TUESDAY, SEPTEMBER 12, 1989
1. The meeting was called to order by Mayor Ackland at 7:30 P.M. The follow-
ing were present: Mayor Paul L, Ackland, Aldermen Mike Carls, John Mlinar,
Marlin Torgerson and Pat Mikulecky. Also present: City Administrator Gary
D. Plotz, Consultant Engineer Marlow V. Priebe, and City Attorney G. Barry
Anderson.
2. INVOCATION
The invocation was given by the Reverend Donald Kinzer.
3. MINUTES
The minutes of the regular meeting of August 22, 1989 and bid opening of
September 5, 1989 were approved as distributed.

PROJECT COORDINATOR
Coordinator Connie Mangan reported on the progress of the Hutch Hotel
project and the results of the housing study.

The motion was made by Alderman Mlinar, seconded by Alderman Torgerson
and unanimously carried, to waive reading and adopt.
(b) ORDINANCE NO. 89 -06 (REVISED FORMAT) - AN ORDINANCE OF THE CITY OF
HUTCHINSON, MINNESOTA, AMENDING CITY CODE CHAPTER 4 ENTITLED "CONSTRUC-
TION LICENSING, PERMITS AND REGULATIONS ", BY ADDING A PROVISION RELATING

The motion was made by Alderman Torgerson, seconded by Alderman Miku- •
lecky and unanimously carried, to waive first reading of the amended re-
vised format and set second reading for September 26, 1989.
(c) ORDINANCE 10. 89 -07 - AN ORDINANCE AMENDING ORDINANCE 10. 464
CONCERNING ZONING REGULATIONS IN THE CITY OF HUTCHINSON AND THE
OFFICIAL ZONING MAP (ROBERT HORNICK PROPERTY - 434 MAIN STREET I.)
The notion was made by Alderman Mikulecky, seconded by Alderman Torger-
son, to waive second reading and adopt. During discussion it was
pointed out that the ordinance should not be adopted before the con-
struction began on September 1, which had not happened to date. Alder-
man Mikulecky withdrew his notion, and Alderman Torgerson withdrew his
second to the motion.
The notion was made by Alderman Torgerson to defer until the neat City
Council meeting of September 26, 1989. Motion seconded by Alderman
Mlinar and unanimously carried.
(d) ORDINANCE 10. 89 -08 - AN ORDINANCE VACATING A PORTION OF CAROLINA
AVENUE IR HELLAND'S SIXTH ADDITION
The notion was made by Alderman Torgerson, seconded by Alderman Mlinar
and unanimously carried, to waive second reading and adopt.
8. UNFINISHED BUSINESS
(a) REPORT ON PART I, PHASE I OF DOVNTOVH SPRINKLING SYSTEM PROJECT •

Consultant Engineer Priebe reported on the sprinkling project. It was
his recommendation to hold three informational meetings with property
owners /tenants at Peter's Restaurant on September 26 at 2:00 P.M. and
September 27 A 28 at 7:00 P.M.
Ho action was taken, but the Council concurred with the meetings.
(b) REPORT 01 TRUCK TRAFFIC ALONG MCLEOD AHD SIXTH AVENUE H.E. TO /FROM
BREMIX CONCRETE COMPANY
The originator of the truck route petition requested the Council to act
on it. The Consultant Engineer presented his report. Following dis-
cussion, Alderman Torgerson moved that City staff talk with Bremix to
come up with a compromise to reduce the truck traffic. Motion seconded
by Alderman Nikulecky and unanimously carried.
9. HEY BUSINESS
(a) CONSIDERATION OF INSURANCE CONSULTANT'S RECOMMENDATIONS REGARDING
EMPLOYEE INSURANCES AND AUTHORIZATION TO SUBMIT QUESTION ON EMPLOYEE
INSURANCES TO EMPLOYEE VOTE
. Insurance Consultant Mark Flaten and Agent Dennis Potter presented a
report on Plan A and Plan B insurance recommendations. Several City
employees expressed opposition to the proposed insurance plan(s).
Following discussion, Alderman Mlinar moved to reactivate the Employee
Benefit Committee to meet and discuss the issues. Notion seconded by
Alderman Torgerson and unanimously carried. Alderman Torgerson volun-
teered to serve with Mayor Ackland on the committee.
(b) CONSIDERATION OF AVARDING BID FOR TVO 1990 POLICE PATROL CARS
The motion was made by Alderman Nikulecky, seconded by Alderman Torger-
son and unanimously carried, to approve and award contract to Vigen
Chevrolet for two 1990 police patrol cars for net price of $26,701.96,
with $7,264.04 trade -in on two 1987 Ford patrol cars.
(c) CONSIDERATION OF PROPOSAL BY NAVO SYSTEMS FOR ASBESTOS CEMENT REMOVAL
AT VASTEVATER TREATMENT PLANT
Following a recommendation from Mr. Charles Barger of RCN, Alderman
Torgerson moved to approve and enter into contract with Navo Systems of
Minneapolis for $7,489. Notion seconded by Alderman Nikulecky and
unanimously carried.
(d) CONSIDERATION OF CONSTRUCTION OF SIX -STALL AMBULANCE GARAGE AND
EXPANSION OF PARKING AREA AT HUTCHINSON COMMUNITY HOSPITAL
• The motion was made by Alderman Mlinar, seconded by Alderman Torgerson
and unanimously carried, to approve the request.

(e) CONSIDERATION OF SIDEWALK REPAIR
The motion was made by Alderman Mlinar, seconded by Alderman Mikulecky
and unanimously carried, to approve the repair.
(f) CONSIDERATION OF DRAINAGE PROBLEM AT 515 FRANKLIN STREET
The motion was made by Alderman Torgerson, seconded by Alderman Mlinar
and unanimously carried, to approve as recommended.
(g) CONSIDERATION OF 1990 IMPROVEMENT PROJECTS
Consultant Engineer Priebe reviewed the proposed 1990 street, water -
main, and sanitary sewer improvement projects. The Council added the
following street projects: Colorado Street from Seventh Avenue to
Eighth Avenue, Monroe Avenue from First Avenue to Fair Avenue, South
Grade Road from Dale Street to School Road (include sidewalk), and Dale
Street from South Grade Road to end of existing curb near Linden (in-
clude sidewalk).
Alderman Torgerson moved to approve the 1990 improvement projects and
hold fall hearings. Notion seconded by Alderman Xlinar and unanimously
carried. .
(h) CONSIDERATION OF FISCHER & PORTER COMPANY SERVICE CONTRACT FOR
EQUIPMENT AT WASTEWATER TREATMENT PLANT
The motion was made by Alderman Torgerson, seconded by Alderman Xlinar
and unanimously carried, to approve the service contract for $2,200 per
year.
(i) CONSIDERATION OF ABANDONMENT OF FOUR STAR LINES ROUTE 959 FROM MADISON
TO TWIN CITIES
Following discussion, Alderman Mikulecky moved to approve a donation of
$750, contingent that all 17 communities contribute to the project or
Hutchinson would withdraw its support. Motion seconded by Alderman
Xiianr and unanimously carried.
(j) CONSIDERATION OF TRAFFIC SIGNAL OR FLASHING BEACON AT T.H. 15 AND FIRST
AVENUE SOUTH
Following discussion, Alderman Carls moved to waive reading and adopt
Resolution No. 9071 requesting the State to consider as part of its
1990 projects the addition of signal lights at the three intersections
of: Third Avenue and Main Street South, First Avenue and Main Street
North, and First Avenue and Main Street South. Motion seconded by Ald-
erman Torgerson and unanimously carried. •
(k) CONSIDERATION OF COOPERATIVE CONSTRUCTION AGREEMENT N0. 66105 PROJECT

The motion to defer was made by Alderman Torgerson, seconded by Alder-
man Carls and unanimously carried.
10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
Administrator Plotz reported that a student intern will be working in
City Hail at no salary for the next three months.
The Council was informed that the individual offered the City Engineeer
position had declined the offer. Mr. Plotz was instructed to contact
the next choice from Rochester for another interview.
The filings for office closed today, and there was one candidate for
• Mayor and four candidates for Alderman.
Administrator Plotz reported that as a result of his Water Meter/Water
Billing Survey Report, he did not recommend a joint venture with the
utilities at this time.

Alderman Nlinar commented that a question was raised at the HCDC meet-
ing regarding the Hwy. 7 East project. He wondered if another hearing
would be held with the property owners.
It was suggested that Les Kouba, a Hutchinson native and nationally
recognized artist, be presented a Resolution of Appreciation at the
Arts and Crafts Festival this weekend. This will be his 15th year to
participate in it.
The motion was made by Alderman Nlinar, seconded by Alderman Torgerson
and unanimously carried, to show appreciation to Les Kouba and present
him a Resolution of Appreciation for his participation in the Hutchin-
son Arts and Crafts Festival.

