MINUTES
REGULAR MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, OCTOBER 13, 1992
1. The meeting was called to order at 7:30 P.M. by Mayor Ackland.
The following were present: Mayor Paul L. Ackland, Councilmen
Craig Lenz, John Mlinar, and Marlin Torgerson. Absent: Coun-
cilman Don Erickson. Also present: City Administrator Gary D.
Plotz, City Engineer John Rodeberg, and City Attorney G. Barry
Anderson (7:40 P.M.).
2. INVOCATION
The invocation was given by Mr. Paul Otte.
3. MINUTES
The minutes of the regular meeting of September 22, 1992 and
bid opening of September 22, 1992 were approved as distrib-
uted.

The motion was made by Councilman Torgerson, seconded by
Councilman Mlinar and unanimously carried, to order the
reports and minutes filed and issue permit.
5. PUBLIC HEARING - 8:00 P.M.
(a) ASSESSMENT ROLL NO. 278 -- LETTING NO. 6, PROJECT NO. 92 -10
(CENTURY AVENUE)
Mayor Ackland called the hearing to order at 8:00 P.M.
and read the notice of hearing, Publication No. 4442.
Engineer Rodeberg reviewed the location of the project
and breakdown of costs. He reported the project would be
started this fall and be completed in 1993.

CITY COUNCIL MINUTES - OCTOBER 13, 1992
David Broll, 547 Milwaukee Avenue SW, expressed concern
about the Word of Life property. The subdivision agree-
ment stated there were 10 lots, but now the City was
dividing it into 14 lots. He questioned the subdivision
agreement being changed and being charged for additional
assessments because of redistribution of costs.
The City Attorney questioned how binding a 1980 agreement
would be on a new project. He also stated the original
agreement was not clear, and the circumstances for the
subdivision never developed. It was Attorney Anderson's
opinion that the court would favor a more equitable dis-
tribution of costs. For the 8.77 acres of property the
Word of Life Church purchased, it has received more than
its dollar amount of benefit from the project. In the
early stages of discussions with the Word of Life Church
they were made aware of improvements. The City never
made any statement that assessments would be for only one
lot.
Engineer Rodeberg reported the subdivision agreement was
never recorded with the County, and it was a poorly
platted subdivision. He stated it was a fairness issue
to subdivide the one lot since it was the size of the
other nine lots but paid the same cost.
Howard Rekstad, owner of Super 8 Motel, stated he owned
lots 1 and 6. He questioned the fairness relating to his
property and stated he was opposed to the proposed
assessment.
The City Engineer stated the City was trying to be con-
sistent.
Councilman Mlinar moved to close the hearing at 8:27 P.M.
Motion seconded by Councilman Lenz and unanimously car-
ried.
Councilman Torgerson moved to approve and adopt assess-
ment roll No. 278, to award contract to Juul Contracting
Company for $324,727.80, and to waive readings and adopt
Resolutions No. 9823 and No. 9824. Motion seconded by
Councilman Mlinar and unanimously carried.
6. COMMUNICATIONS. REQUESTS AND PETITIONS
(a) PRESENTATION BY CHUCK BARGER OF RCM REGARDING WATER
STORAGE TANK

Mr. Chuck Barger presented the proposed plans for the
South Park water tower to be completed by next fall. He
stated bids would be received for two different types of
tanks.
Following discussion, Councilman Mlinar moved to approve
the plans and specifications, to order advertisement for
bids on November 25, 1992, at 2:00 P.M., and to waive
readings and adopt Resolutions No. 9825 and No. 9826.
Motion seconded by Councilman Lenz and unanimously
carried.
(b) CONSIDERATION OF REQUEST TO REVIEW STREET LIGHTING IN
SHADY RIDGE AREA
Following discussion, Councilman Torgerson moved to refer
to Hutchinson Utilities. Motion seconded by Councilman
Mlinar and unanimously carried.
(c) UPDATE ON DAKOTA RAIL BY KIMBERLY HUGHES
Ms. Kimberly Hughes reported on Dakota Rail's progress
since purchasing the Hutchinson railroad line and its
future plans for a rehabilitation program.
(d) DISCUSSION OF DAKOTA RAIL CONNECTOR ISSUE
Attorney Anderson presented background information on the
issue. He stated the "Y" property would be dedicated to
public use, and the railroad would gain expansion room in
Industrial Park.
Following discussion, Councilman Torgerson moved to refer
to Hutchinson Community Development Corporation for a
report. Motion seconded by Councilman Mlinar and unani-
mously carried.
7. RESOLUTIONS AND ORDINANCES
(a) RESOLUTION NO. 9820 - RESOLUTION ACCEPTING $156,250 FROM
HUTCHINSON UTILITIES COMMISSION
The motion was made by Councilman Lenz, seconded by Coun-
cilman Torgerson and unanimously carried, to waive read-
ing and adopt.
(b) RESOLUTION NO. 9821 - RESOLUTION FOR PURCHASE

(c) RESOLUTION NO. 9822 - RESOLUTION SUBSTITUTING PLEDGED
SECURITIES FOR FIRST STATE FEDERAL SAVINGS & LOAN
ASSOCIATION
The motion was made by Councilman Torgerson, seconded by
Councilman Mlinar and unanimously carried, to waive read-
ing and adopt.
(d) ORDINANCE NO. 92 -68 - AN ORDINANCE TO VACATE UTILITY
EASEMENT IN CASA ADDITION
The motion was made by Councilman Lenz, seconded by Coun-
cilman Mlinar and unanimously carried, to waive second
reading and adopt.

UNFINISHED BUSINESS
(a) CONSIDERATION OF MAC'S BLUFF ASSESSMENT AGREEMENT WITH
GARY HASSE (DEFERRED SEPTEMBER 22, 1992)
Following discussion, Councilman Mlinar moved to remove
from agenda. Motion seconded by Councilman Lenz and
unanimously carried.

NEW BUSINESS
(a) CONSIDERATION OF COUNTY REQUEST TO USE GOLF COURSE WATER
TOWER
Deputy Al Cheney requested permission to locate a county
antenna and repeater system on top of the city's north
water tower. During discussion it was reported the
Hutchinson Police Department anticipated placing an
antenna on the water tower also. It was the consensus
that the two law enforcement agencies would work together
to find locations for their antennas.
(b) CONSIDERATION OF APPOINTING COMMITTEE TO REVIEW HANDICAP
PARKING IN DOWNTOWN HUTCHINSON

Donald Dodnem requested a committee be appointed to
review the handicap parking situation in the downtown
area. Following discussion, Councilman Mlinar moved to
approve appointing a committee. Motion seconded by Coun-
cilman Lenz and unanimously carried.

(c) CONSIDERATION OF FARM LAND LEASE RENEWAL FOR KURT KNUTSON
Kurt Knutson submitted a proposal to renew his farm land
lease for three years based on a rate of $60 per acre.
Following discussion, Councilman Lenz moved to approve a
three year contract at $60 per acre and for city staff to
review the specific wordage, with a contingency regarding
potential road work. Motion seconded by Councilman
Mlinar and unanimously carried.
(d) CONSIDERATION OF PLACING HUTCHINSON INDUSTRIAL PARK
DIRECTIONAL SIGN ON BOULEVARD OF PROPERTY LOCATED AT
NORTHEAST CORNER OF SECOND AVENUE AND ADAMS
It was reported the sign had already been placed on Hwy.
22 right -of -way. No action was required.
(e) DISCUSSION OF CITY SIDEWALK POLICY BY STEVE AND BRAD WICK
The motion was made by Councilman Mlinar, seconded by
Councilman Lenz and unanimously carried, to defer to the
next meeting.
(f) DISCUSSION OF 1993 LIBRARY BUDGET
Librarian Mary Henke reported on the 1993 Hutchinson and
Pioneerland Library System budget.
Following lengthy discussion, Councilman Torgerson moved
to approve the 14 percent increase. Motion seconded by
Councilman Lenz and carried three to one, with Councilman
Mlinar voting nay.
Councilman Mlinar moved to form a committee to research
further options concerning the library system. Motion
seconded by Councilman Torgerson and unanimously carried.
(g) DISCUSSION ON SELECTING DATE FOR CITY BUDGET WORKSHOP
Councilman Lenz moved to set the meeting date for Novem-
ber 2, 1992, at 5:15 P.M. Motion seconded by Councilman
Torgerson and unanimously carried.
(h) DISCUSSION OF PRESENT CITY HALL BUILDING
Councilman Torgerson suggested an open house and a public
meeting for input on possible use of the old City Hall
building and to inform the public of the consultant's

estimates for upgrading to code. He also thought local
realtors should be contacted for possible sale of the
building. No action was taken.
(i) CONSIDERATION OF HOLDING CITY -WIDE AUCTION AND
CONTRACTING WITH AUCTIONEER
Following discussion, Councilman Lenz moved to approve
and enter into contract with Hotovec Auction Service.
Motion seconded by Councilman Mlinar and unanimously
carried.
(j) CONSIDERATION OF CITY FUNDING FOR 1993 JAYCEE WATER
CARNIVAL
Tim Ulrich, 1993 Commodore for Jaycee Water Carnival, re-
quested $1,500 city funding for the 51st Carnival. Fol-
lowing discussion, Councilman Mlinar moved to refer to
the budget workshop meeting. Motion seconded by Coun-
cilman Torgerson and unanimously carried.
(k) CONSIDERATION OF DETERMINING COST FOR EXTRA REFUSE BAG
STICKER CHARGE
Following discussion, Councilman Lenz moved to charge
$2.00 for extra refuse bag stickers for a 32 gallon bag
size and 30 pound weight limit, effective November 1,
1992. Motion seconded by Councilman Mlinar and unani-
mously carried.
11. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
Administrator Plotz commented on Broker Frank Fay's
letter in which he indicated a prospect was interested in
purchasing the lot south of Shopko. Following discus-
sion, Councilman Torgerson moved to have appraiser David
Lorenz do an appraisal on the property. Motion seconded
by Councilman Lenz and unanimously carried.
The City Administrator reported on the schedule for the
compost site. He stated Aagard West was picking up
leaves during October and the week of November 9. Mr.
Plotz commented the second long -range planning meeting
was held last week, and the Policy Handbook will be re-
vised. The City Hall Committee will meet on October 14
at 10:30 A.M. to review proposals.

