MINUTES
SPECIAL MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, MAY 5, 1992
The meeting was called to order at 5:00 P.M. by Mayor Ackland. The
following were present: Mayor Paul L. Ackland, Councilmen John
Mlinar, Marlin Torgerson and Don Erickson. Absent: Councilman
Craig Lenz. Also present: Finance Director Kenneth B. Merrill and
City Attorney G. Barry Anderson.
Mayor Ackland stated the purpose of the meeting was to discuss
Dakota Rail issues. He then reviewed the items discussed at the
previous meeting regarding this matter.
Attorney Anderson stated Eli Mills' counter -offer to the City was:
(1) not to assess $8,000 for Adams Street improvement regarding
Dakota Rail; (2) to decertify 1992 assessments for Third Avenue and
not to certify future assessments; (3) to uncharge or forgive
approximately $40,000 for Les Kouba Parkway; and (4) to proceed
with the original transaction as originally scheduled.
Following discussion, the motion was made by Councilman Torgerson,
• seconded by Councilman Mlinar and unanimously carried, to approve
the terms stated by City Attorney Anderson.
There being no further business, the meeting adjourned at 5:25 P.M.

OFFICER'S MEETING
Monday, April 13, 1992
The meeting opened at 9 :00 p.m.
* Officers /firemen need to make sure trucks have water after returning
to the station. 238 was left empty after a run.
Jim reported we have to be washing our gear keeping it clean to make it
last longer.
Brad reported that If any firemen testify and your are not reimbursed by
your employer the fire department will reimburse you.
Starting Immediately a fire fighter has to be present whenever any family •
member Is down at the station. This Is for liability reasons.

The meeting opened at 8:00 p.m.
Saturday, August 29th will be the Firemens banquet and hog roast.
Ryan Avis and Brian Koelin were voted on to reserves.
Engineer meeting will be Monday, May 25, 1992 at 7:00 p.m.

accept with regrets.
Steve reported we shouldn't be taking any gear from upstairs without
talking to him.
Brad reported on Memorial Day parade. If interested please sign up.
May 18 at 5:30 is 3M tour and steak fry. Net at front entrance of 3M.
Brad reported everybody should be helping with clean -up.

Jim reported new pumper could be here by early August.
Jim reported everybody should be wearing shoes when driving down to the
station and at the station. Along wiht that, liners must be in your
coat /pants and t- shirts must be worn under your coat to protect against
burns.

Meeting called to order at 5:05 P.M.
Members present: Dennis Kahl, Joe Dooley, Jim Faber and Mavor Paul ArlclAnrri
Guests present: Doug Meier, Jerry Peterson, Tom Parker and John Rodeberg.
Motion made by Joe Dooley and seconded by Dennis Kahl recommending a
letter of intent to award bid based on recommendation from TKDA with
approval from MN Department of Transportation and FAA. Passed unanimously.
Bids for 1992 Airport Expansion project were opened on May 18, 1992 and
the tabulated results are attached.
Next meeting will be held June 15, 1992, at 8:00 P.M. in Council Chambers
of City Hall.

WHEREAS, a resolution of the City Council adopted the 10th day of March,
1992, fixed a date for a Council Hearing on the improvement of

Recently we compiled a report of technical assistance the Mid - Minnesota
Development Commission has provided since its inception in 1974 through 1991.
I am in the process of hand delivering this report to all of the cities in
• the region and so far have made short presentations to 18 of the 40 cities.
My presentation rune from 8 -20 minutes depending on questions and comments.
Enclosed is your copy of the report. I will hand out copies to all the
Council on the 26th. I start out by giving some background on the Commission
and then focus on the highlights listed on page two. I'll and up by briefly
going over the assistance we provided Hutchinson which is listed on pages
39 and 40. I will encourage them to look at what kind of assistance we have
provided to others because it may give them ideas for new projects.
If there are errors in the report, they are probably errors of omission. It
was a rather laborious task to go through volumes of different records and
files over a 17 1/2 year period. I'm sure we missed a few things, and
hopefully, didn't give ourselves credit for anything where we didn't have
some sort of involvement.
I'm looking forward to visiting with you and the Council on the 26th.

RESOLUTION ADOPTING POSITION CLASSIFICATION
ASSIGNMENT TABLE EFFECTIVE JANUARY 1, 1992
WHEREAS, the City Council has considered the existing classification of
positions for the City of Hutchinson and the current economic conditions,
BE IT RESOLVED, that a Position Classification Plan is hereby adopted.
All positions covered by this Resolution shall be grouped in grades having a
definite range of difficulty and responsibility. For each position there
shall be a title; and there shall be shown examples of work which are
illustrative of duties of positions, as well as requirements as to knowledge.

A. Allocation 2i New Positiong_
When a new position is created for which no appropriate description exists or
when the duties of an existing position are sufficiently changed so that no
appropriate description exists, the City Council after recommendation of the
Personnel Coordinator shall cause an appropriate job description- specification
to be written for said position.
B. Review of Plan.
As often as necessary to assure continued correct classifications, the
Position Classification Plan shall be reviewed by the Personnel Coordinator
and necessary adjustments recommended to the City Council.
C. Filing of Plan_
Upon adoption of this Resolution, a copy of the Position Classification
Plan approved by the City Council shall be placed on file with the City
Administrator. The plan so filed and subsequently adjusted by the
Council shall be the Position Classification Plan of the City.
Elements of the Plan_ The Compensation Plan shall consist of:
a. A- Basic Table of Nuebered Pay Grades fur All Eaeloyees
Each numbered pay grade in the basic table consists of a minimum
(Level 1) rate, a maximum (Level 7) rate, and a midpoint (Level 4)
rate, in addition to intermediate levels, shown on page 4.
b. A Position f Assignsant Table for €pp19yee1
The assignment table shall assign all of the various positions in
the Position Classification Plan to the appropriate pay grade.
Said table follows on page 3.
2. Modification of Plan.
The City Council reserves the right to modify any or all of the
pay grades or position classification assignments as set forth in
said plan at any time.