Alderman Mikulecky requested that Dry Dock keep records of attendance
and revenue for future availability.

Trailer Court and stated they would be disposed of at the upcoming
City auction.

Engineer Priebe reported that the Bluff Street project was as close to
schedule as possible. The property owners have been very cooperative
with the inconvenience of construction.

1. CALL TO ORDER
The meeting was called to order by Chairman Bill Craig at 7:30 p.m. with
the following members present: Roland Ebent, Clint Gruett, El Roy Dobratz,
Marlin Torgerson, Larry Romo, Tom Lyke and Chairman Craig. Members absent: None
Also present: Building Official Jim Marka and Consulting Engineer Marlow Priebe.
2. MINUTES
Mr. Ebent made a motion to approve the minutes of the regular meeting dated
Tuesday, July 18, k989. Seconded by Mr. Romo the motion carried unanimously.
3. PUBLIC HEARINGS
(a) CONTINUATION OF REZONING BURBER KING PROPERTY FROM C -2 TO R -2
Chairman Craig reopened the hearing at 1:31 p.m. Mr. Torgerson
commented on the time schedule of the building site before September
1st. Mr. Torgerson moved to close the hearing, seconded by Mr. Romo
the hearing closed at 7:33 p.m. Mr. Torgerson made a motion to reject
the rezoning. Seconded by Mr. Romo the motion carried unanimously.
• (b) CONTINUATION OF CONDITIONAL USE PERMIT REQUESTED BY LANCE HEATON FOR A
BED AND BREAKFAST INN AT 231 ADAMS

It was the consensus of the Planning Commission to continue the
hearing until the September meeting since the Heatons were not present
to comment on the project.
(c) CONSIDERATION OF REZONING PROPERTY AT 434 MAIN ST N. FROM R -2 TO C -2
REQUESTED BY ROBERT HORNICK
Chairman Craig opened the hearing at 7:35 p.m. with the reading of
publication #4021 as published in the Hutchinson Leader on Thursday,
August 3, 1989. The request is for the purpose of considering a
request by the owner to rezone property located at 434 Main St. N.
from R -2 (Residential District) to C -2 (Commercial District).
Building Official Marka commented on Mr. Hornick's intent to close on
the property September 1, 1989. He also commented on the use of the
house as office space. Mr. Hornick stated he is considering turning
the house into a real estate office.
Mr. Torgerson voiced his concern with the possibility of moving the
house off the property in the event of a new owner in the future.
Discussion followed of the necessity of a site plan if the use is to
be office space.

Discussion followed on the new Comprehensive Plan and the possibility
of moving the house. There was some discussion on the buffer between •
C -2 and R -2 districts. Fir. Hornick stated he plans on leaving the
house as is.
Consulting Engineer Priebe commented on having an over -all site plan
to show parking space and how all the property would be developed.
Mr. Hornick commented on the survey and his suggestion to donate to
the city the northerly 20' as alley -way to act as a buffer.
Consulting Engineer Priebe commented on the city's unfavorable
Position on the alley -way. Discussion followed on the entrance to
the two businesses.
Mr. Ebent moved to close the hearing, seconded by Mr. Torgerson the
hearing closed at 7:53 p.m. Mr. Torgerson made a motion to recommend
approval of the rezoning subject to providing verification of closing
by Sept. 1, 1989, and a complete site plan and survey to the
satisfaction of city staff by the second reading of the ordinance by
City Council. Seconded by Mr. Ebent the motion carried with Mr. Romo
voting no.
(d) CONSIDERATION OF PRELIMINARY PLAT OF HELLAND'S 9TH ADDITION
Chairman Craig opened the hearing at 7:53 p.m. with the reading of
Publication #4022 as published in the Hutchinson Leader on Thursday,
August 3, 1989. The request is for the purpose of considering the
platting of a parcel of property to be known as Helland's 9th •
Addition.
Building Official Marka commented on the lot sizes.
Mr. Torgerson moved to close the hearing, seconded by Mr. Romo the
hearing closed at 7:55 p.m. Mr. Torgerson made a motion to recommend
approval of the preliminary plat to City Council. Seconded
by Mr. Romo the motion carried unanimously.
(e) CONSIDERATION OF REZONING FROM R -2 TO C -3 PROPERTY ON ADAMS ST.
REQUESTED BY CITY STAFF
Chairman Craig opened the hearing at 7:55 p.m. with the reading of
Publication #4023 as published in the Hutchinson Leader on Thursday
August 3, 1989. The request is for the purpose OT considering a
request by City Staff to rezone property located on Adams St. from R -2
(Residential District) to C -3 (Central Commercial).
Mr. Everett Reisberg, 136 Monroe, voiced opposition to the rezoning of
so many lots and asked why the city couldn't rezoning only Lot 8 in
Block 24. Chairman Craig explained a restaurant has to conform to
that I lot would be

as to rebuildingRresidengtialmhomes 1n
the district. Building Official Marka stated through Conditional Use
Permit application residential could be built. He also commented that

staff feels the area is not condusive to a C -3 district.
• Leslie Smith, 346 Monroe, voiced concern of how far the rezoning will
go in the future and asked to define C -1, C -2 as opposed to C -3
district. Building Official Marka explained the differences in the
zoning districts. Consulting Engineer Priebe commented on IC -1 as a
more controled zone. Chairman Craig read the definitions from the zoning
ordinance book and stated Block 36 is not intented to be rezoned.
Discussion followed on the possibility of R -3 zoning being more
condusive to the area.
Mr. Romo made a motion to continue agenda items 3(b) and 3(e) to the
September 19 meeting. Seconded by Chairman Craig the hearing will be
continued.
(f) CONSIDERATION OF VACATING A PORTION OF CAROLINA AVE. REQUESTED BY CITY
STAFF IN HELLAND'S 6TH ADDITION
Chairman Craig opened the hearing at 8:05 p.m. with the reading of
publication #4024 as published in the Hutchinson Leader on Thursday,
August 3, 1989, and Tuesday, August 8, 198�Fe request is for the
purpose of considering a petition by city staff to vacate a part of
Carolina Ave. located in Helland's 6th Addition.
Building Official Marka explained the vacation request and the
• proposed parkland in Helland's 6th Addition. Mr. Lyke commented on
utility services to that area.
Consulting Engineer Priebe stated there should be a 20' utility
easement centered from street right -of -way of westerly 120' of
vacation.
Mr. Ebent moved to close the hearing, seconded by Mr. Torgerson the
hearing closed at 8:15 p.m. Mr. Torgerson made a motion to recommend
approval subject to a 20' utility easement to the satisfaction of the
Utilities Commission. Seconded by Mr. Ebent the motion carried
unanimously.
4. NEW BUSINESS
(a) PRESENTATION AND ADOPTION OF COMPREHENSIVE TRANSPORTATION MAP
County Engineer Rick Kjonaas, explained the county's position on
replacing a bridge south of County Rd #89 possibly to upgrade County
Rd #67. He commented on correspondence with the City Council and
would report requests to the State for funding. He then explained the
State recommendation to deny the request for state -aid and read the
reasons for denial.

Mr. Torgerson explained the City Council's position of County #89 use
and asked as to what county expense has been in city limits.
Discussion followed on funding between city state -aid and county •
state -aid.
Consulting Engineer Priebe explained the transportation map itself,
commenting route #2 is the most likely route to follow with a
possibility of combining #1 and #2. County Atty. Junge commented on
the practicality of the use of #89.
County Commissioner Grant Knutson questioned the feasibility of
upgrading #89. County Engineer Kjonaas commented on the right -of -way
of #89. Discussion followed on traffic conjestion on Oakland Ave. and
Jefferson St.
Mr. Torgerson commented on access roads to Hwy 15 and Hwy 22 for local
traffic not tourist traffic. It is meant to accomodate area people.
County Zoning Administrator Ed Homan commented on the concept of
preserving the corridor for the future access road.
County Engineer Kjonaas asked the city for a reference in the
Comprehensive Plan Transportation Map to address the corridor for an
access road. He stated that the map with a written paragraph
explaining the need would be helpful for the report to the State.
Mr. Torgerson made a motion to direct the City Engineer and staff to
provide the information necessary for County staff to complete their •
report concerning state -aid funding regarding route #1 on the
Comprehensive Transportation Map. Seconded by Mr. Romo the motion
carried unanimously.
(b) CONSIDERATION OF 1990 PLANNING BUDGET
Building Official Marka explained the budget and the fact that the
$5500.00 for professional services in 1989 would be carried to 1990.
Discussion followed on what is to be transfered into the professional
services budget in 1990 and not spent to date.
The consensus of the Planning Commission would be to retain ongoing
consultation with Mr. Weber.
Mr. Lyke moved to approve the budget as presented, seconded by Mr.
Romo the motion carried unanimously.
5. OTHER BUSINESS
Mr. Dennis Schaefer, 724 Southview Court, commented on the confusion of the
house numbering on Southview Court and Southview Drive. Mr. Torgerson made
a motion to direct staff to review the problem and bring the solution to
Planning Commission in September. Seconded by Mr. Romo the motion carried
unanimously.