(b) COMMUNICATIONS FROM COUNCILMAN CRAIG LENZ
Councilman Lenz inquired how long the booms would be
across the Crow River.
(c) COMMUNICATIONS FROM COUNCILMAN JOHN MLINAR
Councilman Mlinar commented on the number of city prop-
erties available for sale and requested a list be pre-
pared. He further commented that Mr. Carrigan on Hill-
top had a tree to be replaced. Councilman Mlinar asked
about the snowmobile trail routes.
Councilman Mlinar inquired about the Cash Wise negotia-
tions. He was told that no water meter would be
installed until the park contribution was paid and the
plat recorded with the county.
Councilman Mlinar commented on the Hutchinson Utilities
handout which showed the contributions made to the City
from 1942 to 1992.
(d) COMMUNICATIONS FROM COUNCILMAN MARLIN TORGERSON
Councilman Torgerson inquired if HTI had been commended
for the honor received last week. If not, a letter
should be sent from the City.
(e) COMMUNICATIONS FROM DIRECTOR OF ENGINEERING
Engineer Rodeberg commented on the good appearance of the
Main Street stop lights.
(f) COMMUNICATIONS FROM MAYOR PAUL L. ACKLAND
Mayor Ackland commented The Hangar Restaurant had closed.
He instructed the City Administrator to contact the mana-
ger of the bar to determine their plans. The Council
would terminate the license at the next meeting if they
were no longer open.
Councilman Mlinar moved to direct the City Administrator
to contact The Flyer bar and report back to the Council.
Motion seconded by Councilman Torgerson and unanimously
carried.

MINUTES
I. CALL TO ORDER: 2:00 P.M. BOARD PARK TOWERS
Chairman John Paulsen called the meeting to order. Members
present -Don Erickson, Shirley Wass, Tammy Wendlandt and Lyle
Van Hale. Members absent -none.
II. CONSIDERATION OF MINUTES OF REGULAR BOARD MEETING
AUGUST 18, 1992
There being no additions or corrections, Don Erickson moved
that the minutes be approved as mailed. Shirley Wass
seconded and the motion carried unanimously.
III. CONSIDERATION OF STATUS OF ACCOUNTS FOR PARK TOWERS
PROJECT AND GENERAL FUND
Budget status and monthly disbursements were reviewed. Lyle
Van Hale moved that the financial statements be approved as
submitted. Shirley Wass seconded and the motion carried
unanimously. The $20,000 CD will mature on 10- 13 -92;
Shirley Wass moved that the Executive Director renew the CD
for either 3 or 6 months at the best available rate. Lyle
Van Hale seconded and the motion carried unanimously. The
Director requested approval for payment to Laraway Roofing,
Inc. for $45,180.00. The roof is now complete with the
exception of flashing and metal scuppers. Change orders
in the amount of $5,925.29 have been submitted to HUD due to
having to fully adhere the membrane roof at stair towers
because of the height of the roof and because of the amount
of wet insulation found having to be replaced. This amount
will need be be taken from our operating reserves and will
have to be included in our November budget revision.
IV. SECTION 23 /PARK TOWERS PROJECT
1. As of August 30, 1992, there are no rent receivables and
there is one apartment vacant we are in the process of
filling.
2. The 1993 budget was reviewed; the maintenance salary
was changed to reflect a 3% raise approved at the August
Board meeting, resulting in a salary of $10.03 /hour. Don
Erickson moved to approve the 1993 budget as submitted.
Shirley Wass seconded and the motion carried unanimously.
V. OTHER BUSINESS
1. The Housing Task Force has met and is in the process of
developing a survey to gain more information on the supply
and demand of housing in Hutchinson. A meeting has been
scheduled on Thursday, September 17, 1992 with Donn Winckler

from the Mid - Minnesota Development Commission who will help
to develop and tabulate the survey.
2. Funding for the Minnesota Communities Program is now
available from MHFA. The Minnesota Communities Program
enables Cities to set -aside up to $250,000 or 5 loan
set - asides (whichever is greater). The income limits for
this program are $33,760 and the construction limit is
$72,000. We will need to find a lender to handle the loans;
it was noted that currently no lender in Hutchinson handles
new construction first time home buyers program because of
the cumbersome paperwork. The Director will call the
Security State Bank in Glencoe to find out if they would
administer these loans and will check with Ed Ide concerning
any tax forfeited lots available. We will also need to
contact some builders to find out if it is feasible to build
a house in Hutchinson for the $72,000 construction limit,
keeping in mind the cost of lots and assessments.

3. Funding is now available for the Home Rental Rehab
Program which provides a five year no- interest deferred loan
to property owners who provide a 252 match.

SEPTEMBER 15, 1992
I. CALL TO ORDER: BOARD ROOM PARK TOWERS APARTMENTS
President Don Erickson called the meeting to order. Members
present - Shirley Wass, Tammy Wendlandt, Lyle Van Hale and
John Paulsen. Members absent -none.
II. CONSIDERATION OF MINUTES OF AUGUST 18, 1992
There being no additions or corrections, John Paulsen moved
the minutes be approved as mailed. Shirley Wass seconded
and the motion carried unanimously.
III. FINANCIAL REPORT
The financial report was reviewed; John Paulsen moved that
the financial reports be approved as submitted. Tammy
Wendlandt seconded and the motion carried unanimously.
IV. OTHER BUSINESS
1. Prior to the meeting, Board members toured the Dobratz
house. Quenten Larson was on hand to answer any questions
regarding the house. It appears from the bills already paid
and estimated bills to be paid that there will be
approximately $28,000 of expenses; allowing $12,000 for the
lot would require $40,000 to break even. Don Erickson
noted that comps would be around $42,00- $46,000. There will
be work done on Adams Street sometime in 1993, resulting in
assessments to the new owner. There was discussion
regarding the sale of the house using a bid process or
realtor. Lyle Van Hale moved that committee will review
whether Barry Anderson can schedule a bid opening no later
than October 15th and how to handle the pending assessments.
John Paulsen seconded and the motion carried unanimously.
The committee will consist of John Paulsen, Don Erickson and
Jean Ward. The following specifications were set in the
event of a bid process: Minimum bid: $42,000, Earnest
money: $500, Time to qualify for financing: 45 days.
People interested in bidding will be instructed to contact
Jean Ward at Park Towers who will then arrange with Don
Erickson or John Paulsen to show the house.
2. The Director informed the Board that the Cellular 7 Site
Lease agreement has been execute after final approval from
Barry Anderson.
3. The Director informed the Board that the former Reid
Property is available as a tax forfeiture for a total of
_ $663.30 and has contacted Ed Ide concerning the property.
The property could be used as additional parking in the

Meeting called to order by Dave Skaar at 7:45 P.M.
Members present: Dave Skaar, Jim Faber, Tim Miller and Joe Dooley

City Staff present: Engineer John Rodeberg and Doug Meier
Guest present: Tom Parker and Bernie Knutson
Motion made by Joe Dooley and seconded by Tim Miller, that John Rodeberg prepare
a variance form which would allow renters the option to request a variance
concerning the storage of other than airplane related items at Hutchinson
Municipal Airport. Passed unanimously.
Motion made by Tim Miller anri seconded by Jim Faber, not to apply for a grant
from the MN /DOT for the purchase of a new UNICON radio. Passed unanimously.
Motion made by Tim Miller and seconded by Jim Faber concerning a temporary
site for the new refueling system. The primary site would be located at the
Southwest corner of Building #3 (new hangar) and the secondary site would be
located at the Southeast corner of Building #3. Passed unanimously.
Next scheduled meeting will be held in City Council Chambers on October 26, 1992
at 7 :30 P.M.

