REGULAR MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, NOVEMBER 22, 1994
1. The meeting was called to order at 7:30 P.M. by Mayor
Torgerson. Present were: Mayor Marlin Torgerson, Council
Members Bill Craig, John Mlinar, Kay Peterson, and Don
Erickson. Also present: City Administrator Gary D. Plotz,
City Engineer John Rodeberg, Building Official Jim Marka,
and City Attorney G. Barry Anderson.
2. In the absence of a pastor, there was no invocation.
PRESENTATION: The City Council was presented with a large plaque
by The Ambassadors and representatives of 15 community
organizations which contributed toward the cost of the four
"Welcome to Hutchinson" gateway signs.

Building Official Jim Marka presented background
information on item 4 -(g). During discussion, several
property owners in the residential neighborhood of
• Bethany Baptist Church spoke against the proposed use of
the building.
The motion to uphold the Planning Commission's
recommendation to deny the proposed use was made by
Council Member Craig, seconded by Council Member
Mlinar and unanimously carried.

(a) CONSIDERATION OF ENTERING INTO LEASE AGREEMENT WITH
MCNELLY GROUP FOR DEMONSTRATION COMPOSTING PROJECT
City Attorney Anderson reported on a few changes in the
contract with Jim McNelly. Following discussion, Council
Member Erickson moved to approve and enter into a
contract with the recommendation of changes by the legal
counsel. Motion seconded by Council Member Peterson and
unanimously carried.
(b) CONSIDERATION OF ESTABLISHING DATE FOR SPECIAL MEETING
FOR REVIEW OF 1995 BUDGET
Following discussion, Council Member Erickson moved to
set a meeting for reviewing the 1995 budget for December
6 following the Truth In Taxation hearing. Motion
seconded by Council Member Peterson and unanimously
carried.
(c) CONSIDERATION OF ESTABLISHING PUBLIC HEARING DATE .
CONCERNING LOCAL ADMISSIONS POLICY FOR PARK TOWERS
The motion to set a public hearing for December 13, 1994
at 8:00 P.M. was made by Council Member Erickson,
seconded by Council Member Peterson and unanimously
carried.
(d) CONSIDERATION OF PARKS /RECREATION /COMMUNITY EDUCATION
ADVISORY BOARD RECOMMENDATION TO INITIATE 1.59- CAPITAL
OUTLAY ACCOUNT IN 1995 PARKS /RECREATION BUDGET
Following a presentation by Director Dolf Moon and
Advisory Board Member Robert Hantge, the City Council
decided to take the capital outlay account under
consideration with other 1995 budgeting items for the
Parks and Recreation Department.
(e) CONSIDERATION OF PURCHASE OF PHARMACY AUTOMATED
MEDICATION SYSTEM FOR HUTCHINSON COMMUNITY HOSPITAL
Following discussion, the motion to approve the purchase
was made by Council Member Mlinar, seconded by Council
Member Erickson and unanimously carried.

(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
Administrator Plotz commented on the liquor store reports
and measurement system. Mr. Plotz also noted the three
customer service workshops already held and the two
forthcoming sessions. He stated the Steering Committee
will present a report to the City Council on the planning
process and other specifics.
(b) COMMUNICATIONS FROM CITY ATTORNEY
Attorney Anderson reported there were changes in the
Augusta Building Corporation development agreement.
Following discussion, the motion was made by Council
Member Mlinar to defer action to the December 6, 1994,
special City Council meeting. Motion seconded by Council
Member Peterson and unanimously carried.
The City Attorney addressed the issue of the cable
Telecommunications Commission meeting and the discussion
of the cable franchise renewal. He expressed the
• commission's frustration that they received little
cooperation in negotiating the franchise renewal.
Attorney Anderson stated there would be a meeting next
week with the consultant attorney. He commented that the
existing contract with Midwest Cablevision was extended
for six months to December 1, 1994, and recommended an
extension to January 15, 1995.
Following discussion, the motion to extend the cable
franchise to January 15, 1995 and to waive reading and
adopt Resolution No. 10350 was made by Council Member
Erickson. The motion was seconded by Council Member
Peterson and unanimously carried.
(c) COMMUNICATIONS FROM CITY ENGINEER
Engineer Rodeberg reported that the two properties
located at 1020 Hwy. 22 South (B & G Cartage & Warehouse)
and 1020 Hwy. 7 West (Steve Wadsworth) were connected to
the City sanitary sewer system by petition of the owners.
He stated the adoption of Assessment Roll No. 299 would
cover the improvement assessments of $5,000.00 each.
Following discussion, the motion to approve and waive the
hearing, to adopt Assessment Roll No. 299, and to waive
• readings and adopt Resolutions No. 10346, No. 10347 and
No. 10348 was made by Council Member Craig, seconded by

Council Member Erickson and unanimously carried.
The City Engineer invited the Council members to attend
a HATS Committee meeting at noon on December 7 in the
City Center. He commented that the architect will
present the plans and cost for the HATS facility.
It was reported that there was a hydraulic fluid spill at
the Otter Lake crossing which sprayed the fluid onto
several houses. The contractor failed to immediately
notify the City and other agencies of the accident, but
the City is working with various agencies to correct the
situation.
The City Engineer requested approval of the Hutchinson
Mall's parkland dedication payment of $1,000.00 and
dedication of a drainage easement for Augusta Homes.
The motion to approve the parkland dedication payment and
drainage easement for Augusta Homes was made by Council
Member Peterson, seconded by Council Member Erickson and
unanimously carried.
(d) COMMUNICATIONS FROM COUNCIL MEMBER JOHN MLINAR •
Council Member Mlinar commented on the Elks' celebration
of its 25th anniversary. The motion to adopt Resolution
of Appreciation No. 10349 for the Elks' continued
contribution to the community was made by Council Member
Mlinar, seconded by Council Member Erickson and
unanimously carried.
(e) COMMUNICATIONS FROM COUNCIL MEMBER BILL CRAIG
Council Member Craig mentioned the time spent on the
Bethany Baptist Church issue and pointed out that the
public process does work. The outcome was to protect the
rights of residential neighborhoods. Councilman Craig
commended everyone involved on their professional
behavior throughout the meetings and public hearings.

