inquired about the erratic sounding of the warning
sirens.
• (b) COMMUNICATIONS FROM COUNCIL MEMBER KAY PETERSON
Council Member Peterson requested input for items to be
addressed by the Safety Council. She also suggested the
method used for garbage recycling pickup should be
reviewed. Items blow out of the recycling containers and
litter the yards.

(C) COMMUNICATIONS FROM CITY ADMINISTRATOR
Administrator Plotz commented on the upcoming City Center
open house to be held May 7 from 10:00 A.M. to 2:00 P.M.,
with special events planned.
It was reported there would be a spring city -wide pickup
of leaves, twigs and composting grass. The advertising
costs would be covered by County funding.
The City Administrator noted the City had received an
appraisal from Lorence and Associates on the Svanda
property which is part of the Hutchinson airport
project. Mr. Lorence appraised the .48 acres of land at
$1,700.00. Following discussion, the motion to offer
$2,395.00 plus access to their property from the easement
was made by Council Member Craig, seconded by Council
Member Erickson and unanimously carried.

10, 1994, at which time they will review the city's
budgeting process.
(d) COMMUNICATIONS FROM DIRECTOR OF ENGINEERING
Engineer Rodeberg mentioned the "Fins and Feds" will be
in Hutchinson next week regarding the Bicycle and
Pedestrian Friendly Development Project in Hutchinson.

Hutchinson Library Board Meeting
Thursday, April 14, 1994
Members Present: L. Ladd, Mary Henke, Dolores Brunner, Roy Johnson,
Sharon Opatz, Paul Berg, Joyce Beytien
L. Ladd reported on information about a prospective sign for the
Library. David Nystrom, a field service rep. for the State Historical
Society, stated there is no grant money available to signing but
there may be money available for special repairs. Chuck Nelson, an
architect, said there is no model for an appropriate sign but there
are samples and specifications as it is a historic building.
A committee set up with L. Ladd, Kay Peterson, Roy Johnson will
pursue the proposal for the sign.
Computer update: Two new computers are running and the one from
3M is also, thanks to Russ Erickson. We are receiving more requests
for materials now—the machines are quiet ... and exciting!
The grant application has been put on hold.
Library Hours survey: Dolores and Mary will consult with Kay Peterson
and revise the hours scheduling chart to present to the board in May.
Crow River Glass Co. completed the desk top.
A new custodian was hired, Archie Kucera.
Two new library board members were approved by the City Council.
Paul Wright and Sue Munz
Mary presented information on a local library trends survey that
PLS has suggested we fill out and work from to set some goals
and determine our needs in the next five years.
Board members will each bring back their ideas to discuss and compile
in May.
The next meeting will be on Thursday, May 5 at 4:30 P.M.

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA,
AUTHORIZING THE SALE OF MUNICIPALLY OWNED REAL ESTATE
AND ADOPTING BY REFERENCE, CITY CODE CHAPTER 1 AND SECTION 2.99
WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS
THE CITY OF HUTCHINSON ORDAINS:
Section 1. The City of Hutchinson having determined that it
no longer has need of the following property and that it would be
reasonable, just and in the best interest of the City to sell the
same, hereby authorizes and approves the sale of the following
described real estate to Rick Lennes:
South 56' of Lot 3 and the North 10' of Lot 4, Block 51,
North 1/2 City (661x132' vacant lot located at 26 Franklin
Street N.)
Section 2. The terms of the sale shall be as set forth in the
purchase agreement by and between the City of Hutchinson as seller
and Rick Lennes as buyer which purchase agreement is dated
Section 3. City Code Chapter 1 entitled "General Provisions
and Definitions applicable to the Entire City Code Including
Penalty for Violation" and Section 2.99 entitled "Violation a
Misdemeanor" are hereby adopted in their entirety, by reference, as
though repeated verbatim herein.
Section 4. This ordinance shall take effect upon its adoption
and publication.

