UNFINISHED BUSINESS
9. APPROVE/DENY SECOND READING AND ADOPTION OF ORDINANCE NO. 23-840 — AN
ORDINANCE AMENDING CHAPTER 92 OF THE HUTCHINSON CITY CODE PERTAINING
TO WEEDS
John Paulson, Project/Environmental/Regulatory Manager, presented before the Council. Mr.
Paulson noted that no further comments or changes have been made to the ordinance since its first
reading at the last meeting. The primary changes made to the ordinance are due to legislative
changes made earlier this year.
Motion by May, second by Burley, to approve second reading and adoption of Ordinance No. 23-
840. Motion carried unanimously.
NEW BUSINESS
10. APPROVE/DENY PROPOSED VACATION LEAVE, EARNED SICK AND SAFE LEAVE AND
BEREAVEMENT LEAVE POLICIES
Kellie Wendland, Human Resources Director, presented before the Council. Ms. Wendland
explained that the proposed Earned Sick and Safe Leave is mandatory effective 1-1-24 by the state
legislature. This new policy will replace the City's current sick leave policy. The new policy is
more generous in a few areas, including ESSL to be used when a care provider is ill or when an
employee needs more time for bereavement. A benefits survey was put out to employees earlier
this year and the result of that survey was that a majority of city staff felt the vacation accrual
structure needed attention. Therefore, a new accrual structure is being proposed that staff feels will
positively affect employee morale and well-being. A couple of changes include providing all
regular full-time employees with a bank of 40 hours of vacation at time of hire and then continue to
accrue. The proposed adjusted vacation leave accrual schedule allows for more time to be accrued
based on years of service. In addition, bereavement leave was another benefit that many city staff
felt would be beneficial. Currently, employees must use sick leave and it is limited to only
immediate family as defined by law. The new policy will allow employees to take time for any
relationship they deem as significant.
Motion by May, second by Burley, to approve Vacation Leave, Earned Sick and Safe Leave and
Bereavement Leave Policies. Motion carried unanimously.
11. APPROVE/DENY RESOLUTION NO. 15646 — RESOLUTION UPDATING THE CITY'S ENDS

REVIEW OF COMMUNITY SURVEY RESULTS
MINUTES
TUESDAY, OCTOBER 24, 2023 - 4:00 PM
CITY CENTER — COUNCIL CHAMBERS
1. Call to Order
Mayor Forcier called the workshop to order at 4:00 p.m. Members present included Tim Burley,
Pat May, and Dave Sebesta. Member absent was Chad Czmowski. Others present were: Matt
Jaunich, City Administrator and other city directors.
REVIEW OF COMMUNITY SURVEY RESULTS
2. Community Survey Results
Matt Jaunich, City Administrator, presented before the Council. Mr. Jaunich noted that today's
workshop is to review the results of the community survey that was distributed this past Summer.
A third party administered the survey which was a collaboration between the National Research
Center at POLCO and the International City/County Management Association. This
benchmarking survey provides a comprehensive and accurate picture of livability and residents'
perspectives about local government services, policies and management. The survey captures
resident's opinions and the results are based on resident perceptions. The survey results also
describes areas where the community believes things are going well and sheds light on the areas
that could benefit from improvement. Mr. Jaunich also provided information about the National
Citizen Survey which measures livability which describes a community that is not simply
habitable but that is desirable and not only where people do live, but where they want to live.
The 10 facets of a livable community described by the NCS are safety, mobility, natural
environment, community design, utilities, economy, parks & recreation, education/arts/culture,
inclusivity/engagement and health & wellness. The survey also contained some custom
questions.
The survey takes into account that "great communities arc partnerships of the government, private
sector, community -based organizations and residents, all geographically connected". Again, the
survey captures resident's opinions on the community. There were 3000 surveys that went out
and of those 120 were returned. In the end, the results are the opinion of 761 residents.
Households were randomly selected and the survey has a margin of error of +/- 4%. The
response rate was 26% which was the lowest ever. The City has conducted the survey four times
(2007, 2011, 2015 and 2019). In addition to the direct surveys, 74 opt -in online surveys were
received. There was a demographic shift in survey respondents from past years with 71% being
55+, 59% being female and 80% owned a home.

