SPECIAL MEETING - HUTCHINSON CITY COUNCIL
MONDAY, JULY 20, 1992
The meeting was called to order at 12:00 noon by Mayor Ackland.
Present were Mayor Paul L. Ackland, Councilmen Marlin Torgerson and
Don Erickson. Absent: Councilmen Craig Lenz and John Mlinar. Also
present: City Administrator Gary D. Plotz and City Engineer John
Rodeberg.
1. CONSIDERATION OF LICENSE APPLICATIONS FOR RESIDENTIAL AND /OR
COMMERCIAL HAULING
Following discussion, Councilman Erickson moved to approve
issuing licenses for five commercial hauling applications:
Aagard West, Inc.; Junker Sanitation Service Inc.; Kubasch And
Sons, Inc.; McKimm Milk Transit, Inc.; and Witte Sanitation
Inc. Motion seconded by Councilman Torgerson and unanimously
carried.
2. CONSIDERATION OF AWARDING CONTRACT FOR INTERIM RESIDENTIAL
GARBAGE PICKUP
During discussion the City Attorney stated the City Council
• needed to determine whether to award the bid to the lowest
bidder or continue with the present hauler to avoid disrup-
tion of service.
The motion was made by Councilman Torgerson to accept Witte's
bid at $12.95 per month for each city residential unit for the
interim service. Motion seconded by Councilman Erickson and
unanimously carried.
Upon the City Attorney's recommendation, Councilman Erickson
moved to approve licensing Witte Sanitation as a residential
hauler in Hutchinson. Motion seconded by Councilman Torgerson
and unanimously carried.
3. DISCUSSION OF ALTERNATIVES FOR LIQUOR STORE LAYOUT
Discussion centered on the fact that the liquor store proposal
was not in compliance with the City code, and there was a
shortage of parking spaces. If an agreement could not be
reached with Erickson's Diversified, it was suggested the City
consider the alternative liquor store site at the Shopko
location.
4. CONSIDERATION OF SUPPLEMENTAL AGREEMENT NO. 2 TO HUTCHINSON
AIRPORT EXPANSION ARCHITECT /ENGINEER AGREEMENT WITH TKDA
• Engineer Rodeberg explained the purpose of the supplemental
agreement with TKDA. Following discussion, Councilman

Mayor Ackland called the public hearing to order at 8:25
P.M. and read Republication No. 4402.
Engineer Rodeberg reported only two properties would be
assessed; namely, Shopko and Simonson Lumber Co.
Following discussion, the motion was made by Councilman

(a) UPDATE PRESENTATION ON PIONEERLAND LIBRARY SYSTEM AND
BUDGET ITEMS
Director John Houlahan presented a report on the Pioneer -
land Library System and its 1992 budget.
(b) CONSIDERATION OF REQUEST TO BEGIN SEARCH FOR
ARCHITECTURAL CONSULTANT FOR REMODELED CITY HALL AT
MORE -4 SITE
During discussion it was suggested to seek an archi-
tectural consultant through a selection process or
negotiate a price with Short, Elliott and Hendrickson
since the firm did a previous study on City Hall.
Councilman Mlinar moved to approve a selection process •
with a maximum of five firms. Motion seconded by Coun-
cilman Lenz and unanimously carried.
(c) DISCUSSION OF DEFERRED ASSESSMENTS FOR BEELER /ANDERSON
PROPERTY
Engineer Rodeberg commented on the background of this
issue and recommended retaining the past agreement.
No action was taken.
(d) DISCUSSION ON NEW LIQUOR STORE LAYOUT
Following discussion of the proposed layout, Councilman
Mlinar moved to accept the recommendation of Grinstead &
Associates regarding the liquor store layout for 6,255
square feet, contingent upon MN /DoT approval. Motion
seconded by Councilman Lenz and unanimously carried.
(e) PETITION FOR SUNDAY LIQUOR
City Attorney Anderson stated there were inconsistencies
on the petitions submitted, and he would need to review
the petitions.

(a) DISCUSSION OF HIRING PROCEDURE FOR HCDC EXECUTIVE
DIRECTOR BY PRESIDENT JAMES BULLARD /HCDC BOARD
President James Bullard and Board Member Carol Haukos
reviewed the hiring procedure for a HCDC Executive Direc-
tor. It was their recommendation for the Council to: (1)
approve the HCDC interim appointment of Robert Kennebeck,
with administrative assistance, to be effective August 1,
1992, until year -end; (2) establish time frames for a
task force to accomplish specific goals; and (3) name a
selection committee to recruit necessary personnel.
• Following discussion, Councilman Erickson moved to accept
the recommendations of the HCDC Board. Motion seconded
by Councilman Mlinar and unanimously carried.
(b) DISCUSSION OF USE OF MUNICIPAL PARKING LOT FOR ARTS AND
CRAFTS FESTIVAL (DEFERRED JULY 14, 1992)
It was reported the municipal parking lot located behind
the State Theater would be made available for exhibitors
to park their vehicles overnight, if necessary.
Councilman Erickson moved to approve use of the parking
lot. Motion seconded by Councilman Mlinar and unanimous-
ly carried.
9. NEW BUSINESS
(a) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
The motion was made by Councilman Lenz, seconded by Coun-
cilman Erickson and unanimously carried, to authorize
discontinuation of service at noon on August 3 unless
other arrangements were made.
(b) CONSIDERATION OF APPROVING PLANS AND SPECIFICATIONS AND

ties for $163,869.32, and to waive reading and adopt Res-

the permit, recognizing the Planning Commission's
recommendations of four conditions, and to waive reading

