STRATEGIC PLANNING SESSION — GOOD GOVERNMENT
OCTOBER 22, 2024 @ 3:45 P.M.
MINUTES
Members present: Mayor Gary Forcier called the session to order. Members
present were Tim Burley, Dave Sebesta, Pat May and Chad Czmowski. Others
present were Matt Jaunich, City Administrator and other city directors and staff.
1) Introduction to the Topic
Matt Jaunich, City Administrator, noted that today's agenda topics will include a review
of the programs and services and the people that provide them, policies and planning in
Hutchinson, partnerships/volunteering/advocacy, examining elected officials when it
comes to providing 'good government" and the next steps/action items/developing a
plan.
Mr. Jaunich reviewed the core value statements of providing for good government. The
core value of Good Government states "Citizens believe that the City is progressive and
innovative, delivering quality services at a reasonable price and that visionary planning
for the future is taking place".
Mr. Jaunich reviewed community survey feedback regarding good government. The
results showed that 74% rated the overall feeling of quality of services provided by the
City as excellent or good; 82% gave the City's customer service a positive rating; 70%
gave a positive rating in regard to the value of public information services; 52% gave a
positive rating in regard to value of services for taxes paid; 59% rated the overall
direction of the City as excellent or good; 54% feel the City is welcoming of citizen
involvement; 51% stated they were confident in City government; 61% stated that the
City was acting in the best interest of Hutchinson; 61% felt the City was being honest;
58% felt the City treats all residents fairly; 55% felt the City has been open and
transparent to the public; 51% stated that the City was informing residents about issues
facing the community; 66% stated the City was treating residents with respect; 42% of
residents have contacted the City for help or information; 11% have contacted a
Hutchinson elected official to express their opinion; 11% have attended a local public
meeting; 27% have watched a local public meeting; 44% have volunteered their time to
some group/activity; 13% have campaigned or advocated for a local issue, cause or
candidate; and 76% have voted in the most recent local election.
Mr. Jaunich also reviewed the price of providing services and noted that the City has the
second lowest tax rate in the county.
Council Member Czmowski noted that the citizens of Hutchinson are generally happy
with the City and local governing and there are typically no major issues.
Council Member May spoke about the low participation in the community survey and it
concerns him that at times council members are only approached when something
personally effects an individual or their property.
Council Member Burley expressed that he proactively engages the public and asks for
solutions to problems that they see. He feels that council members need to be willing to
engage with the community.
Mayor Forcier expressed that he wants the public to approach the council members with
questions they have.
2) Programs and Services and the People that Provide Them
Mr. Jaunich reviewed the current system of the city which includes administrative,
financial and legal programs and services; economic development programs and
services; housing programs and services; park/rec/community education programs and
services, planning/zoning/building program and services; public safety programs and
services, public works programs and services, water/sewer/storm services, garbage
services, compost and Creekside services, Liquor Hutch services and electrical/gas
services
Council Member Czmowski expressed he does not feel that there is any program or
service that the City could discontinue that citizens would not care about and he
commended all city staff on the work they do.
Council Member May noted that if there are items that are getting too expensive for the
City, perhaps they need to be reviewed to make adjustments and/or see if the public is
willing to pay fees for things. He also noted that he wished there was a solution to keep
the aquatic center open later in the season but cannot due to staffing issues.
Council Member Burley spoke about the issues of recruiting for police officers and even
firefighters.
Council Member May also commended leadership on retaining employees and offering
competitive wages and benefit packages.
3) Policies and Planning in Hutchinson
Mr. Jaunich spoke about all the documents that help guide city staff and the City
Council. These include: City Charter, Core Values statement document, Strategic Plan,
Comprehensive Plan, Transportation Plan, Airport Master Plan, Complete Streets Policy,
Financial Management Plan, Master Park Plan, EDA Strategic Plan, Marketing and
Branding Plan, Housing Plan, Growth Planning, Emergency Operations Plan and
Downtown Plan.
Council Member Czmowski expressed his gratitude for all of the plans put in place by
staff as they are very resourceful tools.
Mayor Forcier expressed that he feels the City is proactive in the development of the
policies it currently has.
Council Member Sebesta expressed that there are times when policies have to be
developed based on specific activities or actions.
Council Member May noted that a policy on cannabis, as well as other policies, will need
to be revised over the years due to state requirements.
Council Member Burley noted that the Council needs to be open to revising and/or
developing policies based on needs or requests.
It was noted that some of the city's development policies and the fees noted within
them may very well need to be revised in the near future as they have not been
updated for many years.
4) Partnerships, Volunteering and Advocacy
Mr. Jaunich noted that city staff prides itself in the various partnerships that it has
throughout the organization. Opportunities for both volunteering and the use of
volunteers is felt throughout the organization. Many city staff volunteer on various
boards and committees that have an impact on regional and statewide issues and the
city is partners with statewide advocacy groups.
Council Member Czmowski suggested perhaps the EDA could partner more with the
Chamber of Commerce which could also include revitalizing the Hutchinson Downtown
Association.
Council Member May spoke about the important relationship the city has with the school
district.
Mayor Forcier spoke about the benefits of holding meetings with the county board and
other local governments.
Staff spoke about partnerships with HUC as well as the McLeod County Soil and Water
Conservation District.
5) Examining Yourself (Elected Officials) When it Comes to Providing "Good
Government"
Council Member Czmowski asked if staff was aware of municipalities that have staff
evaluate Councils — no one was aware of any.
Matt Jaunich encouraged council members to attend the League of Minnesota Cities
annual conference and the Coalition of Greater Minnesota Cities annual conference.
6) Next Steps/Action Items/Developing a Plan
Council Member Burley suggested reviewing city ordinances and policies on a more
routine basis.

5. CITIZENS ADDRESSING THE CITY COUNCIL
Chris Smith, 31 Main Street South, presented before the Council. Mr. Smith addressed the Council
about the local smoke -free workplace ordinance. Mr. Smith explained that a new business opened
up next to him about five months ago which includes cannabis and tobacco sales. Mr. Smith noted
that smoking of cannabis has occurred right next to doorways and windows since the store has
opened. Mr. Smith stated that he has spoken to an employee of the store about the issues as well as
the owner of the store. Mr. Smith stated that since Mr. Smith has raised concerns with the
neighboring business, the business owner has measured 15 feet from their doorway and smoked
daily. The 15-foot distance is in Mr. Smith's driveway. Mr. Smith requested that the Council
change the local ordinance to allow for no smoking within 25 feet of doors/windows.

Matt Jaunich, City Administrator, noted that a revised resolution was distributed this evening
adding an additional project for a deferred assessment.

Council Member Burley asked the reasoning for the No Left Turn Sign on School Road in front
of Tiger Elementary. Mike Stifter, Public Works Manager, noted that the school district has
made the request to have a No Left Turn into Tiger Elementary off of School Road during
designated morning and afternoon hours on school days. Signage and communication wil be
forthcoming as part of the new traffic control device.

8. APPROVE/DENY FIRST READING OF ORDINANCE NO. 24-850 — ORDINANCE RELATED
TO CANNABIS REGULATIONS
Marc Sebora, City Attorney, noted that this item was tabled from the last Council meeting. Mr.
Sebora explained that the main reason for tabling the ordinance was to address hours of sales that are
allowed by Minnesota law. The proposed hours of sale contained in the ordinance are allowing
sales between the hours of 8:00 a.m. and 10:00 p.m. Monday through Saturday and from 10:00 a.m.
to 9:00 p.m. on Sundays.
Motion by May, second by Czmowski, to approve first reading of Ordinance No. 24-850. Motion
carried unanimously.
NEW BUSINESS
9. APPROVE/DENY RESOLUTION NO. 15792 — RESOLUTION APPROVING 2025 EMPLOYEE
BENEFITS PACKAGE
Kellie Wendland, Human Resources Director, presented before the Council. Ms. Wendland
explained that benefits for 2025 will see no changes to plan designs however will see some cost
increases. The City was presented with a 4% overall increase based on better claims experience in

2024. Staff would like to see a better balance between the two plans offered with future changes
that incentivize employees to move to the high -deductible health plan. This would help keep health
plan costs more sustainable for the city moving forward while still offering a benefit that is
competitive. Staff is recommending to continue with the two current health plan options with Health
Partners. The two plans have no changes in plan coverage but will see two changes with deductibles
and/or premium split: 1. Current high deductible plan will move from $3200/$6400 deductible to a
$3500$7000 deductible with an 80/20 premium contribution split (city/employee). This deductible
change is to satisfy the IRS requirements for an embedded deductible for this year and hopefully a
couple of years to come. 2. Current low deductible plan will stay at $2000/$4000 deductible but the
premium split will move from 80% city/20 % employee to a 75% city/25% employee.
Motion by Burley, second by Sebesta, to approve Resolution No. 15792. Motion carried
unanimously.
10. APPROVE/DENY PURCHASE OF NEW FIRE LADDER TRUCK
Mike Schumann, Fire Chief, presented before the Council. Chief Schumann noted that Fire staff has
identified three options for the existing ladder truck: Option A — refurbish the existing truck; Option
B — replace with a new truck through Rosenbauer at a total estimated cost of $2,130,437; Option C —
replace with a new truck through Pierce Mfg. at a total estimated cost of $2,563,815. Fire staff is
recommending Option B not only because of the lower cost but also the shorter build time of two
years compared to four years with Option C. Refurbishment is mainly cosmetic and doesn't include
any major mechanical systems. In addition, if refurbishment was chosen as an option, the
department would be without the truck for several months which could potentially have a significant
impact on fire response operations. Funding is yet to be determined but likely will be a combination
of city reserve funds and new debt. The current capital plan includes the replacement for 2026 but
funding will likely occur in three or four installments over the two-year period.
Chief Schumann explained the need for an aerial truck which is due to the commercial industries in
the city as well as the city's ISO rating and the need to get to high-rise occupied buildings such as
Park Towers.
Motion by Burley, second by Czmowski, to approve purchase of new fire ladder truck. Motion
carried unanimously.

November 12, 2024, at 3:45 p.m. Motion carried unanimously.

Matt Jaunich — Mr. Jaunich noted that the City recognition event is November 7, 2024; canvassing
board at 3:45 p.m. and budget workshop at 4:00 p.m. on November 12, 2024; City offices closed on
November 11, 2024, for Veterans Day. Mr. Jaunich also asked of the Council for any staff direction on
Mr. Smith's request made earlier tonight during the Public Comments period. Council Member Burley
asked staff to find out the state law for distance requirements for smoking. The Council would like
more time and will discuss this at the next Council meeting.
15. COUNCIL/MAYOR UPDATE
Pat May — Council Member May noted that the Public Arts Commission is currently reviewing
sculptures for next year's Sculpture Stroll.
Chad Czmowski — Council Member Czmowski noted that a candidate forum for City Council Members
is being held tomorrow night at 6:30 p.m. in the Council Chambers.
Gary Forcier — Mayor Forcier noted that there are apartment vacancies at Park Towers and provided
housing statistics from the HRA Board. He also noted that the leaf vacuuming service is occurring.

BACKGROUND/EXPLANATION OFAGENDA ITEM:
Public works is seeking approval to order the plow equipment from towmaster for a heavy truck
purchase that was authorized earlier this year. Similar to the truck purchase we are seeking to
order the plow equipment before end of year price increases take effect, potentially a 3-7%
savings. Ordering the plow equipment now does not add any encumbrance to this year's budget
as payment for the plow equipment would not be until the truck is complete and delivered next
year.

Approve Request for Qualifications (RFQ) process to select the CMAR for the WWTF Solids Improvement project
adopted in 2024 Capital Improvement Plan.
One of the major problems the Wastewater Treatment Facility (WWTF) is facing is the age and condition of the
original 1988 equipment and processes. The Solids Processing Building (Building 90) at the Hutchinson WWTF is
generally comprised of aerobic digestion and solids dewatering. The solids processes are in urgent need of
upgrades, particularly to the aeration system. The current aeration equipment is inefficient and results in low volatile
solids destruction. The original diffusers, installed in 1988, are still in use have been modified over time.
Implementing process improvements to separate mixing and aeration functions within the aerobic digesters would
significantly enhance system efficiency.
The dewatering system requires significant upgrades. Currently, the belt presses demand excessive manpower for
operations and maintenance, and they do not remove solids as well as desired. Solids are squeezed out through the
sides of the press and spread over the floor which gets washed down and sent back to the ditch process through
the recycle stream. By replacing the presses with centrifuges, the operation can be streamlined, allowing the facility
to better allocate its workforce and enhance overall plant operations.
There are three componets to the project: 1) Aerobic Digester Improvements; 2) Dewatering System Improvements;
and 3) Building Improvements
Please consider the Resolution to Approve the RFQ process for selection of the CMAR for the WWTF Solids
Improvement project.