TRACTS AND PARCELS OF LAND INTO THE CITY OF HUTCHINSON
AS MORE PARTICULARLY SET OUT IN SAID ORDINANCE
WHEREAS, certain parcels of land as more particularly
described abut or adjoin the City of Hutchinson;
WHEREAS, the Minnesota Municipal Board pursuant to Minnesota
Statutes Chapter 414 has approved the following annexation;
WHEREAS, it would be in the public interest to annex and
incorporate said lands into the City of Hutchinson;
NOW THEREFORE, the City of Hutchinson does ordain:
SECTION 1. That the lands hereafter described shall be, and
the same hereby are, annexed to the City of Hutchinson, a Minnesota
municipal corporation, located in the County of McLeod and State of
• Minnesota and from and after passage and publication of this
Ordinance, said lands shall be annexed to and become a part of and
included in the corporate limits of the City of Hutchinson:
Total of 1.6 Acres
The southerly 375.00 feet of the westerly 190.00 feet
of Lot 3 of Auditor's Plat of the South Half of Section 30
and the North Half of Section 31, Township 117 North,
Range 29 West, as measured along the west and south lines

• Since 1991, Richard Seipel has been issued a transient merchant
permit by the City to sell fresh produce within the city limits.
Again this year, Mr. Seipel is requesting a permit to sell his farm
products on the vacant lot across from Hardee's which is owned by
North Central Food Systems. He has received permission from Bill
Henneman (612- 854 -7944) to use this commercial property during the
summer months.
There have been no complaints or problems with Mr. Seipel's

The 20th Annual Arts & Crafts Festival of the Hutchinson Area Chamber of Commerce will be held Friday,

Crafts Task Force would like to request the following:

overflow of exhibitors and Taste of Hutchinson vendors. For emergency
purposes, the alley behind 101 Park Building will be continued to the south
side of the park. No obstructions will be allowed in this area.
• Closing of Hassan Street between Washington Avenue East to 1st Avenue
Southeast for overflow exhibitors.
• Closing of the following municipal parking lots Friday morning, September 16,
through Saturday, September 17, to accommodate exhibitor parking for the
event:

Registration will be conducted in Library Square, and all exhibitors will receive a parking authorization card.

topographical design of Fifth Avenue as it comes off Dale Street. The hill that goes
from Dale Street to Harrington Street on Fifth Avenue makes it difficult for cars to see
small children crossing near that corner. In addition there are frequently cars that
travel very rapidly over that hill making it even more difficult to stop in time.

SITE LEASE AGREEMENT

This agreement is made and entered into this day of
April, 1994, by and between the City of Hutchinson (Lessor), a
Municipal Corporation and the Cellular 7 Partnership (Lessee), a
Minnesota General Partnership.
In consideration of the covenants and agreements hereinafter
set forth, the parties hereto agree as follows:
(1) Leased Premises. Lessor hereby leases to the Lessee, for
the period, at the rental, ,and- upon the terms and conditions
hereinafter set forth, tthe following described premises:
Space in and_An - top of the South Park water tower and
adjacent property as needed to place a 141 x 17'
equipment building.
(2) Access. Lessor also grants Lessee access to the space
described in subparagraph 1, seven days a week, 24 hours a day,
throughout the term of the lease.
(3) Term of Lease. The term of this lease shall be for an
initial period of sixty (60) months, unless sooner terminated as
provided below. The Lessee shall have an option to renew the
lease, upon 60 days prior written notice to the Lessor, for two (2)
additional sixty (60) month periods, on the same terms as set out
in this lease. Provided, however, that the rent payable to the
Lessor during such renewal periods shall be determined in
accordance with paragraph 5 hereof.