a. Mon_Adoinistrativ_e (Hourly! Employees,
Each position is assigned 'a pay grade. The normal beginning rate
for a new employee will be the minimum rate. After satisfactory •
completion of twelve 112) months probation, up to a five percent
increase will normally be granted, with the exception that such
increase may be granted midway through the probationary period (at
six months) with the approval of the City Administrator.
Thereafter, consideration for performance increases will be given
annually each individual anniversary date. The City Administrator
reserves the discretion to adjust individual rates within the
assigned pay grades based upon (a) a merit review and recommendation
from the department head, reflecting job performance over the
preceding twelve months, and (b) consideration of equity among
departments. Consideration for market adjustment for all pay grades
will be made each January 1.
b. Administrative (Salaried) EmRjgyees_
Each position is assigned a pay grade. The normal beginning rate
for a new employee will be the minimum rate. In special situations,
a beginning provisional (Level O) rate may be used. After
satisfactory completion of twelve (12) months probation, up to a
five percent increase will normally be granted, with the exception
that such increase may be granted midway through the probationary
period (at six months) with the approval of the City Administrator.
Thereafter, consideration for performance increases will be given
annually each individual anniversary date. The City Administrator
reserves the discretion to adjust individual rates within the
assigned pay grades based upon (a) a merit review and recommendation
from the City Administrator or department head, reflecting job

C. Police Civil Service Eaployegs,
In Police Civil Service positions, the established starting rate
for patrol officers shall be Grade X, Level 2. followed by a
probationary period of one year. After completion of probation, an
increase to Level 3 shall be oranted. Likewise, an increase to
Level A shall be granted after completion of two vears employment
and to Level 5 after three years employment. Thereafter, length of
service shall be recognized as follows:
On completion of 5 years service, 1% additional;
On completion of 7 years service, 1% additional;
On completion of 9 years service, 1% additional;
On completion of 11 years service, 1% additional;
On completion of 13 years service, 1L additional (Level 6);
On completion of 15 years service, 1% additional;
On completion of 17 years service, 1% additional;
On completion of 19 years service, 1% additional;
On completion of 21 years service, 1% additional;
On completion of 23 years service, 1% additional (Level 7)- MAX. is
Any market adjustment on January 1 of any year shall be separate

Supervisory and investigative police department personnel shall be
salaried, with salary subject to periodic review by the Chief of Police,
and any recommendation for merit adjustment made to the City
Administrator. Police department office, dispatch and school liaison
personnel shall be hourly and under merit, plan. Any market adjustment
on January I of any year shall be separate and apart from the merit
adjustments.
None of the increases provided by this section shall be made so as to
compensate any employee In an amount exceeding the maximum step in the
assigned pay range.

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA, GRANTING
TO THE MAINSTREET ASSOCIATION THE RIGHT TO MAINTAIN A POPCORN WAGON
OVER AND ABOVE CERTAIN PROPERTY LOCATED IN THE LIBRARY SQUARE,
IDENTIFIED AS THE LIBRARY AND PARR TRACT BETWEEN BLOCKS 7 AND 8,
SOUTH ONE HALF OF THE CITY OF HUTCHINSON.
THE CITY OF HUTCHINSON ORDAINS:
Section 1. The City of Hutchinson, in the County of McLeod,
State of Minnesota, hereafter referred to as Grantor, hereby grants
to the Mainstreet Association, hereafter referred to as Grantee,
a franchise to operate and maintain a popcorn wagon for the purpose
of concession sales on certain property owned by the City of
Hutchinson, described as follows:
Section 2. The franchise is granted for a term of three (3)
years commencing on the date of the acceptance of the franchise.
Grantee shall file a written acceptance of the franchise with the
City Administrator of the City of Hutchinson within ten (10) days
after the effective date of this ordinance. The franchise shall
become effective only when the acceptance has been filed and
evidence of general comprehensive and liability insurance provided
• for in this grant of franchise has been filed and approved.
Section 3. Grantor reserves the right to enforce reasonable
regulations concerning construction, operation and maintenance of
facilities located along, over and under the public premises before
mentioned and the placement of such facilities.
Section 4. Grantee shall indemnify and defend Grantor, its
boards, commissions, officers, agents and employees, in any and
all other public agencies, and their members, officers, agents and
employees, against any and all liabilities for injury to or death
of any person or any damage to any property caused by Grantee, its
officers, agents or employees in the construction, operation or
maintenance of its property, or arising out of the exercise of any
right or privilege under the franchise.
Section 5. At all times during the term of the franchise,
Grantee will, at its own expense, maintain in force general
comprehensive liability insurance, with an insurance company
approved by the City of Hutchinson, with limits approved by the
City of Hutchinson by resolution or otherwise, the policy or
policies being for the protection of Grantor and its officers,
agents and employees, against liability for loss or damage for
bodily injury, death or property damage occasioned by the
activities of the Grantee under the franchise.
• Section 6. Grantee shall not have the right to assign the
franchise or otherwise transfer it in any manner whatsoever or

sell, lease, license, mortgage, or permit others to use or transfer
in any manner whatsoever any interest in all or any part of its •
facilities that are installed or operated under this grant, except
on prior written approval by ordinance of the City Council of the
City of Hutchinson.
Section 7. In the event the Mainstreet Association should
cease to exist or the Mainstreet Association should fail to use
the franchise for one calendar year, this franchise shall be deemed
null and void and shall revert to the City of Hutchinson without
any action on the part of the City of Hutchinson whatsoever.
Section S. This ordinance shall take effect from and after
passage and publication, subject to the provision above requiring
written acceptance by the Mainstreet Association.

REQUEST FOR CONDITIONAL AMENDMENT
Pursuant to City Ordinance Section 5.06 and 5.07, the
Licensee hereby petitions the Hutchinson City Council for a
Conditional Amendment to Liquor License No. 7, as follows:
Licensee shall be permitted to serve alcoholic
beverages on the patio contiguous to the structure
presently licensed. The patio shall have access only
from the licensed structure, and shall be surrounded by
a minimum six (6) foot high fence (See Exhibit " A " ).
The Conditional Amendment shall be predicated upon the
following:
(1) Licensee shall not allow alcoholic beverages to
leave the enclosed patio section, except for
patrons reentering the licensed structure.

(2) Licensee shall be responsible for clean -up of all
debris or rubbish resulting from the service on
the patio.
(3) The Licensee complies with all other City and
Building Ordinances.
(4) The City reserves the right to revoke this
Conditional Amendment, upon notice to the
Licensee, for violation of any of the foregoing
restrictions.

