ECONOMIC DEVELOPMENT AUTHORITY YEAR END REPORT Miles Seppelt, EDA Director, presented before the Council. Mr. Seppelt provided a year end report for the Economic Development Authority. Mr. Seppelt reviewed the EDA's strategies which includes business retention & expansion, business incubation, business attraction, downtown redevelopment, talent development, childcare business development, and housing development. Mr. Seppelt also spoke about grant writing that is completed every year and brought in over $200,000 in 2024. Lastly, Mr. Seppelt reviewed challenges facing the EDA. Council Member Burley asked Mr. Seppelt if there are grants available to make businesses, especially in the downtown area, more ADA accessible. Mr. Seppelt noted that is something he will pursue. UNFINISHED BUSINESS NEW BUSINESS 10. APPROVE/DENY ELK RIDGE ESTATES SUBDIVISION AGREEMENT Dan Jochum, Planning/Zoning Director, presented before the Council. Mr. Jochum noted that a revised subdivision agreement has been distributed this evening. The revised agreement includes the public infrastructure construction cost. This cost was not included at the time the Council packet was published. Motion by Czmowski, second by Sebesta, to approve Elk Ridge Estates Subdivision Agreement. Motion carried unanimously. 11. APPROVE/DENY FIRST READING OF ORDINANCE NO. 25-855 — AN ORDINANCE AMENDING SECTION 154.067 OF THE HUTCHINSON CITY CODE REGARDING THE I-1 ZONING DISTRICT Dan Jochum, Planning/Zoning Director, presented before the Council. Mr. Jochum explained that CITY COUNCIL MINUTES — April 22, 2025 the City has been getting inquiries from data center companies about locating in the Industrial Park. There is a company currently working with Hutchinson Utilities Commission to locate on an open lot owned by a private party within the I-1 Light Industrial area. Data centers are not currently permitted in any zoning districts in Hutchinson. It is being recommended to allow these types of companies in the I-1 district with a conditional use permit. Staff is recommending that these data centers not be allowed as a permitted use due to the varying size and scale of these uses. Instead, staff feels it would be best to look at these uses on a case by case basis via a conditional use permit. Motion by Burley, second by Forcier, to approve first reading of Ordinance No. 25-855. Roll call vote was taken: Burley — aye; Sebesta — aye; May — nay; Czmowski — aye; Forcier — aye. STAFF UPDATES Mike Stifter — Mr. Stifter reminded viewers that the Hassan Street improvement project begins on Monday April 28, 2025. In addition, there is some incorrect signage on Stoney Point Road for that project. The project will begin on or about June 9, 2025. Matt Jaunich — Mr. Jaunich noted that a public hearing is scheduled for May 13, 2025, at 6:00 p.m. on the proposed chicken ordinance. The proposed ordinance is posted on the City's web site and is available at City Center. Feedback may be given at the public hearing or can be given directly to council members or Mr. Jaunich. He also noted that he is working on scheduling a joint meeting between the City Council, EDA and HUC. 15. COUNCIL/MAYOR UPDATE Mayor Forcier — Mayor Forcier asked that the police department's speed trailer be placed on Denver Avenue. Council Member Burley also suggested placing it on Sherwood Street near Elks Park. Chief Gifferson noted that the department will also conduct traffic service requests if a citizen makes such a request in their neighborhood. .19 CITY COUNCIL MINUTES - April 22, 2025 Tim Burley — Council Member Burley reminded viewers to remember veterans and those suffering with mental health issues. Dave Sebesta — Council Member Sebesta noted that the organization Parents Inspired is moving to the former Flank restaurant location on Main Street. He also noted that Trailblazer Transit is in need of drivers as they are short staffed. Pat May — Council Member May noted that the sculpture stroll pieces will be replaced over the next few weeks. We have enjoyed working with City staff and the community to develop the updated downtown plan and are excited to assist with advancing the Festival Street concept and further implementing the downtown wayfinding and signage for key gateways and downtown public parking lots. Based on our meeting on 3/13 and the subsequent walking tour with yourself and Miles, we understand the desire of the city to find an approach for identifying public parking lots to the east and west of Main Street. Additionally, we will explore opportunities for gateway signage for Downtown Hutchinson at the Highway 7 & 15 intersection and at the south end of downtown near 5th Street. For the Festival Street block along 1st Avenue SE, we understand that the roadway will be repaved this summer. This section of street will maintain the same curb alignments, but will have some pedestrian crossing upgrades at Hassan Street