(4) Termination.
(a) Lessor or Lessee shall have the right to terminate •
this lease for cause in the event that the other party defaults on
any material provision of this lease, and in the event that such
default is not cured within thirty (30) days after written notice
thereof provided to the other party.
(b) In the event of termination or expiration of the
lease, the Lessee shall have a reasonable period of time not
exceeding ninety (90) days to remove all antennas, equipment, and
materials from t4q p "}g6s`\1The Lessee shall deliver possession I IL
of the premises `10-ahe Lessor at the expiration of the lease in
good condition and repair subject to ordinary wear and tear, which
is specifically excepted.
(c) The Lessee shall not do or permit any activities
upon the premises which would cause or permit physical, electronic,
or other interferences with any other electronic, audio or video
transmission facilities, equipment, or signals.
(5) Rental Payments.
(a) The Lessee shall pay to the Lessor rental of $500
for each month of the lease. Rental shall be applied to Lessors
Cellular 2000
account as
a credit which
may be applied to all
cellular service provided

no carry over of remaining
credits to subsequent

(b) Option periods will be renegotiated when Lessee
expresses intent to exercise option. Both parties must agree, in

. writing, as to the terms and conditions of any renewal option under
this agreement.
(6) Use of Premises. The Premises shall be used by Lessee
for the installation, operation, and maintenance of a
communications system, including but not limited to cellular
telephone, radio, paging and other narrow band and broad band
audiowave transmission and reception, and related purposes.
However, any welding, painting, drilling of holes or alterations in
any form to the water tower by the Lessee must first be approved in
writing by the Lessor.
(7) Insurance and Indemnification.
(a) Lessee shall, during the term of the lease, maintain
property coverage on all personal property and fixtures owned by
SLessee. Lessee acknowledges that Lessor is not responsible for
insuring against the loss oir/Lessee's equipment and Lessor has not
so insured Lessee *4410m t, fixtures and improvements. Lessee
shall also makatarh a single limit or combined limit general
liability insurance policy of an amount not less than the limits
set forth in Chapter 466 of Minnesota Statutes for property damage
arising from one occurrence or for bodily or personal injuries or
death or damages arising from one occurrence.
(b) Lessee shall hold Lessor harmless from and indemnify
Lessor against any and all liability, damage, loss and expense
arising or resulting from the acts or omissions or caused by Lessee
or Lessee's employees, servants, agents, guests, assigns,
subtenants, visitors or licensees, in, upon or about the premises,

the building or the adjacent areas, including all common areas or .
arising out of or related to the use and occupancy of the property
or the business or activity conducted with respect to the property,
including but not limited to injuries to person or property. This
indemnification clause specifically includes reasonable attorney's
fees incurred by the Lessor, and Lessee shall reimburse Lessor for
attorney's fees as incurred and not only at the termination of the
litigation or other dispute necessitating the retention of an
attorney by Lessor.
(8) Damage or Destruction. If the Premises are damaged or
destroyed by fire, winds, flood or other natural or manmade cause,
Lessor shall have the option_to repair or replace the Premises at
its sole expense, or tom- }mute this lease effective on the date
of such damage o�d }�ti�ion.� In the event it elects to terminate a

obligations hereunder. If Lessor elects to repair or replace the
premises, until such repair or replacement is completed so that the
Lessees can resume full operations, the Lessee's rental hereunder
shall abate until the premises are restored to a condition that the
Lessee can resume full operations at the premises.
(9) Taxes and Utilities.
(a) The Lessor shall pay and be responsible for all
taxes due on the Premises, and the Lessee shall pay and be
responsible for all taxes due on Lessee's equipment and fixtures
installed on the Premises.

(10) Notices. Any notice required or permitted to be given
hereunder shall be in writing and shall be deemed to have been
given (a) upon personal delivery or (b) upon receipt after mailing
by certified or .registered first class mail, postage prepaid,

(11) Miscellaneous Provisions.
(a) Lessor warrants that it has full right, power, and
authority to execute this agreement. Lessor covenants that Lessee,
in paying rent and performing the covenants by it herein made,
shall and may peacefully and quietly have, hold, and enjoy the
leased property.
(b) Lessee's obligations hereunder shall be contingent
upon Lessee's ability to use the premises for the purpose described
in Paragraph (6) above, including but not limited to receipt of all
necessary easements, permits, zoning approvals, and regulatory
approvals.
(c) Lessee shall obtain all necessary governmental and
regulatory approvals required for its occupation and use of the
Premises, including but not limited to zoning changes, and shall be
responsible for the cost of obtaining such approvals. The Lessor
shall cooperate with the Lessee in obtaining such approvals.
(d) The provisions of this lease shall bind and inure to
the benefit of the parties hereto and their heirs, legal
representatives, successors and assigns.