Amendment to Liquor License No. 7 effective May 26, 1992 through

TKDA is reviewing the qualifications of the bidders and will make
a recommendation based on their findings. Preliminary indications
are that Shingobee Builders appear to be a responsible bidder. We
will have a "Letter of Intent to Award Contract' prepared for the
Council Meeting. This is required to be sent to MnDOT and the FAA
in order to qualify for funding, if or when it becomes available.
We required the bid to be held for 75 days to allow for ti" to
reach the funding deadlines prior to actual award of the bid. We
are not sure of the possibility of funding this year, due to mixed
messages being sent by the Bush administration, but currently we
feel that their is a 50 -50 chance of funding availability.

THIS AGREEMENT, made and entered into the day and year set forth
hereinafter, by and between W.A. (Bill) Helland, a single man, Fee Owner, and
Kevin Compton and Carolyn F. Compton, husband and wife, and Donald E. Erickson
and Darlene A. Erickson, husband and wife, Contract Purchasers, hereinafter
called the "Subdivider ", and the City of Hutchinson, a Municipal Corporation in
the County of McLeod, State of Minnesota, hereinafter called the "City ";
WHEREAS, the Subdivider is the owner and developer of the following
described property situated in the County of McLeod, State of Minnesota, to -wits
Tract A of REGISTERED LAND SURVEY NO. 20, McLeod County, Minnesota
The same to be surveyed and platted and hereafter known as SIXTH GREEN
ESTATES;
WHEREAS, City Ordinance No. 464 and 466 requires the Subdivider to make
• certain improvements in the subdivision;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
1. The Subdivider hereby petitions the City to construct sanitary sewer
mains and appurtenances, watermains and appurtenances, sanitary
sewer service leads, water service leads, lateral and trunk storm
sewer and appurtenances, curb and gutter, street grading, street
base, street surfacing, and appurtenances for the entire plat.
2. It is understood and agreed that the improvements in Paragraph No.
1 will be installed by the City under two or more contracts.
3. It is understood and agreed that the total cost of said improvements
in Paragraph No. 1 shall include contracted costs, city
administration and engineering costs and capitalized interest cost.
4. It is understood and agreed that the total cost of said improvements
in Paragraph No. 1 shall be assessed on a per lot basis for Lots 1
through 5. It is understood that the owner's may desire to split
each lot into two parcels at some time in the future. It is agreed
that each of these parcels shall be assessed one -half of the total
assessment to the lot.
5. It is agreed and understood that all deferred assessments (SA -089,
• SA -109, SA -120, SA -179) and all active assessments (SA -227, SA -242,
SA -204A, SA -209A, SA -210A) shall be paid in full prior to the
issuance of any building permits on the property.

6. It is understood and agreed, that the Parks and Playground
Contribution has been fulfilled by the platting of the Helland's
(Rotary) Park.
7. It shall be the responsibility of the Subdivider to clear trees
and /or debris from utility easements and right -of -way, as per the
request of the City or utility prior to installation of the
improvements. The right -of -way shall be graded by the Subdivider to
within 0.2' of final subgrade and any unstable soil conditions in
the right -of -way shall be corrected prior to the commencement of
construction on the site. Any additional work needed to meet this
requirement shall be the responsibility of the Subdivider.
B. It is understood and agreed that it shall be the responsibility of
the Subdivider to provide topsoil for backfill of the curb and
gutter, and provide all turf establishment and erosion control
necessary to protect the utilities and street improvements.
9. This agreement shall be binding upon and extend to the heirs,
representatives, assigns and successors of the parties.
10. It is understood and agreed that it is the responsibility of the •
Subdivider to record this agreement at the County Recorder's office
and that no Building Permits will be issued until said Agreement is
recorded.

RESOLUTION APPROVING PLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS
LETTING NO. 9
PROJECT NOS. 92 -14
WHEREAS, the Director of Engineering for the City of Hutchinson, Minnesota,
has prepared plans and specifications for the improvement of Golf View Court
north of 8th Avenue N.W. in Tract A, Registered Land Survey #20 by construction
of storm sewer, sanitary sewer, watermain, services, grading, gravel base, curb
and gutter, bituminous base, bituminous surfacing and appurtenances, and has
presented such plans and specifications to the City Council for approval.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON, MINNESOTA:
1. Such plans and specifications, a copy of which is attached hereto and
made a part hereof, are hereby approved.
2. The Director of Engineering shall prepare and cause to be inserted in
the official newspaper, an Advertisement for Bids upon the making of such
improvement under such approved plans and specifications. The advertisement
shall be published for three weeks, shall specify the work to be done, shall
state that bids will be publicly opened at 10:00 A.M. on Friday, June 19th, 1992,
in the Council Chambers of the City Hall by the City Administrator and Director
• of Engineering, will then be tabulated, and will be considered by the City
Council in July 1992 in the Council Chambers of the City Hall, Hutchinson,
Minnesota. Any bidder whose responsibility is questioned during consideration
of the bids will be given an opportunity to address the Council on the issue of
responsibility. No bids will be considered unless sealed and filed with the City
Administrator and accompanied by a cashier's check, bid bond or certified check
payable to the City of Hutchinson for five percent (5t) of the amount of such
bid, along with required Insurance Certificates and Certificate of Compliance
with the Minnesota Worker's Compensation Law.

SUBJECT: Assessment 187 Third Ave NW
An assessment search on a property address of 187 Third Avenue
Northwest was recently completed. The search did not include an
assessment for water and sanitary sewer installed in 1968.

At the time of installation the mains were not assessed to the
property the reason which is not fully understood at this time. In
any case rolls were not prepared at the time of installation. A
list of previously undocumented assessments was prepared by Marlow
Priebe, City Engineer prior to his leaving city employ. It was
from this list the above assessments were listed but omitted on the
search.
The amount computed on the assessment was $1,596.27. I have
included the letter mailed in regard to this matter which did
address the matter.

Dear Hs. Wendlandt;
I regret the delay in response to your letter regarding the property at 187-
3rd Avenue N.W. We indeed find the property had two unrecorded assessments
for water main and sewer main installed in 1968. The original cost was
$303.60 and $394.68 for the water and sanitary sewer respectively. We have
computed the cost with interest and compared this to present cost of similar
installations to insure we have not exceeded present day value. This total
cost computed would be $1,596.27.
We have in our possession a check for $2,146.34 for deferred assessments for
Roll 245. A suggestion for possible solution to this issue would be to apply
the amount of $1,596.27 and refund the balance of this check (or issue a new
check).
As we explained, the amount of $2,146.34 may never be due and payable. The
only time the City would ask for collection on this amount is if said property
changes use from homestead property to commercial.
I hope this will clarify the situation and provide an acceptable remedy. If
you have any questions, please feel free to contact me.