(k) CONSIDERATION OF PRELIMINARY AND FINAL PLAT OF HUTCHINSON
MALL PLAT 2 SUBMITTED BY DEVELOPERS DIVERSIFIED WITH
FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Mr. Don Wetter, President of Coborns, presented drawings
of the proposed Hutchinson Cash Wise store. Engineer
Rodeberg commented on a traffic flow study in the area.
Discussion followed on how the plan for a raised median
could affect the local businesses on the north side of
South Grade Road.
Councilman Lenz moved to table to a special meeting on
August 4, 1992 at noon. Motion seconded by Councilman

(r) CONSIDERATION OF CONTAMINATED PONDING SURFACE WATER AT
791 CALIFORNIA AVENUE
During discussion it was pointed out the problem was com-
ing from the county line into the city. It was suggested
the city cut off service at the city limits on the north
side of the road. No action was taken.
(s) CONSIDERATION OF INDIVIDUAL WATER /SEWER SERVICES AT
216 FIFTH AVENUE SW
Mr. Dick Lennes reported his neighbor's sewer line ran
through the basement of his property. Mr. Lennes was
willing to give a temporary easement but requested a
solution to the problem.
Following discussion, Councilman Erickson moved that
there be a direct connection on both properties by June
1, 1993. Motion seconded by Councilman Mlinar and unani-
mously carried.
10. MISCELLANEOUS
• (a) COMMUNICATIONS FROM CITY ADMINISTRATOR
Administrator Plotz reported on a meeting with the County
regarding assessment issues. It was the general consen-
sus that after a two or three year period, the delinquent
assessments should be dealt with on an independent basis.
A written City policy dealing with tax forfeiture prop-
erty will be prepared by the City staff and City Attorney
for the Council to review.
Mr. Plotz informed the Council that Dorothy Smith, Motor
Vehicle Registrar, was retiring August 28, 1992. He also
stated the Fire Department was considering reducing the
Fire Marshall position to part -time in the 1993 budget.
A report was given on the interim residential refuse
hauling. The specifications were being prepared for a
three -year contract, effective October 1, 1992, and a
joint meeting of the Refuse Contract Committee and
potential haulers will be held on August 4 to review
them. Mr. Plotz requested authorization to advertise for
bids from refuse haulers.
Motion by Councilman Lenz, seconded by Councilman Erick-
son and unanimously carried, to advertise and open bids
• for residential haulers on August 17, 1992 at 10:00 A.M.

(b) COMMUNICATIONS FROM CITY ATTORNEY
Attorney Anderson discussed two cost items pertaining to
the downtown development project, namely the telephone
cable and parking improvements.
Following discussion, Councilman Erickson moved to ap-
prove a cost share arrangement of 25 percent City cost,
25 percent telephone company cost, and 50 percent
developer cost for the telephone cable and to assess the
developer for parking improvements. Motion seconded by
Councilman Mlinar and unanimously carried.
(c) COMMUNICATIONS FROM DIRECTOR OF ENGINEERING
Engineer Rodeberg stated the County had requested a Reso-
lution for no parking on Bluff Street from 2:00 to 6:00
A.M. Councilman Lenz moved to waive reading and adopt
Resolution No. 9772 for no parking on Bluff Street. Mo-
tion seconded by Councilman Mlinar and unanimously car-
ried.
11. CLAIMS APPROPRIATIONS AND CONTRACT PAYMENTS •
(a) VERIFIED CLAIMS
The motion was made by Councilman Mlinar, seconded by
Councilman Erickson and unanimously carried, to approve
the claims and authorize payment from appropriate funds.

