TUESDAY, FEBRUARY 12, 2008
CALL TO ORDER — 5:30 P.M.
Mayor Cook called the meeting to order. Members present were Bill Arndt, Casey Stotts and Jim Haugen.
Member absent was Kay Peterson. Others present were Gary Plotz, City Administrator, Kent Exner, City
Engineer, and Marc Sebora, City Attorney.
2. INVOCATION — Rev. Brian Brosz, Congregational UCC Church, delivered the invocation.

Sheila Ellman, 565 Barley Street, presented before the Council. Ms. Ellman stated that she is the wife of a
truck driver and she has concerns with the ordinance that prohibits heavy truck parking in residential
neighborhoods. Ms. Ellman explained that when her husband became a heavy truck owner /operator she
checked with the police department and building department on what it takes to park in residential
neighborhoods. Approximately nine years ago she obtained a building department to buildup her residential
driveway in order to park the heavy truck. Ms. Ellman addressed some of the concerns that have been
raised, such as odor and noise. Ms. Ellman has concerns for the owners that will have to park their trucks
off -site and the lack of protection. Ms. Ellman noted that she would be willing to pay a permit in order to be
able to park the heavy truck in her driveway.
Ron Kalenberg, 107 Mark Drive, presented before the Council. Mr. Kalenberg noted that before he began
parking his heavy truck at his home, he checked with local officials and the police department as to where
parking was acceptable. He suggested that if the City continues to prohibit truck parking in residential
neighborhoods, perhaps the City should provide a location for the trucks to park, and provide liability
• insurance.
Jamie Marx, 41 4 Avenue SW, presented before the Council. Mr. Marx noted that in compliance with the
city ordinance, he has parked his truck outside of residential areas away from his home. During these times,
his truck has been vandalized. While he had it parked in his driveway, no vandalism occurred. It is now
getting harder and harder for truck drivers to find locations to park, even in commercial/industrial districts.
Mark Landreville, 761 Walnut Street, presented before the Council. Mr. Landreville, owner of Lamplighter
Bar & Grill, requested that the liquor sale hours extend to 2:00 a.m. on Fridays and Saturday nights. Mayor
Cook noted that the change in hours would take an ordinance change, which will include a public hearing.
The Council will discuss this.
Council Member Arndt noted that the owner of Hansen Gravel informed him that if there is enough interest
from other truck drivers, he would dig lines to allow for electricity and would allow trucks to park there.
Rick Kalenberg noted that there are still vandalism issues. Mr. Kalenberg raised the question as to when the
ordinance changed. Marc Sebora noted that the ordinance has been in effect for at least 10 years.
Council Member Stotts noted that he did hear from Cenex and currently they have limited area and will not
be able to provide electrical hook -ups. Council Member Stotts noted that he was absent from the last
Council meeting, however his view is that there shouldn't be an issue with trucks being parked on private
property.
Ms. Ellman and Mr. Marx noted that the costs are prohibitive in having to park off of their private property.
The Council noted that this item will be placed on the next Council agenda for discussion.

biosolids drying. John Olson, Public Works Manager, explained that the costs noted reflect about a one
month time frame. Council Member Stotts asked if someone in -house could conduct this drying. Kent
• Exner noted that Scott Equipment is training the senior wastewater operator to operate the drying facility.
Council Member Stotts also questioned the cost of the repair on the Crow River Fountain. He noted that
quite a bit of funds has already been spent on the fountain. He questioned the necessity of continuing to put
money into it. John Olson, Public Works Manager, explained that the replacement cable is of a smaller size
and can be removed and stored. The City cost thus far has been an early repair and the electricity. Council
Member Stotts asked for a cost breakdown of how much the fountain costs on an annual basis.
Motion by Stotts, second by Arndt, to approve Item 6(b)l. Motion carried unanimously.
Item 6(e) had further discussion. Marc Sebora, City Attorney, presented before the Council. Mr. Sebora
explained that he was approached by the superintendent of the Hutchinson School District with concerns
related to the parkland that abuts Park Elementary school. The concerns centered around the school being
able to control student and general public interaction. The agreement authorizes the School District to have
authority to control situations during school hours. This agreement allows the school district to lease the
park during school hours and immediately before and after.
Motion by Arndt, second by Stotts, to approve Item 6(e). Motion carried unanimously.
7. PUBLIC HEARINGS —6:00 P.M.
(a) 2008 PAVEMENT MANAGEMENT PROGRAM PHASE I
Kent Exner, City Engineer, presented before the Council. Mr. Exner explained that the proposed project is
to rehabilitate pavement at several locations this summer to address deficiencies in existing pavement
conditions, sump pump drainage, failed curb replacements and some limited utility improvements. These
proposed project areas are only being considered and are subject to not being addressed depending on City
• funding limitations. The proposed rehabilitation method may include reclaiming/removing the existing
pavement section, grading, minimal curb replacement or complete curb replacement, draintile installation
and new pavement surfacing. The cost of these improvements will be assessed to the adjacent private
properties on a street - frontage basis. The streets included in the project are all or portions of Lewis Avenue
S7 3` Avenue SW, West Pishney Lane SW, East Pishney Lane SW, Pishney Lane SW, Pishney Alley SW,
Alan Street SW and Circle Drive SW. The property owner will be assessed for 50% of street rehabilitation
and partial street reconstruction costs.
Jerome Stahl, 619 4' Avenue S W,presented before the Council. Mr. Stahl noted that he has access from the
alley but he also has access from 4 Avenue SW (main driveway). He has limited access from the alleyway.
Kent Exner noted that his concerns are acknowledged and he will review it and make amendments to those
assessments that have limited access to the alley.
Perry Vacek, 1128 Lewis Avenue, presented before the Council. Mr. Vacek noted concerns he has with the
automobile counts taken on Lewis Avenue. Mr. Vacek noted that 147 cars drove on Lewis Avenue today
from 3:00 — 4:00 p.m. He thinks the traffic counts are high and the grade should account for that. Mr.
Vacek also questioned the assessment allocations.
Motion by Arndt, second by Stotts, to close public hearing. Motion carried unanimously.
Kent Exner noted that staff will do more research and reconfiguration on Lewis Avenue.
Mayor Cook commented on how staff and Council are looking at rewriting the assessment policy which will
address itemizing out costs.
Motion by Arndt, second by Haugen, to approve ordering improvement and preparation of plans and
specifications and approving plans and specifications and order advertisement for bids on Letting No. 4,
Project No. 08 -04. Motion carried unanimously.

(a) PRESENTATION OF PLANNING/ZONING/BUILDING 2007 YEAR -END REPORT
. Rebecca Bowers, PlanninWZoning/Buildin& Director, presented before the Council. Ms. Bowers provided a
summary of the activities in 2007 for the Building Departments and Planning/Zoning Departments. Some of
the goals and objectives for 2008 include completing the Hwy 7 Corridor Study and update zoning; review
custodial and preventative maintenance coordination opportunities; improve monthly reporting system to
Council; explore options for improving code enforcement using existing staff; development of rental housing
inspection program; coordination of Evergreen Senior Dining improvements; and complete Planning
Commission work plan.
Mayor Cook suggested having all of the current Planning/Zoning ordinances on a review schedule.
(b) PRESENTATION OF FIRE DEPARTMENT 2007 YEAR -END REPORT
Brad Emans, Fire Chief, presented before the Council. Mr. Emans provided a report on the 2007 activities
of the Fire Department. Mr. Emans noted that currently 33 individuals serve on the fire department. Chief
Emans also reviewed the education/public relations/safety activities that the fire department provided. Chief
Emans also reported on responsiveness, services and other miscellaneous items. Ideas for 2008 include
experimenting with a Fire Department Citizen Academy, starting the process to develop an emergency action
plan for special needs citizens, experimenting with some innovative ideas regarding fire ground
accountability and RIT and experimenting with "citizen volunteers" assisting with our pudic safety
education. Chief Emans also reported that the new fire truck will be delivered on February 14 .
9. UNFINISHED BUSINESS
(a) CONSIDERATION FOR APPROVAL OF ORDINANCE NO. 07 -0482 — AN ORDINANCE
REGULATING RENTAL UNIT REGISTRATION AND INSPECTION (WAIVE FIRST READING AND
SET SECOND READING AND ADOPTION FOR FEBRUARY 26, 2008)
• Gary Plotz, City Administrator, presented before the Council. Mr. Plotz noted that a subcommittee,
including members of the Council, staff and rental property owners, have been meeting to revise the
originally proposed rental inspection program ordinance. Mr. Plotz noted that the City has notified the
majority of rental property owners informing them of where to locate the proposed ordinance and rental
inspection sheets.
Mayor Cook noted that the proposed ordinance and program hopes to address safety issues, livability
standards and enforcement issues.
Brad Emans, Fire Chief, presented before the Council. Mr. Emans commented that staff hopes to meet with
all rental property owners to explain the program, once a program is adopted.
Brandon Fraser, 1418 McDonald Drive, presented before the Council. Mr. Fraser commented on the
improvements made to the currently- proposed ordinance as to the originally - proposed ordinance. One area
Mr. Fraser believes could still be approved is having the tenant sign a livability checklist and have the
owner /manager attest that the rental property is meeting livability standards. Mayor Cook noted that that
piece of the program could be considered after the program is off the ground. Mr. Fraser also spoke about
his belief that a fee for the program is not necessary. Mr. Fraser also suggested that the city conduct a
random sample of inspections and not conduct inspections on all 1600 identified rental property units. He
also suggested that if property owners have properties that are above the standards, no fee should be
imposed.
Mike Stoebe, Country Club Manor managing partner, presented before the Council. Mr. Stobe noted that his
firm operates 7000 units across the Midwest. Mr. Stoebe asked who would be conducting the inspections.
Chief Emans noted that the current staffed Fire Inspector would be the designated inspector for residential
properties. Mr. Stoebe commented on a registration program that St. Cloud conducts.
• Mayor Cook noted that he was thinking of suggesting a$ 10.00 fee per unit initially. He also noted that he is
considering suggesting a graduated scale. Nuisance calls or repeat violators will be charged additional fees.