RESOLUTION APPROVING PLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS
LETTING NO. 3/PROJECT NO. 24-09
WHEREAS, the Director of Engineering/Public Works has prepared plans and specifications forthe following
described improvement:
L3/P24-09: Wastewater Treatment Facility (WWTF) Solids Improvements Project:
Replacement of aerobic digester equipment including the removal of existing equipment and
installation of diffusers, blowers, mixers, and compressors. Replacement of dewatering
equipment including the removal of belt filter presses and installation of centrifuges.
Replacement of building air handling and heating systems.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
1. Such plans and specifications, a copy of which is attached hereto and made a part hereof, are hereby
approved.
2. The Director of Engineering/Public Works shall prepare and cause to be inserted in the official newspaper,
the City of Hutchinson Web -Site and in Finance and Commerce, an advertisement for bids upon the making of
such improvements under such approved plans and specifications. The advertisement shall be published for
three weeks, shall specify the work to be done, shall state that bids will be received by the Director of
Engineering/Public Works until 2:00 pm on Tuesday, December 3rd, 2024, at which time they will be
publicly opened in the Council Chambers of the Hutchinson City Center by the City Administrator and Director
of Engineering/Public Works, will then be tabulated, and the responsibility of the bidders will be considered by
the Council at 5:30 pm on Thursday, December 19th 2024 in the Council Chambers of the Hutchinson City
Center, Hutchinson, Minnesota.
Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to
address the Council on the issue of responsibility. No bids will be considered unless sealed and filed with the
Director of Engineering/Public Works and accompanied by cash deposit, cashier's check, bid bond or certified
check payable to the City of Hutchinson for 5 percent of the amount of such bid.

The City of Hutchinson, Minnesota, is seeking submissions from qualified general contractors for Construction -
Manager -at Risk (CMAR) services for the Solids Improvements Project at the Hutchinson Wastewater Treatment
Facility.
The City will receive Statement of Qualifications (SOQ) at the Hutchinson City Center, Engineering Office, 111
Hassan St SE, Hutchinson MN, 55350-2522, until 2:00 pm on Tuesday, December 3rd, 2024, for the making of the
following described local improvement:
L3/P24-09: Wastewater Treatment Facility (WWTF) Solids Improvements Project: Replacement of aerobic
digester equipment including the removal of existing equipment and installation of diffusers,
blowers, mixers, and compressors. Replacement of dewatering equipment including the
removal of belt filter presses and installation of centrifuges. Replacement of building air

In accordance with Minnesota Statutes, Section 574.26 and 574.32, Payment and Performance Bonds will be
required from the selected CMAR. The proposer will need to provide a Surety Letter substantiating the appropriate
bonding capacity, see Section 5.3.3 for details.
Submissions shall be prepared at the bidder's expense and become the City of Hutchinson's record and therefore a
public record. Confidential data, if identified as such, will be held confidential upon request, if the request is made
as part ofthe bid and if it determines the data meets the requirement of the Minnesota Government Data Practices
Act.

The Water Utility has budgeted for a multi-phase/year water meter replacement project. With
Phases 1 and 2 now approaching completion, Phase 3 is scheduled to begin still this year with a
budget of $450,000. Staff would again purchase the meters directly, utilizing the contracted
vendor, HydroCorp, for the installation.
Staff are requesting to spend up to $175,000 to purchase our standard meter from Core and
Main. Core and Main is the Sensus representative for this territory and no other company is
allowed to sell Sensus products in this area. Our water meters and transmitters are Sensus.
More importantly, HUC metering equipment, including the TGB equipment at the water towers is
Sensus.
HydroCorp staff will also continue to conduct the Lead -Copper as well as Cross-Connect/Sump
Pump survey with this installation. Residents will also be left with indoor and/or outdoor vacuum
breakers if needed.
All of this has been done at no charge to the resident at this time.

BACKGROUND/EXPLANATION OFAGENDA ITEM:
As the Council may be aware, Skyview Dairy is requesting a Conditional Use Permit (CUP) through the
Hutchinson Area Joint Planning Board (HAJPB) for a feedlot expansion. As you know, the HAJPB is comprised
of one representative each from Acoma Township, Hutchinson Township, Lynn Township, Hassan Valley
Township, the City of Hutchinson and McLeod County. Final decisions for applications in this area are made by
the County Board. Council member Sebesta is the representative to the HAJPB and is unable to attend the
meeting, so Staff wants to get any feedback the Council may have to share with the HAJPB.
Skyview Dairy applied for a CUP for a feedlot expansion from 2,540 animal units to 3,520 animal units in March
of 2024. An Environmental Assessment Worksheet (EAW) was requested by the County and was recently
completed and the item is back on the agenda for the HAJPB for the November 20, 2024 HAJPB Meeting.
The feedlot expansion is 5,066 feet from the City of Hutchinson corporate limits near Hwy 7/22 on the east side
of town. The EAW noted in section 2 (B) talks about land in proximity to the proposed feedlot and whether there
may be incompatible uses. Please see the attached future land use map and growth area plans adopted by the
City of Hutchinson attached to see City plans for this area. The area at Hwy 7/22 is guided for future
commercial use and is zoned Gateway District, which allows for commercial type uses like retail, restaurants,
hotels, gas stations, etc. The Growth Plan adopted last year has land guided for Industrial east of the current
Industrial Park. The EAW notes these uses are not incompatible with a feedlot. The Council may want to
provide comments on whether or not there is any concern by the City of Hutchinson about the compatibility of
uses in proximity to each other.

Physical Characteristics: Established feedlot with multiple barns, feed storage and
manure storage structures (lagoons). This operation is
located—5,066' from the City of Hutchinson municipal
boundary.
Analysis: The applicants are proposing to expand their existing
feedlot operation by adding 980 animal units (700
mature dairy cows >1,000 lbs), constructing a total
confinement barn to operate the increase in animals,
construct a milking parlor/holding area, and installing a
manure tank/digester.
The Minnesota Pollution Control Agency (MPCA) is the
permitting authority for the operation permit on feedlot
greater than 1,000 animal units. Local government has
the statutory right to regulate land use through
ordinance and McLeod County/Hutchinson Joint
Planning Ordinance requires conditional use permits
for feedlot greater than 399 animal units. The MPCA
issued the administrative permits for operation
expansion on April 25, 2023.
The McLeod County Feedlot Committee recommended
the applicant complete a Voluntary/Discretionary
Environmental Assessment Worksheet (EAW) in 2020.
The applicant re -submitted a conditional use
application in 2024 with a completed EAW and manure
management plan. Since the MPCA issued the permit
for expansion already they could not be the reviewer of
the EAW. The McLeod County Feedlot Committee on
February 15, 2024 recommended that the EAW be
reviewed prior to recommending approval/denial of the
conditional use permit. The McLeod County Board of
Commissioners has the authority through the McLeod
County Zoning Ordinance Section 16, Subdivision 5 to
require a voluntary/discretionary EAW for projects.
Mandatory EAW's for feedlots are require if a new
feedlot is requested exceeding 999 animal units or an
existing feedlot is expanding by 1,000 animal units or
more.

2, The Conditional Use Permit shall be reviewed every three years or upon ahange of ownership by the
McLeod County Planning & Zouina Dcpartment, the l nvirunniemal Services INTamnertt, a

3_ Solid Waste produced at each site shall be picked up and disposed of according to State and local
waste rules.
4_ Deceased animals shall be disposed at properly.
5. Skyview Dairy shall have and keep a current Manure Management Plan on Sle in the Environmental
Services office that meets all the requircmcm8 of Minnesota Rule Chapter 7020.
6. The permit holder shall allow the McLeod County Feedlot Office to inspect the site whcncver
necessary. The Feedlot officer or representalivv shall provide adequate notice to the permit holder
in advance. of any inspection involving access to livestock buildings.
7. A Water Appropriation permit shall be kept current. The Minnesota Department of Natural
Resources has a Well interference Program. Ir interference occurs, the fetudlat operator must follow
the Department of Natural Rosource.s directives regarding water use p ri ori ti vat ion.

that may have the potential for significant environmental effects. This EAW was prepared by the Minnesota
Pollution Control Agency (MPCA), acting as the Responsible Governmental Unit (RGU), to determine whether
an Environmental Impact Statement (EIS) should be prepared. The project proposer supplied reasonably

The lands directly adjacent to facility are classified as rural farmland. The town of Hutchinson Is approximately 13 miles
west of the facility and is the locations of the majority of the public facilities. Below is a list of public facilities that are

the Silver Lake DWSMA is located 4.5 miles to the east of the feedlot facility.
• Public Water Supply Wells: The Minnesota Well Index indicated that several domestic wells and other
use private wells near the feedlot facility, but no public water supply wells were identified.
• Parks, recreation areas, a_n_d trails: Halva Marsh WMA is located 1.6 miles from the property, and the
Crow River Snowmobile Trails runs along the south side of the property. Also, the Luce Line State Trail
runs north of County Road 7 out of Hutchinson.
• Lakes and Wildlife Management Areas: Campbell Lake, Swan Lake, and Lake Harrington are located 3
miles from the property.

Manure is all collected In the liquid form that flows into existing earthen basins at the location. A solid separator
Is currently installed to remove any solids from the manure. Those solids are then transported to a composting
location on the farm. This composted product Is then transferred out of the facility for various purposes. The
liquid manure is stored in the lagoons till land application can occur. The lagoons are emptied two times per
year; after harvest in the fall and prior to planting in the spring. The manure is injected into the soil and
immediately covered. Liquid manure is applied via drag hose and tankers.

As stated above, liquid manure Is applied in spring and Fall to various field locations. A manure management plan
IS followed for the correct placement of nutrients to alleviate any envlronmental concerns. The manure is
immediately injected Into the soil. A John Deere harvest lab and rate control are utilized to ensure accurate
nutrients and application rates are followed that were established in the manure management plan.
z. Describe the agronomic rates of application (per acre) to be used and whether the rates are
based an nitrogen or phosphorus. Will there be a nutrient management plan?

A certified manure management plan is established according to MN Pollution Control Agency (MPCA) and
the University of Minnesota recommendations. Typical agronomic rates are 10,000-1-2,000 Gallons Per Acre
that follow a phosphorus -based removal plan.

improvements necessary.
According to a licensed agricultural engineer, there is enough storage in place to meet a rnfOrnum
requirement of 9 months of storage. This is a requirement of MN Pollution Control Agency (MPCA) for any
National Pollutant Discharge Elimination System {NPDES) animal operations. Currently, there are no
necessary Improvements that are identified.
4. Describe any required setbacks for land application systems.
Any land application setbacks are those listed in the facilities MPCA-NPDES permit MNG441937. The facility
is required by law to Follow all MPCA-NPDES program setbacks for land application of manure; including any
further restrictions put forth via MN Department of Agriculture.
F. Other methods of manure utilization. If the project will utilize manure other than by land

6. Air/odor emissions.
A. Identify the major sources of air or odor emissions from this feedlot.
Animals and housing could generate particulate matter, methane, and nitrous oxide. Collection and transfer of
manure could generate odor, particulate matter, ammonia, hydrogen sulfide, methane, and volatile organic
compounds (VOCs). Land application could generate odor, ammonia, and particulate matter.

B. Describe any proposed feedlot design features or air or odor emissian mitigation measures to be
implemented to avoid or minimize potential adverse impacts and discuss their anticipated
effectiveness.
1. Add straw, other bedding material, or approved additives as needed to reduce odor emissions.
2. Avoid holidays or other important events happening in a 2-mile radius.
3. Maintain a natural crust on the liquid manure storage area for order reduction.
4. Manage morallties as required by MN Board of Animal Heath.

1.1
Permit Coverage. [Minn. R. 70201
1.2
Upon the date of receiving notification of coverage under this Permit from the MPCA, the Permlttee is authorized to
construct and operate the facility according to the submitted and MPCA approved permit application materials
(application materials) and in compliance with the requirements of this Permit, all requirements of Minn. R. ch. 7020,
and any other applicable state and federal rules and regulations. No condition of this Permit shall release the Permittee
from any responsibility or requirements under other federal, state, tribal, or local statutes, rules, or regulations. The
application materials are an enforceable part of this Permit. Minn. R. 7001.0150]
1.3
If at any point the MPCA determines that the application materials are deficient, the Permittee shall submit an
amendment within 45 days of being notified by the MPCA. Upon receipt of MPCA approval, the amended application
materials shall become an enforceable part of this Permit_ The Permittee shall comply with the most recently MPCA-
approved application materials. [Minn, R. 7001.01501
1.4
After notice and opportunity for a hearing, this Permit may be modified, suspended, or revoked In accordance with
Minn. R. 7001.0170 through 7001.0190. The Permittee shall comply with the terms and conditions of this Permit until
such action is finalized. [Minn. R. 7001]
1.5
In order to maintain continuous permit coverage, the Permittee shall submit an application for permit reissuance ; 17ue
by 180 days prior to permit expiration. If the Permittee has provided a timely application for issuance of coverage under
the new general animal feedlot NPPCS permit, the Permittee may continue to conduct the activities authorized by this
Permit, in compliance with the requirements of this Permit, until the MPCA takes final action on the application, unless
the MPCA determines that any of the following are true -
a) The Permittee is not in substantial compliance with the requirements of this Permit, nor with a stipulation agreement
or compliance schedule designed to bring the Permittee into compliance with this Permit;
b1 The MPCA, as a result of an action or failure to act by the Permittee, has been unable to take final action on the
application on or before the permit expiration date; or
c) The Permittee has submitted an application with major deficiencies or has failed to properly supplement the
application in a timely manner after being informed of deficiencies. [Minn. R. 7001.0160, Minn. R. 7020,05051
In order to terminate coverage under this Permit, the Permittee shall submit a termination request to the MPCA at least

30 days in advance of the desired permit coverage termination date. If the MPCA determines that NPDES permit
coverage is not required, coverage under this Permit will terminate upon receiving written approval from the MPCA. The
Permittee shall comply with the terms and conditions of this Permit until the termination action is finalized. [Minn. R.