Chairman John Paulsen called the meeting to order.
Members present -John Paulsen, Pat Mikulecky, Tammy Wendlandt,
Richard Peterson, and Jean Ward. Members absent -Don Krasen.
II. CONSIDERATION OF MINUTES OF JUNE 20, 1989 REGULAR BOARD MEETING
AND CLOSED BOARD MEETING
There being no additions or corrections to the minutes, Pat
Mikulecky moved the minutes b,• approved as mailed. Richard
Peterson seconded and the motion carried unanimously.
III. CONSIDERATION OF STATUS OF ACCOUNTS FOR PARK TOWERS AND
HHRA GENERAL FUND
$412.72 was paid to the Hutchinson Leader in advertisements for
vacancies; disbursements also included $607.39 to Popp Electrical
for repair of outside lights on West side of the building and
repair of mercury light in rear of building. Pat Mikulecky moved
the financial statements be approved as submitted. Richard
Peterson seconded and the motion carried unanimously.
1V. SECTION 23 /PARK TOWERS PROJECT
1. The Director informed the Board that by the end of July there will
be 5 vacancies with 4 people on the waiting list.
2. The HUD maintenance review comments were distributed to Board members.
The Director will draft a report on the corrective measures which will
be taken or budgeted for in the coming year. Board members were asked
to review the report; any comments or suggestions will be discussed
at the next meeting.
3. The goal of attaining meals at Park Towers was discussed; the letter
from the Mid- Minnesota Development Commission was distributed stating
that the current budget did not contain the dollars for our request.
However, the letter went on to state that dollars may be allocated
in the future for our purpose. The Director informed the Board that
Ancher Nelsen has advised us to submit an application for a Nutrition
Site at Park Towers through Lorraine Patton, Aging Program Director.
Board Members suggested that other sources of funding be investigated,
as well as sources for meals brought into Park Towers along with
associated costs, such as Burns Manor and Hutchinson Community Hospital.
V
OTHER BUSINESS
I. Dan Papin, the Mcleod County Services Director reported on
the Mcleod County projections and programs for both the elderly
and low - income population. The County has targeted transportation
for the elderly as an issue but stated that after our discussion
would also target a congregate meal plan as needing to be addressed
and that congregate housing would be added to the two - year needs
assessment drafted by the social services department.

2. The Director was asked to contact the McLeod County HRA
to determine if they have identified Congregate Housing as a •
need in the county.
3. John Paulsen, Richard Peterson, and Jean Ward will meet to
discuss assembling a task force on Congregate Housing Needs in
the Community. Some ideas of members to serve on such a task force
were Phil Graves, McLeod County HRA or County Commissioner,
Dan Papin, and Judge Yost.
4. Tammy Wendlandt suggested that P,irk Towers host some seminars
on Aging Issues through Community Education or the Technical Institute.

III. CONSIDERATION OF STATUS OF ACCOUNTS FOR PARK TOWERS AND

Disbursements included $2,165.68 to Crow River Glass for
window replacement; $5,940.00 to General Electric for kitchen
ranges; $725.00 to Woods Painting 6 Decorating for painting
4 apartments while the Caretaker was on vacation and $84.00
to Malinda Rogers for locking doors and monitoring the pager
during Caretaker's vacation in July. $120.00 was also paid
to Nahro as a registration fee for Milt Hanson to attend
• a maintenance workshop. Richard Peterson moved the financial
statements be approved as submitted. Don Krasen seconded and
the motion carried unanimously.
IV. SECTION 23 /PARK TOWERS PROJECT
1. The Director informed the Board that by September 1 there
will be 3 vacancies with 3 people on the waiting list.
2. 1990 preliminary budget ideas were discussed. Don Krasen
recommended that the stairwells and heating pipes be insulated;
the Director noted the following: advertising expenses,
seminars for Director and maintenace person, Nahro Convention in
Minneapolis in 1990; Betterments and Additions- enamel splashboards
in kitchens, additional space for maintenance to store lawnmower
and snowblower attachments, additional garbage bin; Replacement
of Equipment -mower deck and snowblower attachment, 25 ranges and
25 refrigerators; Extraordinary maintenance- refinish doors.
John Paulsen and the Director will meet to review administrative
and maintenance wages and compile for the budget. The budget
will be submitted for Board approval at the September Board meeting.
3. Proposals for installing timers to operate fan exhaust units and
for performing preventive maintenance on fan exhaust units were
submitted by TEK Mechanical and Allied Mechanical. Don Krasen
moved that the low bid from Allied Mechanical for $1,156 for installing
timers and $15.00 per unit preventive maintenance be accepted.

4. The Director informed the Board that the kitchen ranges
have been installed but the refrigerators are back- ordered with •
delivery expected in September. Replacement of fire hoses budgeted
for in 1989 to conform with safety regulations will not be
required if they are removed from the building as per George Field's
recommendations accepted by State Farm Insurance, our liability
insurer. Removing the hoses will save approximately $2,000.
5. FYI- 11Lalth Plus Transportation Service is now available
to Park Tower; residents; r. .idents are asked to call this service
it they request a ride to the Doctor or Hospital.
V. OTHER BUSINESS
1. Connie Mangan, Small Cities Project Coordinator reported on
the feasibility study being compiled by her for submission to
HUD. If apartments are not found to be feasible, approximately
$70,000 will be used to stabilize the structure of the Hutch Hotel
with approximately $230,000 of the grant money then to be used
for housing rehabilitation. Connie will now be submitting
the Rental Rehabilitation Program Application; the program was
suspended by HUD but has recently been re- instated. Connie
will be developing a map of City areas needing rehabilitation
and will share that with the HRA upon completion.
2. The HRA Goals and Objectives were discussed; no further
needs br goals were identified. It was decided that a task
force would not be necessary at this time, but that the first
step in addressing these needs would be to target available funds.
The Director informed the Board that Mike Henrickson from the
Willmar FmHa office will be here on Tuesday, August 22 at
10:00; any Board members who are able are encouraged to attend.

• AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA, AMENDING CITY
CODE CHAPTER 4 ENTITLED "CONSTRUCTION LICENSING, PERMITS AND
REGULATION ", BY ADDING A PROVISION RELATING TO OUTDOOR SWIMMING POOL
CONSTRUCTION AND REQUIRING PERMITS THEREFOR; AND, BY ADOPTING BY
REFERENCE, CITY CODE CHAPTER 1 AND SECTION 4.99 WHICH, AMONG OTHER
THINGS, CONTAIN PENALTY PROVISIONS.
THE CITY OF HUTCHINSON ORDAINS:
Section 1. City Code, Chapter 4, is hereby amended by adding a
Section, to read:
SEC. 4.32. SWIMMING POOL CONSTRUCTION.
Subd. 1. Definitions. The following terms, as used in
this Section, shall have the meanings stated:
1. "Swimming Pool" or "Pool" means a permanent or
portable structure which is not completely enclosed within a
building, whether below ground level, above ground level or
partially above and partially below ground level, intended for
non - commercial use as a swimming pool and which exceeds 24 inches
in depth capacity and has a surface area exceeding 100 square
feet.
• 2. "Spa" means a structure which is not
completely enclosed within a building, designed for therapeutic
use which is not drained, cleaned or refilled for each
individual, equipped, but not by way of limitation, with hydrojet
circulation, hot water, cold water mineral baths, air induction
bubbles, or any combination. Industry terminology for a spa
includes, but is not limited to, "therapeutic pool ",
"hydrotherapy pool ", "whirlpool ", "hot spa ", and "hot tub ".
3. "Toddlers" means all persons five (5) years
of age and younger.

A. Construct a pool or spa beneath overhead
utility lines of any type or above underground utility lines of
any type.
B. Construct a pool or spa within ten (10) feet
of any side or rear lot line or within six (6) feet of any
principal structure or within any required front yard.
C. Commence or pursue construction of a pool or
spa without having the same fully enclosed with a fence, which
may be temporary and portable, not less than four (4) feet in
height.
• D. Construct a pool or spa within twenty (20)
feet of any on -site sewer system facility.