1. CALL TO ORDER
The meeting was called to order by Chairman Clint Gruett at
8:00 p.m. with the following members present: Dean Wood, Craig
Lenz, Bill Craig, Roland Ebent and Chairman Gruett. Members
Absent: E1Roy Dobratz and Tom Lyke Also Present: Gary Plotz, City
Administrator and John Rodeberg, City Engineer.
2. MINUTES
Mr. Ebent made a motion to approve the minutes of the regular
meeting dated Tuesday, August 18, 1992. Seconded by Mr. Craig the
motion carried unanimously.
PUBLIC HEARINGS
(a) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY TOM
DAGGETT, HUTCHINSON MANUFACTURING
Chairman Gruett opened the hearing at 8:02 p.m. with the
reading of publication # 4434 as published in the
Hutchinson Leader on Thursday, September 3, 1992. The
request is for the purpose of considering a conditional
use permit requested by Tom Daggett, Hutchinson
Manufacturing, to allow him to construct a 40' x 80'
storage rack located at 720 Hwy 7 West.
City Administrator Gary Plotz commented on the request of
the storage building to be open on both ends.
Mr. Lenz moved to close the hearing, seconded by Mr. Wood
the hearing closed at 8:05 p.m. Mr. Lenz made a motion
to recommend approval of the request to City Council.

staging area for outside storage located at Stearnswood.

(d) CONSIDERATION OF VARIANCE REQUESTED BY PETER HOEGER, 215
WASHINGTON AVE WEST FOR NONCONFORMING DRIVEWAY AND TO
CONSTRUCT A GARAGE
Chairman Gruett opened the hearing at 8:10 p.m. with the
reading of publication #4437 as published in the
Hutchinson Leader on Thursday, September 3, 1992. The
request is for the purpose of considering a variance
requested by Peter Hoeger, 215 Washington for a
nonconforming driveway and to construct a 16 x 26'
garage.
Mr. Plotz explained the request and the hardship of the
narrow lot and the existing nonconforming driveway. The
planning staff recommends approval of the driveway
variance and the owner constructing a 14' garage to
maintain a 6' side yard setback.
Mr. Hoeger stated it is not possible to build a double
garage in the narrow lot. He explained 16' would give
extra storage space. City Engineer John Rodeberg
commented on the issue of drainage. Mr. Hoeger stated he
will work with the neicjhbors on the drainage. There was
discussion on the existing garage /shed and the age of the

building. Discussion followed on the narrow lots in
older parts of town and other possible options for the
garage.
Mr. Craig moved to close the hearing, seconded by Mr.
Wood the hearing closed at 8:23 p.m. Mr. Craig made a
motion to deny the garage variance due to lack of
hardship but to approve the driveway variance. Seconded
by Mr. Ebent the motion carried unanimously.
(e) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY
JEANETTE HARRIS TO MOVE A 1972 MOBILE HOME TO MCDONALDS
TRAILER COURT
Chairman Gruett opened the hearing at 8:24 p.m. with the
reading of publication #4438 as published in the
Hutchinson Leader on Thursday, September 3, 1992. The
request is for the purpose of considering a request to
move a 1972 Ritz Craft trailer home to McDonalds Trailer
Court.
City Administrator Gary Plotz explained the staff
recommendations to update to Life Safety Issues.

Ms Harris explained the house has been brought up to code
since a fire. She commented on the issues being addressed
except for smoke detectors. There was discussion on the
Safety Issues and the need for the interconnected smoke
detectors.
Mr. Lenz moved to close the hearing, seconded by Mr.
Craig the hearing closed at 8:28 P.M. Mr. Lenz made a
motion to approve the request subject to Life Safety
Issues being met. Seconded by Mr. Ebent the motion

4. NEW BUSINESS
(a) CONSIDERATION OF FINAL PLAT OF °SIOUX HILLS NO. 2
SUBMITTED BY SKIP QUADE, ACOMA TWP, 2 MILE RADIUS
City Administrator Gary Plotz explained the history of
the previous preliminary plat submitted by Mr. Quade and
the platting.
City Engineer Rodeberg commented on concerns with
servicing the area in the event it is annexed into the
city. He also commented on his concerns with wet lands
and lot sizes. He stated Mr. Quade's proposal meets
county and state guidelines. Mr. Rodeberg explained the
city staff recommendat3ion of certified inspectors and
installers for the septic systems as required by the

Mr. Craig stepped down from the commission on this item.
City Administrator Gary Plotz explained the request and
the staff recommendation to annex all of Lot 6 which
would include Wigen property.
There was discussion on the sewer main owned by
Hutchinson Technology the in the future may serve some of
the city.
Mr. Lenz made a motion to begin annexation proceedings
for the entire lot 6, seconded by Mr. Wood the motion
carried unanimously.
(f) DISCUSSION OF REQUEST BY THE DOWNTOWN DESIGN REVIEW
COMMITTEE ON ORDINANCE CHANGE REGARDING BANNER SIGNS
Mr. Plotz commented on a memo from the Downtown Design
• Review Committee requesting an ordinance change regarding
banner signs. There was discussion on the enforcement of
the ordinance. The Planning Commission directed staff to
draft and ordinance regarding banner signs.
(g) DISCUSSION OF MEETING TIME
Mr. Craig made a motion for the planning commission to
meet at 5:30 p.m. on the 3rd Tuesday of the month
beginning in October, seconded by Mr. Wood the motion
carried unanimously.
(h) COMMENTS ON PROPOSED COUNTY COMPREHENSIVE PLAN
There was discussion of the changes in the county
comprehensive plan.

Mr. Louis King, 116 Monroe, stated his property was

commented on the proposal. Mr. King presented a sketch of
the proposal to the rear of the house to eliminate a flat
roof. The Planning Commission directed Mr. King to apply
for a rezoning to R -2.

Tree Board
August 19, 1992
Members present: Virgil Voigt, Carol Brown, Scott Peterson, Mark Schnobrich and
guest Jerry Brown.
The Tree Board was awarded $10,000 from the Hutchinson Utilities Commission for
use in it's energy tree planting project for 1992. The trees must be planted for energy
conserving purposes and the Utility donation is contingent upon Minnesota ReLeaf
awarding Hutchinson at tree planting grant.
Pending approval from the Financial Director and City Council, funds could be raised
via a volunteer donation through private residential water or utilities billings.
Schnobrich will update the program as it is being implemented in Roseville, Minnesota
with assistance from the U.S. Forest Service.

• Federal Emergency Mangement Agency may have dollars for replacement of storm
damaged trees in Hutchinson. Schnobrich submitted a request for $2,000 through
Duane Hoeschens, McLeod County Emergency Coordinator.

Tree Board
September 23, 1992
Members present: Carol Brown, Scott Peterson, Mark Schnobrich and Guest, Jerry
Brown.
Hutchinson was awarded $15,000 from the State of Minnesota for conservation tree
plantings. The $15,000 plus the $10,000 donated from Hutchinson Utilities, along
with the city budget of $4,000 will allow close to 784 trees to be planted in the spring
of 1993.
No formal action to date.
Hutchinson was not approved for $2,000 in tree damage reimbursement for the 1992
storm. Possibly due to hurricane Andrew in Florida and Louisiana

A mortality survey was done with marvelous results recorded. Less then 5 % mortality

1. It has been brought to the attention of Chak man Scherer that the steps on the front of the Lbrwy
have deteriorated very seriously. The balustrades on the sides need brick work and the cap must be
replaced. Tuck pointing has to be done and some other minor repairs. After discussion among the board
members it was decided that we should get three bids to take to the City Council on Tuesday. The
following businesses were to be contacted by a letter to be written by the secretary. They will be
requested to submit bids for the work to be soon as soon as possible.

• 2. The front doors of the Library (facing the park) are also deteriorating and need both sanding and
refinishing. Motion was made to table this until spring. ThompsotlLadd. Motion carried.
3. Discussion regarding the City Council approval of the Pioneerland Library System (PLS) funding.
Several council members have questions in the following regards. Shortfall funding. Reserve funds?
Long Range Plans for reserve fund ?.
In regard to the question on the size of the PLS (ward, it was explained that only about 25-28 people are
able to make the meetings that are held only every third month. Most of the members do not turn in
mileage vouchers and if they do the vouchers pay 20 and one half cents per mile.
The funding formula is based on 50% per capita and 50% land valuation.
Another question was whether PLS was top -heavy with administrative costs, both Roy Johnsen and
Dolores Brunner, Pioneerland Board members explained several things about PLS and both felt that it
was not top -heavy in administrative costs. State and Federal funds must be used for PLS administrative
costs and cities and counties must support their own libraries. The City Council will be appointing a
committee to investigate all options in regard to going to another library system or staying with PLS or
being on their own. Mary Henke and several members did not feel that g&V alone was an option that
would benefit the Hutchinson Library. Mr. Scherer said that he will be on that committee and Mary Henke
will request the Mayor to appoint her to that committee also. Mr. Houlihan will be asked to meet with the
City Council and explain funding, Reserve hind arc.

N 0 T E: After contacting the three masorry companies, all stated that they would not be able to start the
work before winter. They were all very busy completing their contracts now. Mr. Scherer was notified and
is decision was made to delay the project until spring and maybe when the city fixes the bandstand we would
be able to use the same people for our project or to send out bids in spring.