The Permittee shall submita permit application prior to all modifications. (Guidance pertaining to modifications ran be

The permit application should be submitted at least 180 days before the planned starting date of the modification,

2.4
The modification for which the permit application was submitted shall not begin until approval is received from the
MPCA. [Minn. R. 7020.04051
2.5
Prior to a change in ownership or control of the facility, a change of ownership request must be submitted to assign
coverage under this Permit to the new owner/operator, If ownership or control changes without an assignment of
coverage under this Permit, the original Permittee may still be held liable for violations and the new owner/operator
may be held liable for operating without a permit. If modifications to the facility or changes to the application materials
will also occur, the process for permit modifications described above must also be followed. [Minn. R. 7020.0405]
Prior to changes in facility name, the Permittee shall submit a change of name request and the MPCA shall issue a permit

Submittals and Notifications to the MPCA. [Minn, R: 70201
The Permittee shall submit all notifications, reports, applications, modiflcatlon requests, correspondence, and other

permit related materials to the MPCA on a specified form and/or in a specified format, including instances when the
MPCA requires electronic submission. All submittals shall be to the MPCA address, telephone number, or electronic mail

3.3 All reports required by this Permit and other information requested by the MPCA shall be signed and certified by the
Permittee or by a duly authorized representative, A person is a duly authorized representative only if:
a) The authorization is made in writing by the Permittee orowner(s) and submitted to the MPCA; and
b) The authorization specifies either an individual or a position having responsibility for the overall operation of the
regulated facilltt . [Minn. R. 7001,01501
3.4 The Permittee shall not knowingly make a false or misleading statement, representation, or certification in a record,
report, plan, or other document required to be submitted to the MPCA by this Permit. The Permittee shall Immediately
upon discovery report to the MPCA an error or omission in these retards, reports, plans, or other documents. [Minn. R.
7001.0150]
4.1 Requirements for All Construction. [Minn. R. 7020]
4.2 The Permittee shall construct all facility components according to the application materials, Minn- R. 7020, this Permit,
and any plans and specifications approved by the MPCA. If any approved plans conflict with Minn. R. ch. 7020, 40 CFR
ts, 122 and 412, or terms of this Permit, the more stringent condition shall apply. [Minn. R. 7001.01501
4.3 The Permittee shall not operate/stock a facility component prior to completion of construction of the associated manure
storage area, and Its handling/transfer system, necessary to comply with the effluent limitations of this Permit or
minimum storage requirements of Minn. R. 7020.2100. [Minn. R. 7001.01501
4.4 The Permittee shall complete installation of any required monitoring equipment prior to the commencement of
operation of a newly constructed source of potential emissions for which the monitoring is required unless the approved
monitoring plan includes a schedule for installation of the monitoring equipment. (Minn, R. 7001,0150)
4.5 The MPCA Construction Stormwater (CSW) NPPES general permit in effect at the time of issuance, or modification, of
coverage under this Permit is incorporated by reference into this Permit and is an enforceable part of this Permit. The
CSW NPOES eneral permit is available at: http://www.pca,state.mn.us/. [Minn. R. 7090.2020]
4.6 When construction activity disturbs one or more acres of land, the Permittee must comply with the CSW NPDES general
permit listed above, including_ development of a 5tormwater Pollution Prevention Plan (SWPPP), [Minn. R. 7090.2020]
5.1 Additional Requirements for Liquid Manure Storage Area LMSA Construction. [Minn. R. 70201
5.2 The Permittee shall complete construction of any LMSA required to comply with the storage volume requirements of
Minn. R. 7020,2100, subp. 3, Item A (nine months of storage) prior to increasing the manure or process wastewater
eneration of the facility. [Minn. R. 7001.01501 -
5.3 The Permittee shall notify MPCA at least three (3) working days prior to the start of construction of each LMSA. The
Permittee shall notify the MPCA via telephone or electronic mail. [Minn. R. 7020.2100]
5.4 The Permittee shall notify MPCA within three (3) working days of completing constructlon of each LMSA and before
backfill against vertical concrete -lined walls. The Permittee shall notify the MPCA via telephone or electronic mail, [Minn.
R. 7020.21001
5.5 The Permittee shall ensure that the construction Inspections required by Minn. R. 7020.2100, sump. 6. are performed.

5.6 The Permittee shall submit a construction report to the MPCA within 60 working days of completion of the LMSA. The
report shall be prepared and signed by the design engineer and shall contain the following:
a) An assessment by the design engineer of whether the completed LMSA conforms to the plans and specifications
approved by the MPCA;
b) The completed Liquid Manure Storage Area Construction Inspection Form (wq fS-9.3), and
c) As -built plans that contain, in detail, the final construction plans and specifications for the LMSA(s), as well as details
of any changes made during construction to the original MPCA approved plans and specifications. [Minn. R. 7020.21001
5.7 The Permittee may commence operation of a LMSA prior to submittal of the required construction report. However, the
MPCA may require removal of any material within the LMSA If the construction report indicates the LMSA does not
conform to the a proved plans and specifications. [Minn. R. 7020.21001
6.1 Manure Nutrient Testing. [Minn. R. 7020]
6.2 The Permittee shall sample and analyze manure for nutrient content annually. Manure shall also be sampled following
any changes to conditions that may significantly affect the nutrient content. [40 CFR 412.4, Minn. R. 7020.22251 _

6.3
The Permittee's manure sampling protocol shall be consistent with the most recent published ME5 recommendations.
Manure samples must be taken from enough sources so that nutrient content is known for each storage area with
differing types of animals, feed, watering systems, manure handling, or other variables that may affect manure nutrient
content. [Minn. R. 7020.22251
7.1
Transfer of Manure Ownership. [Minn, R. 7020
7.2
The Permittee is responsible for management of manure from the facility unless It is transferred to another party for
land application on fields that are not owned or leased or otherwise controlled by the Permittee. At the time the other
party assumes physical control of the manure, the manure ownership is considered to he transferred. The Permittee is
responsible for manure hauled by, or for, the Permittee until it is physically relinquished to the other person. [Minn. R.
7001.0150
7.3
Except for emergency manure application, the Permittee is prohibited from transferring ownership of manure to a
recipient that will. -
a) perform winter application of the transferred liquid manure; or
b) perform winter application during the months of March of the transferred solid manure. [Minn. R. 7001.01501
The Permittee shall provide to the recipient of the manure, at the time of transfer of ownership, Attachment A of the

7.5
Updates to a transferred ownership manure management plan do not require a modification of this Permit so long as
they are consistent with the requirements of Minn, R. 7020.2225. [Minn. R. 7001.01901
7.6
The Permittee is required to apply for a permit modification when the Permittee obtains control over land application
acres that were previously controlled by a third party. (Minn. R. 7020.0405)

9.3
The MMP developed by the Permittee and approved by the MPCA, is an enforceable part of this Permit. If the MMP
conflicts with Minn. R. ch. 7020, 40 CFR pts. 122 and 412, or terms of this Permit, the more stringent condition shall
apply, The Permittee shall comply with the approved MMP, [Minn, R. 7001.01501
8.4
The Permittee shall annually review and update the approved MMP to ensure that it meets all applicable requlrements.
The annual review and update shall include information for each field where manure will be applied during the following
growing season. Annual updates to the IVIMP do not require a modification of coverage under this Permit provided the
updates are consistent with the methodo'kV of the approved MMP. (Minn. R, 7001.0190, Minn. R. 7020,22251
The following changes to the MMP will require the Permittee to submit an application for a modification to the facility's

coverage under this Permit:
a) Changes to the methodology portion of the MMP that will result in an increase to the maximum field -specific annual
rates for nitrogen and phosphorus derived from all sources for each crop,
b) The addition of any crap, and its corresponding rates of application for nitrogen and phosphorus, not Included in the
methodology portion of the MMP;
c) The addition of application methods not accounted for in the methodology portion of the MMP,
d) Changes in procedures for handling, storage, or treatment of manure that affects rates of application;
e) The addition of new fields to the MMP;
f) Conservation practice changes that could increase the likelihood of nitrogen and phosphorus transport from the field;
and
g) Alternatives to the cover crop or nitrogen 6MPs listed In this Permit.
The modifications identified above require a 14 day public notice period, except for the addition of new fields to the
MMP where the acreage is listed on an approved MMP for any other NPOES permit holder. [40 CFR 122.42, Minn. R.

8.6
If land application practices under the MPCA-approved MMP are found to cause pollution of waters, the MPCA may
require revisions to the MMP to address any causative factors that led to the pollution, The Permittee shall submit a
revised MMP that addresses the required revisions and shall follow the revised MMP once approved by the MPCA.

9.1 Land Application of Manure. [Minn. R_ 7020]
9.2 The requirements of this part only apply when manure ownership is not transferred, [Minn. R. 70201
9.3 The Permittee shall ensure that manure is hauled in such a way as to prevent manure from leaking, spilling, or otherwise
being deposited on a road surface or in the right-of-way. The Permittee shall ensure that manure deposited on a
roadway or in the right-of-way is promptly removed and properly disposed of by the hauler of the manure. (Minn. R.
7001.01501
9.4 The Permittee shall ensure that equipment used for land application is calibrated according to VIES or NRCS procedures
so that actual application rates are known. The Permittee shall also ensure that the land application equipment is
operated properly and periodically inspected for leaks to ensure that discharges do not occur. [40 CFR 412.4, Minn, R.
7001.01501
9.5 IThe Permittee shall ensure that manure or process wastewater are land applied in a manner that will not:
a) result In a discharge to waters of the state during the application process, or
b exceed the hydraulic loading capacity of the land application site based on soil conditions. 1Minn. R, 7020.22251
9.6 The Permittee shall ensure that fields receiving manure are sampled and tested in the upper six inches for soil
phosphorus at least anca every four years. Soil sampling techniques must meet the most recently published sampling
standards developed by either the MES or NRCS. (Minn. R. 7020.2225]
9.7 The Permittee shall employ one, or more, of the soil erosion conservation practices identified in the MPCA-approved
MMi' when manure will be applied to fields during frozen or snow-covered soil conditions and all areas of fields within
3QO feet of all special protection areas, surface tile intakes, sinkholes without constructed diversions, and uncultivated
wetlands, IMInn. R. 7020.2225
10.4
10.5
Nitrogen and Phosphorus Rate Limits, [Minn. R. 7020]
The requirements of this part only apply when manure ownership is not transferred. [Minn. R, 70201
The Permittee shall control manure application rates so the estimated nitrogen available to crops from all nitrogen
sources (including commercial fertilizer) does not exceed expected annual crop nitrogen needs for non -legumes and
expected nitrogen removal for legumes based on the most recent recommendations of the ME5 and the MPCA fact
sheets "Manure Nitrogen Rates For Corn Prodaction (wq f8-18)" and "Manure Management For Corn On irrigated Sandy
Soils (wq f8-52)". Recommendations from another land grant college In a contiguous state may be utilized provided the
field and climate conditions at the land application site are similar to those within the contiguous state. [Minn. R.
7020.22251
Where field average soil test levels exceed 21 parts per million (ppm) using the Bray P1 test (Bray) or 16 ppm using the
Olsen test (Olsen) within 300 feet of a lake, stream, intermittent stream, drainage ditch without protective berms, or a
public waters wetland, the Permittee must either:
a) Apply manure at a rate and frequency so that manure phosphorus applied during any six year period does not exceed
crop phosphorus removal during that same period; or
b) Establish a vegetated buffer that does not receive manure application along the water provided that the buffer width
is at least 100 feet along lakes and perennial streams and is at least 50 feet wide along other waters. [Minn. R.
7C20.22251
Where field average phosphorus soil test levels exceed 7S ppm Bray P1 or 60 ppm Olsen within 300 feet of an open tile
intake, lake, stream, intermittent stream, drainage ditch without protective berms, or a public waters wetland, or exceed
150 ppm Gray P1 or 120 ppm Olsen on any other land, the Permittee shall land apply manure in accordance with all of
the following:
a) When manure is surface applied without incorporation within 24 hours, annual phosphorus application rates must not
exceed crop phosphorus removal in the subsequent crop;
b) When manure is injected or incorporated (within 24 hours), re -application of manure cannot occur until phosphorus
from the previous manure application is calculated to have been removed by subsequent crops; and
c) The approved MMP includes runoff and soil erosion prevention practices that either achieve a "very low" or "flaw"
rating with the Minnesota Phosphorus Index (www.rnnpi,umn.edu) or NRCS Technical Standard 590. [Minn. R.