SUBJECT: EQUIPMENT CERTIFICATES - 1992
In preparing the budget for 1992 we anticipated using equipment
certificates to finance the purchase of the street equipment.
Total cost of this equipment is $39,570. Equipment purchased is a
compactor, melter, heat lance, and router. City Council has
authorized the purchase and the equipment is arriving.
We have looked at several vendors to deal with a financing package
on this equipment and find most do not want to deal with amounts
under $100,000. At the same time investment rates are low and do
not soon appear to be on the rise.
We budgeted $8,500 for 1992 as a payment on the certifictate and
would use this as part of the down payment for the equipment. the
balance could be financed over a 3 year period at a simple interest
rate of 5.5 %. The rate would be comparable to rates paid on the
open market and would bring good return to our water and sewer fund
where we have sufficient funds for such an investment.
We would ask authorization to issue an equipment certificate to our
water and sewer fund for a total of $39,750 at a rate of 5.5 %. The
note would require a payment of $8,500 in 1992 and the balance to
be paid over the next 3 years.

At the time of selecting a long distance telephone service, last
fall, we had look at alternative telephone service. We were
prepared to enter into an agreement with a company called Dial Net.
A company which would have been able to provide on going long
distance monitoring by person making the call in addition to
savings on long distance charges. Because of some technical
problems encountered at the last minute we did not enter into a
contract with Dial Net.

We have received from the League of Minnesota Cities a program
which offers a significant discount on long distance rates through
MCI. The program is offer through the National League of Cities
which the LMC is affiliated.
We have had several discussions with MCI representatives and found
they offer billing by an employee number and will pay for
conversion of the current system as charged by the local telephone
company. In addition the cost of converting back (if the service
did not perfrom) to the present system would also be paid by MCI.
We have had a cost estimate made from one of our current 587 -5151
bills and MCI reports a savings of over $100 on long distance call
for one month.
It would be recommend city council authorization to switch to MCI
long distance telephone service.

Per City Council policy, I am requesting to attend the 65th Water
Environment Federation's Annual Conference in New Orleans,
Louisiana, September 19 -23, 1992. The Technical Sessions that I
plan to attend include Biological, Nutrient and Metal Removal,
Toxicity Reduction, New Process Design and Control, Collection
System Design, Odor and Corrosion Control. Also, two sessions
are planned on the new E.P.A. sludge rules, these sessions are
important to the operation and compliance of our facility.
The last out -of -state conference that I attended was in 1989.
This conference was budgeted for in 1992 at an estimated cost
of $1,100.00.

RE: Request for Purchase /Lease
The 1992 Budget includes $15,000 for the replacement of the 1981
Toro Workmaster. We are requesting the purchase of two John Deere 626
AMTs to replace the Toro Workmaster, and entering into a lease agreement
with L & P Supply of Hutchinson for annual cost of $1,200 through 1997.
The lease agreement will provide the City of Hutchinson two new fully
warranted utility vehicles in years 1992, 1994 and 1996.
We feel by providing two vehicles instead of one, productively
• through the parks department will be greatly enhanced. By entering into
a lease agreement, maintenance costs through 1997 should decline due to a
faster turnover of vehicles than is currently in place.
The initial capital outlay for this program will cone out of the
equipment revolving fund. Future lease payments will be paid through
the Parks Deparment Budget. Monthly maintenance costs will continue to
be paid through the Parks Budget which is the current practice. Below
you will find quotations from three vendors.

SUBJECT: GROOMER PURCHASE
The proposed purchase of the ball field groomers if agreed to by
the city council would occur as follows:
The money for the purchase and additional equipment would come
from the central garage fund. $15,000 will have been
collected in rent for replacement by the end of 1992.
Once the equipment is purchased the funds for the annual lease
would flow from the park department. No rent would be paid to
the central garage for future replacement. The current piece
of equipment would be retain and used until no long functional
for park use. (No rent would be paid in future years on this
piece of equipment).
If a similar piece of equipment would be needed by the Parr
Department, the item would have to be purchased and budget in
the park department and new rental program implemented in the
central garage.

RE: Dry Dock Lease
Following up on the correspondence to Mayor Ackland and Gary
Plotz on May 7, 1992. I talked with Mr. Wakefield concerning a
new lease. Mr. Wakefield stated he would be willing to enter
into another six month agreement through December 31, 1992.
He also said he would work with the city into 1993 providing any
• length of lease we would desire. This would be pending the
amount of funding available and our potential to relocate the
youth center into a city owned facility.
I would recommend picking up a six monthy lease option at the
current facility. Attached you will find the most recent budget
report as well as attendance figures.

Today I'm writing you regarding our agreement on the Dry Dock's lease
agreement. As you know, the lease agreement expires on July 1, 1992,
completing the 6 -month lease, with your last monthly payment being
June 1, 1992.
I
I'm proposing that the City of Hutchinson enter into a new lease
agreement with the landlord, Scott J. Wakefield, to rent the current
space for one (1) year. I'm respectfully submitting this proposal for
your approval. If the City is agreeable to it's terms, there would be
limited disruption from one lease to the other.
From my standpoint, there have not been any problems with the current
lease. I think that Jon and Dolf have done a great job and continue to
do so with the program, keeping it interesting for the young people
it serves. So therefore, I'm in agreement to entering into a new Iease
for one (1) year at the current terms.
If you have any concerns or ideas concerning the lease, please feel free
to contact me. Otherwise, if the City is in agreement to the current
terms of the lease, sign the enclosed lease agreement upon your review,
and forward the original document to me.
I have been pleased with the progress of the Dry Dock and hope we can
continue to collaborate on this project.

