Mayor Protem BIll Arndt called the meeting to order. Members present were Jim Haugen and Casey Stotts.
Members absent were Mayor Steve Cook and Kay Peterson. Others present were Gary Plotz, City
Administrator, Jody Winters, Acting City Attorney.

Mayor Protem Arndt congratulated Gary Plotz, City Administrator, on his 30 years of service to the City of

Elaine Black commented on Gary Plotz's years of service to the City of Hutchinson and congratulated Gary
on all of his years of dedication.

Tom Kloss, Information Technology Director, presented before the Council. Mr. Kloss provided a report on
the 2006 accomplishments of the department, mcluding those related to the network and GIS.

(a) CONSIDERATION FOR APPROVAL OF FRANCHISE AGREEMENT WITH AQUARIA PETS FOR
BICYCLE RACK IN THE PUBLIC RIGHT-OF- WAY

Rebecca Bowers, Planning Director, presented before the Council. Ms. Bowers explained that at the last

Council meeting this item was up for consideration, however the Council tabled the item to research other
bike rack designs. Miles Seppelt, EDA Director, presented before the Council. Mr. Seppelt explained that
the Hutchinson Downtown Association had been dealing with the issue of bicycle racks on Mam Street. A
, prototype design has been found that takes less space on the right-of-way, yet keeps the bicycles protected.
This prototype will be tested in front of Outdoor Motion this summer and If it works well, an identical one
will be placed in front of Aquaria Pets. These racks will then be City bicycle racks and franchise agreements
will no longer be necessary. '
Motion by Haugen, second by Stotts, to approve franchise agreement with Aquaria Pets for bicycle rack in
the public right-of-way. Motion carried unanimously.
10. NEW BUSINESS
(a) CONSIDERATION FOR APPROVAL OF REQUESTS BY HUTCHINSON JAYCEE WATER
CARNIVAL COMMITTEE
Scott Ziegler, Jaycee Water Carnival Commodore, presented before the Council. Mr. Ziegler stated that the
Water Carnival Committee is requesting to move the Midway Carnival to the downtown area. The main
reason is due to the fact that many carnivals that have been servin,r the Jaycees have not seen a lot of
business at the fairgrounds. The proposal is to move the Midway to I A venue between Library Square and
101 Park Place. This location has been reviewed with the Hutchinson Police Department and tenants of 101
Park Place and the comments were mostly favorable for this location. The Water Carnival Committee is also
proposing to move the Teddy Bear Band performance, Kiddie Day Parade, and Junior Royalty Coronation to
Library Square.
Motion by Stotts, second by Haugen, to approve requests by Hutchinson Jaycee Water Carnival committee.
Motion carried unanimously.
(b) CONSIDERATION FOR APPROVAL OF ORDINANCE AMENDMENT SPECIFYING ACCESSORY

WITH FAVORABLE PLANNING COMMISSION RECOMMENDATION (WAIVE FIRST READING
AND SET SECOND READING AND ADOPTION OF ORDINANCE NO. 07-0459 FOR MARCH 13,
2007)
Rebecca Bowers, Planning Director, presented before the Council. Ms. Bowers explained that staffhas been
assessing access drives on double frontage lots (or through lots) for several months. Concerns over
appearance and secondary access have been raised regarding detached garages in the rear yards of double
frontage lots. Double frontage lots are those properties with streets on both the front and rear yards. The
proposed ordinance addresses concerns raised regarding access and appearance and does not allow direct
access to the public right of way through the rear or side yard of double-frontage lots located on any
collectors or arterial roadways, except for properties platted prior to 1988.
Motion by Stotts, second by Haugen, to waive first reading and set second reading and adoption of
Ordinance No. 07-0459 for March 13, 2007. Motion carried unanimously.
(c) CONSIDERATION FOR APPROVAL OF PERSONNEL POLICY UPDATES
Brenda Ewing, Human Resources Director, I?resented before the Council. Ms. Ewing presented three
resolutions for consideration which would revIse the City of Hutchinson Employee Handbook, the Sexual
Harassment Prevention Policy and the Respectful Workplace Policy. The amended Personnel Policy
specifically includes the paid-per-call firefighters unless specifically excluded in the various sections of the
policy.
Motion by Haugen, second by Stotts, to approve personnel policy updates. Motion carried unanimously.
(d) CONSIDERATION FOR APPROVAL BUDGETING FOR OUTCOME RESULT STATEMENTS

DolfMoon, PRCE Director, presented before the Council. Mr. Moon reviewed the result statements that
were developed from the Budgeting for Outcomes process. These statements were created based on
feedback generated by City focus groups. These statements will guide the next phases of this process. These

statements relate to City Government, Public Safety, Environment, Strong Economy, Mobility, Healthy
Citizens and Education.
. Council Member Stotts commented that th~re was much citizen involvement with the creation of these
statements that were created through the focus groups.