The meeting was called to order by Chairperson Myers at 5:35 p.m.
The Bill Movers video with comments on the Planetree model of medical care relating to patient - centered care
(discussed at the last month's meeting) was then shown.
Minutes of Past Meetings. Minutes of the September 20, 1994, regular board of directors meeting were presented.
Following discussion:
Motion was made by Murphy, seconded by Erickson, to approve the minutes of the
September 20 regular board meeting as presented. All were in favor. Motion carried.
Medical Staff Meeting Minutes. Murphy led discussion of the medical staff meeting minutes. He noted that
credentialing of a physical therapist and a CRNA was advanced with a recommendation to the governing board for
approval. The newly- reorganized medical staff s first official quarterly meeting was held during the past month and
was well received.
Old Business
A. Planning Retreat Recap. Robyn Erickson led discussion to recap the planning retreat held in September.
Copies of a presentation by Brian Osberg were distributed to those present, along with minutes of the Friday
morning portion of the retreat. Ideas and action plans, results of the retreat, were also discussed. She noted
that Phil Graves has at this point met a physician and the administrator of the Hutchinson Medical Center to
discuss achieving the goals. Myers and Slanga will also join that group in planning.
The following comments were heard:
O This retreat was different from those in the past in that past retreats have been used to identify goals.
y-a , -':, goals were already identified and the group then went about discussing barriers to
achieving the goals. The HMC participants seemed a bit hesitant at the change because they felt they
had little input in to the 1995 goals.

(A.) O This was an improved retreat due to more frank discussion with the physicians.
O This was the first time the physicians and HCH/BMNH agreed that a greater collaborative effort
needs to be made, which was a very positive approach-
0 Reaching consensus that all participants wanted a healthier community as a final result was very
positive. The Allina Healthy Communities 2000 initiative should fit well in our plans.
O The smaller groups were appreciated and provided good exchange. Positive remarks were heard,
which was an encouragement. It was obvious that some of the newer physicians had different ideas,
and the frank exchange was exceptional.
New Business:
A. Medical Staff Appointments. The recommendation from the medical staff executive committee to grant
practitioner privileges was then reviewed. Following discussion:
Motion was made by Black, seconded by Slanga, to grant privileges
according to their applications for the following practitioners:
O Carol Freeman, Physical Therapist, allied health staff (provisional); and
O Don Shaffer, CRNA, allied health staff (provisional).
All were in favor. Motion carried.
B. Request to Bid Pharmacy Medication System. A request to bid a new medication dispensing system for
pharmacy services was presented. Efficiencies were discussed. An improved system will save pharmacy
staff time and nursing time as well due to automated features.
The payback of 1.1 years was discussed. There will be additional savings for recovery of lost charges and
supplies now being missed. An ongoing analysis of inventories was called a great improvement over the
current manual inventory system. Slanga suggested that this be interfaced with the patient billing process, as
well. Tusa identified that this may potentially interface into an order entry system that we are considering for
the next fiscal year.
Following discussion:
Motion was made by Erickson, seconded by Mills, to approve the bidding
process. All were in favor. Motion carried.
C. Feedback on Winsted Clinic. Question was asked whether the Winsted clinic is going well. Comments from
an HCH/BMNH employee working on the remodeling project there were shared, stating he's seeing a steady
flow of people.
D. Other:
A. Healthcare Seminar. Robyn Erickson distributed a handout on a healthcare seminar being held in
November. Two members of the board attended a similar seminar last year. She asked board
members to call the executive secretary if interested in attending. •

Senior Care Report. Richards shared the following items of information.
A. Nurse Call System Operational. The nurse call system approved by the board in June is now fully installed,
as of today. All rooms have added audible call, and all rooms are on the system. Improved communication
and prioritizing calls are great advantages with this system to help get staff where they need to be.
B. Concrete Work. Concrete work at the nursing home has been completed. As this was a non - budgeted item,
safety issues were addressed at this time but repaired sections were not totally replaced.
C. End of Staffing Crunch. The nursing home staffing crunch is over. Expenses were up last month with
orientation of new employees replacing college students who returned to school in September.
D. Assisted Living. The board will be updated next month on possible land acquisitions for the assisted living
facility being planned for a portion of the BMNH campus.
Abbott Northwestern Report. As the Abbott Northwestern Board meeting is next week Myers did not report but
introduced Paul Bauer, regional vice president of planning and marketing, who presented his report for Allina.
Allina Report. Bauer reported on the following items of interest:
A. The health plan group is having a banner year, enrolling more than 15% enrollment growth for Medica plans.
B. Regarding community, health, he noted that Jan Malcolm (formerly of Health Partners) will head up the
community health group.
C. Focus group surveys were recently held in Hutchinson and other communities. Testing was done for primary
r focus to achieve provider integration, and people in the group settings told them that providers are already
integrated and they hope this continues. Regarding hassle and inconvenience, general feedback was that our
area's health care delivery system works pretty well; even though access can be difficult at times,
appointments can be made (a surprise to the surveyors). Another thing they learned was that 30% of
consumers had visited with a chiropractor within the last year. From a cost perspective, consumers are
concerned about cost, but their primary concern about Allina is that the concept of integration not mean
restricted access or loss of control. Primary criteria forwarded by experts in the field is choice; gatekeeper or
capitation concepts are seen as other words for restricted choice. The West Central market, including
Litchfield, Hutchinson, and Buffalo, overlaps in services by area providers. Market surveys were done
within the last 90 days and will be presented to local providers in mid- November.
Accounts Payable. The accounts payable listing for September was presented. Following discussion:
Motion was made by Mills, seconded by Erickson, to approve for payment the attached listing of accounts
payable and cash disbursements in the amount of $938,182.56. All were in favor. Motion carried.
Statistical Report. Tusa presented the statistical report for September. The organization saw fairly strong volumes,
including admissions of 202 and average daily census of 26. Census days were 781, and the average length of stay
was 3.6 days. The nursing home had 98.% occupancy and a case mix of 2.32, compared to a budget of 2.35. Other
hospital services showing increases from the previous month were newborns, laboratory tests, respiratory care,
physical therapy, ambulance and outpatient visits.