Brandon Fraser noted that his units are all at code or above code and the good property owners take the brunt
• for the bad property owners.
Motion by Stotts, second by Cook, to waive first reading and set second reading and adoption of Ordinance
No. 07 -0482 for February 26, 2008. Motion carried unanimously.
10. NEW BUSINESS
(a) CONSIDERATION FOR APPROVAL OF AMENDMENT TO SECTION 16 OF THE CITY OF
HUTCHINSON EMPLOYEE HANDBOOK
Brenda Ewing, Human Resources Director, presented before the Council. Ms. Ewing explained that the
proposed amendment is the result of a new federal law that is related to the Family and Medical Leave Act.
The new law allows for an employee to take up to 26 weeks of leave to care for a defined family member
that is a covered service member.
Motion by Stotts, second by Haugen, to approve amendment to Section 16 of the City of Hutchinson
employee handbook. Motion carried unanimously.
(b) CONSIDERATION FOR APPROVAL OF ESTABLISHING 2009 BUDGET PARAMETERS
Gary Plotz, City Administrator, noted that at a recently -held Council workshop, the Council identified
budget parameters for 2009. The City's finance director will be presenting the budget parameters identified
by the Council and the effects it has on the 2009 budget.
Ken Merrill, Finance Director, presented before the Council. Mr. Merrill reviewed Resolution No. 13349
which sets the budget revenues and expense parameters for budget year 2009. These parameters include
taxes not exceeding a 5% increase from the 2008 levy, LGA being budggeted at an 8% reduction of the 2008
• budgeted number and transfers from the enterprise funds increasing 5% from the 2008 budget. In addition,
salaries shall be budgeted at a 3.5% increase from the 2008 budget and health insurance costs shall be
budgeted at a 15% increase over the 2008 budget.
Mayor Cook questioned identifying expense parameters, which are mainly assumptions. The Council noted
that these parameters are a work in progress and may change as there are several unknowns.
Ken Merrill distributed a preliminary review of the 2009 budget which includes the proposed parameters.
This preliminary review shows that a modification of $664,340 will have to be made on either 'the
expenditure or revenue side. Mayor Cook clarified that this number is largely due to the 8% reduction in
LGA and no use of one -time money.
Motion by Stotts, second by Haugen, to approve Resolution No. 13349, establishing 2009 budget
parameters. Motion carried unanimously.
(c) CONSIDERATION FOR APPROVAL OF BUSINESS VALUATION SERVICES FOR THE CITY OF
HUTCHINSON
Gary Plotz, City Administrator, presented before the Council. Mr. Plotz noted that the proposal before the
Council is to have a valuation completed of Hutchinson Area Health Care. This valuation will be
undertaken to determine the fair market value of Hutchinson Area Health Care as of December 31, 2007.
The proposal is for $45,000 - $50,000. An asset valuation agreement was entered into by the City and
Hutchinson Area Health Care which outlines that the cost of the valuation will be shared equally.
Motion by Stotts, second by Hau�cn, to approve business valuation services with LarsonAllen, with a not -to-
exceed amount of $50,000. Motion carried unanimously.
• (d) PRESENTATION BY GARY PLOTZ ON BALDRIGE QUALITY MODEL
Gary Plotz, City Administrator, presented before the Council. Mr. Plotz noted that one of his objectives for

2008 was to explore the Baldrige Quality Model. Mr. Plotz provided a review of an audioconference he
attended on the topic. This model entails analyzing, measuring and reviewing for continued improvement.
• Baldrige is a national award for quality /performance excellence that was started in 1988. Its original purpose
was to improve global business competitiveness. Mr. Plotz reviewed the Integrated Management System
which is part of the model. Mr. Plotz then reviewed the story of Coral Springs, FL, which is the city that
received the Baldrige Award. Mr. Plotz expressed that he feels the City is already taking steps towards this
model this year.
(e) DISCUSSION REGARDING TELECOMMUNICATIONS COMMISSION
Mayor Cook noted that currently this board is active on the books, however it doesn't meet regularly, and in
fact, has not convened since 2002. The Board has met approximately six times since 1994. Gary Plotz
noted that he spoke to G. Barry Anderson, who is a board member of the HCVN board, and he sees no
reason to keep this Commission active. If needed, a temporary committee could be called to discuss current
issues.
Council Member Haugen also asked if the Charter Commission needs to meet discuss hospital issues. Marc
Sebora noted that the Charter Commission will be meeting this Spring.
Motion by Arndt, second by Haugen, to consider an ordinance change to abolish the Telecommunications
Commission. Motion carried unanimously.
(f) CLOSED SESSION UNDER MINNESOTA STATUTE 13D.05, SUBD. 3(C) TO DISCUSS PROPERTY
ACQUISITION ASSOCIATED WITH NORTHEAST TRUNK STORM SEWER PHASE 2 PROJECT
Marc Sebora noted that the City Engineer asked that this closed session be tabled to allow additional time to
speak with the landowner's representative.
Motion by Stotts, second by Arndt, to table this item. Motion carried unanimously.

Mayor Cook - Mayor Cook noted that on February 20 the Coalition of Greater Minnesota Cities is
holding a legislative day.
Mayor Cook also noted that Kent Exner, City Engineer, had distributed two transportation Resolutions for
the Council to consider. These Resolutions urge the State legislature to develop a comprehensive
transportation plan. Council Member Stotts noted he was not in support of the League's Resolution that
identifies specific funding options and would rather have it read, "various funding options ".
Motion by Stotts, second by Haugen, to approve the Resolutions with the amendment noted above.
Motion carried unanimously.