MINUTES
Parks & Recreation Board
. May 27, 1992
Members present were Mike Schall, John Mlinar, J.P. Auer, Mike Cannon, Linda
Martin and Virgil Voigt. Also present were Dolf Moon and Karen McKay.
The Minutes dated April 29, 1992 were approved by a motion made by Linda
Martin, and seconded by Mike Cannon. The board unanimously agreed.
OLD BUSINESS
Public Sites - John Rodeberg, Jim Marks and Dolf meet and agreed with the
Public Sites proposal. It has been presented to the City Council; the Parks &
Recreation Board will have input as to the collection of cash versus land
contributions, and also with the dispursing of funds from this account.
Registration - Summer program registration went well. ;17,000 in registrations
were taken in two hours. The lines were deminished within 45 minutes after
registration began. Two new programs, Adventure Camp and Art in the Park will
be adding additional classes to accommodate people on the waiting list. T -Bell
registrations are down at this time, however, many people wait until the last
minute.
L C M.R_ - Three proposals were sent in. Hutchinson didn't qualify, mainly
metro area towns received the grants.
• NEW BUSINESS
Boy Scout Letter - Members of Boy Scout Troop #246 were present including
Jeremy Barrick. The Board received a letter written by Jeremy requesting that
a Boy Scout Park be adopted. The Boy Scouts are unable to provide financial
support, but are willing to provide labor to plan, plant and maintain landscape
materials in a park set aside in their name. Dolf suggested to the Boy Scouts,
and the board; the park area north of Sorenson Farm Supply, referred to as
Fisher's Hill. The scouts are interested in a park with landscape materials,
and a sign signifying Boy park, no shelter or playground equipment.
The Boy Scouts agreed that this area would work out. They would also like the
opportunity to earn badges for forestry, woodworking and gardening for this
project, and the project of planting and maintaining the City of Hutchinson's
tree nursery at the Tree Disposal Site.
John Mlinar made a motion to adopt Boy Scout Park in the area presently
referred to a Fisher's Hill as discussed by the board. Mike Cannon seconded
the motion, and the board agreed unanimously.
Arena I mprovem ents - The board received a copy of the improvements made thus
far in the arena. With the addition of the new dasher boards, the installation
and take down went quickly. J.P. Auer questioned the arena entrance in
reference to handicapped accessiblity. Dolf told the board it needs to be
• addressed as well as the refrigeration system. John Mlinar suggested a savings
plan. Linda Martin questioned also the possibility of installing a drinking
fountain ai the time of the bathroom remodeling.

Summer Projects - Dolf told the board that work continues on the Veterans
Memorial Field. Donations from the Baseball Association will provide for the
installation of a padded backstop to be added this year. The Elks lodge is
interested in adding restrooms to the shelter in Elks Park. The addition of
trail in A.F.S. Park will take place. The Oddfellows are interested in a
shelter similar to South Park. The playground equipment in Roberts Park will
be replaced-this year. The parks crew has been experimenting with growth
retardants in various parks.
BOARD ITEMS
Popcorn Wagon - Mainstreet continues to work on the agreement with the Chamber
of Commerce on the details of products for sale during the Arts & Crafts Show.
Dolf will be checking on the status of the current concessions building in
Library Square.
Rocket /Saar Park - Dick Fisher, representing the Kiwanis, would like to see a
shelter in the park for winter sledding. •
Tree Board - Virgil reported to the board that the Tree Board will be meeting
to prioritize tree planting for 1993. They would like to plant the same number
of trees next year as in 1992. They would also like to a see a policy set for
homeowers requesting larger tree specimens.
Snowmobile Trail - John Mlinar questioned whether there would be something done
along the trail between Second Avenue and Arch Street East. There are
boulevard trees planted where the trail was being travelled last year.
Firewood Available in West River Park - John Mlinar would like to see firewood
available for participants in West River park.
Ad.iourment - The meeting was adjourned at 6:30 p.m. by a motion made by Linda
Martin and seconded by Mike Cannon. The board unanimously agreed.

TO WHOM IT MAY CONCERN:
Notice of Public Hearing to receive comments on the economic, social and
environmental impacts of expanding the Hutchinson Municipal Airport. The
expansion will include construction of an 8000' extension to the existing airport
runway and construction of a parallel taxiway. A draft Environmental Assessment
for the project has been prepared and copies are available for public review at
the City Clerk's Office in City Hall, the Hutchinson Public Library, and in the
lobby of the Airport Terminal Building. The hearing will be held starting at
8 :00 P.M. on Tuesday, August 11th, 1992, in the City Council Chambers in
conjunction with the regular meeting of the Hutchinson City Council.
Such persons as desire to be heard with reference to the proposed
improvement will be heard at this meeting.

THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA ORDAINS:
The following described real property is hereby rezoned from
R -1 Single Family Residence District to I/C Industrial /Commercial
District located in the Fair Grounds Addition.
Legal Description:
The Southwest Quarter of the Northeast Quarter
and the West Half of the Southeast Quarter,
all in Section 12, Township 116 North, Range
30 West of the 5th Principal Meridian. Except
that part of the Southwest Quarter of said
Southeast Quarter, described as follows
Beginning at the southwest corner of said

that had been encountered in enforcement of our existing ordinance.
Enclosed please find an ordinance designed to address the concerns
of the police department and using language suggested by the police
department.

useful to have this ordinance in place by the time winter arrives.

First, it is my understanding that Developers Diversified is going
to guarantee, warrant and indemnify the city from any non - payment
of assessments relating to the Century Avenue improvements. How-
ever, I have not specifically set that out in the Subdivision
Agreement to Hutchinson Mall Plat 2 because we will need the con-
sent of all of the property owners and other parties having an
interest in the Hutchinson Mall (which presumably includes Mortgage
Companies). I presume that Developers is not going to want to
advertise the fact that it is guaranting these payments and on
that basis, I will draft a separate indemnity agreement.
Second, the requirements of the Subdivsion Agreement dealing with
the 60 foot separation and tenant sign locations are already
requirement of either state law or city ordinance, but are in-
cluded for your information. Inclusions of these items is not
meant to waive any other requirements of local or state law that
would not normally be included in the provisions of a Subdivision
Agreement.