Financial Statements. The organization realized again of $83,115 for the month, against a budget of $106,784.
The statement of cash flows and a summary of investments for the first nine months of 1994 were discussed. A
graph was also shown that compared net income to budged income for 1994. Question was asked on claims
experience for the organization's workers' compensation self - insurance fund. It was explained that the City's
insurance consultants advised the organization to increase that fund up to $600,000 from $400,000 to ensure those
funds are available for a catastrophic occurrence. Stop -loss coverage is also carried by the organization. Richards
relayed that the State also has a workers' compensation fund into which everyone paying premiums within the State
contribute a certain percent of payroll dollars.
Auxiliary Meeting Minutes. The Auxiliary meeting minutes were presented. No unusual comments were made.
Adiournment. The meeting was adjourned at 6:50 p.m. by Chairperson Myers.

MINUTES
Monday, November 21, 1994
6:20 p.m.
Members present: Leslie Smith, Lucille Smith, Ed Doring, Mary Ann Kasich and Brian
Bonte.
Also present: Linda Madson (runners subcommittee) and Lee Brady.
I. RESIGNATIONS
Chair Mary Ann Kasich read a letter from Brad Burich stating he is resigning from the
task force and she also reported her conversation with Carolyn Pohlen who also in
resigning from the task force but will help on a subcommittee.
II. BROCHURES - HOW TO IMPROVE FOR HANDOUT
Mary Ann handed out a draft brochure explaining the Hutchinson Project. There was
discussion on what information should be placed in the brochure to motivate the public
• interested in biking, running, walking, etc. Les Smith commented the MN State Safety
Council brochures could be used as an example. The group agreed there should be room
for name, address, phone number and what area the participant is interested in on the
brochure. This could be handed out to walkers at the Recreation Center, meetings of
organizations in Hutchinson, on the Luce Line trail, etc.

III. HOW TO IDENTIFY POTENTIAL MEMBERS FOR SUBCOMMITTEES.
Many ideas were discussed to help identify potential members to be on the
subcommittees. These were: brochures, Bike Club, bike shop, ad in paper, Sr. Center,
Rec Center, brainstorm other ideas in the groups.

HUTCHINSON HANDICAP ADVISORY COMMITTEE
October 27, 1994

Call to Order
Building Official Jim Marka called the meeting to order. In attendance were Jim Marka, Carolyn
Pohlen, Scott Johnson, Don Todnem, Brenda Ewing and Bonnie Baumetz, Secretary.
1. Jim Marka commented on materials Wilma Ross compiled for education in the schools.
He will forward that information to Ms. Rachel Torgerson, Counselor at theHigh School,
for use in the district.
2. City Attorney G. Barry Anderson was present to explain the Minnesota laws regarding
citizen volunteers for enforcement of handicap parking violations.
Mr. Anderson commented on liability concerns and training of volunteers. He stated an
ordinance must be adopted to set up the program. Volunteers must be selected and
trained appropriately.
Discussion followed on fines and the amount for parking violations. There was also
discussion concerning the use of private medical permit signs as used by H.T.I. and 3M
as opposed to State handicap signs.
Mr. Anderson explained that private property enforcement for parking is not done unless
there is a problem. He stated Willmar is aggressive in enforcing the parking laws.
3. Don Todnem stated he showed the video to Vi Meyer, Chamber of Commerce Director.
4. Discussion followed on the civic arena ramps from the front door. Jim stated ped ramps
will be included in the improvements next year.

Cary Linder of Hutchinson Telephone Co. presented information
on Internet. Discussion and questions followed. He may be

Larry Ladd presented the diagram of the proposed sign to be placed
on the West side of the Library, near Main Street, identifying
the Public Library. The information will be given to D. Moon,
Park and Rec., and then it will come back to the board for approval.
Viking Signs will do the lettering.
Motion was made and passed to approve a SAMMIE grant for $200
toward the purchase of a FAK.(Kay Peterson -Joyce Beytien)
The Friends of the Library also approved $800 toward this
purchase. Mary is looking at costs,companies, and questions
on FAX usage /cost.
Mary informed the board of Barb Whittenjerg's retirement
effective December 31.
Dolores presented a short overview on PLS's automation project
which has established a three year 'rough draft'.

RE OFFENSIVE BEHAVIOR POLICY
Recently, City employees received training at a workshop on
Sexual Harassment.
Attorney Tim Pawlenti, who conducted the workshop, recommended
that the City adopt an Offensive Behavior policy, which is more
comprehensive than the Sexual Harassment policy that the council
approved several years ago.
Resolution No. 10351, Offensive Behavior Policy, is attached for
adoption, based on that recommendation. This will be distributed
to employees to replace the old policy.

OFFENSIVE BEHAVIOR POLICY
It is the policy of the City of Hutchinson to maintain a working
environment free from offensive or degrading remarks or conduct. Such
behavior includes inappropriate remarks about or conduct related to the
employee's race, color, creed, religion, national origin, sex, marital status, sexual
orientation, disability, age, status with regard to public assistance, membership
or activity in a local commission dealing with discrimination. Offensive
behavior prohibited by this policy also includes requests to engage in illegal,
immoral or unethical conduct or retaliation against a person who makes a
complaint.
One specific kind of illegal behavior is sexual harassment. Sexual
harassment, which can consist of a wide range of unwanted sexually directed
• behavior, is defined as
Unwelcome sexual advances, requests for sexual favors and other verbal
or physical conduct of a sexual nature when:
•
1 Submission to such conduct is made either explicitly or implicitly a
term or condition of an individual's employment;
2 Submission to or re jection of such conduct by an individual is used
as the basis for employment decisions affecting such individual; or
3 Such conduct has the purpose or result of unreasonably interfering
with an individual's work performance or creating an intimidating,
hostile or offensive work environment.
Any person who feels he or she is being subjected to offensive behavior of
any kind should feel free to object to the behavior and should also report the
behavior to either the supervisor in charge or the human resources
coordinator.
It is not necessary for any employee who feels that he or she is the
subject of offensive behavior to handle it himself /herself. If an employee feels
harassed or offended by another employee, by a customer /client or any other
person whom he or she encounters in the course of employment, whether the
opposite sex or same sex, and does not feel able to deal with the problem
directly, the employee should go directly to the human resources coordinator or
the city administrator. Additionally, any supervisor who receives an offensive
behavior complaint or believes offensive behavior is occurring shall report the
behavior to the director in charge, the human resources coordinator or the city
administrator.
All allegations of offensive behavior will be investigated promptly, fairly
and completely. The facts shall determine the response to each complaint.
Depending upon the seriousness of the violation, remedial action may range
from an apology, counselling, transfer, verbal or written warning, suspension
with or without pay or termination. Each situation will be handled discreetly. is
In the event that the offensive behavior reoccurs or if any retaliation results, it
should immediately be reported to any of the persons named above.
Employees should understand that this policy applies to each and every
member and employee of the City of Hutchinson, including the City Council,
boards and commissions, directors and supervisors, and all full-time, part-time
and temporary employees. No retaliation or intimidation directed towards
anyone who makes a complaint will be tolerated.