Motion by Stotts, second by Haugen, to approve budgeting for outcome result statements. Motion carried
unanimously.
(e) CONSIDERATION FOR APPROVAL OF RESOLUTION OPPOSING WINE-IN-GROCERY BILL
Gary Plotz, City Administrator, noted that for several years, a bill has been proposed to the legislature to
allow for the sale of wine in grocery stores. The Municipal Beverage Association, as well as the
municipally-owned li9uor store, opposes this bill for reasons outlined in the resolution. This resolution will
be forwarded to the City'S local legislators
Motion by Haugen, second by Stotts, to approve Resolution No. 13145 opposing wine-in-grocery bill.
Motion carried unanimously.
(f) CONSIDERATION FOR APPROVAL OF RESOLUTION NO. 13144 - A RESOLUTION OF SUPPORT
CONCERNING EFFORT TO SECURE STATE BONDING TO FURTHER DEVELOP THE LUCE LINE
TRAIL
Gary Plotz, City Administrator, noted that in past years the Council has taken favorable action to support this
bill as written by the City's state senator, Steve Dille. It is being requested again.
Motion by Stotts, second by Haugen, to approve Resolution No. 13144 in SU(lport concerning effort to secure
state bonding to further develop the Luce Line Trail. Motion carried unarnrnously.
(g) CONSIDERATION FOR APPROVAL OF RESOLUTION NO. 13143 - A RESOLUTION IN SUPPORT
OF THE 2007 FREEDOM TO BREATHE ACT

Gary Plotz, City Administrator, noted that there are several bills currently in the legislature that are being
proposed that will not allow smoking in the work place.
Motion by Haugen, second by Stotts, to approve Resolution No. 13143 in support of the 2007 Freedom to
Breathe Act. Motion carried unanimously.
(h) DISCUSSION OF COUNCIL REPRESENTATION ON THE RESOURCE ALLOCATION COMMITTEE
John Olson, Public Works Manager, presented before the Council. Mr. Olson explained that the Resource
Allocation Committee thoroughly reviews project scopes/timeframes and the funding alternatives to
complete projects. Historically, the committee has included the City Administrator, Finance Director, PZB
Director, PRCE Director, public works representatives and two Council Members. Mayor Cook has shown
interest in servin& on this committee. Council Member Arndt volunteered to serve on the Resource
Allocation Comrruttee.
11. MISCELLANEOUS

(a) Request expenditure of$150,000 to remodel the inpatient Mental Health Unit at Hutchinson Area
Health Care

Motion by Haugen, second by Stotts, to approve expending $150,000 to remodel the inpatient
Mental Health Unit as requested by Hutchinson Area Health Care. Motion carried unanimously.
(b) Request to appoint Mike Cannon to the HAHC Board, to replace Steve Snapp who has resigned.

Motion by Haugen, second by Stotts, to approve appointing Mike Cannon to the HAHC Board,
replacing Steve Snapp. Motion carried unanimously.
John Olson - John Olson requested moving the Council Workshop time on March 13, 2007, from 4:00 p.m.
to 3:30 p.m. in order to allow time to discuss both the Crow River Dam project and the SW Ring Road
project.
Motion by Haugen, second Stotts, to move the workshop to 3 :30 p.m. on March 13, 2007. Motion carried
unanimously.
John Olson also noted that a Hwy 15 Coalition meeting is being held at 10:00 a.m. at the Event Center on
March I, 2007.
Motion by Haugen, second by Stotts, to approve setting the Hwy 15 Coalition meeting as a public meeting.
Motion carried unanimously.
Casey Stotts - Council Member Stotts noted that the City has excess funds left in the general fund, and he
wants the public to be made aware that before that money is allocated to anything, he wishes to receive
public input on the use of them.
Ken Menill- Mr. Menill updated the Council/public on the implementation of the new water/sewer/refuse
rates for 2007. Mr. Menill explained how the sewer rates are calculated. Mr. Merrill reviewed some ofthe
services the City provides to residents when it comes to water issues, such as leaks in a toilet or water
softener. Mr. Menill also noted that water meter reading dates were adjusted somewhat with this last billing
cycle.