LEASE AGREEMENT
THIS LEASE, entered into in Hutchinson, Minnesota, as of this
day of , 19 , by and between Scott J. Wakefield,
"Landlord "), and the City of Hutc inson, Hutchinson, Minnesota ( "Tenant ").
1. PREMISES:
Landlord hereby leases to Tenant the premises (the "Premises ")
described as follows:
Space within the building located in Block One (1), North 18 feet of Lot Two (2),
Block Eight (8), South Half in the City of Hutchinson, address being: 26 West
Washington Avenue, Hutchinson, Minnesota 55350, having an approximate total square
footage of 1,086 feet.
Landlord reserves the right to place, maintain, repair, and replace
utility lights, pipes, tunneling, and the like, in, under, over, upon, or through the
premises as may be reasonably necessary or advisable for the servicing of the premises
or other portions of the building.
2. TERM:
(A) To have and to hold the premises unto Tenant commencing on
July 1, 1992, and expiring on July 1, 1993. The City may enter into another 6 month
or 1 year lease at that time to better fit it's needs accordingly.
3. RENT
(A) Tenant agrees to pay the Landlord, at 700 South Grade Road,
Hutchinson, Minnesota 55350, monthly installments commencing July 1, 1992, in the
amount of $750.00 per month.
(B)
All utilities will be paid
by the Landlord except
for those
deemed excessive. Excessive will be defined as more
than normal usage due
to unusual
amount of extraordinary
appliances, games, gaming
machines, lighting, and so
on.
4. TAXES:
All taxes will be paid by the Landlord.
5. CONSTRUCTION:
Tenant shall not undertake any construction, nor shall Tenant install
any equipment other than trade fixtures and personal property, without first obtaining
Landlords' written approval of plans and specifications therefore. Tenant shall not
commence any work until Tenant delivers to Landlord a policy or policies of public
liability and property damage insurance naming Landlord as an insured, and limits and
with companies acceptable to Landlord. Construction of Common Area bathrooms and
their cost will be worked out between Tenant and Landlord on a shared cost basis. All
parties shall be agreeable to the dollar amounts or the lease will be terminated.
6. COMMON AREAS:
Landlord grants to Tenant and
Tenant's
customers
and invitees the
right to use,
in common with all others to whom Landlord
has or may
hereafter
grants
rights to use
the same, the Common Areas located
within
the building
and on the land
of Landlord.
The term "Common Areas" as used
in this
Lease, shall
mean the
Men's
and Women's
Restrooms, located directly south
of the leased area, to be
used
collectively with
Family Rexall Drug. Landlord
hereby
reserves the
following
rights
with respect to the Common Areas:
(1) To establish reasonable rules and regulations for the use
• thereof;
(2) To change the layout of such Common Areas, including the
right to reasonably add to or subtract from the shape and size,
whether by the addition of building improvements or otherwise;
(3) The Tenant shall maintain, clean, and stock appropriate
Common Areas, and this shall be taken into consideration;
Tenant shall pay to Landlord as a Common Area Charge, the
following share of all costs and expenses of every kind and nature paid or incurred by
Landlord in operating, maintaining, and repairing the Common Areas:
(i) Tenant shall pay One Hundred Percent (100.00 %) of all
maintenance, repair, and supply costs and expenses for the public
restrooms.
(ii) Tenant is also responsible for the maintaining of the Common
Area in front, back, and sides of the leased property in accordance
with City Policy, and by the other lessee's actions. Common Area
charges are to be verifiable expenses and not to exceed Twenty
Dollars ($20.00) per month, excluding utilities.
7. USE OF PREMISES BY TENANT:
Tenant shall use the Premises only as and for the purpose of
conducting a youth center.
• 8. TENANT'S COVENANTS WITH RESPECT TO OCCUPANCY:
Tenant agrees to the following:
(A) To occupy the Premises in a safe and careful manner and in
compliance with all laws, ordinances, rules, regulations and orders of any governmental
bodies having jurisdiction over the Premises, and without committing or permitting
waste;
(B) To neither do not suffer anything to be done or kept in or
about the premises which contravenes Landlord's policies or increases the premiums
therefore;
(C) To permit no reproduction of sound which is audible outside the
Premises nor permit odors to be unreasonably dispelled from the Premises;
(D) To place no sign on the exterior of the Premises or on the
interior surface of any windows of the Premises without also obtaining Landlord's prior
written consent, which will not be unreasonable withheld, and to maintain in good repair
and promptly remove and repair any damage caused by any such permitted signs.
Tenant agrees to maintain its' signs in a good state of repair and to save the Landlord
harmless from any loss, cost, or damage as a result of the same and shall repair any
damage which may have been caused by the erection, existence, maintenance, or
removal of such signs;
• (E) To keep any refuse in proper containers in the interior of the
premises until the same is removed and to permit no refuse to accumulate around the
exterior of the Premises;

(F) To neither load nor unload or permit the loading or unloading
of merchandise, equipment, or other property from any doors of the Premises that open
onto the front sidewalk areas, nor from any of the doors except from the west side of
the Premises and to use its' best efforts to prevent the parking or standing of vehicles
and equipment upon the land except when actually engaged in loading or unloading;
(G) To permit Landlord free access to the Premises at all
reasonable times for the purpose of examining the same or making alterations or repairs
to the Premises that Landlord may deem necessary for the safety or preservation
thereof;
(H) To adequately heat and cool the Premises;
(I) To permit no lien, notice of intention to file lien or other
charges whether arising out of work of any contractor, mechanic, laborer or material -
man or any mortgage, conditional sales, security agreement encumbrances or charge
upon the Premises or any part thereof of the income therefrom, and to suffer no other
matter or thing whereby the estate, right and interest of the Landlord in the Premises
or any part thereof might be impaired;
(J) To comply with all reasonable rules and regulations which
Landlord may from time to time, establish for the use and care of the Premises, the
Common Areas, and other facilities and buildings on the land;
(K) Handle and dispose of all rubbish, garbage, and waste in
accordance with regulations established by Landlord and not permit the accumulation
of any trash, rubbish, refuse, garbage or waste materials in, on, or about any part of
the land;
(L) That it shall not subject any fixtures, furnishings or equipment •
in or on Tenant's Premises which are affixed to the realty of any mortgages, liens,
conditional sales agreements, security interests or encumbrances;
(M) To permit no damage or destruction of Landlord's Premises or
personal property, reasonable wear and tear excepted.
9. REPAIRS AND ALTERATIONS:
(A) Landlord shall provide the following repairs within a reasonable
time from the date of possession:
Repairs by Landlord. Landlord shall keep the foundations, roof, and
structural portions of the outer walls of the Premises in good repair, except for repairs
required thereto by reason of the acts of Tenant, Tenant's employees, agents, invitees,
licensees, or contractors. Tenant shall give Landlord written notice of the necessity for
repairs coming to the attention of Tenant following which Landlord shall have a
reasonable time to undertake and complete such repairs. The provisions of this section
shall not apply in the case of damage or destruction by fire or other casualty or by
Eminent Domain, in which events the obligations of Landlord shall be controlled by
preceding Sections hereof.
It is expressly understood that Landlord shall not be responsible for
any structural or exterior portions of the Premises not originally constructed by the
Landlord nor any structural or exterior portions of the abutting building. •