and two new lighting fixtures. The desire for this exploration is to find alternatives for the festival street that maintain the current street configuration, but also explore bigger ideas for future implementation over the next 10-15 years. The following outlines our approach and key tasks to take these two projects to the next level of design and allow for an iterative design process with City staff. Festival Street Concept Development HKGi will create a detailed analysis of the existing conditions and how this section of street functions for day-to-day operations and for event programming. Grantor, for good and valuable consideration as acknowledged herein, does convey and deed to the Drainage Authority for McLeod County Ditch 18 ("CD 18")(Grantee), for the benefit of said drainage system, an easement over that portion of the Burdened Parcel described as follows: An easement for access and occupation related to inspection and maintenance of CD 18 and for other lawful purposes under statutes chapter 103E over and across that part of the Burdened Parcel, as described and depicted in Exhibit "B". The basis of need for the easement is as follows: Grantor seeks to accommodate the drainage authority's desire to realign a portion of CD 18 in order to avoid root intrusion and reduce maintenance costs on the system. Grantor's acknowledgment is conditioned on the abandonment in place of the current alignment of CD 18 on the Burdened Parcel, without removal of the existing CD 18 the or other disturbance of the Burdened Parcel. The Easement shall be assignable, in whole or in part, to any unit of government for any purpose related to the maintenance, repair, improvement, or operation of CD 18. Further, along with the permanent easement conveyed herein, Grantor conveys a permanent right of entry over the Burdened Parcel, to be executed reasonably, for the purpose of allowing the Drainage Authority for CD 18, or its agents, to access CD 18 for the purpose of statutorily required maintenance and inspection of CD 18. At the conclusion of the public hearing, the City Council will be asked to consider a first reading of Ordinance 25-854. The public hearing notice has been published in our local newspapers and our website (with a copy of the ordinance) and has been scheduled for 6 p.m. on Tuesday. Following the conclusion of the public hearing, if the council is comfortable with the ordinance, a first reading of such ordinance should be considered. If approved, a second reading with adoption will take place at our May 27 meeting. Subdivision 1. Definitions At Large. A chicken out of its run, off the premises or not under the custody and control of the owner. Chicken. A female chicken or hen. Coop. A cage or pen for confining chickens Rooster. A male chicken Run. An area inside a fence where chickens are kept and allowed to walk around Subdivision 2. License Required A. It is unlawful for any person to keep or harbor chickens in the city limits of Hutchinson without first having obtained an annual license therefore from the City. B. An application for a renewal license shall be filed prior to the expiration of the current license. C. The fee for a license will be established yearly by the City Council. D. Licenses ill be valid for a one-year time period and will be issued on a calendar year basis. Subdivision 3. Licensing Requirements. A. Annual licenses will be granted for owner -occupied properties that are single-family or two-family properties, or on any property used as a public, private or charter school only. Rental properties that meet these definitions are also eligible for licenses if written consent by the owner is provided to the city B. There is a maximum of six chickens allowed per parcel, none of which will be roosters or crowing birds. Property used as a public, private or charter school are allowed up to twelve chickens for educational purposes. C. Licensees shall provide chickens with sufficient food and water. D. Licensees shall permit city personnel on the licensed premises to ensure compliance with this ordinance. E. Licensees must go through a public education course on the keeping of chickens as established by the City. Subdivision 4. Licensing Procedures. Initial and subsequent licenses to harbor chickens within city limits may be granted by the City. Before any license is to be considered by the City, an application for a license shall be submitted to the City that contains, among other things, the following: A. A diagram or picture of the coop and its location. B. A detailed plan of how the applicant will comply with requirements of this ordinance. C. The license fee as required by the city. D. Provide certificate of completion of public education course as established by the City. An annual fee for the keeping of chickens in the city shall be established by the City Council and shall be contained in the annual city fee schedule as