(e) This lease contains the entire agreement of the
parties with respect to any matter mentioned herein and supersedes

any prior oral or written agreements.
(f) This lease may be amended in writing only, signed by
the parties in interest at the time of such amendment.
(g) This lease may be assigned by the Lessee without the
written consent of the Lessor, provided that the assignee continues
carrying on Lessee's communications business as contemplated
hereunder and assumes in writing the obligations of the Lessee
hereunder. This lease may be assigned by the Lessor without the
consent of the Lessee, provided that the assignee shall take the
Premises subject to this lease.
(h) No waiver by eithe y of any provision hereof
shall be deemed a waiver of a p vision or of any prior or
subsequent breach or any Y`siiYn ereof.
(i) If any terMM"rovision of this lease is held to be
invalid or unenforceable, such invalidity or unenforceability shall
not be construed to affect any other provision of this lease, and
the remaining provision shall be enforceable in accordance with
their terms.
(j) This agreement shall be governed by and construed in
accordance with the laws of the State of Minnesota.
(k) If Lessee does not promptly vacate the premises at
the end of the Lease term, such holding over shall be treated as
creating a month to month tenancy.
IN WITNESS WHEREOF, the paries have executed this lease

It is my understanding from a conversation I had with attorney Morgan Godfrey that the 3M
claim can now be resolved by payment of the agreed upon $18,000.00. My recollection is that
the council directed Mr. Godfrey and myself to enter into discussions with opposing counsel
but that we had not received specific authority and I am now requesting that authority in the
amount of $18,000.00.
If the council would approve this request at the next City Council meeting, Mr. Godfrey can
secure the necessary signatures on the release and other documents resolving the 3M claim.
As you may recall, the 3M claim arises out of the continued violation by 3M of the court order
following the February, 1992 judgment that was entered in this case.
This leaves essentially two issues. First, Junker continues to persist in his claim for damages
involving the waste water treatment facility and second, there is the possibility of an appeal
by Junker of the adverse results on the issue of the interpretation of the waste hauling statute.
Mr. Godfrey will bring you up to date on those issues as the need arises.

My recommendation is to award the contract to MacQueen Equipment of
St. Paul, MN to supply one (1) new 1994 Model Elgin Street Sweeper to the
City of Hutchinson for a net bid of $73,768.00. This price includes the of
trade -in of our present street sweeper (1983 Elgin). I've made this
recommendation based on the following reasons:.
when considering the three companies that bid this unit, only one
company met specifications. (MacQueen Equipment) ABM Equipment and Supply
were eliminated because they were the high bidder and also didn't meet
specifications. Crysteel Truck Equipment did not meet specifications but
were low bidder. Therefore, I have outlined below some of the areas where
their machine was unable to meet specifications.
1. Rear unloader - poor visibility; operator can't see the curb
behind the gutter brooms. Can not see directly
behind the sweeper and can only check for on- coming
traffic by using the mirrors. Operators have
expressed safety concerns.
2. Single front tire - flat tires are a problem. Mechanic has expressed
concerns with time required and also safety for
on -street repair.
3. Single seat center of cab - no bubble windows, tight space for
larger operators.
4. Hydraulic driven gutter brooms vs. mechanical - hydraulics cannot
equal the sheer power of the mechanical broom in
advance sweeping conditions. In heavy spring
clean up, hydraulic driven brooms can stall out,
causing heat build up in the system. Productivity
is affected, meaning delays in finishing the spring
clean up. Truck operators are waiting, which means
additional cost. Hydraulic driven brooms only have
4 -way protection anytime the broom is hit straight
on, arm does not move. Specifications called for
6 -way protection. (in /out, up /down, forward,rearward)
S. Main broom - is ten inches less length than requested. This would
equate to less street being swept and more passes
required to accomplish the job. Operators familiar
with this machine have indicated that l's hours are
required to exchange the Johnston broom vs. � hour
for the Elgin.
6. Uses a squeegee system; high speed and high wear item. Large bulky
items jam easily. Specifications indicated that the
squeegee system would not be acceptable.
7. Rear Dump: operator must first back -up to the receiving vehicle (while
watching through mirrors), control a dump cycle that
raises a hopper he cannot see, to a height of 18 ft.
Then he dumps a load he cannot see over the engine and
radiator compartment into a truck he see's by mirrors.
Tremendous liability risk! High center of gravity.
8. The Johnston machine is standard style chassis with hopper lift and
drive system assembled to it rather than the unitized
machine called for in the specifications.