(B) Be5airs by Tenant. Except as provided in Subsection 10, (A)
Tenant shall keep the Premises and every part thereof and any fixtures, facilities or
equipment contained therein, in good condition and repair.
• (C) Removal of Improvements. All items of Landlord's
construction, all heating and air conditioning equipment, and all alterations, additions
and other improvements by Tenant shall become the property of Landlord and shall not
be removed from the Premises. All trade fixtures, alterations, additions, and other
improvements by Tenant, furniture, furnishings, and signs installed in the Premises by
Tenant and paid for by Tenant shall remain the property of Tenant and may be removed
upon the expiration of the term of this Lease; provided (i) That any of such items as
are affixed to the Premises and require severance may be removed only if Tenant
repairs any damage caused by such removal, and (ii) That Tenant shall have fully
performed all of the convenants and agreements to be performed by Tenant under the
provisions of this Lease. If Tenant fails to remove such items from the Premises prior
to the expiration or earlier termination of this Lease, all such trade fixtures, furniture,
furnishings, and signs shall become the property of the Landlord unless Landlord elects
to require their removal, in which case Tenant shall promptly remove same and restore
the Premises to its' prior condition. In the event Tenant fails to remove all such trade
fixtures, furniture, furnishings, and signs within ten (10) days after the Landlord elects
to require their removal, Landlord shall have the right to remove same and sell such
trade fixtures, furniture, furnishings, and signs to pay for the cost of removal.
Tenant further agrees that all personal property of every kind or
description which may at any time be in the Premises shall be at the Tenant's sole
risk, or at the risk of those claiming under the Tenant. Landlord shall not be
responsible or liable to Tenant for any loss or damage that may be occassioned by the
acts or omissions of persons occupying any space adjacent to or adjoining Tenant's
. Premises, or any part thereof. Landlord shall not be responsible or liable to Tenant for
any loss or damage resulting to Tenant or its' property from roof leaks, water, gas,
steam, fire, or the bursting, stoppage, or leaking of sewer pipes, or from the heating or
plumbing fixtures, or from electric wires, or from gas or odors, or caused in any
manner whatsoever.
10. INDEMNITY AND INSURANCE:
(A) Indemnification by Tenant. Tenant will indemnify and hold
Landlord harmless from and against all loss, cost, expense, and liability whatsoever
(including Landlord's cost of defending against the foregoing, such cost to include
attorney's fees) resulting or occurring by reason of the Tenant's construction, use or
occupancy of the Premises.
(B) Public Liability Insurance. Tenant agrees to carry public
liability insurance covering the Premises and Tenant's use thereof, together with
contractual liability endorsements covering Tenant's obligations set forth in Subsection
11(A), in companies and in a form satisfactory to Landlord, with minimums of Two
Hundred Thousand Dollars ( $200,000.00) on account of bodily injuries to or death of
one person, Six Hundred Thousand Dollars ( $600,000.00) on account of bodily injuries to
or death of one or more than one person as a result of any occurrence and Fifty
Thousand Dollars ( $50,000.00) coverage for property damage, in lieu of the $2,500.00
damage deposit, and to deposit said policy or policies (or certificates thereof) with
Landlord prior to the date of any use or occupancy of the Premises by Tenant; said
policy or policies shall name Landlord and Tenant as insureds and shall bear
• endorsements to the effect the insurer agrees to notify Landlord not less than thirty
(30) days in advance of any modification or cancellation thereof.

(C) Landlord's Liability. Landlord shall not be liable (i) For any
damage to Tenant's property located In the Premises, regardless of the cause of such
damage. (ii) For any acts or omissions of other Tenants of the building, not (iii)
For any condition of the Premises whatsoever unless Landlord is responsible for th
repair thereof, and has failed to make such repair after notice from Tenant of the need*
therefore, and expiration of a reasonable time for the making of such repair.
(D) Fire and Extended Coverage Insurance. Landlord agrees to
carry policies insuring the improvements of the building against fire and such other
perils as are normally covered by extended coverage endorsements in the county where
the Premises are located, in an amount equal to at least Eighty Percent (80.0 %) of the
insurable value of such improvements, together with insurance against such other risks
(including loss of rent) and in such amounts as Landlord deems appropriate. Tenant
agrees to notify Landlord in writing on the date of completion regarding the cost of
any improvements installed in the Premises during the term of this Lease other than
trade fixtures, inventory, furniture, furnishings, signs, or personal property of the
Tenant. Tenant's failure to advise Landlord regarding the value of said improvements as
provided herein shall constitute a waiver of Tenant's right to be reimbursed for said
improvements in the event of destruction of the Premises. Tenant shall pay its' pro-
portionate share of the foregoing insurance per said Subsection; provided, however, that
Tenant shall have no rights in said policy or policies maintained by Landlord and shall
not, by reason of such reimbursement, be entitled to be a named insured thereunder.
In the event any of the Landlord's policies insures Premises or risks other than the
building or the rents therefrom, the statement of the insurer shall be conclusive as to
the portion of the total premium attributable to the building. Tenant agrees to carry
insurance against fire and such other risks as are, from time to time, included in
standard extended coverage endorsements, insuring Tenant's stock -in- trade, trade
fixtures, furniture, furnishings, special equipment, floor and wall coverings, and all other
items of personal property of Tenant located on or within the Premises, such coverage
to be in an amount equal to at least Eighty Percent (80.0 %) of replacement cost
thereof. Prior to possession Tenant shall furnish Landlord with a certificate evidencing
such coverage.
11. DAMAGE AND DESTRUCTION.
In the event the Premises are damaged by any peril covered by
standard policies of fire and extended coverage insurance to an extent which is less
than Twenty -five Percent (25.0 %) of the cost replacement of the Premises, the damage
shall, except as hereinafter provided, promptly be repaired by Landlord, at Landlord's
expense but, that in no event shall Landlord be required to repair or replace Tenant's
stock -in- trade, trade fixtures, furniture, furnishings, equipment, or personal property. In
the event (a) The Premises are damaged to the extent of Twenty -five Percent (25.0 %)
or more of the cost of replacement of the Premises, (b) The buildings are damaged
to the extent of Fifty Percent (50.0 %) or more of the cost of replacement, notwith-
standing the extent of damages to the Premises, Landlord may elect either to repair
or rebuild the Premises or the buildings, as the case may be or to terminate this Lease
upon giving notice of such election in writing to Tenant within ninety (90) days after
the event causing the damage. If the casualty, repairing, or rebuilding shall render the
Premises untenantable, in whole or in part, a proportionate abatement of the Minimum
Rent shall be allowed until the date Landlord completes the repairs or rebuilding. If
Landlord is required or elects to repair the Premises, Tenant shall repair or replace its'
stock -in- trade, trade fixtures, furniture, furnishings, equipment, and personal property in
a manner and to at least a condition equal to that prior to its' damage or desctruction
and the proceeds of all insurance carried by Tenant shall be held in trust by Tenant for .
the purpose of such repair and replacement.