adopted by the Council. The Council may also establish inspection, and reinspection fees in connection with the enforcement of the provisions of this ordinance. Subdivision 5. General Requirements A. Chickens shall be kept in sanitary conditions such that odors are not detectable outside of the confines of the property lines of the licensed premises. Timely removal of feces, urine and food scraps is required. B. Dead chickens shall be disposed of properly within 24 hours. C. Waste from chicken coops or runs shall not be placed in city compost containers or disposed of at the city's compost facility, Creekside Soils. D. Chickens shall not be slaughtered on the premises or elsewhere within the city other than a retail establishment that employs a butcher. E. Chickens shall be kept in a manner that complies with Minnesota statute chapter 343. (Cruelty to animals) F. Chickens shall be confined inside an enclosed coop or run at all times and shall not be allowed to run at large. G. Any unexplained sickness or signs of disease, and/or unusual deaths should be reported to the local veterinarian and/or the Minnesota Board of Animal Health. H. Licenses are non -transferable and do not run with the property. Subdivision 6. Structure Requirements. A. All chickens will be kept in a coop that will sufficiently protect the chickens from the elements and predators and to discourage rodents. The coop shall provide a minimum of four (4) square feet of space with a maximum of ten (10) square feet for each chicken. B. Only one coop is permitted for each property and is subject to the following requirements: a. The coop should be raised from the ground to sufficiently protect it from rodents. b. The coop shall be constructed with a solid roof. 2 c. The coop shall be constructed with at least one window to provide natural light. d. The coop shall be insulated and may contain lights, but shall not be equipped with heat lamps. e. Construction must be done in a workmanlike manner and with durable material. C. Incorporated into the coop area there shall be an enclosed chicken run area of at least 10 square feet for each bird kept on the licensed premises. D. Coops and runs must comply with all City planning and zoning regulations. Subdivision 7. Location. A. No chicken coop and run shall be located in the front or side yard of any home and shall not be closer than 10 feet from any property line. B. Coops and runs shall be no closer than 25 feet to any neighboring residence. Subdivision 8. License Revocation. A license granted under this chapter may be revoked for violating the provisions of this chapter or for being convicted of any nuisance offense under e Hutchinson city code or Minnesota state law. A violation will include a warning of license revocation A second violation within a twelve-month period will result in a revocation of license Subdivision 9. Hearing Upon service of a notice of license revocation by the City Administrator or his/her designee, a license holder under this chapter may request a hearing before the City Administrator or his/her designee. Request for a hearing by a license holder shall be made within 7 days of service of the notice of license revocation and the hearing itself shall occur within 10 days of the license holder's hearing request. A license holder whose license is revoked for violations of this chapter or other nuisance ordinances or law shall be required to remove all chickens from the property within 14 days of the upheld revocation and be ineligible to reapply for a license under this chapter for a period of two years from the date of revocation. Subdivision 10. Criminal penalty Violations of this chapter constitute a misdemeanor crime. Subdivision 11. Miscellaneous A. Properties with coops unused for at least 180 days shall be removed by the property owner immediately upon the request of the city. B. Dogs and cats that kill or injure chickens shall not be deemed as "dangerous" or "potentially dangerous" under the Hutchinson City Code or state law. 3 C. It is not the expectation of the Police or any other City department to capture chickens running at large. D. No license under this ordinance will be issued to properties where nuisance conditions exist. Subdivision 12. Effective Date. This ordinance shall become effective three months after its final passage and publication. What do you see for the housing market for Hutchinson in 2025? We believe the 2025 housing market in Hutchinson will resemble the 2024 market. We're predicting similar units sold (which was a 30-year low), while pricing remains flat. 2. What are the most influential factors affecting housing in Hutchinson? Interest rates are the main contributor to the market slow down. Home prices increased at a record pace, which was supported by historically low interest rates for over a decade. With rates twice doubling in just 3 years, affordability is the major