RE: 2023 Assessments to Wurdell Property
MEMORANDUM
This memo outlines considerations for 2023 assessments on the Wurdell property for the mill and overlay
improvements on School Road NW as part of the 2023 Pavement Improvement Project. The 2023
assessments for the Wurdell property should be revised from $22,275 to $16,474.
The assessment value of $22,275 that was included on the final assessment roll was based on the fixed
cost method. This method of assessment was calculated based on 13 future lots having direct driveway
access to School Road NW. In 2004, when this segment of School Road NW was constructed, it was
determined that direct driveway access to this new segment of street would not be allowed. Recent
discussions with planning staff and further consideration by engineering staff, confirmed the 2004
decision to not allow direct driveway access to School Road NW. However, based on redevelopment
plans of the former golf course property adjacent to School Road NW and the fact that this parcel has no
other street access available, it was determined that a maximum of two access points would be allowed in
this segment of School Road NW.
School Road NW provides street access and a benefit to the adjacent Wurdell property, therefore special
assessments should be levied on the property for the 2023 improvements. The Area method of
assessments would be used to calculate assessments for the property. Based on a sketch plan submitted
to the City a potential of 16 twin home lots could be developed in the parcel east of School Road NW (see
attached). The sketch plan shows 6 lots that would be directly adjacent to School Rd NW. Access for
these lots would not be directly to School Rd NW, but there is a benefit to having two access points off
School Rd NW to develop these lots.
Assessment value based on lot area is calculated using a standard 66 ft x 132 ft City lot as basis for
computing a per square foot assessment rate.
Using the per foot assessment rate of $33.75/ft on a 66 ft front lot width, establishes an assessment value
that can be converted to square feet using on the standard lot depth of 132 feet. The calculation is as
follows:
66 ft frontage x $33.75 / ft = $2,227.50
66 ft x 132 ft = 8,712 sq ft
$2,227.50/8,712 sq ft = $0.26/ sq ft
Based on the sketch plan submitted, assessments would be levied for the 6 twin home lots that are
adjacent to School Rd NW. Lot dimensions of 80 ft x 132 ft would result in the following total area
calculation:
6 lots x 80 ft x 132 ft = 63,360 sq ft of total lot area.

Applying the per square foot assessment rate of $0.26/sq ft results in the following assessment:
63,360 sq ft x $0.26 / sq ft = $16,474
The assessments would be deferred until development occurs. The assessments would then be applied
on a square foot basis.

MEMORANDUM
RE: 2023 Assessments to Bullert Property (951 Golf Course Road NW)
This memo outlines considerations for 2023 assessments on the Bullert property for the mill and overlay
improvements on School Road NW as part of the 2023 Pavement Improvement Project. The 2023
assessments for the Bullert property should be revised from $13,365 to $0.
The assessment value of $13,365 that was included on the final assessment roll was based on the fixed
cost method. This method of assessment was calculated based on 6 future lots having direct driveway
access to School Road NW. In 2004, when this segment of School Road NW was constructed, the
Bullert's were notified that they would not have direct access to this new segment of street. Recent
discussions with planning staff and further consideration by engineering staff, confirmed the 2004
decision to not allow direct access to School Road NW. The Bullert property could be developed in the
future with access from Golf Course Road. Golf Course Road has lower traffic volumes than School Road
NW and is not a State Aid Collector route, making this access location a better option for future
development of the Bullert property.
The fixed cost method of assessment is based on providing direct access to School Road NW. This
methodology of assessment is not applicable without direct access to the street. Assessments have
previously been levied for improvements on Golf Course Road where future access would be extended
for developing the Bullert property.
A sketch plan showing one option for a lot layout on the Bullert property with access off Golf Course Road
is attached to this memo.

BACKGROUND/EXPLANATION OFAGENDA ITEM:
State regulations now provide the ability for cities/townships/schools to adopt a one-time
resolution to only require write-in candidates to have their votes tallied if the number of write-in
votes for the contest is greater than or equal to the fewest number of votes cast for a non -write-in
candidate. This will eliminate a lot of unnecessary counting of random write in votes (e.g.,
"Mickey Mouse" votes), when essentially those votes have already been overturned by the
results of the regular contest.