11.3 The Permittee shall Immediately incorporate surface applied manure into the soil surface If a high probability (over 50
percent chance predicted by National Weather Service) of rainfall exceeding one-half inch is predicted within 24 hours of
the end of the application period, unless it is an emergency manure application, as defined by this permit. (Minn. R.
7001.0150]
11.4 17he Permittee shall not apply manure to fields that are dominated by coarse -textured soils until soil temperatures are
less than 50 degrees Fahrenheit, unless It is an emergency manure application, as defined by this permit. [Minn. R.
11.5 June, July, August, or September Restrictions - The Permittee shall not apply manure In June, July, August, or September
to harvested fields unless a cover crop Is planted and allowed to grow for the remainder of the growing season. The
cover crop must be planted in accordance with MES recommendations by one of the following methods:
a) Interseeded into the standing primary crop such that vegetative growth is established prior to manure application;
b) Planted/seeded after the primary crop harvest and within 14 days of manure application; or
c) other method approved by the MPCA and included as part of the approved MMP.
Alternatives developed by a land grant University or governmental agency can be used if approved by the MPCA and
included as part of the approved MMP, fMiriri, R. 7001-0150, Minn. R_ 7020.2225]
11.6 October Restrictions - The Permittee shall not apply manure prior to October 15 to harvested fields unless at least one of
the following nitrogen BMPs are implemented:
a) Soil temperature is below 50 degrees at the start of manure application;
b) A nitrogen stabilizing agent/product is added at the recommended inclusion rates;
c) A cover crop is established in accordance with the requirements of this Permit for -June, July, August, or September
manure applications; or
d) A split application of nitrogen Is used where no more than 1/2 of the recommended nitrogen rate is applied before
October 15. Winter application of the remaining recommended nitrogen rate is prohibited.
Alternatives developed by a land grant University or governmental agency can be used if approved by the MPCA and
included as part of the approved MMP.
Nitrogen BMP implemontatioo is not required for emergency manure application, as defined by this Permit. [Minn. R.

11.7 The Permittee shall maintain records of nitrogen RMPs implemented for manure application during the month of
October on a farm specified by the MPCA. [Minn. R. 7001.01501

11.8 Winter application of solid manure during the months of December and January - Winter application of solid manure
during the months of December and January shall comply with all of the following:
a) Manure is applied on fields identified in the MPCA appr4ued MMP for winter application;
b) Manure is applied more than 300 feet from sensitive features including lakes, streams, open the Inlets, sinkholes,
water supply wells, mines and quarries, intermittent streams, un-bermed drainage ditches, or public water wetlands;
c) Water or ice do not occupy tillage furrows to the extent that additional snowmelt or precipitation cannot be
contained between furrows or In other depressions within the field;
d) Fields used for land application meet a total phosphorus loss risk index number of two or less (low to very low relative
risk) as calculated according to the Minnesota phosphorus index;
e) Air temperatures are less than 40 degrees Fahrenheit during, and for at least 24 hours from the end of, the
application process when two or more inches of snow are on the field;
f) Less than a 50% probability of rainfall In excess of 0.15 Inches predicted by the National Weather Service within 24
hours of the end of the application period; and
g) slopes are less than or equal to six percent on the entire portion of the field where manure is land applied. [Minn. A.

11.9 Winter application of solid manure during the month of February - During the calendar year 2021, winter application of
solid manure during the month of February shall comply with requirements of this Permit applicable to December and
January.
Beginning with the calendar year 2022, winter application of solid manure during the month of February shall comply
with all of the following:
a) Manure Is applied on fields identified in the MPCA approved MMP for winter application;
b) Manure is applied more than 300 feet from sensitive features including lakes, streams, open tile inlets, sinkholes,
water supply wells, mines and quarries, intermittent streams, un-bermed drainage ditches, or public water wetlands;
c) Water or ice do not occupy tillage furrows to the extent that additional snowmelt or precipitation cannot be
contained between furrows or In other depressions within the field;
d) Fields used for land application meet a total phosphorus loss risk index number of two or less (low to very low relative
risk) as calculated according to the Minnesota Phosphorus Index;
e) Air temperatures are less than 40 degrees Fahrenheit during, and for at least 5 days from the end of, the application
process when two or more Inches of snow are on the field;
0 Less than a 50% probability of rainfall in excess of 0.25 Inches predicted by the National Weather Service within 5 days
of the end of the application period; and
g) slopes are less than or equal to two percent on the entire portion of the field where manure is land applied. [Minn. R.

11.10 Winter application of solid manure during the month of March - During the calendar year 2021, winter application of
solid manure during the month of March shall comply with the requirements of this Permit applicable to December and
January.
Beginning with the calendar year 2022, winter application of solid manure during the month of March is prohibited.

11.11 Winter application of snow -manure mix - Winter application of snow removed from animal holding areas, mixed with an
incidental amount of manure (snow -manure mix), is not subject to the Permit requirements applicable to winter
application of solid manure provided the Permlttee complies with all of the following:
a) Snow -manure mix is applied to the field(s) approved within the manure management plan for application of the snow -
manure mix;
b) Snow -manure mix is applied at least 300 feet from sensitive features including lakes, streams, open tile inlets,
sinkholes, water supply wells, mines and quarries, Intermittent streams, un-bermed drainage ditches, or public water
wetlands; and
c) Snow -manure mix applied during the month of March is limited to the amount necessary to ensure animal welfare,
such as access to feed, water, or. sheiter. [Minn. R. 7001.0150]

11.12 The Permittee may establish a temporary solid manure stockpile at the facility during March without the need to modify
coverage under this permit provided an approved permanent manure stockpile site is unavailable, weather or field
conditions do not allow short term stockpiling of manure within land application fields, and the temporary stockpile
location complies with all of the following -
a) The stockpile site complies with the location requirements of 7020.2125 subp. 2C.
b) The slope of the stockpile site does not exceed 2%.
c) The stockplie site Is elevated or bermed so that surface water cannot enter or flow through the stockpile site.
d) Snow is removed from the stockpile site prior to establishing the stockpile.
e) Manure is removed from the stockpile site as soon as practicable.
The Permittee must notify the MPCA, via telephone or electronic mail, within 24 hours of establishment of the
temporary stockpile.
Temporary stockpiling activities under this part d❑ not release the Permittee from compliance with the effluent
limitations of this Permit. [Minn. R. 7001.01501
11.13 Winter application of liquid manure - Winter application of liquid manure is prohibited except for emergency manure
application, as defined by this permit. Emergency manure application shall comply with all of the fallowing;
a) Apply only the volume of manure that is necessary to prevent manure storage overflows;
b) Apply only on those fields identified in the MPCA approved MMP for emergency application;
c) Apply only to fields with slopes of less than or equal to four percent;
d) Apply a maximum of 1,500 gallons per acre per winter season, not to exceed 60 pounds of crop available P205;
e) Apply at least 300 feet from sensitive features including lakes, streams, open the inlets, sinkholes, water supply wells,
mines and quarries, intermittent streams, un-bermed drainage ditches, or public water wetlands;
f) Apply at a rate to preclude runoff or ponding of liquid manure during the application process; and
g) Notify the MPCA within 24 hours of the emergency application. [Minn. R. 700L01501

12.2 The requirements of thispart only apply when manure ownership Is not transferred. [Minn. R. 70201
12.3 The Permittee shall comply with the following land application of manure setbacks for sensitive features located within

12A Open Tile Intakes - Manure application Is prohibited within 200 feet of an open tile intake unless one of the following
protective measures is employed;
a) Manure is injected or incorporated prior to rainfall or within 24 hours (whichever occurs first) within 300 feet of the
open the intake;
b) Manure is not applied within 100 feet of the open the intake and a one rod (16.5 feet) perennial grass buffer exists
around the open the intake; or
c) A 35 foot perennial grass buffer exists around the open the Intake and manure is not applied to the buffer. [Minn. R.

12.5 Drainage Ditches - Manure application Is prohibited within 300 feet of a drainage ditch unless one of the fallowing
protective measures is employed;
a) A protective berm prohibits runoff from directly entering the drainage ditch such that runoff must travel at least 300
feet, measured from the nearest point of manure application, before entering the drainage ditch;
b) Manure is not applied within 25 feet of the drainage ditch and manure is Injected or incorporated prior to rainfall or
within 24 hours (whichever occurs first) within 300 feet of the drainage ditch. Additionally soil phosphorus levels must
be managed so that levels do not increase beyond 21 ppm (Bray 121) or 16 ppm (Olsen) within any six year period;
e) Manure is not applied within 10D feet of the drainage ditch and a one rod (16.5 feet[ perennial grass buffer exists
along the drainage ditch; or
d) A 50 foot perennial grass buffer exists along the drainage ditch and manure Is not applied to the buffer. [Minn. R.

stream or public waters wetland unless one of the following protective measures is employed:
a) Manure is not applled within 25 feet of the intermittent stream or wetland and manure is injected or incorporated
prior to rainfall or within 24 hours (whichever occurs first) within 300 feet of the Intermittent stream or wetland,

12.9 Sinkholes - Manure application is prohibited within 300 feet of a sinkhole unless one of the following protective
measures is employed:

a) Manure is not applied within 100 feet of the sinkhole and is Injected or incorporated prior to rainfall or within 24
hours (whichever occurs first) within 300 feet of the sinkhole; or

Road Ditches - Manure application is prohibited within road ditches. When manure is applied near a road ditch that is
also an intermittent stream or drainage ditch, the requirements applicable to Intermittent streams or drainage ditches

13.1 Requirements for Operation and Maintenance of the Facility. [Minn. R. 7020
13.2 For any facility meeting the definition of New Source, the Permittee shall ensure th2t the production area is designed,
constructed, operated, and maintained to contain all manure, manure -contaminated runoff, or process wastewater, and
all direct precipitation. 40 CFR 412, Minn. R. 7020.2003]
13.3 For any facility the does not meet the definition of New Source, the Permittee shall ensure that the production area is
designed, constructed, operated, and maintained to contain all manure, manure -contaminated runoff, or process
wastewater, and the direct precipitation from a 25-year, 24-hour storm event as defined by the Precipitation
frequency Atlas of the United States, National Oceanic and Atmospheric Administration. (40 CFR 412, Minn. R.
7020.2003
13.4 The Permittee shall operate and maintain the facility in accordance with the application materials, all MPCA approved
plans and specifications, and the requirements of this Permit, Approved plans and specifications include any proposed
plans and specifications submitted with the current application for permlt coverage and any plans and specifications for
an existing facility component that have been previously approved by the MPCA. [Minn. R. 7001,01501
13.5 The Permittee shall operate and maintain any required facility monitoring equipment In accordance with the MPCA
_ approved monitoring plan. [Minn. R, 7001,01501
13.6 The Permittee is prohibited from discharging, depositing, or otherwise placing any substance Into a manure storage
areas) except manure, process wastewater, manure -contaminated runoff, or direct precipitation unless expressly

The Permittee is prohibited from discharging from the animal mortality area to surface or ground waters of the state, or

When manure is used as compost medium for an animal mortality composting area, the requirements of Minn. R.
7020.2125 for manure stockpiles shall apply, [Minn. R. 70201
13,11
The Permittee is exempt from ambient air quality standards during agitation and removal of manure from the facility If
the Permittee has notified the MPCA in writing prior to commencement of the agitation and removal of manure. The
written notification shall be via letter or electronic mail and must include the following:
a) The names of the owners or the legal name of the facility;
h) The location of the facility by county, township, section, and quarter section;
c) The facility's feedlot registration number; and
d) The anticipated start date and the anticipated number of days of removal of manure -
The maximum cumulative exemption days claimed by the Permittee shall not exceed 21 days per calendar year. [Minn.

13.12
For temporary closure of a facility component, the Permittee shall, within one year of ceasing operation of the
component, remove all manure from the component. The Permittee shall maintain permit coverage for the facility,
including the temporarily closed component. [Minn. R. 7001,01501
13,13
The Permittee may establish a short-term manure stockpile at the facility in conjunction with manure pack removal
activities from animal holding areas without the need to modify coverage under this Permit, provided the manure is
stockpiled for fewer than 10 consecutive days, and no more than 6 times per calendar year. This does not release the
Permittee from cam Hance with the effluent limitations of this Permit. [Minn. R. 7001.01501
Additional Requirements for Operation and Maintenance of Llquld Manure Storage Areas (LMSA). [Minn. R. 7020]

For open-air LMSAs the Permittee shall install and maintain a visual marker that clearly Indicates the freeboard of the
LMSA. For covered LM5As, including those that are below a barn, the Permittee shall develop and employ a system to
measure and monitor the liquid level in the LMSA such that the freeboard of the LMSA Is maintained. [40 CI"R 412.371
14.5
The Permittee shall notify the MPCA staff, via telephone or electronic mail, within 24 hours of encroachment into the
freeboard of the LMSA. The notification must include the approximate depth of storage space remaining, an estimated
time'line for manure or process wastewater removal from the LMSA, and the date when the freeboard encroachment
began. Notification under this part does not release the Permittee from the obligation to maintain the freeboard of a
LMSA. [Minn. R. 7001.0150]
14.6
For anaerobic digesters, the Permittee shall notify the MPCA via telephone or electronic mail within three business days
whenever manure must circumvent the anaerobic digester and be deposited Into a LMSA that does not have an
Impermeable cover. The notification must include the reasons far the interruption of service as well as the start and
anticipated end date. This does not release the Permittee from the state ambient air quality standards for hydrogen
sulfide. [Minn. R. 7001.0150]

14.7 When a LMSA undergoes temporary closure, the Permittee shall comply with the following:
a[ Maintain, at a minimum, a two -foot depth of manure and/or water in a LMSA to provide protection from damage
caused by freezing temperatures.
b) Maintain the LMSA in accordance with the MPCA approved plans and specifications and the requirements of this
Permit, including maintenance of the required freeboard; and
c) Prior to using any LMSA that has been unused for three years or more, a professional engineer must evaluate and
prepare a report on the condition of the liner. The MPCA must review and approve the report prior to using the LMSA.