E. Complete construction without completely
enclosing a pool with a permanent wall or fence of the non -
climbing type so as to be impenetrable by toddlers, affording no .
external hand holds or foot holds, and a minimum of four (4) feet
in height. No integral part of any pool shall constitute
compliance with this Subparagraph. All such enclosures shall be
equipped with a self - locking and self - closing gate. The locking
device shall be located within twelve (12) inches of the top of
the fence and opened by key only. The opening between the bottom
of the fence or gate and the ground or other surface shall not be
more than three (3) inches.
F. Construct or maintain a spa which is not
enclosed within a fence or wall as described in the foregoing
Subparagraphs or a latchable cover. The cover shall be
constructed of a material which cannot be penetrated by toddlers.
G. Construct, alter or renovate a pool or spa
without a building permit.
H. Maintain outdoor pool lighting which is
permitted to spill or shine upon properties adjacent thereto
which are not under the same ownership.
Subd. 3. Retroactive Effect. All pools constructed
prior to the effective date of this Section shall substantially
comply with this Section within sixty (60) days from the
effective date hereof. Owners of pools constructed prior to the •
effective date of this Section may make a written request for an
exception.
Section 2. City Code Chapter 1 entitled "General Provisions and
Definitions Applicable to the Entire City Code Including Penalty for
Violation" and Section 4.99 entitled "Violation a Misdemeanor" are
hereby adopted in their entirety, by reference, as though repeated
verbatim herein.
Section 3. This ordinance shall take effect upon its adoption
and publication.

APPOINTING OF JUDGES FOR THE CITY OF HUTCHINSON GENERAL ELECTION
WHEREAS, Chapter 204B, Section 204B.16, Subd. 1 and Section 204B.21, Subd. 2
of the Laws of Minnesota states that the governing body of any municipality,
by resolution adopted prior to the giving of notice of the election, may
designate the location of polling place and naming of judges for the State
Primary and General Elections,

I have met with Mr. Plath this morning and he has some additional
• questions and at his request, I am removing approval of the Plath
settlement from the agenda this evening. I do not anticipate any
problems with Mr. Plath, but he did have some questions that he
wanted answered prior to officially settling with the City. I will
be back in touch with you on Mr. Plath's situation in the near
future.
With regard to the McCormick property, Mr. McCormick has contacted
me and indicated that he is willing to accept the amount of the
approved appraisal which is $8600. You may recall that the City
had suggested a smaller figure based on a review by the City's
appraiser, but the State ultimately determines the valuations in
these circumstances and the State has certified the $8600 figure
to be offered to the property owner. Under those circumstances,
the landowner having agreed to accept the amount authorized by the
State of Minnesota, the City essentially must agree to the
disposition in the amount of $8600. This payment, along with all
other payments, is, of course, eligible for reimbursement at the
percentage previously discussed.

RE: Investigation 21st Century Promotions
On 9 -21 -89 I completed the investigative report on the
application for Transient Merchant License to 21 Century Promotions
of Cumming, Iowa. As part of the investigative report I, contacted
the Attorney General of Minnesota to see if there were any
complaints lodged in the State of Minnesota regarding 21st Century
Promotions. I was advised there were no complaints listed.
I next contacted the Secretary of State Consumer Division and
inquired if 21st Century Promotions was listed with their agency.
I was advised that 21st Century Promotions AKA W. H. Anderson was
not listed with that agency.
With the information provided by Mr. Anderson that they had
last sold in the Knoxville, Iowa area, I contacted the Knoxville
Police Dept. I was advised by the Knoxville Police Dept. that they
did not have any complaints on record for Mr. Anderson or his
business. I also contacted the Chamber of Commerce who advised
that 21st Century had in fact sold coupon books in the area between
July and September. I was advised there were several complaints
referring to high pressure sales tactics used by the operation.
I was further advised there were no criminal complaints lodged.
With information provided by Knoxville I contacted Indianola, Iowa.
I contacted the Chamber of Commerce and spoke to Debra Payson.
Ms. Payson said she was familiar with 21st Century Promotions and
has spoken with representatives from their company. She said there
were no criminal complaints during the time the company was in
their area. Ms. Payson also stated they had received several
complaints of high pressure sales tactics by sales representatives
of the company.
In summary, the company has worked in several communities in
Iowa and there are no criminal complaints against the company
however, each area has received complaints from citizens concerning
high pressure sales tactics used by the representatives of the
company.
The final area of investigation was on the proprietor of 21st
Century Promotions Wayne Harris Anderson. I checked with several
City and County Agencies where Hr. Anderson has resided or done

business in the last year. Areas checked were Gilmer City, Iowa, At
Pocahomtas County Sheriff's Dept, Humboldt County Sheriff's Dept.,
and all areas checked revealed no criminal activity on Mr.
Anderson.

Dear Gary:
In connection with the airport project, I would request that the
City Council approve the acquisition of property owned by Fredrick
Plath, totalling 4.75 acres in exchange for payment by the City of
Hutchinson in fEe amoun o , epa men of

and has approved the valuation and the transaction. Obviously, we
will need to review the title, but assuming that no problems with
the title are present, I would anticipate we would be able to close
this transaction quickly.
You may recall that at one point the City was of the opinion that
the total amount to be paid to Mr. Plath should be approximately
$4,000, based upon the review appraisal by Mr. Robinson. However,
Mr. Plath and I have discussed this matter, and he was willing to
sell the subject property for approximately what the County paid
him for property taken in connection with a road improvement in the
area. That figure was approximately $2,000 an acre. In
considering the appraisal prepared by the Department of
Transportation and in reviewing the matter with the Department of
Transportation and Mr. Plath, an agreement was reached to pay the
total sum of $11,900 and I need authorization from the City Council
to close this transaction and to issue the appropriate draft.
Obviously, any closing expenses will be paid by the City.

The Hutchinson Wastewater Facility is in need of a service contract for
our heating and air conditioning systems. This system was designed to
be energy efficient, and is very sophisticated. This heating system
must be maintained by a qualified serviceman. I have included two quotes
from suppliers.

EXCLUDED FROM THIS PLAN:
(1) Service, repair, adjust, clean or replace parts of any of the following: Air balancing: boiler tubes; ducts; cabinet interiors
and exteriors; drains which are not a part of the equipment covered by this plan; heating and cooling coils; electrical
service, beyond the subject equipment disconnect; surfaces exposed to air and water as part of the system performance
(such as sump pans, evaporative condenser tube bundles, tower and evaporative condenser distributors, panels, fans
shafts, etc.); recording instruments, gauges, and thermometers.
(2) The cost of replacement parts, material or refrigerant.
TERMS: acceptance of proposal
(1) HMC service shall commence on within 90 days and shall remain in effect for a
period of one year, and from year to year thereafter except that either party may terminate this agreement by giving the
other party thirty days prior written notice on any anniversary date. Annual contract price can only be adjusted at
anniversary date unless equipment is added to or subtracted from original contract.
(2) Failure to make payment when due, or impairment of owner's credit, shall relieve HMC of the obligation of further
performance of this agreement.
(3) Price shall be adjusted yearly.
(a) The contract price shall be increased or decreased proportionally according to prevailing costs and escalations in
labor and material.
(b) Annual price adjustment sheets shall hereafter become a part of this agreement.
(4) HMC service will be paid in advance for the sum of:

GENERAL TERMS AND CONDITIONS
le1. when properly signed and executed this Agreement shall become
effective and remain in force from year to year until cancelled.
Either party may cancel this Agreement by giving the other
party written notice not less than thirty (30) days prior to
the anniversary date, except as noted otherwise in this Agreement.
2. Seller reserves the right to withhold services under this
Agreement if payments due Seller are not current.
3. Purchaser agrees to furnish safe and free access to all equipment
to be serviced under this Agreement.
4. Seller shall not be required to furnish items of equipment
or equipment retrofit required or recommended by an other
insurance company, governmental or other authorities.
5. This Agreement does not include the repair or replacement
Of portable instruments, electrical disconnect switches, duct
work, piping, service valves, domestic water lines, non - moving
and non - serviceable components such as cabinets and coils,
boiler or heat exchanger tubes and shells, insulation and
refractory material, or other similar parts.
6. Seller shall not be responsible for any utility service connected
to or essential to the operation of the covered equipment,
nor the failure of such utilities, nor shall Seller be liable
for damages sustained to the equipment due to failure thereof.
Seller shall not be responsible for damages caused by power
failures, low voltage conditions, lightning, single phasing
or other electrical irregularities.
7. This Agreement does not cover damage to, or loss of property,
due to Purchaser's improper operation or misuse of the equipment
or by fire, flood, explosion, or other elements, or by strikes,
vandilism, riots, or other civil commotion or by other causes
beyond Seller's control.
+�- The �crvices to be performed are not a guarantee against obsol-
escence or normal wear; nor shall inspections be constructed
as an approval or guarantee of the condition of the equipment
or system design and performance.
9. In the event of alterations, additions, adjustments or repairs
made by others without the Seller's written consent, Seller
may, at his option, terminate this Agreement immediately.