WHEREAS, the Director of Engineering and the Chief of Police
have observed areas of traffic control concerns which warrant
traffic control devices, and;
WHEREAS, the Hutchinson City Council has the authority to
establish locations as points where traffic control devices shall

WHEREAS, the Hutchinson Police Department has accumulated
various unclaimed property;
AND WHEREAS, the Hutchinson Police Department has had this
accumulated unclaimed property for longer than sixty (60) days;
AND WHEREAS, the various city departments could use various
items of this accumulated unclaimed property;
AND WHEREAS, the Hutchinson City Code provides pursuant to
Section 2.20, Subdivision 2, Paragraph C for the appropriation of

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA, REPEALING
PRESENT CITY CODE SECTION 8.09, AND ENACTING REVISED SECTION 8.09
ENTITLED "SNOWMOBILES" AND BY ADOPTING BY REFERENCE CITY CODE
CHAPTER 1 AND SECTION 2.99 WHICH, AMONG OTHER THINGS, CONTAIN
PENALTY PROVISIONS.
THE CITY OF HUTCHINSON ORDAINS:
SECTION 1. City Code Section 8.09, is repealed in its entirety.
SECTION 2. City Code Section 8.09 is hereby enacted as follows:
Subd. 1. Definitions. For the purposes of this Section, the
terms defined shall have the meaning given them.
1. "Snowmobile" - A self propelled vehicle designed for
travel on snow or ice or natural terrain steered by skis or
runners.
2. "Owner" - A persons, other than a lien holder, having
a property interest in, or title to, a snowmobile.
Subd. 2. Snowmobile operating Restrictions. It is unlawful
to operate a snowmobile as follows:
A. On a public sidewalk or walkway used for pedestrian
travel, or upon any boulevard.
B. On private property of another without lawful
authority or permission of the occupant or owner.
C. On school grounds, park property, playgrounds,
recreational areas, and golf courses, without express permission
to do so by the property authority.
D. Upon any county road or state highway within the City
of Hutchinson, or within the designed "downtown area" which
includes and is bounded by the rights of way of Franklin, Main and
Hassan Streets from Second Avenue North to Fifth Avenue South.
E. Upon any street, other than the most direct route
from the owners or operators residence to the nearest departure
point from the City or appropriate snowmobile trail.
F. During the hours between 10:00 o'clock P.M. and 7:00
o'clock A.M. of the day next following, Sunday through Thursday,

subd. 3. snowmobile Equipment. It is unlawful for any person
to operate a snowmobile unless equipped with the following:
A. Standard mufflers which are properly attached and in
constant operation, and which reduce the noise of operation of the
motor of the minimum necessary for operation. Mufflers shall
comply with Regulation CONS. 55 which is hereby adopted by
reference as it existed on September 1, 1970. No person shall use
a muffler cut -out, by -pass, straight pipe or similar device on a
snowmobile motor, and the exhaust system shall not emit or produce
a sharp popping or crackling sound.
B. Brakes adequate to control the movement of and to
stop and hold the snowmobile under any conditions of the operation.
C. A safety or so- called "deadman" throttle in operating
condition, so that when pressure is removed from the accelerator
of throttle, the motor is disengaged from the driving track.
D. At least one clear lamp attached to the front, with
sufficient intensity to reveal persons and vehicles at a distance
of at least 100 feet ahead during the hours of darkness under
normal atmospheric conditions. Such head lamp shall be so aimed
that glaring rays are not projected into the eyes of an oncoming
vehicle operator. It shall also be equipped with at least one red
tail lamp having a minimum candle power of sufficient intensity to
exhibit a read light plainly visible from a distance of 500 feet
to the rear during the hours of darkness under normal atmospheric
conditions. The equipment to a in operating condition when the
vehicle is operated between the yours of one -half hour after sunset
to one -half hour before sunrise or at times of reduced visibility.
E. Reflective material at least sixteen inches on each
side, forward of the handlebars, so as to reflect or beam light at
a 90 degree angle. — All&

A. Notwithstanding any prohibition in this Section, a
snowmobile may be operated upon a public street in an emergency
during the period of time when, and at locations where, snow upon
the roadway renders travel by automobile impossible.
B. For safety purposes every person leaving a snowmobile
in a public place shall lock the ignition and remove the key.
subd. S. Owner Responsibility. It is unlawful for the owner
of any snowmobile to permit its operation in violation of this
ordinance. The party holding title to the snowmobile shall be
conclusively presumed to be the owner unless the snowmobile shall

RE: Drug Forfeiture Funds
As you are aware, the Hutchinson Police Department has received
$34,465.48 in drug forfeiture funding for its direct participation
in the arrest of a physician who was illegally dispensing drugs.
Additionally, another 4,359.83 will be received through the Drug
Task Force for the same case.
Because Federal and State mandates address these funds as
specifically going to law enforcement, I have prepared a resolution
for City Council review and approval. Essentially, the resolution
establishes a "forfeiture fund" with disbursements being made from
this fund upon the recommendation of the Chief of Police and
subsequent approval of the City Council.
Keeping the aforementioned in mind, I would like to advance four
projects the police department has anticipated completing but
adequate funding has not been available.
The first project is to complete the basement of the police
station. Initial construction did not allow for the completion of
the ceilings or additional office space which may be used by the
new assistant city attorney. By completing the basement the police
department can add additional storage, two offices and an
acoustical dropped ceiling. A storage area for janitorial supplies
will be added as well as equipment storage for larger equipment
items will be made available. The shower stall in the mens locker
room will also be repaired as it is leaking badly. The approximate
cost of the project will be $10,000.00.
The second project is to move and redevelop the police department
weapons range. The current range is located south of the city
street department garage area. The berm is built along the bank of
the river. Further plans are to build walking paths along the
river. The walking path could not be built in the vicinity of the
range unless the berms are moved away from the river. The plan for
the project would be to move the range berms one hundred feet to
the east, place asphalt as the base for the shooting area, place a
small shed on a concrete slab to hold range supplies and landscape
the berms. The approximate cost of the project will be under
AML $6,000.00.

The third project is to provide cold weather clothing for police
patrol personnel. The current winter clothing does not provide for
long term exposure to cold weather situations. The last few years
we have encountered several situations wherein long term exposure
was necessary. The clothing provided will be a gortex heavy coat
along with gortex snow bibs. The approximate cost to this project
is $6,000.00
The fourth project is to outfit the chiefs car, the investigators
car, the sergeants car and mobil command post with cellular
telephones. This technology is important to maintain contact
during emergencies as well as provides for more productive time
during normal operations. The investigator can maintain contact
with other investigators while traveling. The sergeants can reply
to citizens questions and /or complaints from the squad car in lieu
of having to drive to the station and take himself off the street.
The chief will be able to communicate with any other vehicle or
city staff that have cellular capability or regular telephone
service. The approximate cost is $2,500.00.

RESOLUTION ESTABLISHING DISBURSEMENT OF FUNDS
OBTAINED FROM FORFEITED PROPERTY
Resolution No. 9835
WHEREAS, the City of Hutchinson has empowered its police
department to enforce the general criminal laws pursuant to Section
2.31 of the Hutchinson City Code;
AND WHEREAS, the Hutchinson Police Department develops, from
time to time, criminal cases wherein forfeiture of property may be
involved;
AND WHEREAS, Federal and Minnesota State Statutes provide for
a percentage refund to local agencies involved in criminal cases
where forfeiture is approved by the court;
AND WHEREAS, Federal and Minnesota State Statutes mandate
forfeited property to be used by local law enforcement agencies as
a supplement to the agency's operating fund;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUTCHINSON, MINNESOTA:
1. That the Hutchinson City Council hereby establishes the
"Forfeited Property Fund" to be disbursed for law
enforcement equipment or capital needs as recommended by
the Chief of Police with City Council approval.

Dear Gary:
• As you know, Midwest Cablevision, an intermedia company, has
purchased the assets of Star Cable Systems and is now the new
operator of the cable franchise system here in the City of
Hutchinson.
The franchise is scheduled to expire in 1984. We have received
correspondence from Mark Machart, the Area Manager for Midwest
Cablevision, requesting that the City enter into a franchise
renewal process.
I was initially reluctant to do so because of pending legislation
which may affect the position the City was going to take relative
to franchise renewals.
As you know, federal legislation is now in place, although not yet
fully effective, which deals with the issue of regulation of cable
franchise systems by municipalities.
I would ask that the Council at its next regularly scheduled
meeting discuss how they wish to handle negotiations with Midwest
Cablevision with respect to the franchise renewal process. At this
point, I am principally concerned with putting a committee together
which would have responsibility for dealing with this issue. I
believe the Cable TV Advisory Committee would be an interested body
and would be willing to participate in these discussions, but I do
• believe City staff and also the Council should be represented.

It also includes the following revisions:

increase the cost to standard City lots.
► Assesses 253 of sanitary sewer and watermain lateral costs
in reconstruction areas. The purpose of this change is to
• relate the cost to the benefit received from improved

reached the end of their usefull life.

The City maintains the right to modify the above Assessment Policies if conditions warrant
a variation. The City will base its decisions on provisions of Minnesota Statute 429, or
other applicable local, state or federal laws.

We have received a quote from Charles Bailly & Co. our present
audit firm for 1992 year end work. Richard Siewert, a partner with
Charles Bailly, who presented the results of the 1991 audit to the
city council will be doing oversight of the 1992 audit.