16.5 When leachate and feed storage area runoff is managed with a vegetated infiltration basin, the Permittee shall perform
the following operation and maintenance activitles:
a) Clean out and repair structures that contain and convey contaminated liquids on an annual basis;
b) Remove accumulated solids from solids settling areas when the depth of solids exceeds one foot;
c) Repair channel/rill erosion;
d) Re-establish vegetation that has been damaged or destroyed; and
e) Harvest vegetation at least two times per year. The preferred method of harvesting Is by mechanical means; however,
grazing by animals can be utilized provided it is limited to no more than three grazing periods per year, with each grazing
period lasting no more than five days,
When 1,000 or more tons of sweet corn silage is stored at the facility, the Permittee is prohibited from using a vegetated
infiltration basin as a leachate and contaminated runoff control structure. [Minn. R. 7001,0150)

19.2 IThe Permittee shall make the following inspections for any LM5A at the facility according to the schedule Indicated and
after any rainfall event exceeding the 25 year, 24 hour storm event:
a) A weekly visual inspection of the LM5A and any devices channeling manure -contaminated runoff to the LM5A to
assess conformance to the approved plans and this Permit;
b) A weekly visual inspection of the liquid level and Freeboard marker in each LMSA to ensure that adequate freeboard Is
maintained;
c) For LMSAs with a perimeter drain tile, a monthly examination of the monitoring port or drain tile outlet for water flow
and signs of discoloration or odor in any water flowing in the drain tile;
d) For anaerobic digesters, in addition to the Inspections for LMSAs above, the Permittee shall conduct a weekly visual
inspection of any digester system to assess Its performance and to check for system malfunctions. 140 CFR 412.37]
1$3 Any repair to the liner of a LM5A must be approved by the MPCA prior to commencement of the repair and the
Permittee shall submit plans and specifications prepared by a design engineer if requested by the MPCA. [Minn. R.

19.1 Correction of Deficiencies Discovered During Required Inspections. (Minn. R. 70201
19.2 The Permittee shall correct any deficiencies found as a result of the Inspections required by this Permit within 30 days,
or within a shorter tlmeframe when required elsewhere in this Permit, unless one of the following apply:
a) Construction is required that cannot be effectively performed during the winter season;
b) The activity to correct the deficiency requires a permit modification or permit Issuance;
c) A piece of equipment/part required to correct the deficiency cannot be manufactured and installed within 30 days; or
d) Other reasons beyond the control of the Permittee. 140 CFR 412.37
19.3 The Permittee shall notify the MPCA within 20 days of discovery of any deficiency if an extended period of time is
needed to correct the deficiency. The notice shall include an explanation for the delay and indicate the expected period
of time needed to correct the deficiency. This notification does not preclude the MPCA from taking any administrative or
legal actions to cam el cam liance. Minn. R. 7001.10501
20.1 Permanent Closure, [Minn. R. 7020]
20.2 Within one year after permanently ceasing operation of a facility component, the Permittee shall remove, from the
closed component, all manure and any soils visibly contaminated by manure, [Minn. R.7020.2-025]
20.3 The Permittee shall notify the MPCA via telephone or electronic mail within 3 business days of completion of manure
and contaminated soils removal and prior to filling/covering the area previously occupied by the closed component.

20.4
The Permittee shall, after removing manure and manure -contaminated soils from the closed component, reduce soil
nitrogen by growing alfalfa, grasses, or other perennial forage for at least five years unless:
a) the component is, or is within, a building that will not be demolished;
b[ the liner/floor/base of the component was concrete or asphalt that will not be removed;
c) a structure or other impervious surface will be constructed over the area occupied by the component within 60 days;
or
d) the component was a LMSA.
The alfalfa, grasses, or other perennial forage must be established as soon as practicable within the current growing
season or at the start of the following growing season when manure removal happens after September 30th. [Minn. R.
20.5 within 60 days after compieting the requirements for permanent closure of an animal holding area or manure storage
area, the Permittee shall provide written notification to the MPCA that the closure requirements have been completed.
When closure requires growing alfalfa, grasses, or other perennial forage for at least five years, this notification shall be
provided within 60 days of initial establishment of the vegetation, [Minn, 7020,2025)

21.2 Except where specifically noted, the Permittee shall retain all records/reports/submittals required by this Permit for a
minimum of six years. This retention period shall be automatically extended during the course of any legal or
administrative proceedings or when so requested by the MPCA. Documents shall be maintained at the facility or at the
Permittee's business address, The Permittee shall make all documents available for examination and copying upon
request of the MPCA or county feedlot officer (CFO) and shall, upon request, submit any documents to the MPCA or CFO

21.3 The Permittee shall maintain the following facility maintenance records:
a) A description of any modifications, or damage and repair, to the manure collection, containment, and storage
components,
b) Any significant activities that alter the nature of the facility or that would increase the likelihood of discharge from the
facility or potential for groundwater pollution; and
c) Any other factors affecting compliance with the requirements of this Permit. [Minn. R, 7001.01501
21.4 The Permittee shall either maintain records of the dates and amounts for all precipitation events when manure Is
exposed to precipitation, including 24 hours prior to and following land application events, or direct the MPCA to data
maintained by governmental agencies or educational institutions. [40 CFR 412.37] _
21.5 The Permittee shall maintain records of the results of any inspections required by this Permit, including any deficiencies
found and documentation of any actions taken to correct deficiencies, including the discovery date and the date when
corrective measures were completed. For any deficiencies not corrected within 30 days of discovery, the documentation
must Include an explanation as to why the corrections were not made within the 30-dyperiod[Minn. R. 7001,01501

21.6 The Permittee shall retain records of the written requests for exemption from the ambient air quality standards during

21.7 The Permittee shall retain records of manure application activities, Including instances of transferred ownership. The

21.8 The Permittee shall retain the records pertainfng to any required facility monitoring as Identified in the MPCA-approved

22.2 The Permittee shall submit annual report : Due annually, by the 1st of March. The Permittee shall submitthe annual
report to the MPCA regarding facility activities which occurred in the previous calendar year, The Permittee must use the
"Animal Feedlot Or Manure Storage Area Annual Report (wq-f3-22b)" farm or use a format determined by the MPCA,

22.3 The standardized form identifies the information required for the annual report, which at a minimum includes the
requirements of 40 CFR 122,42 (e)(4) and land application records. [40 CFR 122.421
22.4 When one permit coverage is Issued to multiple registered feedlots, the Permittee shall submit one annual report form

23.2 The Permittee shall not discharge from the facility, by overflow or other means, manure, manure -contaminated runoff,
or process wastewater to a sinkhole, fractured bedrock, well, surface file intake, mine, quarry, or other natural or
constructed channels that convey fluids to groundwater_[Minn. R, 7020.2003]
23.3 The Permittee shall not discharge manure, manure -contaminated runoff, or process wastewater from a land application
area, except where the discharge is an agricultural stormwater discharge as defined by this Permit. This requirement
does not apply when manure ownership is transferred, [40 CFR 122.23j
23.4 For any facility meeting the definition of New Source, the Permittee shall not discharge manure, manure -contaminated

overflow of manure or process wastewater is caused by a precipitation event and the facility is in compliance with the

24,2 The Permittee shall Immediately report by telephone to the State Duty Officer (800-422-0798) and the MPCA any
discharge, spill, or overflow of manure, process wastewater, or manure -contaminated runoff, Including those authorized

24.3 When a discharge, spill, or overflow occurs, whether authorized by this Permit or not, the Permittee small take all actions
necessary to minimize that discharge, spill, or overflow, to recover the material released, and to mitigate impacts to

Within five days of any discharge, spill, or overflow, the Permittee shall submit a written statement to the MPCA that
Includes the following informatlom
a) Cause of discharge, spill, or overflow, such as precipitation (inches of rain or snow per day) or other cause e.g.,
structural failure, equipment breakdown);
b) A description and approximate volume of any discharge, spill, or overflow;
c) Location and name, if available, of the vulnerable drinking water supply management area (i]WSMA), surface water
source DW5MA, waterway, dry ditch, gully, creek, stream, pond, lake, river, or other waters of the state receiving the
discharge, spill, or overflow;
d) Corrective steps being taken to reduce or eliminate and prevent a recurrence of a non -permitted discharge, spill, or
overflow;
e) The period of time the discharge, spill, or overflow occurred Including exact dates and times or, if still occurring, the
anticipated time the discharge, spill, or overflow will continue; and
f) Name of person reporting the discharge, spill, or overflow.tMlnn. R, 7001,01501
24.5 The Permittee shall ensure that all discharges, spills, or overflows associated with the facility do not cause or contribute
to non -attainment of applicable state water quality standards. [40 CFR 122.441

25.2 An owner of a facility is not ellglble for coverage under this Permit and must obtain coverage under an individual NPDE5
permit when any of the following apply:
a) a schedule of compliance is required to address a pollution hazard;
b) special conditions are required as the result of environmental review;
c) a new technology for construction or operation which is not addressed by this Permit is proposed;
d) removal of bedrock is proposed to comply with site restrictions under Minn. R. 7020,2100;
e) feed for animals will be brokered or sold at the facility;
f) the facility, including the feed storage area, does not meet the design standards of Minn. R. ch, 7020 and this Permit;
g) the MPCA determines that the facility operations would be more appropriately controlled by an individual permit;
h) the owner is proposing to land apply manure in a manner that is not consistent with the requirements of this Permit;
1) the owner is proposing to use a vegetative Infiltration basin (VIB) to control runoff from an open lot or manure
storage area; or
j) the MPCA determines that discharges from a facility or the land application areas under the Permittee's control have
the potential to cause or contribute to non -attainment of applicable water quality standards. [Minn. R. 7001.02101
26.1 General Conditions. (Minn. R. 7020)
2U Compliance with other laws - The agency's issuance of a permit does not release the Permittee from any liability,
penalty, or duty imposed by Minnesota or federal statutes or rules or local ordinances, except the obligation to obtain
the permit. [Minn. R. 7001.0150) _
263 Future rules and standards - The agency's issuance of a permit does not prevent the future adoption by the agency of
pollution control rules, standards, or orders more stringent than those now in existence and does not prevent the
enforcement of these rules, standards, or orders against the Permittee. Minn. R. 7001.01501
26.4 Property right -The permit does not convey a property right or an exclusive privilege. [Minn. R. 7001.01501