12. ASSIGNING AND SUBLETTING:
Tenant shall not sublet the Premises or any part thereof nor assign
this Lease, without in each case the prior written consent of Landlord.
• 13. EMINENT DOMAIN:
In the event the building or any part thereof shall be taken or
condemned either permanently or temporarily for any public or quasi - public use or
purpose by any authority in appropriate proceedings or by any right of eminent domain,
the entire compensation award thereof, including, but not limited to, all damages as
compensation for diminution in value of the leasehold, reversion and fee, shall belong to
the Landlord, without any deduction therefrom for any present or future estate of
Tenant, and Tenant hereby assigns to Landlord all its' right, title, and interest to any
such award. However, Tenant shall have the right to recover from the condemning
authority, but not from the Landlord, such compensation as may be separately awarded
to Tenant on account of interruption of Tenant's business and for moving and relocation
expenses.
14. DEFAULT BY TENANT:
If Tenant defaults in the payment of Minimum Rent or other
charges or in the performance of any other of Tenant's obligations hereunder, and fails
to remedy such default within ten (10) days after written notice from Landlord (unless
the default relates to matters other than the payment of money and cannot be
remedied within ten (10) days and Tenant commences to remedy such default within
ten (10) days after written notice from Landlord and thereafter diligently pursues
correction thereof in which event the time to remedy such default shall be extended to
the time reasonably required therefore), or if a receiver of any property of Tenant on
• the Premises is appointed or Tenant's interest in the Premises is levied upon by legal
process.
Landlord may enter upon the Premises and terminate this Lease.
In the event of such termination, the obligations of Landlord hereunder shall cease
without prejudice, subject however, to the right of Landlord to recover from Tenant any
sums due Landlord for rent or otherwise including reasonable attorney's fees, to the
date of such entry, and also liquidated damages equal to any deficiency between the
then rental value of the Premises for the unexpired portion of the term and the rent
provided for that portion of the term, discounted at Four Percent (4.0 %) per annum to
present net worth. In addition, Landlord may enter upon the Premises without
terminating his Lease and may relet them in its' own name for the account of Tenant
for the remainder of the term at the highest rent then obtainable and immediately
recover from Tenant any deficiency for the balance of the term between the amount
for which the Premises were relet, less expense of reletting and the rent provided here-
under. If Landlord submeters electric current, gas, or water to the Premises, then if at
any time Tenant fails to pay rent or other charges for the same within ten (10) days
after they are due, Landlord may, at its' option, in addition to the foregoing remedies
and without further notice to Tenant, cease furnishing such electric current, gas, or
water. No failure of Landlord to enforce its' right or remedies upon default of Tenant
shall prejudice or effect the rights of Landlord upon any subsequent or similar default.

interest at the rate of Fifteen Percent (15.0 %) (or the highest rate of interest
allowable by law, whichever is the lesser) from their due date until paid, said interest*
to be so much additional rent under this Lease and shall be paid to Landlord by Tenant
upon demand.
All rights and remedies of Landlord herein enumerated shall be cumulative,
and none shall exclude any other remedies allowed at law or in equity.

and to the interest thereon, and all renewals, replacements, and extensions thereof.
Tenant also agrees that any mortgagee or trustee may elect to have this Lease prior
to the lien of its' mortgage or deed of trust, and upon notification by such mortgagee •
or trustee to Tenant to that effect, this Lease shall be deemed prior in lien to the said
mortgage or deed of trust, whether this Lease is dated prior to or subsequent to the
date of said mortgage or trust deed. Tenant agrees that, upon the request of Landlord,
any mortgagees, or any trustees named in such mortgages or trust deeds, it shall
execute and deliver whatever instruments (including but not limited to a Memorandum
or Lease and /or a Non - Disturbance and Attornment Agreement in recordable form)
which may be required for such purposes and to carry out the intent of this section.
17. QUIET ENJOYMENT:
Landlord hereby convenants and agrees that if Tenant shall perform all the
convenants and agreements herein stipulated to be performed on Tenant's part, Tenant
shall at all times during the continuance hereof have the peaceable and quiet enjoyment
and possession of the Premises without any hindrance from Landlord or any person or
persons lawfully claiming the Premises.
18. MISCELLANEOUS PROVISIONS:
(A) Accord and Satisfaction. No payment by Tenant or receipt of a
lessor amount than the rental herein stipulated shall be deemed to be other than on
account of the earliest stipulated rent nor shall any endorsement or statement on any