The proposal is for 1992 audit a not to exceed $18,700, plus out of
pocket expenses. There would be reduction in the fees if more of
the work would be completed by City Staff. While some field work
would be done prior to year end the majority of work will commence
after April 15, 1993.
Charles Bailly, has been a good audit firm. Because the number of
grants and special programs Hutchinson has it is important to have
auditors who are familiar with government auditing.
It would be requested to have Charles Bailly named as our auditors
for 1992 year end.

Funds from this grant are being reimbursed by our City to Glencoe
City, Hutchinson Utilities, and McLeod County for administration
per the grant application and reimbursement request.

Enclosed please find a copy of an order entered by the District
Court in connection with Hutch, Inc., the business entity owned by
W.R. Block which operates Country Club Terrace.
. As you can see, the City of Hutchinson has been appointed
Administrator for the purpose of collecting rents until such time
as the dispute relative to the park shelter is resolved.
The City will become obligated to collect the rents upon service
of the order upon the residence of the mobile home park. I would
suggest that the police department handle service of the order upon
each mobile home resident.
I would further suggest that this matter be placed on the City
Council agenda for next Tuesday evening to discuss any issues that
the City Council may have regarding how the use of the funds
collected by the City should be handled. I would recommend that
we make service upon each of the mobile home residents after next
Tuesday evenings City Council meeting.

Based upon the proceedings, files, records and argument of counsel, THE COURT
MAKES THE FOLLOWING:
1. This is an action:
(a) pursuant to Minn. Stat. S 327.24 subd. 1 (1990) to abate the unlawful
operation of a manufactured home park whose license has been revoked for failure to

provide a safe place of shelter for park residents or a plan for the evacuation of park
• residents to a safe place of shelter within a reasonable distance of the park for use by
park residents in times of severe weather, including tornadoes and high winds,
approved by the municipality within which the park is located, as required by Minn.
Stat. S 327.20 subd. 1(7) (1990); and
(b) pursuant to Minn. Stat. S 566.20 (1990) to appoint an administrator
with the powers described in Minn. Stat. BS 566.29 subd. 4 (1990) to collect rents
from the park residents and from them pay to construct such a shelter which the
owner of the park is obligated to provide but has refused or failed to provide; and
(c) pursuant to Minn. Stat. S 8.01 (1990) which directs the Attorney
General to appear for the state in all civil causes whenever, in the Attorney General's
opinion the interests of the state require it, and to the common law
powers of the Attorney General for the abatement of the unlawful operation of the
park, the appointment of an administrator and for such other and further relief as the
0 Court deems appropriate.
2. Hubert H. Humphrey lII (the "Attorney General ") is the duly elected Attorney
General of the State of Minnesota.
3. Marlene E. Marshall (the "Commissioner ") is the duly appointed
Commissioner of the Departntcnt of Health (the "Department ") of the State of Minnesota.
4. Hutch, Inc. ( "Defendant ") is a Minnesota corporation which owns and operates
the Country Club Terrace Mobile Home Park (the "Park ") a park with approximately 214
manufactured homes located in the City of Hutchinson (the "City") McLeod County and,
prior to revocation of its license, licensed by the Department pursuant to Minn. Stat.
S 327.15 (1990).
5. Minn. Stat. 327.20, subd. 1(7) (1990), enacted in May 1987, required that
manufactured home parks with ten or more manufactured homes licensed prior to March

1, 1988, have municipally accepted evacuation plans or severe weather shelters in place by
March 1, 1989, 40
6. On or about January 18, 1989 the Department sent notice to Defendant of the
need to comply with the municipally approved severe weather plan or shelter requirement
of the statute by March 1, 1989.
7. On or about August 23, 1989 the Department inspected the Park and again
advised Defendant that it needed to have the City of Hutchinson inform the Department
that the City had approved Defendant's evacuation plan.
8. On or about February 27, 1990 the Department sent Defendant a citation to
appear on April 6, 1990 to determine whether to initiate license revocation proceedings
due to its failure to have an approved plan or shelter. On or about April 5, 1990 the
prehearing conference was continued indefinitely
9. On or about May 22, 1990 Defendant was notified by certified letter that the
prehearing conference was rescheduled for June 1, 1990 runless municipal approval was
received prior to that date. is
10. On or about August 15, 1990 the Commissioner sent out a Notice of and
Order for Hearing for a contested case before an administrative law judge in the matter.
11. On or about August 17, 1990 the Department moved for summary judgment in
the contested case proceedings.
12. On or about November 2, 1990 Administrative Law Judge ( "ALJ ") Howard L.
Kaibel, Jr., issued his recommendation for summary judgment for the Department as
follows:
IT IS HEREBY RECOMMENDED:
(1) That the Motion for Summary Judgment be GRANTED and
that disciplinary action be taken against the license of Hutch
Incorporated.
(2) That the final disposition of this matter by the Commissioner of
Health be stayed thirty (30) days to permit the Licensee to apply
for judicial review of the decision of the City of Hutchinson.

(3) That if the Licensee seeks judicial review of the City's decision
that the Commissioner of Health. stay her final decision
indefinitely pending a judicial determination.
(4) That the Commissioner direct Licensee to name her as a party
in any action for judicial review, to ensure that the litigation is
expeditiously prosecuted.
13. On or about April 8, 1991 Acting Commissioner of Health Mary Jo O'Brien
issued the Commissioner of Health's Order. Based upon her review of the entire record,
the Commissioner ordered:
1. The commissioner hereby adopts paragraphs
numbers (1), (2) and (3) and the accompanying memorandum of
the November 2, 1990 recommendation of Judge Howard
Kaibei, which is attached hereto and incorporated herein.
2. Hutch, Inc. shall inform the commissioner on a
monthly basis as to the status of its negotiations with the City of
Hutchinson. The status reports shall specifically describe what
steps have been taken toward resolution of the dispute over
approval of the evacuation plan. This first report shall be
subminCad 30 days from the effective date of this order. Reports
shall be addressed to Thomas Maloy, Assistant Commissioner,
Minnesota Department of Health, and copies shall be provided
• to the following parties:

3. If, based on status reports submitted by Hutch or
other information available to the Commissioner, the
Commissioner determines that reasonable efforts are not being
made to resolve the dispute with the city of Hutchinson, the

Commissioner will immediately issue a final decision in this
matter.
14. By letter of May 13, 1991 from Mr. W.R. Block ( "Mr. Block ") president of is
Defendant to Mr. Charles B. Schneider ( "Mr. Schneider ") Chief of the Environmental Field
Services Section of the Department, Mr. Block enclosed a copy of correspondence from the
City documenting the City's April 23, 1991 approval of an evacuation plan for six months
with a review at the end of the time limit.
15. By letter of June 14, 1991 Mr. Barry Anderson ( "Mr. Anderson ") attorney for
the City advised the Department the City was revoking its approval of the evacuation plan.
16. By letter dated August 12, 1991 Defendant's counsel sent the Department's
counsel modifications to the evacuation plan which he indicated were to be approved by
the City August 13,1991. The plan was to terminate on November 1, 1991.
17. On December 13, 1991 the Department received a copy of a resolution and a
letter of transmittal from Mr. Anderson to Gary D. Plotz, Hutchinson City Administrator
dated December 11, 1991. The resolution directs Defendant to provide a temporary •
evacuation plan no later than February 11, 1992 and to present plans and specifications for
the construction of a permanent shelter no later than February 11, 1992.
18. In a letter dated March 11, 1992 from Mr. Anderson, the Department was
informed that Mr. Block and Defendant had failed to present any evacuation plan or plans
for shelter to the city as previously directed. The City asked that the Department proceed
swiftly on this matter.
19. By a letter dated March 23, 1992 from the City the Department received an
executed copy of Resolution No. 9679 adopted by the City on March 10, 1992 as follows:
This resolution is adopted by the Hutchinson City
Council on the 10th day of March, 1992.
RECITALS:
1. Hutch, Inc. and its principal, W.R. Block, have
advised the City that an evacuation plan as required by law
would be in place by the time of the City Council's first meeting
in February, 1992; •

2. Neither Hutch, Inc. nor its principals have advised
the City of any evacuation plan or of any shelter for its residents;
3. The City is concerned that the absence of any plan
to evacuate the residents of Country Club Terrace safety is
detrimental to the health and welfare of the City of Hutchinson;
NOW THEREFORE, BE IT RESOLVED by the
Hutchinson City Council that the City ttorney is directed to
advise the State of Minnesota of the failure of Hutch, Inc. and
its pprincipal to comply with the requirements to provide a storm
shelter and evacuation plan.
20. On or about April 27, 1992 Commissioner of Health Marlene E. Marschall
entered her Order. By her Order, the Commissioner ordered:
1. Hutch, Ine.'s license to operate a manufactured home
park, license #0278, is revoked.
2. Minnesota Department of Health staff are authorized to
take appropriate enforcement measures.
3. In the event that Hutch, Inc. comes into compliance with
M.S. 327.20, it may apply for licensure pursuant to
Chapter 327.
• 21. Defendant made no motion to the Commissioner for reconsideration of her
April 27, 1992 Order pursuant to Minn. Stat. S 14.64 (1990) nor did Defendant seek stay of
her Order from the Commissioner pursuant to Minn. Stat. S 14.65 (1990).
22. Defendant did not appeal the Commissioner's Order and the time for appeal
of said Commissioner's Order has expired pursuant to Minn. Stat. S 14.63 (1990).
CONCLUSIONS OF LAW
1. By its conduct as found above Defendant has violated Minn. Stat. S 327.20
subd. 1(7) (1990), and Defendant's license to own and operate the Park has been duly
revoked by the Commissioner pursuant to Minn. Stat. S 327.18 (1990). Defendant has not
appealed said revocation and the time to appeal has expired. Defendant's continued
operation of the Park is unlawful pursuant to Minn. Stat. S 327.15 (1990) and is subject to
abatement in this action pursuant to Minn. Stat. S 327.24 subd. 1 (1990).