CITY CODE SECTION 10.08 "ANTENNAS AND TOWERS" AND ADOPTING BY
REFEREIJCE, CITY CODE CHAPTER 1 AND SECTION 2.99 WHICH, AMONG OTHER
THINGS, CONTAIN PENALTY PROVISIONS.
THE CITY OF HUTCHINSON ORDAINS:
Section 1. City Code, Sec. 10.08 is hereby amended by
substituting the following language, in its entirety, for existing
City Code Sec. 10.08:
SEC. 10.08 ANTENNAS AND TOWERS
Subd. 1. Antennas and Dish -Type Antennas Having a
Diameter No Greater than 30 Inches. Antennas and towers having
over -all heights of 75 feet or less are a Permitted Use in all
Districts and are permitted encroachments on height requirements of
this Code. This includes towers of all types and antennas of all
types and sizes except dish - shaped antennas having a diameter
greater than 30 inches. Antennas and dish - shaped antennas having
• diameter of 30 inches or less are exempt from any requirement for
• building permit, but are subject to excavation permit
• requirements when applicable. Antennas and towers higher than 75
feet require a conditional use permit.
a. Vertical Antennas. The bottom of the base of
a mast -or tower - mounted vertical antenna may
be at a height of 75 feet or less with no
over -all height limit for the tope of the
antenna. The highest point of any ground-
mounted vertical antenna, however, may be no
more than 75 feet.
b. Directional Satellite Communications Antennas.
The point at which the main boom of a
directional, non - dish -type satellite
communications antenna or antenna array is
attached to its support structure (tower,
mast, rotator, etc.) can be no more than 75
feet high. The uppermost parts) of such
antenna(s) can be at 100 feet.
c. Height. The height of an antenna, dish
antenna, or tower shall be measured from the
adjacent ground elevation at the base of the
antenna, dish, or tower to the highest point
of the antenna or tower. If the antenna or
tower is mounted on a building, height is
measured from the average grade level on which
the building is constructed.

d. Definitions.
. An antenna is a wire or other device that •
receives or transmits radio waves.
. A tower is defined as a structure to which
an antenna is attached.
. A directional satellite communications
antenna is defined as any directional antenna
or antenna array designed to provide radio
communications using satellites, manned or
unmanned spacecraft, moonbounce, tropo-
scatter, meteor -trail ionization, or similar
vehicles or propagation modes.
Subd. 2. installation Requirements. An excavation
permit is required for all towers and antennas for which excavation
is required. All antennas and towers must conform to the Uniform
Building Code, the National Electric Code, the City /County Airport
Zoning Ordinance, and the regulations of the Federal Airways
Administration (FAA) and Federal Communications Commission (FCC) .
Antennas or towers may be installed in utility easements if a
waiver is obtained from the City Engineer and the Hutchinson
Utilities Commission.
Subd. 3. Tower Locations. Antennas and towers shall not
be allowed (1) nearer the street than the principal building on the .
lot; and (2) nearer the rear or side lot lines than the minimum
rear or side yard setback. Wire antennas are exempt from this
requirement.
Subd. 4. Encroachment. No part of an antenna may extend
beyond the lot line over an adjoining lot without written
permission from the owner or lessee of that adjoining lot.
Subd. 5. Reservations. The City reserves the right to
permit antennas, in its sole discretion, on the tope of water

WHEREAS, Robert Cowger and Sally Cowger have filed a petition dated September 23, 1994, requesting that
certain land, as legally described below:
That part of the Southwest Quarter of Section 2, Township 116 North, Range 30 West of the 5th
Principal Meridian described as follows:
Beginning at the southwest corner of said Southwest Quarter; thence northerly, along the west
line of said Southwest Quarter, a distance of 1760.00 feet; thence easterly, deflecting to the right

• Mr. Ting -Ying Zheng plans to open a Chinese restaurant in the old hardware store site at
Plaza 15. Since they will be doing remodeling in the facility, the restaurant will not open
for approximately two months. As you will note from the release of information form, Mr.
Zheng operates a Chinese restaurant in Brookings, SD.
If you can have the investigation finished by the next Council meeting, I will schedule the
application for the Council agenda of November 22, 1994.

Intoxicating Malt Liquor for King's Wok

On November 29, 1994, I concluded the investigation on applicant
Ting -Ping Zheng, DOB/03- 22 -67, applying for an on -sale non
intoxicating malt liquor license for King's Wok. Address of the
restaurant is going to be Plaza 15 Shopping Center Bay 5A.
As part of the investigation, all of the normal procedures were
conducted. A check of his previous business, located at Brookings,
South Dakota, was completed through the Chamber of Commerce, who
has received no complaints. I was informed by the Chamber Office
that King's Wok had opened in Brookings in March of 1984. Since
that time there have been no complaints received by the Chamber.
I also contacted the Brookings Police Department and spoke with
Investigator Gale Hillbred. Investigator Hillbred informed me he
knew of the restaurant and had been at the restaurant in the last
few weeks. In a review of their office records, he could not find
any - calls -to the restaurant, indicating to him that there was not
a problem with the establishment. In checking with the Sales Tax
Division of South Dakota, located in Watertown, I was informed that
all tax revenues have been paid in a timely fashion. In the State
of South Dakota, restaurants are inspected by a Environmental
Health Inspector. I inquired of Gene Gilbert, the Environmental
Inspector for Brookings, if they have had any problems associated
with the King's Wok Restaurant. Mr. Gilbert stated that they have
not received any complaints and the restaurant has passed
inspection when it was inspected.
Checks were conducted through the Minnesota Bureau of Criminal
Apprehension and the State Bureau of Apprehension in South Dakota
for any criminal activities with the restaurant King's Wok and the
name Ting -Ying Zheng. There was no criminal activity associated
with either name.
Based on this information, it would be my recommendation to the
- Council to grant a non intoxicating license to Mr. Zheng.