9. 84 amp alternator vs. 105 amp called for in the specifications.
10. Warranty calls for full disclosure of parts and service availability.
• Vendor did not supply this information as called for in specifications.
Vendor(Crysteel) did indicate that they would only stock items such
as brooms) any other repair parts would come from their factory in
California. Customers have indicated a 1 week minimum ship time
involved. ,
11. If the unit is out of service for a period of more than 72 hours, vendor
must supply the City with a comparable unit at no cost to the City.
The vendor has indicated that they don't intend to stock a demo at
this time. Therefore, I am unclear as to how they intend to supply a
unit in the event of a breakdown.
In summary, the lower bids are not always the best buy. The City of Hutchinson
has eighteen years of satisfied service from its Elgin sweepers.

RE: Discussion of Potential Traffic Control Revisions
Over the past several months, several suggestions for revisions to existing traffic control have been
made. Steve Madson and I have reviewed several suggestions to improve safety, and Doff Moon
and I along with the Light Traffic Task Force have reviewed several suggestions for adding bike
routes. Please review the following ideas and let me know if you have any comments or questions.
BIKE ROUTES •
The current proposal is to add bike lanes along Roberts Road, 5th Avenue SE and Juul Road to
provide a high visibility route which would provide better access to the Schools and Roberts Park.
In particular the proposal is as follows:
Roberts Road (Dale Street to School Road)
Prohibit parking on the north side of the entire route. Add painted and signed bike routes
on both sides of the route. Parking on the south side would be allowed. This would allow
2 -5' bike lanes, I parking lane and 2 traffic lanes.
Roberts Road (School Road to Roberts Park}
Prohibit parking on both sides of the road to allow for bike/pedestrian lanes. Since the
road narrows west of School Road, there is not enough room to keep parking. The
abundance of side streets would shill provide for on- street parking for adjacent residents.
We may consider removing some trees and continuing a sidewalk on the south side of the
street to the park. Also, we recommend a pedeshian/bike crossing at the park entrance
with special signing, and potentially a speed hump or other traffic control structure.
5th Avenue SW /Juul Road
Prohibit parking on the south side of Jun! Road for an east -bound bike path, and on the
north side of 5th Avenue SW/Juergen Road for a west -bound bike path. The bike path
may continue to Park Elementary School utilizing Grove Street. This require special
City Centesl�lg or stop signs at Grove Street and 2nd Avenue. •