. The FD responded to a call in the northwest part of the city Where a citizen was buming papers In a
discarded fiberglass bathtub. Minimal damage was done to the deck of the home, and the citizen
was advised that open bumlng was prohibited.
. The FD responded to a senior residence building In the southwest part of the city where a resident
had dumped the ashtray into a plastic garbage can and startE1Cl a fire. The apartment sustained
minor smoke damage.
. The FD responded to a two vehicle crash in the southeast part of the fire district where firefighters
extricated one person from a vehicle.
. The FD responded to a motor vehicle accident Where the driver snapped off a power pole dangling
the wires.
. The FD responded to City Center when a damper motor burned out setting off the smoke
detectors. City Center sustained minor smoke damage.

President Julie Jensen caned the meeting to order. Ann Vance moved to approve the minutes from
the Nov. 27. 2006 meeting. with John Hassinger seconding. Approved.
Reports:
Mary read Jack Sandberg's report on the Pioneerland Library System (PLS) 80ard meeting on Jan. 22
2007. Paul Setzepfandt was elected the Executive Board chair. Cell phone and collection
development policies were approved along with others. Extra money from Mardag grant may be
used to fund 2 more years of Rosetta Stone. if approved. PLS di5lnbuted Interest income to local
libraries with Hutchinson receiving $5,000 for 2006. It looks like 1here may be greater chance of a bnt in
the Minnesota legislature for increased funding for libraries. The Pioneenand/Plum Creek/SAMMIE final
report from consultants was a olSappointment In some ways. Steenng committee of which Jack is a
member is meeting today to decide how to proceed.
State Aid Support resolution was reviewed by the Board and has been signed by cily and counly
officials to increase library funding.

1. Capital improvements for 2006

B. Historic pictures in meeting room-Bin Corby completed the pictures and the Friends
of the Library hung them.

Suggestions were made about how to publicize this new resource available at the Ubrary.
3. New Board members-The City of Hutchinson wnt put an article in the newspaper
to advertise openings for cily board posltlons. Mary spoke with 3 people who were not
chosen last year and they'll get back to her.
4. Town Boll authors' visit on Dec. 9-A video and a display of parts of the
book pertaining to Hutchinson were shown to about 25 people who attended.
5. Holiday gifts to staff-Staff received between $5-$40 doDcn depending upon hours
worked each week.

2. Library Legislative Day will be March 28 at the State Capitol. Last year, no one from
Hutchinson attended because counly commissioners and regional system directors had
organized a meeting with legislators and space was limited. Mary asked that any Board
members interested attend this year with her.

Parks, Recreation & Community Education Advisory Board
February 5, 2007
Members present were: Bill Arndt, Keith Kamrath, Mike Retterath, Mike Cannon and Kirk
Kosel. Also present were DolfMoon, John McRaith, Lawrence Winter, Sara Witte and Karen
McKay.
The meeting was called to order at 5: 19 pm.
A motion was made by Bill Arndt and seconded by Mike Cannon to approve the minutes dated
December 4, 2006. The board unanimously agreed.
OLD BUSINESS
2007 Park & Recreation Budget - The budget was approved by the City Council and there were
no adjustments made.
NEW BUSINESS
John McRaith, Recreation Services Coordinator highlighted the accomplishments of 2006 in the
Recreation Division.
A tournament director position was added to reduce the amount of time John spends working
weekend tournaments. Two well-qualified people share the position.
John took over the position of League Director for the Girls Softball Association. It involves
approximately 70 teams from the region of St. Cloud, Hutchinson and the metro area. One
goal is to reduce the amount of travel time for the players.
The girls youth softball program was moved to the evening and the number of participants
grew. An additional field was added to the program. The field is located on the St.
Anastasia Church/School property.
John began coordinating the elementary basketball program to make it more enjoyable and
less expensive for young players. The program has already seen an increase of 50 players.
The city will net $5,000 for the administration of the youth basketball program.
Registration activity on the PRCE web site increased in the past year, as residents get more
familiar with it.
A part-time temporary employee will be hired to coordinate the softball umpires for weekend
tournaments.
John asked the Board "At what age and how far should youth participants travel to compete in
sports." Once fundamentals are taught, the Board felt participants could have more fun and
variety with some traveling. Most thought that less than one hour was appropriate for travel
times.
Lawrence Winter, Parks Supervisor summarized how the park staff time is divided between park
maintenance, mowing, snow removal and ice rink preparation.
. Some of the activities that the parks are used for include: Bird watching, church services,
family gatherings and weddings.