First, it is my understanding that Developers Diversified is going
to guarantee, warrant and indemnify the city from any non - payment
of assessments relating to the Century Avenue improvements. How-
ever, I have not specifically set that out in the Subdivision
Agreement to Hutchinson Mall Plat 2 because we will need the con-
sent of all of the property owners and other parties having an
interest in the Hutchinson Mall (which presumably includes Mortgage
Companies). I presume that Developers is not going to want to
advertise the fact that it is guaranting these payments and on
that basis, I will draft a separate indemnity agreement.
Second, the requirements of the Subdivsion Agreement dealing with
the 60 foot separation and tenant sign locations are already
requirement of either state law or city ordinance, but are in-
cluded for your information. Inclusions of these items is not
meant to waive any other requirements of local or state law that
would not normally be included in the provisions of a Subdivision
Agreement.

SUBDIVISION AGREEMENT
• HUTCHINSON MALL PLAT 2
City of Hutchinson, Minnesota
This agreement is made and entered into the day and year set
forth by and between Developers Diversified, Ltd., an Ohio
corporation, ( "Subdivider ") and the City of Hutchinson, a Minnesota
municipal corporation, ( "City ") located in the County of McLeod,
State of Minnesota.
RECITALS:
Subdivider is the owner and developer of a tract of land
described as follows:
Part of Outlot A, part of Lot 5, part of Lot 1 and all
of Lot 4, Block 2, Hutchinson Mall, according to the
recorded plat thereof, in the City of Hutchinson, County
of McLeod, Minnesota; together with a part of the
northeast quarter of the Northeast Quarter (NE 1/4 NE
• 1/4) of Section 12, Township 116 North, Range 30 West,
McLeod County, Minnesota and a more particularly combined
description as follows:
Beginning at the northeast corner of said NE 1/4 NE 1/4;
thence West, plat bearing, along the north line of said
NE 1/4 NE 1/4 a distance of 445.00 feet; thence South 01
degrees 00 minutes 00 seconds West 33.00 feet to the
northeast corner of said Lot 4; thence West, along the
north line of said Lot 4, Lot 1 and Outlot A, a distance
of 657.30 feet to a point 230.00 feet east of the
northwest corner of Outlot B of said plat; thence South
00 degrees 57 minutes 20 seconds West, parallel with the
west line of said Outlot B, a distance of 322.00 feet to
the south line of said Lot 5; thence East along said
south line of Lot 5 and its easterly extension thereof
a distance of 744.04 fee; thence South 01 degrees 00
minutes 00 seconds West parallel to the east line of said
NE 1/4 NE 1/4 a distance of 255.00 feet to a point on the
westerly extension of a 141.99 foot boundary line of said
Lot 1; thence East, parallel to the north line of said
NE 1/4 NE 1/4 and along said westerly extension, said
141.99 foot line and its easterly extension thereof a
distance of 358.01 feet to a point on the east line of
said NE 1/4 NE 1/4; thence North 01 degrees 00 minutes
00 seconds East along said east line a distance of 610.00

2. This tract has been surveyed and platted by Subdivider
1 ? -- A,
as Hutchinson Mall Plat 2 (and is wholly owned by Subdivider) and
a true and correct copy is attached as Exhibit " A " ; •
3. Subdivider desires that the City provide certain services
to the property and has agreed to make certain commitments
regarding development of the property and payment for services;
4. City ordinances require subdividers to make certain
improvements in the subdivision and to make arrangements for
payment for the installation of these improvements;
5. The parties hereto desire to reduce their agreement to
writing;
NOW THEREFORE, FOR $1.00 AND OTHER GOOD AND VALUABLE CONSIDERATION,
IT I8 HEREBY AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS:
1. Spreading of Assessments Hutchinson Mall Plat 2 shall
be assessed for any improvements to South Grade Road or Trunk
•
Highway 15 which improvements include but are not limited to
roadway construction or reconstruction, storm sewer, sanitary sewer
and general utility improvements as well as traffic control and
traffic signal improvements. Assessments shall be divided and
attributed to Hutchinson Mall Plat 2 on the basis of the size of
the lots. The parties agree that the division shall be on the
basis of 753 of the assessed amount for Lot One (1) and 12.53 for
Lot Two (2) and 12.53 for Lot Three (3) of Hutchinson Mall Plat 2.
Subdivider waives any objection or right to appeal to the district
court of the assessment procedure followed by the City of
Hutchinson or the method of spreading the assessments adopted by
the City of Hutchinson for these assessment or any future
assessments. However, subject to paragraphs 2 and 12, Subdivider
•
does not waive its right to appeal to the district court that the