RESOLUTION ESTABLISHING CITY OF HUTCHINSON REGULATIONS RELATED TO
COUNTING OF WRITE-IN VOTES
WHEREAS, current voting regulations require election workers to count and tabulate each write
in vote under certain conditions; and
WHEREAS, counting of write-in votes is time consuming on election night and rarely, if ever,
results in a winning candidate; and
WHEREAS, recent legislative changes have provided cities/townships/schools with options for

BACKGROUND/EXPLANATION OFAGENDA ITEM:
The Public Works department is requesting replacement of a Plow Truck. The truck is scheduled
for replacement in 2024 but is being requested now to secure a 'build' slot. Missing the slot would
likely mean a truck in 2025 instead.
Staff received two quotes:
Western Star: $124,314.62
Mack: $134,709.58
Due to price and availability of Mack (24-30 month lead time), staff is recommending the Western
Star. A future request will be made to complete the Truck Body and Plow assembly once the
Chassis is complete.

BACKGROUND/EXPLANATION OFAGENDA ITEM:
PRCE Department is seeking approval to purchase a 2024 Toro 4000D Grounds Master Mower
for $89,551.98 under Government/State pricing. The purpose of this purchase is to replace the
current 2017 John Deere WAM (wide area mower) that has reached the end of its usable life
expectancy. Currently, PRCE has two Toro 4000D Grounds Masters in our current fleet. This
purchase would replace the John Deere WAM to align our fleet with another Toro 4000D
Grounds Master for ease of operations and maintenance. The mower is part of the Parks
Department's mower fleet, which mows over 500 acres on a weekly basis. If not replaced, the
mower will significantly reduce the amount of grass that can be cut in a week, resulting in
unmowed Parks, Athletic Fields, and other city -owned facilities.
The current mower is costing an average of $6k-8k in repairs, and its failing components are due
to the harsh environment it consistently operates in. Therefore, City of Hutchinson PRCE staff
have tested multiple mowers, including Jacobsen, John Deere, and Toro. After conducting a
1-day demo, they have concluded that the Toro 4000D is the best machine to fit the department
needs based on machine structure, dependability, and functionality for seasonal and full-time
staff.
BOARD ACTION REQUESTED:
City Council authorization to purchase 2024 Toro 4000D Grounds Master Mower.

BACKGROUND/EXPLANATION OFAGENDA ITEM:
The City received grant funding in 2023 from the MPCA for Stormwater, Wastewater, and
Community (SWC) Resilience Planning. The grant will be used to complete a hydrologic and
hydraulic (H&H) modeling of the City storm sewer system. The modeling will identify parts of the
system that have adequate drainage capacity as well as those that do not. The information will
be used to prioritize drainage improvements and to inform us of future system needs due to
changes in precipitation intensity and duration.
An important component of this effort is conducting outreach and engagement in the study area
using a web based mapping tool. Residents and businesses in the study area will be able to
click on a point and attach a comment along with a photo of past flooding.
The purpose of this is to collect input from residents about areas that have flooded in the past as
well as to calibrate the model with the information collected. The attached outreach documents
will be published in the Hutchinson Leader as well be posted to the City website and Facebook
page.
City staff will be available to answer any questions that you may have at the meeting.

November 14, 2023 — Council Selection
PURPOSE OF RFP
The Hutchinson City Council is accepting formal written proposals from licensed real estate
brokers and/or firms to sell property owned by the City. The properties to be sold are located at
44 Washington Avenue West (former Emergency Operations Center), 10 Franklin Street SW
(former Police Station), and 28 Franklin Street SW (parking lot south of Police Station) in
Hutchinson, MN. It is the intent of this RFP to have the successful broker/firm enter into a
professional services contract with the City to supply real estate brokerage services as outlined
within this RFP.
BACKROUND ON PROPERTIES
The City is looking to sell these properties due to the opening of new Police Station and the no
longer use of these properties for City operations_ All properties are located in downtown
Hutchinson and are currently zoned C-3 (Central Commercial). Allowed uses within this district
include, but are not limited to, that of trade and service -type businesses, retail stores, cultural
facilities, offices, restaurants, theaters and the like. Questions on specific uses, both allowed and
conditional, can be directed to the City's Building/Planning and Zoning Director, Dan Jochum at

BACKROUND ON PROPERTIES

longer use of these properties for City operations. All properties are located in downtown
Hutchinson and are currently zoned C-3 (Central Commercial). Allowed uses within this district
include, but are not limited to, that of trade and service -type businesses, retail stores, cultural
facilities, offices, restaurants, theaters and the like. Questions on specific uses, both allowed and
conditional, can be directed to the City's Building/Planning and Zoning Director, Dan Jochum at
d i ochum a,hutchinsommn. aov.