• TRAFFIC CONTROL /SAFETY
Suggestions have been made to increase the safety at several intersections, and on some street
routes. They include the following:
3rd Avenue SE
Consider making at least the block east of Main Street a one -way similar to 1 st Avenue
South. This intersection carries considerable traffic due to the Legion, Post Office and
other businesses, and continues to have a fairly high traffic accident rate. Creating a one-
way would allow easier access to post office boxes and also would allow the stop sign at
Hassan to be removed to allow better alternative routes to Main Street. However, our
main concern is to allow for the safe and efficient access to the Fire Station. We have not
been able to discuss this issue with the Fire Department and must verify that routing,
access and safety are fully considered.
Dale Street and 2nd Avenue Intersection
Currently only cast -bound 2nd Avenue is controlled (stop). This creates a situation in
which two perpendicular roadways are uncontrolled. Steve has suggested moving the
stop sign from 2nd Avenue to Dale Street. My concern is that Dale Street is a minor
arterial and a truck route, while 2nd Avenue west of Dale Street, is not a trunk route and
is minor collector. This type of signing may increase both the passenger and illegal
commercial traffic on 2nd Avenue SW and on Lewis Street. I believe that either a three-
way stop, or a design change would better serve the intersection.
South Grade Road (TH 15 to Dale Street)
As part of the proposed project that was removed from this year's improvement schedule,
we proposed to prohibit parking on both sides of this route and add a center turn-lane.
This would provide for safer access to the Civic Center/Recreation Center and Mall, and
would transition better into the proposed design at the intersection of TH 15. Since most
of this route is already posted as "No Parking ", this should have limited impact on the
adjacent properties.
Harrington and Sunset Streets
We continue to have a significant number of complaints regarding these two streets
adjacent to the Recreation Center and softball fields. The amount of traffic and the
number of cars parking along the route, often blocking mailboxes, has created the
majority of complaints. These concerns are increased by the abundance of young
children and parents at the site during events. We have discussed creating opposing one-
way routes (Harrington- north, Sunset - south) but realize that this would be an
inconvenience to adjacent residents. There may not be an easy answer for this, but we
felt it should be brought to your attention.
Alan Street
Alan Street continues to be utilized as a short cut for traffic between School Road and
• Roberts Road. Attached is a petition requesting that additional traffic control (stop
signs, speed humps or other measures) be installed to limit use of non -local traffic. The
Light Traffic Task Force has looked at this situation as one that may be addressed by .
these methods of "traffic calming ". We would propose to erect stop signs and a speed
hump as an experiment to see how this may work. We expect that this may move traffic
to Stoney Point Road and Boulder Street. These routes would be reviewed for additional
needs following study of changing traffic patterns. We are also planning on requesting
that the School District discontinue use of these streets as major bus routes. The amount
of bus traffic effects the safety in the area, and the damage to the street has been
significant.
Again, at this time I like consideration of which, if any, traffic control revisions need to be made.
We would like to do the striping and signing of the bike routes within the next few weeks.

Dear city Council Members,
This petition is presented to you to address the safety issue of a high traffic
volume on Alan street. Traffic speed and congestion create a dangerous
situation for pedestrians and bicycles. Due to our pro)dmity to the schools
children of all ages are present on the roadway throughout the day. As most
residential areas we also have a large percentage of small chril&en not in school
and their safety is also of concern.
We would like to see some traffic calming measures implemented to address the
concerns stated previously, (i.e. a three way stop on Lea/ Alan or speed humps).
We feel either or both of these measures would disway traffic primarily using Alan
as a short cut and thorough fare which accounts for the majority of traffic. Immediate
attention to this matter would be deeply appreciated.

South Grade Road (TH 15 to Dale Street)
Most of these routes are in notably poor repair. Some of the routes, Hayden and Osgood
Avenues, Harmony Lane and 5th Avenue NE in particular, are going to be fairly hard to maintain
due to the lack of solid bituminous. We have reviewed the potential for removing the bituminous
on several of these routes, but anticipated grading and dust problems make this proposal
undesirable. Based on our review, we expect to spend between $ 6,000 and $ 10,000 for extra
materials to maintain these streets until next year. We also expect to complete less street
maintenance on other routes due to the significant time required on these streets.
At this time, we are requesting that the Council authorize the Street Department to
purchase additional materials required to maintain the noted routes. In discussions with Gary
and Ken it was indicated that the Contingency Account was the most feasible source of funding.
We expect the costs to be in the neighborhood of S 8,000.

materials are for only a one year period. Within the general fund Council could •

RESOLUTION TO ACCEPT MNDOT LIMITED USE PERMIT FOR TREE
PLANTING ON HIGHWAY 7 EAST IN HUTCHINSON.
WHEREAS, in a continuing effort to reforest Hutchinson streets and
byways.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUTCHINSON, MINNESOTA:
The following limited use permit for tree planting on Highway 7 East (as
disclosed in the accompanying drawing and documents) within the Hutchinson
city limits, starting at Hutchinson Technology, Inc. and proceeding westward
along both south and north boulevards.
Adopted by the City Council this 10th day of May, 1994.