amount of the assessment exceeds the benefit received by the
• subject property.
2. Assessments for Traffic Improvements. 50% of the cost
to construct turn lanes, islands, traffic signal improvements and
improvements to the intersection of State Highway 15 and South
Grade Road, including all related expenses, shall be assessed to
Hutchinson Mall Plat 2 according to the formula set forth in
paragraph 1. Subdivider agrees to waive its right to object to,
or appeal from, the assessments described in this paragraph on any
theory whatsoever and further agrees to pay the assessments in the
manner set forth by city ordinance and state law.
3. Park Dedication Fee. Subdivider shall pay a park land
dedication fee of based on the 3.6 acres of property
• within the plat previously not assessed a park land dedication fee.
This fee shall be paid prior to the issuance of any building
permits.
4. Access. Parking and Circulation Review. Attached and
marked as Exhibit "B" is the Access, Parking and Circulation Review
completed by TKDA, the City's engineering consulting firm which
review is dated July 28, 1992. Subdivider agrees that the review
shall be followed by the Subdivider in the construction and
maintenance of all improvements on the site. Subdivider shall
construct a concrete median at the main entrance within the plat
from South Grade Road approximately 75 feet to the south to control
traffic at the intersection of the main entrance as set forth on
the plat (Exhibit " A " ) with South Grade Road and into Lot 2 of the

plat. Subdivider further agrees
to dedicate

additional 12 feet of right of
way along

adjacent
to the

southerly right of way line of South Grade Road, for the purpose
of constructing additional turn lanes. The existing curb cut and •
entrance to the outlot (Lot 2 of Plat) shall be removed prior to
the new main access being open for traffic. As per the traffic
study, no access from Lot 1 to Lots 2 and 3 will be permitted
except at a common entrance at the common lot lines of Lots 2 and
3.
5. Parking Agreement. subdivider represents that a
reciprocal parking agreement with all of the property interests of
the Hutchinson Mall has been secured to allow for reciprocal
parking for any business located within the original plat area of
Hutchinson Mall or Hutchinson Mall Plat 2. The City has relied
upon the existence of the reciprocal parking agreement in entering
into this Subdivision Agreement. •
6. Outlot A. It is agreed and understood that Outlot A of
the original Hutchinson Mall plat shall be maintained as a buffer
as noted in the original Subdivision Agreement for the Hutchinson
Mall. No signing, advertising or non emergency lighting will be
permitted on the north side of structures located in Lot 1,
adjacent to said Outlot A without the formal approval of the City
Council of the City of Hutchinson.
7. Signs. Any proposed common tenant sign location must be
approved by the City.
8. Minimum Separation. It is agreed and understood that the
Subdivider will be required to maintain a minimum separation of 60
feet between buildings to meet the requirements of state building
codes.

9. Access. It is agreed and understood that all lots within
• Hutchinson Mall Plat 2 will be provided suitable access to
municipal sanitary sewer and watermain service.
10. Drainage and Ponding. Subdivider shall provide drainage
and ponding for Hutchinson Mall Plat 2 as noted in the drainage
plan submitted by RCM of St. Cloud and reviewed by Barr Engineering
of Bloomington, a copy of which is attached hereto and marked as
Exhibit "C" and incorporated as if fully set out. Subdivider shall
also construct a bypass such that storm sewer runoff can be
rerouted from the southwest storm sewer into the south water shed
at some point in the future. This connection will not be open but
shall be blocked and any rerouting of storm water shall not occur
without written authorization of the City of Hutchinson. Lots 2
• and 3 must provide detention ponding for any development which
occurs within the lots.
11. Spreading Assessments - Century Avenue. Future
assessments to Century Avenue shall be assessed to the remaining
properties in the original Hutchinson Mall Plat and not the
properties in Hutchinson Mall Plat 2. Assessments proposed for
improvements to Century Avenue from Boston Street to the west end
of the Hutchinson Mall Plat shall be assessed to the following
properties based on building square footage:

Subdivider agrees to waive any objection to, and any right to
appeal from, the method of spreading the assessments or further

assessments as set forth herein.
12. Payment of Assessments. Subdivider agrees to waive any •
right to object to, or appeal from, the assessments for Century
Avenue improvements planned for 1992 and 1993 which improvements
include, but are not limited to, road reconstruction, road
extension, sanitary and storm sewer improvement. The City
represents and agrees that the amount to be assessed to the
Subdivider, as well as the additional parties described in .
paragraph 8, shall not exceed $80,000.00 and shall be payable over
a ten year period in accordance with usual city procedure and state
law.
13. Consent and Indemnity. Subdivider represents to the City
that all persons having a property interest in the Hutchinson Mall
Plat have consented to the changes and conditions set forth in the
•
Subdivision Agreement for Hutchinson Mall Plat 2 and agrees to
indemnify the City for any damages, including reasonable attorney's
fees, resulting from the failure of any party, entity or individual
to agree to the terms and conditions of the Subdivision Agreement
for Hutchinson Mall Plat 2 or to take any action contrary to the
Subdivision Agreement. This indemnity obligation shall extend to
and include all persons, firms or entities of whatever kind who
have any interest whatsoever, whether as a landlord, tenant, owner
or otherwise, in the property described as Hutchinson Mall.
14. Conflicts. To the extent the Subdivision Agreement for
Hutchinson Mall Plat 2 conflicts with the agreements and provisions
of the Subdivision Agreement for the Hutchinson Mall Plat, the
provisions of the Subdivision Agreement for Hutchinson Mall Plat
•
2 shall control.