• Parks, Recreation & Community Education Advisory Board
January 7, 2008
Members present were: Deane Dietel, Bill Arndt, Lora Muilenburg, Beth Hepola, Mike
Retterath, Mike Cannon and Keith Kamrath. Dolf Moon and Karen McKay were also present.
The meeting was called to order at 5:19 pm.
A motion was made by Bill Arndt and seconded by Deane Dietel to approve the minutes dated
December 3, 2007. The board unanimously agreed.
OLD BUSINESS
Tour - The shelter in Drift Riders Park was completed by member volunteers in November. A
dock would be a great feature in the park. Dolf will check with the fisheries division of the
Department of Natural Resources (DNR), about possible financial assistance.
NEW BUSINESS
Dam Update — The City Council approved additional resources up to $100,000 to finish the dam
project. The money will be coming out of the excess bond funds. The project was bid too close
to the actual cost, generally projects are 5% over in case of change orders.
• Underpass — The underpass requires an additional $50,000 coming from excess bond funds. The
Minnesota Department of Transportation (MNDOT) was going to stake out the project, but City
staff did it and didn't compensate themselves.
Aquatic Center Discussion - The Mayor thought that excess bond funds could be used to match
or apply as a down payment to upgrade the pool. The City has just over one million left in the
excess bond funds for use at the City Council's discretion. The estimate to renovate the pool was
S1.6 million in 2000, with inflation it could be $2 million by now.
Other cities that have renovated their pool recently include Crystal and Glencoe. Crystal used
excess bond funds with a taxpayer match. Glencoe funded their pool with excess bond funds and
service group donations.
Dolf will have financial models together for the February meeting that will include prices for
passes, estimated attendance and revenue generated by attendance along with operation costs.
Once the project is completed there is a possibility of needing additional staff for maintenance
purposes.
Lora questioned how the decision to move forward is made. Dolf responded that since the Parks,
Recreation and Community Education Board is an advisory group the board would send a
recommendation to the City Council.

Fireman's Park Memorial — The Fire Department staff want to create a memorial to recognize
volunteers. To help fund the project they may sell bricks with names and years served engraved
on them. The park will be getting a facelift as part of the bridge installation. Lawrence has
created three designs that have been presented to a small group. The newly formed Public Arts
Commission will also review the design.
Event Center Update — The Event Center recently purchased a dishwasher, china and silverware
to serve 600 people. The Senior Advisory Board funded the items that could generate
approximately $17,000 to $18,000 a year when rented. Rental fees will be divided by the Senior
Advisory Board, the Event Center and the caterer. The Senior Advisory Board will recoup their
investment; they continue to redirect their funds to Senior Activities.

The Gopher Campfire Sanctuary is looking differently with the water elevation down. City staff
removed undesirable vegetation and stabilized the shoreline. A landscape design is being
planned for a cost of $35,000- $40,000. Gopher Campfire will be seeking funds from the DNR
for the project, the City is contributing $25,000. The fence around the sanctuary also needs to be
addressed as Minnesota law requires fences enclosing wildlife to be eight feet high and it's
currently six feet high.

Chairman Otteson opened the hearing at 5:37 p.m. with the reading of
publication #7643 as published in the Hutchinson Leader on January 3,
2008.
Ms. Bowers commented on the request and explained the history of the
property annexation and the 78 acre site owned by the Hutchinson EDA.
All properties are annexed into the City as R -1 (single family residential).
The plan for the property is industrial. She explained industrial zoning
would be consistent with the comprehensive plan and fit the needs of the
future industrial development. The EDA has been working on the
development of the property. She noted the following staff
recommendations:
1. The rezoning would be consistent with the intent of the
Comprehensive Plan and Zoning Ordinance, including the industrial
land use guiding, adjacent industrial zoning, and the industrial nature
of the area.
2. The property is proposed to be developed as industrial use.
Rezoning would allow the proposed use to be developed in
• conformance with the 1 -1 district.

• Mr. Seppelt, EDA Director, reported the EDA has hired SEH to give ideas
on development of the property. He gave background on the plans for
the industrial park and described the proposed low impact design for
stormwater run -off. He explained there will be no storm sewer lines in the
development to help reduce development costs. The preliminary lot
layout is a mixture of lot sizes. Mr. Seppelt stated they are being as
innovative as possible to develop an environmentally friendly site.
Discussion followed on the proposed road to the north and acquiring
property from Cenex and Hutch Iron and Metal. Mr. Seppelt explained
the project and the proposed road right of way for an access road.
Discussion followed on the future plans for the development. Mr. Seppelt
stated the water must be looped from 5' Avenue on the north and
sanitary sewer from the south. There may be some phasing of the
development. The first phase will be the street, water and sewer. Mr.
Seppelt has discussed the development idea with 3M and Kadelbach's,
abutting property owners.
Ms. Bowers explained this is only the first step. The platting process will
follow.
There was discussion on the name of the street and the development.
Energy Parkway vs. Energy Park Drive were discussed.
• Marc Telecky, 1180 Arch St., property owner, commented on the
proposed industrial park. Comments included concern for the
infrastructure costs, impact to existing properties and future plans, and
questions on the vacancy rate for industrial properties. Discussion was
held on the city's future development plans and cost of the infrastructure
to serve the property. Mr. Seppelt provided additional details on the
proposed industrial park and provided information on the industrial
development market and stated that there is limited industrial park land
available.
Mr. Seppelt stated he has had discussions with the Hackbarth family on
their property. The discussions were difficult and the property would be
expensive to develop. There was no flexibility on the price.
Mr. Exner commented on service to the Warrior property. He stated
service to the Hackbarth property would come from Industrial Blvd. to
the west by gravity.
Ms. Bowers stated this is a typical rezoning request. There will be future
discussion when the plat is reviewed. She explained the railroad
property will be rezoned in the future.
Mr. Marc Telecky voiced his concern with the development of this
property and commented on orderly growth of the city.

Mr. Dave Telecky discussed an existing access agreement to the
• property and problems that have occurred due to heavy truck traffic
damaging their township road. Mr. Seppelt stated they want to be a

Ms. Bowers commented on the request and the vacation of the
easements in 2007. She explained the EDA is proposing a spec building
for the lot. She described the portion of the property to be platted and
the property to be traded to Hutch Coop. She reported on the following
Staff recommendations:
• 1. Any relocation of utilities will be the applicant's responsibility.
2. Future development of the site will require review and approval of a
site plan by the Planning Commission and City Council.
3. The remaining 1.74 acre portion of lot 5, Goebel's Addition, outside of
the subject plat, must be combined with the Cenex Co -op property to
the east.
4. Fees for future development will be determined by the subdivision
ordinance and the current City's fee schedule in effect prior to
construction. Engineering fees and sewer and water access fees will
be based upon the site work necessary for the site and the specifics
of the proposed use of the building to be constructed on the site. All
required fees shall be paid prior to issuance of a building permit and
prior to any construction on the site.
The remaining portion to the east will be platted with the Hutch Co-op
site.
Mr. Seppelt stated the easterly property will be a trade for the street right
of way property. Discussion of the easements to be platted with the
Cenex property.

Ordinance. Other items will be to update the comprehensive plan,
transportation plan, and park dedication. The work plan items will be in
process as time permits.
b) JOINT PLANNING COMMISSION AND CITY COUNCIL WORKSHOP
Ms. Bowers asked the Planning Commissioners to think about dates they
would be available for a joint meeting with the City Council. She
suggested a meeting possibly in February before the next Planning
Commission meeting. Ms. Bowers will talk to the Council on a date.
Items to discuss will be the Hwy 7 impact on existing businesses.
c) Mr. Haugen commented on the City Council discussion regarding truck
• parking in residential neighborhoods and stated this will possibly go to the
planning commission for review.

Mr. Gasow commented on the request to add language to the Zoning Ordinance
to allow expansion of a feedlot in the Joint Planning area. He explained the
request by Mr. Luthens to expand his feedlot. He stated with this proposed
ordinance change, Mr. Luthens would be allowed to make a permit application for
another feedlot expansion by conditional use permit at his current feedlot site.
He explained the present ordinance regulating feedlots in the Joint Planning
Area. He also stated the existing feedlot meets MPCA feedlot regulations. Mr.
Gasow stated staff does not oppose the request based on the history and
timelines of the previous permitting process of this feedlot. The Board would not
lose control because of the need for a conditional use permit. This change affects
a small area.
Mr. Berggren, commented on the number of animal units permitted in the Joint
Planning Area. He explained that there are possibly less animal units in reality.
Discussion followed on the problem with writing an ordinance for one feedlot. It
was suggested to change the ordinance to allow over 400 animal units for all
• feedlots to make the rule uniform in the Joint Planning Area. Mr. Knutson