organization. Since we act on all gambling devices licenses for
renewal the 1st day of January, the V.F.W. Auxiliary is asking your
approval again in order that they may send a certified copy of the

for approval an agreement between the McLeod Cooperative Power Association and the City
of Hutchinson. A draft of this agreement was previously circulated to the Utilities Commission
and City Council members, but, in general, the only change is that the agreement will run until
January 1, 2000 rather than the 15 years originally specified.
The agreement also contains a requirement that parties taking out building permits pay the sum
to be paid to the MCPA for a territory acquisition. For single family residences, the fee will
be $800.00 and based on present power rates, that fee will be recovered by the homeowner
within three years. I will have the final form of the agreement to the City Council at or before
the meeting Tuesday night. I would ask for City Council approval Tuesdav ni4hh� �n that the
McLeod Cooperative Power Association can execute the a eement the fn11n1xjng Monda at
`t their regularly sche u ed meeting. I wl then Lsmiss the pending condemnation action.
I also bring to your attention the action of the Minnesota legislature in eliminating the "quick

The City Council will approve the agreement this coming Tuesday evening. I would like to
have a clean draft by the close of business on Monday so that if there any last minute changes,
we can take care of them and still have sufficient time to distribute copies to all council
members for their review prior to the Tuesday evening City Council meeting.
I would suggest additional language along the following lines, in accordance with my
correspondence to you of last week: ____
agreement is personal to the parties. The parties have entered into this agreement
as a result of special circumstances including a desire to promote cooperation between
the parties and to eliminate unnecessary litigation. The parties also recognize and
acknowledge that nothing in this agreement shall constitute an admission by the City
of Hutchinson that the city is required, under the 1974 agreement, to compensate any
entity for the acquisition of bare ground or that the City of Hutchinson, under this
agreement, is required to compensate any entity other than McLeod Cooperative PowSp
I believe that paragraph can replace most of the recitals.

This correspondence is for the purpose of updating you on the above entitled matter. First, I
am pleased to report that the Hutchinson Utilities Commission has unanimously recommended
for approval an agreement between the McLeod Cooperative Power Association and the City
of Hutchinson. A draft of this agreement was previously circulated to the Utilities Commission
and City Council members, but, in general, the only change is that the agreement will run until
January 1, 2000 rather than the 15 years originally specified.
The agreement also contains a requirement that parties taking out building permits pay the sum
to be paid to the MCPA for a territory acquisition. For single family residences, the fee will
be 5800.00 and based on present power rates, that fee will be recovered by the homeowner
within three years. I will have the final form of the agreement to the City Council at or before
the meeting Tuesday night. I would ask for City Council approval Tuesday night so that the
McLeod Cooperative Power Association can execute the agreement the following Monday at
their regularly scheduled meeting. I will then dismiss the pending condemnation action.
I also bring to your attention the action of the Minnesota legislature in eliminating the "quick
take" authority of a municipality. A copy of the legislation is enclosed and should be included
in the council packet as well. Please note that this legislation has no effect on our pending
action but will prevent the city from bringing such actions in the future. With the agreement
now in place, such actions become unnecessary until at least the year 2000.