15. Modification. This Agreement may be changed or modified
• only in writing and only after formal approval by the Hutchinson
City Council.
16. Successors. This agreement shall be binding upon and
extend to all heirs, representatives, assigns and successors of the
parties.
17. Recording. It is agreed and understood that it is the
responsibility of the Subdivider to record this agreement at the
County Recorder's Office along with the plat, and that no building
permits shall be issued, or occupancy permits obtained, until a
copy of the recorded agreement is on file with the City.

The board of directors of Hutchinson City Council /Burns Manor Nursing Home, as part
of their re— meeting on July 38, considered the results of the bide for Phase II
,remodeling project for Burns Manor Nursing Home.
During the previous month, an advertisement was placed for competitive bids on the
project, which includes remodeling of an area in the nursing home's lower level in
order to comply with the federal Americans with Disabilities Act already in effect.
Two bids were received from a field of five interested parties, and the low bidder
was Professional Construction Services of Hutchinson, at a bid price of $25,500.
The following is an excerpt from that evening's meeting minutes and reflects the
board's discussion on this subject:
• "Motion was made by Johnson, seconded by Gilmer, to recommend approval to the
City Council for acceptance of the low bid by Professional Construction
Services of Hutchinson in the amount of $25,500 for Phase II remodeling at
Burns Manor Nursing Home. All were in favor. Motion carried.•
lso discussed at this meeting was the board's preference for replacement of Rev.
Thor Skeie or decreasing the size of the current board. Consensus was that the size
of the current board was workable and helpful to ensure a quorum when trustees needed
to be absent from a meeting for any reason. A representative of the 3M Co. would be
preferred, considering the number of employees represented and the business acumen
brought to the board. The following reflects the board's discussion on this ■ubject:
"Motion was made by Johnson, seconded by Carle, to recommend to the mayor that
a replacement for Rev. Thor Skeie be sought, preferably a representative of the
3M Co., one of the area's largest employers. All were in favor. Motion
carried."

This Assessment Policy is adopted this 11th day of August,
1992 by the Hutchinson City Council. The Policy is intended to
address issues surrounding assessments on property where the taxes
are now delinquent or the property has been forfeited for failure
to pay taxes. The Policy is intended to be a guide for the benefit
of the Hutchinson City Council, which will decide questions
regarding assessments on a case by case basis and retains the right
to deviate from the policy where necessary or beneficial to the
public.
RECITALS
1. The city has made significant road and utility
improvements in areas of the community and has assessed the costs
• for these improvements to the then property owner or owners;
2. In some instances, the costs of the improvements has not
be recovered because the property owner or owners have failed to
pay their real estate tax obligations and interest has continued
to accumulate upon the delinquent balances owed for taxes or
assessments;
3. It would be in the public interest to promote development
to return presently taxed delinquent property to the tax roles, but
any such development must be weighed against the cost of
constructing the improvements in the first place;
4. The city council has determined that a written policy
would be helpful in reaching decisions, on a case by case basis,

as to whether or not delinquent assessments should be reimposed,
• written down or in some manner adjusted to facilitate the sale of
the property and the return of the property to the tax roles.
Based on the findings as described above, the city council
adopts the following policies regarding delinquent assessments:
1. Adjustments to the assessment burden on a particular
parcel will be considered only when the property has been carried
on the tax roles as delinquent for three years or more.
2. The city council for the City of Hutchinson will abate
all of the assessments on such a parcel subject to the following
terms and conditions:
a. The original principal amount of the assessment will
be reimposed with the principal amount adjusted
upward based on a cost of living factor to be
determined by the engineering department using
engineering guidelines provided for this purpose;
• b. The balance so determined shall bear interest at the
rate of 7% and shall be payable in equal
installments over a five year period.
C. A written agreement shall be entered into between
all the parties having an interest in the real
estate reciting that the city shall be entitled to
collect the assessments as provided by law or by
foreclosure by action, at the sole option of the
city.
3. The proposed land use is a factor in whether or not the
city council grant relief from assessments and accordingly,
any construction or change in use contemplated and agreed to by the
parties shall be completed within one year of the decision of the
city council abating the present assessment burden.

4. This policy is intended to be a guide and each
• application to the city council for relief from assessments will
be decided by the city council on a case by case basis. This
policy may be amended, modified or abandoned in its entirety, in
the sole discretion of the city council. Nothing in this policy
shall be construed to give any property owner or applicant a right
to a change in the assessment burden imposed on any specific
property.