explained, in the beginning, the ordinance was to discourage new feedlots in the
• Joint Planning Area. Discussion followed on the option of omitting the no feedlots
shall exceed 400 animal units. Mr. Berggren explained MPCA does look at the
well head protection area in granting a feedlot expansion. Discussion followed on
the Joint Planning boundary. There was further discussion regarding changing
the ordinance for one feedlot. Mr. Berggren explained a feedlot can expand if
they meet the setbacks from residential developments.
There was discussion on the City of Hutchinson's view of the ordinance change
Randy Peterson, Hassan Valley Twp, asked where does this feedlot growth end?
Will Skyview Dairy get larger after this? He has concems regarding the township
roads getting heavy use. Mr. Knutson explained taxes will be more for the feedlot
than a single family home. There was discussion regarding gravel pit truck traffic
on township roads.
Brandon Luthens, Skyview Dairy, addressed Mr. Peterson's concems with the
traffic on the township roads. He explained the improvements the dairy has made
to decrease traffic on the township roads. The entire family is involved in the
family business which is five families. Mr. Knutson asked about the proposed
digester.
Steve Reiner, Hassan Valley Twp. supervisor, stated he receives more
complaints on the roads than the smells. The township struggles with the road
issues.
• Mr. Lauer moved to close the hearing. Seconded by Mr. Knutson. The hearing
closed at 6:31 p.m. Mr. Wirt made a motion to delete number (1) in Subdivision
6, Section 15, Joint Planning Ordinance. Seconded by Mr. Lauer. Mr. Gasow
stated he was opposed to the proposed language change of Mr. Wirt and Mr.
Lauer. He explained the Luthen's expansion would be allowed in the county
outside of the Joint Planning Area. He stated if a feedlot meets the conditions the
conditional use permit must be approved. The setback issues could be a problem
for residential developments. Mr. Telecky commented on similar issues in the
State. He would disagree with the Board changing the proposed amendment. Mr.
Knutson stated he wants to make sure the City of Hutchinson is protected. Atty.
Sebora stated the County attomey must enforce the ordinance. He stated the
motion is a good solution to a difficult situation for equality to feedlots. The
motion carried unanimously. Mr. Gasow stated this item would be forwarded to
the County Board and placed on their agenda, February 5th, 2008, at 10:00 a.m.
b) CONDITIONAL USE PERMIT TO ALLOW AUTOMOBILE DEALERSHIP AND
IMPOUND LOT TO BE LOCATED AT 16355 HWY 7 EAST, HUTCHINSON

construct a 75' X 100' fenced impound area on the property. Minor auto repair is
• proposed to prepare vehicles prior to sale. The concern with outdoor storage is
the appearance of the property and potential impacts to adjacent properties. For
this property, the appearance and visibility from Hwy 7 is a concern. The
applicant proposes to screen the impound lot with a 6 -foot high wood fence. Staff
recommends limiting the number of vehicles for sale to 20. The applicant has
requested 30 vehicles. Future consideration could be given to expand the
number based upon more detailed information provided by the applicant and
subject to meeting conditional use permit standards with no extra fees.
Staff recommends approval of the request with the following recommendations:
1. The number of used vehicles for display on the site shall be limited to the
number that can be maintained in a 9 x 18 parking stall with an adequate
drive aisle, with a maximum of 20 vehicles. The applicant may apply to
expand the number based upon detailed site layout information to be
provided by the applicant in the future and subject to meeting the
standards for a conditional use permit.
2. The impound lot shall be located and indicated on the site plan with a 6-
foot high wood fence completely enclosing the impound lot. Impounded
vehicles shall not be stored outside the fence.
3. Any lighting will be directed away from the highway and not be intrusive to
passing motorists or adjacent properties.
4. Any signage related to the business must meet the County and Joint
Planning Ordinance.
• 5. The drainage and utility easements shall remain clear to facilitate
drainage and shall not be paved.
6. The storage and disposal of hazardous materials from damaged vehicles
shall comply with State and Federal regulations.
7. If floor drains are used with interior storage of vehicles, a conforming
septic system shall be designed and pumping agreement be created in
accordance with ISTS Rules.
Discussion followed on the placement of display areas and number of vehicles.
Mr. Evenson stated he would place the "for sale" vehicles closer to the pond and
leave the front area grass. There is a graveled area to the south of the proposed
sales lot. He will occupy the front 1/3 of the building. There was discussion
regarding the house on the property. Mr. Evenson stated the owner's employee
lives in the house and is cooperative with the proposed use. Mr. Evenson is
planning on remaining at this location for a long period of time.
Mr. Wirt moved to close the hearing. Seconded by Mr. Anderson. The hearing
closed at 5:50 p.m. Mr. Anderson made a motion to approve the request with the
seven recommendations. Seconded by Mr. Wirt, with an amendment to the
motion to include: proof of an approved septic for the house must be provided.
Mr. Telecky stated the house was not originally constructed for residential use it
was originally intended for an office. The septic was not put in for a residential
use. Mr. Wirt agreed to seconding the motion with the seven recommendations.

ADVISORY BOARD
§31.32 ORGANICS PROCESSING FACILITY ADVISORY BOARD
(A) Establishment.
(1) A Creekside Organics Processing Facility Advisory Board is hereby established.
(B) Purpose.
The purpose of the Creekside Organics Processing Facility Advisory Board shall include but
is not limited to:
(1) Advising the City Council on topics concerning the operation of any city-owned organics
processing facility or program;
(2) Providing input to City staff and the City Council as to the continued use and
environmental- friendly manufacturing of compost and other organic products reselling
from what would otherwise be unused waste materials;
(3) Promoting the use and marketing of compost and other organic products by industry,
• public entities and individuals;
(4) Acting as a liaison between the City of Hutchinson and those neighboring any process
facility to address questions or concerns about Creekside organic processing facility
operations;
(C) Appointment and Board Composition
(1) The Board shall be composed of five members. The members shall include two City
Council Members and three citizen members.
The City Council Members shall serve one year terms and shall be appointed or
reappointed annually by the Mayor subject to ratification by the City Council.
Citizen member positions shall be designated as "Position 1", "Position 2" and "Position
3 ". The initial appointment for Position 1 shall be for one year; Position 2 for two years,
and Position 3 for three years. Thereafter, citizen members shall be appointed for three -
year terms. Citizen members may serve a maximum of two terms or six years, whichever
is less.
Persons appointed to fill vacant Board positions shall be deemed to be completing his or
her predecessor's unexpired term.
The City Administrator and Compost Facility Manager shall be ex- officio members.

TELECOMMUNICATIONS COMMISSION
WHEREAS, on March 22, 1994, the Hutchinson City Council established a standing
Telecommunications Commission in Ordinance No. 94 -106; and,
WHEREAS, the purpose of the Telecommunications Commission was to act in an
advisory capacity to the City Council for the city and make recommendations to the City Council
on issues regarding cable television and telecommunication services within the city limits; and,
WHEREAS, the Telecommunications Commission has met infrequently since it was
established in 1994; and,
WHEREAS, if necessary, an ad hoc Telecommunications Committee could be created to
work on short-term projects; and,
WHEREAS, an ad hoc Telecommunications Committee would facilitate getting
volunteer committee members, make better use of committee members time and would be a
• better use of City resources,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON, THAT
Hutchinson City Code Section 31.30 is hereby repealed and the Telecommunications

Background:
The applicant is proposing to complete the remaining phase of the Ravenwood Condo plat.
A conditional use permit was approved in 2002 to allow up to 6 -unit buildings with a
maximum of 64 units. This request is to construct five 8 -unit buildings, which would provide
two additional units within the existing building footprints, for a total of 66 units. A
conditional use permit is required for 3 to 8 unit buildings in the R -3 zoning district. The
applicant is also requesting a conditional use permit to construct garages that are less than
the required 400 sq. ft. Additional information is contained in the attached Planning
Commission staff report and attachments.
• Planning Commission Meeting:
The Planning Commission held a public hearing and considered the request at their February
19, 2008, meeting. Two letters were received from neighboring property owners with concerns
regarding the development (see attached letters). The letters were provided to the applicant
before the meeting so the concerns could be addressed. The applicant also met with several
neighbors prior to the meeting to discuss their concerns. There were several property owners
present at the meeting, however only one resident spoke at the public hearing. The concems
stated were the water shut -off valves extending above the ground and the lawn sprinkling
system being installed incorrectly. The City Engineer stated the water shutoffs are private and
are the developer's responsibility to correct.
The Commission asked the applicant to address some of the neighbors concerns. The
applicant presented information about the deed restrictions on age and the senior housing
market. He stated the exterior of the buildings will look the same as the existing condos and
20 guest parking spaces will be provided. The applicant said no parking is allowed on the
private streets, but guests can park on the public streets and in the proposed guest parking
spaces in the southerly half. The Commission discussed the requirements from when the
development was approved compared to the current requirements. After discussion the
conditions, the Commission recommended approval.
Recommendation:
• The Planning Commission unanimously recommended approval of the conditional use permit
with the findings and conditions in the attached resolution.