26.5 Agency obligation - The agency's Issuance of a permit does not obligate the agency to enforce local laws, rules, or plans
beyond that authorized by Minnesota statutes- [Minn_R_7001.0150]
26.6 Permitted actions - The Permittee shall perform the actions or conduct the activity authorized by the permit in
accordance with the plans and specifications approved by the agency and in compliance with the conditions of the
ermit, [Minn. R. 7001.01501
26.7 System reliability - The Permittee shall at all times properly operate and maintain the facilities and systems of treatment
and control and the appurtenances related to them which are installed or used by the Permittee to achieve compliance
with the conditions of the permit. Proper operation and maintenance Includes effective performance, adequate funding,
adequate operator staffing and training, and adequate laboratory and process controls, including approprlate quality
assurance procedures. The Permittee shall install and maintain appropriate backup or auxillary facilities if they are
necessary to achieve compliance with the conditions of the permit and, for all permits other than hazardous waste
facility permits, if these backup or auxillary facilities are technically and economically feasible_(Minn.R. 7001.01501
26.8 False information -The Permittee may not knowingly make a false or misleading statement, representation, or
certification in a record, report, plan, or other document required to be submltted to the agency or to the commissioner
by the permit. The Permittee shall immediately upon discovery report to the commissioner an error or omission in these
records, reports, plans, or other documents. [Minn, R. 7001.01501
26.9 Submittals - The Permittee shall, when requested by the commissioner, submit within a reasonable time the information
and reports that are relevant to the control of pollution regarding the construction, modification, or operation of the
facility covered by the permit or regarding the conduct of the activity covered by the permit. (Minn. R. 7001.0150]
26.10 Right of Entry - When authorized by Minnesota Statutes, sections 115,04; 1158.17, subdivision 4; and 116,091, and upon
presentation of proper credentials, the agency, or an authorized employee or agent of the agency, shall be allowed by
the Permlttee to enter at reasonable times upon the property of the Permittee to examine and copy books, papers,
records, or memoranda pertaining to the construction, modification, or operation of the facility covered by the permit or
pertaining to the activity covered by the permit; and to conduct surveys and investigations, including sampling or
monitoring, pertaining to the construction, modification, or operation of the facility covered by the permit or pertaining
to the activity covered by the permit. (Minn. R. 7001.01501
26.11 Steps to minimize non-compliance impacts - If the Permittee discovers, through any means, including notification by the
agency, that noncompliance with a condition of the permit has occurred, the Permittee shall take all reasonable steps to
minimize the adverse impacts on human health, public drinking water supplies, or the environment resulting from the
noricompliance. [Minn. R.7001,0150]
26.12 Non-compliance notification - If the Permittee discovers that noncompliance with a condition of the permit has occurred
which could endanger human health, public drinking water supplies, or the environment, the Permittee shall, within 24
hours of the discovery of the noncompliance, orally notify the commissioner. Within five days of the discovery of the
noncompliance, the Permittee shall submit to the commissioner a written description of the noncompliance; the cause
of the noncompliance; the exact dates of the period of the noncompliance; if the noncompliance has not been
corrected, the anticipated time it is expected to continue; and steps taken or planned to reduce, eliminate, and prevent
reoccurrence of the noncompliance. [Minn. R. 7001.0150]
26A3 Non-compliance report - The Permittee shall report noncompliance with the permit not reported as a part of the next
report which the Permittee is required to submit under this Permit. if no reports are required within 30 days of the
discovery of the noncompliance, the Permittee shall submit the report within 30 days of the discovery of the
noncompliance, [Minn, R_ 7001.0150]
26.14 Advance notice of potential non-compliance - The Permlttee shall give advance notice to the commissioner as soon as
possible of planned physical alterations or additions to the permitted facility or activity that may result in noncompliance
_ with a Minnesota or federal pollution control statute or rule or a condition of the permit. [Minn. R, 7001,01501
26.15 permit transfer - The permit is not transferable to .any person without the express written approval of the agency after
compliance with the requirements of Part 7001.0190. A person to whom the permit has been transferred shall comply
with the conditions of the ep rmit. [Minn. R. 7001,0150)

26.16 Liability - The permit authorizes the Permittee to perform the activities described in the permit under the conditions of
the permit- In issuing the permit, the state and agency assume no responslbility for damage to persons, property, or the
environment caused by the activities of the Permittee in the conduct of its actions, including those activities authorized,
directed, or undertaken under the permit. To the extent the state and agency may be liable for the activities of its
employees, that liability is explicitly limited to that provided in the Tort Claims Act, Minnesota Statutes, section 3.736.

26.17 Duty to Prevent and Mitigate - The Permittee shall notify the agency immediately of the discharge, accidental or
otherwise, of any substance or material under its control which, if not recovered, may cause pollution of waters of the
state, and the responsible person shall recover as rapidly and as thoroughly as possible such substance or material and
take immediately such other action as may be reasonably possible to minimize or abate pollution of waters of the state
caused thereby. [Minn. Stat. 115.061]
26.18 Need to Halt or Reduce Activity Not a Defense - It shall not be a defense for a Permittee in an enforcement action that it
would have been necessary to halt or reduce the permitted activity In order to maintain compliance with the conditions
of this Permit. 140 CFR 122.41]
26.19 Civil and Criminal Liability - Nothing in this Permit shall be construed to relieve the Permittee from civil or crlm€nal
penalties for noncompliance with the terms and conditions provided herein. [Minn. R. 7001]
26.20 5everability - The provisions of this Permit are severable, and if any provision of this Permit or the application of any
provision of this Permit to any circumstance is held invalid, the application of such provision to other circumstances, and
the remainder of this Permit shall not be affected therebt[Minn. R. 70011
26.21 Discharge Monitoring Reports - This Permit requires the submittal of annual reports in lieu of discharge monitoring
reports as the Permittee is not authorized to discharge to surface waters except as provided in Minn. R. 7020.2003,
sub . 2, which references 40 CFR pt. 412. (40 CFR 4121
26.22 Availability of Reports - Except for data determined to be confidential under Minn. 5tat. 116,075, subd. 2, all reports
prepared In accordance with the terms of this Permit shah he avallable for public inspection at the offices of the MPCA.
Procedures for submitting such confidential material shall be pursuant to Minn. R. 7000. Monitoring data shall not be
considered confidential. Knowingly making any false statement on any such report may result in the imposition of
criminal penalties as provided for in Minn, Stat, 115,071, subd. 2. [Minn. R. 7000,12001 _
27.1 Definitions. [Minn. R. 70201
27.2 "Agency" means the Minnesota Pollution Control Agency, as constituted pursuantto Minn, Stat. 116.02. [Minn. R.
7020.0300] _
27.3 "Agricultural Stormwater" means a precipitation -related discharge of manure, litter or process wastewater from land
areas under the control of a CAFO where the manure, litter or process wastewater has been applied in accordance with
site specific nutrient management practices that ensure appropriate agricultural utilization of the nutrients in the
manure, litter or process wastewater, as s ecp ified In 40 CFR 122A2je)(1)(vi)-(Ix)_[40 CFR 122.23] _
27.4 "Anaerobic Digester" means a liquid manure storage area that Is constructed with the Intent to capture and combust gas
emissions resulting from the digestion of waste by microbes in anaerobic conditions. An anaerobic digester is a LMSA
and is required to comply with all requirements applicable to LMSAs. Requirements specific to anaerobic digesters will
be noted when applicable. [Minn. R. 7020]
27.5 "Animal Feeding Operation" ("AF0") means a lot or facility (other than an aquatic animal production facility) where
animals have been, are, or will be stabled or confined and fed or maintained for a total of 45 days or more in any 12-
month period, and crops, vegetation, forage growth, or post -harvest residues are not sustained in the normal growing
season over any portion of the lot or facility. [40 CFR 122 23]_
27.6 "Animal Feedlot" means a lot or building or combination of lots and buildings intended for the confined feeding,
breeding, raising, or holding of animals and specifically designed as a confinement area in which manure may
accumulate or where the concentration of animals Is such that a vegetative cover cannot be maintained within the
enclosures. For the purposes of this Permit, open lots used for the feeding and rearing of poultry (poultry ranges) shall
be considered to be animal feedlots, Pastures shall not be considered animal feedlots under this Permit. [Minn, R.
7020.0300]
27.7 "Animal Manure" or "Manure" means poultry, livestock, or other animal excreta or a mixture of excreta with feed,
bedding, precipitation, or other materials, (Minn. R. 7020,03001

27.8 "Application Materials or Permit Application" means all information submitted by the applicant for coverage under this
permit and relied upon by the MPCA to make a decision on the request for permit coverage, This includes but is not
limited to the application form, manure management plan, plans and speciflcatlons for facility components, emergency
response plan, and required monitarin tans as a roved b khe MPCA. [Minn, R. 7001]
27.9 "Approved Plans or MPCA Approved" means any previously approved plans/documents or new/revised
tans/documents required bythis Permit that receivL�pproval from the MPCA. [Minn. R. 70011
27,10 "Best Management Practices" ("bMPs") means schedules of activities, prohibitions of practices, maintenance
procedures, and other management practices to prevent or reduce the pollution of waters of the state. BMPs also
include treatment requirements, operating procedures, and practices to control site runoff, spillage or leaks, sludge or
waste disposal, or drainage from raw material storage. [Minn. R. 70011
27.11 "Closure" refers to the cessation of use of all or any part of the facility, Including:
a) The removal of livestock or poultry from all or any of the animal holding areas located within the production area; and
h) The discontinuation of a structure or area located within the production area to handle, store, or treat manure.

27,12 "Coarse -textured Soils" means fields that have at least 33 percent of the surface soil and/or subsoil (within three (3) feet
of the surface) with one of the following coif texture types: sand, loamy sand, loamy coarse sand, fine sand, loamy fine
sand, coarse sand, or very fine sand. [Minn. R. 70011 _
27.13 "Commencement of Construction" means to begin or cause to begin, as part of a continuous program, the placement,
assembly, or installation of facilities or equipment; or to conduct significant site preparation work, including clearing
excavation or removal of existing buildings, structures, or Facilities, necessary for the placement, assembly, or
installation of facilities; or equipment at a new or expanded animal feedlot or a new, modified, or expanded manure
storage area. [Minn. R. 7020.03001
27.14 "Commissioner" means the Commissioner, or other MPCA staff authorized by the Commissioner, of the MPCA, as
described in Minn. $tat. 116,03, as amended. [Minn. R. 7020.0300] _
27.15 "Concentrated Animal Feeding Operation" ("CAFO") means an AFO that is defined as a Large CAFO or as a Medium CAFO
by the terms of 40 CFR 122.23(b)(2), or that is designated as a CAFO in accordance with 40 CFR 122.23(c). [Minn. R.
7020,03001 —.
27.16 "Corrective or Protective Measure" means a practice, structure, condition, or combination thereof that prevents or
reduces the discharge of pollutants from an animal feedlot or manure storage area to a level in conformity with MPCA
rules. Minn. R. 7020,0300]
27.17 "Design Engineer or Professional Engineer" means an engineer licensed En the state of Minnesota or a MRCS staff person
having MRCS approval authority for the project, [Minn. R. 7020.03001
77.18 "Discharge" means the addition of a pollutant to waters of the state, including a release of animal manure or process
wastewater from an animal holding area, manure storage area, or a manure land application site by leaking, pumping,
pouring, emitting, emptying, dumping, escaping, seeping, leaching, or any other means. Discharge includes both point
_ source and non oint source discharges. [Minn. R. 7020,03001 _
2.7,19 "Emergency Manure Application" Emergency manure application means instances of land application of manure that are
the direct result of situations beyond the control of the Permittee, such as unusual weather conditions, unavoidable
equipment failure, or other circumstances that could not have been avoided with proper planning and management and
there Is no opportunity to provide temporary storage within another approved manure storage area at the facility, In
these situations, only the applicatlon of the volume of manure that Is necessary to prevent manure storage overflow is
considered to be emergency manure application. [Minn. R. 7001� _
27,20 "Facility" means an animal feedlot, a manure storage area, or an animal feedlotwith a manure storage area that is
subject to this Permit. [Minn. R, 7020.03001 _ _ _

"Feed Storage Area" means a designated area at the production facility, paved or unpaved, covered or uncovered, that is
utilized for storage of any materials used to create the rations for livestock. Also included are those areas used to store
spoiled, spilled, or other unused rations for livestock. For purposes of this Permit, "feed storage area" does not include
buildings or roofed structures that contain dry commodities, provided that precipitation does not came into contact With
the commodities stored inside the structure. "Feed storage area" does not inciude areas used for the storage of hay
bales and other absorbent materials which do not create contaminated leachate and do not create a pollution hazard.

27.22 "Feed Storage Area Runoff' means liquid that leaves the Feed storage area that is the result of precipitation on the
feedstocks or on the surrounding feed storage area where residual feed is present. This does not include water that
flows off of the tarp/roof of a feed storage, unless that liquid is allowed to come into contact with feedstocks, residual
feed, or other liquid that has come Into contact with feedstocks or residual feed, This liquid is not starmwater and
should not be allowed to directly enter waters of the state, tile Intakes, or stormwater collection/mitigation area
(stormwater ponds, etc.). [Minn. R. 7001]
27,23 "Incorporate or Incorporation" means applying manure using Injection, disking Into the soil, tilling the soil after
application, or using other practices that result in a majority of the manure being placed below the ground surface
within 24 hours of apAplication and prior to rainfall. [Minn. R. 70011
27.24 "Intermittent Stream" means all watercourses identified as intermittent streams on united States Geological Survey
quadrangle maps. [Minn. R. 7020.03001
27.25 "Land Application Area" means land under the control of an AFO owner or operator, whether it is owned, rented, or
leased, to which manure, litter, or process wastewater from the production area Is or may be applied. [Minn. R. 7001]
27.26 "Liquid Manure" means manure that does not meet the definition of solid manure. Process wastewater and manure -
contaminated runoff are considered to be liquid manure. [Minn. R. 7020,03001
27.27 "Liquid Manure Storage Area" ("LMSA") means an area where liquid animal manure and process wastewaters are stored
or processed. [Minn. R, 7020.03001 _
27.25 "Manure -contaminated Runoff" means a liquid that has come into contact with animal manure and drains over land
from any animal feedlot, manure storage area, or animal manure land application site. [Minn. R, 7020.0300] _
27.29 "Manure Storage Area" means an area where anlmal manure or process generated wastewater are stored or processed
Short-term and permanent stockpile sites and composting sites are manure storage areas. Animal manure packs or
mounding are not manure storage areas provided they are managed in accordance with Minn. R. 7020.2000, subp. 3,
[Minn. R. 7020.0300]
27.30 "MPCA" means the Minnesota Pollution Control Agency or Minnesota Pollution Control Agency staff as delegated by the
Minnesota Pollution Control Agency. Minn. R, 7001]
27.31 "Modification" means a change to a facility component or operational practice described, required, or authorized by this
Permit, Including an expansion. Major and minor modifications are described by Minn. R. 7020.0300 and Minn. R.
7001,0190. A change to a facility component or operational practice that Is not described, required, or authorized by a
permit Is not a modification, including changes to;
a) the type of crop or manure application rate if consistent with the methodology portion of the manure management
plan and reflected in required records;
b) routine maintenance;
c) feeding or milking schedules;
d) animal diets;
e) bedding materials so long as consistent with approved plans and specifications;
f) equipment used to clean the facility so long as consistent with approved design plans and specifications;
g) lands used as pasture; or
h) facility components not Involved directly in animal or manure management such as an office or machine shed. [Minn.
R. 7020.03001
27.32 "MPS" means the Unlversi of Minnesota Extension System. [Minn. R. 7001] _
77.33 "National Pollutant Discharge Elimination System Permit" or "NPIDES" means a permit Issued by the MPCA as required by
federal law for the purpose of regulating the discharge of pollutants from point sources into waters of the United States
from concentrated animal feeding operations (CAFOs) as defined by federal law. [Minn. R. 7020.03001