MONTHLY CITY COUNCIL UPDATE
April, 1994
The Fire Department responded to 25 calls in April. A few of the
more interesting calls were:
- A cut in the railroad tracks on a curve which could
potentially cause a train derailment. Fortunately for us the
railroad ties caught fire and we noticed the tracks were cut.
• - The tennis shed at the high school burned causing about
$20,000 damage.
The Bruce Karl home was severely damaged from an unattended
stove causing $60,000 damage including all the clothes for
their upcoming wedding.
We responded to five grass fires, one of them cost the
property owner his garage and a ticket from the DNR for
burning without a permit.
- We assisted two other fire departments in April. Cosmos on a
house fire in Boon Lake Township and Glencoe on a possible
drowning.
DRILLS:
We had an Incident Command drill using fire simulators from the
Technical College. We also had a tour of both 3M plants. The
Hutchinson Fire Department met with other fire departments in our
region.
OTHER FIRE DEPARTMENT EVENTS:
• On April 17 we held a very successful fund raiser for the Brad and
Annie Paulson Family. We had help from many people outside the
department to make this fundraiser work. Over $10,000.00 was
raised!!
On April 23 we had our annual firefighters dance. This was the
first year we had it in the City of Hutchinson. The new
fairgrounds worked out well for us and we anticipate using a local
site again next vear.
. The Hutchinson Safety Council
The Hutchinson Safety Council met on Monday April 25, 1994
at 12:00 at the Heritage Center in Hutchinson, Mn.
There were 15 memners present.
President Duane Hoeschen presented the program on Emergency
Services including slides on chemical spills, tornados, flash
floods, fire, hail storms, training of personnel, county wide
response, skywatch program. He announced that the National
Weather Service is moving their tower from the Minneapolis
Air Port to Shakopee and this will not cover McLeod County.
Dave Conrad will have the June meeting program. This will
on bus and bus safety and school patrol.
Vi Viesselman attended the state safety meeting and will
give a report on this.
Craig Johnson attended a meeting at Pipestone on first
responders and motorcycle safety and gave a report on this.
The next meeting will be May 23, 1994 at the Heritage Center.

The State Demographer is required by law to produce annual population and household
estimates for each of Minnesota's cities. Enclosed you will find a sheet containing the
April 1, 1993, population and household estimates for your city. Please note that these
estimates pertain to one year ago, not the present. These estimates are subject to
change and are being sent to you now for review and comment. A copy of your
estimates has also been sent to your county auditor for review.
These estimates are no longer used to determine levy limits or local government aid. The
number of households is used to calculate an adjustment factor for the homestead and
agricultural credit aid (HACA). A loss of households will not have an adverse effect on
the HACA calculations for your city.
The enclosed figures represent estimated population and household changes since the
1990 Census. The number of households corresponds to the number of occupied
housing units. A household may be a single family, one person living alone, or any other
group of persons who share the same living quarters. While we believe that our
estimates are usually accurate, we realize there may be occasional problems. For this
reason, we value your comments. In particular, we may not be aware of changes caused
by annexations or detachments.
If you are satisfied with our estimates, it is not necessary to contact us or provide any
further information. If you wish to challenge our estimates, please send us the
appropriate documentation, as indicated in the enclosed guide, by Friday, May 27, 1994.

. HOW TO CHALLENGE THE POPULATION AND HOUSEHOLD ESTIMATES
FROM THE OFFICE OF STATE DEMOGRAPHER
The legal responsibilities of the Office of State Demographer with respect to local
population and household estimates dictate that we be able to defend any revisions of
the estimates. Consequently, we need some sort of written documentation for our files.
Cited below are types of information we will accept with a challenge to our estimates.
You may select whichever approach is most appropriate for your situation. However, the
more information you can provide the better.
1. An actual count of persons or households is acceptable, but places with more than
500 people should contact the State Demographer before proceeding with a count.
You should provide a list containing the address of each household, the name of
the householder and the number of persons in the household. A map of your city
or township would be helpful. Please be sure that only year -round residents have
been included. Young people away at college or in the military, elderly persons
who have moved to a nursing home in another town and seasonal (summer)
residents should not be counted. Please indicate when the count was conducted.
2. Another approach is to provide the number of housing units added and lost by
calendar year for the years 1990 through 1992. Building and demolition permits
are a good source of such information. Be sure to include mobile homes and
apartments, and indicate whether any of the apartments were for the elderly.
Please try to be as specific as possible about the type of unit involved (single -
family, apartment, mobile home, etc.).
3. You may also send us the number of active residential utility accounts in April
1990, April 1992 and April 1993. We would prefer electrical accounts, but water
and sewer is acceptable. Utility data are much more useful when provided
together with building permit data (see #2 above).
Any additional information you can provide about your community will be appreciated.
Changes in vacancy rates, the conversion of summer homes to year -round use, and
changes in employment opportunities are the types of things we like to hear about when
we are evaluating an estimate.
One final request. When you write us, please provide your address and a telephone
number where you can be reached during the day.