• The Comprehensive Plan identifies the property as "Mixed use residential ", which sets an overall density
of 5 -18 units per acre. The proposal to increase the density from 64 to 66 units would result in an
increase from 10.3 to 10.6 dwelling units per acre, which is within density guidelines. The proposed 66
total units on the 6.2 acre condo site would result in 4,096 square feet per unit. The minimum lot area
required per unit is 4,200 sq. ft, however a deduction of 400 sq. feet per unit is allowed for 8 -unit
structures such as the proposed. Therefore, the proposal would meet lot area requirements.
During the staff review meeting, a number of items were discussed. Because the units will be primarily
senior units, staff recommends that a Knox Box should be placed on the building with a master key for
emergencies. Sprinkling of the building is recommended and may be required upon building permit
review. Easements for utility access between buildings was also discussed. Additional information is
needed from the applicant regarding plans for utility services. Placement of the water meter in an
accessible area was discussed. Regarding requirements for tree planting escrow, staff researched the
subdivision agreement and subdivision regulations required at the time of platting the Ravenwood Condo
development (1998) and found that no trees escrows were required at that time.
Two letters were received from residents in the existing condos stating several concerns about the
proposal and unaddressed development issues. The letters are attached and have been forwarded to the
applicant to address at the meeting.
Staff would recommend approval of the request with the following recommendations:

Because of the down to in the real estate market, sem*ors have had a problem nettin an

Dear Planning Commission Members:
Due to my inability to attend the public hearing on 02/19/2008 concerning the CUP requested
by Mr. Roger Derrick, I am sending this letter to address my concerns. On Friday, February
8th, my wife and I visited Bonnie Baumetz to obtain the preexisting facts. We were dismayed
to learn that a previous CUP allowing 64 total units in the Ravenwood Condominium Associa-
tion was already in place. All marketing materials and drawings presented by CHOA to the
present homeowners indicated a total of 46. Since their option for 64 units already exists, I
guess 2 more units are a moot point. However, I still have major concerns (as do several other
homeowners that have contacted me) about the density of 5 eight unit buildings and what that
means to the Association as a whole.
1.
Parking..... This is already an issue in the present construction containing only 26 units.
2.
Extremely narrow streets.... presently White Owl has no "no parking" signs.
3.
Will all new construction "look like" and nicely blend with present buildings?
4.
Will this housing be for "seniors" 55 and over? Just last fall Cottage Homesteads of Amer-
ica went against the very by -laws they drafted and sold an existing unit to an individual in
their thirties.
5.
Who will pay the monthly association dues ($144 per month) on the 8 units in any con-

structed (yet unsold) building or buildings when they require snow removal, mowing, water-
ing etc. It has been difficult to get CHOA to remain current on their present obligations for
the 2 units that remain unsold in the existing construction.
6.
The additional traffic 40 more units will bring to already narrow, constricted streets.
7.
The association is already bogged down by 2 unsold units, 2 resales and 1 foreclosure.
There is no "model" or active marketing for the 2 unsold units owned by CHOA.

Will the projected low price of proposed units drag down the value of the existing units?
9.
It has been difficult to get CHOA to rectify or complete certain obligations in the exist-
ing property. Will they fulfill their promises for the proposed addition? There are several
water shut -offs on Ravenwood property that protrude as much as a foot out of the ground.
The city says it's the developer's responsibility and the developer says it is the city's re-
sponsibility. Can someone give us a definitive answer by looking back to the original plan?
There is also a large conduit sticking out of the ground at the end of the street along Blue
Jay Drive. The rumor is that is was suppose to be a streetlight. Can anyone clarify that?
I realize there is no turning back on the previously granted CUP, however, I wonder if certain
stipulations can be placed on the granting of the current request by Mr. Derrick.

• I . Incorporation of extra parking areas in proposed new construction that would be available for
use by all 66 units.
2. Installation of "no parking" signs on White Owl and "no parking" signs on any additional
streets impacted by new construction.
3. Written and documented assurance that proposed additional units would be sold (and not
rented) to individuals at least 55 and up.
4. That CHOA completes any obligation they have concerning the existing properties.
(If, in fact, they are responsible for lowering water shut -offs and completing a street fight)

calls for $102.00 per hour for a pay loader and $70.00 per hour for trucks in addition to the normal charge
for clearing snow. This would provide a real financial burden on an Association that is always strapped for
funds.
Our second concern is that allowing smaller garages would mean that garbage cans would need to be left
outside at all times and that is against regulations and would not make for an attractive appearance.
When we purchased here and as late as the last annual meeting all of the information we received was based
on the entire number of units in Ravenwood would be 46 units. This was the plat we were given when we
bought and at no time have we been informed of plans to build five more eight unit buildings, possibly
making our total 86. Cottage has been very slow to complete outside work and inside warranty work in
Ravenwood. Almost all of the water connections in the existing yards are many inches above the grass and
makes mowing difficult and the chance of hitting them another concern of the association. A couple of the
units have been waiting for inside warranty work for more than a year.
We appreciate your attention to the problems listed. We will be in Arizona for a few weeks and cannot
attend the meeting in person.

SUBJECT: AMENDMENT TO ZONING ORDINANCE SECTION 154.057 TO ALLOW BY
RESERVATION SPECIAL EVENTS SPACE IN OWNER OCCUPIED HOMES IN
THE R -2 DISTRICT BY CONDITIONAL USE PERMIT, REQUESTED BY
AUDREY HOLLATZ.
Background:
The applicant is proposing to add a new conditional use to Section 154.057 of the Zoning
Ordinance to allow by reservation special events space in owner occupied homes in the R -2
District. The proposed reservations would be for special occasions such as: birthday parties,
baby and bridal showers, family celebrations, etiquette and craft lessons, meetings, etc. The
applicant has a purchase option on 325 Hassan Street SE, the L.A. Ritter house, which is the
intended location if the ordinance is approved. The specific information on approximate
numbers of persons attending, hours of operation, parking needs, etc, would be addressed in
• the conditional use permit process. Additional information is contained in the attached
Planning Commission staff report.
Planning Commission Meeting:
The Planning Commission held a public hearing and considered the request at their February
19, 2008, meeting. There were no comments from the public on the request, other than from
the applicant. Ms. Hollatz commented on her plans for the conditional use permit if the
ordinance amendment is approved. She explained that all groups would be by- reservation
only, so she would specify the number of attendees ahead of time. She stated the size of
groups would vary from 4 to a maximum of 40 people, which is expected to be less than 20
cars. She has spoken with Faith Lutheran church staff about using their parking lot. The
Commission discussed the size of groups for special events and parking arrangements. The
details of her proposal would be reviewed with the conditional use permit. The Commission
also discussed that the proposal could encourage preservation of historic homes.
After discussing various zoning districts, the Commission recommended changing the draft
ordinance to limit the area to R -2 property within 500 feet of the C -3 (central commercial zoning
district). Also recommended was to add the details of the proposed use in the conditional use
permit, along with the maximum number of attendees, hours of events, and parking
accommodations. The attached ordinance has the proposed changes.