on an annual basis, your community provides space for a congregate meal
program for seniors. This program is operated by Heartland Community Action
Agency but is funded by the Older Americans Act which is administered by the
Mid - Minnesota Development Commission (also known as the Area Agency on
Aging). On October 26, 1994, this agency was notified by the Heartland
Community Action Agency that it may decide to not deliver the meals program
as of January 1, 1995.
As a result of that notification, we are in the process of holding
discussions with other potential providers of meal services. Hopefully all
of this will be settled at a meeting on November 30. Our goal is to continue
the congregate meal program uninterrupted at the same sites during 1995.
I believe you have an annual agreement with the Heartland CAA for the use of
your facility for congregate dining for seniors. At this time, I don't know
if Heartland CAA or some other agency will be providing the meal service in
1995. Please look at the agreement for use of your space and advise me as to
whether or not you can continue to provide congregate meal space regardless
of who is providing the congregate meal service. Any new agreements should
probably be written in a way that refers to the use of the space by an agency
that is delivering the congregate meal program for the elderly. This would
tie the lease to the program and not an individual agency.

LEASE AGREEMENT
THIS AGREEMENT, signed and ,dated below, specifies the terms and conditions as
agreed by the City of Hutchinson (Lessor) and Heartland Community Action
Agency Senior Dining Program (Lessee) for Lessee to use the premises described
as: Hutchinson Senior Center, 115 Jefferson Street, Hutchinson, MN 55350.
BOTH PARTIES AGREE AS FOLLOMSs
TERM
This lease shall be in effect for the calendar year 1995 and renewable
annually thereafter until either party provides 60 days written notice of
intent to terminate.
REIMBURSEMENT
The quarterly payments of $985.50 dollars each shall be paid to the Lessor for
reimbursement of utility and maintenance expenses directly associated with
Lessee's use of the premises. This amount shall be reduced in any month on a
prorated basis if the Lessee's use is terminated or less than the usage at the
beginning of the term.
USE OF PREMISES
Lessee shall have the right to use the kitchen from 5:00 AM to 2:00 PM, and
dining room from 10:00 AM to 1:00 PM or reasonable time of completion daily,
Monday through Friday, to provide meals and social services to senior
citizens.
In the event the Lessor must unavoidably use the premises during these hours
the Lessee shall be notified two weeks in advance and provided with an
acceptable alternate option or receive a prorated credit toward reimbursement
owed Lessor.
REPAIR /MAINTENANCENTILITIES
Lessor agrees to maintain the premises including sidewalks and parking lots in
good order to insure safe, sanitary, and habitable occupancy by Lessee.
Lessor agrees to maintain all Lessor owned equipment and fixtures included in
the leased premises in safe and good working order. Lessor agrees to maintain
all structural components (including but not limited to: mechanical,
plumbing, electrical, all surfaces including glass, etc.) in safe and good
condition. All such repair and maintenance is at Lessor's expense.
The Lessor will be responsible for major housekeeping chores, (i.e. cleaning
bathrooms, cleaning carpet, washing windows, and shoveling snow.) The Lessee
will conduct daily light housekeeping.
Utility payments to the vendors shall be the responsibility of the Lessor.
LESSEE PROPERTY
All goods, foodstuffs, fixtures, equipment and personal property of the Lessee
shall remain the property of and reserved for the Lessee at all times. Any
damage /disappearance mysterious or otherwise, during the Lessor's use of the
premises shall be the Lessor's responsibility to reimburse Heartland Community
Action Agency for replacement cost.
LESSOR PROVIDED TRADE FIXTURES
The Lessor shall provide refrigeration, oven, washing and storage fixtures as-
well-as place settings, tables and chairs, and cleaning utensils for meal site
operation at the level described in "special conditions ". This property
remains the Lessor's if provided at the Lessor's expense.

• INSURANCE
The Lessee agrees to carry personal property insurance to cover all its
contents and personal property on the leased premises.
SA SIGNS
The terms and agreements of this lease shall extend to and bind the heirs,
assigns, and executors of both parties.
FOOD LICENSE
The Lessee will maintain a Minnesota Food License for Program operations only.
The Lessor is responsible to ensure that any other food preparation activities
in the facility are in compliance with Minnesota State Law.
SPECIAL CONDITIONS:
A. The Lessor will maintain telephone service for program use only.
The lessee will pay for long distance telephone calls made by
program staff.
B. The Lessor will provide adequate place settings and other trade
fixtures for an average meal service capacity of 80 persons.

POSITION: Assistant City Attorney
QUALIFICATIONS: Applicant must hold a degree from an accredited law school and must
be licensed by the Supreme Court to practice law.
EXPERIENCE: No direct prosecution experience is required but at least minimal exposure to

SALARY RANGE: $27,500 to $40,000
RESPONSIBILITIES:

3. Applicant will also assist in the handling of victims assistance programs.
4. Applicant will, at all times, be under the supervision and direction of the City
Attorney. All major assignments, other than routine prosecutorial duties, shall
first be referred to the City Attorney for review and consideration and a
determination as to whether or not the assignment should be given to the
Assistant City Attorney, handled by the City Attorney or otherwise dealt with.
5. The performance of the Assistant City Attorney shall be reviewed by the City
Attorney who shall report his findings to the City Council or otherwise as
directed by the City Council. Prior to conducting a performance review, the
City Attorney shall consult with the Chief of Police and the City Administrator
as to the performance of the Assistant City Attorney.
6 The Assistant City Attorney shall be responsible for such additional civil but
municipal matters as may be assigned to the Assistant City Attorney by the City
Attorney, based on time available to perform these additional duties consistent

with the principal responsibilities of the Assistant City Attorney as described •

7. The Assistant City Attorney shall be subject to all of the rules and regulations
of the City of Hutchinson and shall comply with the directives of the City
Administrator relating to administrative matters.
8. The job description for the position will change from time to time depending
upon the circumstances and the applicant is required to be flexible in terms of
the specific duties assigned to the Assistant City Attorney.