10. Purchaser agrees to pay $11,200.00 for Yearly Maintenance
Agreement, to be paid in quarterly payments of $2,800.00
on March 20th, June 20th, September 20th, and December 20th.
Net 10 days.
11. This Agreement, including pages 1 through contains the
entire Agreement, and the parties herebu agree that no under-
standings, conditions, agreements, modifications, alterations,
or amendments will be recognized or enforceable unless made in
writing and signed by both parties.

The City has received an invoice for $1,976 (20 cents per capita)
from the Coalition of Greater Mn. Cities. The billing is for

Session. The cost is over and above the previously paid assessment
of $3,897.60.
The amount is a special assessment agreed to at a special meeting
on August 25th. The invoice states the special assessment may be
paid in 1990. Money for payment in 1989 would have to come from
the contingency account of the General Fund.

the public bid opening on September 19, 1989 in the Council Chambers at
City Hall are as follow:

The results of the bids indicate that Wigen Chevrolet was the low bidder
at $33,760.94, and also the vehicle meets specifications. Therefore, I
recommend that Wigen Chevrolet of Hutchinson, MN be awarded the contract
to supply two new 1990 Chevrolet } -ton 4x4 pickup trucks with snow plow
to the City of Hutchinson.
The vehicle for the Wastewater Department was approved for replacement in
the 1989 budget and will be purchased through the wastewater enterprise fund.
The vehicle for the Park Department was included and approved for replacement is
in the 1989 motor pool budget.
The vehicles that are being replaced will be sold at public auction sometime
in October of 1989, with the exception of the 1979 International Scout which
is equipped with a snow plow and will be retained until the replacement vehicle
is received. Then it will be sold on public auction sometime in 1990.

Your memorandum of June 20, 1989 addressed to the Hutchinson
Planning Commission has been brought to my attention. Item #1 on
that list falls within my jurisdiction as City Attorney for the
City of Hutchinson.
I have had a chance to confer with Marlow Priebe on the subject of
the existing deferred assessments. It is my understanding that you
are currently paying an assessment on property that is within the
city limits and have some concerns over your ability to pay both
assessments.
I would propose, assuming annexation takes place, the following
agreement between yourself and the City:
A. The City would continue to defer the assessment or
assessments which have not yet been activated until such
time as the prior assessments have been paid.
B. The assessment would be activated at your request, upon
the sale of the property or upon the payment of the
existing water main assessment, whichever occurs first.
C. This agreement would extend to and include only deferred
assessments now existing and would not include any future
projects in the area.

If this agreement would be acceptable to you, and all of the other
details regarding this annexation are taken care of, we might be
able to significantly reduce the interest rate to 3% on the unpaid
balance of the deferred assessments.
Please keep in mind that I have no authority to bind the City
Council to this agreement and that only the City Council can
formally approve the discussion set out above. However, I would
be willing to recommend this agreement to the City Council.
Normally, as property is annexed, the City has the opportunity to
activate the deferred assessment; the agreement that I have just
outlined will hopefully make annexation a much less expensive
proposition for you.
Please give this matter some thought and get back to me at your
convenience. Thank you.

Planning Commission is hereby submitting its findings of fact and recommendation
with respect to the aforementioned request for a conditional use permit.
HISTORY
On August 18, 1989, Mr. Patrick McGrann, 3M Co. Civil Engineer, St. Paul,
MN, submitted an application for a conditional use permit to allow them to
construct a Thermal Oxidizer and Electrical Substation within the 100 year Flood
plain Boundry of the south fork of the Crow River located at the 3M Company on
Hwy 22 South. A public hearing was held at the regular meeting of the
Planning Commission on Tuesday, September 19, 1989 at which time there was no one
present who objected to the request.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee
paid.
2. Notices were mailed to the surrounding property owners as well as
published in the Hutchinson Leader on Thursday, September 7, 1989.
3. The proposal is in conformance with the requirements of a conditional
use permit.
RECOMMENDATION
It is the recommendation of the Planning Commission that the aforementioned
request for a conditional use permit be granted as set forth above.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Patrick McGrann, 3M Co., has made application to the City Council
for a Conditional Use Permit under Section 6.07 of Zoning Ordinance No. 464 to
allow them to construct a Thermal Oxidizer and Electrical Substation within the
100 year Flood plain Boundry of the south fork of the Crow River located at the
3M Company on Hwy 22 South with the following legal description:
Legal description: Part of Lots 4 and 5 and all of lots 6 and 7 all being in
Block 66, City of Hutchinson, Minnesota; part of lots C,D,E,
and F and all of lots A and B, all being in auditors plat of
South half of Section 6, Township 116 N, Range 29 W, McLeod
County, Minnesota.
2. The City Council has considered the recommendation of the Planning
Commission and the effect of the proposed use on the health, safety, and welfare
of the occupants of the surrounding lands, existing and anticipated traffic
conditions, and the effect on values of properties in the surrounding area and
the effect of the use on the Comprehensive Plan.
3. The Council has determined that the proposed use will not be detrimental
to the health, safety, or general welfare of the community nor will it cause
serious traffic congestion nor hazards, nor will it seriously depreciate
surrounding property values, and the proposed use is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
CONCLUSION
The application for Conditional Use Permit for the purpose designated is
granted as set forth above.

with respect to the aforementioned request for an addition to the Zoning Ordinance.
HISTORY
In July of 1989, Building Official Jim Marka, requested there be an addition to
the Zoning Ordinance regarding Bed and Breakfast Establishments in the city. A
public hearing was held at the regular meeting of the Planning Commission on
Tuesday, September 19, 1989 at which time there was no one present who objected
to the request.
FINDINGS OF FACT
1. All procedural requirements for amendments to the Zoning Ordinance have
been complied with.
2. Notice was published in the Hutchinson Leader on Thursday, September 7,
1989.
3. The proposal was deemed to be appropriate and in the best interest of the
City.
RECOMMENDATION
It is the recommendation of the Planning Commission that the aforementioned
request to add to Section 8.03, under conditional permited uses, for a Bed and
Breakfast Ordinance, be granted subject to the following changes:
In 1. and 2. - omit the word resident.
In 10 - possibly change the wording to state that the City Council may issue a
one time permit per establishment at its sole discretion, for the provision of
meals....
In 12 - there was discussion on limiting the number of Bed and Breadfast Estab-
lishments in the City of Hutchinson the consensus is there should be no limit.

PROPOSED ORDINANCE:
An ordinance providing for the creation of Bed and Breakfast
establishments within the City of Hutchinson. The City Council of
the City of Hutchinson does ordain as follows:
Bed and Breakfast establishments ( "Establishment ") may be
allowed as a conditional use in the City of Hutchinson by permit
as provided by the Zoning and Land Use Regulations established by
the City of Hutchinson if the follwoing conditions are
met:
1. The owner or resident manager of the Establishment shall
operate the facility.
2• The owner or resident manager of the Establishment shall
reside at the facility.
3. The Establishment shall conform to State Health and
Building Code requirements.
4. The Establishment's owner must furnish evidence that
licenses required by the State of Minnesota either have been issued
or will be issued before commencing operation.
5. The Establishment shall be limited to five (5) guest
rooms.
6. Guests shall not stay at the Establishment for more than
thirty (30) days within any ninety (90) day period.

7. The Establishment shall provide a minimum of one (1) off -
street automobile parking space for each guest room and one (1)

Establishment.

9. No cooking or cooking facilities shall be allowed or

I have received a request from the Planning Commission for some
changes in the proposed Bed & Breakfast ordinance. Enclosed is a
copy of the revised ordinance with the following comments:
1. I have combined and modified paragraphs 1 and
2 so that the owner or resident manager must
reside and operate the facility. The intent
is to simplify the paragraphs 1 and 2 of the
ordinance.
2. I have clarified paragraph 9 of the ordinance
so that it provides specifically that the City
Council may issue special permission on the
basis of either a single event or annually,
presumably at the time the license is approved.
Please note my previously expressed concern
about the service of meals to non guests in a
residential district.
A question has been raised about the language included in paragraph
11 that limits the City to issuing three bed & breakfast licenses.
This provision originated with this office and my reasoning is as
follows: as a matter of law, if an applicant otherwise qualifies
for the issuance of a license, the City is required to issue a
license. The City has no prior experience with bed & breakfast
facilities in terms of problems with operation, problems with
owners of the property or complaints on the part of neighbors.