2. By its conduct as found above Defendant has violated a health and safety code
applicable to the Park as described in Minn. Stat. 5566.18 subd. 6 (1990) which the 40
Department is charged with enforcing pursuant to Minn, Stat. S 566.20 (1990). On or about
January 18, 1989 the Department informed Defendant of the violation and directed
Defendant to correct the violation by March 1, 1989; the Department by inspection report
dated August 23, 1989 again informed Defendant of the need to correct the violation.
Defendant has been given a reasonable period of time to correct the violation pursuant to
Minn. Stat. S 566.19 (1990). Pursuant to Minn. Stat. SS 566.25and 566.29 (1990) this Court
is authorized to appoint an administrator to receive and collect the rents from the residents
of the Park and pay from said funds for the construction of a safe shelter for the residents
of the Park in correction of said violation.
3. Minn. Stat. S 8.01 (1990) and the common law parens ap triae powers of the
Attorney General authorize the Attorney General to appear for the state in this cause
when in the opinion of the Attorney General the interests of the state require it.

4. By its conduct as found above Defendant has placed the health and safety of
the citizens of this state residing in the Park in continuing jeopardy. The interests of the
• state require that said conduct cease and that all steps necessary to provide the residents of
the Park with safe shelter be ordered by this Court.
WHEREFORE, this court hereby orders that judgment be entered on behalf of
plaintiffs as followss:
I. Declaring:
A. Defendant's conduct found above to be in violation of Minn. Stat. S 327.20
subd. 1(7), 327.15, and 327.24, subd. 1(1990); and
B. Defendant's conduct found above to be in violation of Minn. Stat. S 566.16,
566.20 (1990) and to require the appointment by this Court of an administrator pursuant to
Minn. Stat. 55 566.25 and 566.29 (1990) with all the powers set forth therein.
C. Defendant's conduct found above has placed the health and safety of the
citizens of this state residing in the Park in continuing jeopardy. The interests of the state
is require that said conduct cease and that the residents of the Park be provided with safe
shelter; and
I1. Temporarily and permanently restraining and enjoining defendant, its
employees, agents, successors, assigns, affiliates, divisions, and all other persons acting in
concert or participation with them from unlawfully operating the Park or receiving the
rents therefrom; and
11I, Appointing the City of Hutchinson as administrator pursuant to Minn. Stat.
SS 566.25(c) and 566.29 (1990) to collect the rents front the residents of the Park and-pay
from said funds for the construction of a safe shelter for the residents of the Park.
IV. Directing that all rents due on and from the day of service of judgment on the
residents of the Park be deposited with the Administrator.

V. Directing the Administrator to use the rents collected for the purpose of
remedying the violations found to exist by the Court,i.e, failure to provide storm shelters .
and further, allowing said Administrator to pay the debt service, taxes and insurance, and
provide services necessary to the ordinary operation and maintenance of the Park which
defendant is obligated to provide but fails and refuses to provide.
VI. Ordering defendant to provide to the Admindstrator all paperwork, information
and documents necessary to allow the Administrator to carry out the duties as ordered by
US Court.
VII. Granting the plaintiffs such other, further, or different relief, whether legal or
equitatle, as this Court deems proper, together with judgment against defendant for costs,
disbursements, and reasonable attorney fees incurred on behalf of plaintiffs herein.

Dear Mr. Anderson:
I am in receipt of the Order prepared by Mr. Paul Zerby and I am
convinced that I am a target for harassment by the State of
Minnesota and in particular Mr. Zerby. What the Order fails to
recognize is that the shelter is built. In addition, all invoices
have been paid. The roofing will be complete by Tuesday October
26. That invoice will be paid when received. The appointment of
a receiver /administrator to construct and pay for a shelter is
obviously ridiculous. It's done.
• For your information and I'm sure that you will recall since you
were there, the plans for the shelter were discussed at a City
Council meeting. The fact that it was sized for 80% of the maximum
population was also discussed at length. I mentioned a study by
the City of Lakeville on a Mobile Home Park called Ardmore. In the
study the City did a traffic count; to determine the number of
people: actually in the park. A time of 7:00 pm was selected by the
City as that time when a maximum amount of people would be at home.
The result was 75% of the maximum population were in their homes.
I chose 80% as a reasonable number. ,The City Council agreed with
that number and issued the building permit that evening.
Furthermore, since the storm shelter structure was complete (not
including the roofing material) two storm sirens have sounded.
According to my manager, in both instances less than 100 people
utilized the shelter.
l To further litigate this matter is ridiculous. I am being forced
to pay attorney fees for nothing. why on God's Green Earth would
the City accept the administrative duties called for in the Order
when it is clear that the issue is resolved. The City should

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MN:
FINDINGS
1. Mr. George Lee, has made application to the City Council
for a Conditional Use Permit under Section 6.07 of Zoning Ordinance
No. 464 to construct a 30'x36' pole building on a lot without a
principal structure located at 72 Arch St with the following legal
description:
Legal description: Lots Two(2), Three (3) and Four(4) in
Block Two (2) in the Townsite of
Hutchinson South Half, being in the
Northeast Quarter of Section 6, Township
116, Range 29
2. The City Council has considered the recommendation of the
Planning Commission and the effect of the proposed use on the
health, safety, and welfare of the occupants of the surrounding
lands, existing and anticipated traffic conditions, and the effect
on values of properties in the surrounding area and the effect of
the use on the Comprehensive Plan.
3. The Council has determined that the proposed use will not
be detrimental to the health, safety, or general welfare of the
community nor will it cause serious traffic congestion nor hazards,
nor will it seriously depreciate surrounding property values, and
the proposed use is in harmony with the general purpose and intent
of the Zoning Ordinance and the Comprehensive Plan.
CONCLUSION
The application for Conditional Use Permit for the purpose
designated is granted based on the findings set forth above subject
to requirements by staff that the building be not more than 1000
sq. ft., a pole building is not permitted and elevation
requirements must be met.

The Downtown Design Review Committee requests a change to the City
of Hutchinson's Zoning Ordinance limiting to 45 days the time a
banner can be left on a building.
The Downtown Design Review sees the importance of banners
announcing special events, but has seen some banners being left up
for over a year. We feel that 45 days should be a sufficient
amount of time for a banner to be left up. We also feel that this
change should be citywide.

FINDINGS
1. Robert Grambow, 567 Lynn Rd, has applied for a variance
from Section 7 of Zoning Ordinance No. 464 to reduce the driveway
setback from 5' to 1' located at 567 Lynn Rd with the following
legal description:

LINDER BUS COMPANY FOR THE CONSTRUCTION OF A BUS
WAREHOUSE LOCATED IN 1ST ADDITION TO HUTCHINSON
INDUSTRIAL DISTRICT
Pursuant to Section 6.07, of Zoning Ordinance No. 464, the
Hutchinson Planning Commission is hereby submitting its findings of
fact and recommendation with respect to the aforementioned request
for a conditional use permit.
HISTORY
On September 30, 1992, Linder Bus Company Inc., Hutchinson,
submitted an application for a conditional use permit to allow them
to construct a 135' x 180' bus warehouse located in 1st Addition to
• Hutchinson Industrial District. A public hearing was held at a
regular meeting of the Planning Commission on Tuesday, October 20,
1992, at which time there was no one present who objected to the
request.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee
paid.
2. Notices were mailed to the surrounding property owners as well
as published in the Hutchinson Leader on Thursday, October 8,
1992.
3. The proposal is in conformance with the requirements of a
conditional use permit.
RECOMMENDATION
It is the recommendation of the Planning Commission that the
aforementioned request be granted as set forth above subject to
meeting the requirements by staff as follows hardsurfaced parking,
1 per every 2,000 sq. ft (approx. 13 stalls) and the boulevard,
flammable waste trap, and moving the building closer than 150'to
roadway. The floor on the inside of the building is to be
hardsurfaced over the next 5 years.

2. The City Council has considered the recommendation of the
Planning Commission and the effect of the proposed use on the
health, safety, and welfare of the occupants of the surrounding
lands, existing and anticipated traffic conditions, and the effect
on values of properties in the surrounding area and the effect of
the use on the Comprehensive Plan.
CONCLUSION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MNS
1. Mr. Leslie Linder, Linder Bus Company, has made
application to the City Council for a Conditional Use Permit under
Section 6.07 of Zoning Ordinance No. 464 to construct a 135'x180'
bus warehouse located in 1st Addition to Hutchinson Industrial
District with the following legal description:

3. The Council has determined that the proposed use will not
be detrimental to the health, safety, or general welfare of the
community nor will it cause serious traffic congestion nor hazards,
nor will it seriously depreciate surrounding property values, and
the proposed use is in harmony with the general purpose and intent
of the Zoning Ordinance and the Comprehensive Plan.
The application for Conditional Use Permit for the purpose
designated is granted based on the findings set forth above subject
to requirements by staff as follows: hardsurfaced parking, 1 per
every 2,000 sq. ft. (approx. 13 stalls) and the boulevard access,

In response to McLeod County's proposed 0 -1 mile urban expansion zone around
Hutchinson, it is our recommendation to the Hutchinson Planning Commission /City
Council to deny the zone as proposed.