This correspondence is a followup to our discussions at a workshop approximately a month ago
regarding the above referenced position. I was directed by the City Council to give some
additional consideration to the proposal and to return with a revised analysis and whatever
additional suggestions seemed appropriate.
In the course of the last month, I have met with you, Police Chief Steve Madson, various city
officials as well as least one council member to discuss the proposal. I have also taken into
account the comments that council member Milnar and council member Craig made during the
course of the workshop.
My recommendation is that the city add Gina Brandt, presently the Assistant City Attorney
employed by Arnold & McDowell, to the municipal staff to perform the duties outlined on the
attached job description. It is my conclusion that no other formulation will address all of the
concerns and needs of the city.
Since we last discussed this topic, our office has been advised of an additional requirement
imposed on municipal attorneys in McLeod County. Presently, tickets issued by law
enforcement agencies within the City of Hutchinson are filed with the District Court
Administrator and copies are sent to prosecuting agencies when a defendant pleads not guilty
and t'rr.;;::.ds a cour? appearance. McLeod County will no longer be providing this service and
will instead be requiring the prosecuting agency to make the photocopies at the courthouse.
While the inconvenience is not all that significant, it simply illustrates the earlier point that I
. made regarding the ability of the court system to impose additional requirements without regard
to the fact that prosecution services are provided by an attorney under private contract.

Two concerns were raised at our last meeting, one having to do with supervision and direction
and the second having to do with financial issues.
As to the supervision and direction issues, the attached job description makes it clear that the
first set of responsibilities assigned to the Assistant City Attorney deals solely with police
department and prosecution matters. I thought the comments in that regard were well
considered and I have incorporated them into the job description.
The second set of issues, raised by council member Milnar, has to do with financial concerns.
Originally, the concept of this proposal was that the city would provide secretarial services as
well. After due consideration, I have modified the proposal so that the suggestion now is that
our office would continue to provide secretarial services (in terms of preparing complaints and
other associated paperwork) but that the city would provide office space and, of course,
telephone receptionist services. Additionally, the law firm would agree to cover the employee
for legal malpractice purposes for at least calendar year 1995.
I would propose that the civil contract for the City of Hutchinson be kept at its present level
for calendar year 1995. The balance of the proposed budget for 1995 would be retained by
the city for the purpose of adding this employee. Setting aside the nonrecurring capital
improvement costs, (and office space issues), I would estimate the additional cost to the city
of this proposal in calendar year 1995 would be approximately $6,000 to $7,000 over and
above the 1995 total budgeted amount.
Originally, it was my thought that we could consider this concept at this evening's meeting.
I am still willing to do this, and it is on that basis that I am sending this transmittal to you via
fax. However, depending upon the status of budget considerations, it might be more
appropriate to defer consideration to the December 13 meeting. I leave this to your discretion
and the discretion of the City Council.

After reviewing the results of the Bids with the Police Department, the
consensus was to accept the Bid from Superior Ford for $34,830.00 with no
trade -ins.
Recommendation is based on the fact that Superior Ford was low bidder by
$166.00, and while this alone would not constitute purchasing out of town,
in addition to being low bidder they (Superior Ford) included the cost of
Graphics and installation at $250.00 per vehicle, for a total of $500.00.
The savings would now be in the neighborhood of $700_00, and we feel this
does warrant purchasing out of town. In the event the Council decides to
purchase in town, the next lowest bidder would be Plowman Ford for $34,996.00.
After further review of the Police Department Vehicle Fleet, the consensus
was to upgrade the Fleet at this time by retaining the 1993 vehicles as re-
placements for older and higher mileage units presently in the Fleet.
The vehicles that are being replaced will be held over for Auction at a
later date or sold outright by sealed bid.
The vehicles being purchased were included in the 1995 Motor Pool Budget.
The City will not take possession of these vehicles until after January 1, 1995.

The Hutchinson Community Development Corporation took a posi on early in 1994 that we would work
with HRA to eventually transfer the housing related loan programs jo HRA. The purpose for this is to
place housing related programs and issues under one administratio . That administration, at the present
time, seems to be most appropriately HRA.
At the November 18, 1994 meeting of HCDC the Board of Directo voted to recomment to the City
Council that all appropriate housing programs be placed under the aXministration of HRA. It is with this
motion and the willingness of HRA to assume the responsibility that CDC requests City Council
authorization to transfer the responsibility effective January 1, 1975.
The specific loan programs to be transfered are the Small Cities Housing Rehab. loans. The Rental
Rehab. loans are proposed to stay with HCDC because these loans are for commercial buildings in the
downtown area and relate more closely to the Commercial Loans that HCDC will continue to administer.

The committee for the selection of an audit firm for 1994 will not
be completed until Monday evening. The committee has received and
reviewed a total of 10 proposals in response to the RFP for
auditing services.
The committee has selected 3 firms to interview. Two of the firms
were interviewed on Thursday and the final candidate was not
available until Monday afternoon. The committee expects to reach
agreement and be able to make a recommendation for Tuesday evening.

The committee composed of Marlin Torgerson, Kay Peterson,Gary
Plotz, Glen Matejka, Phil Graves, Ed Tusa, and myself reviewed 10
responses to our request for proposal for audit services. The
committee selected 3 firms to interview.
Monday evening the committee concluded the interview process. The
three firms interview were Eide Helmeke & Co.; Malloy Montague
Karnowski Radosevich & Co.; and Abdo Abdo and Eick. The committee
asked for a review of references which was completed today without
any negative responses.
It is therefore the unanimous decision of the committee to
recommend to the Hutchinson City Council the firm of Abdo Abdo and
Eick. The proposal is for 3 years with bids of $14,885, 15,365,
and $15,845 for each of the years.