SPACE IN OWNER OCCUPIED HOMES IN THE R -2 DISTRICT BY CONDITIONAL USE PERMIT
THE CITY COUNCIL OF THE CITY OF HUTCHINSON. MINNESOTA ORDAINS:
Notice of public hearing was duly given and publication of said hearing was duly made to appear to the
satisfaction of the City Council that it would be in the best interests of the City to amend the Zoning Ordinance
to amend language in Section 154.057 of the City Code as follows:
§ 154.057 R -2, MEDIUM DENSITY RESIDENTIAL DISTRICT.
(A) Purpose. The R -2 medium density residential district allows single - family homes and
complementary uses on land parcels that are smaller than those required in the R -I district. Two - family
buildings are also allowed.
(B) Permitted uses.
(1) Single - family detached dwellings. All new home construction in residential districts
shall have an attached or detached garage with a minimum of 400 square feet. Single - family dwellings without
garages or with garages less than 400 square feet are conditionally permitted. A conditional use permit is
required;
(2) Two - family attached dwellings, duplexes, double bungalows. All new home
• construction in residential districts shall have an attached or detached garage with a minimum of 400 square
feet. Single - family dwellings without garages or with garages less than 400 square feet are conditionally
permitted. A conditional use permit is required;
(3) Parks and playgrounds;
(4) Licensed family day care as permitted by state law; and
(5) State licensed residential facilities serving six or fewer persons.
(C) Conditional uses.
(1) All conditional uses of the R -1 district;
(2) Replacement of existing nonconforming accessory buildings and driveways may be
conditionally permitted, provided:
(a) The applicant provides the city with a rear and side yard utility and drainage
easement as required by the city;
(b) The garage is 1,000 square feet or less and is not closer than three feet, zero
inches from any interior property line, in which case the overhangs must be less
than one foot from building exterior. There shall be no recorded easement on
the property in the setback area;
(c) A land survey, signed and designed by a registered land surveyor, is provided
and approved representing property lines, easement locations and drainage, and
a site plan with the proposed building dimensions, finished floor elevations and
setbacks from property lines;
(d) A waiver from utilities, telephone company and cable franchise; and
(e) The applicant shall provide a six -foot easement on opposite side and rear of
property prior to issuance of conditional use permit. The city, at its sole option,
may waive the six -foot rear yard setback requirement.

(d) The specifics of the use shall be included in the conditional use permit

of a commercial zoning district to take advantage of the proximity to existing businesses and
public parking and to limit encroachment into residential areas with no nearby commercial areas.
Limiting the area will also allow an opportunity to evaluate this new concept within limited
boundaries. The Commission may also consider further limiting the area to specify only the C -3
(Central Commercial District), which is the downtown commercial district.
The proposed use is somewhat similar to a home business or a live/work unit, however review
through the conditional use permit process is recommended to specify requirements such as
parking, hours of operation, maximum number of participants, etc. Consideration will need to
be given to the size of the groups that will be allowed.
Staff is also recommending two minor changes to the existing ordinance to remove duplicate
language (154.057.c.3) and add a reference to the conditions for a bed and breakfast for clarity
(154.057c.9).
Staff discussed the ordinance at their February 4 meeting and recommends approval. Staff
stated that live /work units and the concept of holding special events in single family homes is
becoming a trend. Seattle, WA and Excelsior, MN were mentioned as examples where homes
are being used for special uses.
Recommendation:
Staff recommends approval of the ordinance revisions as shown in the attached ordinance
amendment. As noted above, the Commission may also consider further limiting the area to
specify within 500 feet of the C -3 (Central Commercial District) The attached ordinance

As construction has proceeded on the below listed projects there have been additional work, project scope revisions, and
construction staging revisions. All of these items have been identified and deemed necessary to satisfactorily complete
the projects. The following Change Orders are proposed to address these items:

1.
PURPOSE AND FINDINGS
Subdivision 1. The City Council of the City of Hutchinson finds that there is a need for periodic
municipal inspection of residential rental units in the City to ensure that such units meet City and
State safety, health, fire and zoning laws and codes in order to promote the public health, safety and
welfare of the community at large and the residents of rental units within the City.
Subdivision 2. The City Council of the City of Hutchinson finds that a municipal registration
program is appropriate to effectively enforce residential rental unit maintenance standards and
correct or prevent law violations, nuisances and other disturbances and disorders involving
residential rental units within this City.
Subdivision 3. The City Council of the City of Hutchinson finds that an effective means of
• implementing the foregoing registration of all residential rental units with the City and inspection of

such units from time to time as determined appropriate in the exercise of discretion by staff and
personnel of the City and in response to complaints involving such units.
• 2. DEFINITIONS: For purposes of this Ordinance, the following definitions shall apply;
Subdivision 1. Rental Unit or Residential Rental Unit means any house, apartment, condominium,
townhouse, manufactured home, mobile home, mobile or manufactured home lot, room, or group of
rooms, constituting or located within, a dwelling and forming a habitable unit.
Subdivision 2. Dwelling means any building or other permanent or temporary structure, including a
manufactured or mobile home which is wholly or partly used, or intended to be used, for living or
sleeping by human occupants.
Subdivision 3. Rent, Lease, Let or Sublet means the leasing of a rental unit to a non -owner for a
fixed or non -fixed period of time, and shall include installment sales, purchases, and other similar
arrangements whereby nonpayment of a periodic payment means the occupants may be evicted
without the necessity of either a statutory mortgage foreclosure procedure, a statutory termination of
contract for deed procedure, or a statutory repossession procedure.
Subdivision 4. Shall and must as used in this Ordinance are each mandatory. Should and may as used
in this Ordinance are each permissive or directory.
Subdivision 5. Administrator means the City Administrator or their designee.
• Subdivision 6. Registration Holder means a person or entity that is the owner of record according to
the records on file with McLeod County, Minnesota.
Subdivision 7. Local Property Manager means a natural person residing within 50 miles of the City
of Hutchinson who is authorized by the rental unit owner to make decisions for the owner about
rental, occupancy and maintenance of the rental unit.
REGISTRATION REQUIREMENTS:
Subdivision 1. No person or entity may hereafter occupy, allow to be occupied or rent, lease, let or
sub -let a rental unit, to another person or entity for occupancy unless that rental unit is registered for
occupancy pursuant to a valid and current rental unit registration issued by the Hutchinson City
Administrator.
Subdivision 2. Each rental unit must have an owner, or Local Property Manager designated by the
owner, who resides within 50 miles of the City of Hutchinson.
Subdivision 3. All rental agreements or leases used to rent, let, lease or sub -let any rental unit to
another person or entity for occupancy shall include and incorporate by reference, as a condition of
the occupancy or tenancy, all of terms, provisions and requirements of Sections 7, 9, 10, 11, 12, 13,
14, 15, and 16 of this ordinance. All tenants or other occupants under any rental agreements or
leases used to rent, let lease or sub -let any rental unit shall be provided a written notice that the terms

of the rental agreement or lease include and incorporate all of the terms, provisions and requirements
of Sections 7, 9, 10, 11, 12, 13, 14, 15, and 16 of this ordinance and such written notice shall recite
• verbatim the terms, provisions and requirements of Sections 7, 9, 10, 11, 12, 13, 14, 15, and 16 of
this ordinance.
Subdivision 4. Any person or entity desiring to rent, let, lease or sub -let to another any rental unit
shall apply for registration by using forms furnished by the Administrator for that purpose. The
forms must provide information required by the Administrator, including the following:
A. Name, address, phone number (and FAX number, if owner has one) of the property
owner.
B. Name, address, phone number (and FAX number, if manager has one) of a designated
Local Property Manger.
C. The street address of the rental property.
D. The number and types of units within the rental property (dwelling units or sleeping
rooms).
E. The maximum number of occupants permitted for each dwelling unit or sleeping
room.
F. The name, phone number, FAX number and address of the person authorized to
make, or order, made repairs or services for the property if in violation of City or
State codes, if the person is different than the owner or Local Property Manager,
G. A list of the names of all residents of the premises which will be updated by the local
property manager or registration holder.
4. EXEMPTIONS:
This Ordinance does not apply to units owned, operated or managed by a governmental entity or
agency, hospital units or rooms, nursing homes, retirement homes or other similar rental space which
is otherwise registered by the State of Minnesota or the City of Hutchinson if 100% of the units are
agency inspected on a yearly basis.
MANNER OF REGISTRATION RENEWAL:
The first registration of property must be done by May 1, 2008. The City will annually mail
registration renewal forms to rental unit owners or their designated Local Property Managers on or
about January 1" of each year. Completed registration renewal forms must be delivered to the City
Administrator or their designee no later than March I" of each year. Failure of the City to mail
renewal forms and failure of an owner or Local Property Manager to receive a renewal form, does
not excuse or waive the registration required by this Ordinance.