. Parks staff developed brochures outlining the parks in 2006.
. Staff spent more time landscaping in 2006 and will see an increase in 2007 as the highway
project is completed.
. A mowing comparison was presented showing the addition of the school property in '99. A
more efficient method of mowing was implemented by using larger equipment. In addition,
to time saving measures were added, with pavers under park benches as an example.
Goals for the parks division in 2007 include playground equipment installation in Drift Riders
and Rolling Meadows park areas. Oversight and maintenance oflandscaping along the Highway
7 and 15 renovation project including the museum area.
BOARD MEMBER ITEMS
The next PRCE Advisory Board meeting will be March 5th with the location yet to be
determined. September Jacobsen, Event Center Coordinator, Sharon Armstrong, Community
Education Programmer and Marv Haugen, Facilities & Operations Manager will be presenting
their year-end reports.

This memorandum will serve as a request to purchase a Ma5 stacking conveyor.
In the past Creekside has been renting a conveyor. The cost for renting was
$15.00 per hour at 160 hours per month equaling $2400,00 per month rent rental
per year was 4 months equaling $9,600.00. Creekside has obtained two quotes
from Holtmeier construction and Midwest leasing, the two quotes are attached.
Creekside has $35,000.00 in the 2007 operating budget for such a purchase.
The two quotes represent the same model conveyor. The life expectancy of the
conveyor is 15yrs.
I would recommend the purchase of the Ma5 conveyor from Holtmeier
construction for $30,000.00.

RESOLUTION SUPPORTING NEW STATE PARK ON GREENLEAF LAKE IN
ELLSWORTH TOWNSillP, MEEKER COUNTY
WHEREAS, a group of citizens is interested in establishing a State Park in the
Hutchinson-Litchfield area; and
WHEREAS, the area surrounding Greenleaf and Sioux Lakes in Meeker County
has been identified as a possible site for a State Park; and
WHEREAS, a group of landowners near Greenleaf and Sioux Lakes have agreed
to have their lands be included in the proposal for a State Park; and
WHEREAS, a State Park will help preserve the scenic quality, natural resource
values and cultural history of the Greenleaf area; and
WHEREAS, a State Park will provide recreation and outdoor education
opportunities for the citizens of Hutchinson, as well as being an attraction for people to
visit the area; and
WHEREAS, the Department of Natural Resources, Division of Parks and
Recreation, works with citizen groups and seeks input from local units of government
concerning the potential for new State Parks; and
WHEREAS, an act of the Minnesota State Legislature is required to establish a
State Park;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUTCHINSON, MINNESOTA:
THAT, the Hutchinson City Council supports the establishment of a state park on

SUBJECT: FRANCHISE AGREEMENT WITH AQUARIA PETS FOR A BICYCLE RACK IN
THE PUBLIC RIGHT OF WAY AT 30 MAIN STREET S.
Backqround:
At the February 13th Council meeting, the Council tabled renewal of the franchise agreement
for a bike rack in front of Aquaria Pets in order to obtain information on an alternative bike rack
designs.
EDA staff has been working with the Downtown Association to improve the bike racks
downtown. Attached is additional information on this project and photos of the bike rack
chosen by the association. If the trial bike rack works well, the Downtown Association would
purchase a second rack to replace the existing bike rack in front of Aquaria Pets. This would
be a public bike rack, owned by the City, which would eliminate the need for franchise
agreements for downtown bike racks.
Franchise Aqreement:
Steve Barton, owner of Aquaria Pets, is requesting to renew his franchise agreement with the
City to place a bicycle rack on the sidewalk in front of this pet store. He has paid $25.00
toward a new franchise and provided an updated Certificate of Liability insurance. The current
franchise expires April 11, 2007. In the past, the renewals have been made for a longer period
of time, typically 5 years, with a yearly fee. However, staff recommends allowing the
agreement for one year to allow evaluation of the Downtown Association's trial bike rack.
John Olson, public works superintendent, has requested the agreement state that the bicycle
rack must be removed from December 1 - March 31, each year due to difficulty for the city
crews to remove snow from the downtown sidewalks with the racks outside.
Staff will be available at the meeting to provide additional background information if needed.
Recommendation: Staff is recommending that the Council approve the attached ordinance to
renew the franchise for 1 year with a $25.00 fee with the existing bike rack at Aquaria Pets.
This would allow time to evaluate the suitability using of the new bike rack.