Once a license has been issued, it is extraordinarily difficult to
revoke the license and even the annual renewal is usually a matter
of rubber stamp approval. Under the circumstances, with the
absence of any prior experience, it was my thought that the City
perhaps did not want to leave itself open to issuing an unlimited
number of licenses. Even if the City's experience with bed &
breakfast facilities is totally unsatisfactory or if the City feels
that the ordinance as drafted does not address problems that were
not previously anticipated, the most the City will have to deal
with is three existing facilities.
The Council can always choose to amend the ordinance to remove the
license limitation. I would point out, however, that license
limitations are relatively common with respect to other facilities
so this provision is not unusual.
This is purely a matter of policy and from a legal standpoint, the
Council may choose to allow unlimited licenses to be issued if it
so chooses.

SUBDIVISION AGREEMENT
HELLAND'S NINTH ADDITION
CITY OF HUTCHINSON
THIS AGREEMENT, made and entered into the day and year set forth
hereinafter, by and between Triple H and 0, a Partnership, hereinafter called
the "Subdivider ", and the City of Hutchinson, a Municipal corporation in the
County of McLeod, State of Minnesota, hereinafter called the "City ";
WITNESSETH:
WHEREAS, the Subdivider is the owner and developer of a Tract C of
Registered Land Survey No. 22 and Lot 1, Block 2, Helland's Sixth Addition, to
be known as HELLAND'S NINTH ADDITION, which is located in the City of
Hutchinson, McLeod County, Minnesota, and;
WHEREAS, City Ordinance Chapter 12, dated July 1, 1989, requires
subdividers to make certain improvements in the subdivision;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
1. It is understood and agreed that grading, sanitary sewer, watermain,
storm sewer, sewer and water service leads, aggregate base, curb and
gutter, bituminous base and appurtenances have been installed or are
contracted for installation in 1989 and have been assessed on
Assessment Roll No. 241 and 251.
2. It is understood and agreed that the balance of the assessments to
the property being platted shall be reassigned on a per lot basis in
an equal amount to each lot in the subdivision.
3. It is understood and agreed that the Subdivider hereby petitions the
City for the bituminous surfacing of Arizona Street.
It is understood and agreed that said improvement will be constructed
in 1990 or later, as deemed feasible by the Subdivider and the City.
It is understood and agreed that 504A of the cost of this improvement
will be assessed to Helland's Eighth Addition and 50% of the cost of
this improvement will be assessed to Helland's Ninth Addition. The
assessment will be on a per lot basis in an equal amount to each lot
and that said assessment will be in accordance with Minnesota Statute
429.061.
The Subdivider waives all rights to a public hearing and appeal for
the cost of the improvement. The waiving of all such rights shall be
binding upon and extend to the heirs, representatives, assigns and
successors of the Subdivider.
4. It is understood and agreed that the Subdivider has fulfilled the
contribution to the City of Hutchinson for Parks and Playground for
Helland's Ninth Addition for one dwelling unit per lot. Charges for
additional dwelling units per lot will be due at the time a Building
Permit_ is issued and the cost will be according to the City Fee
Schedule for additional units at the time-,said permit is issued.

It is understood and agreed that prior to the installation of
electrical and gas utilities and appurtenances in the platted
easements, the Subdivider will clear any trees and /or debris and
grade the easements to within 6" of finish grade.
6.
It is understood and agreed that all electrical and gas lines in
easements that may have to be moved by request of the property
owner, will be done at said property owners expense.
7.
It is understood and agreed that to enhance, perpetuate, and
propagate our urban tree population, the City will furnish and plant
trees in the boulevard adjacent to each lot in the Subdivision. The
number and species of trees will be determined by the Tree Board.
Trees will be planted only subsequent to a dwelling occupying the lot
and the establishment of all final soil grades. The City will
replace any tree which dies within one year of planting.
8.
It is understood and agreed that the Subdivider will provide the City
with reflectorized street name signs, mounting posts, and mounting
brackets for the intersection of Carolina Avenue and Arizona Street.
The signs and appurtenances shall be of the materials, color, size,
and type determined by the City Maintenance Operations Supervisor,
and the aforedescribed materials shall be delivered to said City
Maintenance Operations Supervisor prior to the completion of grading
and aggregate base construction for the Subdivision. The City will

install the street name sign at the intersection.
9. This agreement shall be binding upon and extend to the heirs,
representatives, assigns and successors of the parties.
10. It is understood and agreed that it is the responsibility of the
Subdivider to record this agreement at the County Recorder's Office
and furnish the City of Hutchinson with a copy of said recorded
agreement and that no Building Permits will be issued until said
Agreement is recorded.

Tuesday, September 19, 1989
1. CALL TO ORDER

The meeting was called to order by Chairman Bill Criag at 7:30 p.m. with
the following members present: Roland Ebent, Clint Gruett, E1Roy Dobratz,
Marlin Torgerson, Larry Romo, Tom Lyke and Chairman Craig. Members absent:
None Also present: Building Official Jim Marka and Consulting Engineer Marlow
Priebe.
2. MINUTES
Mr. Roma made a motion to approve the minutes of the regular meeting dated
Tuesday, August 15, 1989. Seconded by Mr. Dobratz the motion carried
unanimously.
3. PRESENTATION
(a) FINAL PRESENTATION OF COMPREHENSIVE MAP PRESENTED BY BILL WEBER
Mr. Weber commented on issues to focus on in the presentation.
Land Use Map - He explained how the map was compiled and stated
the Planning Commission would use this section the most in making
planning decisions.
Mr. Weber also commented on the population forcast and the sewer
issues North of Hwy 7.
The density districts are shown as Single family, Attached
Housing and Mid or High Residential. Park locations are shown
and new parks are planned.
Commercial expansion would be suggested South Hwy 15, North Hwy
15 and along Hwy 7. Major Industrial growth would be around
Hutch Technology. The Comprehensive plan suggests developing the
land North of Hwy 7 as a business park to include office and
light industry and the land South of Hwy 7 for heavy industry and
light industry. Mr. Weber suggested two different industrial
areas to keep the distiction clear.
Mr. Weber stated that ammendments to the Zoning Ordinance will
reflect policies in the Comprehensive Plan.
Street System Plan - The basic streets indicated were, Principle
arterials, Minor arterials, Collectors and Local streets (not
meant to carry traffic through the neighborhoods). Mr. Weber
explained the changes in the ring route and the input from the
county. Building Official Marka commented on the state -aid
funding available as the county has proposed the route.
Mr. Weber commented on the collector streets south of the
Vocational school. Discussion followed on the ring road concept
and its effect on the businesses. Collector streets will aid in

the traffic system. Consulting Engineer Marlow Priebe explained
the road system is an ongoing, long process.
Mr. Weber stated that the Planning Commission give careful
consideration when reviewing plats within the 2 mile radius. The
Planning Commission should be aware of getting adequate right of
way for collectors. Collector streets are planned streets at the
time of platting. Collectors are placed every 112 mile and Locals
every 300' to 600'.
Building Official Marka suggested the Planning Commission looking
at the larger development instead of coming with so many small plats.
Major points emphasized by Mr. Weber included:
Sanitary Sewer Plan - The City should look at providing
larger capacity in the North section of the City for
expansion.
Surface Water Plan - Mr. Weber suggests further engineering
study for ponds and to calculate runoff into sewer system.
Parks Plan - The location for new parks should be according
to land use plan. Parks along the river would be flood
protection areas. Mr. Weber commented on the City's
aquisition of parkland and suggested the city identify the
parks and then buy the land ahead of time.
The Public Hearing for the Comprehensive Plan will be set for
Tuesday, October 17, 1989, at 7:30 p.m.
4. OLD BUSINESS
(a) CONSIDERATION OF ANNEXATION OF TRACT IN SECTION 1, LYNN TOWNSHIP OFF
OF SCHOOL RD.
Mr. Ron Hansen commented on the land use of the property remaining a
gravel business. He also voiced concern on any future assessments
being placed on his property with the development of the Wagner Plat
to the North. Consulting Engineer Priebe stated there would be no
assessments to the Hansens caused by the Wagner Plat. The future
assessments would be caused by development of the land by the owner
himself. Building Official Marka recommended the Hansen's work with
Mr. Priebe and the City Council on the assessment issue.
Mr. Torgerson made a motion to begin annexation proceedings and to
include the road right -of -way which is the South 1/2 of South Grade Rd
from Dale St. to approximately 1/4 mile West of School Rd. Seconded
by Mr. Romo the motion carried unanimously.