6. TRANSFER OF PROPERTY:
• Every new owner of a rental unit, whether fee owner or contract purchases, shall famish to the City
Administrator or their designee the new owner's name, address, phone number and fax number and
the name, address, phone number and fax number of the new owner's designated Local Property
Manager before taking possession of the rental property upon closing the transaction. No new
registration fee is to be required of the new owner during the year in which such possession takes
place, provided that the previous owner has paid all registration fees and has complied with all
requirements of this Ordinance, State law and corrected any violations of health, zoning, fire or
safety codes of the City or State law. If any change in the type of occupancy as originally registered
is contemplated by the new owner, a new registration application will be required.
7. POSTING OF REGISTRATION:
Each rental unit registration holder must post the rental unit registration in a conspicuous spot new
the front entry to the rental unit in a public corridor, hallway or lobby, must retain a copy of the
rental unit registration on file and must be able to produce said copy upon demand. Failure to post
the registration and keep the registration posted is a misdemeanor, and may be grounds for
termination of registration.
8. FEES:
The fees for rental unit registration, registration renewal, late fees and inspection,5 will be set by the
City Council in the ordinance adopting the City's fee schedule. Failure to pay appropriate fees will
result in the City assessing such amounts to the property value through the County.
9. SAFE HOUSING EDUCATION/MAINTENANCE OF RECORDS:
The City of Hutchinson shall provide an Apartment Building Checklist and may facilitate access to
City and State safety, health, fire and zoning codes to interested persons. Registration Holders shall
provide each tenant with a copy of the Apartment Building Checklist at the time the tenant leases the
property. After registration and inspection the City shall provide the owner with the completed
inspection form with an additional copy to be received and acknowledged by the tenant.
All records, files and documents pertaining to rental unit registration and rental unit inspections may
be obtained by the City Administrator or their designee and will be available to the public as
allowed, permitted or required by State Law or City Ordinance.
10. MAINTENANCE STANDARDS:
Every rental unit must be maintained in compliance with the, dwelling maintenance standards, blight
ordinance and noise ordinance of the City of Hutchinson, State of Minnesota nuisance statutes, State
of Minnesota dwelling maintenance standards, State of Minnesota health code, and State of
Minnesota fire code, respectively as now in force and hereafter amended, revised or replaced, and in
compliance with all other standards, ordinances, laws and regulations governing use, occupancy,
construction and maintenance of property and conduct of persons in or on that property. Rental unit

registration does not constitute certification of compliance with such codes, standards, ordinances or
statutes by the City of Hutchinson.
• 11. INSPECTIONS AND INVESTIGATIONS:
All Inspections will be completed by the Fire Chief or their designee, so as all inspections will be
completed in a uniform manner.
Subdivision 1. Initial inspections of all registered properties will occur within the first year after
adoption of this ordinance. Properties will have a scheduled re- inspection on a schedule to be
determined by the City Administrator or their designee. All properties shall be inspected by the City
at least once every 3 years. The City shall have the right to make periodic inspections of all
properties based on complaints of landlords, tenants, neighbors or other individuals. Inspection
procedures for minor complaints should be as follows:

3. If owner does not respond and address the problem within a reasonable period,
tenant may send a copy of the owner notice to the City to report the deficiency.
4. City inspector arranges to inspect the rental unit.
5. City inspector notifies the owner in writing describing the deficiency and
recommended corrective action.

However, the City reserves the right to inspect registered properties without regard to the above -
suggested procedure if, in the opinion of the City Administrator or their designee, the facts
underlying the complaint constitute a condition that is unsafe to persons or property.
Subdivision 2. Law Enforcement, the City Building Official, and the City of Hutchinson respective
designees and representatives, are hereby authorized to make inspections reasonably necessary to the
enforcement of this Ordinance.
Subdivision 3. All persons authorized herein to inspect shall have the authority to enter, with seven
days notice to the registration holder or property manager any rental unit or structure containing a
rental unit, registered or required to be registered, for the purpose of enforcing this Ordinance. All
Registration Holders shall, as a condition of registration, consent to such entries for inspection
without warrant and all Registration Holders shall include, as a condition of any lease or rental

agreement with any tenant or occupant, that such tenants or occupants consent to such entries for
inspection without warrant. This subdivision does not limit or preclude any other right of entry
• authorized by law.
Subdivision 4. Written notice of a violation of this ordinance may be given to the Registration
Holder by First Class mail directed to the address of the Registration Holder as shown by the
Administrator's registration application file. Said notice may contain a Compliance Order stating that
compliance with this ordinance shall be made immediately and, in that case, the notice shall advise
the Registration Holder that the property may be re- inspected at a time to he determined by the
person conducting the inspection.
Subdivision 5. Any person who fails to comply with a compliance order and upon conviction
therefore shall be punished by a fine not to exceed the maximum penalties for misdemeanor crimes,
together with the cost of prosecution. Each day of such failure to comply shall constitute a separate
punishable offense.
12. FAILURE TO GRANT REGISTRATION, REVOCATION, SUSPENSION OR FAILURE
TO RENEW REGISTRATION
Subdivision 1. The City reserves the right to not register a rental unit unless it complies with the
requirements of this Ordinance.
Subdivision 2. Any registration issued under this Ordinance is subject to the right, which is hereby
expressly reserved by the City, to deny, suspend, revoke or not renew the same should the
• Registration Holder or their agents, employees, representatives or lessees directly or indirectly fail to
comply with the requirements of this ordinance or operate or maintain the rental dwellings contrary
to the provisions of this Ordinance or any other ordinance of the City or any special permit issued by
the City, or the laws of the State of Minnesota. Provided, however, registration shall not be denied,
suspended, revoked or not renewed if the Registration Holder complies with a compliance order or
orders in a reasonably timely manner as determined by the City Administrator or their designee.
Subdivision 3. The City Administrator or their designee shall notify the applicant that registration has
been denied, or the Registration Holder that registration is being suspended, revoked or not - renewed.
The suspension, revocation or non - renewal shall occur thirty-five (35) days after the date of the
notification order, or at such later date as set out in the notification.
13. SUMMARY ACTION
Subdivision 1. As a condition of receiving rental unit registration, each Registration Holder is
presumed to agree and consent that when the conduct of any Registration Holder or Registration
Holder's agent, representative, employee or lessee, or the condition of their rental unit, or the
property in or on which it is located, is detrimental to the public health, sanitation, safety and general
welfare of the community at large, or residents of the rental units so as to constitute a nuisance, fire
hazard, or other unsafe or dangerous condition and thus give rise to an emergency, the City
Administrator or their designee shall have the authority to summarily condemn or close individual
rental units or such areas of the rental dwelling as the City Administrator or their designee deems

necessary. Notice of summary condemnation shall be posted at the units or areas affected and shall
describe the units or areas affected. No person shall remove the posted notice, other than the Fire
• Chief, City Administrator, or their designated representative.
14. INTERIM HOUSING
As a condition of receiving a rental unit registration, the Registration Holder agrees that in the event
that the registration is denied, suspended, revoked or not renewed due to the action or inaction of the
Registration Holder, all tenants or sub - tenants of the residential rental unit shall be provided, at the
Registration Holder's expense, suitable interim housing approved by the Fire Chief or their designee.
The Registration Holder shall provide such interim housing until the registration for the unit is
restored or until the end of the lease term, which ever is shorter. Failure of the Registration Holder
to provide and/or pay for such interim housing shall be grounds for adverse action al all rental unit
registrations the Registration Holder has in the city.
15. APPLICABLE LAWS:
Registration Holders are subject to all of the ordinances of the City and State of Minnesota relating
to rental dwellings, and this Ordinance shall not be construed or interpreted to supersede or limit any
other applicable ordinance or law.
16. VIOLATIONS, INJUNCTIVE RELIEF:
Subdivision 1. Nothing in this Ordinance prevents the City from taking enforcement action under
• any of its fire, housing, zoning, health safety or other codes, ordinances and State laws for violations
thereof, or to seek injunctive relief and criminal prosecution for violations of any ordinance, code or
law. Nothing contained in this Ordinance prevents the City from seeking injunctive relief against a
property owner or designated property manager who fails to comply with the terms and conditions of
this Ordinance or to obtain an order closing such rental units until violations of this particular
Ordinance have been remedied by the property owner or designated property manager.
Subdivision 2. Violation of this Ordinance is a misdemeanor. Each separate day on which a
continuing violation occurs is a separate violation.
17. PENALTIES:
Subdivision 1. Any person violating any of the provisions of this Ordinance by doing any act or
omitting to do any act which constitutes a breach of any Section of this Ordinance, shall, upon
conviction thereof by lawful authority, be punished by a fine not to exceed the maximum penalties
for misdemeanor crimes, together with the costs of prosecution. Each day that a violation continues
shall be deemed a separate punishable offense. No provision of this Ordinance designating the duties
of any official or employee of the City of Hutchinson shall be so construed as to make such official
or employee liable for the penalty provided in this Section because of failure to perform such duty,
unless the intention of the City Council to impose such penalty on such official or employee is
specifically and clearly express in this Section creating the duty. All costs of prosecution will be
assessed to the property owner.