It looks as if Lot 9 /Black 1 of California Second Add tion would be
a very good location for an additional street right 91-way. This
area has had drainage problems, and no street r t -of -way is
available in the area to access the Zable area. I would strongly
recommend picking up the lot for public purposes if the cost is
minimal. R ecommend checking assessments on property. I see no value
in any of the other lots for public purposes.

develop the natural resources; and foster and develop agriculture and other industries
in the districts and places best suited to them.
In making the classification the county board may use information made available
by any office or department of the federal, state, or local governments, or by any other
person or agency possessing pertinent information at the time the classification is made.
The lands may be reclassified from time to time as the county board may consider nec-
essary or desirable, except for conservation lands held by the state free from any trust
in favor of any taxing district
If the lands are located within the boundaries of an organized town, with taxable
valuation in excess of $20,000, or incorporated municipality, the classification or
reclassification and We must first be approved by the town board of the town or the
governing body of the municipality in which the lands are located The town board of
the town or the governing body of the municipality is considered to have approved the
classification or reclassification and sale if the county board is not notified of the disap-
proval of the classification or reclassification and sale within 90 days of the date the
request for approval was transmitted to the town board of the town or governing body
of the municipality. If the town board or governing body desires to acquire any parcel
Iving in the town or municipality by procedures authorized in this subdivision, it must
file a written application with the county board to withhold the parcel from public sale.
The application must be filed within 90 days of the request for classification or reclassi-
fication and sale. The county board shall then withhold the parcel from public sale for
one year.
Subd. la. Conveyance; generally. Tax - forfeited lands may be sold by the county
board to an organized or incorporated governmental subdivision of the state for any
public purpose for which the subdivision is authorized to acquire property or may be
released from the trust in favor of the taxing districts on application of a state agency
for an authorized use at not less than their value as determined by the county board. •
The commissioner of revenue may convey by deed in the name of the state a tract of
tax- forfeited land held in trust in favor of the taxing distncts to a governmental subdivi-
sion for an authorized public use, if an application is submitted to the commissioner
which includes a statement of facts as to the use to be made of the tract and the need
therefor and the recommendation of the county board.
Subd. lb. Conveyance; targeted neighborhood lands. (a) Notwithstanding subdivi-
sion la. in the case of tax- forfeited lands located in a targeted neighborhood as defined
in section 469 201, subdivision 10, outside the metropolitan area, as defined in section
473.121, subdivision 2, the commissioner of revenue may convey by deed in the name
of the state any tract of tax- forfeited land held in trust in favor of the taxing districts,
to a political subdivision that submits an application to the commissioner of revenue
and the recommendation of the county board-
(b) Notwithstanding subdivision la, in the case of tax- forfeited lands located in
a targeted neighborhood, as defined in section 469.201, subdivision 10, in a county in
the metropolitan area, as defined in section 473.121, subdivision 2, the commissioner
of revenue shall convey by deed in the name of the state any tract of tax - forfeited land
held in trust in favor of the taxing districts, to a political subdivision that submits an
application to the commissioner of revenue and the county board
(c) The application under paragraph (a) or (b) must include a statement of facts
as to the use to be made of the tract, the need therefor, and a resolution, adopted by
the governing body of the political subdivision, finding that the conveyance of a tract
Of tax - forfeited land to the political subdivision is necessary to provide for the redevel-
opment of land as productive taxable property.
Subd. lc. Deed of conveyance. The deed of conveyance must be on a form
approved by the attorney general and must be conditioned on continued use for the
Purpose stated in the application. If, however, the governing body of the governmental
subdivision by resolution determines that some other public use should be made of the
lands, and the change of use is approved by the county board and an application for •
change of use is made to, and approved by, the commissioner, the changed use may be

We are now receiving from the directors the work sheets with
requests for 1993 operations. Once the sheets are completed we
will know a preliminary total budget request.
TAX LEVY
For 1993 we, for the first time, do NOT have a tax levy limit. This
needless to say is a first in your careers as city representatives
and is also a first for present city staff. We will want to review
• with you the procedure to be employed in setting this preliminary
(can not exceed but may be reduced) tax levy for 1993. The
preliminary tax levy must be certified to McLeod County Auditor Ed
Ide by September 15.
Tax Specific Property Tax Notices
This year the tax notice mailed to the tax payer will tell them
what there taxes will be for their specific parcel if the taxes as
proposed are adopted. This is unlike previous years when the
notices told only of the total amount of taxes which are proposed
to be levied. This is part of the truth in taxation process and is
known as parcel specific notices.
Final Budget and Tax Levy
As in past years the final tax levy can not be adopted until the
truth in taxation is held. The date is in December and will not be
set until later this fall. At the close of the hearing the final
tax levy and budget can be adopted for 1993.
The council may want to review the budget prior to setting the
preliminary hearing or adopt an increase which is acceptable. If
the council would like to review the budget we would probably
require several special meetings for budget review. Keep in mind
this set only the maximum amount of taxes and they can be reduced.