The City of Hutchinson's Comprehensive Plan has similar language of which we
previously tried to coordinante with the adjacent townships, with little
success.
We invite you to Hutchinson's October 20, 1992, 5:30 pm. Planning Commission
meeting at City Hall to discuss this matter further.
Please note that urban expansion boundries are very important to Hutchinson,
especially from an economic perspective. Extension of City services past
township parcels of which are not assessable can potentially create extreme
deferred and direct costs to Hutchinson's constituency. With the 90'3 being
forecasted as tough economic times, we all must plan and develop effectively.
We look forward to discussing this matter with you on October 20, 1992.

SUBJECT: Comprehensive Plan; Municipal- Township Fringe Development
The McLeod County Planning Commission has requested me to organize
efforts to establish an Urban Fringe Boundary around each
municipality. It is recommended that to ensure the highest quality
of future development, there should be close communication and
coordination between the cities and the townships in the
development of the acres adjacent to existing city limits.
The Urban EXpane;nn 2nne may encomp an area within 0 to 1 mile
of the city limits. The boundaries should be established by an
agreement between the township, city, and the county. However, if
a mutual agreement is unobtainable, the Planning Commission will
meet with both city and township officials to serve as an
arbitrator to establish the boundary.
I have enclosed a copy of the policy recommendations for Municipal
Fringe Development and a map that I would like you to use and
return once you have identified the boundary of your choice,

POL ICY RECOMMENDATIONS
INTRODUCTION
This section of the Plan describes the proposed objectives, recommendations and
policies which have been developed for McLeod County in response to the issues,
concerns, and goals identified during the review and analysis stages of the
1 planning process. The following pages are intended to serve as a guide for the
future development of land in the County and to serve as a reference for the
amendments to the zoning and subdivision regulations which will be necessary.
The recommended land use pattern in McLeod County is illustrated in Figure 4.
1 The topics addressed include: Municipal Fringe Development; Agricultural
Preservation; Environmental Concerns; and Development Ordinance Provisions and
Administration.
MUNICIPAL FRINGE DEVELOPMENT
Objectives
Based upon the foregoing analysis and the stated goal for the municipal fringe,
the following objectives have been identified:
• Encourage residential, commercial, and industrial development within muni-
cipalities, where services are available.
• Allow residential, commercial or industrial development on the fringes of
the cities in a manner which:
1. Is consistent with city plans for street and drainage rights -of -way.
} 2. Is consistent with city land use planning.

Recommendations
To ensure the highest quality future development, there should be close communi-
cation and coordination between the cities and the townships in the development
of the areas adjacent to existing city limits.
Urban Expansion Zone
The existing Urban Expansion Zone of the McLeod County Zoning Ordinance should
be revised to better facilitate its intended purpose of coordinating the transi-
tion between urban and rural areas of the County.
The zone would generally encompass all areas within one mile of the city limits
of Hutchinson and all areas within 1/2 mile of the city limits of the other
cities in the County. Adjustments in these boundaries may be necessary and
should be established by agreement between the City, the Township, and the
County. This concept is illustrated in Figure 5.
Cities should be encouraged to develop plans for the extension of collector and
arterial streets, drainage ditches, and utilities within one mile (or 1/2 mile
as appropriate). Township development should respect and not encroach on these
identified future rights -of -way.
Permitted Uses:

residential uses.

It would be required that the structure be located on one of the potential
future lots, and not straddling two or more of the potential lots. Minimum lot
width would be 300 feet. An example of this is shown in Figure 6.
As an alternative to the straight minimum lot size requirement described above,
the County would allow the equivalent number of lots (either one per ten acres
or four per ten acres), but allow the houses to be clustered onto lots as small
as 10,000 square feet as long as (1) adequate septic tank fields and backup
sites are created and (2) the balance of the site is "ghost - platted• for econo-
mical future resubdlvislon.
Communication
The County should continue to invite City review of subdivision requests within
the Urban Expansion Zone to encourage coordination.
Municipalities should initiate contact with the adjacent Township boards to
discuss growth and development issues of mutual concern. Meetings between these
governmental bodies should be held at least annually.
Annexation
Municipalities should continue their present practices of considering annexa-
tions only when petitioned, although plans should be in place for the delivery
of municipal services to areas adjacent to the City.
AGRICULTURAL PRESERVATION
Objectives
The following objectives have been developed to further the goal of protecting
the long -term viability of farming:
e Protect prime agricultural lands from non -farm developments and intrusions.
a Allow limited non -farm development provided the impacts on agricultural
land and activities are minimized.

j Recommendations
The County's Zoning Ordinance and Subdivision Regulations should be amended to
reflect a commitment to the preservation of its prime agricultural resources,
while also allowing for limited non -farm development.
Agricultural Protection Area
An Agricultural Protection Area, similar to one 1
Minnesota, since 1977, should be a areas outside the Urban

Dear Gary:
• At the request of the City Council I am writing to you today to
advise you of the procedure that must be followed to properly
suspend or revoke a liquor license issued to a licensee.
In recent years, federal courts have emphasized the need for due
process in licensing and revocation hearings. It is not enough to
reach a conclusion that a violation has occurred and to simply
order the closing of the business based on the alleged violation,
unless there are serious health considerations that must be
addressed.
The City's procedure in this matter is generally set out in
Ordinance Code Section 5.02, a copy of which is enclosed with this
correspondence.
As you can see from paragraph G of Section 5.02, Subdivision 4, the
licensee is entitled to a hearing before the Council and notice
must be given in writing to the licensee by the Council not less
than 15 nor more than 30 days prior to the hearing date, and the
notice must state the time, place and purpose of the hearing.
The licensee would have the right to cross examine any witnesses
who testify against the licensee and the licensee would also have
the right to produce witnesses in his or her behalf.
_— Notice of the hearing should specify the specific grounds relied
,qw- upon by the City to request revocation of the license.

The term "restaurant" is defined in our ordinance as an
establishment, other than a hotel, "under the control of a single
proprietor or manager, where meals are regularly served at tables
to the general public, and having seating capacity for at least 85
guests."
The Council will be charged with the responsibility of ultimately
deciding whether or not the license should be revoked and, of
course, the license holder would have the right to appealing an
adverse decision.

22. "Wholesaler" means any person engaged in the.business
of selling alcoholic beverages to a licensee from a stock
maintained in a warehouse.
23. "Wine" means a beverage made without rectification or
fortification by the fermentation of sound ripe grapes, grape
juice, other fruits, or honey, and also carbonated wine, wine made
from condensed grape must, wine made from other agricultural
products, imitation wine, compounds sold as wine, vermouth, cider,
perry and sake, containing not less than one -half of one percent
nor more than fourteen percent alcohol by volume. (This definition
includes so- called "wine coolers" with the alcoholic content limits
stated herein.)
SEC. 5.02. APPLICATIONS AND LICENSES UNDER THIS CHAPTER -
DQRE AND ADMINISTRATION.
Subd. 1. Application. All applications shall be made at
the office of the City Administrator upon forms prescribed by the
City, or if by the Commissioner, then together with such additional
information as the Council may desire. Information required may
vary with the type of business organization making application.
All questions asked or information required by the application
forms shall be answered fully and completely by the applicant.
Every application for the issuance or renewal of an alcoholic
beverage license must include a copy of each summons received by
the applicant during the preceding year under Minnesota Statutes,
Section 340A.802.
Subd. 2. False Statements. It is unlawful for any
applicant to intentionally make a false statement or omission upon
any application form. Any false statement in such application, or
any willful omission to state any information called for on such
application form shall, upon discovery of such falsehood, work an
automatic refusal of license, or if already issued, shall render
any license issued pursuant thereto void and of no effect to
protect the applicant from prosecution for violation of this
Chapter, or any part thereof.
Subd. 3. Application and Investigation Fees. At the
time the initial application is made, an applicant for a license
under this Chapter shall accompany such application with payment of
a fee to be considered an application and investigation fee, not
refundable to the applicant, to cover the cost of the City in
processing the application and the investigation of the applicant.
No such fee shall be required of an applicant for a temporary beer
license.
Subd. 4. Action.
A. Hearing. Prior to granting an initial liquor
license, a public hearing shall be held by the Council after notice
by at least one publication in the official newspaper at least ten