(B) Entire Agreement. This Lease and the exhibits attached hereto set
forth all the covenants, promises, agreements, conditions, and understandings between
Landlord and Tenant concerning the Premises and that there are no covenants, promises,
• agreements, conditions or understandings, either oral or written, between them other
than are herein set forth. Except as herein otherwise provided, no subsequent
alteration, amendment, change or addition to this Lease shall be binding upon Landlord
or Tenant unless reduced to writing and signed by them.
(C) Surrender and Holding Over. Tenant shall deliver up and surrender to
Landlord possession the Primes upon the expiration of the Lease, or its'
termination in any way, in as good condition and repair as the same shall be at the
commencement of said term (damage by fire and other perils covered by standard fire
and extended coverage insurance and ordinary wear and decay only excepted). Should
Tenant remain in possession of the Premises after any termination of this Lease, no
tenancy or interest in Premises shall result therefrom but such holding over shall be an
unlawful detainer and all such parties shall be subject to immediate eviction and
removal, and Tenant shall upon demand pay to Landlord, as liquidated damages, a sum
equal to double the Minimum. Rent as specified herein for any period during which
Tenant shall hold the Premises after the stipulated term of this Lease may have
terminated.
(D) Additional Rent. Any amounts to be paid by Tenant to Landlord
pursuant to the provisions of this Lease, whether such payments are to be periodic and
recurring or not, shall be deemed to be "Additional Rent" and otherwise subject to all
provisions of this Lease and of law as to the default in the payment of rent.
(E) Severability. in the event that any provision or section of this Lease
is rendered invalid by the decision of any court or by the enactment of any law,
• ordinance or regulation, such provision of this Lease shall be deemed to have never
been included therein and the balance of this Lease shall continue in effect in
accordance with its' terms.
(F) Security. The Tenant shall receive one (1) key to said Premises and
shall be liable for cost incurred if the key is lost, stolen or destroyed. After the
termination of the Lease, said key shall be returned to Landlord promptly.
(G) Personal Property. All personal property of the Landlord's shall be
the responsibility and under the Landlord's control. Items deemed personal property
shall be, the air conditioner and various cleaning devices. After termination of said
Lease, the articles aforementioned shall stay in said Premises and be deemed in good
working order.

Pursuant to Section 6.07, of Zoning Ordinance No. 464, the
Hutchinson Planning Commission is hereby submitting its findings of
fact and recommendation with respect to the aforementioned request
for a conditional use permit.
HISTORY
On March 16, 1992, Tom Daggett, Hutch Mfg., submitted an
application for a conditional use permit to allow for the
construction of an addition to current office space and saw shed
located at Hutchinson Manufacturing on Hwy 7 West. A public
hearing was held at a regular meeting of the Planning Commission on
Tuesday, May 19, 1992, at which time there was no one present who
objected to the request.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee
paid.
2. Notices were mailed to the surrounding property owners as well
as published in the Hutchinson Leader on Thursday, May 7,
1992.
3. The proposal is in conformance with the requirements of a
conditional use permit.
RECOMMENDATION
It is the recommendation of the Planning Commission that the
aforementioned request be approved providing staff recommendations
are met regarding the pond, buffering, hardsurfacing of parking lot
and verification of utility easement.

FINDINGS

the use on the Comprehensive Plan.
3. The Council has determined that the proposed use will not

community nor will it cause serious traffic congestion nor hazards,
• nor will it seriously depreciate surrounding property values, and
the proposed use is in harmony with the general purpose and intent

CONCLUSION

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,

FINDINGS
1. Larry DeGrote, has applied for a variance from Section 7
of Zoning Ordinance No. 464 to allow the him to reduce setback for
driveway from 5' to 1' located at 228 Grove St with the following
legal description:
The South 120 feet of Lot 3 in Block 30 in the Townsite
of Hutchinson South Half, except the West 70 feet
thereof, McLeod County, Minnesota.
Lying and being in the Northwest Quarter of Section 6
Township 116 North of Range 29 West.
2. The Planning Commission has reviewed the application for
a variance and has recommended to the City Council that the
application be approved for 3'and denied for 1'.
3. The Council has considered the effect of the proposed
variance upon the health, safety, and welfare of the community,
existing and anticipated traffic conditions, light and air, danger
of fire, risk to the public safety, and the values of property in •
the surrounding area and the effect of the proposed variance upon
the Comprehensive Plan.
4. Because of conditions on the subject property and on the
surrounding property, it is possible to use the subject property in
such a way that the proposed variance will not impair an adequate
supply of light and air to adjacent property, unreasonably diminish
or impair health, safety, comfort, morals, or in any other aspect
be contrary to the intent of the ordinance and the Comprehensive
Plan.
5. The special conditions applying to the structure or land
in question are peculiar to such property or immediately adjoining
property and do not apply generally to other land or structures in
the district in which such land is located.
6. The granting of the application is necessary for the
Preservation and enjoyment of a substantial property right of the
applicant. It will not merely serve as a convenience to the
applicant, but is necessary to alleviate demonstrable hardship or
difficulty.
CONCLUSION
The application for variance for the purpose designated is
approved for a 3' driveway setback. •

1. CALL TO ORDER
The meeting was called to order by Acting Chairman Bill Craig
at 7,30 p.m. with the following members present, E1Roy Dobratz,
Tom Lyke, Craig Lenz and Bill Craig. Members Absent, Clint Gruett,
Roland Ebent and Dean Wood Also Present, Gary Plotz, City
Administrator, and John Rodeberg, City Engineer
2. MINUTES
Mr. Lenz made a motion to approve the minutes of the regular
meeting dated Tuesday, April 21, 1992. Seconded by Mr. Dobratz the
motion carried unanimously.
3. PUBLIC HEARINGS
(a) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY TOM
DAGGETT, HUTCHINSON MANUFACTURING
• Acting Chairman Craig opened the hearing at 7,32 p.m.
with the reading of publication #4377 as published in the
Hutchinson Leader on Thursday, May 7, 1992. The request
is for the purpose of considering a request to construct
office space and saw shed at Hutchinson Manufacturing on
Hwy 7 W.
City Administrator Gary Plotz commented on the zoning.
He explained the staff required a site plan and met with
Mr. Tom Daggett. He also commented on the
recommendations of staff. City Engineer John Rodeberg
explained the 100' x 100' pond for flow of drainage.
Discussion followed on the buffering between R -1 and
Industrial site.
Mr. Farid Cumimbhoy, Hutchinson Mfg., explained the use
of the saw shed and agreed to the hardsurfaced parking.
Mr. Lyke moved to close the hearing, seconded by Mr.
Dobratz the hearing closed at 7:43 p.m. Mr. Lyke made a
motion to recommend approval to city council subject to
the recommendation of staff being met in regard to pond
size, buffering, hardsurfacing of parking lot and
• verification of utility easement. Seconded by Mr.

of the house. Neighboring property owners questioned the
position of the house on the lot.
Mr. Plotz explained the notice including a sign on the
private property stating the proposal will be instead to
place the sign on the boulevard. There was discussion of
the size of the sign.