Attached is all the related information regarding the above referenced deferred assessment. As
previously discussed with the Council, the facts as I know them are as follows:
. 1. The watermain and sanitary sewer were constructed in 1968. We have no record
of an Assessment Roll including this project, nor is there a record we can find
regarding a public hearing.
2. The City's first assessment occurred in 1961, with several sporadic assessments
between then and 1969. Assessments started for most projects in or near 1969.
Hearing notes and assessment rolls are available for most of these projects.
3. An assessment search for this property completed in 1977 made no reference to
any deferred assessments.
4. In 1987, former City Engineer Marlow Priebe completed a "Deferred Assessment
Manual" that detailed assessments that he noted as being deferred against

properties inside and outside of the City. The City has since that point being
noting these on Assessment Searches, although some conflict has arisen in the
past (i.e. Fairgrounds Property, Augusta Homes, Wal -Mart, etc.). We have been
adding interest to these in the past, although the interest has been waived in some
cases.
5. An assessment search completed on October 3, 1994 by our staff included the
irrcd assessments, including interest, from Marlow's report ($1,680.06 for each
lot).

When we discussed this issue previously, it was noted that we have activated previous
assessments in this project earlier, and many more deferred assessments are noted for this
project, along the entire length of 3rd Avenue NW. We do have an ordinance in the Municipal
Code that allows the City to assess a 'connection fee" of $2,500 for water service and $2,500 for
sanitary sewer service if no previous assessment was made. This ordinance would apply in this
case. As noted above, this charge would be well in excess of the deferred assessment paid.
My concern is that the "deferred" assessment, and the sanitary sewer and watermain, are almost
30 years old. However, we must consider that a precedence will be set, and that there is certainly
a benefit to the property from the sewer and water that exceeds the value of the assessment.
Based on my review, I would recommend assessing a connection fee, as noted above and in
the Municipal Code, or accept the "deferred" assessment that has been paid (which is several
hundred dollars less) as full payment for benefits received

status report noting how the final Federal State and local costs break down. I hope to have a copy
of this document to hand out on Tuesday.

Dear Mr. Rodeberg:
As previously discussed, we are enclosing two partially executed copies of Supplemental •
Agreement No. 4 for the above- referenced project.
The existing Agreement for Professional Services, which includes Supplemental Agreements 1, 2,
and 3, provides for Resident Engineering services for up to 28 weeks. This project was intended
for completion in a single construction season but rainy weather, combined with existing clay
soils, extended the work for ant additional season. TKDA provided resident inspection services for
a total of 42 weeks.
The cost of the additional 14 weeks of resident engineering and the associated project
administration from our St. Paul office would be approximately $51,000, based on the typical
effort during the construction period. TKDA used all available methods to limit the engineering
costs, including rental of a laser -level in lieu of additional personnel. We also elected not to
provide on -site staff during periods when the construction operations were limited and the quality
of construction and airfield safety would not be compromised. As a result, the supplemental
agreement has been prepared using a not -to -exceed amount of $34,500, based on the costs already
incurred and the anticipated effort to complete the project through final payment to the Contractor,
as described in Pan B, Construction Phase Basic Services, of Supplemental Agreement No. 3.
Billings for this work would, as before, be based on the actual hours required.
FAA requires an independent estimate of engineering costs prior to entering into such an
agreement. You can perform this analysis, or have one performed for you. Costs associated with
this independent review, as well as the cost of the additional engineering services provided in the
supplemental agreement, are eligible for federal reimbursement. is

Jaffray Plaza, 444 Cedar Street, St. Paul, Minnesota 55101, hereinafter referred to as the
CONSULTANT.
WITNESSETH:
WHEREAS, the OWNER previously engaged the CONSULTANT to provide
architectural, engineering and/or other Professional Services in connection with 1992
AIRPORT EXPANSION at the Hutchinson Municipal Airport, hereinafter referred to as
the Project, which engagement was formalized in a Professional Services Agreement dated
the 9th day of April 1992, and Supplemental Agreement No. 1 dated April 28, 1992,
Supplemental Agreement No. 2 dated July 28, 1992, and Supplemental Agreement No. 3
dated February 9, 1993, all referred to hereinafter as the Agreement,
AND WHEREAS, the Agreement provided for Design, Construction and Post -
Construction Services,
AND WHEREAS, a change in the scope of work is now needed for completion of the
Project,
NOW, THEREFORE, the OWNER and CONSULTANT, for the consideration hereinafter
named, agree to amend the Agreement by and through this Supplemental Agreement No. 4
as hereinafter stated.
The purpose of this Supplemental Agreement No. 4 is to provide for basic and special f
construction phase engineering services during the extended Project construction period.

We were approached by 1\ like Schall of First Federal regarding the proper at 995 Jefferson Street
(Lot 6 of Lot G Subdivision). Apparunih the property ow7rers noted alter the property was purchased
that the house itself sits partiall} - on top of a storm sewer easement. Since we need access to the area
. for maintenance of the system, we feel that we can not vacate the easement. However, upon review
with Cih Attorney Anderson, we recommend approving a license that would allow the property to
overlap onto the easement with the following conditions:
1. No additional encroachment would be allowed.
2. The license would expire if the properh was removed or destroyed. New construction on the
site must not encroach on the property.
We may want to include a condition that would allow reconstruction of partially damaged structure,
so as not to require total reconstruction if the damage is limited. This limit may be 50110 of the
assessed value of the house.
Based on the above recommendations. we recommend approval of the aforementioned
License,

MEMO
Each December we have looked at investing part of the funds of
. the city into longer term securities. The city policy we are
following is to invest in certificates of deposit with our city
institutions with certain exceptions and also with city council
authorization for other instruments. We are attempting to build
a portfolio pattern that in a few years would have some of the
investments come due each year. The longer maturities usually
contain a better interest rate and the city should have part of
its funds in such maturities.
We have been working in the past with Smith Barney personnel in
St. Paul who understand our investment criteria we will have
quotes on Tuesday of examples and the amount of funds we would be
able to invest. Preliminary numbers on Thursday would indicate the
possible 3 year return of 8.2296 may be possible on government
agencies.