(10) days prior to such hearing. Opportunity shall be given any
�} person to be heard for or against granting the license. After such
hearing, the Council may, in its discretion, grant or refuse such
license. A public hearing may be held, but is not required, on
renewal liquor licenses and other licenses under this Chapter.
B. Granting. The Council may approve any
application for the period of the remainder of the then current
license year or for the entire ensuing license year. All
applications including proposed license periods must be consistent
with this Chapter. Prior to consideration of any application for a
license, the applicant shall pay the license fee, and if
applicable, pay the investigation fee. Upon rejection of any
application for a license, or upon withdrawal of an application
before consideration by the Council, the license fee shall be
refunded to the applicant. Failure to pay any portion of a fee
when due shall be cause for revocation.
C. Issuing. If an application is approved, the
City Administrator shall forthwith issue a license pursuant thereto
in the form prescribed by the City or the Commissioner, as the case
may be, and upon payment of the license fee. All licenses shall be
on a calendar year basis unless otherwise specified herein. For
licenses issued and which are to become effective other than on the
first day of the licensed year, the fee to be paid with the
application shall be a pro rata share of the annual license fee.
l Licenses shall be valid only at one location and on the premises
therein described.
D. Transfer. No license shall be transferable
between persons. Any change in individual ownership,
incorporation, or substitution of partners is a transfer. No
license shall be transferable to a different location without prior
consent of the Council and payment of the fee for a duplicate
license. It is unlawful to make any transfer in violation of this

the licensee has failed to comply with a statute, regulation or
qlr!' provision of the City Code relating to alcoholic beverages. The
Council shall revoke the license upon conviction of any licensee or
agent or employee of a licensee for violating any law relating to
the sale or possession of beer, wine or liquor upon premises of the
licensee, or if such revocation is mandatory by Statute. If it
shall be made to appear at the hearing thereon that such violation
was not willful, the Council may order suspension; provided that
revocation shall be ordered upon the third such violation or
offense. No suspension or revocation shall take effect until the
licensee has been afforded an opportunity for a hearing before the
Council, a committee of the Council, or a hearing under the
Administrative Procedures Act, as may be determined by the Council
in action calling the hearing. Such hearing shall be called by the
Council upon written notice to the licensee served in person or by
certified mail not less than fifteen nor more than thirty days
prior to the hearing date, stating the time, place and purpose
thereof. As additional restrictions or regulations on licensees
under this Chapter, and in addition to grounds for revocation or
suspension stated in the City Code or Statute, the following shall
also be grounds for such action: (1) that the licensee suffered or
permitted illegal acts upon licensed premises unrelated to the sale
of beer, wine or liquor; (2) that the licensee had knowledge of
such illegal acts upon licensed premises, but failed to report the
same to police; (3) that the licensee failed or refused to
• l cooperate fully with police in investigating such alleged illegal
1 acts upon licensed premises; or, (4) that the activities of the
licensee created a serious danger to public health, safety, or
welfare.
H. Corporate Applicants and Licensees. A corporate
applicant, at the time of application, shall furnish the City with
a list of all persons that have an interest in such corporation and
the extent of such interest. The list shall name all shareholders
and show the number of shares held by each, either individually or
beneficially for others. It is the duty of each corporate licensee
to notify the City Administrator in writing of any change in legal
ownership, or beneficial interest in such corporation or in such
shares. Any change in the ownership or beneficial interest in the
shares entitled to be voted at a meeting of the shareholders of a
corporate licensee, which results in the change of voting control
of the corporation by the persons owning the shares therein, shall
be deemed equivalent to a transfer of the license issued to the
corporation, and any such license shall be revoked thirty days
after any such change in ownership or beneficial interest of shares
unless the Council has been notified of the change in writing and
has approved it by appropriate action. The Council, or any officer
of the City designated by it, may at any reasonable time examine
the stock transfer records and minute books of any corporate
licensee in order to verify and identify the shareholders, and the
Council or its designated officer may examine the business records
of any other licensee to the extent necessary to disclose the

interest which persons other than the licensee have in the licensed
business. The Council may revoke any license issued upon f is
determination that a change of ownership of shares in a corporate
licensee or any change of ownership of any interest in the busi
of any other licensee has actually resulted in the change of
control of the licensed business so as materially to affect tie
integrity and character of its management and its operation, but ao
such action shall be taken until after a hearing by the Council an
notice to the licensee.
Subd. S. Duplicate Licenses. Duplicates of all origimal
licenses under this Chapter may be issued by the City Administrator
without action by the Council, upon licensee's affidavit that the
original has been lost, and upon payment of the fee adopted by
resolution of the Council for issuance of the duplicate. Aal
duplicate licenses shall be clearly marked DUPLICATE.

Subd. 6. Posting. All licensees shall conspicuously
post their licenses in their places of business.
Subd. 7. Resident Manager or Agent. Before a license is
issued under this Chapter to an individual who is a non - resident of
the City, to more than one individual whether or not they aze
residents of the City, or to a corporation, partnership, mr
association, the applicant or applicants shall appoint in writing a
natural person who is a resident of the City as its manager ar
agent. Such resident manager or agent shall, by the terms of tds
written consent, (1) take full responsibility for the conduct of
the licensed premises, and, (2) serve as agent for service_ of
notices and other process relating to the license. Such manager �zr
agent shall be subject to an investigation and shall be a person
who, by reason of age, character, reputation, and other attributes,
could qualify individually as a licensee. If such manager or agem t
ceases to be a resident of the City or ceases to act in such
capacity for the licensee without appointment of a successor, tie
license issued pursuant to such appointment shall be subject to
revocation or suspension.
Subd. S. Persons Disqualified.
A. No license under this Chapter may be issued.tm:
(1) a person not a citizen of the United States or a residemt
alien; (2) a person who within five years of the license
application has been convicted of a willful violation of a Federal
or State law, or local ordinance governing the manufacture, saLe,
distribution, or possession for sale or distribution, of alcoholic
beverages; (3) a person who has had an alcoholic beverage license
revoked within five years of the license application, or to amy
person who at the time of the violation owns any interest, whethEer
as a holder of more than five percent of the capital stock of a
corporate licensee, as a partner or otherwise, in the premises ar
in the business conducted thereon, or to a corporation,

partnership, association, enterprise, business, or firm in which
any such person is in any manner interested; (4) a person under the
age of twenty -one years; or, (5) a person not of good moral
character and repute.
B. No person holding a license from the
Commissioner as a manufacturer, brewer or wholesaler may have any
ownership, in whole or in part, in a business holding an alcoholic
beverage license from the City.
SEC. 5.03. RENEWAL LICENSE APPLICATIONS. Applications for
renewal of all licenses under this Chapter shall be made at least
sixty (60) days prior to the date of expiration of the license, and
shall contain such information as is required by the City. This
time requirement may be waived by the Council for good and
sufficient cause.
SEC. 5.04. DELINQUENT TAXES AND CHARGES. No license under
this Chapter shall be granted for operation on any premises upon
which taxes, assessments, or installments thereof, or other finan-
cial claims of the City, are owed and are delinquent and unpaid.
SEC. 5.05. PARKING REQUIREMENTS. No initial license shall be
granted for operation on premises unless such premises include a
surfaced off - street parking area within 100 feet of a public
entrance and have a parking capacity of one car space for each
�I three people of seating capacity. Such off - street parking area
shall be owned or leased by the owner of said premises.
SEC. 5.06. CONDITIONAL LICENSES. Notwithstanding any provi-
sion of law to the contrary, the Council may, upon a finding of the
necessity therefor, place such special conditions and restrictions,
in addition to those stated in this Chapter, upon any license as
it, in its discretion, may deem reasonable and justified.
SEC. 5.07. PREMISES LICENSED. Unless expressly stated
therein, a license issued under the provisions of this Chapter
shall be valid only in the compact and contiguous building or
structure situated on the premises described in the license, and
all transactions relating to a sale under such license must take
place within such building or structure.
SEC. 5.08. UNLAWFUL ACTS.
Subd. 1. Consumption. It is unlawful for any person to
consume, or any licensee to permit consumption of, alcoholic
beverages on licensed premises after the hour when a sale thereof
can legally be made.
Subd. 2. Removal of Containers. It is unlawful for any
on -sale licensee to permit any glass, bottle or other container,
containing alcoholic beverages in any quantity, to remain upon any
- table, bar, stool or other place where customers are served, after
the hour when a sale thereof can legally be made.

MINUTES
Twenty members were present at the September 28, 1992
Hutchinson Safety Council meeting held at the Heritage
Center.
George Field called the meeting to order. The minutes were
approved as submitted with exception of correction of
today's meeting date of September 28th instead of September
27th. Bills were submitted: $23.73 to Allen Office for an
expanding file and $29.00 to Joyce Rix for postage. John
Rodeberg moved that the bills be paid as submitted; Myron
Johnson seconded and the motion carried unanimously.
John Rodeberg presented a Construction Status Report
concerning projects in progress and also reported on the
gosoline spillage incident at Erickson's. Everyone worked
together to contain the gasoline resulting in the Minnesota
Pollution Control Agency commending the agencies responsible
for their swift and appropriate action.
George Field reported on the Farm Health /Safety Booth at the
McLeod County Fair which had a PTO demonstration. The
Safety Council will provide the PTO tape to organizations
requesting. (two thus far). George would like to see that
Farm Safety be stressed in the schools to reach both

installed at the intersection of Bluff Street and Highway 7.
Les Smith reported that he has a safety pamphlet on how to
properly install electric fences and will try to bring to
the next meeting.
Greg Curry will be asked to speak about security systems at