issue for most buyers. Also, existing homeowners with rates locked in the 3-4% range are not as interested in moving and losing that rate. 3. What do you think will happen to new housing construction in 2025? We also feel that new construction starts will be similar to 2024 numbers. Affordability and the inflation of new construction prices makes any significant growth a challenge. A modest new construction home with 4Bd & 213a would cost 30-40% more than the average home in Hutchinson. The average price/sq ft for existing homes is $150/sq ft, where new construction is about $250/sq ft. Local Mortgage Lender 2025 Housing Market Predictions: 1. What do you see for the Hutchinson housing market in 2025? I think the Hutchinson housing market will move toward a more healthy balance between buyers and sellers. We are already seeing the signs of home that have fewer competitive buyers, homes that remain listed for longer than a few days, and some appearance of price reductions from list price occurring. I think that these factors might slow the pace of price appreciation a little bit ... but I don't expect dramatic things to happen this year. Hutchinson HRA 2024 Annual Report Page 8 of 10 2. What are the most influential factors affecting housing in Hutchinson? Quite a bit of uncertainty remains about the future of interest rates. Rates are affecting buyer's ability to afford the homes at current prices .... and sellers remain reluctant to sell and give up their low rate mortgage for a higher one if they move. 3. What do you think will happen to new housing construction in 2025 New construction will likely continue to be somewhat healthy. Existing home prices are high .... and people can make a choice to buy new construction and have it be relatively competitive. Lower priced homes, though, are not even possible any more with new construction. The combination of price and rate makes new construction a tough hill to climb for most buyers. But for those folks looking for existing homes in the $300+ price category, new construction can become an option for them. When the property was sold to Ian McDonald in 2022, the title company did not contact the city, as is normal procedure, to verify any unpaid utility bills or assessments. Mr. McDonald was not aware of the assessment when he closed on the property and he only learned of it when he petitioned the City to split the lot. Regardless, there was a valid agreement between the City and the prior owner for the deferred assessment and unfortunately the title company neglected to contact the city prior to closing on the property sale. Mr. McDonald would like the city council to consider waiving a portion of the accrued interest. An email is attached with his proposal of a $10,000 payoff to settle the assessment. I've also attached documentation regarding the deferral as approved by city council in 1996. We have discussed this same situation in the past with other property owners looking for relief from deferred assessments and the city council has not waived any principal or interest. To do so would set a precedent for future property owners to seek reductions in deferrals. City staffs position is to deny the request not only for the precedent issue but also due to the title company creating this issue by neglecting to verify unpaid assessments with the City. This occurred following staff's denial of his request to waive a portion of the interest fees on the deferred assessment. Please note that staff does not have the authority to waive such fees. The assessment total as it stands today is $13,371.04. This is a deferred assessment from a project that was done in 1996. The deferral was in place until the land was either developed or sold. In May of 2020, Mr. McDonald purchased the property from the previous owner. The previous owner did not disclose with the purchaser about the deferred assessment that was on the property. At the time of the purchase, there was also not an assessment search done by the buyer or their title company. Mr. McDonald was not aware of the assessment until he attempted to do a lot split with the City in 2022. You will note in the email provided to Council that the current owner is willing to pay $10,000 of the $13,371.04 assessment. This would include all of the principal and a portion of the interest, and he is asking for the Council's consideration in waiving the remaining interest fees on the deferred assessment ($3,371.04). Here are a couple of things to think about in considering this request: The deferred assessment is in place due to an agreement the City entered into with the previous owner of the property back in 1996. There was nothing in those agreements that talked about waiving interest fees. Approving it would set a precedent. We get requests all of the time to waive city assessments/fees. Currently there are 81 deferred assessments with a principle balance of over $963,000. We would need to be mindful of what a decision like this would/could have an impact on those future assessments. The City's policy for deferred assessments on undeveloped property (special assessment policy) does not offer any language to waive deferrals, but does give the council flexibility when it comes to adjusting accrued interest on assessments. To staff's knowledge, the City has never waived deferred assessments or interest fees for a property that was undeveloped and had requested a deferral. We have made adjustments to properties that are in tax forfeiture and have done so according to our special assessment policy. I do believe there is a valid point in the amount of accrued interest that is incurring on the deferred assessment and that is likely a policy issue for the Council to considered. If you were to make adjustments with this deferred assessment, you would have to be mindful of how this would impact all other and future deferred assessments. Staff is recommending that the request be denied for the reasons noted above. It is my understanding that the current owner of the property has attempted to resolve the issue with the previous owner unsuccessfully and is the reason behind this request to the City Council. I've attached a spreadsheet that shows the accrual of the assessment over the years. If the Council were to grant the request or a portion of the request, we should have some sort of reasoning of doing so to assist with future requests. The obligation of the Buyer to complete the transaction contemplated under this purchase agreement is specifically contingent on and the Buyer satisfying itself that there are no significant environmental or other problems affecting the property. The Buyer shall be the sole judge of the fitness of the condition of the property. The closing of this transaction shall take place within 30 days of the end of the contingency period and, in no event later than on or before June 30, 2025, or as otherwise mutually agreed by and between the parties. Deed. At closing, Seller shall execute and deliver a Warranty Deed conveying title of record, subject to building and zoning laws, ordinances, state and federal regulations, exceptions to title which constitute encumbrances, restrictions or easements of record. Assessments. Seller shall pay on the date of closing any deferred real estate taxes (including "green acres" taxes) under Minnesota Statute §273.1.11 or special assessments payment of which is required as a result of the closing of this sale. Real estate taxes due and payable in the year in which this transaction is closed shall be prorated between the Buyer and Seller. Buyer shall pay real estate taxes due and payable in the year following closing and thereafter. Seller makes no representation concerning the amount of future real estate taxes or of future special assessments. Seller's Lien Warrants. Seller warrants that there have been no labor or material furnished to the property for which payment has not been made. Condition of Propegy. Seller shall remove all debris and all personal property not included in this sale from the property before possession date. Seller has not received any notice from any governmental authority as to the existence of any Dutch elm disease, oak wilt, or other disease of any trees on the property. Upon execution of this purchase agreement, Seller will deliver to the Buyer true and correct copies of all records effecting the property and its ownership, condition and use including, without limitation, copies of all surveys, soil tests, environmental studies and reports, market studies, appraisals, tax records, governmental permits and correspondence either in the Seller's possession or immediately available to Seller. Seller knows of no hazardous substances or petroleum products having been placed, stored, or released from or on the property by any person in violation of any law, nor of any underground storage tanks having been located on the property at any time. Notwithstanding Buyer's environmental investigations of the property, Seller does not warrant and represent to Buyer that there have been no acts or occurrences upon the property that have caused or could cause hazardous substances or petroleum products to be released or discharged into the subsoil or ground water of the property or other property in the area. Seller does not represent and warrant to Buyer that the property is free of hazardous substances and is not subject to any "superfund" type liens or claims by governmental regulatory agencies or third parties arising from the release or threatened release of hazardous substances in, on, or about the property. Seller knows of no wetlands, flood plain, or shoreland on or affecting the property. Seller's warranties and representations contained in this section shall survive the delivery of the deed provided that any notice of a defect or