Proposal
Project Overview
The City of Hutchinson Minnesota (The City) has requested this proposal to sell 3 parcels of real
estate in Hutchinson Minnesota, (PID#s 23-050-0660, 23-050-0720 and 23-050-0740) after
moving Police operations to the new City facility in 2023.
Goal: It is the goal of Erika Kellen, Jim Fahey and Edina Realty, Inc. to sell for The City the subject
property using the traditional listing method after implementing a comprehensive marketing plan.
Objectives:
© To conduct the private treaty sales in a professional manner and to achieve the highest sale price
for our seller.
o To develop and implement an effective marketing plan, giving the property as much exposure as
possible.
o To professionally supervise the sale of the real estate with the least amount of disruption to the
operations of The City.
sales
REAL ESTATE: Edina Realty proposes completing a market analysis on each parcel of real estate
described within 15 days of the award of the contract. As a result of the market analysis, Edina
Realty will make a recommendation as to how the properties should be offered. For example
whether the bare land parcel should be sold separately or with the former police station.
With the information from the market analysis, The City and Edina Realty staff will explore moving
forward with the following options:
1. Place the real estate on the market for sale at an agreed asking price using traditional
private treaty methods by entering into a 6 month listing agreement.
Public
Edina Realty will facilitate all showings either personally or through normal Regional Multiple
Listing Service procedures.
I, COVER LETTER
Dear Mr. Jaunich;
Jim Fahey and Erika Kellen are honored to be able to make this proposal to the City of Hutchinson.
Although this proposal is laid out in specific terms to meet your request, if you feel there is
anything we have missed or anything we need to discuss or explore, please do not hesitate to
contact us immediately. We would be happy to meet with you and the appropriate City Staff and
Elected Officials at any time.
We believe that the traditional listing marketing is the best approach for the liquidation of these
City assets. Taking into consideration market conditions and the competition that your property
faces at this time, a properly managed listing and marketing plan can maximize return in the sale
of your assets in a timely manner.
Regarding the real estate pricing, the results of the market analysis and finding out more about
The City's goals and timeline for the project will help us advise you about the best approach to
take.
Working hard and doing the right things together will make the sale of these properties as good as
it can be. Our commitment to you is that if we are awarded this contract, we will work hard to
meet your goal of getting the property sold, while netting the taxpayers of Hutchinson as many
dollars as possible, providing quality service with the least amount of inconvenience and disruption
to the operations of The City.
Thank you for considering Edina Realty.
Respectfully,
James D. Fahey

4, Marketing Plan
REAL ESTATE: Edina Realty will be using traditional marketing methods including engaging
commercial and industrial groups such as the Regional Multiple Listing Service, Edina Realty
Commercial Group, Loopnet and MNCAR. We would also engage area Commercial Lenders, EDCs
_ and EDAs of all municipalities in McLeod County, Carver County, Sibley County and Renville
County. We request the marketing also be linked to The City News & Announcements section on
The City Website.
Signage will be placed on each property and brochures will be printed and provided to the
Hutchinson Area Chamber of Commerce and Visitors Bureau.
5. Additional Services
In the event of a prolonged marketing time without a sale, it may be advantages to the city to
explore a different method of marketing to create a sense of urgency. Jim Fahey and Erika Kellen
have extensive experience selling real estate at auction through a strategic partnership with Jeff
Martin Auctioneers, Inc. (JMA).
JMA is a nation-wide firm that purchased Fahey Sales, Auctioneers and Appraisers in August 2021.
This acquisition gave the multi -million -dollar company a presence in the Upper Midwest at the
former Fahey location in Glencoe. Jim and Erika have partnered with JMA in the sale of millions of
dollars of real estate at auction.
6. Cost Proposal
REAL ESTATE:
The real estate commission on the proposed parcels is 8% of the selling price.
In addition, The City will be responsible for all sellers' costs normal to a commercial real estate
transaction such as broker administrative commission, title commitment, state deed tax, document
preparation, etc. An estimated net sheet will be provided to The City at the time of the market
analysis.
MARKETING COSTS: Edina Realty shall be responsible for placing all electronic media and
newsprint advertising and signage. The cost of all said marketing shall be paid by Edina Realty.