(a) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY 3M CO.
Chairman Craig opened the hearing at 8:40 p.m. with the reading of
publication #4033 as published in the Hutchinson Leader on Thursday,
September 7, 1989. The request is for the purpose of considering a
Conditional Use Permit requested by 3M Co. to allow thim to construct
a Thermal Oxidizer and Electrical Substation within the 100 year Flood
plain Boundry of the south fork of the Crow River located at the 3M
Company on Hwy 22 South.
Mr. Frank Mott, 3M Hutchinson and Mr. Pat McGrann, Civil Engineer, 3M
St. Paul, were present to represent 3M Co. and comment on the
conditional use permit application. Mr. McGrann explained the request
for the two buildings proposed. 1. Thermal Oxidizer Plant is an air
emission control plant. There will be no solvents or pollutants
present. The units will not be tall but the bridge of ductwork will
be 60' in height. 2. The Electrical Substation will work in
conjuction with Hutch Utilities for electricity to the S.E. quadrant
of the City.
. Building Official Marka commented on the telephone conversation he had
with the DNR hydrologist and explained the concerns of the DNR. Mr.
Skip Wright requested a hydrolic analysis for the substation
encroachment and for the thermal oxidizer 3M is to obtain a floodway
encroachment permit from the DNR. Mr. McGrann stated the 3M Co. will
work with the DNR Hyrologist.
Mr. McGrann stated there is a December 1, 1989, beginning date' for the
foundations and the 3M standards for this type of building is higher
than PCA requirements at the present time.
Mr. Romo moved to close the hearing, seconded by Mr. Torgerson the
hearing closed at 8:55 p.m. Mr. Gruett and Mr. Dobratz asked to
abstain from voting. Mr. Ebent made a motion to recommend approval of
the request for the buildings and equipment. Seconded by Mr.
Torgerson the motion carried unanimously among those voting.
(b) CONSIDERATION OF ADDITION TO ZONING ORDINANCE REGARDING BED AND
BREAKFAST ESTABLISHMENTS
Chairman Craig opened the hearing at 8:56 p.m. with the reading of
publication #4034 as published in the Hutchinson Leader on Thursday,
September 7, 1989. The request is for the consideration of an
addition to the Zoning Ordinance #464, Section 8.03, Conditional
Permitted Uses, for a Bed and Breakfast Ordinance.
Ms. Linda Heaton commented on the Ordinance being fair to anyone
interested in opening a Bed and Breakfast Establishment. Building

Official Marka stated the proposed ordinance was reviewed and written
by City Attorney Barry Anderson.
Discussion followed on paragraph #12 limiting the number of
establishments in the City to three.
It was the consensus of the Commission that paragraph #10 was somewhat
unclear pertaining to the limiting number of guests at one seating
and how the ordinance would be enforced. Each establishment should
apply for an individual permit according to capacity. The Commission
directed that City Attorney Anderson rewrite the paragraph to clarify
the meaning.
Mr. Ebent moved to close the hearing, seconded by Mr. Torgerson the
hearing closed at 9:10 p.m. Mr. Torgerson made a motion to recommend
approval to City Council subject to the following suggested changes:
Paragraph 1 and 2 - omit the word residential
Paragraph 10 - possibly change the wording to state that the City
Council may issue a one time permit per establishment at its sole
discretion for the provision of meals...
Paragraph 12 - there was discussion on limiting the number of Bed and
Breakfast Establishments in the City of Hutchinson, the consensus was
that there should be no limitation. Seconded by Mr. Gruett the motion
carried unanimously.
NEW BUSINESS
(a) CONSIDERATION OF ENCROACHMENT FRANCHISE AGREEMENTS .
Building Official Marka commented on staff recommendation to have City
Attorney Anderson draft an encroachment franchise form.
Mr. Torgerson moved to recommend that City Attorney Barry Anderson
draft an encroachment franchise form and that City Staff handle the
administration of up to 12" encroachments for projects funded by
downtown grant money. Seconded by Mr. Romo the motion carried
unanimously.
(b) CONSIDERATION OF EXTENSION OF CONDITIONAL USE PERMIT REQUESTED BY
CARLIE KARG
Mr. Torgerson made a motion to recommed approval to City Council,
seconded by Mr. Dobratz the motion carried unanimously.
(c) CONSIDERATION OF FINAL PLAT OF HELLAND'S 9TH ADDITION
Mr. Torgerson made a motion to recommend approval to City Council,
seconded by Mr. Dobratz the motion carried unanimously.
(d) CONSIDERATION OF FINAL PLAT OF MILLER TOWNHOUSE FIFTH ADDITION
Consulting Engineer Priebe explained the layout of the PUD and •
commented on the phases in this overall project.

The reason for this process of certification is to ensure that no
public hearings are scheduled on the same day.
Please note that if the city anticipates not adopting final levy

Attached to this letter is the sequence which the Department of Revenue requests that
counties, school districts and cities with populations over 2,500 follow in setting and
reporting dates for public budget hearings. As you will recall, each county, school district
and city with a population over 2,500 must notify the county auditor of its property tax levy
no later than November 9, 1989.
Also attached to this letter are new criteria which the Department is asking local
governments to follow in choosing a newspaper or newspapers in which to publish the
required notice of the date, hour and place of their public budget hearings.
You will notice that the sequence for setting and reporting budget hearing dates assigns to
the county auditor the role of coordinator of the entire process -- receiving notification of
the date established by the county and infomring the school districts, receiving notification
of the dates established by the school districts and informing the cities, and receiving
notification of the dates established by the cities.
In addition to asking counties, school districts and cities to establish dates for public budget
hearings, the Department is also asking that each county, school district and city with a
population over 2,500 establish and report to the county auditor a date for reconvening its
public budget hearing in the event the initial hearing must be recessed We are asking that
each county, school district and city with a population over 2,500 establish a date for
reconvening a recessed public budget hearing even if it does not expect that it will be
necessary to recess their public budget hearing.
Finally, I want to take advantage of this opportunity to assure you that any proposal for
property tax reform which the Governor presents to a special session of the legislature will
avoid provisions which would lead to delays in the mailing of property tax bills by
counties. Thus you can be assured that, under any proposal introduced by the Governor,
property owners will have sufficient time to pay their first half property tax bills by the
regular May 15th deadline.

1 First, the county board will determine the date of the county public budget
hearing for property taxes payable in 1990 and the date for reconvening the
meeting if recessed and will notify the county auditor of the date set for the
public budget hearing and the date set for reconvening the meeting if recessed.
2 Second, the county auditor will then notify the superintendent of each school
district whose administrative headquarters is located within the county of the
date set for the county public budget hearing and the date set for reconvening the

meeting if recessed, and the county auditor will request that each city council set
a date for the city's public budget hearing and a date for reconvening the meeting
if recessed.
5 Fifth, each city council of a city having a population over 2,500 will set the date
for the city's public budget hearing for property taxes payable in 1990 and for
reconvening the meeting if recessed and the mayor will notify the county
auditor of the county in which the city is located of the date set for the public

In late June you received a letter with instructions entitled Summary of Property
Tax Developments and Instructions to Counties, Cities with Populations over 2,500
and School Districts dated June 23, 1989.
The Department of Revenue is now eliminating a portion of those instructions
which concerned the selection of newspapers in which to publish budget and /or
levy hearing notices, and it is replacing another portion.
The following instructions requiring publication of a notice announcing the
reconvening of a recessed meeting are eliminated:
for counties: paragraph 20, sections h and i
for school districts: paragraph 6, sections g and h
for cities with populations over 2,500: paragraph 14, sections g and h
The instructions establishing criteria for selection of a newspaper or newspapers in
which to publish notice of budget and /or levy hearings are replaced with the
instructions given below.
Since counties theoretically must notify every citizen in the county and school
districts must notify every citizen in the school district, and since counties and
school districts often cover large geographic areas, the new instructions may require
local governments outside the Twin Cities area to publish the notice in more than
one newspaper.
The following instructions are replaced with the instructions given below:
for counties: paragraph 20, sections c and d
for school districts: paragraph 6, sections b and c
for cities with populations over 2,500: paragraph 14, sections b and c
1 Hennepin, Ramsey, Dakota, Washington, Anoka, Carver and Scott counties, all
school districts located within one or more of these counties and not located
partly in any other county, and all cities with populations over 2,500 located in
these counties.