I have received quotes from Smith Barney for investments authorized
by the City. The options described and to give an idea of the
condition of the market are:

The federal home loan are bonds but have a call date after 1 year.
The request would be to invest up to $500,000 in 3 year home loan
bonds for the City of Hutchinson.

to Constructtion Fund
As most of you are aware, HRA and HCDC are restructuring some of the responsibilities and the
staffing. This also means a rearrangement of offices, etc. A floor plan is attached that reflects the 1995
arrangement.
In an effort to provide a professional image and remain compatible with existing furniture in City
Center, we have worked with the company that furnished the modular system to the City We are recom-
mending the furnishing of two units in the HCDC /HRA receptionist area. The prices are as follows:
HRA receptionist module $2,830.45
HCDC work area $1,530.17
TOTAL $5,144.06

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA
VACATING A PORTION OF GLEN STREET AND THIRD AVENUE SOUTHWEST
THE CITY OF HUTCHINSON ORDAINS:
SECTION 1. That notice of hearing was duly given and
publication of said hearing was duly made and it was made to appear
to the satisfaction of the City Council that it would be in the
best interest of the City to vacate a portion of said streets.
SECTION 2. That certain street and public thoroughfares in
the City of Hutchinson located and described as follows:
Beginning at the southwest corner of said Lot 6, Block 31;
thence South 89 degrees 47 minutes 00 seconds West, assumed
bearing along the westerly extension of the south line of said
Lot 6, a distance of 41.25 feet; thence on a bearing of north
371.25 feet; thence North 89 degrees 47 minutes 00 seconds
east 116.25 feet; thence South 58 degrees 19 minutes 55
seconds east 66.97 feet to the northerly extension of the east
line of said Lot 10, Block 31; thence on a bearing of south
5.87 feet to the northeast corner of said Lot 10; thence South
89 degrees 47 minutes 00 seconds west 132.00 feet along the
north line of said Lot 10 to the northwest corner of said Lot
10; thence on a bearing of south 330.00 feet along the west
line of said Block 31 to the point of beginning.
being located in the City of Hutchinson, be and the same hereby are
vacated.
SECTION 3. This ordinance corrects the legal description
previously set forth in Ordinance No. 94 -115, Publication No. 4704.
SECTION 4. This ordinance shall take effect form and after
passage and publication and upon filing of a certified copy thereof
with the property County officials as required by law.

Although it is not yet public knowledge, I wanted to pass along to
you that I have learned that there are negotiations now underway
between the present owners of Dakota Rail, Inc. and a group in
Michigan. The early reports would seem to indicate that the
potential buyers are interested almost exclusively in operating a
railroad and it is on that basis that they have an interest in
acquiring the assets of Dakota Rail, Inc. I have very little
additional information to offer at the present time, but if this
transaction were to go ahead, it does appear that it would be on a
fast track and would probably be resolved by the end of January.
You might want to pass this information along to the Council for
their consideration.

Dear Dagmar:
• I am enclosing herewith our final title opinion in connection with
the fairgrounds property. This parcel, you may recall, was owned
by the McLeod County Agricultural Association (Fair Board) and the
City was able to reach an agreement with the Fair Board shortly
after condemnation was begun relating to this parcel.
With the exception of a sponsor certificate for this parcel, I
believe with your receipt of this final title opinion, all work
will have been completed relative to the Fair Board parcel.
However, I find I do not have a sponsor certificate to prepare on
this parcel so if you could send me one I will see that this is
completed and returned to you in the ordinary course of business.
As to the Svanda parcel, that condemnation will need to be
completed before we can close that transaction even though it is a
minor amount of money. The attorney's fees will exceed the amount
of compensation to be paid and, in fact, the fees probably have
already exceeded the compensation to be paid.
If you need additional information or have questions in connection

At the request of the City of Hutchinson, whom this office
represents, I have examined the Abstract of Title to the above
described parcel. The Abstract, as presented for examination,
consisted of 106 entries numbered from 1 to 106 inclusive and was
certified as complete to 6th day of September, 1994, by Deborah
Jensen, Deputy McLeod County Recorder. Fee simple title to the
above described property was owned by: THE CITY OF HUTCHINSON, a
Minnesota municipal corporation.
Said ownership was subject to the following:
1. Subject to the rights of any person or person in possession of
the premises above described.
2. Subject to the rights of any person or persons to claim a lien
on the premises herein for work performed or materials
furnished in the improvement of said premises within the 120
days preceding the date of certification of the Abstract.
3. Subject to all encroachments, easements and other matters that
might be ascertained by an actual survey and inspection of the
premises above described.

Chapter 336 of Minnesota Statutes.
7. Subject to taxes as follows: Taxes for 1994 and prior years
have been paid in full. Taxes are assessed as exempt
according to a certificate attached to the Abstract dated
September 6, 1994 and the taxes are assessed against Parcel
No. 23- 319 -0050.
8. According to a certificate attached to the Abstract dated
September 6, 1994, there are no federal or state tax liens,
federal court judgments or county personal property tax liens
against the above described property. There are various
judgments against prior fee owners, but these judgments are
either outlawed by the passage of time, subsequent
cancellations of contract for deed or other events that
invalidate the judgments as a lien against any of the premises
involved in this title opinion.
9. Subject to the terms and conditions of a clear zone easement
granted to the City of Hutchinson which easement was dated
March 14, 1988 and was filed for record in the office of the
McLeod County Recorder on July 8, 1988 in Book 111 of
Miscellaneous Records at pages 351 -353. This clear zone
easement appears at Entry No. 84 of this Abstract of Title and
remains effective. This easement is obviously intended to
benefit airport operations.
10. Subject to various grants of road way right -of -way as set
forth in McLeod County Highway Right -of -Way plat No. 26 and a
permanent roadway easement which are found as Document Nos.
244094 and 244097 in the office of the McLeod County Recorder
and appear at Entry Nos. 100 and 101 of this Abstract of
Title.
11. According to a certificate attached to the Abstract, there are
no assessments of record against the above described property
imposed by McLeod County.

Location Signs
■ We are considering working with Mn/DOT to add directional signs for high
volume, governmental and semi - governmental buildings. The buildings and sites
most often noted as needing location signs include:
Civic Arena/Recreation Center
Public Schools
McLeod County Fairgrounds
City Center
We are also considering putting additional signs on TH 15 and TH 22 to direct
traffic along Airport Road (CSAH 8) for use as an alternative route. Signing would be proposed
to include:
TH 22 at Airport Road (CSAH 8)
Sign noting Hospital access, name of road, access to TH 15
TH 15 at Ai=rt Road (CSAH 8)
Sign noting name of road, access to TH 22 and Glencoe
Our desire is to improve visibility and access to these high traffic routes, without creating an
extensive amount of sign clutter. Please let me know if you have any comments, questions or
concerns. I will begin working with Mn/DOT in January.