The Hutchinson Downtown Association
has noted that the bike racks currently
seen downtown could be improved.
The existing racks take up a lot of
sidewalk space. present a potential
safety hazard and do not blend in at all
with the downtown streetscape.
To address the situation, the Downtown
Association has worked with local
bicycle enthusiasts to design a bike rack
that is safer, takes up less space on the
sidewalk, keeps the bikes aligned
parallel to the front of the building. and
blends in with the existing streetscape.

A local manufacturer has produced a
prototype, which will be tested this
summer on the sidewalk in front of
"Outdoor Motion." If the new bike rack
works well, the Downtown Association
will purchase a second rack to replace
the one in front of "Aquaria Pets."
These bike racks will be owned by the
city and emplaced each summer at the
same time downtown benches and
planters are put out.
This will eliminate the need to provide
franchises for the placement of bike
racks downtown.

RIGHT TO PLACE TWO BICYCLE RACKS OVER AND ABOVE CERTAIN PROPERTY LOCATED ON
PUBLIC PROPERTY LOOATED AT 30 MAIN STREET SOUTH
THE CITY OF HUTCHINSON ORDAINS:
Section I. The City of Hutchinson, in the County of McLeod, State of Minnesota, hereafter referred to as
Grantor, hereby grants to Aquaria Pets, hereafter referred to as Grantee, a franchise to place and maintain two
bicycle racks at 30 Main Street South, on certain property owned by the City of Hutchinson.
Section 3. Grantor reserves right to concerning construction, operation
and maintenance of facilities located along, over and under the public premises before mentioned and the placement
of such facilities.
Section 4. Grantee shall indemnify and defend Grantor, its boards, conmrissions, officers, agents and
employees, in any and all other public agencies, and their members, officers, agents and employees, against any and
all liabilities for injury to or death of any person or any damage to any property caused by Grantee, its officers,
agents or employees in the construction, operation or maintenance of its property, or arising out of the exercise of
any right or privilege under the franchise.
Section 5. At all times during the term of the franchise, Grantee will, at its own expense, maintain in force
general comprehensive liability insurance, with an insurance company approved by the City of Hutchinson, with
limits approved by the policies being for the protection of Grantor and its officers, agents and employees, against
liability for loss or damage for bodily injury, death or property damage occasioned by the activities of the Grantee
under the franchise.
Section 6. Grantee shall not have the right to assign the franchise otherwise transfer it in any manner
whatsoever or sell, lease, license, mortgage, or permit others to use transfer in any manner whatsoever any interest
in all or any part of its facilities that are installed or operated under this grant, except on prior written approval by
ordinance of the City Council of the City of Hutchinson.
Section 7. In the event Aquaria Pets should cease to exist or should fail to use the franchise for one
calendar year, this franchise shall be deemed null and void and shall revert to the City of Hutchinson without any
action on the part of the City of Hutchinson whatsoever.
Section 8. There must be no less than a 36 inch wide open space on the sidewalk for pedestrian movement.
Section 9. The bicycle rack must be constructed ofa rust free material.
Section 10. The bicycle rack must be removed from December 1 - March 31 each year.
Section II. This ordinance shall take effect from and after passage and publication, subject to the provision
above requiring written acceptance by Aquaria Pets.