claim of breach of warranty must be in writing. Any such notice with respect to matters referred to in this section must be given by the Buyer to the Seller within one year of the date of closing or they will be deemed waived. The conditions of the conveyance of this property set forth in the Price and Terms section of this agreement shall also survive the delivery of the deeds. Buyer shall have the right to have inspections of the property conducted prior to closing. Unless required by local ordinance or lending regulations, Seller does not plan to have the property inspected. Other than the representations made in this paragraph, and by any contingencies, the property is being sold "AS IS" with no express or implied representations or warranties by the Seller as to physical conditions or fitness for any particular purpose. Buyer acknowledges that an annual agriculture rental agreement is in place and other than to conduct soil borings, no other general disturbance is anticipated that would adversely affect the agreement for this calendar year. Buyer shall collect rental dollars for this crop year. Seller acknowledges that a change to the assumed property line was noted in the site/survey work and is reflected in the legal description above. Its incumbent upon the Seller to resolve the property line in question by calendar year end unless otherwise agreed upon. Disclosure of Notices. Seller has not received any notice from any governmental authority as to violation of any law, ordinance or regulation. If the property is subject to restrictive covenants, Seller has not received any notice from any person as to a breach of the covenants. Seller has not received any notice from any governmental authority concerning any eminent domain, condemnation, special taxing district, or rezoning proceedings. Access Prior to Closing. By this purchase agreement, Buyer does not acquire any right of possession of the property, license, or easement. However, during the period from the date of the Purchase Agreement to the Closing Date, Buyer and its agents shall have access to the Property for completing such tests, studies, evaluations and other investigations as Buyer deems necessary. This right of entry shall also include the Buyer's agents, surveyors, engineers, and site evaluators for the purposes of testing, measuring and evaluating the condition of the parcel. Buyer shall indemnify and hold Seller harmless from any and all liens, claims, liabilities or charges incurred or caused by Buyer's contracts with surveyors, engineers, and site evaluators, which indemnity shall include any costs and disbursements incurred by Seller in any defense thereof. Possession. Seller shall deliver possession of the property not later than May 30, 2025, the date of closing; or such earlier time as the Seller is capable of executing the deed. Closing Costs and Prorations. Seller shall pay any state deed tax due and payable with respect to the Warranty Deed conveying the property. Real estate taxes, if any, due and payable for the Property the year in which the Closing occurs shall be prorated between Seller and Buyer as of the Closing Date. Buyer shall pay the costs of recording the conveyance instruments and the premium for any policy of title insurance which Buyer elects to purchase. All other costs and expenses with respect to the property shall be prorated between the Seller and Buyer as is customary as of the closing date. Each party shall pay its respective attorney's fees and professional costs with respect to the negotiation and closing of the purchase. Seller shall pay any commission or fee payable to Seller's broker or agent if any. Records. Upon the execution of the Purchase Agreement, Seller will deliver to Buyer true and correct copies of all records (the "Records") affecting the Property and their ownership, condition and use including, without limitation, copies of all surveys, soil tests, environmental studies and reports, market studies, appraisals, tax records, governmental permits and correspondence either in Seller's possession or immediately available to Seller. Minnesota Law. This contract shall be governed by the laws of the State of Minnesota. Well Disclosure. Seller certifies that Seller does not know of any wells on the property. Closing. Closing shall be conducted at Title Mark located at 106 2nd Ave SW, Suite 92, Hutchinson, MN 55350. At closing, Seller and Buyer shall disclose their Federal Tax Identification numbers for the purposes of completing state and federal tax forms. Breach of Contract. The parties herein agree that the ordinary remedies available for breach of contract, including but not limited to rights of specific performance, shall apply to this transaction, notwithstanding the payment of any earnest money by Buyer. Miscellaneous. This agreement is subject to terms and requirements of the City Charter of the City of Hutchinson.