All counties, school districts and cities with populations over 2,500 listed above
must publish their notices in the Thursday community section of the
Minneapolis Star Tribune or the Thursday communitv section of the St. Paul
Pioneer Press - Dispatch newspapers, whichever is delivered to the greatest
number of people in the county, the school district or the city. The notice must
be published in the edition of the community sections which regularly
publishes news of your county, city and /or school district.
2 All other counties, school districts and cities with populations over 2,500
a County governments must publish the notice of their public budget
hearings in all daily newspapers and all weekly newspapers which are
printed in the county for circulation anywhere within the county.
b School districts must publish the notice of their public levy hearings in all
daily newspapers and all weekly newspapers which are printed in the
county for circulation anywhere in the school district.

budget hearings in the daily newspaper which is printed in the city for

meet these requirements:
i the newspaper must be sold, it must not be a newspaper which is
available without charge.
ii the newspaper must regularly contain news articles of general interest.
iii the newspaper must be delivered directly to its subscribers by mail or

district or city which is sold, the notice may be published in a free

Enclosed is an example of the type of budget hearing notice the Department of Revenue is
asking all local governments to publish to fulfill the truth in taxation requirements pre-
scribed by the Department for taxes payable in 1990.
The notice should be printed using the same amount of space -- one - quarter page -- the
same arrangement of type and the same type sizes shown in the example.
To ensure that all citizens throughout the state receive the same type of notice, we are ask-
ing all local governments to use the language shown in the example -- modified, of course,
with appropriate local names, dates and locations. In addition, the use of uniform language
throughout the state will aid the Department in judging the effectiveness of the notice.
The organization of the notice is calculated to bring attention to the issue of greatest impor-
tance to property owners -- whether or not there will be an increase or decrease in the
amount of property tax to be collected. The language is aimed at a general audience -- one
not familiar with property tax terms used by government officials. The tone is intended to
be informal and friendly, and to communicate that you genuinely want the public to attend
the hearing.
You will notice that the second to the last sentence of the notice sets a date, hour and place
for reconvening the budget hearing if discussion on the budget cannot be completed at the
initial meeting and it must be recessed. Thus, in addition to selecting the date, hour and
place for your budget hearing, it will also it will necessary for you to select a date, hour and
place for reconvening the budget hearing, even though you do not expect it to be necessary
to reconvene the hearing.
This example fulfills all the requirements of the truth in taxation instructions which the
Department has mailed to you.

Asbestos Survey
Dear
FOR YOUR INFORMATION.
The following reports the results of our investigation into the presence
of asbestos - containing materials in the Hutchinson City Hall and the
Gargage /Police Storage Building located at 37 Washington Avenue West and
44 Washington Avenue West, Hutchinson, Minnesota. This assessment was
conducted per your request and is based on a walk- through of the property
on August 22, 1989. Bulk material samples for asbestos analysis were
collected at that time.
SAMPLE COLLECTION AND ANALYSIS
Material samples were collected by physically excising a portion of the
material. Each sample was placed in a separate polyethylene bag and
numbered in sequence of collection. The sample numbers and description
of the sample location were recorded separately. The samples were
submitted for analysis by the Minnesota Regional Office of PACE
Laboratories, Inc. (PACE).
Analysis was performed using the EPA Provisional Polarized Light
Microscopy Method, EPA - 600 -H4 -82 -020, December, 1982. The method
detection limit is 1% asbestos by weight. The Minnesota Regional Office
of PACE is accredited by the National Voluntary Laboratory Accreditation
Program to perform bulk asbestos material examinations.
ANALYTICAL RESULTS
City Hall: The results of the bulk sample examination are shown on Table
1. Three of the samples taken were found to be asbestos containing
material (ACM). These included the thermal system insulation (TSI) which
includes many of the straight heating pipe insulation runs in the
building as well as all of the pipe elbows. This material is white and
powdery, and easily identifiable. It is in fair to good condition.
Also found to be ACM were two samples of vinyl floor tile located in the
Motor Vehicle Department and in the hallway adjacent to the lst floor
bathroom.

The remaining fourteen samples were found not to be asbestos - containing.
These included the TSI surrounding the boiler, wall and ceiling plasters,
all of the different styles of ceiling tile, the vinyl tiles located in
the first floor break room and the second floor "meeting" room, the
sprayed -on fireproofing in the attic, and the asphalt roof seal coating.
Garage /Police Storage: Only two suspected asbestos - containing materials
were present. These included two "vibration panels" on the overhead
heating units and a "transite" wall board which was free standing in the
police storage area.
BUILDING DESCRIPTIONS
City Hall: The building was constructed in the late 1800's and has been
remodeled for various purposes several times. Its basic structure is
cement flooring with cement block and brick walls. It is covered by a
wood beamed flat roof with non -ACM asphalt seal coating. The roof frame
is also protected with non -ACM sprayed -on fireproofing.
Interior building materials sampled included the following floor
materials:
- Vinyl ACM tile in the Motor Vehicle Department and immediately
surrounding areas, and in the small area adjacent to the first
floor bathroom. All other vinyl tiles were reported as non -ACM.
- Non -ACM inlaid ceramic tile was found on all bathroom floors.
- Non -ACM terrazzo flooring was present at the main entrance.
Interior wall materials included:
- Non -ACM drywall room dividers.
- Hard piaster frames which were found non -ACM.
- Non -ACM ceramic tile was found in all the bathrooms.
Interior ceiling materials included:
- Soft non -ACM plaster in the boiler room.
- Hard non -ACM plaster in several rooms.
- Several varieties of non -ACM ceiling tiles indicative of the
many remodeling projects.

Additional interior building materials included:
TSI "mud" around virtually all of the T's, elbows, and joints.
This was tested and determined to be ACM. Some straight runs
were also made of this material.
TSI which was inaccessible because the pipes were located above
interlocking ceiling tiles and samples could not be obtained
without severely damaging the suspended ceiling. This TSI
appeared to be "air- cell" which is ACM. However, this TSI above
the ceiling tiles in excellent condition and will not need any
special attention unless remodeling or demolishing the
building. At such time, further investigation would be possible.
- Many straight pipe runs are covered with non -ACM fiberglass TSI.
- The boiler is jacketed with non -ACM fiberglass, non -ACM cement
"packing" and steel.
Garage /Police Storage: The Garage /Police Storage Building was also
inspected. This is a newer building with cement flooring, cement block
walls, and a metal ceiling with a similar asphalt roof seal coating.
RECOMMENDATIONS
City Hall: There are only two areas of concern regarding asbestos in
this building. These are the vinyl ACM floor tiles and ACM (TSI). The
vinyl floor tile poses very little health threat since the material is
very hard and harmful fibers can only be released by sanding, grinding or
removal. Removal is necessary before the tile is disturbed for
demolition or remodeling.
The ACM TSI is of much more concern. The T's, elbows, and joints which
are readily visible and easily disturbed should be abated as soon as
possible. In most cases abatement may be in the form of repair. ACM in
high activity areas should be removed. One such area is in the office
areas where damage has occurred to short sections of pipe wrap. Other
cases, such as in areas of the boiler room, removal is the only practical
option.
There is an undeterminable amount of TSI located above the interlocking
ceiling tiles. This TSI is suspected as ACM and is in good condition.
This material may be left intact. Water leakage apparent on a given
section of suspended ceiling tile may indicate a leaking pipe, in which
case it should be assumed that ACM TSI is also present in a damaged and
potentially harmful state. No such problems were in existence during the
inspection and no indication of any prior or potential problems were
given by maintenance personnel.

Garage /Police Storage: The vibration panels suspected are ACM and

very little threat of damage - even during demolition - since they can be
moved without disturbing the material. The transite wall board can be
moved to a new location if it appears that storage activities in this
building could 'lead to damaging the material.

RE: Abandonment of Four Star Bus Lines Route 959 from Madison to Twin Cities
Dear Community Leaders:
As most of you are aware, Four Star Bus Lines has abandoned Route 959, effective
September 18, 1989.
Our Task Force was successful in securing $32,162 in State grant funds to set up
a six -month demonstration project to help market the service in hopes of making
it self- sufficient. The burden was then placed on the 17 local communities to
match the state program. Phase 1 of the program was to raise $6,000 by September
15, 1989. Eight communities needed to make a $750 investment in inter -city bus
service by September 13, 1989. The only 4 communities that responded with a $750
check were Madison, Montevideo, Granite Falls and Renville, with a total of
$3,000 raised by the deadline. Our Task Force met on Thursday, September 14,
1989, to discuss the lack of support. It was the consensus of the group that a
3 -month demonstration period be explored. We contacted the State, and a 3 -month
demonstrations period with the potential of an additional 3 -month period would be
acceptable. We then proposed to Glen Roseland, president of Four Star Lines,
that we would send a check for $3,000 and enter in a 3 -month demonstration
period. On Friday, September 15, 1989, Mr. Roseland, after checking with his
attorney, indicated that a 3 -month demonstration period would be acceptable to
him and that he would send a bill for $3,000. The next day he sent a letter out
with his drivers to be delivered to all the agents, that Monday, September 18,
1989, would be the last day of bus service due to lack of community support. On
Sunday, September 17, his wife contacted Task Force member Bill Laven at his home
and told him that her husband was not accepting the 3 -month proposal.
To.say the least, myself and Task Force members were very disappointed in the
response (or lack of) to this issue. Today the lack of inter -city bus service
may not seem to be a big deal, only the future will tell us the importance of
this issue. It is hoped that neighboring communities will be able to join
together more effectively in addressing other rural problems that will face us in
the future.