* 154.004 DEFINITIONS.
LOT FRONT. The portion of a lot abulling a public street. If a lot abuts two public streets, the LOT FRONT is
the narrower of the two lot edges. On double fronta!!e lots with eauallot ed!!es. the lot front shall be the lot
ed!!e at the front of the house.
YARD, REAR. A yard extending across the entire rear of a lot and measured between the rear lot line and the
rear of the building, or any projection thereof other than steps. balconies, paved terraces, porches or bay
windows. On corner lots, the REAR shall be considered as parallel to the street upon which the lot has its least
dimension. On double fronta!!e lots with eauallot ed!!es. the rear vard shall be the lot ed!!e at the rear of the
house which is oDDOsite the lot front.
* 154.026 ACCESSORY BUILDINGS.
(A) No accessory buildings shall be erected or located within any required side yard setback,
except as provided in H 154,056 and 154.057 of this code, for R-1 and R-2 districts.
(B) Utility buildings in residential districts shall not exceed 12 feet by 16 feet and shall be six feet
or more from all lot lines of adjoining lots, and shall not be located within a utility easement.
(C) No accessory building or garage per single-family homes shall occupy more than 25% of a
rear yard, nor exceed 1,000 square feet of floor area. Garages which exceed the aforementioned maximum may
be allowed with a conditional use permit.
(D) No permit shall be issuedfor the construction of more than one accessory detached private
garage stru<:ture for each dwelling.
(E) No accessory building or use shall be constructed or developed on a lot prior to the time of
construction of the principal building to which it is accessory, except by conditional use permit.
(F) Accessory buildings in all districts shall be located to the rear of the principal building.
(G) No accessory building in a commercial or industry district shall exceed the height of the
principal building except by conditional use permit.
(H) Utility sheds in residential districts which have floor areas greater than ten feet by 12 feet
shall have a floating concrete slab. Only one utility shed per home is permitted.
(I) Pole buildings shall be permitted only if siding and roofing in building materials are similar
to the principal structure. Pole buildings are allowed only by conditional use permit.

Plannina Commission Meetlnas:
The Planning Commission opened the public hearing on the ordinance amendment (outlined
above) at the December 19. 2006, meeting. Consideration was tabled until the January meeting
to allow full attendance. Staff received one phone call from a resident in support of the
ordinance to not allow detached garages in the rear yard. After much discussion on the
proposed ordinance at the January meeting, the ordinance was tabled until the February
meeting. At the, January meeting, the Commission directed staff to rewrite the ordinance to
allow detached garages with a recommended rear yard setback of 25' and to restrict secondary
access to certain roads by classification and/or restrict access by the time period platted.
Staff presented several options to the Commission at the February meeting (refer to attached
February staff report). After additional discussion on which roads should be protected from
secondary access and questions on impact to existing non-conforming garages in older parts of
town, the Commission recommended changing the ordinance to the following:

History:
At the December and January Planning Commission meetings, a public hearing was held and
continued on a proposed ordinance amendment to restrict detached garages in the rear yard of
double frontage lots. Background material and the first version of the ordinance are included in
the attached report from the December meeting. The amendment was tabled at the January meeting
with direction to staff to revise the proposed ordinance to continue to allow detached garages in the
rear yard, however to restrict secondary access and specify a larger setback.
Zoning Ordinance Amendment:
StafIhas revised the ordinance to provide two alternatives, based upon the direction of the
Commission. Both alternatives would allow detached garages to be constructed in the rear yard of
double frontage lots, however the two alternatives vary in secondary access restrictions.
In version IT, secondary access is prohibited and in version III, secondary access is regulated by
street function. Both include the same clarifications to the definitions previously proposed and the
recommended 25-foot setback. Please refer to attached ordinances for full text..

and submitted proj ect documents to Mn!DOT and other agencies for final approval. City staff anticipates this
approval occurring within the next couple of weeks. At this point, City stafffeels that it would be beneficia] to
approve the plans/specifications and advertisement for bids, so the project can be advertised and ultimately let
as soon as possible. This will allow the City to hopefully benefit from 1H 7/15/22 project coordination and
construction cost standpoints. Current project cost estimates closely match previous estimates at approximately
$],450,000.00 (p]ease see the attached Engineer's Report for additional estimated cost and funding info).
Final resolutions will be provided at the City Council meeting.
The bid opening date for this project is anticipate to occur in late mid to late May. This will allow for the
awarding of the project to occur in early June, which would fit the anticipated 1H 7/15/22 construction
schedule.