27.34 "New Source" means a swine, poultry, or veal calf facility that began construction after December4, 2008, and Is subject
to a new source performance standard in 40 CFR pt. 412 prohibiting discharges from the production area. [40 CFR 122.21
27.35 "NRC5 means the Natural Resources Conservation Service. [Minn. R. 70011
27.36 "Overflow" means the release of manure or process wastewater resulting from the filling of wastewater or manure
storage structures beyond the point where manure, process wastewater, or stormwater can be contained by the
structure, IMinn, R. 70011
27.37 "Owner" or "Owners" shall mean all persons having possession, control, or title to an animal feedlot or manure storage
area as defined by Minn. R. 7020.0300, subp. 17. [Minn. R. 7020.0300) ,
27.38 "permanent Closure" means ceasing operation of all or any part of the facility with the intent that the animal holding
area(s) and/or manure storage area(s) will no longer be used for that purpose. [Minn, R. 70201
27.39 "Permanent Manure Stockpile" means a solid manure storage area where manure is stored or processed that does not
meet the regi ulrements of Minn. R. 7020.2125, sub.. 2, for short-term stockpiles. [Minn. R. 7020.03001
27,40 "Permitwee" means the owner or owners or any person or group of persons including, but not limited to, a single
Individual, manager, partnership, limited partnership, cooperative, or any form of corporate entity that has possession
or control or title to the feedlot granted coverage under this Permit in accordance with the MPCA-approved application
materials, [Minn. R. 70011
27.41 "Probability of Rainfall" means National Weather Service statistical predictions (may be found at the website:
http://www.weather.gov/mdI/synop/preducts.phpi Mlnn_ R.7001]
27.42 "Process Wastewater" means waters and/or precipitation, including rain or snow, which comes Into contact with
manure, litter, bedding, or other raw material or Intermediate or final material or product used in or resulting from the
_ raductio_n of animals, poultry, or direct products such as milk or eggs. [Minn. R. 7020.0300]
27.43 "Production Area" means that part of the animal Feeding operation that includes the animal confinement area, the
manure storage area, the raw materials storage area, and the waste containment areas. The animal confinement area
includes, but is not limited to, open lots, housed lots, feedlots, confinement houses, stall barns, free stall barns, calf
huts/hutches, milkrooms, milking centers, egg washing or egg processing areas, areas used for the storage and
disposal/treatment of mortalities, cowyards, barnyards, medication pens, walkers, animal walkways, and stables. The
manure storage area includes, but is not limited to, lagoons, runoff ponds, storage sheds, stockpiles, under -house or pit
storages, liquid impoundments, static piles, and composting piles. The raw materials storage area includes, but is not
limited to, Feed silos, and silage bunkers. The waste containment area Includes, but Is not limited to, settling basins and
areas within berms and diversions_ which separate uncontaminated stormwater, [40 CFR 412.21
27.44 "Short-term Manure Stockpile" means a manure storage area where manure is stored or processed according to Minn.
R, 7020.2125, subp, l to 3_ [Minn. R. 7020.0300] -
27.45 "Sinkhole" means a surface depression caused by a collapse of soil or overlying formation above fractured or cavernous
bedrock. [Minn. R, 7020.03001
27.46 "Soil Temperature" means a thermometer reading at a depth of six inches or as Indicated by the closest soil temperature
monitoring location available on the MDA soil temperature network available at https://app.gisdata.mn.gov/mda-
soiltemp/. [Minn. R. 7001)
27.47 "Solid Manure" means manure that has 15 percent or more solids, can be stacked at a 3:1 vertical to horizontal ratio,
_ and is handled as a solid product. [Minn, R, 7020]
27.48 "Spill" means the release of manure, manure contaminated runoff, or process wastewater from the confines of an
animal feedlot, manure storage area, manure transfer system, or other component used to collect, transfer, or store
manure, manure -contaminated runoff, or process wastewater that if not recovered would pollute waters of the state.
Spill includes releases from activities associated with land application that do not comply with this Permit. [Minn. R.
7001
27.49 "Special Protection Area" means land that is within 300 feet of all protected waters (lakes and streams) and protected
wetlands, identified on Department of Natural Resources (DNR) protected waters and wetlands maps and intermittent
streams and ditches identified on United States Geological Survey (USGS) quadrangle maps, excluding drainage ditches
with berms and segments of intermittent streams which are grassed waterways. [Minn. R. 7020.03001
27.50 "Temporary Closure" means ceasing operation of all or part of a facility with the intent of reusing the facility or portion
of the facility at a future date. Minn. R, 70201

27.51 "Waters of the State" means all streams, lakes, ponds, marshes, watercourses, waterways, wells, springs, reservoirs,

natural or artificial, public or private, that are contained within, flow through, or border upon the state or any portions

BACKGROUND/EXPLANATION OFAGENDA ITEM:
At our last council meeting we had a business owner address the City Council regarding their
concerns on the City's Smoke -Free Workplace Ordinance - Chapter 113.25 of our city code
(attached). In particular, concerned was raised on the regulation requirements that noted
smoking is prohibited within 15 feet of entrances, exits, open windows and ventilation intakes of
public places and places of work and any outdoor dining or bar areas of food establishments.
The request from the property owner was that the City extend the 15 feet regulation to 25 feet.
The City Council asked staff to put this item on a future council agenda for discussion.
Along with the City Code, I've also included a copy of Minnesota's Clean Indoor Air Act. This is
on for discussion only. Any potential ordinance changes would be brought back at a future
meeting.

SMOKE -FREE WORKPLACE REGULATIONS
§ 113.25 FINDINGS OF FACT AND PURPOSE.
(A) The City Council finds that:
(1) Tobacco smoke is a leading cause of disease in non-smokers and a major source of indoor air pollution.
Secondhand smoke causes premature death and disease in children and in adults. Secondhand smoke causes heart
disease, lung cancer, respiratory infections, decreased respiratory function and other health problems;
(2) In a 2006 report of the United States Surgeon General, U.S. Surgeon General Carmona concluded that "exposure
to secondhand smoke remains an alarming public health hazard" and that "more than 126 million non-smokers are still
exposed';
(3) Numerous nationally recognized medical and scientific authorities, including the American Medical Association, the
U.S. Surgeon General, the National Institute on Occupational Safety and Health, the National Cancer Institute, the
Environmental Protection Agency, the National Academy of Sciences, the National Toxicology Program and the World
Health Organization, have issued reports and health advisories addressing the adverse effects of exposure to secondhand
smoke;
(4) It is estimated between 24,300 and 71,900 low birth weight or pre -term deliveries, about 202,300 episodes of
childhood asthma (new cases and exacerbations), between 150,000 and 300,000 cases of lower respiratory illness in
children, and about 789,700 cases of middle ear infections in children occur in the United States each year as a result of
exposure to secondhand smoke;
(5) It is estimated that in the United States secondhand smoke causes about 46,000 (a range of 22,700 to 69,600)
deaths per year from cardiac -related illnesses (including 700 to 1,240 deaths among Minnesotans) and 3,400 deaths per
year from lung cancer;
(6) There is no known safe level of exposure to secondhand smoke; neither the separation of smokers and non-
smokers nor the introduction of new ventilation systems can eliminate the health hazards caused by secondhand smoke.
The scientific evidence indicates that there is no risk -free level of exposure to secondhand smoke. Eliminating smoking in
indoor spaces protects non-smokers from exposure to secondhand smoke. Separating smokers from non-smokers, cleaning
the air or ventilating buildings cannot eliminate exposure of non-smokers to secondhand smoke. The only means of
effectively eliminating health risks associated with indoor exposure is to prohibit smoking;
(7) Objective evidence does not support fears that restricting smoking in enclosed, indoor areas will harm a
community's economy. On the contrary, many independent economic studies have shown that the elimination of smoking
has no material economic impact on a community. These studies have drawn from the experience of hundreds of
communities that successfully eliminated smoking in workplaces and public places. Numerous U.S. cities, counties and
states and many nations have adopted laws ending all smoking in bars, restaurants and other public places;
(8) Business owners have no legal or constitutional right to expose their employees and customers to airborne toxins,
such as those found in secondhand smoke. On the contrary, employers have a common law duty to provide workers with a
workplace that is not unreasonably dangerous;
(9) Restricting smoke in public places and places of work can help to model smoke -free behavior and to reduce youth
exposure to secondhand smoke; and
(10) Public health policies, ordinances and other laws are part of the system by which people learn behaviors, guide
youth, reduce health threats and reinforce community norms that support the public's health.
(B) Accordingly, the City Council finds and declares that the purpose of this subchapter is to:
(1) Protect vulnerable populations, including employees, children, the elderly and those with chronic health conditions;
(2) Affirm that the right to breathe has priority over the desire to smoke; and
(3) Protect the public health, welfare and safety by better ensuring the ability of citizens to breathe safe and
uncontaminated air.

§ 113.26 DEFINITIONS.
For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a
different meaning.
FOOD ESTABLISHMENT. Any establishment, however designated, engaged in the preparation or serving of food or
beverages for consumption either on or off the premises, or anywhere consumption of food occurs on the premises. This
term includes any establishment, however designated, that has an on -sale 3.2% malt liquor license, an on -sale intoxicating
liquor license, an on -sale wine license and/or a strong beer liquor license issued by the state, the municipality within which it
is located, or the county.
OTHER PERSON IN CHARGE. The agent of the proprietor authorized to provide administrative direction to, and general
supervision of, the activities within a public place or place of work at any given time.
PLACE OF WORK. Any enclosed, indoor location at which two or more individuals perform any type of a service for
consideration of payment under any type of employment relationship including, but not limited to, an employment
relationship with or for a private corporation, partnership, individual or government agency. This term includes any location
where two or more individuals gratuitously perform services for which individuals are ordinarily paid. Examples of a PLACE
OF WORK include, but are not limited to, enclosed, indoor areas of an office, a factory, a hotel or motel (except rented
sleeping rooms), a vehicle, a warehouse and other locations where services are performed under an employment
relationship. Enclosed, indoor areas of a private club and rooms used for private meetings or social functions are PLACES
OF WORK if two or more persons acting under an employment relationship provide cleaning, catering, food or beverage
service, maintenance or other support services in such locations.
PROPRIETOR. The party who ultimately controls, governs or directs the activities within the public place or place of work,
regardless of whether the party is owner or lessee of the public place or place of work. PROPRIETOR may apply to a
corporation as well as an individual.
PUBLIC PLACE. Any enclosed, indoor area used by the general public or serving as a place of work including, but not
limited to, arenas, auditoriums, bars, bowling alleys, bingo halls, commercial establishments, educational facilities other than
public schools, as defined in M.S. § 120A.05, Subd. 9, 11 and 13, as they may be amended from time to time, hospitals,
offices and other commercial establishments, pool halls, public conveyances, restaurants, retail stores and common areas of
rental apartment buildings. PUBLIC PLACE also means the outdoor dining or bar area of food establishments.
SMOKING. The inhaling, exhaling or combustion of any tobacco product, weed, plant, cannabis, nicotine liquid or aerosol,
or any other similar article, including any cigar, cigarette, pipe or any other similar article. SMOKING includes possessing or
carrying a lighted cigar, cigarette, pipe or any other lighted or activated, smoking equipment. SMOKING does not include
the use of tobacco by an enrolled member of a federally -recognized Indian tribe as part of a traditional Indian spiritual or
cultural ceremony. This definition applies to the entire city code.

§ 113.27 PROHIBITIONS.
(A) Except as provided in division (B) below, smoking is prohibited in the following locations:
(1) Public places and places of work, including outdoor dining or bar area of food establishments;
(2) Within 15 feet of entrances, exits, open windows and ventilation intakes of public places and places of work; and
(3) Within 15 feet of any outdoor dining or bar areas of food establishments.
(B) The prohibitions of this section do not apply to the following places or situations:
(1) Private residences;
(2) Motor vehicles in private use;
(3) Motor vehicles that serve as a place of work for no more than one employee;
(4) Outdoor areas, except as provided in division (A) above;
(5) The use of tobacco by an enrolled member of a federally -recognized Indian tribe as part of a traditional Indian
spiritual or cultural ceremony; and
(6) A hotel or motel sleeping room rented to one or more guests.