This Agreement, is made this 11th day of August 1992, 2 between the City
of Hutchinson, State of Minnesota, hereinafter referred to as the City and
Better Built Homes, Inc., Gary Hasse, Chief Executive Officer, of McLeod
County, State of Minnesota, hereinafter referred to as Owner.
In consideration of the action of the City Council, at the owner's
request, to cause the improvement of Hasse Hills First Addition (Located North
of McDonald Drive and West and Adjacent to McDonald's Sixth Addition) by the
construction of storm sewer, sanitary sewer, watermain, services, grading,
gravel base, curb and gutter, bituminous base, bituminous surfacing and
appurtenances, and to assess 100% of the cost of said improvements to the
Owner, the Owner agrees to pay said percentage, as nay be determined by the
Council of the City to be a fair apportionment of the costs of said
improvement over a period ten years. Owner expressly waives objection to any
irregularity with regard to the said improvement assessments and any claim
that the amount thereof levied against owner's property is excessive, together
with all rights to appeal in the courts.

Sixth Addition) by construction of storm sewer, sanitary sewer, sewer service,
watermain, water service, grading, gravel base, curb and gutter, bituminous
base, bituminous surfacing and appurtenances, filed with the Council on August
11th, 1992, is hereby declared to be signed by the required percentage of
owners of property affected thereby. This declaration is made in conformity
to Minnesota Statutes, Section 429.035.
2. The petition is hereby referred to the Director of Engineering and he
is instructed to report to the Council with all convenient speed advising the

Dear Jerry:
I have received and reviewed your fax transmittal from yesterday
afternoon which includes most of the proposed changes that we
discussed on Friday.
Obviously, the City Council will be responsible for making a
decision as to what is acceptable and what is not acceptable.
Most of the proposed changes are technical and matters of
clarification and should not pose a major problem.
As you put it, however, one of the proposed changes certainly has
the potential to be a "deal killer." The position that you have
taken in your correspondence of August 10, 1992 regarding paragraph
13 on page 6 of the Subdivision Agreement is directly contrary to
the position taken by your representative during the course of
several of our meetings. I raised a question at one of those
meetings, in the middle of July, having to do with the Subdivision
Agreement and I indicated that the Subdivision Agreement would need
to address the changes to Century Avenue, as well as the changes
to Southgrade Road because of the inter - related nature of traffic
through and around the site. I foresaw difficulty in securing all
of the necessary consents from the property owners to accomplish
this task and raised doubts about whether or not this could be
• accomplished prior to the stated deadline of August 1, 1992.

I was assured by Mr. Berryhill, who is your representative, that
Developers would be willing to secure those signatures and
indemnify the City from any claims from parties who for some reason
were not willing to sign the necessary documents.
As I understand your position now, Developers is basically saying
that it is willing to. pay its portion of the share of the
reconstruction of Century Avenue, but is not willing to assist the
City in any other respect.
The change in position of Developers may very well cause the City
to rethink its position regarding the spreading of assessments and
similar issues. Under the circumstances, it is possible that
additional delay, at a minimum, will occur.
I will get back to you following the City Council meeting this
evening.

UNDERTAKING AND INDEMNITY AGREEMENT
This Undertaking and Indemnity Agreement is made by the City
of Hutchinson this _ day of August, 1992, in connection with the
sale of certain redevelopment property located within the city
limits of the City of Hutchinson.
RECITALS:
1. The City of Hutchinson, a Minnesota municipal corporation,
is the owner of the following described real property located
entirely within the County of McLeod, State of Minnesota:
The part of Block 47 and 48 and that part of
Jefferson Street and that part of Adams Street,
all in the Townsite of Hutchinson, North Half,
according to the recorded plat thereof,
described as follows: Beginning at the
northwest corner of said Block 48; thence
southerly, along the west line of said Block
48, to the south line of the north 12.00 feet
of Lot 7 of aid Block 48; thence easterly,

prolongation, to the intersection with the
center line of the alley in said Block 48;

5. The City of Hutchinson hereby does agree to undertake the
following actions and to issue the following indemnity to
Erickson's Diversified Corporation and Universal Title Insurance
Company.
NOW THEREFORE, IT IS AGREED for One Dollar and Other Good and
Valuable Consideration, the

undertake

1. The City shall arrange for the continuation of such
abstracts as are necessary to show good and marketable title for
all vacated streets and alleys located within or adjacent to the
subject property.
2. Willard Pellinen, a registered land surveyor, licensed by
the State of Minnesota, has determined that an approximate one inch
gap may exist, depending upon measurement in Lots 7 and 8, Block
47, Townsite of Hutchinson, North One Half. The City agrees that
it will provide Quit Claim Deeds from parties in the chain of title
sufficient to cure the defect and to provide marketable title to
all of Lots 7 and 8 or, in the alternative, the City agrees to
undertake, at its sole expense, a quiet title action to assure

Meeting was called to order by Chairman Bullard.
Motion by Haukos, seconded by Graves, and carried to approve the minutes of June 5,
1992.
Motion by Graves, seconded by Mlinar and carried to approve the financial report.
Motion by Haukos, seconded by Fraser and carried that Hutchinson Community
Development Corporation will interview for a consultant to direct the affairs of the
corporation with the three individuals indicating an interest in the position with terms of
employment and remuneration to be determined.
Interviews will be conducted on Wednesday, July 8 with a full board meeting at 4:30
PM at Marquette Bank.
Bernhagen gave a status report as of June 30, regarding the work plan and the grants
and loans of various commercial and housing projects.
There being no further business the meeting was adjourned.