18. WRITTEN NOTICES:
• Notices from the City required by this ordinance shall be effective if personally delivered or if mailed
to the addressee by First Class mail, return receipt requested, to the address shown in the City file
pertaining to the rental unit involved in the notice.
19. EFFECTIVE DATE:
This Ordinance is effective upon its adoption and publication pursuant to the City of Hutchinson.
Provided, however, that the initial registration provisions of this Ordinance do not become effective
until rental unit owners have completed the process of registration. The initial registration covers a
period of time from the date of issue through March 1, 2009.
20. SEVERABILITY CLAUSE:
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be
invalid, such decision shall not affect validity of the remaining portions of this Ordinance.
This Ordinance shall take effect immediately from and after its passage and publication according to
law.

This memorandum is to request an adjustment to the current fee schedule with regard to
kennel fees. Currently the police department is charging a fee of $10.00 per day to kennel
an animal when it is impounded. This rate needs to be increased in order to recoup the fee
that is being charged to the City of Hutchinson. The rate for dogs should be increased to
$13.25 per day and $11.00 per day for cats.

§ 72.06 TRUCK PARKING RESTRICTED.
(A) It is unlawful to park a detached semi - trailer upon any street, city owned parking
lot or other public property except those as are specifically designated by the Council by
resolution and signposted.
(B) It is unlawful to park a truck (other than a truck of 10,000 pounds gross vehicle
weight or less), truck - trailer, tractor - trailer or truck- tractor within an area zoned as a residential
district except for the purpose of loading or unloading the same, and then only during the time as
is reasonably necessary for that activity.
(C) It is unlawful to park a commercial vehicle of more than 10,000 pounds gross
vehicle weight upon any street in the business district except streets as specifically designated by
the Council by resolution and signposted, but parking of this type of vehicle for a period of not
more than 20 minutes shall be permitted in that space for the purpose of necessary access to
abutting property while actively loading or unloading when access cannot reasonably be secured
from an alley or from an adjacent street where truck parking is not so restricted.
(D) It is unlawful to park a truck or other vehicle using or equipped with a trailer, or
extended body or other extension or projection beyond the original length of the vehicle, or any
• passenger bus, diagonally along any street except for a time sufficient to load or unload, and in
that case, only parallel parking shall be permitted. Provided, however, that a truck may stand
backed up to the curb if the weight or bulk of the load makes parallel parking impracticable, but
then only for a period of time sufficient to load or unload.
(E) Parking of commercial vehicles is permitted in duly designated and signposted
loading zones, and in alleys, for a period of up to 20 minutes, provided that this alley parking
does not prevent the flow of traffic therein, all of which shall be for the purpose of access to
abutting or adjacent property while actively loading or unloading.

At the January 29, 2008, visioning session/workshop, the consensus of the City Council
was to proceed with Policy Governance and enter into a consulting contract with Stacy
Sjogren of Out of the Woods Consulting from Sartell, Minnesota. The cost was
estimated at $15,000 plus reimburseables (i.e. travel). I was able to negotiate a "not to
exceed contract' of $15,000 that does include all costs (i.e. travel). Please see the
contract attached.
I did attend the recent special workshop led by Stacy Sjogren on January 25, 2008, with
Council Member Jim Haugen, Council Member Bill Arndt and Mayor Steve Cook.
• Subsequently, there was an additional session with Council Member Stotts.
I believe Stacy Sjogren will continue to conduct excellent training through
implementation of this project. Policy Governance, itself, should work nicely with our
current efforts in establishing both a "strategic plan" and a business plan (one -two year
objectives) that were discussed at our January 29, 2008, workshop.
The Policy Governance project should also coordinate and mesh well with our 2008
objectives and, specifically, measure any potential future opportunities, such as the
ICMA Baldrige Award model.
Ken Merrill, Finance Director, will be at the City Council meeting in my absence. We
have discussed using the excess bond monies or fund balance monies to pay for this
project. I recommend approval.

Agreement: Policy Governance® Transition

This is an agreement between Stacy Sjogren of Out of the Woods Consulting
( "Sjogren ") and the City Council of Hutchinson, MN ( "Hutchinson "), dated February
15, 2008.
WHEREAS Hutchinson is seeking the assistance of a qualified consultant to assist the
council through its transition into Policy Governance®.
WHEREAS Hutchinson desires to enter into an agreement with Sjogren for such
services, the parties hereby agree to the following:
1. Sjogren will facilitate a "policy blitz" retreat before April 30, 2008 during which key
staff and all council members will be sufficiently trained in the model,
Governance, Executive Limitation, and Board - CEO Delegation policy templates
will be personalized to the city setting, and annual calendar will be crafted. If
time allows, the council will engage in some team building activities and start
Ends Policy development.
Sjogren will work in conjunction with staff to do the necessary legal checks of all
new policies and identify any resulting by -law changes prior to "going live" with
the policies in before May 31, 2008.
Sjogren will be provide coaching assistance to the chair and city manager as
they assume their roles as defined by Policy Governance&
4. Sjogren will assist the council as a whole during the transition by attending various
council meetings then facilitating follow -up debriefing sessions that foster the
transition to Policy Governance®, and assisting the council as it establishes and
implements its initial ownership linkage strategic plan.
5. Roughly 8 -11 months after policies are established, Sjogren will facilitate a 5 -6
hour retreat to finalize Ends Policies (organizational results) based on the input
and data the board has gathered from owners and experts over the past
number of months.
6. Sjogren shall be paid a flat rate of $15,000. Payments will be spread out through
the 12 month length of engagement. Monthly invoices of $1,250 will be
electronically submitted to the city manager starting at the end of March.

• 7. Sjogren shall be responsible for providing her own office, fax, telephone, and
computer equipment needs. Hutchinson will provide administrative assistance at
retreats and as necessary throughout the year to maintain newly developed
documents. Hutchinson will provide supplies and photocopying services for the
board's training needs and policy binders.
8. Any additional training (e.g. new council member or prospective council
member training) will be considered additional expenses and will be billed
separately.
Neither party shall have the authority to bind the other party to any agreement
with any other party for services without the prior agreement by either party.
10. Sjogren agrees to indemnify and hold harmless Hutchinson for any damages or
liabilities, including legal fees, suffered by Hutchinson as a result of actions by
Sjogren, unless such acts were carried out in accordance with instructions
received from Hutchinson. Hutchinson agrees to indemnify and hold harmless
Sjogren for any damages or liabilities, including legal fees, suffered by Sjogren as
a result of acts of Hutchinson, its employees, officers, or agents that pertain to the
work of this specific project.
11. All information and documentation related to Hutchinson's Policy Governance®
transition is considered the property of Hutchinson and shall not be released to
• any third party without prior approval by Hutchinson.
12. This agreement shall remain in effect until modified in writing by both parties or
terminated by either party. Either party may terminate this agreement for any
reason after giving 15 days written notice to the other party. In the event of
termination by Hutchinson, Hutchinson shall pay Sjogren for all prorated fees and
expenses incurred through the date of termination.

RESOLUTION IN SUPPORT OF A LOCALLY -OWNED WIND POWER
GENERATION FACILITY
WHEREAS, the City of Hutchinson has identified renewable energy and use of
non - fossil fuels as a goal to which the City should aspire; and,
WHEREAS, the State of Minnesota has enacted legislation known as the
Renewable Energy Standard which would require 25% of all energy from electric utility
providers to come from renewable sources by the year 2025; and,
WHEREAS, the use and development of renewable energy would have a positive
impact on stemming the effort of global climate change and would also stimulate the
economy of rural Minnesota; and,
WHEREAS, wind energy represents an efficient, clean, and plentiful potential
source of renewable energy,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUTCHINSON, MINNESOTA:
• THAT, in consideration of the foregoing, the Hutchinson Utilities Commission is
encouraged to investigate the feasibility of owning a local community-based wind power
generation facility either owned by Hutchinson Utilities Commission or in partnership with
other area utilities, the City and/or private entities that would help meet the renewable
energy goals as set out by the State of Minnesota and the City of Hutchinson by
developing wind energy.