§ 113.28 RESPONSIBILITIES OF PROPRIETORS AND OTHER PERSONS IN CHARGE.
The proprietor or other person in charge of a public place or place of work where smoking is prohibited shall:
(A) Post "No Smoking" signs that comply with the Minnesota Clean Air Act Rules, Minn. Rules part 4620.0500, as
amended from time to time;
(B) Ensure that ashtrays, lighters, matchbooks or other smoking paraphernalia are not provided in areas where smoking
is prohibited;
(C) Place any receptacles for the deposit of extinguished cigarettes, cigars, pipe tobacco and other smoking materials
more than 15 feet from entrances, exits, open windows and ventilation intakes of public places and places of work; and
(D) Ask any person who smokes in any area where smoking is prohibited to refrain from smoking and, if the person does
not refrain from smoking after being asked to do so, ask the person to leave. If the offending party refuses to leave, the
proprietor or other person in charge shall handle the situation consistent with lawful methods for handling other persons
acting in a disorderly manner or as a trespasser. Appropriate action shall include calling the Police Department for
assistance.

§ 113.29 PRIVATE PROHIBITIONS.
Nothing in this subchapter prevents the proprietor or other person in charge of any place, including, without limitation, any
residence, motor vehicle or outdoor space, from prohibiting smoking in any such place.

§ 113.30 RETALIATION PROHIBITED.
No person or employer shall discharge, refuse to hire, penalize, discriminate against or in any manner retaliate against any
employee, applicant for employment, or customer because the employee, applicant or customer exercises any right to a
smoke -free environment afforded by this subchapter or other law.

§ 113.31 EMPLOYEES RIGHTS PRESERVED.
An employee who consents to work in a setting where an employer allows smoking does not waive or otherwise surrender
any legal rights the employee may have against the employer or any other party.

§ 113.32 OTHER LAWS.
This subchapter is intended to supplement the State Clean Air Act, M.S. §§ 144.411 to 144.417, as they may be amended
from time to time. Nothing in this subchapter authorized smoking in any location where smoking is prohibited or restricted by
other laws.

§ 113.33 VIOLATIONS.
(A) Smoking where prohibited. It is a violation of this subchapter for any person to smoke in an area where smoking is
prohibited by this subchapter.
(B) Proprietor or other person in charge It is a violation of this subchapter for the proprietor or other person in charge of
any premises subject to this subchapter to fail to comply with the requirements of § 113.28 of this chapter or to retaliate
against an employee, applicant or customer as prohibited by § 113.30 of this chapter.
(C) Enforcement. The provisions of this subchapter shall be enforced by the Police Department or other enforcement
agency designated by the city.
(D) Injunctive relief. In addition to the penalties provided in §113.99 of this chapter, the City Attorney may bring a civil
action against the proprietor or other person in charge of a public place or place of work to enjoin repeated or continuing
violations of this subchapter.

§ 113.99 PENALTY.
(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to §
10.99 of this code of ordinances.
(B) (1) Licensees. Any licensee found to have violated this chapter, or whose employee shall have violated §§113.01
through 113.13 of this chapter, shall be charged an administrative fine of $75 for a first violation of §§113.01 through 113.13
of this chapter; $200 for a second offense at the same licensed premises within a 24-month period; and $250 for a third or
subsequent offense at the same location within a 24-month period, as well as a license suspension for not less than seven
days.
(2) Other individuals. Other individuals, other than minors regulated by division (13)(3) below, found to be in violation of
§§ 113.01 through 113.13 of this chapter shall be charged an administrative fee of $50.
(3) Minors. A minor found in unlawful possession of, or who unlawfully purchases or attempts to purchase, tobacco,
tobacco products or tobacco -related devices shall, if a first time offense, be referred to a diversion program operated by
appropriate city officials or, if a second or subsequent offense, be petitioned or ticketed into juvenile court as a petty offender
and receive disposition as is authorized by law and appropriate for petty offenders.
(4) Misdemeanor. Nothing in this section shall prohibit the city from seeking prosecution as a misdemeanor for any
violation of §§ 113.01 through 113.13 of this chapter.
(C) (1) A violation of any provisions of §§ 113.25 through 113.33 of this chapter shall be a petty misdemeanor for the
first offense. Any additional violation of §§ 113.25 through 113.33 of this chapter shall be a misdemeanor. Each day of
violation constitutes a separate offense.
(2) Violation of any provision of §§ 113.25 through 113.33 of this chapter by a licensee shall be adequate ground for the
denial, refusal to renew, suspension or revocation of any food, liquor or other business license.

Minnesota. Clean Indoor Air Act (MCIAA)
The Freedom to Breathe (FTB) provisions amended the Minnesota Clean Indoor Air Act (MCIAA) further protect
employees and the public from the health hazards of secondhand smoke. These provisions went into effect on
October 1, 2007. In 2019, the MCIAA was amended again to expand the definition of smoking to include vaping, the
use of electronic delivery devices (also known as e-cigarettes or vapes). The amendment is effective on August 1,
2019. On August 1, 2023, adult -use cannabis was legalized in Minnesota. Vaping and smoking cannabis products is
included in the definition of smoking underthe MCIAA. Minnesota's cannabis law and local ordinances have
additional requirements regardingthe use of these products in the indoor environment. For more information,

Public health issue
The United States Surgeon General states there is no risk -free level of secondhand smoke exposure. It is estimated
that since 1965 approximately 2.5 million nonsmokers have died from health problems caused by secondhand
smoke exposure.
Accordingto the CDC, e-cigarette aerosol (often called vapor) can contain harmful and potentially harmful
substances including nicotine, ultrafine particles, flavoring chemicals, VOCs, aldehydes and heavy metals.
What is considered smoking?
The MCIAA defines smoking as inhaling, exhaling, burning or carrying any lighted or heated cigar, cigarette, pipe or
any other lighted or heated product containing, made or derived from nicotine, tobacco, marijuana, or other plant
intended for inhalation. As of August 1, 2019, this definition includes carrying or using an activated electronic
delivery device.
What is the definition of 'indoor area"?
"IndoorArea" means a space between a floor and a ceiling that is at least half enclosed by walls, doorways or
windows (open or closed) around the perimeter. A wall includes retractable dividers, garage doors, plastic sheeting
or any other temporary or permanent physical barrier. A (standard) window screen is not a wall.
Where is smoking prohibited?
Smoking is prohibited in virtually all indoorpublic places and indoorplaces of employment, including:
• Bars, restaurants, and private clubs
• Office and industrial workspaces
• Retail stores
• Common areas of rental apartment buildings, hotels and motels
• Public transportation, includingtaxis
• Work vehicles, if more than one person is present
• Home offices with more than one on -site employees, or used as a place to meet or deal with customers —during
work hours
• Public and private schools, educational facilities
• Auditoriums, arenas, meeting rooms
• Day care premises
• Health care facilities and clinics
Where is smoking permitted?
The MCIAA does not prohibit smoking in the following locations or circumstances:
• Outdoor smoking, regardless of distance from building openings
• Private places, such as private homes, residences or automobiles when they are not being used as a place of
employment
• Sleeping rooms of hotels and motels
• Cabs of commercial motorvehicles that weigh over 26,000 pounds
• Family farm buildings, farm trucks and equipment, if certain conditions are met
• Patients of licensed residential healthcare facilities in designated separate, enclosed areas that meet applicable
regulations
• Patients in a locked psychiatric unit in a separated well -ventilated area, as approved by the treating physician
• Tobacco product shops -when customers are samplingtobacco products
• Approved scientific study participants
• Traditional Native American ceremonies
• Theatrical productions, that is, actors and actresses who are smoking as part of the theatrical performance
• Disabled Veterans Rest Camp in Washington County
What are the responsibilities of proprietors?
Employers and facility managers playa n important role in controlling smoking in their place of business. In general,
they are required to:
• Make reasonable efforts to prevent indoor smoking
• Post "no smoking" signs
• Ask person who smoke in prohibited areas to refrain from smoking and to leave if they refuse to do so
• Use lawful methods consistent with handling disorderly persons ortrespassers for any person who refuses to
comply after being asked to leave the premises.
• Refrain from providing ashtrays and other smoking equipment
• Refuse to serve noncompliant person
Is outdoor smoking or e-cigarette use addressed?
The MCIAA does not prohibit outdoor smoking orvaping, regardless of distance from building openings such as
doors and windows. Smoke or vapor drifting in from outside of a building is not covered by the MCIAA. Some cities
and counties have local ordinances that restrict smoking and vaping by entrances.
Compliance and enforcement
The Minnesota Department of Health (MDH) has compliance authority over the MCIAA and may delegate compliance
activities to local units of government. MDH, a local board of health or any affected person can request a court order
directing a repeat MCIAA violator to stop.
In addition, local law enforcement has the authority to issue petty misdemeanor citations to proprietors or
individuals who knowing fail to comply with the MCIAA.
Local government ordinances
Other governments retain the authority to adopt and enforce more stringent measures to protect individuals from
secondhand smoke. For example, the federal government prohibits smoking in certain housing.
Retaliation prohibited
An employer, manager or other person in charge cannot fire, refuse to hire, penalize, discriminate or retaliate
against an employee, applicant or customerwho exercises any right to a smoke -free environment provided under
the MCIAA.

Ordinance No. 24-850 — An Ordinance Related to Cannabis Regulations
The City Council hereby ordains:
123.01 City Registration Required
No person or business entity may sell at retail any cannabis product without having obtained a
registration approved by the City of Hutchinson.
123.02 Registration Procedure
The City of Hutchinson may issue or renew a cannabis registration if the following requirements
have been met by the applicant:
(1) the applicant has provided the city with a copy of a valid state license or written
notice of licensed preapproval from the Office of Cannabis Management;
(2) the applicant has completed a City of Hutchinson cannabis registration form;
(3) the applicant has paid any applicable initial registration and/or renewal fees as set
forth in the City of Hutchinson fee schedule
(4) the proposed retail location is located in an area of the city in which the city's land
use controls permit such activity.
123.03 Compliance Checks
The City of Hutchinson shall conduct at least one annual compliance check of all cannabis retail
businesses in the city to verify that the business is meeting age verification requirements as
required under Minnesota Statute § 342.22.
123.04 Hours of Operation and Sale
Cannabis businesses are limited to the retail sale of cannabis, cannabis flower, cannabis products,
lower potency have edibles, or hemp derived consumer products. The sale of such products is
permitted between the hours of 8:00 AM and 1.00 AM 10:00 PM Monda, through Saturday and
from 10:00 AM to 9:00 PM on Sunday.
123.05 Suspension of Registration
The City of Hutchinson may suspend a cannabis retail businesses registration if it violates this
ordinance or poses an immediate threat to the health or safety of the public. The City of
Hutchinson shall notify the cannabis retail business in writing as to the grounds for the
suspension. The suspension of the registration may be for up to 30 days unless otherwise directed
by the office of cannabis management.
123.06 Effect on Other Local Ordinances and State Laws
Nothing in this ordinance shall be deemed to supersede or limit the applicability and enforcement
of other city or county ordinances or state laws.

Dianne called the meeting to order.
Minutes from the August 26, 2024, meeting were reviewed and approved.
Old Business:
1. Summer Reading Summary:
a. Adult Reading Program: 61 logs were completed of the 91 distributed.
b. Summer Reading Program had 498 children participating. The prize wheel
and scratch offs were very popular. 60 Teens participated. 625 reading logs were returned.
223 bonus challenges were completed.
c. Quest for Knowledge Booklets: 34 children participated in reading NF books.
d. Stories in the Park: The 9 programs drew in a total of 908 participants.
2. September Programs Summary:
The two Story Times held so far, drew an average of 41 attendees; Lego Club
(15), Graphic Novels (5), Tween Gaming (7), Teen Gaming (4) and Coding (5).
3. Friends of the Library Book Sale:
The sale was very successful. 31 volunteers set out 180+ boxes of books on
tables donated by HCA, etc. Coffee was generously donated by Dunn Bros. The only expense
was recycling costs. The sale brought in $1850.25.
4. DNR Birding Programs:
September 28: Adults at 10:00 a.m. (HCVN will film). Children at 1:00 p.m.
5. October Felting Workshop: Suzanne Fairchild (A Legacy program)
October 17, 6-8 p.m. at The Depot. Registration is open. Ages 10+

Several switches will be made in the Teens, NF, Young Adult, and Adult areas.

Painting is in progress in the main level. There will be new carpeting and other
flooring throughout the library. A water issue in the lower -level storeroom is being addressed.
4. Joyce Young Watercolor Donation:
The family of LaVonne (Henke) Constans has donated a Joyce Young watercolor
to the library.
5. 3D Dinosaur Kits:
Tim Burley brought an example of the kits he is making. The Legion will sponsor
20 kits which will be made available during November (for "Di-No-Vember"), ages to be decided.