To whom it may concern:
Hutchinson Properties LLC, (Tom Daggett and Jeff Haag partnership) have used the team of Jim
Fahey and Erika Kellen of Edina Realty to market the historic Jorgensen Hotel. While not an easy
property to market, they were diligent at promoting the property and ultimately finding the perfect
buyer that has the capability of completing the building to full capacity. They were accurate in
their valuation and got it sold for what they said they could. With several showings throughout the
period it took to sell the property, we received timely updates from them as to the level of interest
and likelihood of an offer. Jim and Erika are vested in the community and are most capable at
marketing commercial space in Hutchinson.

To Whom it may concern:
'I have known Jim Fahey for close to fifty years. My first encounter with him was as a young
auctioneer arriving to expand the Fahey brand.
His first question to me was how to get involved with the community and how to meet the town.
I've watched in awe as he built that business to a legend. He did this through untiring hard work,
commitment, dedication, and honesty to his clients. He applied these same principles to becoming
one of Hutchinson's strongest supporters. I can only guess as to the hundreds if not thousands of
hours this man has given to promote this passion. If it's good for Hutchinson he's there, heart and
soul. I am confident that he would do an amazing job in any task assigned or granted him. He's
one of a kind, make the most of his passion for Hutchinson!
Jim and Erika listed and sold my business when I retired and did a stellar job.
Sincerely,
Bob Elliott
s, conflicts of Interest
As disclosed in section 3 of this proposal, Jim Fahey and Erika Kellen are actively engaged in the
community of Hutchinson. We are separate principals in several properties involving a combination
of ownership and leasing of commercial space. We both sit on various boards and work with some
area non -profits. Both Jim and Erika have investigated the subject properties from a personal
investment standpoint and at this time have no interest in the properties involved. If this should
change during the marketing of the properties, full disclosure will be made to the City Attorney and
City Administrator. In collaboration the City will direct us in how to proceed.

4. NEW BUSINESS
A. ALTERNATIVE NATIVE LANDSCAPES
a. LEGISLATION PASSED EFFECTIVE JULY 1, 2023
b. ALTERNATIVE LANDSCAPES IN ROW
c. LANDSCAPE MANAGEMENT PLAN
John Paulson provided an overview of alternative landscaping concepts and what the
City allows. The City of Hutchinson currently allows property owners to utilize
alternative landscapes when they are being specifically managed for native prairie
landscapes. This alternative is considered on a case by case basis and only after in-
depth review and discussion with the landowner. Understanding the maintenance
needs for such a landscape is integral to the success of the area being converted but
also to prevent harboring of noxious weeds and to keep area from becoming
overgrown and causing a nuisance. Currently the City does not refer to this
alternative in City Code. A revision to the Code will be prepared to align with the
new legislation and existing alternative landscape guidance.
5. UNFINISHED BUSINESS
A. CLIMATE POLLUTION REDUCTION GRANT UPDATE
Mr. Paulson updated the board on the status of the Stormwater Resiliency Modeling
project underway. City staff is working with SEH to complete a agp analysis and fill
in any missing storm sewer system data that exists. Over the next month staff will be
collectingmissing GIS information necessar tprove the accuracy and outputs of
the storm sewer system model. Once the data gaps are filled then SEH will begin
building and running model projections with various rainfall inputs and intensitX
projections that reflect current and projected intensities. Work will also include
communityput gathering over the winter with project concluding in June 2023.
6. COMMUNICATION FROM STAFF
A. COMPOST IT RIGHT — THINK BEFORE YOU THROW
PRESENTED BY — AMPLIFY FOR CHANGE
An update of the Compost It Right program was provided remotely y Betsy Lipson,
Amplify for Change. Her presentation was an overview of the work done to date that
included citizen survey data and analysis of the level of contamination present. The
desired program outcomes were also discussed. Community engagement and user
education are fundamental items that will be improved with this project and should
serve as a roadmap for continuing those efforts into the future. It is apparent that
many people were not aware they were doing an. tag wrong. Continued education
about reducing contamination is a high priority. Discussion about maximizing
outreach effectiveness led to finding who community influencers are and finding a
way for them to help spread that message.
B. SWC CLIMATE RESILIENCY GRANT UPDATE
John Paulson updated the Board on the recently completed GIS data agp analysis and
the subsequent data collection efforts that are ongoing. The data gap collection
should conclude in September with an immediate transition into building the model
and beginning to run various model scenarios. There is also an opportunity for
information sharing and partnering with the UofM Saint Anthony Fall LaboratorX
while they conduct research on stormwater modeling calibrations and data input
accuracy. There was support to continue expoloring a partnership with the UofM on
the research.
